President’s Message Access to Care —

Where are we now? In the interest of keeping you all informed of the major activities of your elected representatives, Board of Directors and SDDS Delegates to the CDA House, I would like to bring you up to date regarding the Access to Care issue. In 2008, recognizing that a significant portion of Californians continue to experience barriers to oral health care, the CDA House of Delegates adopted Resolution 36S12008-H. This resolution directed CDA to undertake a comprehensive study aimed at improving access to dental care for the underserved population. Resolution 36S1 was referred to the Policy Development Council and two groups, the Access Workgroup and the Workforce Research and Forecasting Task Force were formed. Progress reports were made in 2009 and 2010 (Resolution 27-2009-H, Resolution 31-2010-H). Both groups engaged in indepth examinations of the issues, including review of existing literature, presentations by subject experts and independent research. The groups’ analysis of barriers to oral health care, the role of the dental profession and considerations for solutions produced the Access Report and the CDA Access Proposal: Phased Strategies for Reducing Barriers to Dental Care in California. To aid Delegates and interested members in understanding the problem, ask questions and get clarity of the presented information and the proposed solutions, Town Hall Meetings were held in various locations in Northern, Central and Southern California, at webinars and at CDA Presents. As part of the solution to treat the underserved, a study to determine the efficacy, safety and feasibility of creating a mid-level/non dentist provider was proposed. and the Special Session was held all day on March 3, 2012.

Before the vote to accept the filing of the report at the 2011 HOD, many caucuses were held. Discussions were many and diversified. Most everyone conceded that if the State Legislature "bus" was "leaving the station," and that dentists should at least be on the "bus" if not driving it. A majority of Delegates, 87%, voted in favor of the resolution to file the report. Filing the report did not mean all the recommendations in the report were accepted

A revised Resolution was passed by the Special Session HOD 2012 without much change from the one passed by the HOD in November 2011. According to many Delegates, however, this time everyone had the same information and the vote was more transparent. The vote was a lot closer. CDA will continue its support of SB694 with a clarified, defined workforce study. The resolution clarified that the midlevel provider studies will be carried out only at California universities and will be limited to RDAEF-2 and RDH licensed individuals who have received modular training on specified new duties. The study must focus on safety, quality, patient satisfaction and cost effectiveness of the care of children delivered in a public health setting under the direct, general and remote supervision of a dentist. The resolution also requires CDA, at the conclusion of the study, to analyze the results and take a position on any proposed changes to the Dental Practice Act only after presentation and approval by the CDA House of Delegates.

You can be very proud of our SDDS representatives, as they carried out their fiduciary responsibilities to CDA for our component members. by the CDA House. The House also adopted Resolution 2RC-2011-H, that the Access Proposal serve as a framework for CDA in addressing Access to Care Issues and that CDA pursue the strategy recommendations in phase 1 of the Access Proposal. In early January 2012, SB694/Padilla was quickly moving through the State process. Many CDA members became alarmed of the possibility that the proof of efficacy, safety and feasibility process would be minimized and that undertrained mid-level providers would be doing our job on the most vulnerable people in our communities — THE CHILDREN — sooner rather than later. This caused much unrest and uncertainty among CDA Members and Delegates. Many Delegates called for a Special Session of the House to be convened by CDA Leadership, bringing everyone together for better clarification and understanding. More than the required votes to call a Special Session of the HOD were sent to CDA Leadership

So far no one has shown how expanding the dental work force by adding mid-level/nondentist providers to do irreversible dental procedures will solve the access problem. If there is a better way we must find it. You can be very proud of our SDDS representatives, as they carried out their fiduciary responsibilities to CDA for our component members. They were all present and were exemplary in their performance. In my view, dentists are some of the most caring, giving people on the planet. We all must own this problem of helping the underserved. We are doing a lot now. Thanks to all of you SDDS members we do well over one million dollars in pro bono dentistry every year for the underserved. From the Editor’s desk International Dentistry & Dental Tourism Those of us who have had a chance to travel extensively, and see firsthand what dentistry is like in foreign countries, have come to realize rather quickly that the dental world around us is rapidly changing. We have always had an air of superiority along with a handful of other industrialized nations as to providing excellent dental care for our patients. For the most part, Western Europe, Australia, New Zealand, Canada, Singapore, Israel and the Arab Emirates among others, have very good reputations for providing state of the art dentistry. Other countries are rapidly developing their educational systems and are definitely upping the ante. One look at the journals these days tells you that a large number of research and clinical articles originate from a diverse number of countries across the globe. Educators and clinicians in countries that 10 or 15 years ago would have never submitted articles to peer reviewed journals are now commonplace. International conferences, global networking and the internet in particular have all raised the bar professionally for those willing to learn. Graduate students from all over the globe flock to our shores to enter specialty programs in multiple dental and medical specialties. This has its good point, in that we provide educational nourishment to many areas of the world. On the other hand, it does compete with available space for those

American dentists who desire to enter a specialty or attain additional education. It has been my experience in every country I have visited as a lecturer that the level of clinical excellence can vary a great deal,

In contrast, third world countries have a very small percentage of dentists who provide a level of treatment that we would consider superior. A common denominator always seems to be related to economics. If you have the means, you can and will obtain the best that dentistry can provide, be it in Bangladesh or Peoria, Illinois. To some extent, in the U.S. it is getting to be no different. The recession or depression, whichever you choose to call it, has had an impact on our dental population. Loss of employment, loss of benefits and erosion of the financial nest egg has led to more of our patients looking to obtain more affordable dentistry elsewhere.

One such enticement is dental tourism. Medical and dental tourism is not new. However, according to the tourism industry, it is on the increase globally, not only in the U.S. but in other highly industrialized countries as well. Fly to Malaysia for a week vacation and, while there, get a tummy tuck, a face lift, breast implants and, of course, full mouth restoration with dental implants at a pittance of what it costs in your own country. Enjoy the beauty of our land while we enhance the beauty of your body. Given the same level of treatment (or is it?), using the same dental materials, why is it so much less expensive in other parts of the world? From a local perspective, two blatant reasons come to my mind immediately. Excessive regulations and rampant bureaucracy. For example, I just purchased a new x-ray unit and before it was out of the box, I received a registration form from a state “regulatory” agency, asking for money. The cost of doing business and providing services in California and the U.S. is excessive. Those of you in practice only know that too well. Naturally, other factors such as high labor cost, taxes and the cost of living all play a significant role. Given that the medical and dental services available outside of the U.S. are continuing to improve and our own economic situation continues to decline, dental tourism will continue to be a growing industry. 



Dental Tourism Dental Tourism: Subset of Medical Tourism that involves individuals seeking dental care outside of their local healthcare systems, often accompanied by vacation time. Where do the patients come from and where do they go to obtain treatment? There is scant information available on dental tourism from the United States to other countries. There are no experts on the subject. No database exists at the American Dental Association as to the number of patients leaving our borders to go elsewhere and obtain dental treatment. Perhaps, even more importantly, there is no ADA-maintained database that dentists across the nation

Maybe there is no issue with the dentistry they received abroad and it’s really a non-entity! However, as many of you will agree, that is not the whole story. Unfortunately, in order to get a clearer indication of what is occurring, you have to rely on information gathered from other countries’ experiences. PubMed offered several informative papers regarding dental and medical tourism. Other sources included searching the web for specific treatment destinations, websites, the printed media and personal (unbiased) anecdotal information. With that in mind, let’s investigate where patients come from and where they go for treatment. www.sdds.org

The greatest source of information comes from Europe. Essentially the European Union has open borders and there are minimal restrictions as to geographic relocation. There are also minimal licensure qualifications for the EU members, which allow dentists to apply to practice not only in all the countries of the EU but also within the greater EU zone of influence. The Association for Dental Education in Europe (ADEE) has made significant strides to establish quality assurance and evaluate and provide accreditation of EU dental schools. In the European sector for example, Austrians go to Hungary, Slovakians to Slovenia and the Irish to Hungary, Poland, Turkey and the Ukraine. Hungary appears to be a predominant destination for neighboring countries such as Germany, Czech Republic, Slovakia and Italy. Approximately 81% of the new patients in that area of Hungary come from tourism. Two of every 10 practices realize 40 to 100% of their income from dental tourism; and the numbers are increasing. One suburb of Budapest that 10 years ago had no dental tourism, today has over 150 dentists providing services. Another town, some 60 miles away, has about the same number of dentists doing the same thing. Now, larger, multi-disciplinary operations are moving into the region to take advantage of the one-way patient flow. Obviously the cost of doing business in Hungary (former Soviet block country) is less. The current economic issues in Europe, relative to the cost of goods and services, has resulted in closing the gap between the more affluent economies and the low-cost developing and marginal economies. There is now a greater marketing effort directed to UK and U.S. patients. For example, one large Hungarian clinic has opened its own tourism office in New York City. The depression, the fall of the U.S. dollar and, to some extent, 9-11 has dampened the interest of American patients.

Dental tourism is not for lower income unsophisticated patients. Those who have the financial means to avail themselves of optimal treatment in their local healthcare system also have the means to travel. Americans have traveled to India, Singapore, Venezuela and Brazil for major medical and plastic surgery. However, most patient traffic goes to Mexico, San Salvador and other Central American countries. If you go online, there are a plethora of websites enticing you to Tijuana, Juarez and other border towns. They advertise that when you walk across the border, a car and driver will meet you and drive you to the dental office. On completion of the dental treatment, they drive you back safe and sound. The narcotic wars have seriously impacted the border towns and they are no longer safe. The businesses have moved to more distant places such as Cabo, Puerto Vallarta and Mazatlan. Canada is also a focus for medical and dental tourism. There are approximately 25 tourism companies promoting travel to foreign countries in Canada. The core marketing message is that treatment is affordable, completed in a short time and of high quality (criteria were determined by the tourism companies themselves). Some promote specialty services such as organ transplants and dental only, with emphasis on implant treatment. Marketing is extensive through sophisticated web sites. Reasons for Dental Tourism. Cost is the foremost reason for seeking treatment outside the U.S. However, an analysis of what drives and motivates American patients, conducted by medical and dental travel agencies, indicates it’s often more than money. They claim it indicates that these individuals believe they have good consumer judgment, are “savvy,” in a social position to do it and that they demonstrate independent and libertarian ideal. This information is used in complex marketing efforts that essentially say the person is smart and cutting edge. continued on next page May 2012 | 7

Business Week, in a 2008 article written by Catherine Arnst, blames the lack of dental insurance as the reason why “Americans are flocking overseas for high-quality, low-cost dental care.” The article states that surveys estimate “as many as 30% of the population along the Texas side of the Rio Grand cross the border for cheaper dental services.” She notes that crowns in the U.S. range from $750 to $1000 in the U.S. and $150 in Mexico. They also seek less expensive options in Budapest, Prague and Bangkok. She tells of the “full mouth reconstruction” quoted at $60,000 in the States, completed for $19,000 in El Salvador, which not only met but exceeded the patient’s expectations. A July 2005 issue of USA Today relates the experience of a Federal Government “health educator,” who journeyed to Budapest for treatment after receiving a quote from her Washington DC dentist in the amount of $11,150 for an exam, a hygiene appointment, a RCT and 8 crowns. She spent 10 days in Hungary on “vacation,” paid $3,195 for the “same” dental treatment, with a total outlay of $4,300 that included hotel and air fare. Another patient in the same story claims that he paid

Along the same lines, the Sacramento Bee published an article by Carrie Peyton entitled “More Americans have surgery overseas to cut costs and hassles.” She also cites that rising health care costs and limited insurance drive “hundred of thousands of Americans” out of the country for care. There was no reference cited in the article that substantiates those numbers. Furthermore there is little data other than that about international organ transplants, and even less about the aspects of safety. The story recants two medical experiences and one dental experience where treatment was obtained in Tijuana, Mexico.

implant related, that would amount to $3500 per crown or pontic! If you added a few extra units, just in case, it still comes to $2800 per unit. That is more than twice my specialty fee for PFM or Zirconia restorations. In Mexico he paid $32,000 (which included travel and accommodations). I contacted the reporter and told her I was skeptical regarding the veracity of the expenses reported in her article but never received a response. A GP dentist stated in the article that the dentistry provided in Mexico was “really good; better than some of the dentistry I’ve seen in the U.S.” There is no doubt that adequate treatment can be obtained in some offices in Mexico. In my experience however, it’s been the exception and not the norm.

A Roseville patient is a “lifelong grinder,” who was quoted $80,000 for periodontal treatment and crowns on 20 teeth. Having been in practice in Roseville for 38 years, as a fixed and removable prosthodontist, I was stunned to see those numbers. Let’s just say that the periodontal surgical treatment was $2500 per quadrant ($10,000) for the entire mouth that would leave $70,000 for crown and bridge. Since nothing was mentioned as

deductable and co-pays are being considered. The example offered in the article is that a heart procedure that costs $100,000 in the U.S., costs 10–20% of that amount in private hospitals in Asia. Global Healthcare, a subsidiary of Blue Cross has signed with hospitals in Bangkok, Singapore, Turkey, Ireland, Costa Rica and, by now, India. The selected hospitals are approved by the Joint Commission International, which is a part of the same regulatory organization that accredits American hospitals. However, when mistakes are made, the hospitals are insulated since it’s very difficult to sue for malpractice in a foreign country. To underscore that the cost of treatment, be it medical or dental, is important. A published paper from Germany evaluated the preference of 1,368 patients by giving them four different treatment scenarios involving local treatment or tourism. The difference in the cost of a crown and an implant treated locally vs tourism was 80 Euro and 280 Euro respectively. 92% of the patients said that quality was an important factor. Yet one third said that “price” was the determining factor. Like it or not, we live in a global world. Cork University in Ireland asked 520 patients if they used the internet on a regular basis. One third of the participants did not use the internet regularly. One third of the 520 patients investigated their dental condition and possible solutions prior to treatment on line. And almost 40% of the sample visited tourism locations and indicated that they would consider using tourism. The article’s conclusion stated, “with the increased interest in traveling abroad for

dental treatment, guidance for patients and practitioners regarding the legal and ethical issues pertaining to dental tourism is critical.” It also indicates the power of the internet. Price and Quality The dramatic difference in dental fees from one geographic location to another is sometimes difficult to unravel. It is possible to compare specific procedures and sometimes the identical materials used. For example, the identical dental procedure using the same porcelain veneer made by a Swedish dental laboratory, when applied by an Australia dentist generates a fee of 2500 AUD and only 1200 AUD when applied in India. So the difference is not exclusively the material, although it can have an impact. There are a wide variety of dental laboratory services available in the U.S. as well as in other parts of the world. Not all are created equal nor do the fees charged reflect the difference in quality. The lay consumer does not know the difference between Chiclets and a properly fitting and contoured esthetic crown. As you well know, the difference comes down to the skill of the operator (what he believes his time is worth), the education of the clinician, the economic setting in which the dental treatment takes place, the fixed and variable overhead, which includes rent and staff salaries and benefits. Office rent in San Francisco and Manhattan are significantly greater ($30 to $40 per square foot) than those in Roseville, Mumbai and Budapest. The cost of living is also more expensive in those different locations and all those factors are determinants of the fee that is charged.

A German dentist that moved to Hungary states that in Germany most of the costs were due to high salaries and lab expense. In Hungary, he uses the same materials, pays his staff better than prevailing local wages and still makes a bigger profit since the cost of doing business there is considerably less and that is reflected in the lower fees. Government intrusion with excessive regulations, fees and taxes further adds to the burden of doing business. I seriously doubt that in Hungary, El Salvador or any other country, you have a drive by ADA lawyer that sues and then runs with the money. The cost of doing business is just not comparable. Consider the Credentials The popularity of implants and “esthetic” dentistry has given additional vigor to the dental tourism business. In Mexico, as elsewhere, there are different levels of education and expertise. Many dentists will have taken short courses and begin placing implants. The patient does not know what he is getting into. Checking out the credentials on the internet does not always give a clear indication as to the foreign dentist’s ability or qualifications. To the lay person they seem impressive, but to a fellow professional it’s readily apparent that it’s a dental meeting here and there and usually amounts to nothing but fluff. Healthcare Tourism, (www.healthcaretrip. org) a major resource in the tourism industry, sends patients to dental clinics that, according to them, duplicate U.S. standards. According to Dr. Stuart M. Hirsch, Associate Dean for International Programs and Development at New York University, School of Dentistry, NYU takes in 110 foreign dentists from 33 countries and trains them in advanced dental techniques every year. Inference is that they are directly associated with Healthcare Tourism. He states “there is no reason to assume the quality of care is any lower overseas.” In selected office settings that may apply, but certainly not in all. The ADA has no official position on dental tourism. ADA consumer advisor and Associate Professor at UCLA, Dr. Edmund Hewlett, states, “We tell people it is possible to get high-quality dental care in places other than the U.S., but they should be aware there are no international standards.” For the patient in the international market place, there is no protection. Global travel, especially to endemic areas for hepatitis A and B, require additional vaccinations and precautions. The most common risk factors abroad are casual sex with new partners, medical and dental care abroad and the adoption of children who are hepatitis B carriers.

Medical tourism has “awakened many ethical and legal issues,” such as malpractice, consumer protections, telemedicine, organ trafficking and alternative medical practices. It creates issues between the doctors at home and those abroad. It alters the doctor-patient relationship and some practitioners have declined treating patients who have issues created from medical–dental tourism.

Another ADA advisor, Dr. Matt Messina from Ohio, validated that the ADA does not have any records or database on tourism. He states that he is more concerned with long term follow-up and possible complications. The Negative Side of Medical and Dental Tourism Medical and dental tourism is sometimes advertised as an adventure where you have your procedure completed, relax in a five star hotel, have better service and get totally spoiled. It can be an adventure indeed, judging by some reports. In one German study, 60 patients who went outside of the country to obtain treatment were examined and it was found that 29 (48.3%) had clinically relevant findings that required reparative/corrective dentistry. The average cost to complete the reparative treatment amounted to 1,383 Euro. The Australian Dental Association cautions travelers that there is a lack of accountability, and that no regulations exist when problems arise outside the country. In the article they document five such cases where serious complications arose. Since there is a lack of independent inspection and evaluation for dental facilities offshore, compared to the medical that generally does have international hospital accreditation standards, there is no assurance that the facility adheres to stringent sterile technique. While speaking in India at a dental conference, I recall that one of the attendees approached me and asked if it would be alright to reuse a failed dental implant, retrieved from another patient, if he re-sterilized it. Consider all the others who did not ask! During the same trip, we visited a new state-of-the-art cardiology surgery center. It was magnificent, with all the latest technology available at the time. The appearance and spread of New Dehli metallo-beta-lactamase-1 (NDM-1), which has extreme resistance and “raises the specter of untreatable bacterial infections” is another factor to contend with. The concern is for the international traveler who seeks medical, dental and surgical care. A Belgian became the first death attributed to this antibioticresistant superbug that originated in South Asia. Since then, three Americans from California, Massachusetts and Illinois returned to the U.S. from India, infected with the virus. The superbug was first identified last year in a Swedish patient admitted to a hospital in India. It is found inside bacteria containing the New Delhi metallo-lactamase-1 (NDM1) gene. On Dec 21, 2011 another report said that 94 patients died in Kolkata Hospital in India, raising serious questions regarding India medical tourism. The Herald Sun, in 2007, reported on botched plastic surgeries done in Thailand and Malaysia. The women were lured with attractive package deals promising full facelift and breast enlargement at a Malaysian hospital, costing upwards of $10,000. This is quite cheap and would have saved the patients thousands of dollars compared to local rates. The Australian Society for Plastic Surgeons then completed a national survey to determine how often local surgeons were seeing botched operations. By geographic region, Perth reported 66, New South Wales 35 women, and Victoria 14, for a total of 115 patients. The down side is that treatment is a long distance. What if you experience the inevitable complication when you return home? Jump back on the plane and the awesome savings are history. The experiences reported in the news media are often glamorous, with unbelievable financial savings. However, it does not always work out that way and there are serious risks involved. The risk of infection is real and should be taken seriously. Traveling to high risk geographic areas exposes you when you are at your most vulnerable state. Costs are not always what they seem either. Patients don’t know what they are getting. Is it a PFM with noble metal or non precious, is the crown made in China, is the post a paper clip or a real cast post? Dr. Hirsch from NYU “assumes” that there is no difference in the quality of care, but I have seen, as I am sure you have as well, that many times there are significant differences. Patients are also vulnerable to scams involving travel and hotel accommodations, making it another area for vigilance. A serious negative is quite often that you don’t understand your physician or dentist, since he or she speaks broken, barely discernible English. Communication is often difficult enough when you speak the same language and adding that extra barrier takes it to another level. In the end, people need to do what they feel comfortable with. The old adage, “let the buyer beware” certainly does apply to medical and dental tourism. 

The Sacramento District Dental Foundation sponsors events that are stimulating, rewarding and lots of fun. Let’s start with the fun! To raise funds for our charitable activities, we attend Broadway musicals (Million Dollar Quartet, Mamma Mia and Wicked) and sponsor a golf tournament at Turkey Creek on May 11. But the tremendous highlight of 2011 was The Gala, the best party of the year. Dr. Wes Yee and his committee, Cathy, and all the SDDS staff spent countless hours collecting donations, planning entertainment and creating an extremely exciting evening for all of us. It was a spectacular achievement for SDDS and SDDF. 450 people attended and raised nearly $100,000. People from all over the Sacramento region were shown what SDDF does for the community. People left feeling both happy and impressed. Thanks to all of you who made this night so special! The programs of SDDF can also be extremely fun and rewarding. Our renowned Smiles for Kids (SFK) program screened over 35,000 children in 112 schools. The 93 screening volunteers found the kids were slightly healthier than at any previous screening. 71% had no observable caries compared to 67% the year before. Despite screening 9,000 more children than last year, fewer patients needed treatment through Smiles for Kids. On SFK treatment days, volunteers help families to apply for the Healthy Families program. That, together with all the treatment and prevention instruction provided each year, seems to be having a definite impact. About $950,000 of dental treatment was provided by 700 volunteers in 2011. Smiles for BIG Kids is the program that we want to highlight this year. Adults in dire financial need are screened and placed with dentists who volunteer to participate. The dentistry is done at no charge, but lab fees are paid by SDDF or donated by the labs. 44 patients were completed in 2011 with $91,300 donated by docs and $5800 by labs. Dentists donated an additional $52,000 to SDDF in 2011, $27,000 of that total through Crowns for Kids. Membership in the Foundation, at $75 per year, grew to 312 in 2011. Our goal is to have every SDDS member be a member of SDDF as well. Dental spouses, staff, vendors and friends are also encouraged to join. SDDF partners with other organizations to improve oral health. We agreed to cover lab expenses for The Gathering Inn, helping them to deliver $85,000 in dental care. We recruited volunteers for the RAM clinic that provided $1,346,000 in services at Cal Expo. SDDF will also assist CDA Cares and Missions of Mercy (MOM) on May 18–19 in Modesto and Aug 24–25 at Cal Expo. MOM is a two-day dental only event, which is extremely well organized. Please volunteer for any of the charitable events mentioned in this report. You will be well rewarded for you service and extremely thankful that you are not in the position of those receiving the care. 

Increasing Delta Issues

& an appeal to our members As with other major dental plans in California, CDA has a designated liaison with Delta Dental to assist in addressing problems that member dentists are experiencing. This liaison arrangement works best on a case-by-case basis when a dentist is inquiring about a specific payment dispute and the normal lines of communication with Delta aren’t resulting in a resolution. Since January, CDA has experienced an increasing volume of inquiries about issues with Delta’s claims adjudication system. These are more than individual claim issues as they are issues that potentially affect hundreds or thousands of dental practices and the claims they are submitting to Delta. We’ve heard, for example: Delta is failing to properly process and pay secondary dental claims when the plan is both primary and secondary for a patient (they have opted to pay both claims as if they are primary, and then go back and offset future claims to retrieve overpayments on the secondary claim payment); claims submitted by long-term providers in Delta’s provider network where the plan’s system erroneously recognizes the provider as non-contracted, resulting in payment errors; claims sent to dentists at previous addresses where the dental practice used to be located; claims sent to the wrong dentist; pre-authorized treatment not being recognized by the system as pre-authorized, causing processing delays; improper capping of fees on procedures the plan doesn’t cover and consequently doesn’t pay for; the automated system for confirming patients’ eligibility of coverage not being able to recognize the patient in the system because the plan’s new system has assigned new identification numbers to enrollees; a case where weeks of claims not paid because the system is reading an “incorrect” tax identification number for the dentist, in spite of the fact that the dentist submitted the new tax ID weeks previously, including faxing that number to Delta twice in addition to the formal notice of the change. 22 | The Nugget

The list goes on, as these are just a few of the problems that have been occurring. As members have brought their issues to the CDA Practice Support Center, we’ve submitting them individually to our designated liaison with Delta. But the volume of the issues we’ve received has been so large that trying to address them on a case-by-case basis with Delta has been nearly overwhelming. Last month, CDA wrote to Delta’s Dental Director over claims adjudication and provider relations, describing the Delta system-related problems we’re hearing from members. We asked for a response to the specific issues we raised in the letter, for information on what Delta is seeing as problems, and how they are working to correct those problems so that we might accurately report back to our members, and expedite problems members are experiencing. In response, Delta assured us that the problems we cited are known to them, that they are working to correct their system, and that they would shortly respond to each of the issues we raised in our letter. We were asked to be patient while Delta works on these issues. Our view is that we and our members have shown enough patience. The problems have been occurring since late last year. We’re now into the third month of 2012 and the problems show no indication of either being resolved or diminishing. CDA had an initial conversation with representatives of the Department of Managed Health Care about the system problems at Delta. Our belief is that unresolved system difficulties are resulting in noncompliance with various aspects of the Knox-Keene Act under which Delta operates. DMHC asked CDA provide a summary of the issues we are hearing from dentists, including the correspondence we’ve had with Delta, and copies of formal appeals either members or CDA has submitted to Delta on behalf of members.

issues to raise with Delta is to hear from dentists who have filed formal complaints and appeals with Delta. CDA has urged dentists calling about their Delta-related issues to communicate their concerns to DMHC through the department’s toll-free provider complaint number (877-525-1295). DMHC told us that when receiving a call from a dentist about their issues, dentists have been directed to send a summary of their issue to the provider complaint unit’s email address (pcu@dmhc.ca.gov). We are working with our contact at Delta to resolve individual payment problems. And we will shortly be submitting what dentists are experiencing to the Department of Managed Health Care, which will help the department determine course of action it might take to assure that these issues are resolved quickly. But in addition… If you have experienced problems and delays in receiving payments from Delta which stem from system issues, CDA wants to hear from you, but please take the time to summarize your issue, or as many issues you are having, and send them to DMHC at pcu@dmhc.ca.gov. DMHC is tasked with protecting consumers, including providers, when dealing with health care service plans. Hearing from you is important to the department. You can help us to help you by communicating the issues you’re having to both CDA and to DMHC at the email address given. We desire that every dentist who has contacted CDA about their recent problems to also communicate those issues to DMHC. Please take the time to submit your comments and issues to the department. This will help bring these issues to a quick resolution. 

Pregnancy

You are a dentist. You’ve been to school, taken your Boards and settled into practice. End of story? Not quite. Employee evaluations, hiring and firing, labor laws and personnel files are an important part of being an employer. Are you up on the changes that happen nearly EVERY January 1st? In this monthly column, we will offer information pertinent to you, the dentist as the employer.

Disability Leave From California Employers Association (CEA) For companies with five or more employees in the current or preceding year, your employees are entitled to Pregnancy Disability Leave (PDL). There is no length of service requirement before an employee disabled by pregnancy is entitled to PDL. The time is unpaid, and can be taken whenever a woman’s doctor certifies that she is disabled during the pregnancy or after the delivery. The PDL is for any period(s) of actual disability caused by pregnancy, childbirth or related medical conditions up to four months (or 88 work days for a full-time employee) per pregnancy. The time off can be taken all at once or any time throughout and after the pregnancy for morning sickness, prenatal visits, recovery, etc. An employee is affected by pregnancy or a related medical condition, with supported documentation of a medical practitioner, may request reasonable accommodation transfer to a less strenuous or hazardous position or duties. An employer may require medical certification only if medical certification is required for other types of disability leave. Certification should include the date on which the employee become disabled due to pregnancy, the date of the medical advisability for the transfer or reasonable accommodation, probable duration of the period(s) of disability, transfer or accommodation. A statement should also include that, due to the disability, the employee is unable to perform one or more of the essential functions of her position without undue risk to the employee, the successful completion of the pregnancy or to other persons. The statement may also say that, due to the pregnancy, transfer or reasonable accommodation is medically advisable. Employers must post a notice regarding PDL rights and have a PDL policy in the company’s employee handbook. 26 | The Nugget

During PDL, an employer can require use of sick time, but vacation or PTO benefits can only be used at the employee’s request. All women disabled by pregnancy are entitled to State Disability Insurance (SDI) to the same extent as for all other disabilities. Generally SDI will pay for four weeks before delivery and six to eight weeks after delivery. If the employer provides more than four months of leave for other types of temporary disabilities, the same must be made available to women disabled due to pregnancy, childbirth, or a related medical condition. Leave may be taken before or after birth, during any period of time the woman is physically unable to work because of pregnancy or a pregnancyrelated condition. A woman returning from PDL must be placed in the same or a comparable position as before leave. Terminate employment for an employee who does not return to work after taking PDL may generally occur, unless a policy exists granting longer leave for other disabilities. Employers with 50 or more employees must grant employees PDL, Family Medical Leave (FMLA) and California Family Rights (CFRA). FMLA can run concurrently with PDL, meaning a pregnant woman can take up to four months of PDL, the first 12 weeks of which are also counted as FMLA, as long as the employee is notified that her PDL is considered FMLA. CFRA regulations do not consider pregnancy a serious health condition and do not allow an employee to take family leave for pregnancy related disability, so it cannot run concurrent with PDL. However, CFRA can be used for ‘baby bonding” time after the pregnancy. Employees are only eligible for FMLA and CFRA if they have worked 1250 hours during the 12 months immediately before the first day of FMLA leave, not the first day of CFRA leave.

Maximum combined PDL and family leave is about seven months (four months plus 12 workweeks). An employee can only take the maximum when she is actually disabled by pregnancy for four full months, and then immediately takes 12 weeks of baby bonding family leave. 

BRINKER MEAL & REST PERIOD CASE The California Supreme Court decision in the Brinker case upheld the Appellate Court’s ruling that an employer is not required to “ensure” a meal period is taken. “We conclude that under Wage Order No. 5 and Labor Code section 512, subdivision (a), an employer must relieve the employee of all duty for the designated period, but need not ensure that the employee does no work.” “We conclude that, absent waiver, section 512 requires a first meal period no later than the end of an employee’s fifth hour of work, and a second meal period no later than the end of an employee’s tenth hour of work. We conclude further that . . . Wage Order No. 5 does not impose additional timing requirements.” “The employer that relinquishes control but nonetheless knows or has reason to know that the employee is performing work during the meal period, has not violated its meal period obligations [and owes no premium pay], but nonetheless owes regular compensation to its employees for time worked.” (Emphasis added) There is a lot of discussion on whether or not class certification should be granted, but the most important for employers was this issue of meal breaks. Doug had a wonderful relationship with each one of his patients. He was more than their dentist. He was their friend. One of his patients wrote me a card when she heard of Doug’s passing. She recalled a conversation with Doug when she stopped wearing her night guard due to breast cancer. Doug would say, “You are just ruining your teeth. Just because you had cancer, are you going to quit your job and take drugs?” This talk with Doug helped her snap out of her doldrums. In 1999, Doug was appointed by Governor Wilson and served on the Committee on Dental Auxiliaries. Many of you know Doug professionally, but he was so much more than a dentist. Doug loved his family, enjoyed boating, golf, travel, community service and history. He especially enjoyed playing the SDDS Golf Tournament, because it was a scramble format and he didn’t have to play full round. He loved his boats and cruised out to his favorite fishing hole in the Delta. There he would read the paper, drink coffee and catch a few stripers. Although Doug and Karun have traveled around the world on cruises, they did join my wife and I on a couple of road trips to Europe. We had a blast driving around the countryside and often getting lost. Doug was an historian and especially knowledgeable on Chinese American History. For over 10 years Doug fundraised and then published the book Canton Footprints, a critically acclaimed book on Chinese history in Sacramento. He also coordinated the living history each Labor Day weekend in Old Sacramento for Gold Rush Days. For all his efforts he was awarded the KVIE Volunteer of the Year Award in 2006. He also served on over 20 community boards. Doug served as the president of our Yee Family Partnership and had our complete respect. Doug and his wife Karun looked after our parents with tender loving care. Most of all, he was a wonderful husband to Karun, attentive father to Darrun, Julia, Dean, Debra, and grandfather to little Jake. We would talk or meet a couple times a week to discuss family, community service events or plan a golf game.

Doug lived a full life, albeit too short of one. He practiced dentistry for 35 years in the city where he grew up. He was good in all facets of dentistry and was especially adept at oral surgery. During his third year at Loma Linda Dental School, he went to Honduras and extracted 600 teeth in two weeks.
