TURKS AND CAICOS ISLANDS A PROPOSAL FOR A

BILL FOR AN ORDINANCE TO AMEND THE NATIONAL HEALTH INSURANCE ORDINANCE; AND FOR CONNECTED PURPOSES.

ENACTED by the Legislature of the Turks and Caicos Islands.

Short title and commencement 1. This Ordinance may be cited as the National Health Insurance (Amendment) Ordinance 2014 and shall come into operation on such day as the Governor may appoint by Notice published in the Gazette.

Section 37 amended 2. Section 37 of the National Health Insurance Ordinance is amended by repealing subsection (1) and substituting— “(1) Any person who fails to pay any contribution in respect of any period on the day on which payment is due shall be liable to pay an additional charge at the rate of three per cent of the outstanding contributions for each month or part thereof during which the contribution remains unpaid.”.

Application 3. The amendment effected by this Ordinance does not apply or extend to contribution due and payable before the commencement of this Ordinance.

EXPLANATORY MEMORANDUM This Bill seek to revise the additional charge levied on late payment of contributions to one that serves as a deterrent yet not overly excessive to persons who fall behind in payment of contributions.

To this end, this Bill seeks to lower the rate of additional charge from 10% to 3% for each month that contributions remain outstanding.

Clause 2 of the Bill, which seeks to amend section 37 of the Ordinance by substituting subsection (1), provides that a person who fails to pay any contribution when due shall be liable to pay an additional charge at the rate of 3% of the outstanding contributions for each month or part thereof during which the contribution remain unpaid.

Clause 3 of the Bill seeks to make it clear that the reduction in the rate of addition charges shall not apply to outstanding contributions owed prior to the date of commencement of the Ordinance.
