ROAD TRAFFIC (PUBLIC SERVICE VEHICLES) (AMENDMENT) REGULATIONS 2015

MADE by the Minister under Regulation 62 of the Road Traffic Ordinance.

Citation and commencement 1. These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Amendment) Regulations 2015 and shall come into operation on publication in the Gazette.

Interpretation 2. In these Regulations “principal Regulations” means the Road Traffic (Public Service Vehicles) Regulations.

Regulation 4 amended 3. Regulation 4 of the principal Regulations is amended— (a) in subregulation (1)— (i) by inserting immediately before the words “The Director” the words “Subject to subregulation (1A),’; and (ii) in paragraph (c) by deleting the words “and not older than 75 years of age”; and (b) by inserting after subregulation (1) the following subregulations— “(1A) Where a person is over 75 years of age, in addition to the conditions specified in subregulation (1), he shall submit together with his application a medical certificate that he has, in the previous three months, undergone medical examinations, including ophthalmologic, hearing and mental fitness tests, conducted by a medial practitioner registered in the Islands, and is certified as being fit to drive passengers for hire or reward.

(1B) Certification made under regulation (1A) shall be by a medical certificate in Forms RT 3 and RT 4 of Schedule 1A.”.

Regulation 26 amended 4. Regulation 26 of the principal Regulations is amended by inserting after subregulations (1), the following subregulations— “(1A)

Where a person applying for the renewal of his public service vehicle operator’s licence is over 75 years of age, he shall submit together with his application a medical certificate that he has, in the previous three months, undergone medical examinations, including ophthalmologic, hearing and mental fitness tests, conducted by a medical practitioner registered in the Islands, and is certified as being fit to drive passengers for hire or reward.

(1B) Certification made under subregulation (1A) shall be by a medical certificate in Forms RT 3 and RT 4 of Schedule 1A.”.

Schedule 1 5. Schedule 1 to the principal Regulations is amended in FORM RT 1, under the heading “Declaration”, by deleting the words “nor above the age of seventy-five (75) years.”.

Schedule 1A inserted 6. The principal Regulations are amended by inserting after Schedule 1, the following Schedule— “SCHEDULE 1A (Regulations 4 and 26) FORM RT 3 MEDICAL EXAMINATION REPORT VISION ASSESSMENT

Important information for doctors The standard of acuity of vision is considered unsatisfactory if it is below 6/12 with one eye and 6/36 with the other eye, with or without optical aid.

(vi) Does the applicant suffer from squint or any other visual defect which could affect his fitness to drive a motor vehicle? (vii) Could any visual defect observed be sufficiently corrected to make the applicant fit to drive a motor vehicle?

3. Are blood pressure readings – both systolic and diastolic normal, having regard to the applicant’s age? If not, do you consider that the abnormal blood pressure would be likely to affect his/her competence as public service vehicle driver?

4. Is there any defect of hearing? If so, do you consider that it would interfere with the efficient performance of the applicant’s duties as a public service vehicle driver?

5. Has the applicant any deformity of loss of limbs? If so, could it interfere with the efficient performance of his/her duties as a public service vehicle driver? (Note: special attention is directed to the condition of the arms, hands, legs and feet and particularly to the point of the upper and lower extremities) 6. EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations remove the upper age limit of seventy-five years for the grant of a public service vehicle operator’s licence.

Public service vehicle operator’s licences can now be issued or renewed annually without upper age limit. Where the applicant is over the age of seventy-five he must undergo medical examination and must submit together with his application a medical certificate certifying that his vision, hearing, body and mental fitness are such as to warrant the issue of a licence to drive passengers for hire or reward.
