Scientist confirms:

Yes, there’s fish off City shores

A marine biologist has confirmed there’s a lot of fish along the Dumaguete coastline, contrary to pronouncements of proponents of the 174-hectare reclamation project.

Dr. Aileen Maypa, a representative of the International Union for the Conservation of Nature and a researcher and adjunct professor at the Silliman University Institute of Environment & Marine Sciences, presented data gathered by a fellow scientist.

The study conducted by Dr. Rene Abesamis recorded 219 species of fish in barangay Bantayan alone.

Maypa said of these species, 84 percent of them are targeted by fisherfolk.

Maypa also presented data from the City Agriculture Office which recorded the fishcatch from the Dumaguete shoreline in 2018 at more than 40,000 metric tons.

In another study done in 2019, Dumaguete fisherfolk data revealed they harvested a total of 28.7 metric tons from the City’s waters, mostly “second class” fish like Ihalason, Tulingan, Manolsog, and Tamarong.

“And this was even understated because some fishermen thought they would be taxed if they reveal a huge catch,” Maypa said.

“There is fish in the Dumaguete coast. Over the years, it’s been slightly declining but the data recording efforts could be affected by the pandemic,” she said.

She said that last month, she went with fishers who laid down their fish trap, locally known as bobo, just about 30 meters from the shore in Piapi. to page 2

SP voids Ipe’s power to sign recla MOU

The Dumaguete City Council, in a special session Friday, has withdrawn the authority it had issued to Mayor Felipe Antonio Remollo in July to sign a Memorandum of Understanding with EM Cuerpo Inc., the proponent of the controversial 174-hectare reclamation project.

The move came barely a few hours after the City Council received a request from the Mayor in a letter dated Sept. 8.

The Mayor said he decided to withdraw the request for authority to sign the MOU “after a careful consideration and in-depth study of the factual circumstances and legal ratifications”.

He said he has decided to defer the signing of the Notice of Award to EM Cuerpo as winning bidder of the Swiss challenge for the ‘smart city’ project until and after the governing board of the Philippine Reclamation Authority shall have reviewed and passed upon the entire biding process conducted by the PPP Selection Committee, so as not to preempt any

action or decision on the matter by the PRA. Remollo, however, said the City may still pursue its applications for pertinent permits with the PRA and the Department of Environment & Natural Resources relative to the ‘smart city’ project “at the proper time”.

The request of Remollo was made after the City Council received a letter from Atty. Janilo Rubiato, PRA general manager, to City Vice Mayor Karissa Faye Tolentino-Maxino dated Sept. 7.

In that letter, Rubiato clarified several points raised

by Councilors Rosel Erames, Agustin Miguel Perdices, Joe Kenneth Arbas, and Bernice Anne Elmaco in a letter they emailed Aug. 27, seeking confirmation of the statements made by PRA Assistant General Manager Atty. Joseph John Literal during a policy dialogue hosted by Oceana earlier last month.

Assistant GM Literal had mentioned that Dumaguete

City does not have a pending application for the reclamation project with the PRA; that PRA never received any request for review from Dumaguete for the Swiss challenge and for the terms of reference of the unsolicited proposal of EM Cuerpo, and that a prior clearance is needed from the PRA prior to the conduct of the Swiss challenge for reclamation projects.

All those points shared by lawyer Literal in the policy dialogue were confirmed by GM Rubiato in his letter to the City Council, who further said that under the law, all reclamation contracts shall go through public bidding, consistent with the government’s thrust to promote transparency and competitiveness.

Rubiato said that because of the competitive challenge, it is possible that other companies will get the project, and not necessarily the joint venture partner that the City has identified.

Yes....from p. 1 Studies over the past several years have shown there are 144 hectares of coral reefs along Dumaguete, 65 hectares of mixed coral and seagrass beds, and 219 species of fish, which altogether produce 34-40 metric tons of fish production annually.

“Dumaguete fisherfolk are highly dependent on coral reefs. Eighty percent of them do not have boats so they engage in gleaning (manginhas) or they walk along the shoreline, or swim in the sea in search of fish,” Maypa said.

She also shared that the ocean currents from the Pacific Ocean enters the Bohol Sea, which finds its way to the Dumaguete coasline. From the Dumaguete seas, the water goes south.

“The 174-hectare reclamation will, therefore, affect Apo Island.

Sediments from January to March, the time of the year when currents are strongest, settle as silt in Apo Island,” she warned.

Income generated through tourism activities at Apo Island, a 74-hectare volcanic island off the coast of Dauin town, earned P14 million in 2018 alone, she revealed.

Maypa, who also studied coral reef recovery and rehabilitation, said there is no mitigation technology that exists today that will mitigate the damage that will be caused by the 174- hectare reclamation.

“The A-I-R strategy of Mayor Remollo is not viable,” she said, referring to the Mayor’s assurance on national TV that he will either Avoid-IntegrateReplace corals that will be affected by the reclamation.

Maypa recommended that the City should instead focus on projects that encourage fishery enhancement for food security, and projects that help the marine sector.

“Pelagic fish, such as Anduhaw, which feed on plankton, also come to the reef. If the coral reef is destroyed, mature fish will disappear, and not lay eggs. Juveniles would also be lost. There will be no more fish to sustain the population,” she concluded.

Meanwhile, Nancy Ugsad-Estolloso, president of the People’s Development Council, addressed the Council to remind the Councilors of the law requiring committees to have members of the PDC, which represent the marginalized sector, sit as members.

She lamented the lack of consultation on the reclamation project, likening the PDC to a spurned wife.

The PDC has over 6,000 members from various organizations of the marginalized sector such as massage therapists, tricycle drivers, farmers, fisherfolk, waste pickers, and others.

“I think the government still intends to continue the project because of the phrase ‘without prejudice’ [in the Mayor’s letter to the Council]. But the PDC will

not support the 174-hectare reclamation because 1) it is illegal for lack of participation from the PDC and for not following the process; 2) it is contrary to the env ir onm e nt al agenda of PDC, and will damage the environment of Dumaguete; 3) it will affect the livelihood of the members of PDC; and 4) the lack of transparency [on details about the project] has caused fears of corruption.

Estolloso was, however, reminded by the Council that all decisions so far made about the 174-hectare reclamation project are still at the executive level and as such, no committee meetings have been conducted about it.

Another speaker was environmental advocate Leodegario Rosales, who reminded the Council about the defects of the reclamation of the Pantawan II, which are again finding their way into the proposed 174-hectare reclamation project.

Outlining similarities between the two projects, Rosales pointed to the various instances of misinformation surrounding the project, particularly the absence of an area clearance from the DENR for the total reclaimed area.

He challenged the City to find solutions to the pressing problems of Dumaguete such as drainage, and instead of pursuing a ‘smart city’, to pursue instead the idea of a smart community and the Metro Dumaguete concept.

Other speakers during Friday’s special session defended the reclamation project.

Jerome dela Cruz, kagawad of barangay Balugo, batted for citizens’ participation in the implementation of government programs and to give the fisherfolk a voice in society.

City marks Civil RE leader echoes Service anniversary IPCC ‘code red’

Officials and employees of the City government of Dumaguete joined the nationwide observance of the 121st Philippine Civil Service anniversary in simple rites as they reaffirmed their allegiance to the “highest ideals of public service” before Civil Service Commission-Negros Oriental Director Merlinda Flores-Quillano.

Mayor Felipe Antonio Remollo shared the efforts of his administration to enhance the delivery of basic social services, completion of major infrastructure projects, effective strategies to control COVID-19, and the professionalization of the public service.

He also discussed the goals of the proposed 174-hectare ‘smart city’ project that he said would sustain economic growth and provide job opportunities for the poor.

City Human Resource & Management officer Dinno Depositario said the Mayor has implemented initiatives to improve the recruitment, promotion, and merit system of LGU-Dumaguete to attract and retain competent and dedicated employees.

Since Mayor Remollo assumed office in 2016, the daily rate of the lowest paid Job Order worker was increased from P280day to P370 upto P440/day this year.

In the last five years, about 329 JO workers have been appointed to casual plantilla positions, while 15 casuals have been appointed to regular positions.

The City government appropriated P367.4 million in the annual budget and supplemental appropriations of P31.6 million to grant all salary increases and benefits due for casual and regular employees.

The administration has also conducted several mandatory surprise drug testing for all officials and employees to maintain a drugs-free workplace.

The Civil Service Commission had introduced a 10-year overarching theme, Transforming Public Service in the Next Decade: Honing Agile and Future-Ready Servant-Heroes, that reflects the path civil service has to take to build on the gains of last year’s modernization efforts. (PIO)

Tomawis, president of the Negros Oriental Muslim Association, said there are some people who oppose the 174-hectare reclamation with no logical reasoning. He urged the public not to prematurely judge the project. He said the PRA and the DENR should decide on the future of the project.

Tomawis heaped praise on Remollo, saying the

Mayor deserves to be loved, respected, and obeyed. He said the opposition is doing something to misguide the people to destroy the good mission and vision of ‘Lupad Dumaguete’ in carrying out the vision of the 174-hectare reclamation.

He challenged oppositors to a debate on the issue.

A third speaker to

defend the reclamation project was Imam Abdulmaula Muhsin of the Muslim community, who said they were enlightened by the project through the Mayor’s information drive.

He said he understands there will be those opposed to the project but that as Muslims, they support the proposed reclamation because it is for the development of the City.

Unless there are immediate, rapid, and large-scale reductions in greenhouse gas emissions, limiting global warming within 1.5 to 2 degrees Celsius will be beyond reach.

This is the alarm sounded by Richard Tantoco, president and chief operating officer of Energy Development Corp., in a Zoominar organized by the Ecumenical Initiative Forum, a gathering of faith-based organizations serious about climate change issues guided by the landmark Laudato Si encyclical of Pope Francis.

Dubbed Climate Change: The Greatest Crisis of our Time, the digital meet brought together stakeholders from the business sector, civil society, academe, and the Catholic Church led by the Focolare Movement Philippines, Season of Creation Pilipinas, and the National Laudato Si Program organized by the Catholic Bishops Conference of the Philippines.

“Contrary to what a lot of us may think, the COVID-19 pandemic is not our greatest problem. Even when we get out of this pandemic, the biggest crisis of our time remains, and that’s climate change,” said Tantoco of the First Gen-owned renewable energy leader, who was keynote speaker.

Tantoco bared the findings of the latest assessment report from the UN Inter-governmental Panel on Climate Change issued in August. The sixth in a series of periodic reports put out since 1990, it is the most daunting and alarming to date, pointing to “irreversible consequences” of climate change if no drastic action is taken to decarbonize the atmosphere.

Among the facts cited by the IPCC report was that human activities have unequivocally warmed the oceans, land and atmosphere, when it was merely deemed a possibility eight years ago.

The report also confirmed the scale of the recent climate system changes as “unprecedented in a period of thousands of years of the Earth’s existence”.

“Global surface temperatures will continue to increase at least until 2050,” explained Tantoco.

In terms of exceeding the limit of global temperature increase of the 2015 UN Climate Change Conference of the Parties (COP 21), “under most scenarios, crossing 1.5 degrees will happen in the early 2030s. [But] in the absence of deep carbon cuts, two degrees will be exceeded during this century.”

Tantoco outlined practical steps that nations and enterprises can take such as accelerating the pursuit of renewable energy in powering not just homes and industries but transportation as well, coupled with “green” investing, and an unequivocal rejection of fossilbased fuels such as coal.

Forest cover rehabilitation and regeneration is also critical, Tantoco said.

For communities, resilience against extreme weather disturbances needs to be of utmost priority for local government units. For families and individuals, “simple but impactful” lifestyle practices such as conservation of natural resources and decreased material consumerism will continue to be a big help, Tantoco said.

“While we can no longer undo the environmental mistakes that humanity has made in the past, it is up to all of us to do something to prevent them from happening again—to be a part of the solution to the greatest crisis of our time,” concluded Tantoco.

Clergy holds Penitential walk versus EJK, COVID, 174-hectare reclamation

Despite the rain and the gloomy weather, the clergy of the Diocese of Dumaguete held Monday a penitential walk for the protection of life and the environment.

Bishop Julito Cortes led the penitents in praying for the victims of extrajudicial killings and the Covid-19 pandemic.

They also offered the penitential walk from the Redemptorist Church to the Dumaguete Cathedral for the scrapping of the controversial 174-hectare reclamation project in the city.

It was supposedly for the clergy and the religious but several laypeople joined the solemn activity along the way.

Following health

protocols, the penitents made a symbolic stop, lining themselves along the iconic Dumaguete Boulevard where they recited A Prayer for Our Earth, taken from Pope Francis’ encyclical, Laudato Si’.

Bishop Cortes entrusted their petition against the P23-billion reclamation project through the intercession of the Our Lady of the Miraculous Medal, as the Church commemorates her nativity on Sept. 8.

The Bishop said the Church has just entered the “Season of Creation” where Pope Francis reminded the world how people had become “remiss” with God and each other. “(We have become) remiss in our relationship with each other because

of different forms of selfishness and corruption.

Remiss in our relationship with the earth because of our greed,” Cortes said.

The Prelate also reiterated the Church’s appeal to dialogue with Dumaguete City Mayor Felipe Remollo.

In March of this year, Bishop Cortes said they forwarded to Remollo’s office and the City Council a document detailing why they should stop reclaiming its shoreline.

“What I hoped was he (Remollo) would acknowledge it, and invite us to explain himself. Since then, there have been none,” he said. “In professional communication, when you [are] sent something, you respond.” (CBCP)

PDLs Crime dips enlist for amid quarantine elections

Persons Deprived of Liberty (PDLs) will be allowed to vote during the May 9, 2022 elections but only within the jail premises on the same day and under the supervision of a special board of election inspectors.

Lawyer Ian Macaraya, election officer of Dumaguete and spokesperson of the Commission on Elections in Negros Oriental, said on Wednesday the PDLs who are eligible to vote are getting registered during satellite activities at the different detention facilities.

Records at the city Comelec office show that 11 female PDLs were registered on Wednesday at the Bureau of Jail Management & Penology’s Dumaguete City Detention & Rehabilitation Center in barangay Bajumpandan.

The crime volume in Negros Oriental has dropped as of August this year compared to last year despite the lesser quarantine restrictions amid the coronavirus disease 2019 pandemic.

Maj. Don Richmon Conag, acting provincial police operations officer of the Negros Oriental Provincial Police Office, in an interview Friday, said the total crime volume from Jan. 1 to Aug. 31 this year is at 4,087.

This is less than 604 crime incidents compared to last year for the same period at 4,691, he said.

Conag attributed the decline to increased police visibility, interventions, and other operations, as well as people’s cooperation due to the pandemic restrictions even though they are more relaxed this year.

People are staying at

home these days and the quarantine restrictions, especially border control and other police operations, act as a deterrent to the commission of crimes, Conag said.

Negros Oriental is currently under general community quarantine with heightened restrictions until Sept. 30.

Meanwhile, the police to population ratio in Negros Oriental is now higher, with one police personnel to 952 people, Conag said, adding based on the 2020 census, Negros Oriental now has a population of more than 1.4 million.

The police personnel strength in the province, on the other hand, is only 1,105, he added.

COVID cases surge 62% Poor border controls have been blamed as the cause of the 62 percent surge in COVID cases in Negros Oriental this past week.

As of Friday, there were 806 active cases and seven deaths, compared to 502

cases seven days prior.

Assistant Provincial Health Officer Dr. Liland Estacion told a press conference Friday that contact tracers found asymptomatic third generation contacts of covid positive individuals.

Silliman alumni here and abroad and their friends have raised more than half a million pesos in the last five weeks to primarily oppose the Dumaguete government’s proposed 174-hectare reclamation.

The SU Alumni Association Inc. turned over a cheque of P514,478.30 to Silliman University to be used for its Environmental Advocacy Fund.

Silliman alumni are raising the money to fund research and scientific data gathering; information dissemination to promote community awareness; efforts in transparency in the implementation of relevant processes; the need for the strict adherence to applicable national laws, local ordinances and guidelines set by the proper government agencies; the call for informed decision-making by government officials and stakeholders; and even legal action to seek redress before the courts of law, when needed.

Judge Jenny Lind Aldecoa-Delorino, SUAAI president, said the Board resolved to partner with the University in establishing the environmental advocacy fund.

“Following the release of the University’s institutional position against reclamation now and in the future, and the SAAI Board’s statement to oppose the proposed 174-hectare reclamation project, the SU administration proposed, in a letter sent to me, the establishment of an environmental advocacy fund through donations from alumni and friends of Silliman,” Judge Delorino said.

She said the amount of more than a half a million pesos recently turned over comprise only donations that were sent directly to SAAI. One of the donors is the Pay-it-Forward for Development Inc. (PIFDI), a foundation established by the first batch of Cocofed scholars at Silliman from 1975-1980.

Judge Delorino said other donors include friends of Silliman alumni who also believe in the cause of noreclamation.

DOST scholars’ assoc bags 2nd best in Region 7

The DOST Scholars Association of Negros Oriental bagged 2nd place in first Search for the Most Outstanding Scholars Association in Region 7.

The announcement of winners was held during the virtual National Science & Technology Week Celebration in Central Visayas.

DOST Science Education Institute Dirrector Josette Biyo personally announced the winners of the contest.

Some of the notable programs implemented by the Negros Oriental DOST scholars association include organizing 21 webinars with their counterpart in Cebu, drafting eight sets of reviewers for undergraduate scholarship exam, donating essentials to fellow scholars who were stranded during the lockdown last year, and assistance in the conduct of an Energy Audit.

The DOST SA NegOr is registered as a legitimate youth organization in Dumaguete since 2020.

The scholars association will receive a plaque of recognition, and P5,000 cash for bagging 2nd place.

DOST SA Negros Oriental is composed of DOST scholars enrolled in Negros Oriental State University, Foundation University, and Silliman University.

Back to the drawing board

The controversy and drama surrounding the proposed 174-hectare reclamation project appears to have ground to a halt (at least temporarily) after the Sangguniang Panglunsod acceded to Mayor Felipe Remollo’s request for their withdrawal of the authority they gave him to sign the Memorandum of Agreement with EM Cuerpo Inc. On social media, not a few among those opposed to the project have heaved a sigh of relief that the drive to push for the reclamation project has at least gone down by a few notches, or perhaps gone back to the drawing board altogether.

The withdrawal of the authority to sign the MOU coincided with the reply of the Philippine Reclamation Authority to a letter from the Minority Councilors, which affirmed that the Dumaguete local government unit indeed, did not follow the proper procedure in selecting or awarding the proponent of the ‘smart city’ project.

But after listening to all the logical and non-sequitur arguments for and against the project, we may hopefully lay to rest the proponents’ statement that there are no fish in the Dumaguete shoreline.

Studies by scientists conducted even before this reclamation idea was hatched had established the presence of 219 species of fish and 144 hectares of coral reefs in the Dumaguete shoreline.

All these will disappear if we bury them with armor stones dredged from the Ocoy River or the mountains of Valencia.

By enumerating the flaws in the process, the PRA has also given a blueprint for the City to follow, should it pursue an environmentfriendly and socially-acceptable vision for the people of Dumaguete.

Perhaps, if it so desires to redraw its vision for a humongous landscape-altering project, the local government should not just genuinely study all the legal infirmities pointed out by the PRA, but study all the available scientific data which are already in their hands.

Projections should be backed by real figures derived from good old-fashioned research.

And if need be, we can all come back to this discussion with open minds, ready to reason with each other, and, most important, have the willingness to be humble enough to submit to a nobler idea or purpose.

ast Monday, Sept. 6 there was a Penitential Walk conducted by the Catholic Diocese of Dumaguete to express their opposition to the City’s 174-hectare reclamation project, and pray about the pandemic.

You can imagine some quarters questioned the actions of the Catholic clergy in spearheading the protest activity, among them, on the issue of the separation of Church and State.

The 1987 Constitution begins with the Declaration of Principles and State Policies, which proclaims: the separation of Church and State shall be inviolable.

The separation is then secured through the Bill of Rights: No law shall be made respecting an establishment of religion, or prohibiting the free exercise thereof.

combative. Intolerance of another person’s faith is a personal choice, not a legal requirement. The right to practice any faith, or to have no faith, is a foundation of all freedom.

The freedom of religion, in so far as the concern is belief, is absolute. You can believe anything that you want to.

But the moment that you commit an overt act based on your religion, that will be subject to state supervision.

The Church is not just the clergy – it is also composed of laypeople.

Thus, the separation of the Church and State is to the advantage of the Church for it protects the Church from State control and interference in the moral values of the Christianity, in denouncing evil in society, in serving the common good, in working for the defense of life and the environment, in struggling for justice and peace, and in operating social action projects that benefit the poor.

It is important to have a proper understanding of what “separation of Church and State” really means. Otherwise, a misunderstanding of it can be used to silence the Church.

No supporting evidence is proffered. It’s simply true because someone in power says so.

Ex cathedra claims seem to play into the considerations of policy options on Dumaguete’s 174-hectare reclamation project.

Claims relating to 174.

As with other development projects, 174 is claimed to create benefits. It’s also claimed to incur costs and harms. Public and policy considerations of it involve judiciously assessing how its claimed benefits would justify its claimed costs and harms, or that its claimed costs and harms – when mitigated – pare acceptably less than the claimed benefits. The policy choice – to reclaim or not – may depend on probabilities and proofs that its claimed benefits would happen, and that if they would, they’d exceed the claimed costs and harms.1 Benefits of 174. 174 is said to benefit Dumaguete because it’d create jobs that’d would increase residents’ incomes,

and reduce the need for Dumagueteños to look for jobs elsewhere. It would mean more taxes so that the City could offer free hospital services and scholarships for residents.

It’d make Dumaguete just a 30-meter canal away from a Dubai- or Singapore-like haven of rich amenities. It’d benefit nearby municipalities and the Province itself.

Costs and harms of 174. It’s said that 174 would not cost Dumaguete any centavo. But it does institutionally, say others.

These living ecosystems are protected by law, and are considered among the planet’s high concentrations of marine biodiversity that many studies have determined to be important to human sustenance and survival.

It’d harm a long stretch of fishing grounds in Negros Oriental and nearby islands, and would threaten biologically-important and tourism-rich aquatic areas like Tañon and Apo. It’d harm Dumaguete’s

There’ve been videos that titillate the imagination of 174’s benefits to Dumaguete because they have similarly happened elsewhere. But sans details, this seems like saying that snow could fall on Dumaguete because videos show that it does elsewhere.

Advancing ex cathedra claims. As in many ex cathedra claims, opposing views are quickly branded as motivated by ill will, and those opposing them are said to be ignorant or of impure motives.

A case in point? Trolls.

Those who question or oppose the statements of their patrons are branded as devious, and of questionable pasts and present.

Trolls combine argumentum ad hominem, argumentum ad passiones, the fallacy of false equivalence, and even sprinklings of tu quoque to advance the unsupported claims of their masters. (Sung by Shirley Bassey, 1967) ntroducing Pharmally Pharmaceutical In. (Pharmally), led by its President Huang Tzu Yen. In the SEC records of incorporation, Yen claims to be a Filipino citizen. Incorporated in September 2019, Pharmally reported a paid-up capital of less than a million pesos, specifically P625,000. It had no transactions or income that year.

By 2020, its financial fortunes grew by leaps and bounds. The Procurement Service of the Department of Budget & Management awarded Pharmally contractsfor Covid-19 related medical supplies amounting to P7.9 billion.

Pharmally won these bids without meeting the requirements under the Government Procurement Act for financial capacity.

This law requires a net financial contracting capacity worth the budget of the contract awarded to it.

Moreover, the DBM and the Department of Health had no memorandum of agreement for the turnover of the latter’s P42 billion budget allocation, under the Bayanihan Act, to PS DBM to handle the procurement of medical supplies.

Further investigation revealed that Yen, Pharmally’s principal stockholder and CEO, and his father Huang Wen Lei are wanted in Taiwan for financial fraud. His father

Is there a China connection here? How far and how deep do the tentacles reach?

Is Malacañang isolated by a “China Wall” or does this render the President vulnerable?

One theory is that the President’s “China Wall” consists of diversionary tactics by engaging in petty quarrels with the Senators which is investigating his lieutenants at the Blue Ribbon Committee in earnest.

The President seems to rely on his continued popularity from the plurality of 16 million votes which he received in

For the time being, the President seems to forget, however, that each Senator, he has chosen to joust with, enjoys the same constituency as he does; all of them were also elected nationally at large.

In fact, we should recall that several of them received more or at least as many votes as the President.

Among them are Franklin Drilon, Joel Villanueva, Tito Sotto, Panfilo Lacson, Richard Gordon, Juan Miguel Zubiri, and Emmanuel Pacquiao.

While the Senate acts as a collegial body versus the President who exercises executive power by himself, there is no question that the Senate (as part of the legislature) and the President are co-equal under our system of republican government.

The President, therefore, deceives himself if he believes that his popularity alone will allow him to bully the Senate, or any Senator, or even a constitutional body such as the Commission on Audit.

Lloyd Christopher Lao, (a presidential appointee from Davao) former head of PS DBM, and closely identified with Sen. Bong Go, special presidential assistant (and more recently a presumptive, but apparently-reluctant presidential aspirant), awarded the questionable bids to Pharmally, by his admission to the Senate Blue Ribbon Committee, without investigating Pharmally’s financially capacity. Dumaguete’s arithmetic for disaster

hat exactly does the Dumaguete reclamation project of 174 hectares off the coast of the City — an area, by the way, three times the size of the Luneta — mean in terms of economic impact? Here is the arithmetic for economic disaster.

(I’d like to underline that this is not just an environmental issue but also one of pesos and centavos, since the City planners have brushed off the importance

whopping 17.4 million cubic meters of sand, soil, and whatever the project proponent EM Cuerpo Inc. will have to throw into the crystalline waters of Dumaguete Bay to make this happen.

Just how vast is 17.4 million cubic meters? Well, the average dump truck can carry 11 cubic meters of building materials.

You would hence need 1.6 million dump truck trips to create the proposed “fake island” of Dumaguete.

First off, “174 hectares” doesn’t really give you a feel of the big picture of the figures. It’s actually the same as 1.74 million square meters.

However, reclamation is always 3D, so you need to think three-dimensionally.

The depth of Dumaguete Bay runs from four meters near the shoreline to some 28 meters at its deepest, but let’s just go with a median figure of 10 meters.

The total volume you would, therefore, need for this reclamation project is a

That alone would change not just the vista of Dumaguete but also its presently civilized atmosphere as a University Town and a placid retirement community.

y initial experience with Filipinos provided me with an important insight to their national character.

In the previous millennium (the year was 1986), I was working in a San Francisco bar that was popular with Filipinos.

Huge demonstrations in Manila and other Philippine cities resulted in the end of the Marcos regime that time. I was fascinated by the way Filipinos from both sides of the political divide behaved.

To my astonishment, they respectfully shook hands and

At only 12.9 percent, the number of people in the Philippines who are fullyvaccinated against C19 is low.

In this month of September in Ireland, 100 percent of the population will have been fully- vaccinated. Most European countries also have high vaccination rates.

Why is there such a difference between those countries and the Philippines?

Sadly, almost all the local people I’ve interviewed told me they don’t trust vaccinations.

And understandably so. Much of their reasoning is because of the disastrous outcome of the dengue fever vaccinations on children five years ago.

In 2016, dengue had become a serious health concern impacting Filipino children. The Philippine Department of Health paid US$67,000,000 (approximately P335 million) to a major pharmaceutical company for vaccines to combat the

If you do, then you can thank your grandparents, great-grandparents, or even your great-great-greatgrandparents who passed them on to through those things called genes.

A gene is the basic physical and functional unit of heredity. Genes are made up of DNA. Every person has two copies of each gene, one

The Ngan family The Ngan family tree with its many branches (Dad was among 19 children) is not a tall one because my paternal grandparents were orphans and my paternal grandfather, Angkong Ngan Hong Pin, was only 12 years old when he migrated to the Philippines from Fujian, China.

Angkong taught us the value of education (which was denied to him) and modeled to us industry, perseverance, filial piety, the fierce loyalty to and support of family and magnanimity.

n times of difficulty, like the one we are all into right now, it cannot be helped to ask ourselves: If God remains the same and is just, is the present turmoil a sign of his displeasure and punishment of our transgressions and shortcomings?

But then we also know the trial we are currently experiencing comes to godly people, as well as the wicked individuals.

In light of the recognition of troubles in this life, it does not seem that God is bringing the disease (and the chaos that goes with it) simply as a result of human turpitude.

Perhaps, what we are going through today is an appropriate reason and occasion for selfexamination.

We Christians have plenty of reasons to cultivate the spirit of humility and repentance before God. God’s gracious blessings are gifts that we who are Christians ought not to take for granted. It is possible that difficulty should serve to remind us how much we have received from God and motivate us to give thanks in response.

We ought not to consider blessing as normal or to think that trials invite us to simply pray them away. Grace is God’s favor, given freely in spite of our irreverence and immorality.

Good times should be

accepted with gratitude and treasured as gifts from God. God’s purposes, even though they come during difficult times, usually bring unexpected results, visible only in hindsight, that accomplish much for the building of his Kingdom.

What, then, are we to do when trials such as we have now come? The answer lies in thinking about God’s steadfastness.

God is consistently good.

This should be instructive

ways to let our neighbors know that they are not alone.

Let us consider how God might be calling us to listen to others or speak a comforting word, to help provide food or necessities to those who are lacking, or to share other blessings with those who are struggling.

A phone call can be very encouraging to those who are isolated.

We must consider writing letters and placing them in our neighbor’s mailboxes with our contact information.

Encourage them to reach out if they need anything; dropping off extra supplies to an elderly person who cannot do things for himself.

Perhaps, we can join social media platforms for local neighborhoods, so that we can connect digitally to those around us.

Even in times of social distancing, we can safely reach out with mercy and love. God is calling His people to be a blessing and, most importantly, to provide hope to those who are fearful.

Naturally, there will be many inconveniences, challenges, and frustrations in times like these. But God will grant us a spirit to see these as avenues of service to others. God is at work in each of us. As the Scriptures say, “[He] is our refuge and strength…therefore we will not fear.”

What trials mean for us. The path through suffering encourages us to focus our attention on Christ. When we shift our gaze to our suffering, taking our eyes off Christ, suffering becomes a distraction that hinders our discipleship.

The call to live as followers of Jesus Christ and to make disciples remains, despite the clamor around us.

How are we called to serve? In this time of crisis, each one of us as God’s people should ask ourselves, “How is God calling me to serve?” There will be many tangible needs in our communities.

Prior to this outbreak, poverty, lawlessness, loneliness and isolation were serious problems.

Social distancing, so very important now, will exacerbate these feelings.

The resident auditor of PS DBM flagged the expensive face masks and face shields, including three purchase orders with Pharmally in April 2020. It was observed that the PS DBM bought the items at a very high overprice, such that the government agencies to which the medical supplies were passed on to refused to receive them.

Thus, is the saga of the government’s mismanagement of the Covid-19 pandemic in the Philippines. It is bad enough that the policies and programs to address the pandemic have been less than satisfactory: support for the frontliners, particularly medical and allied personnel, have been severely wanting and delayed; the lockdown and local government quarantines have been largely ineffective; the availability of vaccinations have not been timely; and the distribution of support packs

to isolated or quarantined persons have been inadequate, among other problems of implementation.

And now, we discover, the worst governnent sin of all! The waste and inefficient utilization of resources (coming from our tax money).

It’s sad that bureaucrats, (all the way up to the “command responsibility” heads of government), treat the people’s money like Shirley Bassey’s Big Spender! It’s not theirs, but they have no qualms of spending and wasting it, whether by corruption, ineptitude, or just plain mismanagement.

Such prodigal spending will be amplified once more as our election mentality preoccupies the nation’s culture.

Vice President Leni Robredo observed recently that in the proposed national expenditure budget submitted by the DBM to Congress, which exceeds P5 trillion, the bulk of infrastructure expenses

under the Department of Public Works & Highways was lumped in local projects for barangay multi-purpose courts for disaster relief -a euphemism for electionrelated projects -- rather than for facilities to address the country’s needs against Covid-19.

There appears to be no regard in the 2022 budget to substantially address Covid-19. What seems to be more important is to fill the election campaign war chests.

Predictably in 2022, people’s votes will again be the prime commodity; and the Big Spenders for coveted political posts will “spend a little time (translated: money)” on the morally-unrestrained electorate. God help us all!

Finally on a lighter note (and about time, you reasonably think), the following is a ‘-ber Alert’.

I’m referencing the reality that here in the Philippines, beginning in September upto December, the months that end in -ber, result in Christmas songs being played ad nauseum in commercial settings every morning, afternoon, and night.

Every month from September to December has -ber in them. That’s four months, a third of the year!

I witnessed it in Dumaguete right on September 1st and was painfully reminded it’s the -ber months.

I first experienced this particularly Philippine phenomenon in Cebu back in 2015. Upon hearing Christmas carols, thinking I’d become lost in some time warp, I asked the saleslady what was the source of “the noise.”

She smilingly explained the -ber months concept to me.

I innocently asked how the heck she and her co-workers could survive such nonsense for four months in every year.

Her startled look made me realize I’d unintentionally offended her.

Despite that, she generously responded with the classic Filipino politeness, with a broad smile on her face but a coldness in her eyes: “Because that’s the way it is, Sir.” Indeed. I walked away feeling embarrassed. I’d just experienced the first of what would become far too many East-West cultural differences.

Often in life, the full consequences of prior actions are only revealed when subsequent events unfold.

Such is the case with the dengue vaccine, and those evil people who were in any way involved in financially profiting from harm done to the children from dengue vaccinations. And as usual, nothing significant has been done to punish those responsible. It’s another national disgrace that sadly reoccurs here every few years.

‘Justice for the children’ is simply another of the endless wrongs that will never be remedied.

Just as it is worldwide, the oppressed, the so-called underclasses, have no voice.

Their pain will never be heard. They have no financial resources or excess energy available. They are too busy with the basics such as keeping their families fed. They will never mount any significant challenge to the establishment. ***** I often wonder at the unseen pain caused by this cursed virus. Just when life was slowly improving, suddenly, the Delta variant floats into the Philippines and in Dumaguete.

Filipinos must have a remarkably-strong capacity to endure suffering. They attribute much of their challenges as “God’s will.” If so, what an unloving God he/ she/they/it must be.

Another response is “It’s always been that way.”

And that defeatist attitude is true. Somehow, they find consolation in both, what for me, are untenable viewpoints.

But as I’ve learned the hard way after being correctly told many times, it’s solely the Filipino view that’s relevant. My view, or the opinion of any other foreigner, understandably has little value for the average Filipino.

Because of their stoicism, a mantle of silence cloaks most, perhaps all, barangays. It’s only inside homes where the truth is known. That reality must be painful and often heartbreaking. As always, it’s

Our unified voice opposing the Dumaguete reclamation We, the clergy and laity of the Iglesia Filipina Independiente in the Diocese of Negros Oriental and Siquijor, composed of 15 regular parishes, three missions and several outreaches, through careful study and prayer, speak as a unified voice to oppose the 174-hectare Dumaguete reclamation project.

As a Church adhering to the God of righteousness, we oppose because of a blatant disregard for the rules of inclusion and transparency shown toward God’s people.

The creation of a Public-Private Partnership document for the Mayor of the Dumaguete to sign without the prior knowledge and proper consultation of the people is a violation of responsibility, and the laws of the land, and against God. As a C h u rc h r e s p o n s i b l e fo r t h e stewardship of Creation, we oppose the reclamation because of its massive damage to the ecological system that God has mandated us to protect and nurture.

The building of two artificial islands disrupts the ocean topography, and burying coral reefs that sustain life on land and in the ocean will cause irreparable damage to the biodiversity, affecting generations to come.

As a Church founded on the principle of affirming national sovereignty and empowerment of our local people, we oppose because we are aware of the potential for the exploitation of this 174-hectare reclamation project by profit motivated interests of people

from outside Dumaguete, and even outside the Philippines.

The contract agreement shows there is greater benefit to be reaped by the share of the outsiders than the share of Dumagueteños.

As a Church born within the struggle for workers’ rights, we oppose because it denies the role and capacity of Dumaguete businesses to meet the cost qualifications to enjoy a place in the ‘smart city’. We foresee a proposed ‘smart city’ that is cost-prohibited for the great majority of our local businesses, and in turn, will draw wealthy businesses from other parts of the country, while turning our people into a cheap labor force to enrich their interests.

The people of Dumaguete City, including neighboring towns affected by this reclamation project, deserve more honesty, protection, respect, and assurance.

There are other possibilities that can bring development and work to Dumagueteños without the potential of rendering our businesses excluded, our environment devastated, and our people further exploited.

We call on all people of faith to stand with us in opposing the 174-hectare Dumaguete reclamation project. This proposed project is an offense to all people who profess adherence to the Holy Scriptures.

Her first exhibition of collectibles and home accessories will present two and threedimensional pieces commissioned from local artists namely Iris Tirambulo-Armogenia, Hersley Ven Casero, Miko Cataylo, Lawra Eco, Carmen del Prado, Hemrod Duran, Daniel Fabros, Jana Jumalon, and Sharon Dadang-Rafols.

Dumaguete’s....from p. 5 homes. There are charming restaurants and for now, not a single anonymous mall.

I’m not even talking about the strangulation of fishes and the demolition of coral reefs, but the economic toll on the two-legged creatures on land.

The noise, dirt, and dust would instantly uglify the whole City.

Make no mistake, nobody would be spared, if you think it’s just the folks eating silvanas, sunning themselves in Silliman, or living in the houses sitting by the bay.

The financial losses for all the hotels, restos, stores, homes, and other business establishments in the entire City would be immeasurable.

But there is something else that we can measure, and that is where fat-cat contractor EM Cuerpo, a friend of China behemoth Poly Changda Engineering Corp., says they will get the sand and soil for the reclamation.

It will be from no less than the Ocoy River of Negros Oriental itself.

Documents from EM Cuerpo itself reportedly estimate that it will be carting off sand from a 900-hectare size area of the river — now we’re talking of an area 15 times the size of the Luneta — which comes to about 450,000 cubic meters for landfill. That’s a drop in the bucket of 17 million cubic meters it will need to execute the project.

So there will probably be other Negros mountains or rivers that will be flattened or killed for this project.

Geologist Ken Mafel Orcullo from Sibulan town next to Dumaguete estimates that quarrying the Ocoy River from the distance of Kalamigan bridge to Valencia — an area of 50 hectares — would have dire effects on the communities around it.

EM Cuerpo’s plan of 900 hectares would cover, he says, four whole barangays. It’s an astronomically huge area that would scrape off the precious top soil needed for agriculture, and probably just toss it aside, creating a whole new set of problems.

The topsoil would have to be removed to expose the bedrock to extract material.

Heavy-duty blasting would be needed.

It would leave unprotected slopes that would lead to landslides, to name just one example of a negative effect on the economy of the area. “It would have a catastrophic effect on the host community,” he warned.

Orcullo adds that the brunt of quarrying would be borne not only in Dumaguete but also elsewhere in the Province, especially in Sibulan town itself.

Rivers, he points out, have a way of rebalancing themselves. When you remove tens of thousands of cubic meters of sand, that void must be filled, and Mother Nature will correct itself in the way it knows how.

“Our spillway has already suffered from quarrying down river, so we cannot cross the Ocoy easily,” he said.

He also points out that reclamation projects need “armor rocks” or huge boulders that need to be lined up along the artificial coastline to protect it from the tide and the waves. These large volcanic stones would most likely have to be sourced from as far away as Valencia, once again cutting a jagged path to the City through once-lush countryside.

President Duterte may not be the most popular figure these days, but to his credit, he called a halt to quarrying in all of Negros Oriental last June 2021, and the DENR has called for the submission of position papers by quarrying companies to dispute this ban.

This should send a collective chill down the spines of small towns across the country that tend to be the target of this kind of economic adventurism.

Can it be a coincidence that certain contractors are cozying up to newlyminted presidentiables? The rumor is that some even aspire to seek congressional posts themselves in other provinces — to more easily target important construction materials such as sand and rocks, perhaps?

The City government and EM Cuerpo claim that untold riches await the people of Dumaguete City once this reclamation is completed.

Let’s first look at an existing development in Dumaguete City: Marina Spatiale by the expert and highly-experienced property group Filinvest. It is developing a 1.7-hectare site featuring a mall and highrise condominiums on one end of Rizal Boulevard.

Can you imagine 100 Marina Spatiales rising on the 174-hectare property? Can you also further imagine they would be 100 percent sold out?

The 174-hectare reclamation is not “a mini BGC” or “a mini Makati CBD.” There aren’t 100 condominiums in either of these cities.

Now what if the reclamation profits never come, and the untold riches never happen? What happens if — after at least 10 long, hard years of stripping the Dumaguete rivers, Negros mountains, and the debasement of the City and its marine reserves — the project is never completed?

What if it becomes a white elephant sitting monstrously on the coast of the City after killing off its environment and its economy?

Then the City government of Dumaguete would have gambled not only with the present lives of its citizens, but also the futures of their children’s children in exchange for complete and utter economic ruin.

The future of the reclamation is said to be uncertain, but the destruction of the City’s economy to even get the process started is beyond doubt.

Cessa, however, chose to direct her journey back to the Visayas.

She moved to Dumaguete in November

2020 for a slower, more cadenced living.

The exhibit shows her willingness to listen and learn from local communities how to retell stories of innate craftsmanship.

Beyond lifestyle and trends, her work seeks to integrate a minimalist framework that embraces local colour and design values.

Position on the artificial islands from Bantayan to Banilad

As spelled in Sec.12 Art. II of the Constitution and By-Laws of the United Church of Christ in the Philippines: “As steward of God’s Creation, the United Church of Christ in the Philippines shall protect, promote and enhance the ecological balance and integrity of creation.” Psalmist said “The earth is the Lord’s, and everything in it, the world, and all who live in it; for he founded it upon the seas and established it upon the waters.” (Psalm 24:1-2) The stand of the Negros District Conference of the United Church of Christ in the Philippines to the proposed reclamation/ construction of a 174-hectare artificial island from barangay Bantayan to barangay Banilad in Dumaguete City, covering 85 percent of its coastline, quotes the above verses from the Scriptures.

The words from the Holy Bible remind us that we as people of God do not own anything and everything here on earth. We are but stewards of God’s creation. As such, our responsibility is to maintain the integrity of His creation.

Our Constitution, laws, and jurisprudence, including local ordinances, provide for the prudent and wise use of our natural resources.

In fact, there are basic principles that need to be strictly followed that are inherent in good governance. These are accountability, transparency, participation, and predictability. There are likewise prescribed rules and procedures that need to be complied with to guarantee the protection of our natural ecosystems.

The book Fisheries of Central Visayas, Philippines: Status and Trends, published by the Department of Agriculture-Bureau of Fisheries & Aquatic Resources, in cooperation with the Coastal Resource Management Project of the Department of Environment & Natural Resources, revealed that “Development is tied intricately with the marine fisheries ecosystems, providing income through fishing

and other marine-related industries. Fishing is the number two employer in the region, second to farming.”

Since reclamation entails filling materials dumped into these marine fisheries ecosystems, it will irreversibly destroy the fishing grounds which our subsistence fisherfolks directly depend on.

Reclamation also requires filling materials that are quarried from the mountains or dredged from the rivers, which will all the more damage and lead to unwarranted abuse of our God-given natural resources.

With the foregoing background, the Negros District Conference strongly opposes the joint venture of Dumaguete City with E. M. Cuerpo Corp. and a Chinese corporation for the 174-hectare reclamation and construction of artificial islands, until all the rules and procedures are adhered to.

A full environmental impact assessment should be conducted to determine not only the threats to the environment but to ensure the social acceptability by all stakeholders of the project. This project does not only have constitutional and environmental consequences but spiritual implications and significance as well. After all, we are responsible stewards of God’s creation.

We appeal to the City government of Dumaguete to consider the true voice of Dumagueteños, and consider the God-given strength of Dumaguete for it to prosper, and not blindly follow other places that have succumbed to material greed at the expense of destroying God’s creation. A development which is sustainable, and benefits all of God’s creation. Bearing in mind that we did not inherit our environment but that we hold it in trust for our next generation.

Judge Delorino lauded the various efforts initiated by the alumni.

“This is significant because as Silliman alumni, we are acting on our belief that the advocacy of the University in protecting the environment, and calling for sustainable and inclusive development is imperative,” she said.

“In engaging and supporting activities that are aimed to oppose the 174-hectare proposed reclamation, we believe, among other reasons, that we are preventing immeasurable, disastrous, irreparable environmental and ecological damage to Dumaguete City”, Delorino added.

As administrator of the fund, the office of the Vice President for Finance will oversee the allocation and disbursement of the Environmental Advocacy Fund, the campaign for which continues.

The stories recounted, many in tears, were of their experience with Angkong even before the war. The fierce loyalty and respect accorded to him was quite overwhelming and heartwarming.

I was blessed to have met one of my Angkong’s relatives, Pao A, whom we called Chiak Kong (grand uncle) who was the family chef and had been with the Ngan family for the longest time. He was admired for his cooking prowess and feared for his temper because he would bark at anyone who dared take a step into his sanctum where delectable dishes where quick-fired over the longest wood-fired stove I had ever laid my eyes on.

Chiak Kong, who was quite elderly and no longer in service at the time of my Angkong’s passing, did not take a ride but ran all the way to the wake when he heard the sad news. The distance from his house to the funeral home consisted of several blocks and it was by a small miracle that he did not collapse or had a hard attack!

My maternal grandmother, Ama, Cua Sing, was much loved. Her quiet and softspoken demeanor belied the quiet inner strength and character of a person who had undergone much hardship as a child.

For someone who never had a formal schooling, she was quite well bred and familiar with Ho Leso (good manners and etiquette) and insisted that we observe them.

And that was no easy feat for the matriarch of a household that counted the birth of 19 children and hundreds of grandchildren and great grandchildren!

Ama doted on us but would not suffer our shenanigans. Her gentle and calm way of disciplining us was, I felt, more effective, because it was never done in anger or with judgement.

In death, as in life, Ama imprinted her love on all of us. Her funeral cortege ran over two blocks and the quiet weeping among us who walked in our white clothes with red sashes (representing 4 generations) behind her hearse was witnessed by

My maternal grandma, Alicia Somoza, was a Spanish beauty related to the Villanuevas, Ponce de Leons and Arnaizes of Negros. The good looks were passed on to her kids, two of whom became Miss Sillimans.

As was the norm in her day, Lola Ising was an interna at a school run by nuns in Cebu who taught her the basic skills required of being a good wife and mother: cooking, baking, embroidery, housekeeping etc.

From her I learned time management, the intricate art of cake decorating, and crafting skills which came in quite handy in my own life.

I am who I am today because of the love and support that my parents gave me as a child. I wouldn’t be nearly as comfortable in my own skin had it not been for them reminding me that it was okay to be who I was.

I am who I am because through my parents, I was the beneficiary of the love, sacrifice, experience, achievement, and generosity of my grandparents.

The Banogon family The Banogon family tree or rather forest, on the other hand, is unbelievable in its length and breadth! I used to get amused about the so many Titos and Titas we had to greet and buzz each time we had a family event or when we walked the streets of Dumaguete.

My maternal grandfather, Engr. Francisco Sevilla Banogon traces his roots to Tanjay and La Libertad, the latter of which was founded by his father Pio Banogon.

Lolo Kiko was the original scholar in the family who was blessed with the best education at Silliman University and, later, at Purdue University.

A m o n g his relatives I remember the Sagas, Cornelios, Borromeos, and a whole slew of names that escapes me now.

The pedigree and traits inherited from Lolo Kiko we r e pr i c e l e s s !

His shoes were, to this day, too big for anyone of his progeny to fill. He was much respected in the Ngan Hong Pin and Cua Sing Ngan Banogon clan and

Verifiable data and evidence should be required to substantiate all claims. Then assess how the claims could happen, compare the gains and losses to Dumaguete should those claims happen, and arrive at a decision to reclaim or not. (As I understand it, this option is not new; it’s what the City’s 2016 PPP ordinance requires.)

The Sangguniang Panlalawigan acted on facts. People could question its motives, or if its action amounts to anything. But it acted on the basis of facts. And, to me, this is what matters when exercising public office. Not ex cathedra claims.

SCOPE. This ORDINANCE shall be applicable to all persons within the territorial jurisdiction of the City of Tanjay, Province of Negros Oriental.

“Section 2. CURFEW HOURS. A curfew hour shall be established from 9 o’clock in the evening until 5 o’clock in the morning.

All persons are prohibited from roaming around, loitering, wandering, staying in public places, whether singly or in groups, during this period.

“Section 3. GUIDELINES. The following guidelines shall be used in the implementation of this ordinance.

A. PERSONS/INDIVIDUALS EXEMPTED FROM THE CURFEW: Persons/ Individuals exempted from the curfew are the following: 1. Workers and employees going and coming from work; 2. Persons/Individuals under medical care and emergencies; 3. On-duty health workers, police and military personnel; 4. Any government official and employees and barangay functionaries while in the performance of their duties and responsibilities; 5. Those who provide public transport services and delivery services of basic necessities; 6. Any person involved in an emergency situation including rescuers and first-aid responders; and 7. All farmers and fisher-folk in the exercise of their livelihood.

B. For Persons/individuals who are reporting for work, they are required to show their Government or Company-issued ID and Company Certification of DUTY-STATUS at designated PNP/LGU/DOH checkpoints. Persons/individuals who fail to present such documents will not be allowed to pass through the checkpoints/chokepoints.

“Section 4. IMPLEMENTATION and ENFORCEMENT. All Punong Barangays, Tanod and the PNP of the City of Tanjay shall be responsible for the enforcement of this ordinance.

“Section 5. ADMINISTRATIVE SANCTION CLAUSE. Persons/ individuals who shall be found violating this ordinance shall be administratively sanctioned with a FINE in the amount of THREE HUNDRED PESOS (P300.00) for every violation committed and/or to render COMMUNITY SERVICE for EIGHT HOURS, the latter shall be decided upon by the Office of the City Environment and Natural Resources Officer on the nature of the task to be undertaken.

“Persons/Individuals who display clear arrogance toward the apprehending authority/ies shall be liable under the Revised Penal Code of the Philippines.

“Section 6. REPEALING CLAUSE. Resolution No. 21-207, enacting Ordinance No. 3 and all previously enacted ordinances inconsistent hereof are considered repealed.

“Section 7. SEPARABILITY CLAUSE. If for reason or reasons, any part or provision of this ordinance shall be held unconstitutional or invalid, other parts of provisions hereof which are not affected thereby, shall continue to be in full force and effect.

“Section 8. EFFECTIVITY CLAUSE. This ORDINANCE shall take effect immediately upon approval.
