INTERNATIONAL ARBITRATION

Acting for a client based in Italy and facing an arbitration claim by a Dutch Company involving the supply of cocoa where the issue for the Arbitrator appointed under the Cocoa Federation Rules was whether the tribunal had the necessary jurisdiction.

Defending a claim based on allegations of misuse of confidential information and intellectual property, as well as breach of director’s duties and employment terms. The case involved an ex parte interim injunction, an amended claim alleging 171 different instances of wrongful conduct, and an application for committal to prison.

Advising a large care provider based in the South of England in relation to dispute resolution and regulatory matters.

This provider has over 50 residential care homes, as well as numerous supported living locations. We helped them manage CQC inspections, disputes with commissioners over fees, relationships with difficult relatives and vocal, complaining neighbours, the highly problematic posting of video footage of service users online, and other thorny issues.

Providing one of our major civil engineering contractor clients with key dispute resolution advice in connection with its earth moving and drainage works for the new junction on the M49 motorway at Avonmouth, near Bristol. The issues were successfully resolved for the client without recourse to adjudication or litigation.

FREEZING INJUNCTION Acting on a claim seeking recovery of substantial sums lent to the Defendant and where urgent steps were required to obtain a freezing injunction to prevent the disposal of assets.

The case also involved tracing the loan money in both UK and foreign jurisdictions, pursuing claims against third parties, and ultimately successfully obtaining a substantial judgment in the client’s favour.

Acting for a professional services client following a thirdparty cyber-attack which shut down their computer systems and obtained commercial information and personal data on clients. Assisted the client with instructing cyber security experts, advising on regulatory obligations arising from the breach including notifying regulatory bodies and clients, investigating the cause of the data breach, and responding to claims arising from the breach.
