Despite the growing number of online and print sources of advice for property owners looking to custom-build their home, the construction process remains a daunting prospect for most. Clashing concerns about cost, time, and quality form a complicated “trilemma” that all ownerbuilders face. Choosing a contractor is typically the first and most important step towards building your home. However, many sources suggest that managing your own construction project is a viable money saving option. This brief article intends to offer some basic information about the role of a contractor, how to choose one, and whether you can manage without one. The Role of the Contractor Once the contract is signed, the contractor takes full responsibility for completing the project within the agreed upon budget, specifications, and timeline. The tasks of the contractor include the following: - understanding the owner’s vision and interpreting the specifications of the design to plan a feasible project - establishing a payment schedule and distributing the budget among labour and materials - scheduling the construction - purchasing the materials and coordinating the deliveries - hiring, coordinating, and supervising the subcontractors - obtaining the necessary permits for construction or remodeling - detecting and resolving any problems that arise on site - communicating with the owner to provide progress reports and discuss options In addition to a wealth of knowledge and experience in various areas of construction, a good contractor benefits from a solid relationship with a network of sub-contractors and vendors who are aware of the standards expected from them. Throughout the construction process, the contractor communicates with the owner regarding progress of the projects and various options for going forward. Can you be your own contractor? Building a home can be a valuable experience for owners with some relevant skills and a long term interest in construction, but you must be cautious not to overestimate your potential savings if you are considering the DIY option for economical reasons. It is realistic to assume that about 10% of your budget would go to your contractor if you chose to hire one. This is the amount that some sources suggest you would save as your own builder. However, about half of this 10% would cover costs such as truck and tools, accounting, office expenses, and business related fees. As your own contractor, you would incur a portion of these costs, so your potential savings would be in the vicinity of 7%. But ‘potential’ is the operative word here. Remember that a fulltime contractor can exploit his connections and keep costs down by negotiating better prices for materials and labour. This is a bargaining chip that you might lack. More importantly, an experienced builder’s technical knowledge prevents costly setbacks while keeping the team on its toes and maintaining standards. You must be sure that you have the expertise and the time for this level of supervision; errors and delays can eat into your budget with a surprising

How to Choose a Contractor Choosing a contractor is not an exact science, and your first impressions will play a substantial role in your final selection. But you can start doing your research by asking your architect (if you work with one) or your experienced friends for recommendations. If possible, talk to owners of custom-built homes and familiarize yourself with the typical cost and timeline of projects similar to yours. This will help you adjust your expectations and enter negotiations with some information. Try to choose a builder whose work you are familiar with. It is very important to select a builder whose forecasts about the project are professional, calculated, and realistic; a contractor who promises a mansion with a modest budget is setting you up for disappointment. Your contractor must have experience in completing projects whose scope and nature are similar to your project. Ask to tour some of his finished projects to ensure that the quality of his work meets your standards. Here are some of the questions you should ask your prospective contractor: 1) How much experience do you have? How many homes have you built? 2) Can you give me a tour of a home you have built for another customer? 3) What type of warranty do you provide? 4) Will you provide any services in obtaining the city permit and architectural plan? 5) How do you charge your customers? Is it cost plus a percentage or is it a fixed fee? 6) What is your payment schedule? 7) How and when will the final price for my home be determined? 8) Who will oversee the construction of my home? Who should I contact for updates and information? 9) How and when can I make changes or upgrades in the course of the projects? Will there be any penalties? 10) How long will my home take to complete? You will be spending a lot of time with your contractor, and you relationship will be largely based on trust (it’s a old school kind of partnership). Make sure that you can communicate easily, and that your tastes and philosophies align. Needless to say, it is vital to keep a written record of your agreements and communications throughout the process.

IS YOUR CONTRACT GOING TO HURT YOU? When doing a real estate transaction or any type of business, it is the hope of both parties that each party acts in good faith. However, sometimes during a transaction a party’s motivation can change and put the transaction in jeopardy. To ensure that the transaction proceeds as agreed there is the contract of purchase and sale. One has to know how to use it to protect themselves during such a transaction. This article will talk about some of the circumstances that would motivate a party in a contract to break the agreement and a few points on how to protect one’s interest. In a rapid changing market regardless of prices rapidly increasing or decreasing, a buyer’s and seller’s motivation can easily change. In the time between having an offer accepted and removing the subjects, the seller may receive another offer. This could be a higher offer than the one currently accepted and could potentially motivate the seller to cancel the transaction by making the current accepted offer null and void. This can be caused by a rapidly increasing market or by listing the property under market value. So what could the seller use to get out of the contract? Once the offer is accepted and the only remaining step is the subject removal by the buyer, the seller will not have much to go on other than uncovering flaws or weak points in the contract of purchase and sale. One potential weakness could be the acceptance time, such as if the offer was actually accepted, signed and delivered after the expiration time of the offer. In that scenario the seller would

have an option of calling the offer null and void due to a breach of contract. In order to protect oneself from this, it is vital to make sure to submit all documents with the required signatures within the agreed time. In contracts, time is of the essence. Another aspect of the contract of purchase and sale that can be used to break the contract is the time of the subject removal. Part of the terms and conditions of the accepted offer is a date on which subjects have to be removed. Should the buyer or buyers’ agent deliver the subject removal past midnight of the due date, the seller can consider the contract null and void due to a breach of contract. If one foresees within a day or two that it may not be possible to remove subjects on time, asking for an extension from the selling party may be a viable option to consider in order to remain within the terms and conditions of the contract. However, if one asks for an extension and the sellers have another higher offer in place, it is unlikely that the extension will be granted. The deposit is also a very important part of the contract and one that could lead to a breach in the contract. Since the deposit is held in trust, it is recommended that the deposit be payable after the subject removal and not on acceptance of the offer. However, that is when the language of the contract can lead to either a weakness in the contract or another strong and clear term and condition of it. We have seen language in contracts that reads “deposit will be paid upon subject removal”, when is upon? Vague language in a contract can lead

to a potential breach and a court battle. In order to avoid any potential issues, having clear language such as “deposit will be paid within 48 hours of subject removal” is highly recommended. Remember, buying or selling a house is often the biggest single investment for an individual or family. With that in mind, do not leave the success of a transaction only to the goodwill of the parties involved, but protect oneself and family by having enforceable contracts and executing them effectively. 6 Keys Steps To a Successful

First Time Homebuyer Experience BY GRANT POWELL

Being a first time homebuyer should be an enjoyable experience, but if you are not prepared it can become a very frustrating one. Here are six key areas during this exciting home buying process that need to be addressed.

1. Type of Property Purchase Have you asked yourself; “Will purchasing a property now get me on the right path to obtain my real estate goals? Will this first purchase be a flip to obtain more capital? Do I want to live in the property and enjoy the lifestyle, then sell in a few years and use the profits towards my next purchase? Should I buy a place strictly as an investment and get someone else to pay the mortgage by renting it out?” To help you determine which direction would make the most sense, I suggest you get a pre-approved mortgage. This will allow you to do all the realistic number crunching so you can make an educated decision.

2. Get Pre-Approved Shopping for a home is an emotional experience especially if you are out looking at luxury properties you may fall in love with but later find out they are out of your budget. Get in touch with a mortgage broker to start the pre-approval process; it should only take a couple of days to get the answers you need to move forward. This process will determine a few of the most important things which are; budget, credit and employment or savings you need to work on before you look to purchase a property. It is best to know all of this before you put your valuable time into shopping for a place with a realtor. The last thing you want is to get an accepted offer to later find out that there is no way you can get the financing to purchase the property that you have already fallen in love with!

3. Hold off on Major Purchases Once you are pre-approved, if you are thinking of making a major purchase discuss this with your mortgage broker before taking action. You will need to make sure that a major purchase will not decrease your home-buying power as pre-approval is only based on your expenses. If you go out and finance a major transaction this new transaction will be taken into account in your overall debt and how you will be able to pay for your expenses on

4. Government offered Tax Credits, Rebates & Grants There are excellent programs available to first time homebuyers as residents in the province of British Columbia. A) RRSP’s (HBP): This a federal government program, you can take advantage of using up to $25,000 (as a single person) or $50,000 (as a couple) of your registered retirement savings plan (RRSPs) to purchase a home. There are a few rules to qualify; the complete information is listed on the Canada Revenue Agency site. Here are a few of the conditions as stated by Revenue Canada. You must be considered a first time homebuyer. To qualify the RRSP funds must be on deposit for 90 days before you wish to withdraw those funds to use for the down payment. You must intend to occupy the qualifying home as your principal residence. You must be a resident of Canada at the time of the withdrawal. These funds are non-taxable as long as they are paid back into your RRSP within a 15-year period.

B) Tax Credit (HBTC) In 2009 the federal government came up with another incentive to help first time homebuyers with the expenses that occur when purchasing your first home. This credit provides $750.00 in federal tax relief within the calendar year you purchased the home. It’s simple to claim. When it is time to file your taxes, make sure your accountant is aware of your home purchase and provide him or her with your Statement of Adjustments. The solicitor would have given you a copy of this document at the time you signed the final papers to purchase your home.

C) Property Tax Exemption: In the province of British Columbia, there’s a Property Transfer Tax, which was put into effect in 1987. This tax is based on the purchase price of a home and it is calculated at one percent of the first two hundred thousand and two percent of the balance. So on a $400,000 purchase, the tax would be $6,000.00. As a first time homebuyer you may qualify for a partial or full exemption if this tax. There are a few rules and regulation that you need to follow in order to make sure you qualify. Finding a Realtor Since purchasing a home is a negotiation of price, dates and possibly other components, make sure you have your own realtor when going into the offering stage of any property. When searching for and purchasing a home, there are many things that need to be considered and occurrences that will take place during the process so having a trusting relationship with a realtor will help make the process run smoothly. A good realtor is not only there to help you to find your perfect home, negotiate price and dates, they are also a source of information for neighborhood, schools, parks that would suit your family needs or best location for investment short term, long term, rental return etc. 6. Saving for a Down Payment/Closing Costs To purchase a home, you need a minimum of 5% down payment. This can come from your savings, investments, RRSP, a non-refundable gift from immediate family or even borrowed funds. You will also need closing costs of roughly 1.5% of the purchase price. This covers expenses such as; conveyance fees, Tax Adjustments, title insurance, property transfer tax if applicable, and any other fees that may be applicable upon your transaction. When it’s time to close and take procession of your property, you will need an appointment with your predetermined conveyance lawyer/notary approximately five to seven days before the procession of your property purchase. For this meeting the conveyance lawyer/notary will ask you to bring a few things such as a couple pieces of photo identification, the balance of the down payment and closing costs minus the deposit you had already given at Subject Removal. Keep in mind as with all mortgage programs, credit is VERY important in the interest rate you will pay, so maintain healthy credit habits. many think that the only way to lose the extra fat is by doing cardio. It’s true that doing cardio exercises help with burning calories, however supplementing resistance training (weight lifting) to your program will increase your results by 60%, if done right! Canadian health and fitness has suggested all adults to exercise 60 minutes/6days a week. For some people it’s hard to fit that in their schedule. Knowing the right exercise, with no equipment necessary can help everyone, no matter what age or gender and how busy their schedule is, to fit that 60 minutes in to their daily routine. Thanks to internet and social media these days it’s quite easy to find these exercises. A couple of tips to remember during the day in terms of exercising and healthy life style: 1) For every push there must be a pull! For

example: if you do push ups then you must do some kind of rows. My personal favorite is plank and row. 2) If you are not suffering from any sort of joint or ligament injury you must put a plyometric exercise in your routine: for example: squat jumps. plyometrics elevate your heart rate, which helps increase of blood flow into your heart and muscles, strengthen your heart and also helps burning more calories in less time. 3) Have an isometric core exercise in your routine. For example holding plank for 30 seconds. 4) Work all muscle groups. There are no more only leg days or arm days! (If your goal is to lose weight and get in shape)
