Joseph and JoAnn Callaway had an epiphany early on in their real-estate careers. They represented both a buyer and a seller in one transaction, and after several counteroffers, realized the deal wasn’t working well for either client.

Although several much-needed commissions were riding on the sale, JoAnn looked at Joseph and said, “Maybe we should undo it all. ... It’s not a good deal for the seller; it’s not a good deal for the buyer.”

hose offers from lenders are starting to arrive in the mail to metro Phoenix homeowners again. The area’s home values have recovered enough for banks to begin offering home-equity loans.

The number of home-equity loans climbed 20 percent last year compared with 2012, the biggest increase since the housing crash, according to financial research firms Equifax and Moodys. U.S. homeowners signed up to tap more than $92 billion in equity during 2014. Lenders say the upward trend continues this year.

Metro Phoenix’s home values are up more than 65 percent from the crash, and only 20.6 percent, or about 186,500 Valley homeowners, now are underwater, according to real-estate research firm CoreLogic.

During the crash’s low point for home prices in 2011, nearly 50 percent of Phoenixarea homeowners owed more on their mortgage then their home was worth.

Banks trying to drum up more revenue are offering more home-equity loans or credit lines but so far are being much more cautious about the terms. A decade ago, borrowers could take out home-equity loans, also known as second mortgages, for as much as 125 percent of their house’s value. A lot of homeowners defaulted on those loans during the crash.

When home prices started falling in the Valley during 2009, many homeowners had their home-equity lines yanked or reduced by lenders and were left without funds they had counted on to pay for college, trips, cars and investment houses.

Kaleim Manji is a managing member of Spear Education LLC in Scottsdale. The house was sold by Sara Jaro through her trust. Her husband, the late Lawrence Jaro, was chief executive officer of AmeriKing, which at one time was one of the largest holders of Burger King franchises in the country, with more than 100 in the Chicago area alone.

Question: We bought a new home in a Chandler subdivision seven years ago.

There always has been a fence between our home and our neighbor’s home.

We recently ordered a survey in order to build a swimming pool in our backyard.

The survey showed that the fence is not on the property line but encroaches 4 feet onto our property. In this 4foot encroachment, our neighbor has built landscaping, including a putting green. Have we lost this 4 feet?

Answer: Probably not. If the fence has been in the wrong location for only seven years, you still own the 4 feet.

The reason is that the statutory time period for adverse possession is 10 years. You should request that your neighbor sign a quitclaim deed for the entire legal description of your property that includes the 4 feet. The deed you got when you bought your home should have that legal description. If your neighbor will not sign this quitclaim deed, you should contact an attorney who will write a letter under Arizona Revised Statutes, Section12-1103, to your neighbor to demand the signing of the quitclaim deed. If your neighbor still will not sign, your attorney will file a lawsuit and get a court order granting title to the 4 feet in your name, plus an award to you of your attorneys’ fees and court costs.

These agents are also authors who just released their second book, “Super Agent: Real Estate Successes at the Highest Level” (Wiley, $25), following up their 2012 New York Times best-seller “Clients First.”

In “Super Agent,” the Callaways detail several “super powers” that top-level agents should exhibit. Aimed at agents, their books also help homebuyers and sellers understand what they should expect from a great agent.

Clients may be well served by looking for some of these skills. They may not be listed on a resume or be easily observable, so it’s always good to ask previous clients whether a real-estate agent has exhibited these skills: 1. Understanding. A super agent always puts a client’s interests first. But the agent first has to know what the client needs. Joseph Callaway says he often asks, “Tell me about your situation.” Good agents will get to know who you are and what you need.

spect a client’s decisions.

2. Unvarnished honesty. A super agent offers the unvarnished truth. If a house is more than a buyer can afford, a super agent will say so. (First, a super agent won’t show houses well above the amount the client is qualified for.) A super agent doesn’t get a client in over his head or urge a seller to

settle for less than she needs (as long as it’s in the realistic realm).

3. Excellent communication. A super agent understands the importance of communicating and makes him- or herself available. JoAnn Callaway believes it’s easier to take a phone call than return one, so she makes an art of be-

ing reachable. In fact, her policy is not to go home until all calls have been returned. She’s also known for her handwritten notes. Joseph says he has learned a text, e-mail or voice mail doesn’t count as communication unless he has heard back from that person. “Always end with a question so they respond,” he says. “Then you know you’ve communicated.”

4. Meticulous contracts.

Joseph admits they learned to be meticulous in contracts through a couple of mistakes early in their real-estate careers. Since then, he has made it his mission to know every line and word of a contract and to make sure contracts protect each client. For one seller, disclosing that remnants of an old pool remained in the backyard protected that seller when the new owners were trying to install a pool.

5. Smart marketing. A super agent has a savvy marketing plan. “We have a lot of tools, and we use all of them,” Joseph explains. The Callaways have a home stager (who is also an interior designer) do a walk-through with the sellers to explain what needs to change for the home to show well, both in photos and in person. They also have an inhouse art director and take professional photos and film virtual tours. Other tools they employ include open houses, newspaper advertisements and online advertising.

But sometimes stuff happens: power outages, fires or even our own desert-style weather emergencies — monsoon storms, extreme heat and flash floods — that catapult us from our comfort zones.

Although planning for the

30-day notice and moved out on the last day of the month. I was somewhat hurried in my move-out and did not have time to clean everything. Now, the landlord wants to charge me for nine days of rent for the next month, claiming it took nine days to complete all of the cleaning and repairs to the property. Do I have to pay for the nine extra days?

Answer: If it really took nine days

to repair and/or cleaning property as a result of you leaving it in bad condition, then yes the landlord can charge you for the nine days. In fact, if the landlord lost a renter as a result of the landlord not being able to deliver the property in good and clean condition on the first day of the new month, you could be charged for the actual damages resulting from your failure to leave the premises in good and clean condition.

Always move out on time and leave the premises clean. Take pictures or video of the condition when you move out.
