I just saw my property tax bill, and it’s up 8 percent from last year. You’ll be getting your bill again soon, too, if you haven’t already. ‘Tis the season for metro Phoenix homeowners to find out what we owe for schools, fire and library districts and other county and city services. Many of us will likely pay more than last year, but not necessarily because our home values are up. You might be lucky and see a smaller increase in your taxes, closer to the average of 5 to 6 percent. Overall, tax levies on property in Maricopa County are up 6.6 percent from last year, according to the Treasurer’s office. That agency is charged with collecting taxes but not deciding what they are each year. And if you aren’t happy with a higher bill, unfortunately it’s too late to appeal.
Complicated and confusing Arizona has property tax system that’s quite difficult to understand, and I say that after covering it for many years. Homeowners would have needed to appeal valuations from the Maricopa County Assessor sent out in February of 2015 to have any chance of lowering their current bill. Tax bills lag property valuations by almost two years. The lag was built in to give homeowners time to appeal, but it was set long before people could do so much quicker online. And tax rates don’t necessarily rise and fall with home values. Some recent propositions and legislation have put some limits on how much property tax bills can climb and have shifted the tax burden between different types of properties. That makes it hard to compare increases from past years and calculate an accurate average increase for Valley homeowners now. “Property tax increases are not capped, but there are limits to how much a district can spend,� Maricopa County Treasurer Charles See REAGOR, Page 3R

Qu es t i o n : We owned a home in Phoenix for 12 years. When we listed our home for sale, my wife with the help of our real estate agent completed the seller’s property disclosure statement. I just signed the SPDS one night when I came home from work. Although we had done several repairs to the roof, my wife forgot about these roof repairs when she filled out the SDPS. We sold the home three months ago. We received a letter from the buyer’s attorney this week saying that the buyer has had major problems with the roof. The buyer’s attorney also said that, after we moved out, the buyers found some old roof repair bills in the garage. The buyer’s attorney claims that we committed fraud by not disclosing these roof repairs, and that we now have to pay the buyers $12,000 for the cost of a new roof. Under the standard purchase contract for our home, the buyers were told that they should have a roof inspection. Why are we responsible to pay for the buyer’s new roof when my wife just forgot that the roof had been repaired a few times, and the purchase contract told the buyer to get a roof inspection? An s w er : You are correct that the standard purchase contract says that the buyer should have a roof inspection. If you and your wife failed to disclose the roof repairs in the SPDS, however, a judge would likely rule that you and your wife committed fraud. In the parlance of a card game like bridge, fraud “trumps� negligence. In other words, even though the buyer may have been negligent in not having a roof inspection, your fraudulent nondisclosure of the roof repairs should make you liable to pay for the buyer’s new roof. Hoskins recently told me, explaining some of the recent changes to Arizona’s complicated system. “For counties, cities, schools and community colleges, the limit is 2 percent more than last year.” The upshot is most homeowners won’t see too dramatic an increase in what they owe this year.
Where the money goes My property tax bill climbed a bit higher than average because a budget override for one of the school districts in my neighborhood was approved. Also, the city of Phoenix increased property taxes to pay for bonds used to build much-needed libraries, police stations and other city projects. Schools, including community colleges, get the biggest share of Maricopa County’s property tax dollars, about 65 percent, or $3 billion of this year’s budget. Earlier this year, the Phoenix City Council voted to raise the city’s property tax rate for the first time in more than two decades. A homeowner with a house valued at about $190,000 by the assessor will owe about $51 more this year. Every homeowner’s bill is different because there are thousands of taxing entities in Maricopa County. Some homeowners in newer communities, particularly in Valley suburbs, pay for special districts that provide water or even lighting to neighborhoods.

Your tax bill If you haven’t received your bill in the mail yet, you can find it on the Treasurer’s website. Again, it won’t help to call the Treasurer or the Maricopa County Assessor to complain about a property tax bill. It’s too late.
Valley taxing districts set their rates during the summer before bills go out. If you think a school or library district is raising their tax rates too high, then you need to head to those public meetings in June and July. I will barely notice the increase in my property taxes. Like most people, my mortgage company pays those taxes. This year’s bill will only mean another $10 to $20 a month tacked onto my mortgage payment. And frankly, my neighborhood’s
schools need the extra money. Plus, let’s not forget. Arizona has some of the lowest tax rates in the U.S. Just ask anyone who has moved to the Valley from the East Coast, the Midwest or California, where property taxes are easily double what they are here. As I told Hoskins, I am not complaining about my bill. Like many Valley homeowners, I am just trying to figure out the tangled system that dictates what we pay.

Answer: This is not the kind of mold that the manger has to clean. This is the kind of mold that a tenant has to clean himself or herself. Pursuant to A.R.S. 33-1341, the tenant is responsible to keep the premises in clean and safe conditions, to keep the plumbing fixtures clean and to use plumbing in a reasonable manner. Unless this mold is caused by a leak in the wall or from upstairs, this sounds like the kind of mold the tenant must clean regularly.

A professional cleaning company can also save time, headaches, and dollars at the end of your lease. Having a professional company come in and remove all of your remaining goods, cleaning out appliances and cabinets can help you keep more of your security/cleaning deposits and could prevent any fines. If your manager or owner requires a
walk through at the end of your lease, be sure to schedule far in advance to plan the right time for you. Your keys and access passes can be turned in at this time. At this time, the manager may walk through to assess any damages to the apartment and it’s always best to be present for this walk through if possible.
