Leveling the playing field – toward regulation of dark patterns?

DarkpatternsontheInternetareaformofbad behaviorthatdidn’texistbefore,andregulators arealwaysslowtoreacttonovelelementsof thatkind.
But,in2018,theNorwegianConsumerCouncil (Forbrukerrådet)wroteareport,Deceivedby Design,offeringcopiousexamplesofhowthe leadingInternetplatformstookadvantageof darkpatternstoessentiallytrickconsumersinto offeringupfarmoredatathantheymighthave withadifferentdesign.By2022,thetopicwas takenupbytheOECDwhobeganhaving seriousdiscussionsabouthowtolegallydefine dark-patternmarketing(asopposedtomore benignmessaging)andtoestablishwhat consumerharmmightbecaused.
