Members of this Kensington community garden put its CDC on blast after the organization tried to take back the vacant lot.

Kensington CDC backtracks on threats to boot community garden

ver the course of a few hours last week, the New Kensington Community Development Corporation threatened to expel a community garden, apologized, reversed course, and is now in the process of negotiating a secure future for the East Kensington green space.

The Frankford Avenue Garden has had a rotating cast of stewards over the last decade.

Members of Circle of Hope church have been maintaining its ďŹ ve unfenced plots on the 2600 block of Frankford Avenue for the past several years. As is the case with many long-tenured green spaces across Philadelphia, the gardeners donâ&#x20AC;&#x2122;t hold the deeds to the once-blighted land, despite their strong sense of community ownership.

But they didnâ&#x20AC;&#x2122;t expect NKCDCâ&#x20AC;&#x2122;s tersely worded letter on Thursday, April 6, telling them in no uncertain terms that their welcome had expired.

It was an unusual move for an organization that champions its aboveboard community engagement. Nick and Amanda Fury, two of the gardenâ&#x20AC;&#x2122;s stewards, were stunned by the nonproďŹ tâ&#x20AC;&#x2122;s lack of notice. They raised awareness on Facebook, and Nick Fury even had the letter blown up on a ďŹ ve-foot poster to display at the garden.

NKCDC owns two of the gardenâ&#x20AC;&#x2122;s ďŹ ve lots, which are sandwiched between three lots owned by the Philadelphia Redevelopment Authority. Garden stewards have long 3+,/$'(/3+,$:((./< &20

been in negotiations with the two agencies, as well as Councilman Mark Squilla.

In 2015, a memorandum of understanding was reached by all parties for the use of the garden.

In the unexpected letter, Wesley S. Cascone, president of NKCDCâ&#x20AC;&#x2122;s board of directors, notiďŹ ed Circle of Hope that the memorandum of understanding had expired.

It would not be renewed, Cascone wrote, and the gardeners would have one month to â&#x20AC;&#x153;remove their possessionsâ&#x20AC;? from NKCDCâ&#x20AC;&#x2122;s two central parcels.

Meanwhile, both the Redevelopment Authority and Squillaâ&#x20AC;&#x2122;s ofďŹ ce said they had no intention of uprooting the garden at this time. â&#x20AC;&#x153;Weâ&#x20AC;&#x2122;re not kicking them off the [PRAowned] lots,â&#x20AC;? said Sean McMonagle, Squillaâ&#x20AC;&#x2122;s legislative assistant. â&#x20AC;&#x153;I hate to say it, but the government looks like the good guy here.â&#x20AC;?

Each year, the garden produces roughly 50 pounds of fruits and vegetables, with an emphasis on native plants. Community members are encouraged to harvest what they need, and leave some for others. â&#x20AC;&#x153;We didnâ&#x20AC;&#x2122;t necessarily know that [NKCDCâ&#x20AC;&#x2122;s] letter was happening, and we are not asking the gardeners to leave our parcels,â&#x20AC;? said Jamila Davis, a spokeswoman for the Redevelopment Authority.

When ďŹ rst reached by phone on Friday, Cascone said that NKCDC had no imme-

diate development plans for the land. He stood wholeheartedly by the letter. â&#x20AC;&#x153;Thereâ&#x20AC;&#x2122;s no support of this garden outside of the people who are gardening it,â&#x20AC;?

Cascone told PW. â&#x20AC;&#x153;Thereâ&#x20AC;&#x2122;s not that many people doing it either.â&#x20AC;?

He also cited the drug use, homelessness and crime that notoriously plague the area as well as the garden space â&#x20AC;&#x201D; a liability for the nonproďŹ t. In the same breath, he said that NKCDCâ&#x20AC;&#x2122;s move to end the agreement marked a â&#x20AC;&#x153;sad course of events for the neighborhood.â&#x20AC;?

Neither garden stewards nor neighbors disputed the problems, but they did take offense to Casconeâ&#x20AC;&#x2122;s portrait of an unloved garden. â&#x20AC;&#x153;Iâ&#x20AC;&#x2122;m not sure why [Cascone] discounts the neighbors of the garden,â&#x20AC;? Amanda Fury said. â&#x20AC;&#x153;They like having the green space.

They donâ&#x20AC;&#x2122;t like the drug activity on the block, but they like having the green space.

I havenâ&#x20AC;&#x2122;t talked to a single person that said theyâ&#x20AC;&#x2122;d rather the garden be bulldozed than have the green space there, so [Cascone] must be talking to a very different group of people.â&#x20AC;?

Peter Springstead, who has lived adjacent to the vacant lots for 25 years, called the garden an â&#x20AC;&#x153;asset.â&#x20AC;? Retired, he spends most of his days on the block listening to music and observing the street life. â&#x20AC;&#x153;I know all the neighbors on the backside of the garden,â&#x20AC;? Springstead said. â&#x20AC;&#x153;I think theyâ&#x20AC;&#x2122;re all fond of having the garden here.

Of course there are small problems, and of course the rhetoric gets a little heavy, but itâ&#x20AC;&#x2122;s not about the garden.â&#x20AC;?

This quarter of East Kensington is experiencing a deluge of development, with newly constructed homes listing as high as $400,000. On the block of the garden, many nearby renters relocated after a New York-based developer purchased several apartment buildings, some of which were renting single rooms. Across the street, construction crews recently broke ground on 30 new townhomes, and a 178-unit mixed-use development called Woods Square is slated for development on the former Woods Brothers lumberyard.

In subsequent interviews, Cascone said again that he was unaware of residents who supported the garden, and questioned whether they were â&#x20AC;&#x153;owners or renters.â&#x20AC;?

And yet, in the midst of backlash, NKCDC, the Redevelopment Authority and Squillaâ&#x20AC;&#x2122;s ofďŹ ce conďŹ rmed they returned to the bargaining table that would help keep the garden in place.

Cascone said NKCDC is now open to negotiate a new MOU for the upcoming growing season, while the longer-term land use arrangement gets sorted out. Why the

mixed messages? â&#x20AC;&#x153;The fact of the matter is I just resolved this matter thatâ&#x20AC;&#x2122;s been going on for 10 years,â&#x20AC;? Cascone told a reporter, adding that he believed a â&#x20AC;&#x153;thank youâ&#x20AC;? was in order rather than criticism.

Cascone said he had apologized to Nick Fury for sending the letter without notice.

He also asked Fury for an apology for sharing false information with a reporter from The Star newspaper regarding when NKCDC actually obtained rights to the land.

Until recently, gardeners and even some city ofďŹ cials were under the impression that NKCDC acquired the lots after the community garden had already been established.

That would be the case if NKCDC purchased deeds to the two parcels in March 2011, as real estate records indicate. But back in 2001, the development corporation had signed an agreement through the cityâ&#x20AC;&#x2122;s somewhat defunct Donor Taker program.

It took a decade to secure the actual deed, and according to Fury, the original binding agreement wasnâ&#x20AC;&#x2122;t shared with gardeners until last month.

Maria Mendez, a Kensington-based realtor whose ofďŹ ce sits blocks from the garden, said that an equitable agreement from 2001 could have the same legal standing as a deed. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s not that they acquired it the time, but there was a contract,â&#x20AC;? she said.

Fury said that he is looking forward to renewed negotiations and an agreement in writing. A spokeswoman for the Redevelopment Authority could not conďŹ rm the details of ongoing negotiations, noting that all land transfers must be approved by the agencyâ&#x20AC;&#x2122;s board.

Years back, NKCDC sought to exchange its two garden parcels with the city in exchange for a half-acre of land north of the Lehigh Avenue corridor, where the nonproďŹ t is about to open its new headquarters, but Squillaâ&#x20AC;&#x2122;s ofďŹ ce balked at the swap.

More recent negotiations have focused on a lot swap between NKCDC and the Redevelopment Authority so that the garden may continue operating on at least three contiguous parcels. But in this case, a municipal statute mandates that NKCDC would have to develop those parcels within two years, or risk losing them.

NKCDC is raising money to create an orchard on a mixture of public and privately owned lots just a few blocks north of the garden. According to the fundraiser, the Frankford Avenue Gateway will feature cane fruit, shade trees, and â&#x20AC;&#x153;a pervious parking area with recycled concrete for popup shops to utilize." The Democratic Socialists of Philadelphia were the catalysts behind last Fridayâ&#x20AC;&#x2122;s rush hour protest, a demonstration fueled by U.S. airstrikes in attacks on Syria.

New Kids on the Block

Democratic Socialists continue to capitalize on establishment failures with grassroots organizing

unning from a downpour and into the atrium of the Fox School of Business on Templeâ&#x20AC;&#x2122;s campus was Dustin Guastella, the bright-eyed aspiring capitalists bustling around us as we talked socialism.

It was here at Temple, as a senior in 2013, where Guastella ďŹ rst got involved with the Philly chapter of the Democratic Socialists of America. He was among the ďŹ rst wave of young recruits catalyzed by the Occupy movements to join the 35-yearold political organization.

Now as a member of the Steering Committee, he has been witness to a second, more overwhelming wave of engagement, one sparked in large part by the ďŹ rebrand campaign of self-described Democratic Socialist Bernie Sanders. While the Vermont senator has no afďŹ liation with DSA, his $35,/

loss in the 2016 primary election left his diehard base with little political refuge. The Democrats had failed them, and President Trump was in the White House.

DSA nationwide, an organization in existence since 1982, had a little more than 6,000 dues-paying members across the country this time last year. Currently, there are some 20,000 among their ranks, spread across 120 chapters in 42 states and D.C., according to a DSA national spokesperson.

Phillyâ&#x20AC;&#x2122;s numbers have jumped from around 150 to 500, since January 2015.

Other cities have followed a similar pattern D.C.â&#x20AC;&#x2122;s chapter jumped from 300 in January 2015 to 350 in October of last year, and then doubled to 700 since Trumpâ&#x20AC;&#x2122;s election, though a Baltimore chapter opened recently which draws some membership away from the chapter. And NYC went from 350 in January 2015 to 850 right before the election in October. Its total mem-

bership now sits at 2,000.

In relation to the total electorate, of course, the DSAâ&#x20AC;&#x2122;s Philly chapter membership barely registers. But every member pays dues, based on their self-identiďŹ ed income level and what they can afford, in true socialist form. Itâ&#x20AC;&#x2122;s a formula that they believe results in a more active, inspired movement that allows the members a say in tactics and policy craft.

In Philly, one of the main reasons behind the inďŹ&#x201A;ux of DSAâ&#x20AC;&#x2122;s dues-paying members is the blistering sense that while many on the right are out-and-out â&#x20AC;&#x153;ghouls,â&#x20AC;? and have in store a number of destructive policies, those representatives â&#x20AC;&#x153;on the liberal leftâ&#x20AC;? â&#x20AC;&#x201C; those tasked with resisting the far right agenda that the Trump administration has itemized â&#x20AC;&#x201C; â&#x20AC;&#x153;are sort of hapless, and donâ&#x20AC;&#x2122;t know whatâ&#x20AC;&#x2122;s going on,â&#x20AC;? Guastella said.

Guastella said many assumed if they just showed the Democrats that â&#x20AC;&#x153;Bernie would have wonâ&#x20AC;? the general, as the meme goes, they would recognize the errors of their ways and adopt the Vermont senatorâ&#x20AC;&#x2122;s approach to politicking and messaging going forward.

Melissa Naschek, 22, joined the chapter after the election, and kicked herself for not supporting Bernie earlier on. â&#x20AC;&#x153;I was sort of like, in general, not super plugged into politics â&#x20AC;Ś I was following the election but with not much of a political opinion,â&#x20AC;? Naschek said. â&#x20AC;&#x153;During the election, I would say things like â&#x20AC;&#x2DC;Iâ&#x20AC;&#x2122;m glad Bernieâ&#x20AC;&#x2122;s in the election but he canâ&#x20AC;&#x2122;t win so I hope Hillary wins. But I think heâ&#x20AC;&#x2122;s good for the discourse.â&#x20AC;&#x2122; But I was also never a super Hillary fan, I just sort of bought into the narrative that sheâ&#x20AC;&#x2122;s the pragmatic choice.

Sheâ&#x20AC;&#x2122;s who can get elected, and I want a Democrat in ofďŹ ce, I donâ&#x20AC;&#x2122;t want a Republican.â&#x20AC;?

Conventional explanations for why Clinton lost, however, didnâ&#x20AC;&#x2122;t cut it for Naschek. â&#x20AC;&#x153;Before, I think I was just passively a neoliberal. I didnâ&#x20AC;&#x2122;t really question capitalism at all,â&#x20AC;? she said. â&#x20AC;&#x153;After Trump won, I was sort of dissatisďŹ ed with what everyone was saying about the post-election analysis,â&#x20AC;? such as Van Jonesâ&#x20AC;&#x2122; â&#x20AC;&#x153;white lashâ&#x20AC;? explanation, or â&#x20AC;&#x153;that people hated Hillary because she was a woman. That didnâ&#x20AC;&#x2122;t really satisfy me so I started to seek out alternative sources â&#x20AC;Ś and then in the span of like two months I was like â&#x20AC;&#x2DC;yeah, fuck capitalism. Iâ&#x20AC;&#x2122;m a socialist now.â&#x20AC;&#x2122;â&#x20AC;?

Itâ&#x20AC;&#x2122;s a precarious historical moment for the left â&#x20AC;&#x201C; liberal or socialist â&#x20AC;&#x201C; given the massive changeover at the state and federal level of Republicans in previously-Democratic seats. Nationwide, the DSA has attracted

malcontents with a focus on physical demonstration and direct action, capturing a youthful energy they see as vital to fueling a political movement.

In Philly, their red â&#x20AC;&#x153;Socialism or Barbarismâ&#x20AC;? signs dotted the crowds in January at Philadelphia International Airport during a protest of Trumpâ&#x20AC;&#x2122;s travel ban from seven majority-Muslim countries. They could also be seen at the womenâ&#x20AC;&#x2122;s march on Ben Franklin Parkway, and nearly every other resistance demonstration in Philly since Trump took ofďŹ ce.

Thereâ&#x20AC;&#x2122;s signiďŹ cant overlap with the frustrations of new DSA members and the frustrations of Trumpâ&#x20AC;&#x2122;s diehard base, namely economic anxieties, and a fading hope that those in charge, both Democrat and Republican, want to do anything about it.

DSAâ&#x20AC;&#x2122;s main demographic isnâ&#x20AC;&#x2122;t the white working class, however. â&#x20AC;&#x153;The best way to deďŹ ne it is downwardly-mobile millennials, folks who maybe went to college or didnâ&#x20AC;&#x2122;t, but were expecting to have the sort of standard middleclass package,â&#x20AC;? Guastella said. â&#x20AC;&#x153;The standard American middle-class package. And now what theyâ&#x20AC;&#x2122;re getting in return is saddled with a bunch of student debt if they went to school, not many jobs, not much advancement if theyâ&#x20AC;&#x2122;re in jobs.â&#x20AC;?

Marc Schwoerer, 43, said what ďŹ nally pushed him to join DSA was the Philadelphia Democratsâ&#x20AC;&#x2122; failure to stand behind the striking SEPTA workers that coincided with Novemberâ&#x20AC;&#x2122;s election. â&#x20AC;&#x153;You had the [Democrat] mayor and a Democrat governor both trying to get injunctions against the union and that really was like the last straw for me with Democrats,â&#x20AC;? Schwoerer said.

It was a failure indicative of what he sees as a decades-long crawl the Democrats have made away from labor as a central source of political agitation. â&#x20AC;&#x153;It got to the point between labor and the Democrats where the Democrats felt that labor worked for them instead of the other way around,â&#x20AC;? Schwoerer said. â&#x20AC;&#x153;They just became to them basically a ďŹ nancial clearinghouse,â&#x20AC;? a slush fund to procure ground game and funds, â&#x20AC;&#x153;and then they ignore their needs.â&#x20AC;?

Margaret McLaughlin, 27, has been a political organizer for years, but only joined the D.C. chapter of the DSA on Election Day, a decision she planned out weeks before regardless of the electionâ&#x20AC;&#x2122;s victor. Sheâ&#x20AC;&#x2122;ll be up for election for their Steering Committee next month.

ments. â&#x20AC;&#x153;I think a lot of cities have a lot of young people that have lived their entire lives under the binary political system but have always identiďŹ ed as left of Democrats,â&#x20AC;?

McLaughlin said, â&#x20AC;&#x153;and now theyâ&#x20AC;&#x2122;re realizing the failing of the Democratic Party and neoliberalism writ-large.â&#x20AC;?

And municipal politics have long-excluded the young and energized, she says. â&#x20AC;&#x153;If you look at the Democratic Party in Philadelphia, thereâ&#x20AC;&#x2122;s very little inroads for people in their 20s, millennials, to get involved,â&#x20AC;? McLaughlin said. â&#x20AC;&#x153;Weâ&#x20AC;&#x2122;re shut out. So we start forming our own organizations, our own social networks, support structures, and we all move to the left together.â&#x20AC;?

The DSAâ&#x20AC;&#x2122;s social media presence is a living web of in-jokes, organic memes and adversarial interactions with establishment politicos. And itâ&#x20AC;&#x2122;s fun. Comparatively, the Democratsâ&#x20AC;&#x2122; attempts to reach out to millennials can seem canned and corporate or worse, like a grandparent asking their grandson how to work email.

More than that, social media offers a chance for connection that wasnâ&#x20AC;&#x2122;t previously available. Leftists, usually scattered about, â&#x20AC;&#x153;are able to talk to each other, and realize that situations are unequal,â&#x20AC;?

McLaughlin said. â&#x20AC;&#x153;We see how quickly things are moving with this administration for example, and twitter allows us to stay on top of that,â&#x20AC;? she said.

Philly is primed for grassroots leftism, Guastella claims, for a variety of reasons: â&#x20AC;&#x153;Phillyâ&#x20AC;&#x2122;s a working class city, more so than other cities on the East Coast, certainly more so than New York and more so than DC,â&#x20AC;? he said. â&#x20AC;&#x153;That I think is the single biggest factor to how we can grow in this city. And the other thing is, like other East Coast cities, the amount of people on the whole who are liberal, or Democrat voters, is much larger. Which automatically means thereâ&#x20AC;&#x2122;s a space to the left that could be occupied.â&#x20AC;?

And entering into that space is the slowtrickling migration of socialist-sympathetic folks who, when approaching local politics, havenâ&#x20AC;&#x2122;t succumbed to the fatalism that has followed the election of Trump for many. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s been optimistic,â&#x20AC;? Schwoerer said, noting the enthusiasm of those recruits much younger than he, â&#x20AC;&#x153;When you look at the demographicsâ&#x20AC;Ś the way that younger people see things, the future belongs to them really. I mean, the people that have the views that DSA has â&#x20AC;Ś Their core constituency is going to continue to grow and 3+,/$'(/3+,$:((./< &20

eventually itâ&#x20AC;&#x2122;s going to be more of a counterweight to what establishment Democrat politics are.â&#x20AC;?

One of the criticisms leveled at the DSA is that there is inherent in their aims a naivete, a lack of understanding of what is and is not possible within the bounds of the American political system. If you ask those involved in the group, they would counter that the failure of the Democrats to accomplish what used to be commonplace goals is not proof of what the system can or canâ&#x20AC;&#x2122;t handle. One criticism Guastella said he thinks is fair, though he disagrees, is that before you can go about building the left, you must ďŹ rst construct a solid and healthy center. The idea instead, he says, is to push left and let the stragglers catch up.

One straggler, Naschek, said she got on board with the Philly chapter because their membership was sizable compared to other groups of a similar bent. â&#x20AC;&#x153;Once my politics changed I immediately was like â&#x20AC;&#x2DC;okay, I need to do something; I need to get involved,â&#x20AC;&#x2122;â&#x20AC;? she said. â&#x20AC;&#x153;I liked the fact they have kind of like a â&#x20AC;&#x2DC;big tentâ&#x20AC;&#x2122; philosophy. Thereâ&#x20AC;&#x2122;s no sort-of requirement that you must believe X, Y, and Z in order to be a member. I like that itâ&#x20AC;&#x2122;s very inclusive, and that thereâ&#x20AC;&#x2122;s even debate within the DSA.â&#x20AC;?

The chapter is still ďŹ&#x201A;edgling despite the considerable boost following the election, and, given the â&#x20AC;&#x153;big tentâ&#x20AC;? nature of the organization, thereâ&#x20AC;&#x2122;s often disagreement on tactics, such as how much engagement the organization should have with establishment Democrats in the city. Guastella thinks the opposition to collaborating with their liberal peers in city elections springs from a misunderstanding of how open American political parties are at a local level, in stark juxtaposition to the fencedoff nature of the DNC. â&#x20AC;&#x153;The Democratic Party, especially in Philadelphia, is not a uniďŹ ed, unitary block,â&#x20AC;? he said. â&#x20AC;&#x153;There are people who are very progressive and who like us and who are friendly with us and want to work with us. And then there are folks who are very standofďŹ sh, and they think that weâ&#x20AC;&#x2122;re a threat or weâ&#x20AC;&#x2122;re hurting their chances of getting elected and stuff like that.â&#x20AC;?

In the meantime, Guastella says, they will continue to pull the conversation leftward. â&#x20AC;&#x153;I think thereâ&#x20AC;&#x2122;s a good chance that many of them â&#x20AC;&#x201C; who are learning the lessons from the recent election â&#x20AC;&#x201C; will consistently move closer to our positions,â&#x20AC;? he continued. â&#x20AC;&#x153;Because now weâ&#x20AC;&#x2122;re out there showing a signal.â&#x20AC;? efore I get the ďŹ&#x201A;ood of hate mail to an already overcrowded inbox, know this: Prior to taking this position, I was out on the front lines of protests all over the city.

But when is it overkill?

Last Friday, thatâ&#x20AC;&#x2122;s when. Center City streets were clogged around City Hall and points south right at rush hour for a protest led by the Democratic Socialists of Philadelphia in response to last Thursdayâ&#x20AC;&#x2122;s targeted attacks on a military base in Syria. The same base believed to be the site that spawned a deadly chemical gas attack on its own people crippling men, women and children.

In less than a week, the Trump administration had a response for the images that shocked even the hardest heart (perhaps even the one of our Nationâ&#x20AC;&#x2122;s President) with targeted airstrikes (59 by way of Tomahawk missiles to be exact) on a military base destroying aircraft, a hangar, a runway and a few Syrian soldiers.

For me, this is probably the only thing that President Trump has done in his short-lived time in ofďŹ ce that actually seemed justiďŹ able.

It was a warning that didnâ&#x20AC;&#x2122;t affect the lives of civilians, but showed that America isnâ&#x20AC;&#x2122;t a country that will just sit back and watch atrocities and do nothing.

Could there be ulterior motive behind the attacks? Who knows, I donâ&#x20AC;&#x2122;t sit in the Oval OfďŹ ce but at a desk in Cherry Hill, N.J., but I do know that knocking out this base sent a message not only to the Assad regime, but to asshats everywhere bent on terrorism that we donâ&#x20AC;&#x2122;t fuck around when it comes to that shit. $35,/

It was something President Obama, my President, didnâ&#x20AC;&#x2122;t do in his eight years of ofďŹ ce admitting as much to media members and historians that his stance on Syria and sending a subsequent message wasnâ&#x20AC;&#x2122;t as strong as it needed to be. I commend his honesty.

Iâ&#x20AC;&#x2122;m not sure the current guy would admit as much, but again with this attack Donald proved heâ&#x20AC;&#x2122;s full of surprises.

On Friday morning, our resident freelancer Danielle Corcione, who took the awesome pictures inside this weekâ&#x20AC;&#x2122;s issue (on pages 4-5) told me of her intent to cover the protest and while I sent her out on our behalf, I was still dismayed. It was a protest that just didnâ&#x20AC;&#x2122;t make sense. There have been myriad attacks on Syria involving ďŹ ghter jets and gunships from all over the world including the U.S. and the one that disrupts a downtown drive time is the response to a Sarin gas attack? â&#x20AC;&#x153;The real resistance to the Trump agenda recognized the need to take up opposition to his administrationâ&#x20AC;&#x2122;s aggression against Syria,â&#x20AC;? explains Walter Smolarek, an organizer for the PSL Philadelphia chapter and writer for LiberationNews.org said during the protest.â&#x20AC;&#x153;The Trump administration may target another country next, or deepen its intervention in Syria, so we will be alert and ready to mobilize.â&#x20AC;?

Dude, maybe but in this case, no.

Hereâ&#x20AC;&#x2122;s the thing...we are currently involved in wars all over the world and have military personnel stationed all over the world to be ready at a momentâ&#x20AC;&#x2122;s notice in the event one of these wars turns its eyes toward America. Some of these wars are there only to serve certain interests and some are legitimate gripes we have with tyrannical leaders like Bashar-Al-Assad. If bombing a military airbase to pause the threat of chemical gas attacks on a group of people is the case, then then so be it.

If Trump really wants to do the right thing heâ&#x20AC;&#x2122;d drop these stupid so-called travel bans and allow those people asylum. But baby steps here. And his baby steps are blowing a Syrian airbase to hell to stop hell. You want to debate this? I love debates. Letâ&#x20AC;&#x2122;s chat. Staff members at the Mazzoni Center walked out in a â&#x20AC;&#x153;sign of solidarityâ&#x20AC;? stemming from a recent report against a Mazzoni medical professional.

taff members at the Mazzoni Center walked off work Tuesday morning in what several identiďŹ ed as â&#x20AC;&#x153;solidarity with patients and the community.â&#x20AC;?

However, none of the nearly two dozen employees who work at the LGBT medical, health and counseling facility were willing to be identiďŹ ed by name, for fear of retribution or termination. When asked by PW if this was a protest, one caseworker said it was more of a symbolic gesture, â&#x20AC;&#x153;a protest to show concern about patients being harmedâ&#x20AC;? but emphasized they were not stopping work and were not missing patient appointments.

Another current employee said â&#x20AC;&#x153;it saddens me to be here,â&#x20AC;? and wanted â&#x20AC;&#x153;transparencyâ&#x20AC;? from the leadership to â&#x20AC;&#x153;frontline workers.â&#x20AC;?

Tuesdayâ&#x20AC;&#x2122;s walkout stemmed from the absence of Robert Winn, medical director at the Mazzoni Center, currently on paid leave. According to sources, Winnâ&#x20AC;&#x2122;s status is pending an internal investigation.

Police blocked doors to Mazzoni Center to outsiders and repeated attempts for comments from the Center have been ignored. In fact, Mazzoni has yet to make a public statement, $35,/

but when pressed for comment from executive director Nurit Shein, Perry Monastero, Mazzoniâ&#x20AC;&#x2122;s director of development and marketing at conďŹ rmed that Dr. Winn, who has overseen the centerâ&#x20AC;&#x2122;s medical operations since 2004, is taking a leave of absence. â&#x20AC;&#x153;Dr. Winn is on paid leave,â&#x20AC;? Monastero said. â&#x20AC;&#x153;We have no further comment.â&#x20AC;?

The story regarding Winnâ&#x20AC;&#x2122;s unexplained absence was ďŹ rst reported by Philadelphia Magazine.

Abdul-Aliy Muhammad, a former employee of Mazzoni who is close to current staff, told PW Mazzoni leadership has long been aware of and slow to address complaints against Winn. Muhammad led the charge in a petition to force Mazzoniâ&#x20AC;&#x2122;s executive director Nurit Shein from her post in addition to whistleblowing numerous offenses he and multiple former and current staffers claim exist within the Center.

A mix of seven current and former employees, who requested anonymity for fear of retribution from the agency, stated they would not only lose their job for speaking publicly, but likely would not be hired at another facility. One source speciďŹ cally cited Pennsylvaniaâ&#x20AC;&#x2122;s lack of legal protection for whistleblowers.

In 2002, the State of Pennsylvania passed the SarbanesOxley Act which holds employers in violation for retaliating against or terminating an employee for reporting misconduct. However, that act applies only to public companies and organization; private or nonproďŹ t organizations like the Mazzoni Center donâ&#x20AC;&#x2122;t necessarily fall under the same guidelines. â&#x20AC;&#x153;Despite this, Dr. Winn continued to be the clinical director and see patients,â&#x20AC;? the former employee said.

Since he started at the Mazzoni Center, Winn has won multiple awards for his work in LGBT health and served as co-grand marshal of the Philadelphia Pride Parade in June 2010. He has also been employed at Thomas Jefferson University, in the Department of Family Medicine since 2001, training medical students and residents. He has not yet publicly commented on the accusations but reportedly denied them to Mazzoni staff during an ofďŹ ce meeting this spring.

The Black and Brown Workers Collective has also accused Winn of improper hiring and payment practices, as well as quid pro quo arrangements for narcotic drugs, according to a Change.org petition created by the intersectional activist group.

The BBWC made these allegations publicly in February to Shein during the Mazzoni Centerâ&#x20AC;&#x2122;s annual Justice in Action event. They called for the resignations of both Winn and Shein, claiming â&#x20AC;&#x153;Mazzoni Center has created a culture and practice of violence,â&#x20AC;? also accusing the agency of systemic racism in treatment of employees and intimidation of whistleblowers.

The Mazzoni Center provides medical care, HIV testing and treatment, health education, counseling and other services. It has community partnerships with several local nonproďŹ ts and receives funding from a variety of sources, including public money. In 2016, the organization received a $1.5 million award from the Commonwealth of Pennsylvania through the Redevelopment Assistance Capital Program, the largest grant ever towards an LGBT-focused organization from the Commonwealth.

pril in Philly is ďŹ&#x201A;owers, seasonably warmer temperatures and outdoor happy hours.

Itâ&#x20AC;&#x2122;s also Jazz Appreciation Month, highlighted by a single-day celebration of sound on April 29. This yearâ&#x20AC;&#x2122;s Center City Jazz Festival is a potent distillation â&#x20AC;&#x201C; a jolt of heady port from an already intoxicating vintage wine served at ďŹ ve different venues across Center City.

This year, Time (1315 Sansom St.), Fergieâ&#x20AC;&#x2122;s Pub (1214 Sansom St.), Franky Bradleyâ&#x20AC;&#x2122;s (320 Chancellor St.), Chrisâ&#x20AC;&#x2122; Jazz CafĂŠ (1421 Sansom St.) and Milkboy on Chestnut Street (1100 Chestnut St.), from 1-8pm. Created as a Kickstarter project by Ernest Stuart, a Temple University alum and avid trombonist, the scope of the sixth installment of the event encompasses all micro-divisions of Americaâ&#x20AC;&#x2122;s untamed classical music in a fashion similar to its artistic directorâ&#x20AC;&#x2122;s musical career.

As soloist-band leader, or as one-time member of Brooklyn-Bhangra act Red Baraat, Stuart has jumped from straight-ahead standards, be-bop, free jazz, samba, salsa and beyond. So too do the acts that ďŹ ll this yearâ&#x20AC;&#x2122;s festival, as well as its ďŹ ve previous iterations. â&#x20AC;&#x153;CCJF is important because it throws a spotlight on a genre of music that's become increasingly marginalized [while at the same time] recognizing and highlighting the depth and diversity of $35,/

Stuartâ&#x20AC;&#x2122;s goals for the initial Center City Jazz Fest started from a place of hurt, then healing. â&#x20AC;&#x153;My incentive was the ďŹ rst closing of Ortliebâ&#x20AC;&#x2122;s Jazz Haus, a homebase to many of the cityâ&#x20AC;&#x2122;s jazz musicians whom I loved,â&#x20AC;? Stuart said. â&#x20AC;&#x153;Things were not looking up for jazz in Philly at that time,

so I decided to do something to help.â&#x20AC;?

Saxophonist Tom Moon attended the inaugural fest and was hooked. â&#x20AC;&#x153;I went thinking I'd catch a few people in the afternoon for a couple of hours, but instead ended up there all day and night, seeing artists I knew and artists I'd only heard about the day before,â&#x20AC;? Moon recalled. â&#x20AC;&#x153;Even when the venues were crowded, the vibe was low-key and chill.â&#x20AC;?

He added: â&#x20AC;&#x153;This event works for a couple of key reasons: The performances happen in clubs, not concert halls â&#x20AC;&#x201C; that's big, since so much of this music developed in these kinds of settings. There's something truly wonderful about seeing an intimate performance in the upstairs room at Fergieâ&#x20AC;&#x2122;s and then returning to the street and being magnetically drawn to some amazing group through the open windows at Time.â&#x20AC;?

Now, after several years of sold-out events, Stuart claims that venues aren't as skeptical as they were when CCJF ďŹ rst began. With events running without a hitch, clubs are willing to do what it takes to accommodate CCJFâ&#x20AC;&#x2122;s needs. As do the 20 bands and sound studios that ensure the events run on time, a communal vibe that makes CCJF into as much of a party as it is a celebration of music. â&#x20AC;&#x153;Thereâ&#x20AC;&#x2122;s a social aspect to all this that doesn't always happen at high-dollar festivals or, for that matter, in other major cities,â&#x20AC;? notes Moon, who sees the musicians of Philadelphia as endlessly curious and supportive, and numbers himself amongst their ranks. â&#x20AC;&#x153;They're out every night and will be out to soak up what's going on at this festival. In one very real sense, their energy makes the festival.â&#x20AC;?

For veteran Philly jazz musicians such as Moon (whose Ensemble Novo plays the fest) and guitarist Monnette Sudler, they see the CCJF as central to the community that thrives within that six-block circle. â&#x20AC;&#x153;Since itâ&#x20AC;&#x2122;s based [right in Center City], it will attract visiting jazz lovers to attend,â&#x20AC;? says Sudler. â&#x20AC;&#x153;I believe the jazz community is buzzing. Promoters are promoting it. More festivals are sprouting up. There are a few jazz clubs that are well known and many underground spots as well. Musicians are plentiful.

Unfortunately, the ratio-of-musicians-playing-toplaces-to-work is not balanced. But the love of music is there and people are educating themselves on many levels.â&#x20AC;?

While Moon points out that the â&#x20AC;&#x153;old-heads are marvels and the young players are marvels in their own way,â&#x20AC;? Jon Smith, the lead for the band Below Zero will feature as one of CCJFâ&#x20AC;&#x2122;s â&#x20AC;&#x153;young headsâ&#x20AC;? for 2017. Smith, currently recording a double album for winter release, recognizes that fact and raises the stakes. â&#x20AC;&#x153;The more established musicians have taken the newer musicians under their wing and helped us along,â&#x20AC;? said Smith. â&#x20AC;&#x153;Most of my inďŹ&#x201A;uences are Philly musicians and in my opinion we have the best musicians in the world. This festival is a show of that strength.â&#x20AC;? Q

After the dust settled on the fiasco that was a special election for the House of Representatives in the 197th District, Emilio Vazquez emerged victorious as the latest leader of the district.

New rep, broken district Emilio Vazquez takes the helm of an office whose last two officials left as felons

he bar isnâ&#x20AC;&#x2122;t very high for newly minted state Rep. Emilio A. Vazquez.

The last two elected ofďŹ cials to represent North Phillyâ&#x20AC;&#x2122;s 197th House District in Harrisburg left ofďŹ ce in disgrace: former state Rep. Jose â&#x20AC;&#x153;J.P.â&#x20AC;? Miranda went down over a ghost employee scam and Mirandaâ&#x20AC;&#x2122;s successor, former state Rep. Leslie Acosta, pleaded guilty to running a money laundering scheme.

Vazquez, a Brooklyn native who moved to Hunting Park with his family in the 1970s, said itâ&#x20AC;&#x2122;s a new day for his district. â&#x20AC;&#x153;What happened with the past two district representatives, I donâ&#x20AC;&#x2122;t have anything to do with it,â&#x20AC;? Vazquez told PW. â&#x20AC;&#x153;But moving forward, Iâ&#x20AC;&#x2122;ll make sure that I win the conďŹ dence of the voters in the 197.â&#x20AC;? $35,/

The 197th District, a gerrymandered wedge of predominantly Latino and African American neighborhoods, is in many ways the face of Philadelphiaâ&#x20AC;&#x2122;s seemingly intractable poverty rate. The median household income in parts of the district sits as low as $17,106, according to a recent Pew report.

Vazquez, 49, has long spearheaded the cityâ&#x20AC;&#x2122;s 43rd Ward and had run unsuccessfully for elected ofďŹ ce before. A member of the bickering clans that make up North Phillyâ&#x20AC;&#x2122;s Latino strongholds, he now must work with past rivals in Councilwoman Maria QuĂ­Ăąones-SĂĄnchez and state Rep. Angel Cruz.

Perennial promises to bury the hatchet for the good of the barrioâ&#x20AC;&#x2122;s constituents are hardly news, but Vazquez says that he intends to keep the peace this go-round. â&#x20AC;&#x153;Iâ&#x20AC;&#x2122;m going to be calling [QuĂ­Ăąones-SĂĄnchez] and Iâ&#x20AC;&#x2122;m going to be calling [Cruz] to

make sure weâ&#x20AC;&#x2122;re all on the same page for the embetterment of the district,â&#x20AC;? he said.

But Vazquez acknowledged he will stay at the helm of his conďŹ&#x201A;ict-prone ward, joining a lengthy list of elected Democrats who also double as ward leaders.

His role as a ward leader was instrumental during the bizarre special election that followed Acostaâ&#x20AC;&#x2122;s abrupt ouster as Vazquez, despite his early interest, wasnâ&#x20AC;&#x2122;t the partyâ&#x20AC;&#x2122;s ďŹ rst choice. He ultimately won with a last -minute write-in campaign after his partyâ&#x20AC;&#x2122;s nominee, Fred Ramirez, was booted from the ballot for failing to meet residency requirements.

The results of that election are being challenged by a lawsuit ďŹ led by the Republican and Green Party candidates whom Vazquez trounced on March 21.

In a recent interview, former Gov. Ed Rendell called on U.S. Congressman and Democratic City Committee Chairman Bob Brady to strip ward leadersâ&#x20AC;&#x2122; power, saying their self-interest had contributed to ďŹ ascos like the 197th special election. Brady didnâ&#x20AC;&#x2122;t bite.

Vazquez seems comfortable enough with his current arrangement. Asked about how he would juggle the roles, he said, â&#x20AC;&#x153;I have to follow the ethics for the ofďŹ ce I was sworn in for,â&#x20AC;? promising to separate his political operations from his day-to-day legislative duties.

Prior to taking ofďŹ ce, Vazquez worked for the Philadelphia Parking Authority.

He started as a ticket writer in 2003, and climbed rank to become a revenue auditor at the airport, where he was making $58,220 per year at the time of his departure.

On March 31, Vazquez received a payout of $3,294.75 for 117 hours of accrued holiday, vacation, administrative leave, and comp time, according to PPA spokesman Martin Oâ&#x20AC;&#x2122;Rourke.

Vazquez said he was charged with monitoring the money that comes in from the cashiers at the airportâ&#x20AC;&#x2122;s toll booths. â&#x20AC;&#x153;At the end of the week, we would sum up how much money we made and make sure that it was accurate. If anybody was short, we would write them up,â&#x20AC;? Vazquez said, adding that his ďŹ nancial experience will be a beneďŹ t to the district.

In the mid-2000s, Vazquez was hit with several tax liens, one as high as $34,160.76.

He ďŹ led for bankruptcy and the liens have been resolved for more than a decade. â&#x20AC;&#x153;That was 10 years ago,â&#x20AC;? Vazquez said. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s been taken off my credit report.â&#x20AC;? Q TWITTER: @MAXMMARIN

THE BACKSTORY

Back door deal grants Tacony sex-positive club zoning permit A

dvocates of a proposed â&#x20AC;&#x153;sexpositiveâ&#x20AC;? community center in Tacony showed up for an April 5 hearing in front of the cityâ&#x20AC;&#x2122;s Zoning Board of Adjustment, and so did several skeptical neighbors. But a hearing for the controversial Philly Music Hall never transpired.

Instead, the community centerâ&#x20AC;&#x2122;s attorney asked for a postponement of the session that might have granted it a permit to open legally at 4815-19 Longshore Ave. Then a couple of days later, Philly Music Hall obtained its needed permit anyway, without a hearing and despite overwhelming objection from the surrounding community.

Now, City Councilman Bobby Henon, state Sen. John Sabatina and state Rep. Mike Driscoll are lining up behind the Tacony Civic Association to mount a legal challenge to the permit.

On Monday, the lawmakers and civic leaders co-signed a letter addressed to the cityâ&#x20AC;&#x2122;s Department of Licenses and Inspection stating their intent to ďŹ le an appeal, which could trigger another zoning board proceeding. They have just under a month to ďŹ le a formal appeal. â&#x20AC;&#x153;The community wants a ruling from the zoning board on what the use is and if itâ&#x20AC;&#x2122;s a regulated use,â&#x20AC;? Henon told the Northeast Times. â&#x20AC;&#x153;It will be up to the zoning board and the courts.â&#x20AC;?

The letter states in part: â&#x20AC;&#x153;We believe that this use permit was issued by the department in error. Based on the applicantâ&#x20AC;&#x2122;s own public statements, advertising and promotional materials, we believe the applicantâ&#x20AC;&#x2122;s use to be a regulated adult-oriented use and therefore prohibitedâ&#x20AC;? by the Longshore propertyâ&#x20AC;&#x2122;s commercial zoning.

The spokeswoman for Philly Music Hall, Deborah Rose Hinchey, declined an interview request for this report.

She issued a written statement clarifying the basic mechanics of the permit process. Essentially, her organization $35,/

withdrew its initial zoning application and ďŹ led a new one under a different classiďŹ cation. The Department of Licenses and Inspection granted a use permit based on the new application, deeming the requested use as legal by right, within the context of the zoning code. â&#x20AC;&#x153;After engaging with the communities we serve, as well as the neighborhood we will be operating in, our organization has decided to seek zoning and an organizational structure that more accurately reďŹ&#x201A;ects our mission and values,â&#x20AC;? the Philly Music Club release stated. â&#x20AC;&#x153;We are in the process of ďŹ ling to re-incorporate as a 501(c)(7) non-proďŹ t social club and have applied and received a zoning designation under fraternal organization.â&#x20AC;?

In the initial zoning application, the organization sought what the city refers to as a â&#x20AC;&#x153;night club/private clubâ&#x20AC;? designation, allowing it to offer live entertainment for more than 50 people.

Now, with the fraternal organization permit in hand, the club would be limited to up to 50 people at a time. Access would be limited to dues-paying members and their guests, much like a traditional American Legion, Knights of Columbus, Sons of Italy or Hibernian club.

But during a public community meeting on March 23 and in the subsequent statement, Hinchey and other club representatives have described their very non-traditional mission. Their intent is to create a â&#x20AC;&#x153;safe, members-only space for the alternative sexual communities of Philadelphia.â&#x20AC;? Alt-sex is a broad term that includes people of varying sexual identities, inclinations and preferences, people who often feel marginalized or worse by mainstream society.

Philly Music Hall, which takes its name from the historic Tacony Music Hall that it will occupy, will seek to offer recreational, educational and social programming for its members. Alcohol

and drug use will be banned there. People will not be encouraged to have sex or paid to have sex there, but attendees will not be banned from engaging in consensual sex, Hinchey said. It will be an adults-only venue.

At the end of the March 23 meeting, Tacony residents voted 81-18 to oppose the club. The civic association sent a letter of opposition to the zoning board, but it became moot when the Music Hall folks withdrew their application.

In their imminent appeal, the civic association and elected ofďŹ cials are likely to challenge whether the sexual activity permitted by the club should be required to get a special adult-oriented use designation. â&#x20AC;&#x153;The applicant made clear and public declarations about her intentions for the use of the property,â&#x20AC;? the civic associationâ&#x20AC;&#x2122;s letter states. â&#x20AC;&#x153;... We do not believe that the use described by the applicant in these public materials was accurately represented in the original use permit application for a nightclub and we are concerned that the applicant did not accurately represent the use on the permit application for a â&#x20AC;&#x2DC;fraternal organizationâ&#x20AC;&#x2122; use permit.â&#x20AC;? ity GOP sources said rumors of local Republican committee chair Joe DeFelice taking a position in Washington, D.C. under the Trump administration were off â&#x20AC;&#x201C; but just slightly.

Multiple sources told City&State PA that DeFelice is now in the running for a regional directorship at the Department of Housing and Urban Development, which oversees and funds certain affordable housing and homeless service efforts.

The job would allow him to remain in the city. DeFelice had reportedly rejected multiple offers to work in the nationâ&#x20AC;&#x2122;s capital, citing a desire to remain close to his family in Northeast Philadelphia.

DeFelice positioned himself as an early, local â&#x20AC;&#x153;hype manâ&#x20AC;? for Trump. A ďŹ nal decision is expected within the coming week. DeFelice did not respond to repeated inquiries on the subject â&#x20AC;&#x201C; unusual for the typically loquacious GOP booster.

The departmentâ&#x20AC;&#x2122;s regional ofďŹ ces function as a liaison between HUD and local housing agencies like the Philadelphia Housing Authority.

HUD Region III has been without a regional administrator since Trumpâ&#x20AC;&#x2122;s election. Based in Philadelphia, the ofďŹ ce covers a sprawling jurisdiction that includes Philadelphia along with the rest of Pennsylvania, Delaware, Maryland, Virginia, West Virginia and Washington, D.C. DeFeliceâ&#x20AC;&#x2122;s departure was expected to reignite a dormant leadership ďŹ ght within the local party â&#x20AC;&#x201C; current VP Mike Cibik was expected to ďŹ ll in as interim director, with businessman Joe McColgan as a possible opponent for the top spot.

My girlfriend and I have been together for about 18 months. She is adamant about monogamy, while I want to be monogamish. I feel strongly that this is who I am sexually and my sexual desires are not something I can change. Because we are so compatible in every other aspect of our relationship, should I keep trying to work past the unsatisfying sex? â&#x20AC;&#x201C; Needs Advice, Want Threesomes Divorce courts are ďŹ lled to bursting with couples who made the same mistake you and your girlfriend are currently makingâ&#x20AC;&#x201D;a mistake that gets harder to unmake with every dog you adopt or lease you sign. Youâ&#x20AC;&#x2122;re not sexually compatible, NAWTâ&#x20AC;&#x201D;and sexual incompatibility is a perfectly legitimate reason to end an otherwise good relationship. The importance of sexual compatibility in sexually exclusive relationships (the kind your girlfriend wants) cannot be stressed enough. Sexual compatibility is important in open and/or monogamish relationships too, of course, but there are workarounds in an open relationship.

The gaslight bar is set so low these days that Iâ&#x20AC;&#x2122;m going to go ahead and accuse your girlfriend of gaslighting you: There are people out there who have the kind of relationship you would like to haveâ&#x20AC;&#x201D;itâ&#x20AC;&#x2122;s a lie that no one has a GGG partner or a successful monogamish relationshipâ&#x20AC;&#x201D;and I have it on good authority that many of these people are straight. Youâ&#x20AC;&#x2122;ll never ďŹ nd everything you want, NAWT, since no one gets everything they want. But youâ&#x20AC;&#x2122;re too young to settle for the girlfriend youâ&#x20AC;&#x2122;ve got.
