What’s illegal? Almost everything!

E

very other day, I come across an illegal construction in HSR Layout. I wonder what’s wrong with our corporation officials, MLA, MP, corporator and ofcourse our residents. After all, it’s the resident building that house or commercial structure. What they don’t realise is that the roads are meant to only take so much traffic. Similarly, the area of the house can get only so much water from the BWSSB. And that goes for electricity as well. That’s how every civic amenity is provisioned when a layout is formed. By building seven houses on a 20x30 feet site, you have practically destroyed this amicable arrangement. There are more cars and bikes to park. There is more garbage being generated. And there is more demand for water and electricity.

To top it all, there are certain residents who are letting out residential houses for commercial purposes. This makes it all the more stressful for residents living nearby. Imagine en masse parking by the office goers. Imagine the constant hiss of the generator.

The worst part of these violations is the chain reaction that follows.

One illegal construction on a road prompts the others building on the same road to follow suit. The result? There are illegal buildings all along the road and across HSR and Bangalore. This is evident on 21st Cross in Sector 3. All the houses are ground plus four floors when they should be ground plus two. And nowhere have they left the entire basement for parking purposes. There will always be half the basement used to build a 1BHK house.

It is time we as citizens introspected among ourselves. Are we blaming others for the rot in the system when the rot lies within us? Are we bribing or threatening somebody to get our job done, however unlawful?

Until next month, come clean. Be a good resident. Act, don’t react.

NEIGHBOURHOOD NEWS TREE CUTTING RAMPANT IN HSR

Tree cutting has become rampant in HSR and both the BBMP and the forest department are looking the other way. “I had complained about one big portion of a very old tree being chopped off next to our apartment boundary illegally,” recalls resident Kamesh Rastogi. “I had managed to stop them for a few hours but no one turned up from the forest department despite assurances on the phone, and the tree was cut eventually.” This is despite calling the men who mattered to stop this: BBMP joint commissioner Muniraju, Assistant engineer Vinayak and forest officer Manjunath. “I had filed the complaint online eight months ago, but there is no action till now.

According to the joint commissioner, if this is illegal, they should be booked with a FIR at the local police station. When I called Manjunath at that time, he asked me to come to Jayanagar to give my complaint in writing. The BBMP helpdesk calls me at regular intervals asking if they can close the complaint and I request them to keep it open. The logical conclusion is to book the defaulter atleast now if we couldn’t save the tree.”

Another office space cut the trunk of a tree to ensure open view of its facade on 22nd Cross in Sector 3. “Circulate this message on all the social media platforms to boycott them. Heights of Selfishness,” says resident activist Shanthi Tummala. Adds fellow resident Kavitha Reddy: “The trees that were chopped in front of a building opposite the Gayathri temple in Sector 2 were also reported to BBMP, but nothing happened.”

‘PLEASE TAR OUR ROAD’

Resident H Nagendra of Sector 1 is requesting the BBMP to tar the road in front of his house. “For the last four years, 15th Cross has not been tarred,” he says. “The de-bushing is addressed to take care of our parking requirements at our cost.” After much requests and warnings, the BBMP authorities did tar many of the sore points in HSR, particularly in Sector 3 which hadn’t been tarred for over seven years.

CABLE MESS

Residents are complaining about the cable TV guys who are using roadside trees to keep their cables and boxes.

“How to get rid of internet and TV cable mess around my house?” asked one such resident. “We planted a tree outside and fenced it. Now I see the broadband guys keeping their device and cables all around it on 15th A Main in Sector 3.”

After the labour camp was recently removed near Freedom International school, it’s back to square one. The stench is unbearable and it’s going to soon become a breeding ground for all kinds of epidemics, say residents.

Wassup HSR? Trials and tribulations of a civic activist

Resident activist Kamesh Rastogi is not happy with the complaint resolution system of the BBMP. “If the complaint is not attended to, why is there no mechanism for escalating it to the higher-ups? This is a big flaw in the system,” he says. “This brings no ownership and accountability. There is no fear of any law or rules. Otherwise, citizens like me will waste precious time just posting complaints on bbmp.sahaya.com and the other mobile apps for bbmp without any resolution in sight. Their inaction is forcing a rethink on whether we should associate with BBMP in any development-related campaigns.”

There are some caveats here. For road relaying, it isn’t as easy to fix immediately. It takes a budgetary grant. And again, the money granted is never enough to re-lay all the roads in HSR. Therefore, it has to be done selectively and over the course of many years. However, pothole filling can be taken up with contingency funds meant for the purpose. Similarly, garbage disposal, street lights and overflowing manholes can be tackled by the civic agencies immediately. And they are duty bound to do that. However, Rastogi’s experience with a pothole fixing issue left a lot to be desired by the BBMP. “The other day, I called the BBMP engineer about a pothole issue and he referred me to one Mr Rajappa. This is his remark. It’s so funny and this proves that no one has any fear of the law.”

This is what Rajappa allegedly told Rastogi: 1. BBMP will not work on your urgency… it takes time for everything.

2. If this was not done for over two months, can’t you wait for a few more days?

3. Contractors are not there and they are not doing work as they did not get paid or are not getting paid.

4. He refused to come to the site to see and said he will see on his own and fix it soon, but no estimated time and action plan was given.

Leaf composting has begun in four parks of HSR. The leaf shredder will come in handy to reduce large volumes and speed of composting. Leaf composting is more sustainable, they believe.

Wassup HSR? SUBRAMANYA TEMPLE AND ITS MANY VIOLATIONS

Can somebody instruct the Subramanya temple authorities in Sector 3 to stop using multiple loudspeakers on footpaths please?

On festival days, the usage goes on all day for three consecutive days. We have received innumerable complaints from heart patients, housewives, office goers and those who work from home. This has to stop now.

In addition, two floors of the temple are illegally built. What is the BBMP doing about this? Another building coming adjacent to it is also six floors and counting.

Joint Commissioner Muniraju has his work cut out for him. He has to end illegal constructions and issue show cause notices to all buildings that violate the ‘ground+two floor’ norm in HSR Layout. We urge his assistant engineer Vinayak to work towards this and ensure illegal floors are demolished and no further violations take place.

ILLEGAL HOARDINGS GALORE

The BBMP in HSR Layout really needs to be straightened out. The officials sit on citizen complaints for months and never act. Such people need to be penalised and their assets frozen to instil fear in the rest of the government employees. Even a voter ID card is not being issued at the HSR BBMP office citing lack of stamps. How can they fall short of them for months together? That’s not all. Says one resident: I complained about two illegal hoarding removals on 24th Main, but both complaints were assigned to somebody but without any action,” he says. Finally, it took two weeks of continuous followups by Rastogi before they got them removed. We laud Rastogi for his patience and perseverance. May he inspire many more residents among us to do the same. When the going gets tough, the tough have to get going. However, a month later, he found another illegal hoarding had materialised from nowhere. The situation was back to square one. Says Kavitha Reddy: “I want the BBMP joint commissioner to take action. There are so many bad roads, drains, illegal hoardings and billboards, posters and encroachment in HSR that he cannot turn a blind eye anymore.” Rastogi isn’t done yet. “I see a lot of hoardings and flex banners opposite SBI on 27th main. No illegal hoardings and flex banners are permitted as per BBMP rules and must be removed immediately on anyone’s complaint. I have logged complaints, but even after three weeks, there is no action yet.”

25 CYCLE DAY EVENTS IN HSR AND COUNTING…

Unlike other parts of the city, Cycle Day in HSR Layout happens on the third Sunday of every month. Some of the stuff you can see are yoga sessions, tug of war games and even cycle treasure hunts. No vehicles are allowed on this stretch of the road (18th Main, 22nd Cross) and you have all the road for yourself. This is right opposite Aishwarya supermarket on 19th Main. Make the most of Cycle Day. A limited number of cycles are also available for free on this day by the Department of Urban Land Transport (DULT). Activities differ every month while some remain the same. It’s fun all the same. Take your kids and have some early morning fun. It’s on from 6.30am to 10am. Another milestone is that HSR is the only locality in Bangalore to have conducted 25 cycle day events since it began on April 27, 2014.

TRAFFIC MANAGEMENT

The Hindu newspaper is doing some good work. The other day, they arranged a meeting with R Hitendra, additional commissioner (traffic) at the Traffic Management Centre on Infantry Road. Residents from HSR Layout took part and aired their grievances as well. Only when the senior management directly interacts with people will they understand the ground realities. And The Hindu will continue to do this with various government agencies.

BUILDING VIOLATIONS GALORE

When you spot any building that violates the rules (ground + two floors), complain to the Bangalore Metropolitan Task Force. Just know this. If the entire basement is used for parking, then it’s basement+ground+2 floors. Each of us can make a difference. Don’t just rely on the press, resident welfare associations and civic activists.

Wassup HSR? The owners of the plot building a house on 29th Main, 18th Cross in Sector 2 chopped a tree last month and both the BBMP and the forest department looked the other way.

ILLEGAL EATERIES AND HOTELS MUSHROOMING IN HSR

Resident MLCs Vimala Gowda and VS Ugrappa raised an issue in the state legislature about the mushrooming of illegal eateries and hotels in HSR Layout across all sectors. They were particularly targetting the many establishments that have come up on 22nd Cross in Sector 3. “I have been living in the area and many other legislators too live in the locality,” Gowda reportedly said. “I have counted the number of hotels literally. I can even accompany the minister (KJ George) and officials to the spot and do a count. Day and night, non-vegetarian hotels cook and serve food from the streets of the locality especially on 22nd Cross.” Ugrappa echoed her sentiment and said: “A particular hotel runs a live band and dancing during evenings without license. It is located just adjacent to the property of JDS leader Basavaraj Horatti’s site. You just cannot pass by the stretch on weekends. Not only is it noisy but also the area is interspersed with garbage and haphazardly parked vehicles.” Bangalore development minister George promised to send BBMP commissioner on a spot inspection of HSR to weed out illegal eateries and hotels. Meanwhile, Gowda claims that there are more than 75 illegal eateries and hotels in HSR. “Most of them are based out of 22nd Cross as it has more greenery and a serene ambience with a sprawling park nearby. Day and night, business is run unabated. A few even have encroached on footpaths and built permanent structures.”

HOW TO EASE PARKING ISSUES IN HSR?

Many residents have come up with ways to decongest HSR. With parking issue becoming a matter of concern, there are ideas galore to resolve it. “Multi level parking inside BDA Complex can help,” says Kavitha Reddy. Kishore Kanala says, “A designated bus stand on Outer Ring Road and convenient feeder mini-buses may avoid congestion near junctions like McDonald and also encourage people to use public transport. HSR ‘open street day’ proved that we can still commute without private vehicles. But I know my idea seems far-fetched now. Mark my words and see what would happen in five years from now.” Resident Rajesh Kumar has a completely out of the box idea: “Why not build the parking lot above the graveyard at the end of 27th Main, next to the army campus?”

CYCLE LANES IN HSR DELAYED

For want of bidders, the cycle lane project is hanging fire. The last we heard was that the plan is with the BBMP for technical review of the bidder.

Kavitha Reddy cautions planners by saying, “The cycle lane should be elevated a bit, otherwise it will end up as parking space like it happened in Jayanagar earlier.” Shashidhar of HSR Cyclists Group says, “The lane will be a dedicated lane (separated from the rest of traffic) and not just paint like in Jayanagar. But unless we get a proper bidder, the project will not move forward.” Sources tell us that the locations have already been inspected and identified by the BBMP. Once the locations go official, the cycle stand installations will begin.

ROCKVIEW: JUNCTION OF CRIME

The bar at Rockview junction at the end of 27th Main Road in HSR is causing much stress to residents. There is mugging, robbery and unruly behaviour by the visitors to the bar. Residents believe that the bar isn’t being shifted because it belongs to a politically influential person. No matter his credentials, the bar needs to be shut if it’s causing much public inconvenience. It might have been fine earlier when there weren’t too many residents living in the area. But now that it’s become a residential hub, a closure is the need of the hour. The residents are planning on taking a memorandum to the HSR police to act on hooligans indulging in these antisocial acts. “Forget night; even in the afternoon, you don’t feel comfortable walking on this road,” says resident Lakshmi S. Echoes another resident Kavitha Reddy who relates an experience of a friend: “My friend wrote to me saying, ‘Today, my wife faced the most unpleasant experience in life while driving home. A drunkard came out of the bar, danced for a while in front of her car, said something abusive, pointing fingers at her and finally banged the top of her car. The passers by were just laughing at the incident. Not a single traffic cop in the vicinity. Alone, she felt totally helpless with the kid. Is this what is expected of a civilised society?”

APATHY AMONG RWAS

There appears to be abject apathy among Resident Welfare Associations (RWAs) in HSR Layout. A few months ago, when the BBMP called for a discussion at its headquarters to tackle the garbage issue in Bangalore, only one HSR RWA turned up. “It was well attended by RWAs from all over Bangalore except for HSR Layout where only HSR Sector 2 RWA representatives were present,” says resident Arathi Aleya. “We presented critical issues of vacant plot management, daily sweeping of main and internal roads, wet and dry garbage to be picked up daily, among other things.” The points discussed by the other associations included the availability of the garbage contractor, an effective Micro-plan for all wards, penalising defaulters for not segregating the waste, and the clearance of garbage on a daily basis. Joint Commissioner (Health & Solid Waste Management) will conduct a meeting with RWA’s once in two months to keep the momentum going.

Three routes identified for feeder service BMTC serious in decongesting HSR Layout

R

esident activists and resident welfare associations have joined hands to bring the defunct feeder service back to HSR. It failed earlier because the routes were not properly researched and there wasn’t much publicity. This time around, the residents have taken the initiative needed to impress upon the authorities to reboot it with more chances of success.

Perseverance has paid rich dividends as the route maps suggested by them has been considered by the BMTC. Last month, the experts from the corporation visited HSR to identify and trace the route map. They have now submitted the route map after due diligence to the senior management for final approval. “When I spoke to the senior management people, I was told that they are expecting mini buses in December,” says resident Lalithamba V. “Once they are available, the BMTC has plans to start the feeder services after giving ample publicity.”

The three routes considered Decongesting HSR Layout is the need of the hour. Rapid commercialisation and office spaces have cramped its main roads. A public transport system could prevent residents from taking out their two wheelers and four wheelers for household errands.

The authorities will share a detailed report with the residents.

Once that is done, the residents will follow up with the senior management until it’s taken forward. The officials have recommended six mini buses that can seat 32 people to cover the three routes. “Our Hasiru Mithra team will offer full support in promoting the service and making it a success,” says Lalithamba V. December is when the action will begin. Watch this space.

Postcard campaign and mass protest against KCDC Residents on a ‘shutdown’ mission after repeated delays to install the odour management plant

For over three years, the residents of Somasundrapalya and HSR Layout are forced to breath stench emanating from the government composting plant (KCDC). If the new odour control system does not work, the government will be forced to shutdown the plant.

nable to bear the stench from the Karnataka Compost Development Corporation (KCDC) for over three years now, the residents have decided to protest on a massive scale. They have begun a postcard campaign asking for the shutdown of KCDC. Children, belonging to these residents, and being one of the worst impacted section of society, are writing to the chief minister for their ‘right to breathe’. In addition, they are planning a mass protest right outside KCDC until the plant is shutdown by the government.

That is, if their odour management plant fails to become operational by the end of December. “We will block the entry and exit of trucks into KCDC by sitting right at the entrance of KCDC for as many days it takes to make the government listen to our demand of a complete shutdown,” says campaign head Anis Padela.

Enough is enough

The bio-filter plant inside the KCDC in Somasundrapalya was to have been operational in February 2016. But even nine months later, it is yet to start functioning. Although all the four bio filters have been fitted and half the ducting work is over, there are still issues being delayed by the contractor for lack of payment by the BBMP. The corporation is promising to take action on the contractor for the delay in the work, but the contractor is blaming the BBMP for delaying payments. Caught in the middle are hundreds of residents who have to brave the stench and the associated breathing disorders and allergies. Not to mention, the contamination of the ground water because of harmful KCDC effluents being let into the adjacent Somasundrapalya Lake.

Shutdown now

In October 2015, Residents Watch joined hands with the residents to raise the voice against KCDC. This prompted chief minister to visit KCDC ten days before the protest on October 31. Eventually, the daily waste collection of 500 tonnes was brought down to 200. And now, BBMP Joint Commissioner Sarfaraz Khan has ordered his officials to restrict it to 100. But the stench is far from over since the much-touted odour management plant is yet to breathe new life into KCDC. “To highlight the KCDC issue, we are starting a mass post card campaign where school children and other affected apartment residents will write to the Karnataka CM on their apathy and ask for shutdown of the plant,” says Padela. “We aim to start with 5000 postcards and will work with schools in the vicinity to get this executed over the next few weeks. In December, all the school children will write to the CM. If this does not work, we will go in for a mass sit-down at the plant for several days, until the government listens to us.”

The residents believe that the KCDC officials themselves are getting fed up of the issue. “If the biofilters fail, we have a serious chance of getting them committed to shift the plant,” says Lalithamba V. “They are not in a position to spend more money on this project. How much more public money will be spent on such plants?”

The plant was recently visited by BBMP Mayor G Padmavathi who asked the citizens to bear with the stench for a few more days and allow officials to complete the biofilters in the next 15 days.

However, four weeks have passed and the filters are yet to become operational.

And even if they do get them operational, they are more likely to fail, say residents. “The filters are not covered on all four sides,” says resident Sudipan Mukherjee. “The officials say that their sucking capacity is strong enough, but if there is a problem, they will cover it on all four sides.

This technique is being tried for the first in the world, and therefore we are highly doubtful of its reliability.”

Khan was unreachable as he was out of the country. But KCDC officials said the biofilter should be ready within a month and there was no question of its failure. For the long term plan to solve the garbage crisis, the state government is setting up six waste to energy plants outside the city. But that should take 3-4 years, by which time the garbage piles will also become bigger. “And again, the government will say that they would need units like KCDC to take care of the excess garbage. It’s a never-ending cycle,” says Padela. “So it’s important to shutdown the plant and have it relocated outside the city where there are no people living in the immediate vicinity with proper implementation of buffer zone and the basic rule of MSW (municipal solid waste) that is right now being violated by KCDC.”

esidents of Somasundrapalya, also known as HSR Extension, have begun setting examples of resident activism like never before. After the mammoth success of the Sobha Road protest (where a public road was turned private by Sobha Developers for over a decade) a while ago, they got together again to impose one-ways in their neighbourhood to ease traffic congestion.

Barring a few vehicle users continuously violating the one-way rule, it has largely been a smooth transition for the residents.

However, the BBMP, the PWD and the traffic police have much more to do for making it a seamless system.

private parties. Apparently, they laid the road on their land for ease of access when they formed the layout. Now that the BBMP has taken over the entire area, they want proper remuneration for the road. Residents believe that it is going to be a long legal battle.

Bad roads

Even while one-way is functional, residents are pressurising the authorities to fix the bad roads in Somasundrapalya. A delegation even met BBMP chief engineer Nagaraj at the head office a few months ago. It is the Somasundrapalya Main Road that is crying for immediate attention. The problem is that it’s not the BBMP but the Public Works Department (PWD) that is assigned for the job.
