10 HOMESTEAD TRAPS TO AVOID IN 2023

Florida provides its residents very generous homestead protections and exemptions, but also restricts the ability to transfer the homestead. As a result, it is very important to understand these protections, how to apply for exemptions, common mistakes that can result in your loss of these benefits, and how you may be limited in your ability to transfer your homestead.

In order for your home to be considered your “homestead” you must both own and reside in the home as your permanent residence. Ownership of the home can include both legal title and equitable title (e.g. owning the property individually or in a trust for your benefit). If your home qualifies as your “homestead” then three different types of benefits and limitations will apply, relating to: (1) real estate taxes; (2) creditor protection; and (3) limits on the ability to transfer your homestead.

The following is a list of Ten Common Mistakes Relating to Florida Homestead.

1. Failure to “Homestead” the property before December 31st

If you purchased your dream home and it is your primary residence, then you must get your ducks in a row by December 31st. This means that you must complete the purchase of the home not later than the last day of the year, it must be your primary residence on that date, and all documentation evidencing Florida domicile must be dated on or before December 31st. Homestead protection does not require U.S. citizenship; all that is required is that the property is the individual’s primary residence. However, individuals who are not U.S. citizens must be resident aliens and possess a Green Card.

2. Failure to Apply for Exemption by March 1st

You must physically apply for the homestead property tax exemption between January 1st and March 1st at your local property appraiser’s office. Failure to apply by March 1st will result in not obtaining a reduction in assessed value of up to $50,000. It will also result in your disqualification from the 3% “Save Our Homes” valuation cap.

3. Failing to Apply for All Exemptions for Which You Qualify

In addition to the standard homestead exemption, Florida also provides additional exemptions for surviving widows and widowers, disabled individuals, disabled veterans, individuals who are blind, and senior citizens with low incomes. The deadline for applying for these exemptions is also March 1st.

4. Married Couples Failing to Apply for Exemptions Together

Both spouses should sign the application for exemption. If one spouse dies and the surviving spouse did not sign the original homestead application then the homestead exemption may be lost unless further application is made by the surviving spouse. The loss of exemption may apply to not only the reduction in the assessed value but also the 3% “Save Our Homes” cap. In addition, although regaining the standard exemption may be easy, the loss of the 3% cap could be more difficult to correct resulting in revaluation of your property and considerably more tax liability.

5. Couples with Multiple Homes

Generally, a husband and wife may only have one homestead and obtain only one exemption. As a result, if a husband and wife each own a residence, they must choose one homestead. The penalty for maintaining two competing homesteads can be severe unless both of you can meet all of the requirements for the homestead exemption with respect to the separate properties..

6. Adding Family Members to the Deed

It is common to hear that someone has advised a Florida homeowner to add their children to the deed in order to avoid probate. Be aware that while this technique may reduce the likelihood of a Florida probate, unless the child is also residing in the home as their primary residence, it also will result in a reduction in the homestead exemption and can eliminate or destroy the homestead protection from creditors. As a result, you should carefully consider the legal and financial affects before placing your homestead in joint names with your children.

7. Renting the Homestead

If you own your homestead and decide to rent it to others while you are up north for the summer, you could easily lose your homestead protections. Generally, only incidental rental of a property is allowed without homestead being considered abandoned and with that, loss of the Florida homestead protections.

8. Renovations or Improvements to Homestead

Any change, addition, or improvement to the homestead can affect the homestead valuation and “Save Our Homes” exemption. This is true unless the change is due to repairs resulting from a casualty loss and other requirements are met.

Failure to Obtain Long-Term Lease (99-year lease) after QPRT Expires

If you place your homestead in a Qualified Personal Residence Trust, in order to the maintain homestead protection and exemption after the expiration of the retained interest, you must maintain an equitable interest in the property. This means you must plan ahead with a long-term lease designed to qualify as an equitable interest in the property.

10. Failure to Obtain Homestead Waiver

There are Florida constitutional and statutory prohibitions against transferring your homestead away from your spouse or minor children. As a result, devising your homestead to a trust for the benefit of your spouse is not likely effective unless there is a valid waiver of spousal homestead rights. However, even with a valid homestead waiver, if you are survived by a minor child, the devise may still be ineffective. Because of the various Florida constitutional and statutory issues associated with Florida homestead, any transfers of the homestead or use of the homestead for estate planning should only be entered into after consultation with your legal advisors.

KEYS TO BETTER CHIPPING

No matter how good a player you are or how good your ball striking is, you are going to miss greens. Here are a couple keys to good chipping.

1. Ball position back to middle of your stance. This will keep the ball low.

2. Weight on your lead foot. Head behind the ball.

3. Lower body stays quiet. Solid base.

4. Chipping should be an extension of your putting stroke, arms and shoulders.

5. Keep your hands in front of the clubhead. This will allow the ball to stay low to the ground and run.

6. Light grip pressure, don’t squeeze the club.

7. Use a pitching wedge for short distances and not a lot of green to work with. Use an 8 iron when the pin is further away and a lot of green to work with. An 8 iron has less loft and therefore will run out more than a pitching wedge with essentially the same effort.

FINE: Tell us about yourself and your background, where you are from and what was your family like? Where have you lived in the country or are you originally from Florida? Tell us about your education or your work/professional background?

Kylee: I’m all about leading a happy, healthy life with my husband and 2 kids here in Naples. I’m originally from the Midwest; was born and raised in Brookfield, WI. I followed my parents to Florida and attended FGCU where I dual majored and received a Bachelor in Business Management with a concentration in Entrepreneurship, as well as a Bachelor in Resort and Hospitality Management. Between graduating and starting a family, I married my husband Mike, started and sold the first environmentally friendly commercial cleaning company in SWFL, lived in Nashville, earned my Bikram Yoga teaching certification, moved to California for a few years and finally ended up back in Naples to start and run my ultimate passion: The Bowl.

FINE: How and when did you first have the idea to start The Bowl? What made you choose Naples for your store locations?

Kylee: Naples has such a familiar feel to me; it always feels like home even though I’ve lived in a couple of different states. However, it is in dire need of some healthy options for it’s locals and snow birds alike! After moving back to Naples from California, where healthy is the norm, I knew I

had to open a cafe to offer something not only healthy but also organic and quick. Acai and pitaya bowls had become my obsession and main focus for the menu, paired with some whole food smoothies and kombucha on tap. It was everything I was passionate about under one roof! I built on this foundation and added a locally sourced organic coffee (both cold brew and hot) from Black Tulip, as well as organic iced matcha from House Matcha (my sister’s San Francisco based company) to complete the menu.

FINE: I really like both of your stores, the interior is very clean, very nice décor, and it looks very organized. How did you choose the colors, decorations, theme, etc.?

Kylee: Thank you Brian! I designed The Bowl as somewhere I would like to go, with our motto “Good Vibes Only” in mind. My goal was to make it bright and friendly. The colors are intended to bring the beach vibe inside. Let us crack an organic coconut for you and you’ll feel like you’re on vacation.

FINE: What makes The Bowl unique and stand out from the competition? Can you tell us a little bit about the main smoothie mixture and the nutritional aspects of the bowl choices?

Kylee: Unlike other places that serve acai bowls, The Bowl is the only one who serves everything organic! And you don’t have to pay a premium price for it either. From the fresh

fruit on top of your bowl to the frozen fruits, juices and plant based milks in the blend, nothing is doused in pesticides or chemicals like conventional fruit or other food.

Acai is the main ingredient in the blend of our bowls, unlike some competitors who’s main ingredients are often ice or sweetened juices/milks. The acai berry provides antioxidants, fiber and heart healthy fats. Our pitaya bowls, made with dragonfruit, are the naturally bright pink bowls and supply you with a healthy dose of fiber, magnesium and vitamin B. No matter what you choose on our menu, you’re going to get something healthy with loads of benefits.

FINE: Can you tell us about the different Bowl selections on your menu?

Kylee: The Bowl offers organic acai and pitaya bowls: a cold berry blend, thicker than a smoothie, topped with granola, fresh fruit and other toppings like coconut shreds and raw local honey. Our most popular bowls are the AB&J (almond butter in the blend), Barefoot Bodie (peanut butter in the blend), Key West (tropical and fruity) and the Islamorada (pitaya bowl).

As for smoothies, I suggest the Early Bird (made with cold brew coffee), the Good Morning (with

a plant based protein powder) and the Dirty Milkshake (almond butter and cacao). Besides the bowls and smoothies, we have an on tap selection including 2 flavors of kombucha, cold brew coffee and iced matcha.

FINE: Do you have plans to open more stores and any possible future locations?

Kylee: My regulars like to joke with me and ask, “So when are you going to open another store and have another baby?” I signed the lease on the Pine Ridge location on a Friday and had my son Bodie on Monday, and opened the Central location when my daughter Isla was 2 weeks old. And no, I didn’t plan it that way! But to answer your question, expansion is always on the horizon.

FINE: What are some of your favorite things about Naples and why you like living here and having a business here?

Kylee: Naples is beautiful; the sun, the water, the beach. That’s why it makes it the perfect place for The Bowl. Everything on my menu is cold, from the organic pitaya bowls to the iced matcha lattes, it’s exactly what you’d want to eat and drink when it’s 90+ degrees outside.

FINE: What are some of your favorite things to do in Naples? What are some of your favorite restaurants?

Kylee: One of my all time favorite spots is The Naples Beach Club, especially for the Summer Jazz concerts. Restaurants/ Coffee: Organically Twisted, The Crust, Kunjani, Tacos and Tequila.
