Peachtree Road Walgreens finally wins approval

After years of contentious debate, the Walgreens project on Peachtree Road is moving toward construction.

Brookhaven’s Board of Zoning Appeals voted 3-2 on July 16 to allow a series of zoning variances needed for a new proposal for the project.

Developer Jay Gipson said the vote provided the final zoning approval his company needed to move forward “This is it,” Gipson said. “I think we’re done, and we are so excited about moving forward and creating this.”

Gipson’s plan calls for a three-story, brick-faced building with a parking garage at the corner of Peachtree Road and Colonial Drive. He said the structure will look like a “classic, old urban building.” Walgreens will operate a pharmacy on the first

The Brookhaven City Council voted July 22 to defer changes to its tree ordinance to give staff members a chance to tweak them a bit before they’re adopted. But, even after approval, the city’s tree regulations will remain a work in progress, city officials said.

Still, some residents say the proposed new rules are too vague and too lenient on developers.

“I think we need to pass something immediately, so that nothing else slides through under the old ordinance, and then get a better one by September,” resident Ruth Ann Little said.

Residents review proposals for Brookhaven’s future

David Ewing said he moved to Brookhaven less than a year ago and he was curious to see the direction the young city planned to take.

“I just want to see where the city’s going,” he said. “I’m new to the neighborhood and want to see where it’s been and where it’s going.”

So Ewing was among more than 70 people who headed to Brookhaven City Hall on July 21 for an open house to chat with city officials and planners about Brookhaven’s future.

He said he was impressed with the work the city’s planners had done. “A lot of thought has gone into it,” he said.

“People’s concerns, they’re really taking them in. That’s the appearance, anyway.”

Mayor J. Max Davis, one of several city officials on hand to speak with members of the crowd, welcomed the turnout. “It’s wonderful,” Davis said.

“I’m thrilled we have this many ... citizens engaged in what the future of Brookhaven will look like. This is exactly what we envisioned.”

For the open house, planners set up 22 display boards on easels that illustrated how the proposed new city master plan and transportation plan were shaping up.

The city also is developing plans for the city’s park and the Buford Highway corridor. City officials intend for the final Comprehensive Plan to be presented to Brookhaven City Council in October for adoption.

Planners divided the city into 13 communities called “character areas.”

They stretched from Perimeter Center in the north to the Buford Highway Corridor in the south and included neighborhoods such as Briarwood Park, Lynwood Park and the “Lakes District,” which was made up of neighborhoods around Murphey-Candler and Silver lakes.

Residents stuck Post-It notes on the boards or scribbled thoughts on comment sheets. They called for everything from fewer curb cuts on Peachtree Road to rethinking the intersection of Ashford Dunwoody and Johnson Ferry roads.

“We’re not hearing a lot about ‘Widen this [road] to multiple lanes,’ but rather [to make improvements] in multiple locations,” said Joe Palladi, chair of the transportation plan steering committee. “And they want to see what the plan is.”

The proposed vision statement for the city calls for a future in which Brookhaven is a “walkable, urban community that preserves its unique character and history.”

Ewing liked the idea of a walkable city. He said he’d like to see additional bike lanes and slower traffic. “I don’t bike myself, but I plan to someday,” he said. “I do like that idea of a walkable city. It takes a lot of planning and funding, and a lot of cooperation from residents, but, ultimately, it could be a walkable city.”

Genie Stringer said she pays close attention to what the city is planning for its parks. “All of us notice things we wish were improved,” Stringer said. “We don’t think there’s anything we can do.

This gives us a chance to say, ‘We need a bus shelter here. Ashford Dunwoody and Johnson Ferry, where they come together, should be better.’”

Donna Poseidon also would like to see the city find a way to slow traffic.

“I’m a walker and a runner and a bicyclist,” she said. “I’d like to see the drivers slow down and pay more attention to non-cars.”

But on this evening, she said, she was studying the displays and trying to absorb the ideas in the city’s plans.

“Sharing information is always good,” she said.

Brookhaven police calls will be dispatched through the private 911 authority known as ChatComm starting Aug. 11.

City Council voted to approve the agreement with the Chattahoochee River 911 Authority at a March 25 meeting following the encouragement of the city manager and police chief, who said the move would improve police response times and improve safety for police officers.

Police Chief Gary Yandura said at the March meeting that he has not been satisfied with DeKalb’s 911 service. He said there have been complaints of delays on emergency calls, and he’s heard officers complain

DeKalb Sheriff Jeff Mann easily held on to his office July 22 with a runoff election victory over the county’s former CEO. In unofficial returns, Mann collected more than three times as many votes as his opponent, Vernon Jones, who was making a bid for a return to elective office.

According to figures posted on the Georgia Secretary of State’s website, with votes from all of the county’s 189 precincts tallied, Mann had received 76 percent of the vote to Jones’ 24 percent.

Mann thanked the voters on his Facebook page. “I am proud to be able to continue to serve as your 49th sheriff,” he wrote.

Mann took office earlier this year after the resignation of former Sheriff Tom Brown. Mann and Jones collected the largest number of votes among an eight-candidate field in the May 20 nonpartisan election for the office, and were cast into the runoff.

City Council defers tree code changes CONTINUED FROM PAGE 1

The proposed revised tree ordinance will be left on the city website (www. brookhavenga.gov) for public review, city officials said. Another public hearing will be held within 30 days so city officials can continue to modify the ordinance and gather comments from residents.

“I think any ordinance can use reworking,” said Kay Evanovich, a city arborist, adding that there’s “room for improvement.”

The council’s vote to wait a week followed a July 15 work session in which the new regulations were presented with the intent of improving the ordinance the city adopted from DeKalb County.

“We adopted the ordinance [from DeKalb] as temporary, with the intention of going back through it,” said Mayor J. Max Davis at the work session.

Davis said that the city, likewise, previously made changes to its development and police codes that it had adopted from the county.

Evanovich said she agreed with the idea of approving the new ordinance soon while continuing to work on another draft.

She said she was concerned that since the draft has been made public, some homeowners might cut trees before the new ordinance passes.

“If we go ahead and pass this and get these measures in that do help our canopy and then turn around and do another draft . . . I think that might be a more beneficial thing to do at this point,” she said.

Evanovich, along with arborist Teresa Eldredge, a landscape architect and

president of TJ Schell, first presented the modified tree plan to the council during the July 15 work session.

Some changes to the ordinance include encouraging appropriate tree diversity, and maintaining the health of city trees through proper pruning and mulching.

The tree ordinance would take effect when someone wants to remove trees, applies for a land development or building permit, or wants to rebuild more than half a parking lot.

It does not apply for tree plantings on public lands, for landscaping projects on private property when no trees are removed, and for remodeling or additions with no tree or land disturbance.

Under the new ordinance, homeowners may remove five trees in a calendar year with a diameter of 10 inches or more, other than specimen trees. The old ordinance did not specify the size of the trees, nor did it require a permit, as it would under the new code.

Also, the new ordinance would require that residential properties maintain a specified amount of tree coverage per acre when a removal permit is applied for. The old ordinance had no requirement for maintaining or replanting trees.

On properties where land disturbance permits have been applied for, under the new ordinance, developers must maintain a specified amount of tree coverage per acre outside of building setbacks.

The new ordinance also creates a tree fund, which means property owners could pay as an alternate form of compliance with the ordinance.

The collected funds could be used for developing a tree survey, buying and planting trees on public property, tree education, city tree maintenance and promoting a healthy tree population.

A better quality of life: The ultimate goal of the north DeKalb cityhood movement Two years ago, friends and neighbors in communities all across north-central DeKalb County began discussing a shared vision to follow in the footsteps of Sandy Springs, Dunwoody and Johns Creek to pursue a better quality of life through incorporation.

The goals of those seeking a city named “Lakeside” and those who prefer a larger map called “Briarcliff” are mutual: The overdue need for greater levels of local control in an area largely ignored by a county government. The ongoing crises simply exacerbate the problems.

DeKalb County has neglected our community by providing insufficient police protection, a woefully inadequate road-repair and sidewalks program, few parks, and zoning and land-use policies that fail to reflect our community values — to name just a few of the issues.

The county commissioners for our area do not live here and lack a keen awareness of what we need and want — from a lack of economic development in challenged retail areas to improved service deMARY KAY livery to a need for greater police presence in residential neighborhoods.

The Lakeside and Briarcliff teams are now collaborating in pursuit of the common goal of cityhood WOODWORTH during the 2015 session of the Georgia Legislature in January. They share a desire to improve our area GUEST COLUMN and to help turn around the fortunes of our county. The information we have gleaned from neighborhood meetings, social media and other community input will be used to ensure that the map considered by the General Assembly is fair, logical and inclusive.

Cityhood for this portion of DeKalb transcends political party, income or any other label critics have tried to put on either previous cityhood effort. We want what is best to help preserve our neighborhoods and to provide incentives to help our area thrive well into the future.

Both city groups can tell you that most residents in our area are embarrassed by their DeKalb elected officials — not just the never-ending claims of corruption, but also the seeming inability to accomplish anything except infighting.

DeKalb CEO Burrell Ellis faces trial for extortion and conspiracy charges — a trial that has been postponed several times and puts a black eye on the image of the county. Ethics charges have been filed against each of the seven DeKalb commissioners. The accusations primarily relate to the way these elected officials handle themselves in office or misuse of taxpayer funds.

Rather than seriously addressing the multitudinous problems with the county, Interim CEO Lee May has appointed a “task force,” and hired consultants to look at the impact of cities on DeKalb. Citizens and cityhood groups were left off the panel, as were pro-city legislators, until that fact was made public.

DeKalb officials have consistently lobbied against new cities, using taxpayer-funded lobbyists to work against their own citizens. May himself asked the General Assembly to kill the creation of more cities for three years.

Sadly, it is business as usual not only at the DeKalb Headquarters, but also along U.S. 29, where prostitution and drug crimes continue unabated. Northlake Mall — the largest commercial center in our area — is under severe distress, and no significant efforts are being made to renew it.

In contrast, a small city, governed by those who live here and who care about our community, would target these concerns.

This is a proven model of success. But first we have to incorporate.

Our community must agree on a new map and goals for self-governance. LakesideYES believes success depends on beginning with a manageable city size to ensure efficient service delivery, but we also believe that annexation of additional unincorporated areas should be seriously considered once the city is operating successfully.

As we at Lakeside and Briarcliff work on our efforts, you could say we are “dating.” We hope we can come together with a fullfledged agreement to present to the community that will allow a large portion of north-central DeKalb voters to join us next winter in asking the Georgia Legislature, once more, for the ability to self-govern, and to keep DeKalb and our community strong for generations to come.

BY BOB PEPALIS Call it a modern air traveler’s fantasy: A short drive to the airport followed by free parking, no bag fees and no long security lines.

Southern Airways Express promises to deliver on that fantasy. And it sees that promise as the reason frequent fliers should skip bookings on big-name airlines and head to DeKalb-Peachtree Airport when they’re taking short flights to Florida beaches or to Memphis.

Alyson and Scott Reynolds took their first flight on Southern Airways Express to Atlanta from their home in Destin, Fla., on July 8 for her interior design business.

She was happy to skip the Transportation Security Administration’s security lines. He said he liked the flight’s convenience, as the couple lives about 15 minutes from the Destin airport and only needed to arrive 15 minutes before the flight.

“And the flight left early,” Alyson Reynolds said. “That never happens.”

Ben Giles, owner of White Sands Contracting of Destin, likes the little, Memphis-based airline’s business so much he invested in the company.

“I have business quite a bit up here [in metro Atlanta],” he said recently during a stop at PDK. “So, without having to go through TSA and all the hassles of [Hartsfield-Jackson International Airport] and all that, it’s really convenient. And, secondly, as an investor, I hope the airline takes off. I think it’s a great business model and they should do well.”

For its flights in and out of metro Atlanta, Southern Airways Express has found a way to do something other airlines haven’t: avoid Hartsfield.

Long-standing debates about whether Atlanta needs a second airport still go on, but Southern Airways Express is able to operate from PDK under a Federal Aviation Administration definition of public charters. Essentially, airport officials have said, the company markets, schedules and books passengers, and then contracts with a subsidiary that provides the flights.

Southern Airways Express took its first flights in 2013. The company spent the first year experimenting to find which flights met consumer demand and has scaled back on flights. When the company announced its opening last year, it offered flights from PDK to six southern cities.

This summer, the airline operates 54 flights a week, including two takeoffs and two landings most days from PDK. Chief Operating Officer Keith Sisson said a new schedule should be approved by the U.S. Department of Transportation in the next few weeks. That schedule will begin just after Labor Day. “We decided early on our competition was going to be the long car ride,”

he said.

Flights on Southern Airways Express start at $198 one way, but passengers who follow the charter airline on Facebook (Facebook.com/southernairwaysexpress) can occasionally find deals cutting prices to as little as $129. Sisson said the first seats are always cheaper on each flight. Last-minute flights are $248 one way.

Atlanta passengers can fly directly only to Memphis or Destin under the current schedule, but Sisson expects the company will add more destinations once the airline is better established in the Atlanta market.

Company officials plan to look at adding flights from Atlanta to St. Augustine, Fla., Hilton Head, S.C., or St. Simons Island in Georgia. Southern Airways Express will continue to schedule SEC game-day flights,

linking fans with their teams during football season, he said.

Company officials say that the PDKbased flights have not been as successful as the Memphis-based ones. Almost every flight is sold out from Memphis to the beaches, Sisson said.

One flight per day out of PDK is bound for Memphis four days per week – excluding Thursdays and weekends. A flight arrives daily from Memphis Monday through Friday. And Southern Airways flies to Destin once a day five times per week – Monday, Tuesday, Thursday, Friday and Sunday.

An inbound flight from Destin is scheduled four days per week – Monday, Tuesday, Friday and Sunday. That makes nine outbound and nine inbound flights weekly.

But they also want to convince more business travelers to fly their airline to fill the seats now being used by vacationers.

When the leisure travel stopped last win-

ter, so did flights out of Atlanta by Southern Airways Express.

“This year, we know that we have to do something different when the winter rolls along,” he said.

A small start has been made at PDK. Every week, six to eight people fly to Atlanta from Memphis for meetings they used to drive to. And Sisson said the airline would like to start a banker’s shuttle to Charlotte.

“We can take them out of their cars with a convenient flight from their neighborhood to Charlotte,” Sisson said.

For now, John Bunyan and his wife might be close to the airline’s target market.

He’s a retiree, having spent 36 years working for IBM. The Bunyans have homes in both Destin and Atlanta.

“My wife has flown this and I’ve flown this. We think this is outstanding,” he said.

“We keep a car down here and it really works out really handy. You’re here in an hour and a half without the drive.”

Becky Arbiv Rising sophomore, The Weber School On April 26, Becky Arbiv made history for The Weber School, winning the 2014 GISA AAA State Championship in the 300m hurdles.

“She was the only athlete that The Weber School took to the state meet and she won the firstever state track championship for our school,” Coach Tyrone Sawyer said.

Not only did Becky win the championship, but she also set school records for volleyball and basketball. Most students don’t reach these types of accomplishments until their junior or senior year, but Becky did it as a freshman.

Becky was born in Australia, has lived in Chicago and Philadelphia, and moved to the Atlanta area when she was 3. She says sports have always played a major role in her life. “As a little kid, I was extremely active and was always running around,” Becky said. When she was young, she played little league gymnastics, basketball, soccer and tee ball.

Becky may be the epitome of “practice makes perfect.” She says, “I practice every day for either pole vault, basketball, volleyball or just all around working out. Every day I watch countless videos of professional athletes to refine my technique and get better. On the weekends I spend about eight hours pole vaulting, and I love every second of it.”

Although Becky continuously practices, she says she would not have made

it far without the support of her coaches and mother. “My mom and my coaches are my biggest influences because they help and support me through everything, and give me input on my performances,” she said.

Becky’s success isn’t confined to just sports. She is a part of Weber’s student council, and the Junior State of America Club. She also likes to read and play the guitar.

Her coach says Becky can look forward to a bright future. “Becky is extremely humble in all of the success she has had,” Sawyer said. “She motivates her teammates through her great work ethic. Becky is truly genuine and will continue to accomplish great things.”

What’s Next: Becky hopes to compete in the Olympics and one day become a surgeon.

“I broke my leg in two places while chasing a subject and couldn’t move,” he said. “Grizz apprehended the suspect and gave me time to call for backup. He’s a great partner.”

Grizz is a police dog. He and Kitch, who have seven years of experience together, joined the Brookhaven force in March of this year.

Grizz’s work doesn’t just affect Kitch. “With just the knowledge that Brookhaven has police dogs, crime has already gone down,” Kitch said.

Officer David Fikes hopes that the Brookhaven’s newest police dog, Dano, can live up to Grizz’s example. The two passed certification on July 8.

A Belgian Malinois and Tervuren mix, Dano is Grizz’s son. He came to Brookhaven with Officer Fikes and with no experience in police dog work.

“He was what we call a ‘green dog,’ a dog with no background,” said Fikes.

“We went through 10 weeks of training.”

Of the many duties he had to tackle, Dano learned controlled apprehensions. He was taught to use just enough force to keep more dangerous suspects from running without seriously hurting them, Fikes said.

In a recent demonstration, the dog apprehended Kitch as if he were a suspect. Dano fiercely grabbed Kitch’s arm and only backed down when told to by Fikes.

But in the majority of situations, the dogs are not required to use force, the officer said.

“Nine out of 10 times, a dog is shown and not used,” said Kitch. “You can have a bad guy who wants to fight, BK

but when you bring a 90-pound dog out, they want to give up. Our goal is to use as little force as possible.”

Controlled apprehension is based completely on command. A police dog will not attack unless told to by his officer, usually under extreme circumstances. “To a dog, there are no bad guys,” Kitch said. “To apprehend somebody is no different than learning how to sit.”

But apprehension is only a small part of what Dano learned in training.

“Dano and Grizz are dual-purpose dogs,” said Fikes. “They have a patrol background and are trained in narcotics detection.”

Many police dogs are single-purpose dogs, which means they are trained in narcotics detection only. Fikes said that this was the easiest part of training.

Narcotics detection begins around the fourth or fifth week of training.

Dogs, which have a powerful sense of smell, learn to recognize the scent of various drugs.

“The dogs never ingest anything, and never become addicted,” said Kitch. “They are trained in scent recognition only.”

In addition to narcotics detection and controlled apprehension, Dano also mastered obedience, temperament, searching buildings, searching open areas and tracking.

“The dogs are utilized to find lost or missing people by tracking human scent,” Kitch said. “It is the most rewarding work as a policeman and a parent.”

He added the dogs generally enjoy all areas of their work. “They work for us, because it’s play for them,” he said. “They live to work, so they love to work.”

floor, and offices will fill the second and third floors, he said. He said construction could begin by the end of the year and be completed in 2015.

Walgreens has been trying to locate a pharmacy on the property for years, stretching back to before the creation of the city of Brookhaven. Its plans drew opposition from neighbors because they said the proposals violated terms of the overlay zoning district. The overlay, which governs aspects of development in the area, was created to give the area an “urban look,” and requires multi-story buildings built along the street.

Residents in the past objected to plans to create a single-floor building to house the pharmacy and to the property’s curb cut onto Peachtree.

Some residents continued their objections to the project’s curb cut on Peachtree, telling members of the zoning board the curb cut violates terms of the zoning overlay and had been denied in the past. The curb cut is designed to provide a right turn into and right turn out of the development.

During the zoning board’s meeting, some residents and board members said the vote would create a precedent for the area. “This [project] has been kicked around five plus years,” Bill Roberts of the Brookhaven Peachtree Community Alliance told the zoning board members.

Resident Kathy Forbes also objected to the plan. “Granting these variances to Walgreens would be giving special consideration,” she said in a statement read at the meeting.

But the project drew support, too.

Zoning board member Jed Beardsley, who voted for the variances, later said the project would provide needed office space in the area. “This is not just a Walgreens, it’s two stories of office space, and it’s the first new office space in Brookhaven along Peachtree Road in years and years,” he said. “I think that’s a nice part of the project. ... There is a dearth of office space in our corridor.”

Gipson said the building will enclose 32,000 square feet of office space and 14,100 square feet of space for the Walgreens, and it would have “a high-dollar finish.”

Gipson said he was born in Brookhaven and had spent much of his life there.

He is developing the project with his father. “I’m a native,” he said. “When I was born, my parents lived on Dresden Drive.

An Atlanta company plans to raze the 58-year-old Bryton Hills Apartments and replace them with three-story townhomes.

Jay T. Clark, CEO of Southeast Capital Companies, said the company plans to replace the 204 apartments on the 9-acre parcel near Clairmont Road and Buford Highway with 155 townhomes priced “in the high $400,000s.”

A portion of the property will be reserved for future commercial development, he said.

The Brookhaven Board of Zoning Appeals unanimously approved zoning variances needed for the project during its meeting July 16.

“I think this is a positive sign,” resident Robert Smith, who lives nearby on Skyland Drive, told members of the board.

“This area is a front door to Brookhaven. It’ll be a tremendous improvement to Brookhaven.”

Construction on the townhomes should begin after the end of the coming school year, Clark said, and is expected to continue through 2017.

“We’re starting when the school year ends next May,” he said. “The principal of the elementary school asked we not push the kids out during the school year.”
