The unsold story According to independent reports from two of my acquaintances there is a web site that has published a story saying that this magazine has been sold. It’s simply not true. I

couple

of

reasons. The first is that I have visited it and

cannot find the story to verify its existence and, before commenting in detail, I think it is best to get my facts straight. Maybe the site’s owner should do the same. Secondly, I don’t see why I should give the site free publicity when it is doing the magazine a disservice. I don’t know if the spreader of this rumour is simply misinformed or feels he has something to gain from circulating this nonsense. Either way, in terms of its potential impact on REm it could be harmful as it might create instability and uncertainty among clients. Several years back I saw a super film starring Paul Newman called Absence of Malice. I commend you to

see it. In a nutshell it is the story of how an untrue story is deliberately leaked to a reporter to cause the Newman character considerable problems. I believe the American defence, absence of malice is akin to the UK’s “published in good faith”. In other words if the reporter and the journal that publishes an untrue story can demonstrate an absence of malice towards the person on the receiving end then, supposedly, they can’t be successfully sued for lible.

I am fully prepared to concede there might be no malice whatsoever in the story about this magazine’s sale. But the point of the Newman film – and mine too for that matter – is that having no ill intent is of little or no consolation to the person or organisation on the wrong end of a false story. By the way, Newman extracts a very satisfying revenge on the reporter (played by Sally Field), but I won’t give any more away. To happier thoughts ... this publication sees the celebration of our 150th issue. I can only claim about one-third of the credit – if credit is the right word – having become involved a little while before issue 100. Those who have been in Pattaya a while will know that this can be a “here today, gone tomorrow” kind of place so for this magazine to have survived so long is an achievement for all involved over the past 12 years. In future the magazine will have more general interest content while retaining a strong real estate theme. We have given the design a bit of a tweak, but have opted not to totally throw the baby out with the bathwater regarding the look and feel of the mag. I hope you like the subtle changes.

Big support for property show The Mayor of Pattaya City, Itthipol Kunplome, recently met the organisers of the Pattaya Property Show planned for January and expressed his delight that the city will be hosting the event. He told them real estate plays a very important role in Pattaya’s future, so to have a top international property exhibition here is most welcome. He also offered to assist the organisers to ensure that visitors were aware of the event, by helping with publicity, including hosting a press conference at City Hall. The real estate industry support is clear, with more than 70 per cent of the stand space confirmed already, two months before the show opens, endorsing the organisers plans to launch this major event in Pattaya. The four-day exhibition, which will take place at the Hilton Pattaya on January 9-12, has already attracted more than 40 leading developers and realtors including Universal Group,

Representatives of all 13 member companies of the Real Estate Broker Association – Eastern Seaboard (REBA-ES) gained their Certified International Property Specialist (CIPS) accreditation after attending an intensive week-long course at the Artrium Hotel in Bangkok last month. ctober turned out to be an exceptionally busy month in the life of the Matrix Developments group with two key events grabbing all the attention. First, the final touches were added to the new showroom for The Sky development which can be found in the main Matrix office on Pratumnak Hill. As this magazine went to press an opening party was due to be held there. Secondly, Matrix chief executive Miki Haim called an impromptu press conference to announce that the company is preparing to start distributing approximately 700 chanotes to owners in their Paradise Park, Sunset Boulevard 1 and The View projects. Miki also announced another significant development, namely that construction work will start this month (November) on their City Center project close to Soi Arunothai. And all this is on top of the normal business of getting units sold in other projects such as The Amazon where construction is 50 per cent towards completion and The Vision (35 per cent done). Sneak preview I managed to get a sneak preview of The Sky’s new showroom and was very pleasantly surprised by what I saw. “We’ve introduced a new colour palette,” explained Matrix marketing manager May Watson. “We’ve decided to break away from brown!” Breakaway they have. What first struck me about the showroom was the airiness and brightness of the rooms. Light (aqua style) blues have been introduced alongside subtle greys, cremes and, of course, white. As can be seen in these pictures, the result is very pleasing to the eye. The Sky will be a 30-storey tower in Soi Watboon, Jomtien. The majority of the 293 units (from the eighth floor and above) will have sea views. There are 14 different types of unit and each will be fully furnished


with the exception of soft furnishings such as curtains and bed linen. Residents will enjoy a 24th-floor swimming pool, gym and sauna and on the fourth floor there will be a cinema showing children’s films such as cartoons during the day and movies for the grown-ups in the evening. Prices start at Bt1.49m for a studio – at the time of writing there was one remaining. A one-bed unit costs a little more than Bt2m. Head of sales Patrick Shinnors said: “Now is the right time to get in on The Sky. With prices starting from the Bt44k per sqm mark that’s very reasonable for the area. It presents an ideal opportunity for investors.” The Sky plan to provide a shuttle bus linking the project to the beach and the nearby markets. Construction is expected to start in Q3 next year with an anticipated completion date of the end of 2016. Away from The Sky the news is great for those 500-plus people who bought in Paradise Park nearby. Starting now Matrix will be contacting owners one-by-one to give them the chanotes on their units. “It’s just one more example of how we keep our promises,” said CEO Miki Haim. Owners at The View and Sunset Boulevard 1 will also be receiving

certificates showing their legal ownership over the coming weeks. “It has been – and will still be – a slow and laborious process,” said Miki, “but we are delighted to be nearing the end. There are many legal procedures to go through before we can have over the chanotes.” Approval process From the start of any project through to completion the process involves gaining EIA (Environmental impact Assessment), City Hall, Treasury Department and Land Office approvals. “In all we needed more than 10 meetings to get to where we are today,” added Miki. He said that the setting up of the juristic body at Sunset Boulevard 1 was also under way after a considerable wait. Miki said of the chanotes: “This is an important day for us at Matrix. But not just for Matrix. We are building trust here for property development in Pattaya as a whole.” He paid special tribute to his staff members: “We have a very professional team of 80 people here at Matrix. We keep everyone focussed and we are very happy that we have two projects under construction and two others that we have launched.” |

Stick or twist? Why high rise buildings may never look the same again ...

hen Pattaya resident Ray Hunt told me about a building concept he is involved in promoting I asked him if I needed to look at the calendar. “Why?” he asked. “So I can check it’s not April Fool’s Day,” I replied. I said it in a joking and, I hope, not unfriendly way, but there is many a true word spoken in jest and I really did wonder if he was trying to have me on in what he was saying. “No, seriously,” he insisted, “I’m representing a company whose concept is to build tower blocks in which each floor revolves independently. That way, once in motion, the building will never look the same again.” I had never met Ray before and we were chatting before the first Round Table dinner hosted by Southpoint developers Kingdom Property at the Grand Hyatt Erawan in Bangkok. The fact he had been invited to the event gave him a certain credibility and he didn’t look the type to smoke whacky baccy so I decided to pay a little more attention. “Tell me more,” I said. Visuals needed He said it might take a while and really he needed the visuals on a computer to better explain the concept. So we agreed to meet at his house close to Soi Khao Talo and go through it. I consider myself to be as cynical as the next man – maybe more so

after so many years in journalism and hearing some fairly far-fetched stories. That said, I try to keep an open mind. However, I would own up to thinking that this all sounded a little too good to be true. Ray is Asian Business Development director for Dynamic Architecture – a company headed by Italian-based architect Dr David Fisher. No video Here on a static printed page it is difficult to convey what’s involved, but I’ll give it my best shot without the aid of video. As Ray told me ... the concept is for each floor of a tower block to revolve independently so tenants will enjoy 360° views around the clock. Over the years I’ve sat in a few revolving restaurants such as the one here at the top of Pattaya Park. Imagine that repeated all the way up the tower and you start to get the idea. The floors revolve very slowly so there is no feeling of motion sickness. Of course the floors are totally separate and between each of them wind turbines are located, generating enough power to keep the building revolving, the tower’s units in power and still have enough left over to sell back to the local grid. “The gap between the floors carries an added bonus of reducing the wind resistance of the building by up to 60 per cent,” said Ray. “We aim to set a new standard for ‘green’ buildings.”

All tall buildings must be built in such a way they can tolerate movement under high wind conditions. “I spend a lot of my time in Hong Kong,” said Ray, “and the lean in some of the towers there can be considerable which means that sometimes a building will be totally blocked out by another, yet at other times you can see some of it. Our buildings will be able to accommodate greater seismic shifts because the movement is not transmitted through the building in the same way as it would be in a single structure.” At present no fully functional Dynamic Tower is in existence.

“Though we have had a lot of interest shown in major world cities such as Paris, London, New York, Moscow, Shanghai, Dubai and Rio,” said Ray who added that he thought that the Brazilian city might well be the first to feature one of these towers. Could it be that everyone is waiting for someone else to go first? Ray shrugged his shoulders in a way that suggested there might be something in that but added: “I think Thailand is the right place for a concept such as this. People are always looking for something to help them stand out from the crowd. This building will certainly help a developer achieve that.”

Economies of scale play a big part in a building such as the “twister”. For example, Ray talks in terms of 78 storeys as being an optimum size. Construction times are reduced considerably when compared to a more conventional building because all the units are pre-fabricated off site before being assembled around the spine. A building that might take 30 months to construct can be erected in 18 months is the claim. Heavy equipment “This means we can work more efficiently,” said Ray. “Many tall buildings need a large land mass at the base to allow heavy equipment on site. Once we have the spine of the building built we don’t need that.” A Dynamic Tower may contain as many as 10 elevators in the spine, some of which can be used for transporting your car to your unit provided you live on one of the upper floors. That’s right, you can park in your own space – a sort of Vroom with a View! The thought of having my crumpled car parked in my unit didn’t appeal but, let’s be honest, units in a prestigious block such as the type Ray represents are not likely to be owned by a guy who runs around in a Honda City, are they? | l Interested in knowing more? star interview  by the interview feed The name on everyone’s lips, Chris Hemsworth, 30, who stars as British Formula One driver, James Hunt in the action movie, Rush, is finally proving his acting chops. The 6ft 3in muscular blonde Australian actor is primarily known for playing the lead in Thor, as well as reprising the famed Nordic hammer-wielding god in Thor, The Dark World which is out this month. Hemsworth, who got his start on the Aussie soap operas Neighbours, and Home and Away, has also starred in Snow White and the Huntsman, Red Dawn, and The Cabin in the Woods. Married since 2010 to Spanish actress, Elsa Pataky (Fast and the Furious films), 37 (who was formerly in relationships with Adrien Brody, followed by Olivier Martinez), the happy couple are raising their daughter, India, born in London in May last year, in Los Angeles.

From Huntsman to Hunt, Chris Hemsworth is making his mark

Strolling around Sydney – Chris Hemsworth with his Spanish actress wife Elsa Pataky and their daughter, India, who was born in May of last year.

The Interview Feed: Did you know much about Formula One racing before this film? Chris Hemsworth: I wasn’t immersed in the Formula One world prior to this and I wasn’t necessarily a fan, but I read the script and I think it captured that world so well. I think whether you are a fan or not, you’ll have some understanding for it. And the sexiness and the gallantry of Formula One in those days was hugely appealing to me, besides the story. The rivalry between those two guys and the psychology behind what they did was fascinating. Four, five guys were dying per year in the ’70s and prior to that, even more. And you think why would you do that as a job, basically for entertainment? And secondly, what does that do to you? So, you see two different versions of that, the by-products of that world: one is Niki Lauda, who is incredibly calculated and focused, and then James Hunt is head down, adrenaline driven, a different version certainly, on and off the track. TIF: You didn’t know about James Hunt at all?

CH: No, not really. He was one of those people I kind of knew about vaguely but Lauda was more familiar and I’d heard about his accident. TIF: Was it fun to act the playboy? You were very convincing. CH: (laughs) Okay, I will accept that. Anytime you get to play a character that does not want to conform to any particular rule or standard of society, and he was certainly I think the biggest example of that, as far as what I have been exposed to, just wanting to do what he wanted to do and love or hate, agree with it or not, I think that you have got to respect that; the fact that he did everything his way. Chasing his own shadow He did what he wanted to do and especially being in a business where there’s so much censorship, where you have to be so careful about what you say and what you do, looking at the way he acts, I thought, (laughs) ‘I would like do so some of that at certain times’. And I’m not talking about the women, I am talking about the reaction he has to a reporter at one point. And just the way he says

TIF: Are you interested in car racing? CH: My dad used to race motorbikes, right up to superbikes before I was born so I was always around the environment. TIF: What kind of bikes did you have yourself? CH: I had dirt bikes as a kid, not much anymore. My wife rides motorbikes more than I do, she’s more of an adrenaline junkie than I am (laughs). TIF: So you ride together, she takes you to places and stuff? CH: No, that would be embarrassing

wouldn’t it? (laughs) If I was on the back? Yeah. That’s not going to do me any good. (laughs) But I was never a race car fan. We kind of grew up surfing and doing other things. TIF: What do you like about acting? CH: It’s a combination of things. I think because there’s no repetition is a big one. I don’t very often get bored in this business because there’s a constant movement and there’s travel but the biggest thing is that I do love acting. Between action and cut which is all of 30 seconds, two minutes at the most sometimes, is that moment where you sink into something. I think you’ve got to have pride in what you do and there have been times I haven’t been proud of my work so you don’t want so many people to see it. Who inspired me But, it’s nice to be a part of something where from working with Hans Zimmer, who did the music for the film, Peter Morgan who was writing the script, and Ron Howard directing, those guys have inspired me to get into the business. 

what he really wants to say and he doesn’t care about consequences. But there are also times, I think, when he was kind of chasing his own shadow; he was trying so hard to be himself and not conform to something and he then became a cliché of himself at times, which I think he was probably aware of. There were plenty of stories that weren’t in the film where he pushed it way too far (laughs). TIF: He was obviously a huge competitor on and off the track. For you, growing up with three brothers, how competitive are you? CH: Yeah, as brothers, the three of us growing up were competitive. We were that way in sport as well as everything else we were doing as kids, which is the way I think most young kids are. And I think more than competitiveness, it was sort of the immediacy that certain kinds of activities are and then they become addictive. That is why we do any adrenaline-based, driven activity. TIF: Like what? CH: Like mountain climbing. A lot of the time, people talk about the actual

TIF: This was your first movie that was in reality and not fantasy. CH: Yeah. TIF: So do you think it will be a new start for you? CH: I love the fantasy world, and the things that I have been doing, but it was nice to not be wielding some sort of weapon, (laughs) to have a much more character-based smaller story and there’s a bit more satisfaction because you have a bit more understanding of what’s happening through it as well. There’s so much special effects and green screens and what have you on something like Thor, that it’s easy to kind of lose touch with what is going on, where as with this, everything we were doing was pretty much going to be what it was going to look like, and I think we all kind of felt that from the beginning. TIF: What about the physical preparations? CH: That was painful. I would rather have to put on weight than have to lose it. (laughs) Basically I went from lifting weights, eating lots of protein to the opposite, running, cardio, under eating, over training and I have said this before, but my wife was pregnant at the time and she reminds me that I was moodier than she was. (laughs) TIF: How much weight did you lose? CH: I went from about 215 to 195, which was painful. TIF: How has fatherhood changed you? CH: I think you don’t tend to sweat the small stuff as much. All of a sudden, and once again, whether you want to be or not, you have got to be present for that, and I absolutely want to be. In perspective But it puts things in perspective. We hear it a lot but all of a sudden you go, ‘Oh, that’s what it’s all about.’ And everything else is driving and supporting her now as opposed to my own personal ego and whatever I want. You tend to think, ‘Well okay, how does this affect the family now? Where are we going to be in the world when

we shoot this?’ And so, yeah, you start to think about things differently. But when we were shooting this film, and a friend of mine was talking about the way kids own their environment and come in and especially at that age, they are unaware of the separation between them and you, everything is just part of what they want and they will pick this up and they will have that and they will throw that over there and they will talk to you and maybe they won’t. Kid-like attitude And there was sort of an element in James where it was a kid-like kind of attitude about his world. It was sort of, ‘I’ll have that; no I won’t’ (laughs) and that was the strange correlation I found around what was going on in my life and with that character. TIF: You just turned 30. How do you feel? CH: One of my best mates just turned 30, and he was like, ‘What happened to my twenties? I can’t believe I’m 30.’ And I was like, ‘I hadn’t thought about it until you said it like that.’ (laughs). But honestly, since that conversation I went, ‘Well yeah, I am not in high school, but I still feel like I am.’ This is a guy that I went to high school and grammar school with and it still feels like we are in high school sometimes. TIF: Would you ever shoot a movie if your wife was in it? CH: Sure, if the right thing came along. I wouldn’t want her to get sick of me though. (laughs) It might be too much of a good thing. (laughs) TIF: What kind of driver are you? CH: I am pretty safe, especially when the baby seat is in the back even when she is not sitting in it. TIF: If you don’t like racing, what did you like as a kid? CH: Surfing, that would probably be what I grew up doing the most, which was the more sort of adrenalinefuelled activity I think and riding dirt bikes. As kids, we lived out in the bush and we used to injure ourselves quite often, whether it was that or rope swings and things that we would build in the backyard. |

he Hound has been to China and eaten Chinese food in Chinese restaurants made by real Chinese people. It wasn’t what he expected. Spring rolls, Kung Pao Chicken,Wonton Soup, Beef Chow Mein … that’s Chinese food right? You’d be hard pressed to find any of those dishes on the streets of Shanghai or Beijing, but London, New York or Sidney? Absolutely! The Chinese food The Hound grew up with is the Western version, decidedly aimed at our palates. That’s the concept behind Chow Box, a new addition to restaurant row on Thappraya Road near Pratumnak Hill and directly across from Mata Hari. Chinese food … just like back home. It is easy to spot with its classically Chinese pagoda façade complete with tiled roof, blood red walls and those crazy Chinese dog-lions at the entrance. Attention to detail As he entered the temple-like entrance, The Hound couldn’t help but marvel at the attention to detail the interior designers of The Chow Box had paid. The colours, the artwork, the furniture actually make this one of the most up-scale Chinese joints The Hound has ever eaten in. Special note was taken of the big round familystyle tables in the rear … nice touch! The extremely charming manager, Khun Ann greeted The Hound wearing a classical Chinese dress and speaking perfect English, just like back home. The Hound called up three dishes, flirted with the hostess and took in the atmosphere, just like back home.

The Hound’s food came out in exactly the order he’d hoped. The Wonton Soup was savoury and smooth with Chinese cabbage and shrimp filling. The Hound unashamedly picked up the bowl to get the last bits. The Spicy Kung Pao Chicken was as The Hound had remembered from back home. It was shiny with the sweet sauce and full of cashew nuts, onion and sprinkled with sesame seeds. The Hound sounds a warning on this dish … emphasis should be placed on the “spicy” part. It is sneaky hot and The Hound found himself, as he often does, ordering another beer to help with the heat (just like back home). Charming hostess The charming hostess Ann suggested a glass of St Helena Chardonnay with the last dish, the crispy duck with rice pancakes. The only thing The Hound could think to say was: “Sounds like a good idea.” The duck was a nice mix of really crispy shreds and chunkier medium-done pieces. The little rice pancakes came out in the still steaming basket. It’s the kind of thing The Hound will continue to assemble and eat until someone comes to take the plate away. The Hound has a theory that an instantly addictive substance is included in the sauce recipe. Khun Ann tried to coax The Hound into testing the famous fried ice cream dessert, but he reluctantly resisted. Rubbing his belly and wagging his tail, The Hound couldn’t help thinking: “If we would have had a Chinese place like this back home … I’d have eaten a lot more Kung Pao Chicken.”

s if the recent thunder storms were not enough, November provides Pattaya with two more reasons to light up the night sky. The first is Loy Krathong, the second most important festival in the Thai calendar, which this year will be celebrated on November 17. During Loy Krathong, the centuries-old festival of water and light, Thais release colourfully decorated krathongs – slices of banana tree trunk decorated with flowers, joss sticks and candles – wherever they can find water. In Pattaya, that tends to be on the beach, at the Floating Market or at Mabprachan Reservoir. Also look out for thousands of sky lanterns – hot air paper balloons with a small fire suspended beneath. It is considered good luck to release a sky lantern, and many Thais believe they are symbolic of problems and worries floating away. Fireworks competition The night sky will also be lit up on November 29 and 30 when the International Fireworks Competition returns to Pattaya for the fourth year. Despite losing most of its participants last year when government support was withdrawn, the four teams from Canada, China, Singapore and the USA still put on a colourful spectacle along Beach Road.

Two of the best vantage points to see the show are the Holiday Inn Pattaya and the Hilton Pattaya, both of which are offering food and beverage promotions during the event. The Holiday Inn offers uninterrupted views of the display from its infinity pool with a BBQ seafood buffet and unlimited soft

Invariably everyone would become disenchanted with the game within an hour because I owned most of the property, had all the money and everyone was paying me rent. “You can’t mortgage property to buy other property!” my mother would protest. To which I would promptly reply, “Read the top of the box mother … it’s in the rules”. As it turns out, there are all kinds of tricks and pitfalls in the game of Monopoly, but

Wishing things were simple will not make them so. Assuming things are the same as in your home country is the ultimate expression of arrogance and you will be punished for it. If you want to play this game and win, please read the top of the box. For those who are apathetic or just plain lazy, I’ve decided to summarise some of the more misunderstood or misinterpreted rules right here in my column this month. Ownership The next time I hear some foreigner whine, “Oh, well you can’t own land in Thailand” I’m going to punch them in the throat. Perhaps I’m being too harsh. Most people are only parroting what they’ve been fed by “property experts” in their own country, paranoid about real estate investor’s money flowing out to greener pastures. So let’s set the record straight. First of all, not all property involves land. In Thailand, foreigners can own condos outright in their own name. Last week I heard some misguided English lady telling her friend, “Well, you can only own half the condo”. I wanted to punch her in the throat too. Somewhere along the line she had heard that foreigners can only own 50 per cent of a condo and gotten it all wrong. I could just imagine her painting a line down the middle of the floor to delineate which part she owned. 

Condominium buildings are allowed to have 49 per cent of the ownership be foreigners; the other 51 per cent is titled to Thai individuals or Thai companies. Usually the mix is more like 40/60. However, there are no condos foreigners cannot own. If the condo you fancy is not allocated for foreign ownership, you can form a Thai company to facilitate the purchase. When done properly, nothing is shady or illegal. There is no danger of some government raid to strip you of your property. Remember, this is Thailand; for every unreasonable law, there is a cottage industry built on getting around it. You can use the same instrument to own a house that includes land. That’s right … your Thai company can own land. Every few years, some big land office will get a new boss that will come in riding a white horse wielding a flaming sword and pledging to “crackdown” on all this foreign ownership. It seems to happen in Phuket about every five years.

dozen or so sieges come and go and nobody loses their house. If you want to make sure you are extra bulletproof, there are some steps you can take to make sure you’re safe. First off, don’t use nominees as shareholders in your Thai company. As a foreigner, you can own controlling interest in your company, and be the director, but you cannot own more than 49 per cent. In fact it is recommended that you own significantly less than that to avoid attention. So, you’ll have a shortlist of Thai shareholders in your company. The quick and easy way is to let your legal advisor plug-in nominees that you don’t even know. I recommend finding real Thai people that you know at least a little bit. In this way it does not appear that the company was formed entirely for the purpose of skirting the prevailing land ownership laws. If you are building a house it

is possible to indemnify yourself against legal issues by separating the ownership of house and land. Use a company to own the land and lease it to yourself for 30 years with options to renew for another 30. Take the lease to the land office, pay the taxes and get the document stamps. Purchase the house (the building) in your own name. You can own a house in your name, just not land. So, in the end you own your house, you own controlling interest in the company that owns the land, and you own an ironclad lease on that land. In essence, you “double own” it. After 14 years in Thailand, I know about 10 people who have lost their houses. All of those people are Americans who “owned” houses in the US and lost them to the bank. The only people I know who have lost their houses in Thailand are the really clueless blokes who thought putting it in their Thai wife’s name was a good idea. If you Townhouse project in Manila.

Lawyers If you doubt your ability to interpret the rules, I recommend you get a lawyer to read the top of the box and explain it to you. Yes … forgive me … I said the “L” word. There are three things you need to understand about lawyers working here in Thailand. First off, most lawyers aren’t; particularly if they are foreigners. Foreigners are not allowed to practice law in Thailand. Usually a foreign run law office is fronted by someone with lawyer status in their own country, who has sufficiently learned a particular field or fields of law here in Thailand and has partnered with or employs real Thai lawyers. Secondly, not all lawyers are Satan. In my home country, proudly the most litigious nation on the planet, lawyers are the scourge of the earth. They are, however, a necessary breed of remora. Nobody, and I mean nobody, could navigate the sea of American legal nonsense without help from some form of interpreter or medicine man. Thailand isn’t that bad, but it’s working hard to get there. Here in Thailand, most of the lawyers you’ll deal with set up shop based on one particular aspect of law, like land purchase or company formation. For the most part, legal eagles I’ve

dealt with have been knowledgeable and instrumental in getting deals done. Get a little help from your friends and choose a legal specialist someone highly recommended. Finally, not all lawyers are created equal. Just because your friend found a shop that was brilliant at getting his Issan sweetheart a visa to meet good old mum and dad in Newcastle, doesn’t mean you want them setting up your Thai company to purchase a house. Most legal shops specialise in one thing like visas, or accounting. Make sure you find a recommended and reputable property law specialist. And one more thing … don’t get cheap; you get what you pay for. Taxes And speaking of accounting (pardon the abrupt segue), this leads me to a completely new paragraph on the top of the box you’ll need to comprehend completely … taxes. Whether you are purchasing a property to live in, rent

out or flip; you are going to incur one or a battery of taxes. Not having at least a rudimentary understanding of what to expect could leave you crying in your beer with no money to pay for it. If you buy a condo in your own name and eventually sell it, you will hopefully make a profit and will incur a certain amount of capital gains tax. That amount is calculated differently depending on how long you’ve owned the property. Less than five years will cost you a percentage of the profit. More than five years will cost less. If you buy a condo or house using the Thai company structure, you will need to hire an accountant to keep the books for you and pay a nominal amount of tax every year to keep the company alive and owning your property. (An added expense with the Thai company purchase plan) When you sell the property you have two options. You can actually transfer the title to the new owner Project in Johor Bahru, Malaysia.

thus incurring a certain amount of transfer fee and capital gain taxes depending on how long you owned the property. Or, you can simply transfer your shares in the company to the new owner and incur only the expense it cost for your lawyer to draw up the papers and execute the change of ownership. (This is one advantage of the Thai company ownership scenario.) If you buy a house using the hybrid ownership plan where you personally own the house but control the land with a Thai company, a sale gets a little complicated and you definitely need to speak the “L” word aloud and get an expert in these matters. Should you decide to rent out your property, the tax structure on this business endeavor is a little different. Rental income paid to an individual is calculated at the personal income tax rate. Most Thai people collecting rent either in cash or deposit to them personally do not claim it as income and pay no tax. Yes, this is tax evasion and is illegal. I’ve never heard of anyone being caught, but I’ve only seen it in its small scale individual form. Most foreigners I know just follow suit. Keep in mind, it is against the law. Personally, I love living in Thailand and would try to steer clear of committing offences that could get me uninvited. Additionally, paying the taxes you owe on rental income does have its advantages, particularly if you ever want to borrow money. As every season passes, I see more and more opportunities for foreigners to establish credit and borrow money. Just like back home, your ability to repay the loan is based on your income. If you don’t pay the taxes on income derived in this country, you don’t get credit for it. It’s something to think about next time you consider cheating the tax collector. Rental income paid to a company is calculated at a business revenue rate. Because it is run through your company, a good accountant should be able to offset expenses and maintenance fees to

Country comparison After reading the last 2,000 words or so, you may conclude that it’s all too complicated and you’ll just rent a place. If the truth be told, it’s not that bad. Again, when compared to the piles of paperwork and long list of professional payroll you’ll be supporting, participating in the property game in my home country is far more complicated than here in the land of smiles.

But nobody is reading the magazine because they are comparing a property purchase in Thailand to one in their home country. Let’s compare playing the game to other countries in the region. Let’s read the top of real competition’s boxes. All of the countries in this region have upsides and down. When it comes to pure “round trip” costs, which is what it costs from buy to ultimate sale; Thailand and Malaysia look like the best deal. Unfortunately Malaysia has some pretty brutal taxes on rental income. Each of these countries has land ownership laws similar to Thailand’s, with slight variations on the same theme; foreigners cannot own land. The periphery rules you may want to review when comparing these venues have to do with visa laws, retiree programs and property owners rights when it comes to disputes with tenants. But that sounds like fodder for “Read the Top of the Box II”. Most people engage in board games to relax and have a good time. For me, a game like Monopoly is stimulating, but I wouldn’t call it “fun”. Perhaps it’s because it is the only board game available that involves the use of money. Even if it’s play money, I take it seriously. And after more than a decade of playing real life monopoly here in Thailand I realise the correlation. The guy who usually wins is the one who thoroughly reads the top of the box! |

ow everyone in the world, other than a few farmers in outer Mongolia, has heard of the “Economy Class Syndrome”, in which you end up getting blood clots in the legs from being squeezed into seat 176A at the rear of the Economy section of Plummet Airlines. The rationale is that after sitting in 176A for the 12-hour flight to bring the bad news to Outer Mongolia, the blood flow in the legs slows so much that clotting forms and you end up with a DVT, or more correctly Deep Vein Thrombosis. This has produced a group of nervous airline passengers, cowering in fear, waiting for hijacking or DVTs.

However, there are many other ways of getting your DVT, and you don’t have to buy an expensive ticket, plus fuel surcharge to get one. You can get one sitting in front of your work computer. Dearie me, your computer is now a killer. Backing up this contentious claim is one of the world’s respected medical publications in which Professor Richard Beasley of the Medical Research Institute in New Zealand studied patients admitted to hospital with DVT and found that only 21 per cent had travelled on long distance flights, while 34 per cent were sedentary office workers who would sit in front of computer screens for three to four hours at a stretch without getting up, and do this for up to 14 hours a day. This showed two factors. Firstly their work habit was dangerous, allowing the blood to pool up in their legs, and secondly, they had magnificent bladder control. While I was joking about the bladder control, I would postulate that to be able to sit for four hours at a time, these office workers were

not drinking enough fluid, leading to thickening of the blood, and even more likelihood of blood clots. Look around your office, how many of the staff have a water jug, or even a glass of water on their work station? Shut off supply What can a DVT do? What happens is very understandable. The clot breaks off from the deep vein and then travels upwards towards the heart. In doing so, it will go from major, large diameter blood vessels into smaller and smaller again. Eventually, dependent upon the size, the clot will become wedged in a very small vessel and shut off the blood supply to that area. If the blockage occurs in the lung, the condition is called a Pulmonary Embolism (PE). PE causes or contributes to up to 200,000 deaths annually in the United States. There is some good news in all this, if pulmonary embolism can be diagnosed early and appropriate therapy started, the mortality can be reduced from approximately 30 per cent to less than 10 per cent. Still, 10 per cent is a little too high for my liking. So what can you do to prevent getting a DVT? Apart from the obvious maintenance of good health with sensible eating and drinking and regular checkups, the important preventive factors include getting up and walking around at least every hour (both in the office and from seat 176A), drinking plenty of water and taking 100mg of aspirin every day. By making it less likely that a clot can form, you remove the dangers of DVT. Go and get a glass of water now! And use it to swallow your aspirin. |

or the past year, I’ve been giving boutique hotels and guesthouses all my travel lodging business. I suppose I was being hip and trendy and saving a little cash in the process. The other weekend I wanted none of that. It was my birthday and a nice stay in a professionally run resort was on my list of gifts to myself. After perusing my favourite travel assistance website Agoda, I found just what the doctor ordered; The Royal Cliff Resort on Pratumnak Hill in Pattaya. There are plenty of resorts in Pattaya that are newer and more recognized, but for Bt2,900 per night in a waterfront mini-suite, I knew I had found a good deal. The Royal Cliff is on the Pattaya

side of Pratumnak Hill down a private drive leading to the Peach Convention Center. The Royal Cliff and the Sheraton are the primary choices for conventioneers at Peach, so besides being a gorgeous seafront resort, it is a fully-functioning business traveller hotel with several meeting rooms. Quick service As I arrived around the 2pm check-in time, the parking lot and lobby were madness. Sensing my trepidation, a guest relations staff member grabbed my bags and ushered me directly to an open desk clerk and had a key in my hand within 10 minutes. The promotion they ran must have been a success as all the minisuites were taken. I gleefully accepted

their apologies and a free upgrade to a honeymoon suite. The Royal Cliff Resort is actually made up of four distinctly different wings: The Royal Cliff Beach Terrace, The Royal Cliff Beach Hotel, The Royal Cliff Grand Hotel, and The Royal Wing Suites and Spas. I was escorted to a waterfront view Honeymoon Suite in The Grand Hotel. It was spectacular. This room was extremely well designed and complete with a canopy bed, a 46” LCD TV in the lounge area, and a big balcony perfect for sunbathing, reading a good book and listening to the waves crash. The Royal Cliff is a sprawling tropical garden-encased resort with an emphasis placed on choices. Choices of things to do … choices


Edgeless pool Without a doubt the swimming pools at The Royal Cliff Resort are an attraction in themselves. After cruising a few laps for exercise every morning in the big pool I enjoyed the first coffee of the day at the swim-up cave-like bar. The edgeless pool down by the sea was breathtaking. I haven’t just hung out by the pool in years. The other main attraction at The Royal Cliff Resort is the restaurants; in total there are 10. Thai, Chinese, Japanese, Indian, Italian and European eateries ensures guests will

never get bored with the food. There’s Breezio with tapas and barbeque down on the beach; Thailand Tatler Award-winning Caprice offers a fine dining taste of the Riviera; Chamu with its trendy sushi bar and Japanese cuisine; Spacious Chrysanthemum offers Chinese and Cantonese delights; Maharani is a cozy and warm Indian restaurant, Rossini claims to be “the godfather’s favourite” and The Royal Grill Room boasting the only underground wine cellar in Thailand. A person could eat themselves silly at this resort. I took one dinner at The Royal Grill Room and was royally impressed. The staff had me sample a few wines and canapés in the wine cellar before choosing a bottle. The wine list is a little overwhelming with choices. Settling on a Malbec, I scoured the menu chockful of a selection of grilled meats and seafood. Ultimately settling on a roast duck breast seasoned with Chinese five-spice and accompanied with a brandy pepper sauce. It was delicate and decadent at the same time. The dessert was a bubbling gooey chocolate soufflé with raspberry sorbet and coconut ice cream. I left the Royal Grill Room with a food buzz and the other half of my wine to finish with my feet up, watching my 46” TV and listening to the waves outside. The Royal Cliff Resort didn’t have to tell me “make yourself at home” … it was just implied. What impressed me most about The Royal Cliff Resort was its

On the morning I was to check out, one of the lobby staff called to set a time to pick up my bags and take them to the lobby. These were people who have been trained. This is a hotel competing for my business. It was my birthday and I wanted to feel special. Thanks Royal Cliff! |

about what to eat … it is the kind of place that keeps you on the property once you get there. Watching sunset on the first evening, I could see clusters of Thai kids dragging their tired carcasses out of one of the six swimming pools facing the sea. The predominant nationalities of the guests were Thai. One nice couple explained to me that the husband had attended a trade show at the Peach Convention Center a while back and had chosen this resort every year for a family vacation. “The kids are crazy for these swimming pools,” he said. “Their favourite is the new infinity edge down by the beach.” In fact most of the Thai people I encountered were pairing the school holiday with the end of low season prices to get the most for their vacation budget. It was nice to see so many families having a good time.

Mortgage finance for foreign buyers

Strong sales At some point one would expect this to cease, questioning where the demand is coming from yet new developments, particularly in the Bangkok, Phuket and Pattaya regions, continue to sell well, with many of the well-established developers still achieving strong sales figures. The Nation has reported that by the end of last year, the top seven Thai developers had shown an increase of 23 per cent on total sales year-on-year. This can only mean that demand is also continuing to grow, both domestically and internationally. roperty finance in Thailand has long been extremely difficult for foreigners to obtain. Due to regulations and perceived risk, banks have tended to reserve their finance options for Thai nationals only, with the rare circumstance of allowing a foreigner to act as guarantor only. Even with this lack of financing available, the demand for Thai properties has remained high and continues to grow. One of the main changes to be seen in Thailand is that even with the constant increase in supply, properties are still increasing in value and price per sqm is rapidly going upwards (the condo price index soared by 9.39 per cent in Q1 of 2013 according to the Bank of Thailand).

ith recent the heavy rains and flooding that was experienced by many parts of Thailand after a tropical storm hit Vietnam, I am sure many of us were casting our minds back to the severe floods of a couple of years ago when many industries were severely affected by the aftermath. Flooding seems to becoming more and prevalent in many areas of the world and perhaps it was just Thailand’s turn back in 2011. I was working in the real estate industry at the time and it is fair to say that there were very few properties available with many Bangkokonians evacuating themselves to Pattaya. This was obviously a major shortterm boost and from my experience, many were pleasantly surprised by

the city, especially the Jomtien and Naklua areas. Although Pattaya frequently experiences flash flooding, we are rarely affected to the same degree that other areas experience and for this we should be grateful.

dangerous. It is not just Naklua that has seen these improvements; there are others areas of the city where attempts are being made to improve the drainage systems and the overall state of the city. Walking experience The recent improvements on Beach Road have made it easier for flood waters to drain away with improved drainage direct into the sea. At the same time City Hall has also improved the walking experience and making the road more passable for vehicles so this should be for everyone’s benefit. All in all these improvements have hopefully started to reduce the chances of Pattaya being the subject of severe flooding in the future and potentially reducing the incidences of flash flooding that can be so damaging for shop keepers. Cynics may argue that the reason behind these improvements is the rumours that Bangkok is sinking; whether these are true of not is something that will remain to be seen but maybe the improvements are as a direct result of this an the city not wanting to get left behind as a major business hub in the region. I am a frequent visitor to Chiang Mai and this is one of the issues that they are preparing for. The general consensus there is that the business hub will move more towards the north. However the city itself often suffers from serious flooding when the River Ping bursts its banks or again with water backing up from the

drains. It appears to me that they are some way behind Pattaya in terms of roadside drainage so perhaps this really is an opportunity that Pattaya can capitalise on. As it is difficult for any layman to predict weather patterns it makes me wonder what the future holds for region. It does appear to me that Pattaya and the surrounding areas do seem to be one step ahead of a lot of the competition. The natural surroundings reduce the chances of flooding and when this is coupled with the improvements in the infrastructure already mentioned it is easy to see why Pattaya is at the forefront of taking the country forward. This, when coupled with the fact that we already have an international airport close by, can only benefit the area for business and tourism. The area is ideal for business with the many industrial estates in the region being too high above sea level to be seriously affected by flooding. This was one of the major problems in Bangkok with many of the yards holding already manufactured cars coming under several feet of water. Car industry hit The cars were destroyed causing billions of baths worth of damage and resulting in some manufacturers pulling out of Thailand altogether. Not only did this harm the car industry but it had a knock-on effect that also hit the country’s reputation as being a manufacturing force.

However, when it comes to Chonburi and Rayong Provinces, the region is booming with these industrial estates and the BOI backing so it is ideally placed for increased investment from both at home and overseas. This brings me round to the obvious connection with the real estate industry here in Pattaya. We know that it is already thriving with the number of condos and housing developments that are springing up around the city but many have questioned whether this is sustainable in the long term. Enhanced reputation Although the connection is perhaps a little loose I would argue that the recent flooding has further enhanced the reputation of the Pattaya. We have once again remained relatively unscathed and have in fact benefitted from the adverse weather. So every cloud does indeed appear to have a silver lining as far as Pattaya is concerned. If industry and business continues to move out of Bangkok and down to Pattaya this can only benefit everyone. Let’s see how long the trend continues, but assuming that it does, the future for Pattaya is looking very bright indeed. I hope you weren’t directly affected by the flooding last month, certainly not in a negative way at least. If things continue in the same way we will all see the benefits. |

What I’d give for a barn find

I

have lived all my life hoping to come across a ‘barn find’. That’s where you discover an old car that has been left in a barn, the owner died and nobody knew it was there, until you come across it and claim ‘finder’s keepers!’ Some of these barn finds can bring millions of dollars at auction, and I was reminded of this by notification from the international auction house Coys. One of the most important E-Type Jaguars to be discovered in recent years and found in a barn near Le Mans in France. Chassis number 40 was left in the barn in 1974 and was there until discovered by Coys a few weeks ago. It has never moved although the engine was fired up some five years ago and turns over freely. “This is a really amazing find which has got the Jaguar world really excited,” said Chris Routledge, managing partner at Coys. “The 1961 car is in amazing condition considering where it was left and interest is going off the scale.” He added: “But this is not the only Jaguar find, we are also selling an

XK120 Roadster reported to have a competition history that was found in a lock-up in Essex. The last XK that we sold in this condition made over £90,000 and we expect the E-Type to do exceptionally well.” Other cars featured in the Spirit of Motoring Auction included a rare Connaught L3 racing car from the collection of heavy metal rock god Ian Hill of Judas Priest, one of the finest Jensen “Interceptors”, a Vignale FF model that the auction house has never seen before, as well as a fabulous example of early motoring, a Ford Model T Speedster. Landmark sale Chris Routledge said: “After the landmark sale of the Douglas Potter Jaguar in April, which made headlines around the world, it is fantastic to be able to sell two more super rare Jaguars which have lain undisturbed for so many years.” So I’ve missed the boat again, but if you have a locked barn in the otherwise vacant lot behind you, let me know first! |
