California Public Records Act Request This document is in response to a formal request pursuant to Government Code section 6250 et seq (California Public Records Act or CPRA) by KCRA News (Sacramento) and the Stockton Record newspaper as well as informal requests by news media. The information requested pertains to the circumstances surrounding the status of a .40 caliber Beretta Px4 Storm semi-automatic pistol (referred now to as “the Beretta pistol”.) The pistol is legally registered to Anthony Silva, the current Mayor of Stockton, CA. The Beretta pistol is currently in the possession of Stockton Police Department and is being held as evidence in ongoing and continuing criminal investigations. Under Government Code section 6254(f) investigatory documents that either would endanger the safety of a witness or other person involved in the investigation, or would endanger the successful completion of the investigation or a related investigation, need not be disclosed. Nevertheless, given the public interest in the status of the Beretta pistol and, that certain information is already in the public domain (“Two guns stolen from mayor,” April 06. 2016, Stockton Record) and, most importantly, a present request by law enforcement for public assistance in solving the crimes listed below, the following information will be disclosed: On January 15, 2015, around 9:40 PM, a residence located on East Church Street, Stockton, was struck by gunfire. Twenty minutes later, the residence was struck again by gunfire. The two occupants in the residence were not struck. Eight (8) .40 caliber and six (6) 9 mm shell casings recovered. No suspects have been identified. Current preliminary findings indicate that the shell casings were fired and ejected from the Beretta pistol. On February 25, 2015, shortly before 7 AM, a 13 year old, Rayshawn H., was in front of his home on South Sacramento Street in Stockton waiting to go to school. An unknown subject fired multiple rounds, striking Rayshawn and killing him. No suspects have been identified. Family members only heard the gunshots and attempted to help Rayshawn after they discovered him shot. A witness described a African-American male wearing a grey sweater and white shoes. Current preliminary findings indicate that the shell casings were fired and ejected from the Beretta pistol. On March 22, 2015, Mayor Anthony Silva called the San Joaquin Sheriff’s Department and reported his home was burglarized. Mayor Silva stated he had last been at that residence on March 19th, 2015. Among a number of missing items were a 100 quart cooler, a generator, a laser printer, camera and game counsel equipment and the .40 caliber Beretta Px4 Storm semi-automatic pistol. No suspects have been identified in the taking of the Beretta pistol. On June 09, 2016, around 2:30 PM Stockton police were called to a Stockton residence on Treetop Drive where there was a complaint of a domestic disturbance. During the investigation, police located the Beretta pistol. The Beretta pistol was taken as evidence and preliminarily tests were conducted. The preliminary tests determined that the Beretta pistol was used in all of the above crimes.


The Stockton Police Department, San Joaquin County Sheriff’s Department and the San Joaquin County District Attorney’s Office are all requesting help from the public in solving these crimes and in bringing justice to the family of 13 year old Rayshawn. The Stockton Police Department is encouraging citizens to call if they have information pertaining to this investigation.
