I

nterest rates are up, the government experienced a shutdown, and changes to rules and regulations are causing some waves in the mortgage industry. Here is some of the latest mortgage news and the areas that are most affected.

“We have seen a rally in interest rates ever since the Fed announced that there would be no tapper,” says Chad Overhauser of AmeriPro Funding. Of course, the Federal Reserve left language in their announcement that in-

dicates that they will continue to evaluate the "data" and may make changes in the future based on what they see. The Fed’s decision to stop purchasing mortgage-backed secu- rities signaled signs of a healthier economy and drove rates u p from the 3 percent to the 5 percent range, so you can follow their an n ou n c e ments to get an idea of when rates will rise or fall. Historically, however, interest rates as still very low (and have fallen since a recent government shutdown) and inventories seem to be creeping up, so it is great time to purchase a house.

Federal Housing Administration (FHA) In the second quarter of this year the FHA made a significant change to its mortgage insurance program. Now FHA mortgage insurance is in place for the life of the loan. This is in contrast to the old program where the insurance could fall off once either the loan reached a certain maturity or the loan-to-value fell below a certain level. Overhauser explains that a significant impact of this change is that more customers are seeking financing via traditional conventional loans as the mortgage insurance requirement on those loans remained unchanged. Conventional loans still offer a 3 percent down program that now competes well with FHA financing options.

United States Department of Agriculture (USDA)

The new census maps have been released for USDA. These census maps determine the eligible areas for USDA financing. With the recent changes to the eligibility and the growth in previously “rural” areas of Central Texas that have seen a surge of suburban growth, there would many homes that are no longer eligible for USDA financing. S i n c e USDA is one of the only r e maining 100 percent loan programs, this will impact the first-time homebuyer. Fortunately, the change (originally scheduled to take place Oct. 1) was pushed back, and the 100 percent USDA financing is still available based on the old Census, at least until the first of next year.

Amendment to TILA Points and Fees Definition (and Qualified Mortgage Standards) The Consumer Financial Protection Bureau (CFPB) has amended Regulation Z, which implements the Truth in Lending Act (TILA). The final rule puts into place certain sections of the Dodd-Frank Act, and will require creditors to make a reasonable, good faith determination of a consumer’s ability to repay a home loan before issuing the loan. The idea is to prevent consumers from taking on mortgages they can’t handle, and discourage predatory lending practices. It also makes certain exceptions for “qualified mortgages,” explains Penny Green of Willow Bend Mortgage. In a qualified mortgage, borrowers cannot exceed a debt-toincome ratio of 43 percent. The requirement goes into effect Jan. 2014.

Affordable housing bond on November ballot

T

he Austin Board of REALTORS has given its support to Keep Austin Affordable and the Affordable Housing Bond. If the $65 million bond package is approved on the Tuesday, Nov. 5 ballot, the bonds would create needed affordable housing for low-income households and protect Austin’s economy. The affordable housing bonds would also ensure that the programs and new affordable developments needed in Austin are funded for another five to six years. The first set of affordable housing bonds, originally passed in 2006, helped repair over 3,400 affordable homes and apartments, as well as bringing a total economic impact of $865 million. You don’t have to wait until Nov. 5 to vote; early voting will run from Monday, Oct. 21—Friday, Nov. 5. Though resale inventory is low, our builders have increased new home starts—which are another driving factor in our success. We appreciate our

W

hen we entered into 2013, the local economic forecasts indicated we would have a productive year. We have definitively seen that and more! Central Texas real estate is on fire and will continue its positive trend into 2014. The number of sold transactions provides a quality snapshot of our strong real estate market. Williamson County saw the month of July set a brand new record with the largest number of homes sold in one month as we topped over 1,000. August followed suit as we continued our explosive trend with numbers we haven’t seen before. If you stop and chat with any WC REALTOR, they will express how busy business is! Mia Hamm, largely considered the best female soccer player in history, is quoted as saying “success breeds success” and within the Williamson County real estate industry we are seeing exactly that with an increase in new WC REALTOR members. Typically holding new member orientation classes every other month has proven not enough

and we’ve increased this to monthly. People throughout the area see the sizzling real estate market, hear our success stories and want to be a part of it. With the strength of our current membership and large new member group, Williamson County Association of REALTORS is the eighth largest board in Texas. A successful real estate market can create busyness and again, ask any WC REALTOR what their schedule looks like and they will probably tell you “they don’t have time to chat.” During an upswing in the industry we have all heard of horror stories of things getting swept under the rug in terms of unnecessary short cuts but it’s been my experience and that of many other WC REALTORS that is not the current case. Agents are actually picking up the phone and reaching out to each other before a transaction is even on paper. Other WC REALTORS have commented that despite being so busy they are seeing an increase in the level of peer-to-peer communication.

Down Payments Federal regulators proposed the new Qualified Residential Mortgage rule, which would relax down payment requirements. The proposed rule aligns with the CFPB’s Qualified Mortgage (QM) rule, but does away with the 20 percent down payment requirement—a victory for affordable housing.

“Consumer Mortgage Choice Act”— Affiliated Business Arrangements Revised legislation in the Consumer Mortgage Choice Act of 2013 makes changes to the Truth in Lending Act to ensure more consistent and fairer treatment of mortgage lenders with more than 25 percent ownership in affiliated businesses (such as builders who also own title companies, or mortgage banks who also hold insurance brokerages, for example) under the Ability to Repay/Qualified Mortgage rule. The effect of the additional language, Penny Green explains, would be to modify the definition of “points and fees” and level the playing field for affiliates. In detail, the legislation aims to: 1) Clarify that amounts paid into escrow for the future payments of taxes and hazard insurance are excludable from the definition of “points and fees,” making the provision consistent with the exclusion of tax and insurance escrows for purposes of calculating “finance charges” under TILA Sec. 106 (See §103(bb)(4)(C)); 2) Permit the exclusion of charges for title insurance regardless of the title company’s affiliation with a creditor or mortgage originator provided i) the charge is reasonable and ii) in the case of an affiliated title company, that it and its affiliates are operating in compliance with RESPA’s conditions for affiliated business arrangements.

3) Make the new language effective and prevent market disruption and give CFPB power to promulgate appropriate regulatory changes in an efficient manner. A significant effect of this new legislation is a required 3 percent cap on fees and charges. Discount points and origination fees and closing costs cannot exceed 3 percent, and in some cases where there are affiliated businesses involved in the transaction, those fees, including all closing costs, must be even less for each business in order to stay under a total 3 percent.

Changes to Good Faith Estimates Changes to the Good Faith Estimate (GFE) forms went into effect back in 2010, as part of amendments to the Real Estate Settlement Procedures Act (RESPA), and the GFE became a 3-page form that did not require a signature. Now changes to HUD, TILA and the GFE will result in some differences in the forms that must be corrected and will require software changes for mortgage and title companies. The GFE will be a one-page form including the Truth in Lending Act, and will require the borrower’s signature. However, there is little guidance available on how to implement these changes. The Mortgage Bankers Association has asked the CFPB for two years to implement the requirement because of the time and software changes needed to modify the forms. HUD offers samples of the new form online, and you can also find more information on these and other regulatory changes through the Mortgage Bankers Association (www.mbaa. org), and by staying connected to local professional associations in real estate, lending and homebuilding, who report on the latest industry news. ave you ever had a phone call from another agent who was irate or who didn’t seem to care what you have to say. It is extremely hard to work with an agent over the phone when they are obnoxious and aggressive. You may consider hanging up the phone on this person, but don’t. A rude agent may be using that aggressive behavior as a mechanism to avoid the possibility that one might realize a certain weakness in them. Rude agents don’t really realize that they may actually be making things worse by behaving in this manner. We understand that this is a very competitive business and we must do everything we can for our client, but we are in a customer service business. How we provide customer service is by helping buyers and sellers through the process of buying and selling real estate. The best way to make the transaction more effective and effortless is to be civil. Being civil does not always mean saying, “yes” to everything. There are always ways to say “yes” when what you are really saying is “no.” Lead the other agent to the answer you are look-

ing for. It doesn’t matter if the other agent thinks an idea is their idea. Remember, it’s not about you, it’s about the client. Today’s market has put us all in a pricing war and a beauty contest. The seasoned agent knows how to work on behalf of the client whether you are on the buyer’s side or the seller’s side. It’s not necessary for one agent to tell another agent “how it’s going to be.” Remember the Golden Rule. In the books, “The Millionaire Mind,” and “The Millionaire Next Door,” the author found the successful people had one major thing in common; extreme levels of integrity and character. Consider the words “please,” “thank you” or “excuse me.” Offer your assistance and share pertinent information. Extend good wishes and congratulate successes. Most importantly offer an apology when you make a mistake. We as REALTORS must be mindful of the damage to the industry that results from bad behavior. Be sincere and be assertive. Don’t ever forget your duty of ethical behavior towards everyone. In the end, nice does not mean you will finish last. RL

Clients expect you to know the latest mortgage news— pass it on

s agents, we need to stay current on many things. The average sales price in the areas we specialize in, the average prices per square foot and the average days on the market are examples of information about property we need to know. Other questions we are often asked concern mortgage rates. “Do you think they will go down any further?” “When do you think they will go up?” “Should I wait or buy now?” “Should I lock my rate?” As agents, we give our best guess at any given time. Our crystal balls are broken. When I first became an agent, interest rates were 17 to 18 percent. Sellers paid a lot of points to buy down the contract rates so buyers could qualify. Since I was new and didn’t know any better, that market was normal for me. Since that time, interest rates have plummeted. It is a far cry from quoting an 18 percent rate to quoting a 4 to 4.5 percent rate. Now, when people ask me for my opinion on what to do regarding interest rates, I tell them what I have read, “According to Bernake....” or “I read in the New York Times...” The reality of the matter is I do not truly know.

So many things have an impact on interest rates. The U.S. getting into a war in Syria or the economy in Europe impacts interest rates here. A decision by the Feds can raise or lower interest rates. How could we possibly predict what interest rates will do? Our buyers expect us to guide them. One suggestion is to form a close working relationship with a mortgage lender. They know—or should know—what is happening in the market. I have two mortgage lenders I work with and frequently call them regarding the market. They keep me informed and I value their knowledge. When buyers push for a definitive answer on what interest rates will do, I have two answers. Though the remarks seem flippant, they are accurate. One is “Rates go up and rates go down. All I can tell you is they fluctuate.” The other is “I wish I could tell you. I can tell you what they did recently. My crystal ball is broken.” Everyone wants to know what interest rates are doing. It is mortgage news. You need to have trusted sources to give you the latest information and news and then pass it on. RL

W

e have a brain that acts as a computer hard drive, recording information and data. To the right is a diagram of the brain, which has two sides, left and right. The left side is analytical, used for reason and logic. The right is creative, and responds to light, color, music, etc. As humans we are also blessed with a mind that processes, interprets and distinguishes that recorded information and allows us to make decisions. The mind is in two parts, conscious and subconscious. The conscious mind is usually in pretty good shape. For example, if you ask someone if they want to be rich and happy, they usually reply, “yes!” Now ask him, “Why aren’t you?” and listen to that response. This is where the subconscious mind kicks in. What’s the deal with Prop 6? So little water, so close to home

D

espite the recent rains, most of Texas is still in a drought — one of the longest and driest in state history. At the same time, Texas is also growing, with the population expected to double in 40 years. Nobody thinks this is a good combination. The question is, what’s the best way to deal with growing cities and suburbs, on the one hand, and potentially shrinking water resources on the other? The Texas State Legislature came up with a plan, passed by wide majorities of both houses in May, but the lawmakers sent it to voters to ratify (or reject) in the form of a constitutional amendment. On Nov. 5, Texas will vote on Proposition 6, which siphons $2 billion from the state’s “rainy day fund” to help finance and coordinate water projects across the state. Prop 6 sets up a State Water Implementation Fund for Texas (SWIFT) to administer the $2 billion, through low-interest loans and other financial support for approved water development projects. Under the proposed amendment, 20 percent of the money is supposed to go toward water conservation and reuse, with another 10

percent aimed at rural areas and agricultural water conservation. The state Water Development Board and local planning groups will work together to prioritize which projects get funded first. There are more than 4,500 projects in the State Water Plan, ranging from tapping into new groundwater reservoirs to desalination projects and damming up rivers and streams. Supporters of Prop 6 include the League of Women Voters, the Chamber of Commerce, some conservation and agriculture groups, and a bipartisan coalition of state lawmakers, organized by House Speaker Joe Straus (R-San Antonio). The two main political action groups pushing for passage of Prop 6 are Straus’ Water Texas and H204Texas, financed by oil and gas companies, water utilities, municipal water districts, and engineering firms. Opponents include some Tea Party-aligned lawmakers and Independent Texans, a Bastropbased political action committee headed by Linda Curtis. Curtis argues that lawmakers and real estate developers are playing on Texans’ fear of

drought to benefit “water speculators and real estate interests” friendly with Gov. Rick Perry. “If you trust a so-called new and improved Texas Water Development Board that has two of three Perry cronies making decisions, then go ahead and vote for Prop 6,” Curtis says. “I won’t.” The Tea Party lawmakers, like Rep. David Simpson (R-Longview), opposed Prop 6 because they believe the free market is the best way to develop Texas’ water infrastructure. Some conservation groups are wary of the plan because artificial reservoirs wreak havoc on ecosystems and speed up the evaporation of water resources. “The water crisis affects every corner of our state in a very real way,” says Straus, and “a drought doesn’t care if you’re a Democrat, a Republican or an independent.” Prop 6 enjoys broad bipartisan support in the legislature, he adds, but voters need to do their part. “These elections don’t usually trend on Twitter, or get ratings on cable television, but they are important.” RL
