We've designed a Rental Program System that allows us to estimate an income for your property based on how much time you decide to rent it out through the ALBALUZ Rental Program. The Rental Program was designed with a point-pool system to ensure fairness and returns for property owners participating in it.

Through the rental program, we take full care of your property during rental time. With hotel-like operation management, guests will check-in at the front desk with a credit card, allowing us to fully cover any expenses or damages made to the property during its rental period and allow our staff to fix any issues immediately.

The Rental Program is an opt-in option with a term of FIVE years.

When you opt in, a rental package must be acquired. Package values cost as follows:

Two bedrooms $50 000

Three bedrooms $65,000 USD

This rental package includes full furnishing, decorations, and equipment for your property, preparing it for reliability, and ensuring stock for replacements. It standardizes your property's design and quality with all other properties in the rental program.

Yes and no. It is relatively the same in terms of security of title. However, legal documents are somewhat different. A fideicomiso, which is a 50-year renewable trust, allows foreigners to own property/real estate in the restricted zone of Mexico with all incidental rights of real property ownership. The escrow company and notary will oversee the process on your behalf.

Is Title Insurance offered on land and property held in a fideicomiso?

Yes – all of the properties have US Title Insurance companies offering Title Insurance and complete escrow services.

What forms of security do owners receive as foreigners?

Yes, there are HOA fees. They will cover maintenance and cleaning of common-use areas, common-use equipment, general management, and front-desk concierge services. They will also include utilities needed to operate the condominium, including but not limited to the following: elevator servicing policy, elevators, pest control, exterior window cleaning, phone, internet, swimming pool heating, electricity for water pumping, exterior lighting, and purifying water supply. Additional fees in the HOA fee could include insurance for the building and buildings’ equipment, building security, trash removal, and the condominium reserve fund. The approximate cost will be $4.00 per private + exclusive use square meter per month.

Does the HOA provide insurance against hurricanes & other natural disasters?

Yes, the master policy covers all exterior areas and common areas in the condominium (common areas). Each owner must purchase additional property insurance for their personal valuables within their property.

What solutions does the developer recommend for hurricane protection? Will the property come with hurricane shutters?

The property will count with hurricane shutters that are likely to be included in the price of each unit.

Do windows have sun-shield protection?

Each unit counts with 3-meter (approximately 10-feet) wide terraces that generate lots of shade for the interior of the unit. Additionally, the crystals used for windows are Saint Gobain, which allow 90% of luminosity to pass through the glass but only 30% of the heat generated by the sunshine. This, with the end of maintaining light in your apartment but minimizing the heat that enters and is retained in your apartment – ideal for sunny, hot climates like the one in Los Cabos.

Who represents my interest in the business transaction and purchase?

The external licensed brokerage and optional escrow or title company serves as a third party to protect the interest of both the buyer and seller. You are also welcome to involve your personal attorney.

What guarantee do I have as a homeowner that the work will be done correctly and on time?

The Escrow company will work as a liaison that will release the funds in increments based on the progress that has been made on your condominium. Are there property taxes in Mexico? How is payment handled?

There are property taxes in Mexico. They are significantly lower than in the USA. Real estate owners in Mexico pay a 2% acquisition tax as part of their closing costs. A nominal property tax (of approximately $500 USD) is charged on an annual basis. Property taxes are due in January of each year. Los Cabos county gives a 30% discount to owners if they pay during the month of January.

Can I expect my home to appreciate in value?

Yes. While real estate in Los Cabos has appreciated in recent years, beach front projects are extremely scarce, especially in fully developed beaches like where ALBALUZ is located.

What is the source of my water supply? Can I drink the water? Water is available from the respective municipality. Purification systems are also readily available.

Can I rent my home? What is the rental feel? How is it rented?

Is financing available?

Yes. Mexican and US loans are available to those who qualify.

There are several financing options available, during the construction phase (including payment plans). En todas las transacciones comerciales de compraventa de casa habitación, el proveedor se compromete a que éstas se lleven a cabo conforme lo dispuesto en la LFPC, su Reglamento y a esta NOM, por lo cual reconoce que los consumidores cuentan con los siguientes derechos:

1. Recibir, respecto de los bienes inmuebles ofertados, información y publicidad veraz, clara y actualizada, sin importar el medio por el que se comunique, incluyendo los medios digitales, de forma tal que le permita al consumidor tomar la mejor decisión de compra conociendo de manera veraz las características del inmueble que está adquiriendo, conforme a lo dispuesto por la Ley.

2. Conocer la información sobre las características del inmueble, entre estas: la extensión del terreno, superficie construida, tipo de estructura, instalaciones, acabados, accesorios, lugar de estacionamiento, áreas de uso común, servicios con que cuenta y estado general físico del inmueble.

3. Elegir libremente el inmueble que mejor satisfaga sus necesidades y se ajuste a su capacidad de compra.

4. No realizar pago alguno hasta que conste por escrito la relación contractual, exceptuando los referentes a anticipos y gastos operativos, en los términos previstos por la LFPC.

5. Firmar un contrato de adhesión bajo el modelo inscrito en la Procuraduría Federal del Consumidor, en el que consten los términos y condiciones de la compraventa del bien inmueble. Posterior a su firma, el proveedor tiene la obligación de entregar una copia del contrato firmado al consumidor.

6. Adquirir un inmueble que cuente con las características de seguridad y calidad que estén contenidas en la normatividad aplicable y plasmadas en la información y publicidad que haya recibido.

7. Recibir el bien inmueble en el plazo y condiciones acordados con el proveedor en el contrato de adhesión respectivo.

8. En su caso, ejercer las garantías sobre bienes inmuebles previstas en la LFPC, considerando las especificaciones previstas en el contrato de adhesión respectivo.

Annex A

Content of the Letter of Consumer Rights

In all commercial transactions regarding the purchase and sale of real property, the supplier is obliged to ensure that they are carried out in accordance with the provisions of the Federal Consumer Protection Law (LFPC), its Regulations and this NOM, and therefore acknowledges that consumers have the following rights:

1. Receiving, concerning the real property offered, truthful, clear and updated information and advertising, regardless of the means of communication, including digital media, allowing the consumer to make the best purchase decision by knowing truthfully the characteristics of the property been acquiring, by the provisions of the Law.

2. Knowing all the information regarding the characteristics of the property, such as: the extension of the land, floor area, type of structure, facilities, finishes, accessories, parking place, common use areas, utilities, and the general physical condition of the property.

3. Choosing the property that best meets the consumer’s needs and fits the purchasing power.

4. Not to make any payment until the contractual relationship is set in writing, except for advance payments and operating expenses, in accordance with the terms set forth in the LFPC.

5. Signing an adhesion contract registered in the Federal Consumer Protection Agency, in which the terms and conditions of the sale and purchase of the real property must be stated. After signing the contract, the supplier is obliged to deliver a copy of the signed contract to the consumer.

6. Acquiring a property that has the safety and quality characteristics contained in the applicable regulations and reflected in the information and advertising received by consumers.

7. Receiving the real property within the terms and conditions agreed upon with the supplier in the respective adhesion contract.

8 If applicable, the enforcement of real property guarantees provided for in the LFPC, considering the specifications set forth in the respective adhesion contract.

Access to a Privacy Notice to know the treatment that will be given to the personal data provided by the consumer, giving consent thereof and ensuring that personal data will be treated in accordance with the applicable regulations; in addition to making available to the consumer mechanisms to exercise the Rights of Access, Rectification, Cancellation and Opposition.

5. Receiving a treatment free of discrimination, without the support or sale of a real property being denied or conditioned for reasons of gender, nationality, ethnicity, sexual preference, religion or any other particularity under the terms of applicable law.

6. Freedom to choose a notary public to carry out the deed process.

PURCHASING PROPERTY IN THE "RESTRICTED ZONE" OF MEXICO

The Mexican Constitution prohibits foreigners from purchasing or owning real estate within that area of land which is less than 62 miles (100 kilometers) inland from its borders or less than 31 miles (50 kilometers) inland from its coasts. This area is defined as the "restricted zone." The form of ownership will depend on the type of use for which the property will be held.

If the property is for residential or similar purposes, the property must be owned through a bank trust (also known as a fideicomiso). The mechanism by which this trust is created is simple. The Mexican Department of Foreign Affairs (Secretaría de Relaciones Exteriores) issues a permit to a Mexican bank of the purchaser's choice, allowing the bank to act as purchaser for the property on behalf of the purchaser and with the funds of the beneficiary. The purchased property is placed in "trust" and constitutes the trust estate. The bank is the "trustee" of the trust and the actual purchaser is the "beneficiary " The beneficiary can be a single person, multiple partners, a foreign corporation, an estate trust, a living will, or any other entity. Only a Mexican bank can act as trustee of these types of trusts, and it's common for US and European investors to use the Mexican subsidiaries of international banks for these matters. The trustee will take instructions only from the beneficiaries.

The beneficiary has all incidental rights to the ownership of the real property, including (but not limited to) the right to use, enjoy, occupy, possess, lease, build upon or otherwise improve the property. The beneficiary may also transfer the property by instructing the trustee to transfer the beneficiary's rights to another qualified owner, or in the case of the death of the beneficiary, by providing in the trust instrument to bequeath the property to an inheritor.

It should be noted that an important provision of this type of trust is that it allows for a successor beneficiary, creating in essence a succession structure in the event of the death of the beneficiary. The initial term of the trust is 50 years, and it can be renewed indefinitely for additional periods of 50 years, providing for long-term control of the asset.

If the property will be purchased for development or investment purposes, it can be owned through a Mexican corporation. That corporation may hold fee simple title. No corporation may own land in the restricted zone for personal residential purposes.

TITLE INSURANCE

Wherever buying real estate, the investor shall always obtain title insurance to protect the investment. Most major US title insurance companies have operations in Mexico and offer title insurance for the purchase of real estate in most areas. Title Insurance is purchased for a one-time fee and, once acquired, protects the policy holder as long as there is a vested interest in the property Title insurance is a contract of indemnity that protects the property rights transmitted to a new property owner/lender and indemnifies the policy holder against damage or loss arising from a defect in title. Title insurance typically covers:

Invalid documents executed under expired/non-existent power

False assumption of identity concerning the legitimate property owner

Liens and financial burdens charged to the previous property owner

Non-registered easements

Hidden heirs of previous owners

Frivolous lawsuits on property title

Most major title insurance companies in Mexico have escrow departments in the US to provide all parties with the comfort necessary in a real estate transaction. This has allowed reputable third-party escrow services (the Title Company) to hold money in individually US numbered and insured escrow accounts until all matters and items are required for closing in Mexico are completed and the property rights have been transferred to the purchaser.

When purchasing property, one of the most important considerations for both a buyer and a seller is whether and under what conditions the transaction funds will be safely held and distributed by an independent party. In an international transaction, the issue is even more important and often complicated, as either the purchaser or the seller may not be familiar or comfortable having funds deposited in an unfamiliar jurisdiction or with an unfamiliar attorney or bank. Utilizing escrow services provides cost-effective security to all the parties involved in a real estate transaction.

Any purchase of property incurs closing costs. The typical and customary closing costs for the purchase of real property in Mexico include permit fees, notary fees, Acquisition Tax, certificate of no liens, appraisal and registration or recording fees. What amount the closing costs will be may vary, especially if the fees are negotiated favorably for matters such as appraisals, notary fees, and other items that are not regulated or set by law Depending on the state where the property is located and the notary public involved, it should be assumed that typical closing costs will run approximately 4% to 5% of the purchase price.

The primary fee, and the most important fee at closing, is the Acquisition Tax. This tax is paid by anyone purchasing or acquiring property in Mexico (whether Mexican citizen or foreign buyer). The acquisition tax is 2% of the purchase price (and can be higher in certain jurisdictions that may impose some form of local tax) and is paid when the actual closing takes place and the transfer deed is recorded.

NOTARY PUBLIC

A Notary Public is required for the purpose of handling the closing of any real estate transaction in Mexico The Notary "Notario Publico" is very different than in the US - they are highly qualified attorneys that act as Clerks of the Court. They are invested with public faith, they verify the identity of the parties, and are responsible for the legality of the content in civil contracts. They also withhold taxes, register documents and order the public deed (escritura pública) to be recorded with the local property public registry (registro publico de la propiedad).

The loan origination fee is the fee that the mortgage broker gets paid for originating and funding your loan. In Mexico, there is no Yield Spread Premium (YSP) being paid by the bank. The YSP is what the bank pays the mortgage broker for selling a particular interest rate. Payment of YSP is the reason that in the US you can get a zero origination (zero point) loan. The mortgage broker sells a higher rate to the client and is then compensated by the bank. In Mexico there is no YSP paid. The rates are fixed and there is no ability to buy down the rate or for the broker to sell a higher rate. In Mexico all mortgage broker income is paid by the borrower and it is disclosed on the good faith estimate. While in the US the standard broker income is 2% per transaction, in Mexico the income remains the same whereas the timeframe and workload for the mortgage broker is easily quadrupled

Appraisal Fee

In Mexico there are two (2) appraisals conducted for every financing purchase. They are the commercial appraisal and the catastral appraisal

Commercial Appraisal:

This appraisal is conducted by the lender for their value purposes and your loan purposes. It is done in a US style and is done by a US certified and bank approved appraiser. Each lender has its own way to calculate this fee, but it ranges in price.

Catastral Appraisal:

This is the appraisal conducted for Mexico valuation purposes. It records the value of your new home with the Mexican government.

Credit Report Fee

This fee is a direct cost of your broker pulling your credit report

Processing Fee

Fee resulting from the processing of your loan.

Underwriting Fee/Wire Transfer Fee/Funding Fee/Courier Fee

All bank related fees and represent their respective services.

Shipping/Handling Fee

This fee represents the charges for the documents that your mortgage broker will mail internationally during the course of your loan.

In Mexico, there is a 1% fee due to the lender in some cases for the use of a loan program's product. This is very different from the US where lenders compete for your business. In Mexico there are fewer lenders and there is high demand for their products - for which this fee is levied to their customers. Depending on what loan program you choose, you may or may not be subjected to this fee.

Settlement or Closing Fee

The charge that any 3rd party closing company will bill you for all the services inherent to a real estate closing transaction - such as the processing and management of all related permits (fideicomiso, appraisal, notary coordination, etc.).

Notary Fee

A US notary and a Mexican notary have completely different responsibilities. A Mexican notary is a state appointed attorney. Their signature needs to be on every title recorded or the title will not be valid in Mexico. Their fee is non-negotiable as is their participation in your transaction

SRE Permit

This permit attaches itself to the home For us to order this document, we collect the water bill, tax bill, copy of the current title, condominium regime, and all HOA documents and then submit them to the Ministry of Foreign Affairs (Secretaría de Relaciones ExterioresSRE). The SRE permit can take anywhere between 2-4 weeks and is handled by the bank acting as fiduciary or the closing company.

Trust Setup Fee

Your Mexican bank trust, or fideicomiso as it is legally called, is the 3rd party instrument used for you to take title. It gives you a renewable 50 year term which is incidental to ownership rights on the property and it has been used by individual foreigners to take residential title in Mexico since 1972.

Your yearly trust fee is fixed and is prepaid at the beginning of each year.

Trust Recording Fee (Trust Registration and Guarantee Registration)

This is the fee paid to record the trust with the Government. It is based as a percentage of the catastral appraisal which is essentially your purchase price.

RNIE

This fee is related to the setup of your trust, consisting in the National Registration of Foreign Investment.

Acquisition Tax

This is your real estate transfer tax. It is paid at the time of initial transfer of title and is paid every time there is a transfer of title in Mexico on any property. The yearly property taxes thereafter are minuscule compared to the US (approx. $500USD on average).

No Liens Certificate

This certificate ensures that your property is free of liens.

Rule of thumb

Must closings to foreigners opening a bank trust or Mexican company, total cost about 4.5% of the purchase price.

The closing cost could be expensive compared to the US or CAN, but property taxes are way lower.

Once you have selected your desired unit from the available options on the price list, the next steps in the process unfold as follows: A refundable deposit of $5,650 is placed into the escrow account This deposit covers the Due Diligence process, which spans 15 days and involves a comprehensive review of the legal terms pertaining to the property. (Please note that a $650 escrow fee is non-refundable.)

Should the buyer choose not to proceed within these 15 days, they have the option to request a cancellation and reimbursement of the deposit. This concludes this phase of the process. When the decision to proceed is made, a 30% down payment is required. At this point, full commissions are paid out. The remaining balance is structured into 24 equal monthly payments.

Should the decision be to continue, the next step involves signing the promissory trust (Fideicomiso) contract. Just to let you know, the money deposited for this stage is no longer eligible for reimbursement. Additionally, the buyer must deposit the agreedupon difference as outlined in the sales plan.

This amount is directly credited to the developer. All subsequent payments must be directed to the developer, following the agreedupon schedule.
