Founded in 1949, Royal College of Nursing, Australia (RCNA) is Australia’s peak professional nursing organisation, and is highly regarded throughout the Australian health care industry. HOT TOPICS Health care updates Grants and fellowships continue to inspire professional excellence in Victorian nurses and midwives Royal College of Nursing, Australia - media release 01/07/2010 A range of grants and fellowships for Victorian nurses and midwives previously administered through the Nurses Board of Victoria (NBV) will continue to be available through Royal College of Nursing, Australia (RCNA) from July 1, 2010. The NBV grants and fellowships program has enabled many Victorian nurses and midwives to undertake research and projects related to improving health outcomes and changing scopes of practice in nursing and midwifery. It is good news that this support won’t dissipate when the regulatory functions of the NBV are transferred to the Nursing and Midwifery Board of Australia (NMBA), with the national registration scheme commencing tomorrow. “Through the new administration arrangements with RCNA, the NBV have ensured Victorian nurses will not lose the financial benefits they have enjoyed through having a state registration body,” RCNA President, Associate Professor Stephanie Fox-Young FRCNA said. Principles, terms and conditions Terms and conditions for advertising in RCNA publications The terms and conditions upon which Royal College of Nursing, Australia ABN 69 004 271 103 (“RCNA”) will publish an advertiser’s publication and advertisements (“advertisement”) are set out below (“terms”). 1. For the purposes of the terms, advertiser means any person or entity (including their employee, agent or subcontractor) who requests RCNA publish an advertisement in any RCNA publication. 2. Subject to the terms, RCNA will use reasonable endeavours to publish advertisements in the format agreed with the advertiser. 3. An advertiser must provide an advertisement in the form required by RCNA from time to time. 4. RCNA reserves the right to refuse or withdraw from publication any advertisement (including inserts) at any time without giving reasons (even if the advertisement has been previously published).
12. An advertiser must not, unless approved by RCNA in writing, refer to RCNA in any advertisement placed in any other publication to aid its credibility. 13. An advertiser must ensure the information in any proposed advertisement is accurate. 14. RCNA is not liable for any loss or damage whatsoever to any advertisement material (including negatives, artwork, disk or other materials that are the property of the advertiser) left in RCNA’s control. 15. An advertiser must immediately notify RCNA of any error as soon as it appears, otherwise RCNA accepts no responsibility for re-publishing such advertisements. 16. RCNA may re-publish the previous advertisement of an advertiser if the advertiser does not provide RCNA with new advertisements before the material deadline (that is; the deadline for an advertiser to provide an advertisement), as set by RCNA from time to time.
9. Cancellation of any advertisement after 5pm on day of the booking deadline, as specified by RCNA from time to time, will incur a 50% cancellation fee.
17. The advertiser warrants to RCNA that the publication of their advertisement does not breach or infringe: (a) the Trade Practices Act (Cth), Fair Trading Acts (state) or equivalent legislation; (b) any copyright, trade mark, obligation of confidentiality or other personal or proprietary right; (c) any law of defamation, obscenity or contempt of any court, tribunal or royal commission; (d) state or Commonwealth privacy legislation or anti-discrimination legislation; (e) any financial services law as defined in the Corporations Act 2001 (Cth); or (f ) any other law or applicable code.
10. RCNA may place the word “advertisement” on any advertisement that in RCNA’s opinion: (a) r esembles the journals’ editorial style; or (b) c ould be mistaken by readers as editorial matter.
18. T he advertiser acknowledges that it has not relied on any advice given or representations made by or on behalf of RCNA in connection with the advertisement.
11. RCNA may place on any advertisement a disclaimer, in the form RCNA determines, that RCNA does not: (a) endorse the product or services advertised; or (b) g uarantee any of the claims made for any product or service by a manufacturer or service provider.
19. The advertiser indemnifies and agrees to keep indemnified RCNA, its officers, employees, contractors and agents against any costs, expenses, losses, damages, liability, claims or proceedings whatsoever which may arise from:
5. RCNA may request from an advertiser any additional information RCNA reasonably requires to determine whether to publish the advertiser’s advertisement. 6. All advertising rates and charges are GST exclusive unless specified otherwise. 7. All orders are subject to any rate adjustments that occur during the period of the order. 8. Cancellations of any advertisement by an advertiser must be provided in writing to RCNA.

(a) t he publication of the advertiser’s material pursuant to their order; (b) any breach of these terms by the advertiser; (c) any negligent or unlawful act or omission of the advertiser in connection with their advertisement. 20. RCNA is, under no circumstances, liable to an advertiser for any indirect or consequential losses, loss of profits, loss of revenue or loss of business opportunity incurred in consequence of the publication or non-publication of the advertisement. 21. These terms represent the entire agreement between the advertiser and RCNA for the advertisement. 22. These terms may only be varied in writing by RCNA. 23. RCNA is not liable for any delay or failure to publish the advertisement caused by a factor outside RCNA’s reasonable control (including but not limited to any act of God, war, breakdown of plant, industrial dispute, electricity failure, governmental or legal restraint). General principles for accepting advertisements for RCNA publications RCNA will generally accept for advertisement in RCNA’s publications, advertisements which, in RCNA’s sole opinion: (a) are directly relevant to, effective and useful in, the practice of nursing, nursing education, health care and nursing service delivery, and for nurses as professional practitioners; or (b) are for products and services that are of interest to nurses and their families as consumers. RCNA will generally NOT accept for advertisement in RCNA’s publications, advertisements which, in RCNA’s sole opinion: (a) are for or promote alcohol, tobacco, or other products harmful to health; (b) are for lifestyle activities which promote potentially risk taking behaviours, or that reflect unfavourably, either directly, indirectly or by implication, on the nursing profession or its interests; or (c) are for products or services which are the subject of litigation with respect to claims relating to the product or service.

RCNA may accept for advertisement in RCNA’s publications, advertisements for apparatus, equipment, pharmaceuticals and other devices intended for therapeutic purposes. RCNA may request an advertiser provide any scientific and technical data, or an acceptance of the apparatus, equipment, pharmaceuticals and other devices by the Therapeutic Goods Association (TGA). RCNA may refuse to advertise any products for which scientific and technical data as to the product’s safety, operation and usefulness is not provided on request or is incomplete. General principles of form of advertisement required by RCNA Advertisements must: (a) clearly identify the product or service and the advertiser; (b) conform to professional standards of good taste and must not be demeaning or discriminatory in any way; (c) be clearly distinguishable from editorial content; (d) not breach any law.
