Residential Leasing I

n these recent economic difficult times when most investments have had disappointing returns, investment in residential property for leasing has held up its own. The letting market has proved itself to be a sound and profitable area in which to invest. As mortgages have become difficult to secure, particularly for first time buyers and with the increase in migrant workers moving to the North East of Scotland for employment there has been an increasing demand for rented property such that in certain areas the demand far outstrips the supply. Sharp minded investors have capitalised on this demand and in some cases have built up a portfolio of properties for letting out. In addition to the investor we have also seen a new category of landlord, sometimes referred to as the “reluctant landlord”. This type of landlord is the property owner who would ideally like to sell his property, usually his own home, but due to poor market circumstances is unable to find a buyer in a position to proceed with a purchase of the property. After some time on the market with no immediate prospect of a sale, such homeowners will take the decision to lease out their property thereby allowing them to move on and at the same time ensure that any overheads are covered by the rental income. In this way the “reluctant landlord” is able not only to cover costs but in most cases to make a profit. And in those cases where the landlord has already bought another home and moved out of the property the landlord need not worry about paying for utility services and Council Tax for a vacant property and does not have the worry in the winter months of freezing pipes and deterioration to the fabric of the property due to lack of heating and airing.

A lot of demand for the private rented sector properties has of course arisen as a result of the lack of available properties in the social housing sector – eg, from local authorities. Under the “right to buy” legislation councils and housing associations over the last twenty years or so have sold off a lot of their housing stock at discounted prices. The requirement under such legislation to sell housing stock at discounted prices led to a reluctance on the part of councils and housing associations to build new housing stock – and this coupled with tightening budgets over the last few years means that there has been very little replacement, leading to an ever decreasing stock of housing in the social housing sector. Over the last few years changes in landlord/tenant legislation have been introduced with a view to improving the quality of rented property in both the social and private housing sector. These changes have of course brought around increased responsibilities for landlords and anyone considering investing in the letting market should take on board such responsibilities when making the decision to become a landlord. Such responsibilities include the requirement to register the property and register as a landlord with the local authority. There is also the need to meet certain standards, known as the “repairing standards”. Becoming a landlord can no longer be taken lightly, but so saying, providing you set up your property to a reasonable standard and meet all the requirements of being a landlord it can be a profitable investment.

Frequently Asked Questions about Leasing Residential Property How do I know how much rent I can expect? Contact any of our Stewart & Watson property departments and we will give you a recommended monthly rental figure taking into account the property and current market circumstances.

What does a tenant have to pay? Before the start of the lease the tenant will pay one month’s rent in advance and a security deposit equivalent to one month’s rent.

Who is responsible for payment of the Council Tax? The tenant will be responsible. In this way the tenant will be able to claim any available reliefs or discounts applicable to his or her circumstances. The landlord will be responsible for payment during any void periods between tenancies.

Is it better to lease furnished or unfurnished? That depends on market demand and the type of property you have or the type of tenant you might be looking for. Ask Stewart & Watson for advice on your individual case.

How long is a tenancy normally for? We recommend a minimum of 6 months so that you can set up a Short Assured Tenancy and gain maximum control as landlord over the property.

Do I need to provide a list of contents? Yes, you need an itemised list of all contents – otherwise you cannot be sure that you will get everything back at the end of the lease!

What sort of furniture and contents do I need to make available? That is entirely up to you. Imagine that you were going to live temporarily for a few months in a rented property and think about what you might need to be made available if you did not take anything other than clothes and personal belongings with you. That would be a good starting point – bear in mind that the better equipped the property is the more likely you are to get a better rent.

Am I allowed to inspect my property? Yes, but subject to giving appropriate notice to the tenant in accordance with the terms of the tenancy agreement.

What happens if the tenant stops paying the rent?

Can I specify what the tenant can and cannot do in the property?

This is always a difficulty. There is provision for terminating a lease and having a tenant removed for non-payment of rent, however, unfortunately this is not a speedy business and strict time limits have to be observed in raising such proceedings. The legislation does tend unfortunately in some areas to favour tenants – this arises from the days when tenants needed protection from oppressive landlords. If you are unlucky to experience nonpayment of rent we can guide you on what steps to take.

Yes, you can provide that there is to be no smoking in the property or that there are to be no pets.

Can I be held responsible for anything done by my tenants?

Can I specify what kind of tenant I am prepared to have?

Unfortunately yes. If the tenant is deemed to behave in a way which is deemed anti-social you can be asked by the local authority to take appropriate action to have your tenant stop behaving in an antisocial way or to terminate the tenancy. And there will be sanctions on you if you as a landlord do not co-operate.

Who makes the final decision as to whether or not to accept an application from a prospective tenant? You do ! It is your property after all.

Yes, to a certain extent, but you must bear in mind that you cannot be unlawfully discriminatory – ie, refuse any potential tenant on account of their race, religion, gender or such like.

Do I have to make adaptations to my property for access and use by a disabled person? Not at the outset at the moment. But if you have a tenant who becomes disabled he or she may be able to ask for adaptations to be carried out. In such circumstances it is envisaged that there would be grant assistance available.

Do I have to pay tax on the rent? Yes ! It is a form of income – but there are allowances which you can set off against the income before calculating the tax due. If you are going to be non-resident in the UK, then special rules apply – we will be pleased to provide you with further details should you so wish.
