How to make your purchase or sale less taxing For most people there are no tax implications in the sale of a residential property but on some occasions the impact of Stamp Duty Land Tax, Income Tax, Capital Gains Tax or Inheritance Tax requires to be considered. Here are a few brief pointers to some of the taxes payable in connection with the purchase and sale of a residential property. STAMP DUTY LAND TAX For the purchaser of a residential property an important consideration is the Stamp Duty Land Tax payable. The current rates of SDLT are as follows: Rate of Tax Nil 1% 3% 4% 5%

Purchase price of residential property 0 - £125,000 £125,001 - £250,000 £250,001 - £500,000 £500,001 - £1,000,000 Over £1,000,000

The tax applies to the whole purchase price and not just the band within the tax rate. For example if you purchase a house for £275,000 you will require to pay SDLT on the whole price at 3% amounting to £8,250. Different rates apply for non-residential properties and for residential properties situated in disadvantaged areas. The only disadvantaged areas declared by the Government in the North East of Scotland are in Aberdeen postcode areas AB1.3, AB2.1 and AB2.2. To try to stimulate the first time buyer market, the Chancellor has introduced a further relief available for first time buyers only. The first time buyer of a residential property can apply for SDLT Relief if all of the following circumstances apply to the transaction: 1. The effective date of the transaction is after 25th March 2010 and before 25th March 2012. 2. The purchase price is £250,000 or less. 3. The buyer intends to live in the property and it will be their only or main home. 4. The buyer has not previously owned property or land either in the UK or anywhere else in the world, including property bought along with anyone else. This relief applies to residential property only. If the purchase price is just over a band level you may be able to reduce your SDLT if there are moveable items included in the sale and their value can be deducted from the price. For example if you agree a purchase price of £252,000, SDLT would be payable at 1%. If however the price includes carpets, white goods and a ride-on-mower (moveable items) with a genuine value of say £2500, then you can allocate £249,500 to the house and the balance to moveables, thus bringing your price for the heritage (land and buildings) below the SDLT level, saving £2500 in tax. The value of the moveables has to be a genuine figure otherwise you could be committing fraud and you have to be sure that all figures provided to your lender for mortgage purposes make it clear that the house is being purchased for the lower figure. CAPITAL GAINS TAX For the seller of a property there can be more complex taxation issues arising. The seller does not pay SDLT but may have to consider in certain circumstances the impact of Capital Gains Tax (CGT). No CGT is payable on the disposal of an individual’s main residence, so that for the majority of residential property sales CGT is not an issue. However, if you are disposing of a second home or a holiday home no CGT relief will be available and tax will be payable on the difference between the value of the property at the date of acquisition and the sale price at a rate of 18% for Standard Rate Income Tax payers or 28% for higher rate tax payers. Each individual can make a gain of £10,600 per annum tax-free; therefore it is only the amount of the gain over that figure which is subject to taxation. If a property is held in an individual’s name, there may be a benefit in transferring a share of it to a spouse prior to its disposal to attract two sets of exemption and saving in the tax payable. There is generally no CGT payable on transfers between spouses. CGT is a complex taxation system and before embarking on the disposal of any property which may be subject to CGT, detailed advice should be taken from a Solicitor or Accountant. INHERITANCE TAX Inheritance Tax is a tax payable from your estate after you die but only if the value of your estate is above a certain level. For each individual, the Inheritance Tax free limit is £325,000, therefore if your estate is under that figure there will be no Inheritance Tax payable on your death. For spouses, if none of the Inheritance Tax Allowance is used on the death of the first spouse, the allowance will pass to the survivor to be used at his or her death, in effect doubling the relief available on the second death. However if you give away your home to your children and continue to live in it then its value will still be taken into account as part of your estate unless you pay a market rent to the new owner. Bear in mind that if this system is put in place the new owner (most likely your children) will have to pay Income Tax on the rental income at their appropriate rate. Although for most standard house purchases and sales there are no taxation implications other than Stamp Duty Land Tax for the buyer, where rules do apply they can be complex and confusing. We can guide you through these and where possible assist in mitigating the tax which would be payable.
