T

his guide sets the context of the wider Battersea Power Station development centred on Electric Boulevard and provides technical detail of the retail elements. The key aspiration for this project is to create a “beyond expectation” mixed-use scheme for this landmark development.

Electric Boulevard forms the approach to Battersea Power Station, and includes a number of world class mixed use buildings They are integral parts of the redevelopment of the Battersea Power Station site. The buildings include a hotel, residential apartments on the upper floors and retail, leisure and dining on the lower levels.

The contemporary and striking buildings that form Electric Boulevard are by world class architects, Foster & Partners and Frank Gehry. These dramatic new buildings in this unique development with their distinctive forms shape the pedestrian boulevard that leads up to the Power Station itself.

To take you through both the approval and fit out process you will have a Retail Design Manager (RDM) to assist you, from approvals of your fit-out design through to your consent to trade.

INTRODUCTION TO RETAIL DELIVERY This document (Retail Fit-out Handbook) sets out the process of obtaining Landlords’ Approval for the fit-out of the retail spaces and a summary of the technical and construction constraints.

Access to the site prior to starting fit-out works is strictly by appointment. Please contact the RDM for site access before commencing site works. Access during fit-out works must be arranged in accordance with Section 5.2 - Site Constraints and Procedures.

It should be read alongside the Electric Boulevard, Prospect Way and Lumen Lane Design Guides, the individual unit Lease Pack and the Agreement for Lease.

Your occupation date will be shown in your agreement for lease, keep in contact with your RDM to ensure you are aware of all changes on site, including deliveries and location of the loading bay.

This Fit-out Handbook is a live document and will be updated regularly so you should always check that you have the latest version.

Battersea Power Station development uses an electronic communication and document management system to manage documents and communications between parties. Retailers and their consultants will be given access to this system and are required to use it to both obtain and submit documents.

THE RETAIL DELIVERY MANAGER The quality of the development of Battersea Power Station requires all elements being consistent. The purpose of this Handbook is to aid the Tenants in achieving the required aspirations of Battersea Power Station. The Tenant is obliged to carry out the works to the unit in compliance with this Handbook, the relevant Design Guide and liaise closely with the Retail Delivery Manager (RDM) throughout all stages of planning, design, approval and fitting out and open to Trade.

The RDM will be your primary point of contact and will represent the Landlord through the design process and completion of Tenants works.

THE LEASE TAKES PRECEDENCE The Lease takes precedence over this Handbook.

THE APPROVAL PROCESS The Landlord’s approval process is summarised in this section. At each successful completion of a stage, the milestone is recorded through the issue of a completed and signed form, L1 to L7 inclusive.

Landlord’s Approval does not constitute statutory approval, and these must be obtained separately by the Tenant from the relevant authority.

BRIEFING The objective of the briefing meeting is an introduction to the site and the Landlord’s expectations from now until Unit opening. In this meeting, the RDM will issue the Retail Fit Out Handbook Turbine Hall Specific Design Guide and any supplemental information deemed relevant to the incoming Tenant.

CONCEPT DESIGN + APPROVAL The objective of this stage is for submission of the Concept Design for formal approval. This submission will provide confidence to both parties that the Concept design is compatible with the inspiration and vision for The Power Station and that the Design Guides and Heritage Partnership Agreement (HPA) have been fully understood.

Landlord Responsibilities Review and provide comments back on the Tenant’s detailed design Discuss any comments received with the Tenant Agree course of action where necessary and programme Return one set of annotated drawings with form L2: Stage 2 Approval of Tenant Concept Design Agree next steps and Detailed Design programme

At this stage it is vital that the incoming Tenant ensures their submission is compatible with the requirements of Building Control and Fire Officers.

The concept drawings should be completed following the briefing meeting for Landlord Approval and issued to the RDM. The Concept will be reviewed by the Landlord’s Design Team.

Amendments or Alterations The RDM will use reasonable endeavours to process the Tenant’s application for such changes with minimum possible delays but will not be held responsible for any costs or delays as a result of the Tenant awaiting further design approvals.

Concept approval signifies the general agreement of the Landlord’s Team with the Tenant’s layout and design intent.

Tenant Responsibilities Submit the concept design proposals, in the agreed format and time scales, including identifying any changes requested of the Landlord shell and core works Adjust proposals and re-submit based on feedback provided Confirm anticipated budget for fit out works Amendments or Alterations Should the Tenant require any amendments/alterations to the Landlord’s shell & core, the relevant drawings clearly identifying the proposed changes must be re-submitted in accordance with the concept design approval process. Approval (in the form of a revised L2 Approval of Tenant Concept Design form) must be received from the RDM prior to commencing Detailed Design.

The Tenant and their design team, are expected to have incorporated the Landlord’s comments on the Concept Design and taken into account the information contained within the Design Guides and HPA.

Start on Site Works can only commence once the Landlord has accepted the Pre-Start submission and approved the Tenant’s Detailed Design.

A separate ‘Tenant Commissioning in to Landlord Systems Handbook’ will be issued by the Landlord giving full details of the process to be followed inclusive of fees.

Site Monitoring The Tenant and their team is to provide the RDM with a weekly progress report against the agreed programme via email on Thursday of each week.

The Landlord reserve the right of full, unimpeded access to the demise at any time. The RDM will regularly visit site to review the progress of the works. Should it be found that works are not in keeping with the previously agreed criteria, Site Rules, and Codes of Practice, the Landlord reserves the right to suspend all works within the unit demise.

The Tenant shall not recommence works until the Landlord has been satisfied that the compliance is, or will be, forthcoming.

Completion and opening for trade requires careful planning and the booking of relevant contractors to attend in good time and only when systems are completed. The Tenant will agree with the RDM, a mutually suitable date to witness any testing, at least 10 days prior to the event.

The Tenant will need to arrange for the Tenants services to be connected into the Landlord systems upon presentation

CONSENT TO TRADE Consent to trade infomation

Landlord Responsibilities

The objective of this stage is for the Tenant to confirm the compliance of the fit out works in accordance with the approved criteria and that all relevant certification is in place in order to allow the Landlord to issue the ‘Consent to Trade’.

Review the unit for conformity with the approved plans and the achievement of the expected quality Review Request for Consent to Trade (T6 form) the certificates provided for conformity to the technical standards required Review the copies of statutory consents obtained Review the Landlords property for any damage or works required as a result of the Tenant fitting out activities Issue a completed form ‘L6: Stage 6 Consent to Trade Information’ If there are any defect and/or outstanding works they are to be completed within 21 days of the date of issue of L6. The Tenant will not be permitted to trade without the issue of the Landlord’s Consent to Trade L6 If defects are not completed within 21 days, the RDM has the right to withdraw the Consent.

The Tenant shall agree a suitable date for the RDM to review the completed works two weeks prior to the date of agreed centre opening date.

This will be dependent on the completion of the fit out works and the necessary technical compliance documentation noting the Tenants Health and Safety File can follow up to 21 days later. Without the formal issue of the Consent to Trade Information form L6, the Tenant cannot open to trade.

Tenant Responsibilities The Tenant is to arrange it’s Connections into the Landlord’s systems with the Landlords specialists and Commissioning Manager.

10 working days prior to the final commissioning and witnessing of Life Safety systems, the Tenant will notify the RDM by email the commissioning and witness date, planned operational date and date of interface to the Landlords systems.

Information required for Landlord to issue Consent to Trade Upon completion of its works, the Tenant shall request the RDM to inspect the Fit out works for compliance with the previously approved criteria. Following the inspection, the Tenant will be issued with a list of any defects, which must be addressed within 21 days. All Tenants will be bound to conform to this.

To ensure compliance, the Tenant shall submit the following documentation to the Landlord as a single pack of information using T6 form, for the RDM to review before issuing Consent to Trade.

Certificates provided for conformity to the technical standards required and copies of the statutory consents obtained such as: Building Regulations Completion Certificate Fire Officer Approval Fire Alarm and PAVA Completion Certificate Fire Risk Assessments Sprinkler Completion Certificate Mechanical smoke ventilation Completion Certificate ESCo LTHW and CHW Connection Certificate Emergency Lighting completion and inspection certificate Certification conforming water supply by-laws are satisfied Certification of chlorination for the Tenant’s domestic water system Foul drainage Building Regulation compliance certificate

Any other statutory certification as may be required Footfall Counter completion certificate.

The Tenant can open their store on the date illustrated on the Consent to Trade Certificate.

Note: The Store Manager is required to attend an induction with the Centre Management Team, who will take responsibility for general liaison in the Tenants operation of the unit.

Record Drawings For all ‘construction’ projects, a copy of the Health and Safety File must satisfies the requirements of the Construction (Design & Management) Regulations 2015 must be supplied to the centre management team within 21 days of completion.

Within 21 days of Consent to Trade being granted, the Tenant will provide the health and safety file in the required electronic format and structure, including complete set of drawings of the shop unit, service drawings, copies of any certification and any manuals and service agreements.

This shall be submitted in accordance with T7 form, Landlord will issue L7 form accepting the H&S file upon which the deductable deposit will be returned.

The information provided must meet the requirements of Approved Code of Practice L144; Managing Health and Safety in Construction, Construction (Design and Management) Regulations 2007 and HSE books 2007 ISBN 978 0 7176 6223 4.

H&S FILE + RECTIFICATION OF DEFECTS Rectification of Defects

Landlord Responsibilities

If there are any defects identified in stage 6 and noted on Form L6’ Consent to Trade Information’, the Tenant has 21 days to complete from the date issued on the L6. They will be reviewed when completed.

Review the items for rectification and advise whether satisfactorily completed.

Review any outstanding information or new certificates provided for new or altered installations conformity to the technical standards required.

Review the Landlords property for any damage or works required as a result of the rectification or completion activities.

Issue L7 form, noting Rectification of Defects and receipt of Tenant’s H&S file, once all outstanding matters have been rectified.

Any damage caused as a result of the Tenant’s fit-out is permitted to be made good by the Landlord at the cost of the Tenant through the security deposit.

Upon receipt of the above documentation, and having undertaken an inspection of the completed defects that require rectification by the Tenant, the RDM will issue form ‘L7: Stage 7 Confirmation of Receipt of H&S File & Acknowledgement that Defects have been Rectified’.

Tenant Responsibilities Rectify any defect or incomplete works within 28 days.

Prepare and submit the H&S File accompanied by a completed T7: Stage 7 Submission of Receipt of H&S File & Acknowledgement that Defects have been Rectified’ form.

Prepare and submit the Fire risk assessment.

DESIGN CRITERIA

TENANT WORKS

The design of the retail fit out is essential to the success of the retail offering. Battersea Power Station are committed to ensuring that incoming Tenants maximise their full potential for exceptional design.

The design of the shop fit will be reviewed for approval at each design stage throughout the Tenant approval process which can be seen in more detail in this section.

The Tenant works must be carried out in a good and workmanlike manner and in accordance with good building practice, using quality materials, which comply with current British Standards. The Landlord requires creative design that strengthens the Tenant’s identity and conveys the highest quality.

We have created a world class facility for the retail units to be situated within and the same level and quality is expected from the incoming Tenants.

DESIGN REQUIREMENTS The agreed approach to signage, shopfronts, display windows and interior are set out in the relevant Design Guides, which have been approved by the local authority.

Designs that accord with the design guides and receive approval from the landlord therefore require no separate planning consent. Any deviation from this will require planning approval and or advertising consent Engagement with, and any submissions to the local authority must be via the RDM who will engage with the BPS Planning Team on behalf of the Tenant to determine if the proposed changes would be acceptable to the Landlord and whether they are likely to be approved by the Local Authority.

OCCUPANCY & EVACUATION The development’s fire strategy has been developed in accordance with requirements of Wandsworth Borough Council, London Fire & Rescue and satisfies the regulatory Reform (Fire Safety) Order 2005, and Building Regulations 2010.

Incoming Tenants are obligated and have a general duty of care for fire safety which must be considered in all aspects of design and occupation of the unit.

It is the Tenant’s responsibility to ensure that their premises fully complies with building regulations and health, safety and environmental legislation. It is also the Tenant’s responsibility to ensure that their premises are safe at design stage, during fit out and refurbishment and to maintain their store to the relevant standards on an on-going basis.

The RDM is available to give advice and assistance throughout the design process. If there are any questions which require their input, please approach the RDM in the first instance, Information within the Technical Guidance in this section demonstrate the works the Landlord is undertaking as part of the Base Build Design, and the works the Tenant is required to undertake as their Fit-out. All works undertaken are in accordance with the current editions of the British Standards and Codes of Practice.

UNIT DRAWINGS The Tenant will be provided with a set of unit specific 2D drawings as part of the Leasing Pack issued to them by the RDM. These are provided for information only and are not from survey, and as such must not be relied upon in detail design or construction.

The Tenant is required to carry out their own measured survey of the unit.

BUILDING CONTROL

PLANNING REQUIREMENTS

Tenants and their design teams must submit a full building regulations application to the local authority. The Tenant should note that the use of an Approved Inspector is not acceptable and will not be allowed.

The development has been carried out in accordance with the planning approval from the local authority.

The shopfront and associated signage that will be designed and installed by the incoming Tenant will not require planning or advertising consent to be obtained if the designs are expressly approved as part of the Landlords’ Approval process and constructed strictly in accordance with the approved drawings and documentation including the Design Guide.

The local authority is Wandsworth and should be contacted directly at the earliest opportunity.

An EPC of at least a rating of C must be achieved and obtained by the Tenant for the completed fit out. The Tenant will be responsible for arranging and carrying out air permeability testing if they wish to determine if improvements to the default setting can be used.

Please note however that details of any shopfront duct or louvres will need to be submitted to the local authority to discharge condition 30 of the planning consent currently in place for Electric Boulevard.

In addition, Schedules 9 and 9A of the Section 106 Agreement address the requirements of the Local Employment Agreement for the Development, which includes the provisions for establishment and operation of the Battersea Academy for Skills and Employment (‘BASE’).

The purpose of the Local Employment Agreement is to set out a means to ensuring high priority is given to helping local people find work and improve their skills therefore, jobs of all types and at all levels which are created at the Development are filled as far as is practicable by local people. BASE has been developed so that it supports the provisions of the Local Employment Agreement and to become an exemplar for skills and enterprise development, and to maximise the local benefit of the Development; it is expected that tenants take advantage of the BASE service as part of the commitment to benefiting the local area.

HEALTH & SAFETY / CDM In order to comply with the CDM regs, the Tenant must ensure they have suitable appointments as defined by the ‘Construction (Design & Management) Regulations 2015’.

There must always be a contractor, where applicable, Principal Contractor, who has overall responsibility for the management and control of the fit out works and who is responsible for liaising with the RDM. At the Briefing meeting, the Tenant will be asked to confirm they have appointed an appropriate Principal Designer - and confirm the competency of it’s Principal Designer to carry out this role using the form contained in Appendix C. As part of the Pre-Start information submission, the Tenant will be asked to confirm their chosen Principal Contractor is appropriate and demonstration of it’s Principal Contractor is requested to be confirmed using the form contained in Appendix C. The Tenant’s Principal Contractor must cooperate with the RDM and comply with any Landlord rules or direction given by them. They must provide the RDM with any information in respect of health, safety and welfare pursuant to the requirements of the ‘Construction (Design & Management) Regulations 2015’.

The Tenant is required to appoint a contractor or designer to have overall responsibility for the management and control of the fitting out works and to liaise with the RDM. All accidents involving damage to property, personal injury or dangerous occurrence, including near misses, must be reported to the RDM with confirmation in writing within 24 hours of such notification.

The Tenant is responsible for ensuring that their contractors report any accident or specified injury under the Reporting of

Injuries, Diseases and Dangerous Occurrences Regulations 2013, a copy of this report must be issued to the RDM. CDM Requirements CDM Requirements of the Construction (Design & Management) Regulations.

General The whole of Battersea Power Station is subject to the Construction (Design & Management) Regulations 2015.

Tenants and their Consultants are required to take appropriate actions to ensure compliance.

For notifiable works the Tenant is required to appoint a competent Principal Designer and Principal Contractor.

Access to the Premises shall take due cognisance of the controls imposed by the Landlord, Building Contractor or Building Manager and must be observed by all those employed by or representing the Tenant.

The Tenant shall ensure that the F10 Project Notification has been submitted to the local HSE office and that a copy is displayed on the Premises as well as being submitted to the RDM as part of its pre-start submission Under CDM the Tenant’s Principal Contractor is responsible for access to the Tenant’s Premises.

In accordance with the requirements of CDM, the Landlord will make available the relevant information from the Health & Safety file for the building.

Appointment of a Principal Designer The Tenant must appoint a competent, adequately resourced Principal Designer as soon as practicable after initial design

work or other preparations for construction work has begun. The main purpose of the Principal Designer is to help the Tenant to carry out their duties; to co-ordinate health and safety aspects of the design work and to prepare the health and safety file.

The Principal Designer should notify the HSE as soon as possible after their appointment. If the Principal Contractor is not appointed at the time then another, updated notification must be made after they have been appointed.

The Tenant is to review and complete the appropriate form from Appendix C and submit to the RDM. Appointment of a Principal Contractor for Notifiable Works The Tenant must ensure that a competent Principal Contractor is appointed to undertake construction work.

The Tenant is to make sure that a pre-construction information pack has been issued to tendering Principal Contractors.

The Tenant is to review and complete the appropriate form from Appendix C and submit to the RDM.

BREEAM & SUSTAINABILITY The fit-out and operation of all retail units is to comply with and achieve BREEAM (Building Research Establishment Environmental Assessment Method) targeting credits for the development’s retail assessment which is aiming at a ‘excellent’ rating as a minimum. In order to achieve this, the following is required as set out in the Battersea Power Station Phase 3 RS4 & O1 Retail Green Lease Agreement.

There will be no requirement for your fit-out to be individually assessed by an independent BREEAM Assessor, if the fit-out can demonstrate through drawings and specifications, that the identified credits which are noted as to be complied with by the tenant, have been met. The checklist is in Appendix B..

SPECIFIC DESIGN CONSIDERATIONS In preparing the your design submissions, please be aware of the following:

• At least 1 fitting room per gender should be provided to comply with Building Regulations Part M.

• Window displays should not block more than 50% of the glazing

• Where office space and/or staff WC are provided on an upper or different level, access for wheelchair users is required.

• Internal elevations should clearly show heights of fixtures, the use of graphics and finishes • Ceilings must be installed to the fitting room area • The cash desk must be Equality Act 2010 compliant. A detailed drawing should be provided • Fixing of Tenants walls or linings to Landlord’s shell walls and structure is not permitted other than to slab and beam soffits. Nevertheless, there are some partition types to which fixings are allowed if they meet the manufacturer’s guidelines and technical requirements.

• If storage is provided on a mezzanine or upper level, the stair access must meet the requirements for frequent access as set out in Part K. • At least one WC must be wheelchair accessible in accordance with Part M, and the number of WCs overall provided within the unit must be in accordance with BS6465. *All retailers are to ensure that the Point of Sale (POS) equipment that they procure is compatible with the ART Software Group specification provided separately and

• Doorbells on the front elevation are not permitted that will need to be accessed and run by retailers on the Battersea Power Station development for sales and data

• The Tenant is not permitted to paint or change the finishes of the Landlord’s party walls and ceiling • Any storage / racking systems to the rear of the unit must be kept to a minimum of 1 metre below any Landlord installed services

Tenants at Battersea Power Station and must work with the locally installed POS equipment.*

CATERING UNITS All food / catering units must include for floor standing grease traps to their drainage installations. In addition, sediment traps should also be installed to relevant F&B units.

Kitchen extract must meet the requirements of the Landlord.

Full details of all ventilation requirements included within Section 4.

ACCESSIBILITY All units are to provide fully accessible WC and welfare facilities for staff within the demise, to meet the requirements of the Equality Act 2010 and associated legislation. Public facilities may not be relied upon to provide compliance.

The Tenant must install automatic fire detection and a fire suppression system within any cooking extract ductwork and ranges. This needs to be illustrated on the HVAC drawings and then submitted for approval as part of the detailed design pack.

SERVICES INFORMATION The details of the Services provided to each unit demise is set out in each individual Shell & Core Leasing Pack. Tenants must make their own applications for the supply, connection and metering of all utility services including temporary supplies for all fit-out works. Connections to the Landlords Services must be witnessed on behalf of the Landlord so please liaise with the RDM and BPSDC to confirm a date when this can take place. No temporary utility supplies will be available from the Landlord.

DIMENSIONAL SURVEY The Landlord will supply relevant information to the Tenant as it becomes available such that it can progress its design.

The Tenant shall be responsible for any information or dimensions that it relies on as supplied by the Landlord.

The Tenant shall arrange to undertake its own dimensional survey at an appropriate time.

FEES & DEPOSITS

INSURANCES All Tenant’s and their contractors must demonstrate to the Landlord that they hold current and sufficient cover to meet the Landlords’ requirements and all statutory obligations.

The Tenant will be required to pay a Deductible Deposit. The amount of deposit required is based on unit size.

There will be fees to be paid by the Tenant for various services provided by the Landlord, including but not limited to welfare, logistics and waste removal, connection and commissioning of services to the building infrastructure e.g. fire alarms, sprinklers, fresh air/extract, PA/VA, smoke extract etc.

Insurance held must specifically provide for public and employer liability, and all risks insurance. No work will be allowed to commence on site until such time as evidence of these policies being in force have been submitted as part of your L4 submission.

These fees will be deducted from the Deductible Deposit if they are not paid directly in advance or on demand. Any outstanding Landlord fees - which include costs incurred by the landlord to rectify damage caused by the tenant contractor, that are over and above the Deductible Deposit value will need to be paid in full by the Tenant in advance of being provided with consent to trade.

The following minimum levels of insurance cover from the Tenant’s Fit-Out Contractor are expected: • Public Liability – £20 Million • Employer’s Liability – £10 Million • Contractors All Risk – by unit size – see below: 0 – 100m2 - £5million each and every claim 100m2 – 800M2 -£10million each and every claim Above 800M2 -£20million each and every claim

The deposits are as follows: < 150 sqm £10,000 > 150 sqm £20,000

Where a claim or the potential for a claim has arisen, the Tenant must inform the RDM immediately in writing.

The deposits must be held as cleared funds by BPSDC no later than prior to hand over of the unit and issue of the T4 documentation (See Appendix A for T form sample).

Where Tenant’s fit-out contractors cause damage to the building, they will need to rely on their own third party insurance to pay for the rectification of those damages.

The Tenant must ensure that when they are engaging a fit out contractor, that the fit-out contractor remains responsible for and suitably insured for any damage to the existing structure e.g. a JCT Option C type of insurance which includes a C1 replacement schedule, or any other contract that makes the Tenant as Employer responsible for arranging insurance on the existing structure. The Tenant will need to obtain their own legal advice on this and demonstrate to the Landlord that the appropriate insurance is in place.

CHANGE CONTROL

LOGISTICS & WASTE MANAGEMENT

No changes or alterations to the shell of the retail unit, including the installed shopfront, doors and associated glazing, are permitted. Any alteration to the incoming services must be specifically agreed as part of the fit out approval process.

The unit will be provided to the incoming Tenant as per the information included within the Lease Pack document. If the incoming Tenant requires any changes to be made to the unit prior to occupation, this is at the discretion of the Landlord.

Please note, there will be strict time constraints on when payment needs to be received by. If payment is not received by this date, the change will not be instructed and the incoming Tenant will be notified accordingly.

Electric Boulevard is a BREEAM certified development.

BREEAM measures sustainable value in a series of categories.

Within every category, developments score points – called credits – for achieving targets and their final total determines their rating. As waste management is one of the areas assessed for credits all fit out waste needs to be segregated and monitored in line with the common waste recycling and removal arrangement organised through the Landlord’s appointed contractor. No other waste removal arrangements will be permitted.

All tenants are required to utilise the site wide Battersea logistics and supervision service for a lump sum fee, set at one of 3 fixed rates per unit dependent on unit size. Note that certain large or complex spaces are charged a specific rate that you will have been advised of. This fee must be paid in advance of starting works on site. The logistics service provider will supply a detailed handbook setting out their services, timing and service levels to your unit.

STATUTORY APPROVALS The purpose of this section is to aid and assist the Tenant’s fit out team identifying the generic technical requirements that are to be adopted and strictly adhered in order to achieve final commission and certification to ensure a successful opening of the Power Station.

This will need to be read with the Tenant’s AFL (Agreement for Lease) and Lease Pack for unit specific information.

The Tenant is required to comply with all necessary Statutory approvals including Building Regulations, Environmental Health, Fire Officer Approval etc. in relation to their works and Listed Building Consent (unless allowed by the Heritage Partnership Agreement (HPA) or existing Planning Permission).

Obtaining Statutory Approvals is the responsibility of the incoming Tenant.

Tenant’s attention is bought to the fact that this development has specific planning conditions which apply to the interior and exterior. All incoming Tenants must ensure that compliance with all these conditions.

Where the Tenant would like to make any change which deviate from the planning approvals, the RDM will engage with the Battersea Planning Department on the Tenant’s behalf to understand if the deviation will be acceptable. Any and all engagement with Historic England or the Planning department will be via the Battersea Power Station’s Planning Team.

SLAB

By Landlord

The Landlord’s flooring material is installed up to the unit’s demise line.

General The Landlord will install a screed, within the unit to the specification shown in the Base Build Definition document leaving 25mm for a floor finish.

The Tenant’s floor finish is to meet HSE guidance on minimum slip resistance and be suitable for the use proposed; the appropriate certification is to be provided at completion.

The ground floor slab is an easy float concrete floor slab.

The slab will be flat but not necessarily level, and finished to SR2 tolerance (+/-5mm from the mean when measured over a 2m distance using a straight edge). The Landlord does not guarantee levels of moisture within floor slabs.

Floor loading calculations and positions for heavy items such as safes and storage racking should be taken into consideration and issued to the Landlord’s review team.

Where possible, steel column baseplates will be hidden in recessed pockets within the floor slab. These will be infilled with concrete which will be hand floated with a steel float finish.

By Tenant General The level threshold is to be designed and provided by the Tenant.

Metal decking Hung services fixed to the underside of metal deck (where applicable) using a soffit “wedge nut” fixing are to meet metal deck manufacturers’ guidelines. Typically for a Trapezoidal deck this is around 1kN per fixing spaced at no less than 600mm centres.

Tenants shall satisfy themselves regarding floor tolerances and actual site conditions. Whilst the floor slab will be dry it may contain a level of moisture which must be taken into consideration by the Tenant’s fit out contractors.

Any proposed changes in levels will require detailed approval and should maintain disabled access throughout the unit.

Chasing into unit screed finishes is permitted with a maximum depth of 30mm. Floor paint or coating will not be allowed.

A floor finish must be installed.

The Tenant‘s floor finish shall terminate at the demise line.

The Tenant will be responsible for matching their internal finishes levels to external finishes levels (by Landlord) at any entry point to the demise. No step in finishes at the threshold will be allowed.

• Allowance has been made for blockwork walls 140mm thick 2.5kN/m2 (full height) to all service corridor walls at Ground floor only Stability Bracing The internal and external walls and the roof and wall cladding do not contribute towards the stability of the frame.

Tolerances shall be as NSCS and NSSS to accuracy on building or Structural Engineer’s specification to accuracy on building, whichever is the most stringent.

Tolerances to be applied to the positioning of all steelwork elements.

Corrosion Protection All new primary steelwork is intumescent painted. Existing steelwork is shot blasted and intumescent painted. Any steelwork buried within wall constructions shall be suitably treated against corrosion.

By Landlord Shot firing into the base building will not be permitted. Fixing or boxing out of intumescent columns must not compromise the rated finishes and the rating thereon.

All fixings to the base building will need to be submitted as part of the technical detailed design submission.

No fixings are to be made to intumescent painted structures or repaired heritage columns (both brick encased and faïence clad), existing piles and steel columns in Switch House West and Switch House East.

STRUCTUAL MOVEMENT & TOLERANCES Tenant’s fitting-out works are to take due consideration of the structural movement joints within the shell works by providing corresponding joints in the finishes to walls, floors and ceilings with suitable allowance for the designed movement.

Movement joints are not to be covered over with finishes.

ROOFS & CEILINGS Tenants should refer to the Leasing Pack for loadings, fire ratings and acoustic constraints to be considered in the design of their works. Tenants must install a suspended ceiling unless otherwise agreed with the Landlord.

Some units will also require their ceiling design to provide an acoustic and/or fire rating. The performance of your chosen details must be submitted as part of your detail design submission. Please refer to your Shell & Core Leasing Pack for details.

Tenants must ensure that ceiling design proposals do not conflict with any of the Landlord’s services within the unit and retain suitable access as set out in the Shell & Core Leasing Pack and surveyed in the unit.

Where the shopfront contains a “pop in” area set back behind the demise line the Tenant must submit proposals for cladding the soffit as part of the fit-out works.

Noise levels generated by tenant operations within the unit shall not exceed LAeq,3min 80 dB measured over a period of 3 minutes at any time. In addition, the octave band noise limits set out below shall not be exceeded at any time when measured over a period of 3 minutes: Octave band noise limits – 3 minute Leq (dB) for the F&B units.

For retail units the limit would be LAeq,3min 75 dB Octave band centre frequency (Hz) 63 125 250 500 1k 2k 4k tbc tbc tbc tbc tbc tbc tbc If the tenant expects to exceed the above noise limits, they shall propose acoustic enhancements as part of their fit-out works.

Any proposed enhancements shall be accompanied with an acoustic report compiled by a qualified specialist. The report shall demonstrate how the proposed works will mitigate noise transfer and clearly stipulate alternative noise limits within their premises.

SHOPFRONT PILASTERS

SHOPFRONT Shopfront design

Landlord’s works include pilasters between units. These are not to be modified or used for Tenant’s shopfront or fixture fixings. The Tenant is expected to protect these from damage.

For units without a Landlord provided shopfront, the Shopfront Design is to be in accordance with the relevant Design Guide.

The Landlord’s specified foot fall counters must be discreetly incorporated in to the design above the doorway into the unit.

Careful consideration should be given to junctions between the Landlord’s finishes and the shopfront, with the provision of suitable compression movement joints and airtight / watertight detailing as required for units without a Landlord provided shopfront.

No fixtures, fittings or signs to the shopfront are to be fixed to the Landlord’s finishes or pilasters. Where required air intake grills and the like must form utilise the Landlord specified ventilation zones within the shopfront.

Shopfront installation Where a shopfront glazing system is not installed the shell unit structure is designed to accommodate shopfronts built off the floor slab with lateral restraint at the head. Shopfronts with sliding/folding elements or top hung systems will need to design and install a suitable structural transfer structure as an integral part of their shopfront design.

All shopfront fixings are to be concealed and joints to be flush.

The portal-frame to the perimeter of each shopfront opening may be sealed to (suitable silicone or similar approved) but not fixed to or through.

Alterations to the base building external architecture or portalframing device are not permitted.

INTERNAL WALLS Internal walls within a Tenant’s demise are wholly the responsibility of the Tenant. Walls must allow for an appropriate deflection head detail to the shell structure, and provide suitable movement joints to match those present in the shell structure.

Where walls abut Landlord’s shell walls and structure soft joints should be provided at the junctions.

DOORS Rear doors, where applicable, will be installed by the Landlord.

Please refer to the Lease Pack for details. Security of all doors is the responsibility of the Tenant.

You will be required to have your layout agreed (initial plan check) with Building Control ahead of your concept design submission.

Fixing of Tenants walls to Landlord’s shell walls and structure is not permitted other than to slab and beam Soffits. The Landlord’s shell walls form an integral part of the fire strategy and fixing to or chasing these walls is not permitted.

FLOOR FINISHES

SERVICE RISERS

Interior

By Tenant

Internal floor make-up is to be sufficient so that finished exterior floor level to allow the installation of the internal screed and floor finishes to finish flush. Please refer to the Lease Pack for further detail.

Where applicable, a 600mm clear access is required to Landlord risers within the unit demise. The area in front of the risers is usable space but any items in this space need to be moveable or demountable so emergency access can be given.

Covers to risers shall be provided by the Landlord and maintained by the Tenant at all times during their installation.

On completion of the Tenant’s mechanical and electrical installation, the Tenant is responsible for providing a permanent weather tight condition to roof openings to the satisfaction of the Landlord, in accordance with an approved detail.

Permanent means of protection from falling is to be provided by the Tenant to unprotected edges/voids within their riser shafts.

Exterior The Landlord’s paving material is installed up to the unit’s demise line. See the Lease Pack for demise interface details.

For unit with a Tenant own installed shopfront, if the design proposals include setting of the unit shopfront back from the demise line, the Tenant must finish the shopfront ‘pop in’ using the same finish as the Landlord’s exterior landscape or a suitable or appropriate approved material.

Steps between the Landlord’s exterior paving finish and the unit demise/shopfront entrance will not be allowed.

The Tenant’s floor finish is to meet HSE guidance on minimum slip resistance; the appropriate certification is to be provided at Retail design approval stage.

ELECTRICAL SUPPLY The Tenant is to provide a copy of the NIC test certificate upon completion of the works.

The Tenant must provide appropriate building regulation test certificates for their electrical installation as noted within the L6 handover form.

SERVICE ROUTES

By Landlord Those unit demises with remote plant locations will have a designated route for which the Tenant shall replicate in its detailed design submission.

Landlord services are routed at high level within retail units to serve adjoining Landlord areas and other Tenant demises.

The Tenant is required to make sure access to the services are provided throughout the unit.

By Tenant The Tenant is responsible for providing access to Landlord services routed through the demise to serve adjoining Landlord area and other Tenant demises.

FIRE ALARM The Tenant shall install an independent full automatic analogue addressable fire detection and alarm system to protect their own demise.

The Tenant should present their tested signal cables to this interface for final connection in conjunction with the Landlord’s preferred Contractor. Note, they will require at least two weeks’ notice.

The design and layout of the system in the unit must meet the standards set out in BS 5839 and the criteria and information set out within Fire Strategy.

The Tenant is to install their own telephone line for the fire alarm.

It is recommended that the Tenant use the base-build installation contractor for the development of their fire alarm system, in order to ensure compatibility of their equipment and installation.

The Tenant fire alarm system should be installed by an LPS1014 third party accredited company with an LPS1014 Certificate issued upon completion for the installed system.

The Tenant’s system must be fully compatible with the Landlord’s system and must be modified or changed if necessary to maintain the integrity of the Landlord’s system.

The fire alarm cabling should be carried out utilising minimum 1 hour fire rated cable such as Prysmian FP Plus.

The Tenant’s installation will be interfaced with the Landlord’s fire detection and voice alarm system via the Landlord’s interface unit located in the rear service corridor.

The whole system – design, components and installation is to comply with the Landlord’s requirements in addition to the requirements of the LPCB, the Landlord’s insurers and the Building Control Officer/Fire Officer. All costs are borne by the Tenant.

All shell units will be handed over with smoke detector(s) and call point linked to the Landlord’s fire alarm system, These devices must be decommissioned by the Landlord preferred contractor for removal by the Tenant contractor. Removed devices to be handed back to the Landlord.

The following volt free signals are required from the Tenant to Landlord: • Confirmed fire • System Fault The Tenant system needs to receive the following signals from the Landlord: • Landlord fire evacuate • Sprinkler flow • Sprinkler tamper

These devices must not be decommissioned until the Tenant Contractor assumes responsibility for the fire safety of the unit.

Any Tenant’s unit music system is to be fully interfaced so that it will automatically go silent via the fire alarm system on activation of an alarm.

Note to avoid ring round scenario the three signals received from the Landlord must not initiate the Tenant confirmed fire signal output.

The Tenant’s Contractor must not connect to the interface box unit – the connection will be made by the Landlords Contractor once the Tenant installation is complete, commissioned and certified.

Full testing and cause and effect commissioning is required prior to this item being deemed fit for purpose.

Tenants are not permitted to allow merchandising or operations until all life safety systems have been satisfactorily completed and integrated.

In respect of costs there will be several separate visits with cost to be confirmed by your RDM:Please liaise with your RDM in advance for further details.

SPRINKLERS A suitable sized sprinkler stub connection is provided to each unit to allow the Tenant to install their sprinkler protection. It is the responsibility of the Tenant to extend the sprinkler system into the unit and provide an accessible end of line testing facilities as and where appropriate. The Tenant is to use the Landlord’s approved Contractor. The protection classification of the Landlord’s system is OHIII.

part of the installation, which should be located 1.5m above floor level with an isolation valve and cap.

The Landlord capped connection is monitored by a flow switch linked to a fire alarm interface on the Landlord’s system.

All the Tenant installed sprinkler systems are to be fully tested, witnessed prior to connection and inspected prior to connection to the Landlord’s system. The final connection is to be by the Landlord’s approved Contractor.

The design and installation of the system in the unit must meet the standards set out in BS EN12845 and the criteria and information set out within Electric Boulevard Strategy.

The Tenant will be responsible for the costs associated with the provision of the connection and the installation within the tenancy. For all sprinkler witness tests, please contact the RDM allowing two weeks’ notice.

The Tenant’s installation shall comply with the Life Safety requirements of the LPC Rules.

It must also comply with the requirements of the Landlord’s insurance company. Sprinkler heads must be Quick Response (rtI<50) temperature rated type in accordance with the LPC Rules.

On completion of the sprinklers installation an LCPB 1048 test certificate must be provided.

Sprinkler construction drawings must be submitted in advance.

Approvals are via the Landlord insurers who can take up to 10 days for a response. Please ensure you submit with the required information early to avoid any delays.

The Tenant’s installation shall be designed to take account of the available pressure which exists at the Landlord’s capped connection within the retail demise – details of the available pressure are to be obtained from the Landlord’s sprinkler installation Contractor’s drawings and hydraulic calculations and details of the water flow alarm specification will need to be submitted under Section 3.3 as part of the overall detailed design for approval.

Sprinkler systems must be back filled, pressure tested and witnessed prior to the Tenant’s isolation valve is opened. The RDM must be consulted and test certificates issued before the Tenant’s isolation valve is opened to the Landlord’s system.

The Landlord sprinkler system has been installed by Argus Fire.

You are required to contact them for commissioning. They will offer the following service: 1. Review the Tenants Sprinkler Contractors Drawings to confirm that the design has been carried out to the correct standard.

2. Review Sprinkler Heads & equipment used to confirm LPCB approval & suitability to the risk.

3. Review the Tenants Contractors test certificates to ensure the installation is tested to the correct pressure & durations.

4. Review Tenants LPS 1048 Certificate of Conformity & Completion Certificate.

5. Attend site on the day of connection to open the valve, ensure installation is sound and installed to drawings.

6. Carry Out a Flow Switch test if required. There will be a charge for this service payable by the Tenant.

SMOKE VENTILATION

BUILDING MANAGEMENT SYSTEM

The Tenant shall install their own automatic controls to serve Tenant installed equipment.

The Tenant will be responsible for the installation of mechanical smoke ventilation and to suit their fit-out.

The Tenant will be responsible for ensuring that air/ smoke paths are maintained through fit-out elements to the smoke extract point(s) within the unit demise.

Where units are provided with mechanical smoke ventilation the Tenant shall commission the smoke extract flow rates after the fit-out modifications and provide an air flow certificate to the Landlord. The Tenant shall appoint the Landlord’s specialist to operate the smoke extract system for balancing/commissioning and provide the connection and operation certificate.

The Tenant shall interface with the Landlord’s BMS for time control of the LTHW and CHW and Fresh air ventilation systems.

The Tenant shall also install CO2 variable demand control for the fresh air ventilation systems.

The Tenant shall install automatic controls to disable air handling systems in the event of a fire.

The Tenant automatic control system shall monitor the kitchen extract odour/grease filtration equipment and interface to the Landlord’s BMS for monitoring and alarms.

The Tenant shall procure a commissioning certificate for the BMS to be connected to the Landlord’s system and shall appoint the Landlord’s specialist at the Tenant’s cost.

FRESH AIR VENTILATION

By Landlord Fresh air ventilation is to be obtained via louvres or builders works openings provided to the retail unit. However, in some cases Landlord fresh air ventilation systems serve retail units as indicated in the Lease Pack. Landlord fresh air ventilation is provided to the retail units by supply and extract ductwork terminating in each retail unit with a variable air volume (VAV) box and manual volume control damper (VCD). The VCD is to be removed by the Tenant as it was used during the base build commissioning to achieve the fit-out air resistance provision which is stated in the Base Build Document.

The Basement retail units are provided with fresh air provision from the Landlord’s basement air handling systems. The Tenant is responsible for ductwork connections to the fan ductwork to serve their demise.

By Tenant The Tenant is responsible for extending the ductwork systems to suit their fit-out and including the implementation of a CO2 demand led fresh air volume flow rate control to meet the requirements of the buildings BREEAM accreditation. The fresh air extract is to be utilised by the Tenant to discharge the Tenant installed toilet ventilation systems into.

Where the Tenant is connecting onto the Landlord’s centralised ventilation system, the Tenant will be responsible for providing a ductwork distribution system within their demise to suit their requirements. The Tenant will provide drawings, specifications and calculations to confirm all ventilation provisions and louvre sizing.

FOUL WATER DRAINAGE

By Landlord Retail units will be provided with capped drainage pipework and capped ventilation pipework within their tenancy, connected to the Landlord’s system. The Tenant shall not use AAV’s as a means of venting their pipework.

Horizontal and/or vertical stacks associated with the Landlord’s or other Tenant’s system may pass through the Tenant’s demise and will be clearly identified on shell accommodation drawings.

Access doors on Landlord’s stacks will be installed above floor level for testing and maintenance purposes.

The Landlord shall require access to drainage installation for maintenance and other general purposes, where it passes through the demise, as applicable.

By Tenant Tenants will be responsible for connection to the drainage capped connections and ventilation pipes in their demise and the installation of drainage pipework to serve their fit-out.

Cooking facilities will present a risk of the operator discharging fat, oil or grease (FOG) into the Landlord’s drainage system, it is mandatory to install grease trapping equipment to minimise the consequence of FOG entering the Landlord’s system.

Grease trapping equipment is to be fitted to cover all drain runs which will be used for kitchen effluent.

Grease trapping equipment shall be above ground or slab level (as applicable) and be BBA approved. Grease trapping equipment shall be located within the Tenant’s demise prior to discharging into the Landlord’s system.

The Tenant shall submit a Grease Management Plan, including detailed proposals for the removal of FOG from the drainage system as part of its detailed design submission as applicable.

The Tenant shall be responsible for maintaining the system in good working order and in accordance with the manufacturer’s requirements and Health and Safety rules.

Once installed the equipment is to be regularly serviced by a specialist contractor and clear service records are to be kept on-site for auditing by the Centre Management Team.

Any costs associated with damage or blockage to the Landlord’s system due to grease discharged from unprotected lines, or where inadequate equipment has been employed or the system being incorrectly maintained will be met by the operator.

For the full Landlord requirements that must be complied with, refer to the Fat, Oil & Grease (FOG) Management of Wastewater systems: Specification for Tenant Fit Out. The Tenant is responsible for installing their own sanitary and soil and vent pipe work installation within their demise. The whole of the system is to be designed, installed and tested in accordance with BS EN 12056: Parts 1 and 2, 2000 Gravity Drainage Systems inside Buildings.

The Tenant’s attention is drawn to the need to properly insulate pipework and drainage in any circumstances where pipes enter the unit from outside the demise, in particular from the exterior of the development and/or un-heated common parts thereto.

The Tenant should ensure that reasonable access to all inspection covers and rodding eyes is maintained during and after the fit-out works.

WATER SUPPLY

By Tenant Each Tenant is to apply for and have a utility company water meter installed for direct billing of domestic water usage The Tenant shall be responsible for arranging the final water connection and installation of the utility company water meter including any bye-law inspection arrangements and utility supplier’s approvals.

It is the Tenant’s responsibility to provide hot water equipment within the unit as required. The ESCo Lthw connection shall be utilised to indirectly generate water. Water heaters/ calorifiers and showers, if any, should be temperate sterilised or chlorinated before being used in line with the relevant safety codes of practice.

The Tenant shall cross bond the pipework on completion of the installation of the meter.

The Tenant is responsible for sterilising the installation within the unit and for taking precautions to prevent the build-up on Legionella bacteria, including routine testing and sampling, all in accordance with BS EN 8558, HSG 70 and TM13 issued

by CIBSE. The use of lead solder is prohibited.

The Tenant is to ensure all fittings/valves/equipment etc. are WRAS approved.

The Tenant will be required to issue a copy of their flushing and chlorination certificate to the RDPM.

As part of the water utility meter application the Tenant MUST issue the water services schematic drawing to the utility supplier to allow the meter to be sized.

The Tenant shall be responsible for flushing and chlorinating the supply pipework from the connection point at the Landlord’s header pipework to the capped connection in the Tenant’s demise.

The Tenant shall be responsible for all water services installations within the Tenant’s demise including cold water storage tanks in accordance with the utility supplier’s requirements.

Low Temperature Hot Water and Chilled Water supplies for heating and cooling are provided to heat exchangers located with the Tenant demises. The Tenants side termination points must be utilised in the Tenant fit out of the space to provide heating and cooling in order to comply with the building’s BREEAM accreditation requirements.

The Tenant LTHW and CHW systems shall include variable volume flow control, be without bypasses and include equipment selected with the flow and return temperature stated in the unit specification. The Tenant shall be responsible for achieving the flow and return temperature differential stated in the unit specification. This shall ensure the correct operation of the energy centre equipment and network. The design of the systems including schematics, controls description, controls diagrams, equipment selection, flow rates, and operating temperatures shall be submitted to the Landlord for approval. The Tenant shall employ a commissioning specialist to balance the Tenant systems in accordance with the CIBSE commissioning codes.

Metering of the LTHW and CHW supplies shall be via the Landlord’s MID approved heat meters.

Landlord LTHW CHW systems are provided and as indicated in the unit specification. Where Landlord systems are provided the LTHW and CHW pipework enters the retail units at high level and connects to plate heat exchangers. The Landlord side of the plate heat exchangers are provided with heat meters and 2-port pressure independent control valves. The Tenant side of the plate heat exchangers is provided with a temperature sensor and pipework connections for the Tenant to connect to. The Tenant is responsible for the installation of the LTHW and CHW systems in their demise and including pumps, pressurisation units, controls and water treatment.

LTHW and CHW connections will be provided at the allocated plant spaces for the future installation of Tenant air handling units. The air handling connections will include MID approved heat metes and differential pressure control valves.

The Landlord installed heat meters will be interfaced to the energy management system for billing the Tenant for LTHW and CHW energy consumption.

The Tenant is responsible for installing their LTHW and CHW systems in accordance with the CIBSE Code of Practice (CP1) Heat Networks.

The Tenant is responsible for interfacing to the Landlord’s Building Management System.

The Tenant shall flush, chemically clean and dose their LTHW and CHW systems in accordance with BSRIA document BG29. The LTHW system shall be used by the Tenant to generate domestic hot water.

The Tenant shall install systems in accordance with the ESCo document ‘Commercial Unit Welcome Pack and Technical Guide’.

Shell and core building services have been designed in accordance with Building Regulations and planning consent criteria. Independently metered low carbon LTHW and CHW are supplied from the MEC operated by ESCo who are the appointed ESCo.

TEMPORARY SUPPLIES No temporary services will be available from the Landlord and the use of a generator is not permitted.

The Tenants shall make all necessary arrangements sufficiently early in order to obtain gas and electrical supplies for use during their fit-out prior to commencing works on-site. It is encouraged that you order your meter well in advance as the lead time on these items is often a few weeks at least. Please contact your RDM for the required MPAN number.

GAS SUPPLY Should catering occupiers wish to procure their own gas shipper supplies and meter/governor installation and connection from the Landlord installed gas supply pipe terminated within the Tenant demise, the Tenant shall provide their own installation that shall satisfy all regulations and safety requirements.

STATUTORY SERVICES The Tenant is responsible for making an application for service supplies to the statutory authorities such as electricity, gas, water and telephone and any associated costs.

METERING Installation of any meter must be in an accessible location to facilitate regular monitoring and readings by the building occupant / facilities manager (typically plant room, main distribution or control room and not in a ceiling void) and should be labelled with an identifying number as well as the type of energy being metered along with the end use of the energy being metered (i.e. the area, function or piece of equipment using the energy).

In addition, all meters must have pulsed or other open protocol communication outputs, to enable connection (or future connection) to an energy monitoring and management system.

Building regulations state at least 90% of your retail unit’s estimated annual energy consumption of each fuel type (most likely gas and electricity) must be metered. In addition, sub-metering of high-energy loads (e.g. kitchens or display lighting) and of each separate floor (if the unit has more than one floor) should also be provided.

To assist this, the HVAC designer and contractor must provide a description of the proposed energy metering strategy, including schematic drawings, and ensure that meters with pulsed or other open protocol communication outputs are provided to enable future connection to an energy monitoring and management system.

The required level of metering could be any or all of the following, depending on the size and estimated energy use of your unit: • Space heating • Domestic hot water • Humidification • Cooling • Ventilation • Controls • Catering

TENANT’S PLANT

PAVA

By Landlord

The Tenant’s plant is to be located within the unit demise as far as possible.

The Landlord system includes a PAVA interface unit (junction box) in each Retail unit.

Access to back of house and service areas for the purpose of fitting out works and connections constitutes work outside the Tenant’s demise. Permits and access must be arranged with either Sir Robert McAlpine or Battersea The Power Station Management Company (BPSMC) depending on the responsible party for the area to be worked in.

By Tenant The Tenant is responsible for the installation of a central PAVA system within their demise.

The Tenant is responsible for the connection to the interface unit and installation of PAVA cabling and speakers throughout their demise and in accordance with BS 5839 and BS EN 54. The final connection shall be by the Landlord’s approved contractor at the Tenant’s cost. A commissioning certificate shall be issued to the Landlord prior to occupancy.

Any works necessary to Landlord’s areas including protection of the Landlord’s finished surfaces and remedial works constitute work outside the Tenant’s demise and will require Permits to Work.

For units over one floor, forming holes through any roof finishes, floors or elevations will not be permitted.

For demises spreading over multiple floors please refer to your Tenant pack for the location of provided soft spots within the slab.

Where Tenants wish to install a public address system, this should be audible in all parts of the demise premises but should not interfere with the Landlord’s areas.

Tenants should refer to the Shell & Core Leasing Pack and the Structural Engineers constraints document for details of loading allowances for fitting-out works.

TV AERIALS & SATELITE DISHES No aerial or satellite dish connections are available. Separate aerials and satellite dishes are not permitted.

SECURITY Tenants should install their own intruder detection system.

Concealed security devices are encouraged. Visible security devices if required should be personalised and must be clearly identified in the detail design submission.

All wiring, conduits, crossovers and raceways must be hidden from view from outside the unit and within the publicly viewable areas within a unit.

FOOTFALL COUNTERS

KITCHEN EXTRACT

The Landlord is to install a footfall counting devices above the doorway of each unit to provide footfall data. Details and specifications for this very small unobtrusive device is available from your RDM.

All Tenants are required to route the kitchen exhaust via a fire rated duct. The Tenant shall be responsible to provide kitchen extract ductwork to meet correct fire rating and to meet statuary. All access panels required for cleaning in accordance with DW172. Tenant shall provide filtration, smoke control and odour control to meet all statuary and local authority requirements, and bearing in mind proximity to other retail units and residential apartments. The canopy, fan and absolute filtration unit and associated fire rated ductwork are to be accommodated within the demise. Please refer to the Leasing Pack for the location and specified location of kitchen exhaust.

To coordinate this installation with the Tenant’s shop fitting works the Tenant will be consulted on the install of Cat 6 cable from the rear of the unit to the ceiling above the shopfront doorway.

The Landlord will then organise the final installation and connection having agreed suitable dates and timing with the Tenant.

The Tenant’s system requires interfaces between the kitchen catering systems, the extract fans and fire alarm systems, for control and safety operations.

Where a catering extract system is installed, you must ensure that the risk of nuisance odours, smoke and grease deposits outside the unit is minimised.

In order to do this, you must determine the most appropriate odour mitigation measures. Refer to the Leasing Pack for further details. The Tenant is required to include the cleaning strategy within their O&M’s.

KITCHEN EXTRACT FILTRATION SYSTEMS

By Tenant The Tenant is responsible for the installation or filtration and odour control equipment to ensure that odours are not noticeable as a result of the discharge to external spaces. As a minimum the Tenants shall install the following in their demise adjacent to their kitchen: 1. High efficiency baffle type filters panels within the kitchen extract canopies which are up to 70% efficient at 3.5 microns.

2. Double pass electrostatic precipitator (ESP) to remove grease, fat and smoke space and fan provision for a third ESP to be installed in the future. BCSC Servicing Food and Beverage 3. Ultra violet technology (out of air stream) and sufficient dispersion time between UV and carbon filters in exhaust of AHU for ozone produced to dissipate and dissolve odours

The housing construction will be fully welded to prevent any collected grease leakage.

The housing will incorporate a sump for collection of oil and grease. – This sump will have a capacity of a minimum of 16 litres per collector cell. The sump is angled at 2 degrees to enable natural drainage.

Electrical Housing: • The electrical housing will be made as a complete sealed housing in 20 gauge galvanised steel which is fixed to the door of the main housing.

• A rotary safety isolator will be provided to prevent opening of the housing when switched on • The door will be lockable for safety

The Tenants shall install the following in the kitchen exhaust AHU within the Level 4 plantroom.

1. F4 pre-filter 2. Carbon filters to achieve 0.2 sec dwell time.

3. Space and power provision for odour neutralising systems to be installed in the kitchen extract discharge ductwork on the discharge side of the kitchen extract AHU.

• The door is sealed to the housing using EPDM seal

Inspection of internal surfaces and in-line components.

All access panels shall be in accordance with the requirements of DW/144, DW/172 and TR19.

• Provide three layers of mesh in each filter

Electrostatic Precipitators (ESP) specification: Main Cabinet - The housing will be formed from 18 gauge galvanised steel. The unit will be IP64 rated.

Mesh filters inside the ESP: • Provide a mesh pre and post filter per collector.

• The mesh filter will be made from oven aluminium • Provide weep holes to allow drainage of captured oil to the sump and to assist with washing

Ultraviolet Air (UV) Treatment • Out of Air Stream UV-O1000 • UV lamps will sit outside of the extract duct to avoid contamination • Construction will be of steel

• There will be light baffles either side of the unit to prevent direct eye contact with UV light

Tenant’s plant shall not exceed specified noise and vibration limits for the site and local authority limitations.

• Safety interlock will be standard to the door when opening

Drawings of the ductwork, UV system and wiring schematic illustrating the interlock system must be submitted to the Landlord as part of the detailed design submission.

• 185 0r 254mm lamps will be fitted • Volt-free contact will be able to be made to demonstrate a fault or connection to BMS system will be possible • Air pressure switch will be fitted to prevent the unit running without air flow • Key lock access to main UV cabinet and electrical enclosure, safety interlocked when door open.

UV systems will be sized to a minimum ozone dispersion time of 6 seconds to breakdown odour and ozone prior to discharge, UV systems must be (equating to approximately equivalent carbon 0.5s dwell time) within ductwork, interlocked using an airflow switch.

Activated Carbon Filters Located in the Kitchen Exhaust AHU’s • The Carbon filter panels will be bonded panels that hold the activated carbon granules in a rigid biscuit.

Where the Tenant extract ductwork is routed outside the Tenant’s demise and it has not been provided by the Landlord it shall be pressure tested to DW144 Class C standard throughout.

Results of the pressure tests shall be submitted to the Landlord and included with the certificate of conformity. Extract ductwork shall also be ‘grease tight’ and where water wash hoods are used, or extract provided from steam-laden extract air from dishwashers, ductwork shall be DW172 requirements.

The control system shall incorporate: • Interface control panel • UV control panel • UV health/maintenance required interlock • Extract fan interlock on/off switch interface

•The biscuit will be encapsulated in a carbon impregnated cloth, which will prevent any leakage of granules or powder.

• Fire Alarm and Interlock

• The grade of Carbon will be AC207

• Fire suppression interlock

• Carbon filters will be sized to have a minimum dwell time of 0.2s.

• Controls / BMS interlocks

These filtration systems shall report filter life status via SMS and/or GSM connection, and shut down the extract fan if filter overload warning is ignored.

Kitchen Canopy/Hood Fire Protection The Tenant shall install induction type kitchen canopies with high efficiency baffle filter panels up to 70% efficient at 3.5 microns

The above table sets out the minimum frequency with which full system cleaning of ductwork should be undertaken.

The exhaust hood shall be protected by an approved automatic fire detection and fixed fire suppression system installed in accordance with the requirements of the LPC Standard LPS 1223 and Landlord’s property insurers. No charcoal cooking is allowed unless expressly agreed by the Landlord.

Based on the findings of our on-site inspections, we reserve the right to stipulate a minimum cleaning frequency for grease extract ductwork systems as per the requirements of BPSDC insurers, which may be a higher frequency of cleaning than set out in TR/19 recommendations.

Maintenance Requirements Maintenance requirements are subject to the intensity of use and type of cooking & therefore frequency of cleaning and filter replacement shall be adjusted to suit. The Tenant shall use BPSDC FM services to ensure the following minimum levels of maintenance are adhered to.

Failure to comply with such requirements can invalidate the building insurance policy. (cont. next page)

The canopy and canopy/extract plenum is an area of higher fire risk and consideration should be given to more frequent cleaning in accordance with insurers’ requirements.

The Tenant’s installed BMS shall monitor the Tenant’s filtration systems and interface to the Landlord’s BMS for monitoring and alarms. Cleans are to be done in line with the frequencies indicated above, and post-clean wet film thickness tests should not exceed 50um and should be representative of the entire system. Any issues which impede cleaning must be highlighted.

Post clean, the Tenant’s duct cleaning contractors will provide a report that includes the following elements (a copy of this report should be available on site for inspection): • The systems cleaned • Pre-clean measurements • Post-clean measurements • Pre and post clean photographic records • Additional works carried out (if any) • COSHH Data on any chemicals used • Recommendations for future cleaning requirements

• A sketch or schematic of the system indicating access panel and testing locations and highlighting any uncleaned/inaccessible areas with an explanation as to why the area could not be accessed/cleaned • A certificate summarising the cleaning works completed.

Filters Canopy Grease Filters – Daily check/clean by the Tenants ESP – Bi-Monthly filter clean and inspection, fault monitored by Landlord BMS UV Equipment – BI- Monthly clean and inspection, replace lamps annually or after 8000 hours of operation whichever comes first, fault monitored by Landlord’s BMS. Pre-filter – Quarterly clean or when remote monitoring indicates dirty filter Carbon Filter – Change annually or when indicated by inspection or ozone content on discharge side by Landlords’ BMS. A Maintenance report shall be provided on a quarterly basis detailing checks undertaken, defects noted and works carried out. The report shall note the differential pressures across the filtration systems and compare against the manufacturers recommended operating and maximum levels. Maintenance checks and cleaning / replacement of filters shall be increased as necessary to ensure odour control system works effectively.

Misc.

The Tenant shall provide a run on timer facility for the extract fan, variable between 0 and 30 minutes, to allow the extract fan to run on in the event of a fire alarm activation and plant shut-down within the unit. The kitchen extract fan shall also be provided with a fireman’s override switch for ‘hand, Off, Auto’ located adjacent to the Tenant’s fire alarm panel. This shall be presented to the Local Building Control to ensure they are in agreement.

By Tenant Units that trade on two levels or have level changes within their demise will not have staircases provided under the base build.

Unit fire escape staircases are by the Tenant and the Tenant must ensure that they maintain their compartmentation between floors and evacuate onto the mall as if they were operating 2 separate units.

All in accordance with the current Building Regulations.

If an accommodation/escape staircase is required within a unit, this must be constructed by the Tenant in the location around which a soft spot has been provided.

Where, applicable, openings are provided within the shell works for the installation of Tenant stairs only as indicated on drawings available in the Base Build Definition document.

Tenant staircases where provided/installed must be finished with all necessary balustrades and handrails etc. in accordance with the Building Regulations Staircases should be enclosed if required to comply with the Building Regulations Part B. Internal staircases required in other locations are wholly the Tenant’s responsibility and must receive Landlord’s structural engineering approval at the concept design stage in accordance with the concept design submission document.

By Tenant Where a kitchen supply air system is provided it shall be installed in accordance with DW172 Section 6.

The supply system should be positioned as to not obstruct safe access to the kitchen extract system.

Goods lifts rated up to 2,000kg. Some of these will be available during fit out period, subject to restrictions on use as detailed within the Main Contractor’s Site Constraints document.

Lift capacity is provided to allow Tenants to move goods between the unit and the service yard only.

Tenants may use lift landing areas to temporarily store goods whilst moving them through the centre in relay but service corridors are to be kept free.

Works to be provided by Landlord in respect of Tenants Lifts and Escalators to Retail Units Trimmed openings where agreed in the lease will be provided for the Tenant in locations agreed and indicated in the Lease Pack.

Lift and escalator pits where agreed in the lease will be provided with temporary edge protection; location and number is to be agreed within specific zones and locations only.

By Tenant Lifts and Escalators by Tenant Any additional lift or escalator pits in floor slabs, floor slab openings for lifts, escalators, fire escape and customer staircases is the responsibility of the Tenant to install but only after being given permission by the Landlord.

Compartmentation between floors shall be maintained in all cases and fire curtains should be provided to maintain compartmentation between levels.

ACCESS / EGRESS

SERVICE YARD

By Tenant The Tenant is responsible for the provision of disabled access into the unit from the adjacent Landlords’ areas and internal circulation within the demise to meet the Equality Act and Building Regulations’ requirements.

First person in/last person out is to be through the rear of the unit where available.

For fire escape purposes, occupancies are calculated using a floor space factor of 2m2 per person for the whole area including storage and staff areas.

In relation to catering/restaurant units, occupancies have been calculated on floor space factors of 1m2 in seating areas and 7m2 in kitchens. 30% of the unit is taken as kitchen areas and the rest as seating.

The Tenant is responsible for the detailed planning of escape and fire safety within the demise of their unit and will ensure that the correct width of escape doors and corridors are maintained as part of their fit-out.

The Tenant is to comply with current Building Regulations and the Fire Officer’s requirements and to obtain approval of the same from Building Control and the Fire Officer. All fire safety provisions within the unit, including signage and fire extinguishing equipment are the responsibility of the Tenant.

Fire exit signage must match the style of that used in the Landlord’s areas to ensure consistency across the whole scheme.

Signs are to conform to BS EN ISO 7010: 2011 and be sized to suit viewing distances in accordance with BS 5499-4: 2013.

No servicing from adjacent ground level highways is permitted.

The Landlord shall provide vehicular service yards with: • Clearly marked unloading bays for articulated Lorries and variety of smaller vehicles. Adequate space shall be provided for manoeuvring and reversal into the loading bays in accordance with the computer analysis prepared by the Landlord • Electrical installations • External drainage and CWS • Lighting and Emergency Lighting • Safety barriers and handrails • Security • Fume extraction as required • Traffic management to service yard

By Tenant The Main Contractor and Landlord operate a system of booked deliveries to the service yards. The Tenant will comply fully with this system.

The Tenant will use the service yard in accordance with the Waste Management Strategy provided by the Landlord.

All deliveries will need to be scheduled and approved 48 hours in advance.

The Landlord will make certain waste management facilities available in the service area. These can be summarised as follows:

The Tenant will comply with Landlord waste management procedures during their fit-out and future fit-outs. More information on this system will be provided at a later date.

The Tenant will be responsible for sorting waste.

A number of operators will produce significant quantities of food waste. This should also be separated from general mixed waste in accordance with the Landlord’s waste management procedures.

No refuse provision is to be provided by the Landlord within tenancies. The Landlord’s Waste Management Strategy is designed to maximize recovery of waste through recycling.

This will be provided prior to Mall opening.

• Dry compactors and balers.

• Wet compactor.

• Wheeled bins will be supplied for general fit out waste, such as cardboard, paper, glass, plastics, cans and residual waste. Plasterboard must be segregated from general waste. Not to be stored in the Landlord’s area.

• Designated clear areas for the temporary storage of waste containers (including skips) provided by specialist contractors.

By Tenant The Tenant is responsible for storage and daily removal of waste/refuse and shall make provisions for refuse storage within their own demise. There are no communal facilities for waste storage in Landlord areas.

The Tenant will comply with Landlord waste management procedures during their fit-out, future fit-outs and while they are trading. The Landlord’s Waste Management Strategy is designed to maximize recovery of waste through recycling.

• The lift car uses energy-efficient lighting and display lighting i.e. an average lamp efficacy, across all fittings in the car, of > 55 lamp lumens/ circuit watt and lighting switches off after the lift has been idle for a prescribed length of time.

• The lift uses a drive controller capable of variable-speed, variable-voltage, variable-frequency (VVVF) control of the drive motor.

• The lift has a regenerative drive unit so that any energy generated by a traction lift (due to running up loaded to less than the counterbalancing ratio or running down loaded to more than the counter balancing ratio) or by a hydraulic lift (due to running down) is returned back to the electricity utility supplier or used elsewhere in the building.

For escalators and/or moving walks, each escalator and/or moving walk must comply with EITHER of the following: • It is fitted with a load sensing device that synchronises motor output to passenger demand through a variable speed drive. OR • It is fitted with a passenger sensing device for automated operation (auto walk), so the escalator operates in stand-by mode when there is no passenger demand.

TECHNICAL REQUIREMENTS The Tenant will be provided with a travel plan produced by the design team.

The Tenant will be responsible for ensuring that all applicable transport measures listed in the travel plan are implemented and maintained post construction. The transport will be supported by the building’s management during building operation.

TECHNICAL REQUIREMENTS A water supply will be provided within the building, but the installation and specification of sanitary fittings will be undertaken by the future Tenants. The following standard flow rates can be used as a guide to meet the water consumption standard above: • Dual Flush WC with 4/2.6l capacity full and part flush; • Waterless urinals or PIR controlled urinals with flush volume of no more than 1l per flush; • Wash hand basin taps with a consumption no greater than 4l per min; • Showers with a flow rate of no more than 8l per min; • Kitchen Taps with a flow rate of no more than 5l per min; • Kitchen taps: restaurant (pre-rinse nozzles only) with a flow rate of no more than 6l per min; n Domestic Dishwashers of no more than 11 litres per cycle; • Commercial Dishwashers of no more than 4 litres per rack; • Domestic Washing Machines of no more than 35 litres per use; • Commercial/Industrial Washing Machine of no more than 5 litres/kg.

TECHNICAL REQUIREMENTS The Tenant is required to ensure that any water-consuming plant or building areas, consuming 10% or more of the building’s total water demand, are either fitted with sub meters or have water monitoring equipment integral to the plant or area. Each meter (main and sub) has a pulsed output to enable connection to a Building Management System (BMS) for the monitoring of water consumption. If the site on which the building is located has an existing BMS, managed by the same occupier/owner (as the new building), the pulsed water meter(s) for the new building must be connected to the existing BMS.

TECHNICAL REQUIREMENTS The Tenant must ensure that one of the following types of flow control device is fitted to each WC area/facility to ensure water is supplied only when needed (and therefore prevent minor water leaks): 1.

A time controller i.e. an automatic time switch device to switch off the water supply after a predetermined interval 2. A programmed time controller i.e. an automatic time switch device to switch water on and/or off at predetermined times.

3.

A volume controller i.e. an automatic control device to turn off the water supply once the maximum pre-set volume is reached.

4. A presence detector and controller i.e. an automatic device detecting occupancy or movement in an area to switch water on and turn it off when the presence is removed.

A central control unit i.e. a dedicated computer-based control unit for an overall managed water control system, utilising some or all of the types of control elements listed above
