With the end of the year approaching, this is a good time to consider tax deductible expenses for 2019 and weigh the benefit of expediting early 2020 anticipated purchases, in order to deduct them from 2019 taxes. Some of the expense items REALTORS® can usually deduct are: » Advertising » Legal and Professional Fees » Dues and Subscriptions » Meals and Entertainment » Cell Phone » Lockbox Fees » Broker Fees

RAR members and CVR MLS users can see and print a receipt for 2019 Association and MLS-related expenses by logging into their online account and clicking on view paid and unpaid invoices. Be sure to check with a tax consultant/accountant if you have questions concerning the deductibility of an expense. The Federal Budget Act of 1993 and Tax Act of 2018 eliminated tax deductions for portions of dues used for lobbying activities. The estimated portions allocated by the Richmond-, Virginiaand National REALTOR® Associations for lobbying on behalf of real estate interests are listed below. These figures should be communicated to your tax consultant. 2020 ESTIMATED NON-DEDUCTIBLE PORTIONS OF DUES RAR: 7.7% or $13.09 VR: 9.7% or $16.49 NAR: 38% or $57.00 Note: NAR Consumer Advertising Campaign special assessment of $35 is exempt from the above formula and considered a deductible expense.

President’s Letter BY CURT REICHSTETTER

Another year of delivering for our members comes to a close.

O

ne minute I’m being sworn in as President; the next minute, I’m drafting this farewell letter. At least that’s how it feels—the year passed so quickly. I had a lot of fun serving as your President. Often we lose sight of the fact that not only is it “okay” to have fun while volunteering, it’s essential. I encourage each of you to consider future service opportunities with RAR and CVR MLS and join in the fun. Serving with other volunteers—our Boards of Directors and committees—as well as with our talented staff, we accomplished much good work in 2019. We released SavvyCard, a product that enables MLS users to more effectively share contacts and listing content via social media. When we converted to SentriLock, we partnered with a lockbox vendor committed to excellent customer service and continued technological innovation. And in October we launched two Clareity products—Safe MLS and the Single Sign-on Dashboard—demonstrating a two-fold commitment: to a user-friendly MLS system and to the protection of your information as well as that of your clients. Providing members with new technology isn’t the only way we kept pace with the industry’s ever-changing landscape. In 2019 we held over 218 classes, including 40 free MLS training sessions. A record number of members—over 600—turned out for the Outstanding Production awards reception; and members gained

incredible market insights during our TRENDS event. And thanks to the commitment of so many of you, we experienced another record-breaking year with RPAC, with over $155,000 raised from over 1,200 contributors. RPAC is the lifeblood of our advocacy efforts; for that reason, raising awareness of RPAC was one of my top priorities. Thank you for recognizing RPAC’s value and contributing to it. Finally, we continued to be deeply engaged in efforts to enhance our region’s collective quality of life. Led by Chair Jim Napier and staffed by Elizabeth Greenfield and Jovan Burton, the Partnership for Housing Affordability took the lead on the development of a regional housing strategy. We made significant philanthropic investments in affordable housing nonprofits as well as nonprofits devoted to enhancing K-12 educational opportunities. Safe, affordable, stable shelter and access to high performing schools are essential to our community’s quality of life; and it is only when people believe in a community’s quality of life that they are willing to make the biggest investment of their lives—home ownership. While this letter has been dedicated to a look back, I’m really looking ahead to 2020. I’m excited about the leadership that Wayne Gauthier will bring to RAR and Steve Overgard to CVR MLS. We are in good hands and I wish these two gentlemen—my friends—all the best.

This year RAR welcomed back Dr. Lawrence Yun, NAR Chief Economist along with Dr. Lisa Sturtevant, VR Chief Economist and Crystal Washington, Futurist and Technology Strategist. Dr. Yun is widely regarded as one of the top economic forecasters in the country. He shared his insights into the current economic climate and his predictions regarding how these conditions will impact national and regional housing markets in 2020.

A Look Ahead W AY N E G A U T H I E R

I

t’s hard to let a year like 2020 go by without turning our attention to the value of clarity. At RAR, our theme for the year will be “See the Future and Bring it Into Focus.” The words, “see the future,” reflect the need for real estate professionals to look beyond today’s deadlines to anticipate tomorrow’s challenges and opportunities. When, in May, we undertake the development of a new strategic plan, we will chart a course for the Association that enables it to remain responsive and relevant. The words, “bring it into focus”, indicate that action will be necessary, if we want to overcome the challenges ahead and take advantage of future opportunities, such as new ways to communicate the Realtor value proposition.

As RAR members, we can better focus on our professional success if we utilize the programs and services offered by our Association in 2020. For example, support RAR’s advocacy efforts by contributing to RPAC. Plan to attend REALTORfest with its “Focus, Engage, Deliver” theme and consider enrolling in a new program, RAR’s Circle of Excellence. This program is designed to recognize members who seek excellence through Realtor association participation, professional development, and community engagement. To qualify for the Circle of Excellence, members will accumulate points for volunteer service, industry participation, and the completion of certain mandatory educational classes. What a great opportunity for all of us to both give back and grow.

I am honored to serve as your 2020 RAR President. I look forward to partnering in leadership with Steve Overgard who will serve as CVR MLS President.

PHA Framework B Y J O VA N B U R T O N

I

n January of 2004, the Richmond Association of REALTORS® founded the Partnership for Workforce Housing which later became the Partnership for Housing Affordability (PHA) to

reflect its intention to address our regions’ affordable housing challenges—from homelessness to home ownership. In the years since its founding, PHA has worked to ensure the creation and maintenance of an adequate supply of affordable housing as a public policy priority. Through initiatives such as Affordable Housing Awareness Week, the nonprofit has shone a spotlight on housing; and through biennially published reports, PHA has provided public officials with the resources they need to enact policies that increase the number of affordable units throughout the region.

In 2018, PHA began working with leadership from Richmond, Chesterfield, Henrico and Hanover, community members, nonprofits as well as representatives from the business and philanthropic communities to create a regional housing framework that outlines the region’s overarching demographics, challenges, and opportunities. The Framework creates a three-year, solutions-oriented action plan for increasing housing affordability in the Richmond region. From March to July 2019, 30 meetings were held across the Richmond region, which, including survey responses, engaged over 900 people. Community members suggested solutions and strategies which will be considered in the development of the Regional Housing Framework to be released in January of 2020.

irginia REALTORS® announced its 2019 Award Winners honoring the year’s most accomplished Realtors. The ceremony was held on Wednesday, September 18, in Williamsburg—in conjunction with Momentum 2019, the Virginia REALTORS® Annual Convention. The ceremony celebrated excellence in various areas of real estate, including brokerage, education, and other business achievements. These awardees were selected by a committee of peers as standouts among an association of more than 35,000 members.

RAR member, John O’Reilly, received the VHDA Service to Virginia Award for his dedication to making a difference in affordable home ownership. “I’m honored to be presented with the VHDA Service to Virginia Award,” said John O’Reilly. John O’Reilly

Homeownership is one of the most, if not— the most important—financial decision a person will make in their life time. Everyone, regardless of race, background, or upbringing deserves an opportunity to find a stable place to call home and to become a part of a community. Leadership Development Academy BY GRACIE PECK

T

he Leadership Development Academy (LDA) is a six-month program designed to develop visionary, service-oriented Realtor members for professional, civic, and community leadership roles. As a part of this program, participants engage in a group civic project donating their time and sweat equity to a cause of their choice.

After months of preparation, LDA participants took one day to renovate the room. They painted the walls, replaced all bedding and mattresses, hung new blinds for the windows, assembled new storage, installed lighting and hung artwork. HomeAgain Richmond is using the work done by LDA as a model for all future volunteer groups who wish to adopt a room.

The 2019 LDA class adopted a room at HomeAgain, Richmond’s emergency shelter for families experiencing homelessness. LDA participants fundraised and collected donations from their Realtor peers to transform this space into a welcoming home.

We congratulate the 2019 Leadership Development Academy graduates on the success of this ambitious project and look forward to their future leadership endeavors.

2019 Consumer Campaign BY JOHN LE

CVR MLS and the Richmond Association of REALTORS® partnered with local creative teams, specializing in photography and film, to produce content for consumer placements and a stock library for members’ marketing use. The campaign launched in 2018 with photos and video centered around Richmond localities, landmarks, and Realtor-client interactions. The library was expanded this year to include over 2000 high-quality photos, graphics, and videos available for Realtor members to download and use. Additionally, RAR hosted three hands-on

workshops entitled, Building Your Brand: Association Resources and How to Utilize Them focused on teaching members to create graphics and video with materials from RARealtors.com/MarketingContent. The campaign supports our consumer-facing site, WeAreTheR.com. Ads incorporating the new stock library appeared in print and digital consumer placements with the tagline “Realtors: Your Local Community Experts,” to draw consumers to resources promoting the value of using a Realtor.

1. R E V I S E D CVR M LS RE S ID E N TIA L PURCHASE AGREEMENT Paragraph 2. PERSONAL PROPERTY INCLUDED The term “built-in” was removed to eliminate confusion as to whether the range, oven or dishwasher (if any) will or will not convey with the property. Paragraph 16. PROPERTY INSPECTION A clarifying sentence concerning the life expectancy of a system or component was added to the definition of “defects”. The term “defects” as used in this paragraph 16 shall mean (i) a condition which impairs the normal stability, safety or use of any improvements (buildings) on the Property, or (ii) damage to any part of the improvements, but shall exclude any cosmetic flaws, antiquated systems or grandfathered components that are in working order but would not comply with current building code if constructed or installed today. If a system or component is near, at or beyond its projected life expectancy but is properly functioning, then such system or component will not be deemed a defect as defined herein. This section now contains an optional paragraph that, if selected and agreed to by the seller, grants the Purchaser the right to terminate the Purchase Agreement, if they are dissatisfied with the result of the home inspection. This optional paragraph is only applicable, if the Purchaser selects the appropriate box in the optional paragraph. If no option is checked, then the paragraph is not applicable. OPTIONAL PARAGRAPH: This paragraph [select one]:  is OR  is not applicable. If no box is checked, then this paragraph is not applicable. If this paragraph is applicable and Purchaser is dissatisfied with their inspection results of the Property, then in lieu of submitting a Repair Request to Seller, Purchaser may instead terminate this Agreement by written notice to Seller prior to the Inspection Deadline; provided however, if Purchaser submits a Repair Request to Seller, then Purchaser waives their right to terminate this Agreement pursuant to this paragraph, and agrees to proceed with the negotiation of the Repair Request as set forth above. If Purchaser terminates this Agreement in accordance with this paragraph, then subject to the provisions of Paragraph 8, Purchaser’s Deposit shall be refunded in full to Purchaser, and neither party shall have any further obligation hereunder. Paragraph 24B. TITLE The time period to cure title defects has been reduced from 60 day to 30 days. Paragraph 24F. WELL, SEPTIC OR MUNICIPAL SYSTEMS If it is determined prior to settlement that the property is not served by the water and/or septic system indicated in the purchase agreement, the Purchaser shall provide written documentation to that effect. Within five days of receipt of documentation, the Purchaser may negotiate terms for the connection of such(s) systems with the Seller or terminate the Agreement. If the Purchaser does not terminate the Agreement within the five-day period, the Purchaser’s right to terminate is waived.

2 . R E V I S E D CVR M LS PU RCH ASE AGREEMENT FOR UNIMPROV ED PROP E RT Y Paragraph 9. STUDY PERIOD The terms of the study period have been streamlined to allow for due diligence by the Purchaser without performing specific engineering or feasibility studies by professionals. *9. STUDY PERIOD: Purchaser shall have _____ days from the Date of Ratification to determine whether Purchaser’s use or plan of development for the Property is practical. If, prior to the expiration of the study period, Purchaser determines that Purchaser’s proposed use or plan of development for the Property is not practical, then Purchaser may terminate this Agreement by written notice to Seller and subject to the provisions of Paragraph 7, Purchaser’s Deposit shall be refunded in full to Purchaser, and neither party shall have any further obligation hereunder, except as provided herein. Time shall be of the essence for this Paragraph.

REQUESTED REPAIRS The definition of defects as contained in paragraph 16 of the Purchase Agreement was added to the Repair Addendum. 1. Requested Repairs. Pursuant to Paragraph 16 of the Agreement [select one]:  Purchaser waives their right to request any repairs to the Property. OR  Purchaser hereby requests and Seller agrees, at Seller’s expense, to make the following repairs of defects revealed during the Property inspection. Pursuant to Paragraph 16 of the Agreement, Purchaser shall not request Seller to perform any inspections of the Property. Except as listed below, Purchaser waives their right to request any further repairs of the Property pursuant to Paragraph 16 of the Agreement. List below all repairs of defects requested by Purchaser and cost of repairs pursuant to the inspection report(s) provided to Seller.

4. R E V I S E D E XCLUS I VE RIGH T TO REPRESENT BUYER AGREEMENT Paragraph 5. COMPENSATION The compensation language in the Buyer Brokerage Agreement has been revised to clarify: I. The amount of compensation owed to the firm representing the Buyer II. That any amount received from the listing firm or the seller shall be credited towards the amount owed by the Buyer III. Whether additional compensation would be expected from the Buyer, if the amount received from the listing firm or seller does not cover the stated minimum fee owed to the firm representing the Buyer 5. COMPENSATION. For their services rendered, Broker shall be paid the following compensation (the “Fee”) [select one box]:  Option A Broker shall be paid a Fee equal to the compensation offered by a listing firm or seller to a buyer’s broker on property acquired by Buyer, but the minimum Fee paid to Broker shall not be less than [select one box]:  ________% of the gross purchase price of such property. The Buyer may remove a first right by providing the following documentation: i. Written verification from Purchaser’s lender stating such lender has verified Purchaser’s income, assets and credit report and that Purchaser is pre-approved for a loan to purchase the Property without the requirement for Purchaser to sell Purchaser’s Property; OR ii. Written verification from a third-party in possession of Purchaser’s funds that Purchaser has sufficient funds on deposit for a cash closing; OR iii. A fully executed real estate contract for the sale of Purchaser’s Property, along with written verification from a third-party that the buyer of Purchaser’s Property has sufficient funds on deposit to purchase Purchaser’s Property, or from a lender stating such lender has verified the buyer’s income, assets and credit report and such buyer has been pre-approved for a loan to purchase the Purchaser’s Property and neither the real estate contract nor the loan approval is conditioned upon the sale of any real property.

6. NE W S E L LE R’S N OTIC E TO PURCHASER SECONDA RY CONTRACT This new form aids in the use of the First Right Addendum by facilitating the delivery of notice from the Seller to the Purchaser stating that the Seller has accepted a written offer from a third party. Only the Seller is required to sign this notice.

7. NEW PURCHASER’S NOTICE TO SELLER REGARDING FIRST RIGHT OF REFUSAL This new form also aids in the use of the First Right Addendum by facilitating the delivery of notice from the Purchaser to the Seller stating that the Purchaser is either removing the first right contingency or terminating the Purchase Agreement. Only the Purchaser is required to sign this notice.

8. N E W BROKE RAGE RE F E RRAL AGREEMENT This new form is intended to document the referral of a customer from one firm to another, the agreed upon referral fee and when such fee shall be paid.
