TWO x TWO for AIDS and Art is an annual black-tie gala and contemporary art auction held at the Richard Meier-designed Rachofsky House in Dallas, Texas. Thanks to the phenomenal support of the participating artists, dealers, sponsors and patrons, TWO x TWO has raised over $25 million in its eleven year history in support of amfAR’s AIDS research initiatives and the Dallas Museum of Art’s contemporary art acquisition program and exhibitions.

TWO x TWO for AIDS and Art has evolved into a weeklong series of social events aimed at advancing the progress of amfAR and engaging the arts community in Dallas. TWO x TWO has become the largest fundraiser in the United States for amfAR. TWO x TWO is also the largest single annual source of funds for contemporary art acquisitions at the DMA, enabling the addition of over 80 major works of contemporary art to its permanent collection and helping to fund remarkable contemporary exhibitions.

Founded in 1985, amfAR is dedicated to ending the global AIDS epidemic through innovative research. If the auctioneer determines that any opening bid is not commensurate with the value of the article offered, the auctioneer may reject the same and withdraw the article from sale, and if, having acknowledged an opening bid, he decides that any advance thereafter is insufficient, he may reject the advance.

On the fall of the auctioneer’s hammer, the highest bidder shall be deemed to have purchased the offered lot subject to all of the conditions set forth herein and thereupon (a) assumes full risk and responsibility therefore (including without limitation damage to frames or glass covering the prints), (b) will sign a confirmation of purchase thereof and (c) will pay the full purchase price therefore before property can be released. All property shall be removed from premises by the purchaser at his/her expense no later than three (3) days following the sale and, if not removed, may be sent by amfAR at the expense of the purchaser to a public warehouse for the account risk and expense of the purchaser and such added charges will then be added to the purchase price of the object. If the foregoing conditions and other applicable conditions are not complied with, in addition to other remedies available to amfAR by law, including, without limitation, the right to hold the purchaser liable for the bid price, amfAR, at its option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property on three (3) days notice to the purchaser and for account and risk of the purchaser, either publicly or privately, and in such event the purchaser shall be liable for payment of any deficiency, all other charges due thereunder and incidental damages.

6. Deliveries outside of Texas may be subject to the tax of another state and, where a duty of collection is imposed by law, amfAR will require payment of all said taxes. A purchase price below or at fair market value is considered to represent the value of the property purchased and is, therefore, not deductible as a charitable contribution. For a purchase above fair market value, the amount above fair market value is considered tax deductible. All checks will be payable to amfAR/DMA. 7. (a) Neither Sotheby’s nor amfAR is responsible for errors or omissions arising out of or resulting from order bids or bids transmitted by telephone, including, without limitation, errors or omissions arriving from mechanical difficulties or failure. (b) Some lots may be offered subject to a reserve, which is the confidential minimum price below which such lot will not be sold. The auctioneer may implement such reserves by bidding on behalf of amfAR. 8. Items in the Silent Auction may be bid for in-person or by proxy through an absentee bid. The amount of the bid must be equal to or exceed the required increment as shown on the Bid Form and must be in round dollar amounts. All signed bids are binding and successful bidders not present at the auction will be notified by phone on or before October 25, 2010.
