There are certain expenditures associated with purchasing a property in Portugal that need thoughtful financial planning. These acquisition costs may be utilised to offset potential future liabilities arising from the capital gains tax, on the condition that they are carefully documented.
Thus, it is fundamental to maintain and systematically organize these records properly. When you purchase the property in your own name, you will need to pay fixed fees for Notarial and Registration acts. Additionally, the Property Transfer Tax (IMT) and Stamp Duty will be calculated based on the purchase value of the property.
When purchasing a property, it’s important to be aware of the associated taxes. Stamp Duty is a fixed tax rate of 0.8%, while the Property Transfer Tax is a variable tax that depends on the property type and ranges from 1% to 8%.
In the Quinta do Lago market, the typical rate for Property Transfer Tax varies from 6% to 7.5%, with plots specifically at 6.5%, which aligns with the local property prices within this region. These taxes require a one-time payment upon the property purchase.
It is important to take into account the legal fees associated with your lawyer. Although these can vary considerably among solicitors, they usually constitute about 1% to 2% of the transactional value.
Aside from the Transfer Tax, there is an Annual Property Tax (IMI) payable annually in either 2 or 3 installments. In some cases, certain properties that surpass a specific valuation may be subject to an additional annual property tax referred to as AIMI.
The calculation of both taxes is based on the Property Rateable Value (VPTValor Patrimonial Tributário) of the real estate property. The local Municipality determines the tax rates annually, which fluctuate between 0.3% and 0.8%.
Quinta do Lago and other nearby resorts, governed by the Municipality of Loulé, have traditionally been on the lower end of the spectrum, remaining at 0.3% over the past few years.
There are different ownership structures and the progression toward a definitive acquisition will pursue a divergent trajectory in accordance with the type of structure you choose.
Each option will lead to a distinctive path in terms of securing the ownership of your selected property.
THE MOST COMMON OPTIONS ARE
● Purchasing the property under the name of the prospective buyer(s);
● Acquiring the property under the designation of a company, be it domestic or international;
Typically, legal professionals are responsible for the formulation, negotiation, and endorsement of a Share Purchase Agreement. This document delineates the terms and conditions for the transaction’s execution, including provisions for deposits, deadlines, and penalties.
Prior to the official endorsement of the Share Purchase Agreement, a Due Diligence procedure is usually implemented by the purchasing party’s legal counsel to examine all documentation pertinent to the transaction.
Upon mutual agreement, a specific date is accorded for the finalization of the transaction. At this time, this involves signing a terminal document that meets all the necessary final transactional requirements.
Local legal advisors, who are well-versed in these matters, can provide indispensable guidance and necessary support to improve your understanding of each ownership structure. Additionally, they will have access to comprehensive information relevant to every possible scenario.
Upon acceptance and agreement of the offer, the buyer and seller instruct their respective legal representatives to commence the legal and administrative procedures necessary for the transfer of the property.
To ensure the property’s transaction, a “Promissory Contract of Purchase and Sale” (CPCV) is typically drafted and agreed upon by the lawyers of both parties. During the negotiation phase, it is typical for some of the details of this document to have already been settled by both parties.
Prior to the CPCV, a refundable reservation fee may sometimes be requested and held by Quinta do Lago Real Estate as trustees.
This promissory contract usually outlines the major clauses that are required to be incorporated within the final deed, which serves as the official document facilitating the property’s transfer and must be signed at an authorised Notary’s Office. Your legal team along with the Quinta do Lago Real Estate consultants will make sure that all legal requirements are accomplished and that a safe and smooth transaction takes place.
KEY TOPICS COVERED IN THE CPCV CONTRACT
● It is mandatory to include the purchase price and terms of payment in any transaction - a deposit between 10% to 25% is typically considered standard.
● A contract may be subject to the buyer securing the necessary financing for the transaction, a satisfactory evaluation of the paperwork during due diligence, and a satisfactory Structural Survey report, among others.
● The timeline for completion of the transaction usually takes between 30 and 90 days to occur.
● The implications of a potential contractual breach whilst generic consequences can be mutually agreed upon. They usually include the vendor’s right to retain the initial deposit if the breach is caused by the buyer. If the vendor causes the breach, the obligation to return twice the value of the initial deposit to the buyer is included.

TYPES OF VISAS IN PORTUGAL
Choosing the right visa should always be assessed on a caseby-case basis, taking into account the individual’s goals and the purpose of their stay in Portugal.
Broadly speaking, there are two main categories of visas for entry into Portugal:
● Schengen Visa
● National Visa
The Schengen Visa is intended for short stays of up to 90 days and is typically used for tourism, family visits, business trips, meetings, or other short-term purposes.
For stays exceeding 90 days, individuals must apply for a National Visa, which includes:
Temporary Stay Visa – for stays of more than three months and up to one year, often granted for seasonal work, extended medical treatment, or similar circumstances.
Residence Visa – for stays longer than one year.
Among the residence visas, the most frequently used by foreigners looking to reside and regularise their status in Portugal are the D2 – Entrepreneur Visa, D7 – Passive Income Visa, and D8 – Digital Nomad Visa.
D2, D7, AND D8 VISAS
The application process for all three visa types (D2, D7, and D8) begins at a Portuguese Embassy or Consulate. Once the visa is granted, the applicant may enter Portugal and apply in person for a residence permit.
Though the process is similar, each visa serves a distinct purpose:
D2 – Entrepreneur Visa. Aimed at non-EU citizens intending to start a business or work as self-employed individuals in Portugal.
D7 – Passive Income Visa. Designed for non-EU citizens who can demonstrate a stable income from pensions, real estate, intellectual property, or financial investments.
D8 – Digital Nomad Visa. Intended for remote workers — freelancers or employees of foreign companies — who wish to live in Portugal while working for clients or employers outside the country.
Holders of a residence permit under any of these visas must reside in Portugal and may not be absent for more than six consecutive months or eight non-consecutive months.
RESIDENCE PERMIT FOR INVESTMENT ACTIVITY (ARI / GOLDEN VISA)
For non-EU nationals who do not intend to relocate to Portugal but wish to invest, the Residence Permit for Investment Activity (ARI) — commonly known as the Golden Visa — remains a relevant option.
Unlike the D2, D7, or D8, the ARI is not a visa but a residence permit applied for directly in Portugal, based on proof of qualified investment.
Eligible investment options include:
● Subscription of approved investment or venture capital funds
● Donations to the arts or scientific research
● Job creation
● Capitalisation of new or existing companies
In this case, only 14 days of stay every two years in Portugal are required.
SPECIFIC CONDITIONS FOR EACH RESIDENCE PERMIT
Each type of residence permit has distinct requirements. It is advisable to consult AIMA and seek expert advice to access updated and accurate information tailored to your situation.
RNH 2.0 – TAX INCENTIVE FOR SCIENTIFIC RESEARCH AND INNOVATION (IFICI)
With the closure of the Non-Habitual Resident (NHR) regime, and a transitional phase for current applicants, Portugal has launched a new regime — IFICI , often referred to as RNH 2.0
Designed to attract skilled professionals, the regime is available to those who:
● Become tax residents in Portugal
● Have not been tax residents in the previous five years
● Earn income in specific eligible fields
These fields include:
a) Higher education and research professionals in Portugal’s science and technology system
b) Executive roles in companies benefiting from investment incentives
c) High-skilled roles in finance and economics (to be defined by ordinance)
d) Roles in certified start-ups under Law No. 21/2023
Tax benefits include:
● A flat 20% tax rate on eligible employment or service income
● Exemptions on certain foreign income, excluding pensions
