RULES AND REGULATIONS FOR PARTICIPATION IN THE PRIZE DRAW
1. THE GAME ORGANISER
The organizer of the "Pure Gold - The Gold Club Registration Campaign" sweepstakes ("Game") is Galvanize Nutrition Korlátolt Felelősségű Társaság (Registered Office: 1145 Budapest, Columbus utca 27-29. building B., Company Registration Number: 01-09-305771, Tax Number: 25938249-2-42, Represented by László Garai, Managing Director, individually) ("Organizer" "DataController").
Galvanize Nutrition Korlátolt Felelősségű Társaság (Registered office: 1145 Budapest, Columbus utca 27-29. building B., 1145 Budapest, Budapest, Building B., Company registration number: 01-09-305771, Tax number: 25938249-2-42, Represented by László Garai, Managing Director, acting independently) ("Operator" or "Processor") shall also be responsible for the tasks related to the implementation of the Game.
2. CONDITIONS FOR PARTICIPATION IN THE GAME
2.1. Prize draw platform: https://puregoldprotein.com/hu/
2.2. Conditions of Participation:Only natural persons ("Player") who are 18 years of age or older, residing or domiciled in Hungary, and who are not excluded as defined in clauses 2.3, 2.4, 2.5, 2.8, 2.8, 2.9, 5.2, 5.4, 7.3 and 8.4, and who are of legal capacity, may participate in the Game. The language of the Game is Hungarian.
The Game must not contain: conduct or content that is sexual, aggressive, violent, endangers public safety, constitutes a criminal offence or a breach of the law, harms or encourages harm to the environment or nature, or any content that may harm the physical, mental, emotional or moral development of children and minors, etc.
2.3. During the game, the task is:
- Registration on the Sweepstakes platform, 'The Gold Club' loyalty program during the specified period (17 February - 31 March 2025)
2.4. The Organiser may exclude participants who provide false information from the Game.
2.5. The Promoter will only consider valid those Entries that are submitted by the Players by providing their own details (full name, e-mail address).
2.6. By submitting an Entry, the Player acknowledges that the content, performance, message and data transmission and response speeds of the technical infrastructure of the Game are dependent on the
server technology and may be adversely affected by factors beyond the control of the Promoter, such as (but not limited to) connection failure, server computer performance, network load, network congestion, coverage and the maintenance of a secure network connection. The Promoter and the Promoter exclude all liability arising from this paragraph.
2.7. The Promoter may examine the Applications to verify that they comply with the terms of the Rules and if they or the Player submitting them do not comply with the terms of the Rules for any reason, the Player concerned may be disqualified from the Game.
2.8. The employees of the Organiser, the Promoter and other third parties involved in the organisation of the Game are excluded from the Game and all such persons are subject to the provisions of the Civil Code. 8:1 § (1) point 1) of the Competition.
2.9. Players who, contrary to the spirit of the Game, participate in the Game in a team under the name of a natural person, using false information, with the aim of increasing their chances of winning by such deceptive conduct, may be excluded from the Game, at the discretion of the Organizer. Such Players include, for example, persons associated for the purpose of participating in prize draws and other prize games, who coordinate their actions in order to obtain prizes and combine the performances of several persons under one name, thereby depriving other Players who wish to play fairly of the chance of winning. Such persons shall also include those who participate in the Game with false information for the purpose of unfairly increasing their chances of winning. Participants or Players who engage in unfair conduct as defined in this clause shall be liable to compensate the Organiser and/or the Promoter for any damage caused to them in connection with the Game.
2.10. Registration and participation are free.
3. DURATION OF THE GAME
3.1. The Game will run from 17 February 2025 until 31 March 2025. Game closes at midnight on 31 March 2025.
3.2. Entries received after the closing date of the Competition will not be accepted by the Promoter as valid Entries.
4. PROCESS OF THE GAME
4.1.
PARTICIPATION IN THE LOTTERY
In order to be eligible to participate in the draw (to have a valid Offer), the Player must comply with the requirements set out in section 2.1 of the Rules of the Game during the period specified in
section 3 of the Rules of the Game , i.e. the Player registers on the Sweepstakes platform, 'The Gold Club' loyalty program during the specified period (17 February - 31 March 2025).
4.2. DRAW FOR PRIZES
The winners will be selected from the valid Applications after the closing date of the competition, 4 April 2025, as follows:
The Organiser and the Promoter will draw the winners by random mechanical draw. A total of 3 winners will be drawn in the draw. The draw will also draw 3 reserve Winning Tenders. The Reserve Winners will be eligible in the order in which they are drawn if the Winner or the Reserve Winner' previous Winning Entry is invalid for any reason or the Winner or the Reserve Winner's previous Winner is disqualified from the Competition for any other reason related to their Entry.
5. NOTIFICATION OF WINNERS, HANDING OVER OF PRIZES
5.1. The following Prizes will be drawn in the Game:
- A Pure Gold Protein gift card worth HUF 50,000, freely redeemable at the Pure Gold Protein webshop (https://puregoldprotein.com/hu/).
5.2. The list of winners will be announced on the Sweepstakes platform on Pure Gold Protein's webshop and will be notified by the Promoter by email ("Notification").
5.3. Winning Players are required to acknowledge the Notification within 5 (five) working days of receipt of the Notification and to provide accurate personal information (full name, email address) required for the delivery of the Prize. If the Winning Player does not confirm the Notification or provide the details required for delivery of the Prize within the above time limit, the Winning Player's Competition will be disqualified and the Reserve Winner will be declared the winner.
5.4. The Prize will be delivered electronically by the Promoter to the email address provided by the Player in his/her response to the Notification. Delivery of the Prizes will be made after prior arrangement with the Winner. The Winning Player shall be obliged to cooperate with the Promoter in respect of the receipt of the Prize and shall be required to prove that he/she is over 18 years of age before receiving the Prize. If the Winning Player fails to comply with this obligation to cooperate, and the Prize is therefore not transferred, the Organiser or the Promoter shall not be liable for this. The Promoter will not be able to provide another opportunity to collect the Prize.
5.5. The Promoter shall exclude from the Game any Entry for which the Prize cannot be delivered or transferred to the Player who submitted it because the personal data provided in the Entry or in the confirmation of the Notification are not true, incomplete or incorrect, or the Player who submitted the Entry does not meet the personal requirements set out in these Rules for any other reason. The Promoter and the Promoter shall not be liable in any way whatsoever as a result of the incorrect information provided by the Player.
5.6. Prizes are non-redeemable, non-transferable and non-refundable.
6. ADDRESSES
6.1. The Promoter is responsible for any tax liability associated with the Prizes. The Promoter shall have no further obligations other than the delivery of the Prizes and the payment of the tax on them as set out above.
7. DATA PROTECTION, PERSONAL RIGHTS
7.1. The provision of data in connection with participation in this Game is voluntary and based on the Player's freely given consent. The Player may request the deletion of his/her data at any time using the contact details provided in this section, but this shall not affect the lawful processing of data prior to that time. Those who participate in the Game acknowledge and expressly consent to
a) The Organiser as Data Controller and the Promoter as Data Processor to process the personal data provided for the purposes of contact and administration in connection with the Game;
b) The Organiser as the Data Controller will disclose the name of the winning Player on its website for the following purposes: to inform the winning Player of his/her win, in order to avoid the Player not being informed of his/her win because the message is not received.
c) by participating, expressly accept all provisions of the Rules of the Game in all respects.
The Organiser is the controller of the data provided. The data is processed by the Promoter on behalf of the Promoter as Data Processor.
The Data Controller shall manage and store the data of the Players processed for the purposes of the Game for 90 days after the closure of the Game, after which time it shall delete them from its records without any special notification. The Data Controller shall delete the Player's data before the expiry of 90 days after the closure of the Game in the following cases:
- the Winnings have been certified as received by the Player;
- the Player requests the deletion of his/her data before the expiry of 90 days.
In the first case, the Controller shall delete the Player's data following the receipt of the certified receipt, and in the second case, following the receipt of the request for deletion.
Processors have access to the data during the period of data processing by the Data Controller.
Data is stored electronically and on paper at the address of the head office of the operating company.
The personal data are known to the Organiser as Data Controller and to the Promoter as Data Processor.
7.2. The Organiser guarantees that the data will be handled in compliance with all applicable legal provisions.
7.3. The Organizer, as the Data Controller, shall provide the Player with the opportunity to request information about the processing of his/her personal data, request their deletion or correction at any time. In addition, the Player has the right to object to the processing of his/her personal data and the right to restrict the processing of his/her data. The Player may exercise the rights to information, 4
deletion, rectification, objection to the processing of his/her personal data and restriction of the processed data in accordance with the applicable legal provisions. The Player shall have the right to initiate an investigation by the National Data Protection and Freedom of Information Authority or to take legal action in the event of complaints or violations of his/her rights in relation to data processing. The Data Controller and the Data Processor shall act in compliance with the applicable legal provisions in the course of data processing:

Pf.: 223.; +36 (1) 391 4930; pursuant to Article 23(3) of the Infotv. the person concerned may also bring the action before the court having jurisdiction over his/her place of residence or domicile, at his/her option).
Players' rights in relation to data management:
- Access (information): the Player has the right to request information about the processing of his/her data, its purpose, the data processed, the possible transfer of processed data, the duration of processing, the rights of the Player, the possibility of legal remedies against processing, the source of the data, whether data is transferred to a third country or international organization and may also request a copy of his/her data.
- Correction: the Player may request the correction of incorrect data.
- Deletion (or forgetting): the Player may request the deletion of his/her data if they are no longer needed for the purpose for which they were collected, the Player withdraws his/her consent, objects to the processing, in case of unlawful processing. The right to be forgotten shall mean the Controller's action to delete the data disclosed.
- Restriction: in the case of a restriction, data may only be processed with the consent of the Player or for the establishment or defence of legal claims or important public interests, other than storage. The Player may request the deletion of the data if he/she disputes the accuracy of the data, if the data are no longer necessary for the purposes of the processing, or if the processing is unlawful but the Player does not wish to have them deleted, or if the data are no longer necessary for the purposes of the processing but the Player needs them for the establishment, exercise or defence of legal claims.
- Data portability: the direct transfer of data between data controllers or the disclosure of data to the Player may be requested in respect of data processed by automated means (by machine) on the basis of the Player's consent.
- Right to object: the right to object means that the data subject may object to the processing of personal data which are processed in the public interest or on the basis of a legitimate interest pursued by the Controller, unless the interest of the Controller in the processing is based on a compelling legitimate interest which overrides the interests of the data subject or is related to the establishment, exercise or defence of legal claims. The Controller shall not process the Player's data on the basis of a legitimate interest.
The Organiser and the Promoter shall ensure the security of the Players' personal data and shall take the technical and organisational measures and establish the procedural rules necessary to ensure the
proper protection of the Players' personal data. The Organiser and the Promoter shall treat personal data confidentially, and its data management principles shall be in accordance with the applicable legislation on data protection, in particular Act CXII of 2011 on the Right to Informational SelfDetermination and Freedom of Information (Infotv, and with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Regulation (EC) No 95/46/EC (GDPR).
7.4. Failure to provide the data will result in the Player being unable to participate in the Game. The Player acknowledges that requesting the deletion of the data necessary for the conduct of the Game prior to the delivery of the Prize will lead to exclusion from the Game, and that the delivery of the Prize will be impossible without the processing of the data.
8. MIXED PROVISIONS
8.1. The Organiser and the Promoter do not assume any liability for the quality of the Prizes, and the winner may, within the limits of the law, assert such claims against the manufacturer or distributor of the Prize. If the Winner does not collect his/her Prize within the time limit, he/she may no longer claim it from the Promoter.
8.2. The Promoter and the Promoter exclude their liability for any external attacks on the Sweepstakes platform and the server operating it, so-called SQL attacks, or attacks on the telephone network, or malfunctions. Thus, in the event that, as a result of an attack on the Sweepstakes platform or server or the server network, the Players receive incorrect system messages regarding their Prizes, their winner/non-winner status, etc., the Promoter or the Promoter shall not be liable in any way for such cases.
8.3. The Organizer reserves the right to exclude a Player from the Game with immediate effect if it detects or has reasonable grounds to suspect any (computer) manipulation, mass-generated e-mail addresses or any conduct incompatible with or in any way violating the spirit of the Game.
8.4. If the Player closes the browser window while uploading data or during the Game, or if the connection (for any reason) to the server's website is lost, the Organizer or the Promoter shall not be liable for any loss of data.
8.5. The Organiser or the Promoter excludes any liability for any malfunction of the Sweepstakes platform for reasons beyond its control, during which the website is not or only partially usable, but will take all necessary measures to detect and eliminate the cause of the malfunction as soon as possible.
8.6. The Promoter reserves the right to change the Rules at any time for any reason. The Promoter will publish the relevant information on the Sweepstakes platform with the same publicity as other announcements in the Game.
