anagement at the Open University have vowed to take the lessons from an employment tribunal ruling in favour of a former professor’s claim of unfair dismissal. The university is considering its right of appeal against the ruling at Watford Tribunal Court after the Employment Judge ruled in favour of Professor Jo Phoenix. She had been employed as Professor of Criminology by the OU from August 2016 until she was constructively dismissed in December 2021. The tribunal found that the OU failed to protect Professor Phoenix

from attacks by her colleagues for fear of being seen to support the claimant’s gender-critical beliefs. The tribunal judge ruled that Professor Phoenix’s claims of direct discrimination, harassment due to the professor’s gendercritical beliefs, constructive unfair dismissal, wrongful dismissal and of victimisation and harassment after she left the OU were all ‘well founded’. A ruling on compensation will be made at a later date. In a statement, OU Vice-Chancellor Professor Tim Blackman said: “We acknowledge that we can learn from this judgment and are considering the findings very carefully. We

are deeply concerned about the wellbeing of everyone involved in the case and acknowledge the significant impact it has had on Professor Phoenix, the witnesses and many other colleagues. Our priority has been to protect freedom of speech while respecting legal rights and protections. “We are disappointed by the judgment and will need time to consider it in detail, including our right to appeal.” Professor Phoenix was among more than 50 academics who in 2018 had signed a letter to The Guardian newspaper voicing concerns that expressed concern

about self-identification for gender reassignment. However, the letter provoked a hostile response from colleagues. In June 2021, Professor Phoenix established the Gender Critical Research Network at the OU, a research group focused on the importance of sexed bodies in different academic disciplines. However, more than 360 of her colleagues signed a public letter condemning the group and calling for it to be disaffiliated from the OU.
