Changing Your Gender Marker in Missouri

Background

Around August 5, 2024, without public notice the Missouri Department of Revenue (DOR) removed Form 5532 (a Gender Marker Designation Request Form) that was available to use in order to change the gender marker on your state issued IDs. With this process, a transgender Missourian could submit Form 5532 signed by their provider indicating the patient’s gender identity, and the DOR would print a new updated driver’s license.

Without this form, PROMO has been in touch with the DOR alongside coalition partners to gain clarity from their offices on the process still available to update gender markers on state IDs. As of now, there is NO clear policy at Missouri DOR for changing your gender marker We are attempting to provide the information we know, as it is still legal to make the change, just complicated. Volunteer attorneys and paralegals with STL Name & Gender Marker Change Mutual Aid, alongside similar organized groups in Springfield and Kansas CIty have been working tirelessly to assist people to make these changes. We are able to connect anyone to resources who needs it.

How to Navigate the Change

Under the revised process, you are still able to change your gender marker on your government-issued ID if you have had gender-affirming surgery (or a court order can prove you have) To do so, you will need to present a local license office with:

1 Medical documentation addressing that you have had gender affirmative surgery (often a physician’s letter), or

2 A court order declaring the gender designation, which indicates you’ve had gender affirmative surgery

If you are changing the gender marker on your birth certificate (whether or not alongside a name change), that process will streamline your ability to change your GM on your ID

To Get a Certified Court Order:

Unfortunately the current process is tedious There is not currently a document created to petition the court for the reason of changing your gender marker on documentation, so you will have to create your own

Documents you may need to gather to obtain a court order varies depending on your jurisdiction, but here is a full list of what you will potentially need::

● Confidential Case Filing Sheet (FI-05 / FI-10)

● Certificate of Completion, Litigant Awareness Program

● Petition & Judgment for Change of Gender Marker (self-created)

● Request for Publication After Judgment of Change of Gender Marker (self-created)

● Proof of “Sex” Change (Notarized Letter from Medical Surgeon)

● Letters to the Judge

● Requesting Waiver of Public Hearing, Sealing of Case Files, or Waiver of Publication

● Requesting Testimony

The typical process might look like the below:

1 Gather documentation for “sex” change

2 Draft your self-created petition materials

3. File your petition with the Circuit Clerk.

4 Once you have been given a case number and court date, you must return to the Circuit Clerk’s Office and file a letter requesting testimony

5. Attend your court date and receive your judgment.

6 If successful, your Certified Court Order will be mailed to you

Keep in mind the cost to file a petition in civil court can range between $100-$150 These may be waived by submitting an Application for In Forma Pauperis (GN10) If not waived, fees must be paid at the time of filing.
