I am submitting this application to supplement the criminal reports and exhibits submitted in Claim Number: 530161. Due to the ongoing criminal multiple theft of wages, criminal loss of all financial support due me via statutory tenure, and the ongoing multiple criminal income lynching and blacklisting, I cannot afford to resubmit duplicate copies of the criminal reports and exhibits filed with the above noted criminal justice agencies. In Exhibit 65, titled References, the criminal reports are posted and each one has the certified receipts verifying that the crimes were reported and filed with multiple criminal justice agencies.

Above all, the criminal reports and exhibits validate that my family and I have suffered beyond words from these federal and state crimes, primarily, multifaceted attempted murders, theft of wages, economic assassination, and conspiracy against rights crimes and the lack of regulation of such. Expenses covered are medical costs, mental health counseling, funeral and burial costs, and lost wages or loss of support. Crime victim assistance programs provide a range of services, including crisis intervention, counseling, The right to be reasonably protected from the accused offender.

Foremost, for the last 10 years my wages have been criminally stolen repetitiously due to documented law department criminal usurpations, summarized as a criminal and deadly conspiracy against rights headed by Regional Killer Jonathan Lippman criminal law department usurpations. I have earned NYS statutory tenured wages twice. Each time my wages were criminally stolen via criminal law department usurpations despite doing exemplary work protecting my income from such. Pursuant to the above crime victim protection clause, I seek the enforcement of one‟s right to be reasonably protected from the accused. This can happen by the enforcement of NYS crime victim protection loss of wages compensation. Regional Killer Jonathan Lippman has criminally stalked and executed every means of financial support I have and no one can live without income. The criminal theft of all forms of financial support is an attempted murder on one‟s life, particularly when the doing of such is in collaboration with the below terrorization crimes, harassment, and induced hospitalizations of both of my elderly parents.

Please see the elder abuse reference section attached as Exhibit 63. This exhibit shows how crimes have been inflicted on both of my elderly parents, as they are both forms of support for me. In addition, my secured tenured wages are needed so I can repay and help both of my elderly parents as they have become victimized, physically and financially, from these crimes for being a support system to help keep me alive.

These types of criminal insanity attacks on both my elderly parents to kill and or disable them from helping me and the replicated theft of statutory tenured income enjoining the NYS judiciary, epitomize the need for the crime victim‟s board‟s compensation plan and the need for executive and legislative intervention over Jonathan Lippman‟s repetitious criminal use of law departments to obstruct the laws of this country to create judicial jurisdiction to use the judiciary to attack me via replicated and advanced level obstruction of the rule of law to economically assassinate me.

I seek an end to Regional Killer Jonathan Lippman sending people to my home under defraud authority to threaten, set me up for a medical killing, harass, intimidate, retaliate and attempt to silence his crimes. As exemplified in the above audio, these people/criminals/cult members have used his criminal defraud authority judicial position as authority to obstruct justice, retaliate, threaten and intimidate me, a witness. They have inflicted egregious emotional distress on me. Again, the criminal evidence is in the above tape recordings.

An order of protection is needed and is requested to stop these economic assassination crimes and to stop Regional Killer Jonathan Lippman from sending more people to my house to harass, intimidate, retaliate and incite altercations for police pitting against me for documenting initiating evidence of his judicial disqualifications and no certified oath of office. Furthermore, I write this affidavit to document possible murder and retaliation crimes that may be inflicted on my elderly father who is still in a temporary nursing home behind these Regional Killers criminal law department and medical facility usurpation crimes and hits. I say possible premeditated murder because attached you will see Exhibit 64, this is a discharge meeting notice that I went to on June 4, 2010 on behalf of my elderly father.

The focus of the meeting was not on discharge to my fatherâ€&#x;s home. It was on preparations for additional induced hospitalizations under the disguise of premeditated medical problems. In summary, May 2010 my father was induced into the hospital via a miraculous food poisoning. I stayed with my father in the hospital over 8 hours. He was fine except for the food poisoning. Immediately after I left the emergency room, my father was criminally induced into critical care under the disguise of respiratory problems.

While he was home for the last 6 months and while I was in the emergency room with him, he had no respiratory problems. My father has never smoked. He lives a very healthy life style. In fact he is a natural medicine specialist, as well as a retired NYC Health Inspector. No one can or has explained these induced respiratory discrepancy phenomena that occur only while he is in medical facilities.

Again, he went to the temporary nursing home because of the need for physical therapy because the food poisoning induced hospitalization effectuated the disablement of his legs. His heart, lungs and organs are healthy. My elderly father has had no previous medical history of respiratory, heart, or any other problems other than the two times, recently induced hospitalizations over unexplainable and timely food poisonings.

Because Regional Killers Jonathan Lippman and Boyden Gray are trying to hurt me and their criminal law department and hospital administration crimes have not been regulated, they have used medical facilities via criminal law department orderings, to torture my elderly father. Please see Exhibit 63, posted criminal reports and exhibits regarding escalated elder abuse crimes and hospitalizations inflicted on my elderly parents since Regional killer Jonathan Lippmanâ€&#x;s criminal trespass as NYS Chief Criminal Judge.

Please note at this meeting, my father requested copies of legal papers that this nursing home had him sign. There is no telling what those papers entailed and whether my father signed legal papers under false pretenses as this is what these Regional Killers do, particularly since their criminal law department usurpation crimes have not been stopped.

If anything happens to my father, particularly while in the care of this nursing home in which Regional Killer Jonathan Lippman has previously criminally usurped control over the law department, than the record must show that it was a premeditated criminal plan. The meeting for my father was held as if a master retaliatory disguise plan is at hand and those legal papers my father signed and requested are part of the plan. I seek an end to such retaliatory and demonic planning.

This is how claim 530161 was criminally denied and this is how organized crime is inflicted throughout government from the top down. The law unit is criminally insane Regional Killers Jonathan Lippman and Boyden Gray and they are criminally ruling over agencies and public officials directing criminal practices under the disguise of the law unit counsel/order.

I seek an end to the criminal use of law units and departments to make decisions over Public Officials and qualified people holding respective positions. I seek an end to the criminal attacks I have witnessed when people do their jobs competently they are attacked and terminated and the judiciary is being criminally used to implement this criminal insanity obstruction of the rule of law crimes.

I seek an end to the above law department criminal usurpations where the Board‟s legal unit is making decisions for the NYS Crime Victim‟s Board, agency and staff and making such rulings in contravention to the NYS crime victim protection laws, criminally creating judicial jurisdiction not needed.

It is indisputable that my income/wages have been criminally stolen too many times. Please see Exhibits. 3- 97 There is no lawful reason why claim number 530161 was denied and there is no lawful reason for this application to be denied.

To this end, on behalf of Public Officer and equal protection laws of this country, I ask that each public officer entrusted with the power to enforce the crime victim protection laws of this country and New York State be allowed to do such free from Regional Killer Jonathan Lippman‟s criminal law department usurpations, ordered obstruction of the rule of law, and ordered retaliation against me.

I seek an end to these documented Regional Killer Jonathan Lippman criminal usurpations over law department crimes to attack innocent crime victims such as I. Dear Mr. Petrone: I write this letter with respect to the attached letter dated December 16, 2002 and given to me today December 18, 2002, while being forced out of the classroom for teaching effectively. The letter was given to me today right after instruction was maliciously interrupted again, due to ongoing contract violations, harassment and the malicious disregard of the education of the children.

The letter was given to me in direct retaliation to documenting and asserting constitutional rights against ongoing harassment, discriminatory practices, contract violations, and educationally unsound and malice based work conditions maliciously enforced on students and I, at Commerce Middle School.

The evidence exemplifies that these are continued pattern and practice of race based hate crimes, in that the education of these minority children has been disregarded and maliciously interrupted to facilitate and prioritize the harassment of yet another qualified and competent educator of color. The children and I do not warrant such continued unlawful treatment and practices. I have worked above and beyond the call of duty and respectfully request a reason for the harassing, discriminatory, and malicious disregard of law and the educational needs of the students.

Consequently, pursuant to Education Law 3031, I ask that your letter be rescinded and that I be furnished with a written statement giving the reasons for such recommendation.

I ask that your letter be rescinded based on the authority and law cited by the Commissioner of Education, in the Matter of Lubin, 24 Ed Dept Rep 271, 272,273, which states that: “ It is well settled that the Commissioner of Education will not set aside a determination of the board except upon a showing of clear and convincing evidence that such determination was rendered through malice, prejudice, bad faith, or gross error,�

The evidence, specifically documents, correspondence and educationally unsound practices, shows pure harassment, malice, prejudice, bad faith, and gross error enforced on the children and I, all to eradicate another qualified and competent educator of color. The termination letter in itself lacks a rational basis, demonstrates malice, prejudice, bad faith and gross error and is in violation of Education Law 2509. Moreover, harassment while pursuing statutory duties, specifically while teaching, is adverse to the legitimate interests of the school district.

Additionally, your letter includes a copy to the finance department. I truly hope that this termination is not additionally, in direct retaliation to my letter dated 12/16/02 outlining the fictitious statement and harassment in 33

the payroll administratorâ€&#x;s letters, inclusive of the letter of 11/22/02. The payroll department has stolen money out of my check and has falsified attendance records from last year.

It is within my constitutional rights to have these unlawful employment practices addressed and corrected.

I have been victimized by way of ongoing harassment and I ask that these unlawful practices stop. The termination letter further interrupted the education of the children by way of having seven people come to the school to intimidate, harass, and serve me. Moreover, this facilitated the ongoing denial of needed ESL instruction. I have informed all parties that the harassment was taped.

Despite all, I am a good educator, have provided the district with volunteer services and have worked above and beyond the malice based teaching and learning conditions maliciously enforced on the school this year.

The record and evidence speaks for itself. I am black and competent and this bothers a segment of people in powerful positions. The treatment enforced is in direct violations of The Equal Protection Clause, New York State Education laws, and Federal Civil Rights Statutes. This is a legal assault on the students right to a qualified and competent teacher of color and an assault on my right to work and live in the pursuit of happiness.

Despite the above, a Holiday Instructional Program and Festive, in recognition of student hard work, was scheduled for the children and parents of ESL, tomorrow December 19, 2002. I would like to extend an invitation to you, as your letter states that a recommendation will be made in the future to terminate services for unknown reasons. It is my hope that I will be able to continue to teach without being further harassed or harassed to death until this matter is resolved. Your swift response is greatly needed. Thank you.

Two weeks prior to termination I received a satisfactory rating, I tape recorded many of the harassment sessions by Mr. House. He did not follow procedure, I was never given a reason for the termination as evidenced in the documents and other data, A reason was created in retaliation to filing the law suit, No one deserves the public discharge that was enforced without reason, The children did not deserve the disruption in their educational program, etc, These are some facts that must be addressed whether procedurally or exposed otherwise. These tactics do not belong in education. They hurt children. They are the ramifications of contract violations and contract nonenforcement.

Moreover, the likelihood of a trial date in this matter is not viable for at least another nine months, and will of course entail increased legal fees and costs.

To this end, I ask that you consider the following settlement issues: 1. Reinstatement to the position with back pay, as I have no legal reason to be terminated. Probationary teachers with satisfactory ratings worked to the end of the probationary period, and acquire tenure pursuant to statutory law. I will not entertain Commerce law above Constitutional law. This will be a research based exposeâ€&#x; or I can be reinstated with all benefits entitled to.

OR 2. $20, 000 to the students in my ESL program for the disruption of the educational process. Payments to the students would simply state your child was awarded $1,000 in an award between Snyder v. Yonkers Public schools. Parents would sign off on payments in $500.00 increments and provide a receipt for educational expenses, to be mailed to the court and a copy to the plaintiff. The students deserve this. They became victims, because of the ploy to destroy me. The money for ESL students is available through your current 42

settlement agreement between the United States V. Yonkers Public School District. There are monies set aside for ESL instruction. The students Holiday and continuity in education were destroyed based on this matter and they should be compensated for such destruction beyond human control. They are not chattel.

They are children. The money is there. The receipts would document the educational use of the money.

This incentive will encourage children to study education. What better way to use education settlement money set aside for children. Please consider this.

AND 3.

I am not greedy. Make an offer that will make me walk away with the satisfactory rating earned and all benefits and emoluments due as an employee and a union-paying member. Please consider the point that based on the satisfactory ratings, tenure was expected. Make a reasonable offer that you would consider, separate and above the monies for the children. If we can jointly draft a discovery plan, we can jointly draft a settlement agreement.

In closing, number 2 and 3 above work together. This offer has nothing to do with the appeal on the union. Your written response is anticipated to each of the issues discussed in this letter. Thank you.
