Congresswoman Barbara Lee (CA-13), senior member of the House Appropriations and Budget Committees, joined President Biden, members of his Cabinet, and several of her House and Senate colleagues at the White House on Monday for the signing of the Infrastructure Investment and Jobs Act – legislation to invest $550 billion in the improvement of America’s roads, bridges, transportation, and more. California alone stands to benefit from billions of dollars in investment to improve highways and bridges, public transportation, and water infrastructure. Additionally, California will receive hundreds of millions of dollars to expand its electric vehicle charging network, protect communities from wildfires, and help provide broadband coverage across the state. This legislation will provide internet access for 545,000 Californians who currently lack access to broadband, and 27% of people in California will now be eligible for the Affordability Connectivity Benefit, which will help low-income families afford internet access. “(Monday), we celebrated a
monumental achievement by signing the Infrastructure Investment and Jobs Act, a transformational and long-overdue investment into America’s crumbling infrastructure,” said Lee. “After months of tough negotiations, the Biden Administration and Congress were able to do what the previous administration could not— work with both parties to bring our infrastructure into the 21st century. “For decades, underinvestment in our physical and social infrastructure has widened the economic gap, put communities at risk, and exacerbated racial inequality,” Lee continued. “We are now making progress toward addressing those challenges. Now, we move full speed ahead toward passing the rest of President Biden’s economic agenda, the Build Back Better Act, which will invest in childcare, address the climate crisis, increase access to affordable housing, and make other meaningful investments in the quality of life of American families. “I’d like to thank President Biden for his leadership on this historic legislation. I will continue working day and night to deliver relief to our communities and build back better and bolder for the people.”
On Tuesday Nov. 16 the Oakland City Council voted unanimously 8-0 to approve and enter into an Exclusive Negotiating Agreement (ENA) with the African American Sports & Entertainment Group (AASEG). After a year-long process, the “community first” Oaklandbased group will now have 18 months with a six-month extension option to buy the City of Oakland’s half interest of the Coliseum Complex. That was the life of people living with HIV in the early days of HIV treatment almost 30 years ago. Treatment and attitudes have changed a lot over those years. A revolutionary game changer of a long-acting injectable HIV medication is finally available for treatment. The treatment, a combination of two drugs, will be administered by a healthcare provider once a month. Already approved and used in Europe beginning in October 2020, the treatment was approved in the U.S. in January 2021. ‘Adherent treatment’ has been the key for persons to reach viral suppression, rendering them practically incapable of transmitting HIV through sex. As a vice president of engineering at Google, Croak (1955–) has led the company’s “service expansion into emerging markets, including managing the team which developed the initial communications technology for Project Loon, which uses balloons to extend coverage,” according to her bio. She also led the deployment of Wi-Fi across India’s railway system. Pioneering ophthalmologist and laser scientist Bath’s (1942–2019) work reshaped cataract surgery through the invention of a device and technique known as Laserphaco. She invented the Laserphaco Probe, a surgical tool that uses a laser to vaporize cataracts. Little of Croak’s early life has been documented. Born in Pennsylvania, she later grew up in New York City. She is known to speak highly of her father, who was “often an influence in her success in that throughout her childhood, he pushed her to pursue her passion for science through as many creative ways
as possible, such as building a chemistry lab in their home.” Croak attended Princeton University, later completing her doctoral studies at the University of Southern California, specializing in social psychology and quantitative analysis. She would join AT&T Bell Labs (1982), where she advocated for switching from wired-phone technology to internet protocol. Born in New York City, Bath’s curiosity about medicine was stirred during childhood; Albert Schweitzer’s service to lepers in the Congo piqued her interest. Bath received her medical degree from Howard University College of Medicine and completed a fellowship in ophthalmology at Columbia University. She completed her training at New York University, where she was the first African American resident in ophthalmology. Vaccination Protects Children From Dangers of COVID-19 By Nadine Burke Harris, MD, MPH, Special to California Black Media Partner
Our state experienced the most devastating point of the pandemic last winter. More than 21,000 Californians were hospitalized with COVID-19 in the last week of December, and we lost 18,518 mothers, fathers, sisters and brothers to this deadly virus in January. The light at the end of the tunnel felt out of reach. Today, we have the tools to help protect against another winter surge and avoid preventable hospitalizations and deaths: vaccines. More than 87 % of eligible Californians have received at least one dose, and the FDA’s recent authorization of the Pfizer vaccine for children ages 5-11 is a game-changer. For the first time, whole families, from our young kids to our grandparents, can have protection against COVID-19. As California’s first Surgeon General, I am committed to making vaccination available to every eligible Californian. And as a mom of four boys, I am reassured that by having my children vaccinated, I am doing everything I can to keep them, our family, and our community safe. The number of infections is increasing, largely in unvaccinated people, who are 9.5 times more likely to be hospitalized and 18.2 times more likely to die from COVID-19 than fully vaccinated people. People of color are being hardest hit. We need all eligible Californians to get vaccinated or complete their vaccination series and get a booster as soon as they are eligible to help bring this pandemic to an end.

As a pediatrician, I know how crucial vaccination is in protecting children against other preventable diseases like measles, mumps, and chicken pox. The COVID-19 vaccine, which is specially dosed for children ages 5-11, offers an essential layer of protection against this deadly virus. More than 700,000 children and adolescents in California have been infected with COVID-19. There have been more than 6,500 pediatric hospitalizations in our state since July of last year, and we have lost 37 young lives since the start of the pandemic. Children can experience “long COVID” and the virus can also cause Multisystem Inflammatory Syndrome in Children (MIS-C), in which a hyperactive immune system attacks the child’s body. Our state alone has seen 660 of these cases, half of whom had to be hospitalized in intensive care units. Vaccination not only helps prevent these troubling outcomes, but also reduces spread of the virus to our loved ones, such as grandparents and others with more vulnerable immune
systems. And as the state’s leader in efforts to train providers to identify and mitigate Adverse Childhood Experiences (ACEs) and childhood trauma, I know that the pandemic has taken a tremendous toll on our young people. They’ve struggled with social isolation, attending school virtually, as well as family stressors like job loss, food or housing insecurity, COVID-19 infections, hospitalizations and even the death of people they hold dear. Getting vaccinated provides kids a sense of security knowing they’re better protected and that they are protecting others from becoming infected, as well. It’s understandable that some parents still have concerns. I can assure them that the COVID-19 vaccine was demonstrated to be safe and highly effective in comprehensive clinical trials with more than 4,500 children ages 5-11, and is held to the same rigorous safety and effectiveness standard as all other vaccines in the U.S. In fact, the COVID-19 vaccines have gone through the most intensive safety monitoring in U.S. vaccine history. Millions of youth ages 12-18 have already received the vaccine with only mild side effects. Serious side effects are rare, and the benefits of vaccination are shown to far outweigh the risks. There is no evidence, either in clinical trial data or among the millions of women who have already received the vaccine, that it causes any fertility loss. In contrast, vaccination is allowing more of our state’s population to safely get back to the activities they love. Gov. Gavin Newsom Signs Executive California Reparations Task Force Looks at Long History of Order Supporting Healthcare Facilities By Aldon Thomas Stiles, California Black Media
Last week, Gov. Gavin Newsom signed an executive order allowing out-of-state healthcare workers to supplement staffing at healthcare facilities across California. The order is an extension of a statewide COVID-19 provision that also allows “certain medical personnel and emergency medical technicians to continue supporting the state’s COVID-19 response, including administering vaccines,” according to the governor’s office. Although 88% of Californians 18 and older have received at least one dose of the COVID-19 vaccine, cases are on the rise as California loses its top position among states with the lowest case rates. Newsom has raised concerns about cases increasing during the winter months. “COVID cases are beginning to rise -- winter months mean people indoors & more possibilities for spread. The unvaccinated are now almost 7 [times] more likely to get COVID, 10 times more likely to be hospitalized--and 18 [times] more likely to die. Keep your immunity up. Get your booster,” Newsom tweeted. The executive order allows health care facilities to use alternative spaces like parking lots to administer vaccinations. California health officials are encouraging any adult who wants a COVID-19 booster shot to get one as eligibility has been extended to all adults.
During a press conference on Nov. 10, the governor warned Californians not to become complacent. “It was around this time
last year that folks started to put their masks down a little bit and started to feel like we can spend a little time together outside of our households,” Newsom said. “We’re looking forward to all that, I’m looking forward to all of that, seeing friends and family. I just want to remind people to do it with some common sense and the kind of protections we’re here today to promote.”
Injectable HIV Medication Continued from page 2
Undetectable equals Untransmittable. It all leads to fewer people spreading HIV, helping to get to a global goal of no new transmissions. Although the injectable treatment is not for every person living with HIV, it is the answer for so many who struggle with adherence which can lead to a possibility of becoming resistant to the medication and failed treatment, thus unable to control their HIV replication. Darrell Ferrell, a 60-year-old African American substance abuse counselor who was diagnosed with HIV in September 1991, is considered a long-term survivor. Ferrell will be the first patient to receive the monthly injectable at his Lifelong clinic in Oakland. Ferrell says he was prescribed medication immediately upon his initial diagnosis in 1991, but at the time was in denial and afraid as he saw others take the early regimens and still die. In later years, he started a regimen but didn’t always adhere
to it, and at one time became resistant to the medication he was taking. He eventually started a different regimen of one pill a day, but always was challenged with staying adherent. “About six months ago, my physician, Dr. Ortiz, approached me,” Ferrell said. Ortiz was concerned about Ferrell’s struggle with adherence. “Because of my confidence in my doctor, I said ‘yes’ to the injection regimen.” For 28 days, he had to take the medication orally and received his first injection early this month. “The only side effects I had was some anxiety and soreness at the injection site that has since gone away,” Ferrell said. He looks forward to a life of taking fewer pills for his health, since he lives with other co-morbidities that require medication. The worry of adhering to HIV regimen is now gone. If you live with HIV and are having challenges, talk to your care provider. Take the pill burden away and live until there’s a cure.
Racism in American Agriculture

Last month, Lawrence Lucas, founder of the United States Department of Agriculture Coalition of Minority Employees (USDA-CME), testified before the California Task Force to Study and Develop Reparation Proposals for African Americans. Lucas said racism is the prime reason there are just a little over 400 Black farmers in California. “The income of Black Farmers has been drastically reduced and the amount of wealth that has been taken from Black farmers is tremendous,” Lucas said. “What you would call reparations, we call justice. It is why you must do what you have to do in California to right the wrongs suffered by Black people.” Lucas is not the only one concerned about mounting evidence that documents a long history of race-based discrimination in American agriculture. The United States Department of Agriculture recently created the Equity Commission (EC) to study racial discrimination and government policies that have disempowered Black farmers, depleted their wealth and nearly wiped out their presence for over 100 years. EC will advise the Secretary of Agriculture by identifying USDA programs, policies, systems, structures, and practices that created barriers to inclusion or perpetuated racial, economic, health and social disparities. tion within the USDA, which Lucas referred to as the “Last Plantation” during his testimony. The coalition also focuses its work on the historical loss of Black-owned land and how government policies deprived African Americans of generational wealth. The EC is expected to issue a preliminary report and provide “actionable recommendations” within the next 12 months, and a final report to be finished within two years. “The Equity Commission is taking important steps to dismantle barriers historically underserved communities have faced in accessing USDA programs and services,” said U.S. Agriculture Secretary Tom Vilsack in a statement issued on Sept. 24. Lucas said despite the USDA’s efforts to address decades-old discrimination practices, he does not see it “getting any better” for Black farmers. Non-Black farm pro-
ducers are fighting back in the courts, Lucas said. “You have white farmers, who own most of the land and get all the benefits from the land; they are the ones now bringing court cases around the country. They are saying that it’s discriminatory to have debtrelief for Black farmers,” Lucas said. The CME’s biggest accomplishment is its involvement in securing debt relief for Black farmers as part of the American Rescue Plan (ARP). The ARP package included a multi-billion-dollar fund for socially disadvantaged farmers throughout the United States. The coalition has worked alongside U.S. Senators Elizabeth Warren (D-MA) and Cory Booker (D-NJ) to create the Justice for Black Farmers Act, which will provide even more aid to socially disadvantaged farmers. NOTICE TO CONTRACTORS Sealed proposals will be received in the office of the Purchasing Division, East Bay Municipal Utility District, until 1:30 p.m. Wednesday, December 15, 2021 and will at that hour be publicly opened and read in the Board Room, Second Floor, of the District’s Administration Building, 375 11th Street, Oakland, California, for the BRIONES OUTLET TOWER SEISMIC UPGRADE – SPECIFICATION 2174. Work covers the seismic improvements of the Outlet Tower at Briones Reservoir located approximately 3 miles north of the city of Orinda and 8 miles northeast of the city of Oakland, California. Work includes: Underwater installation of temporary construction bulkheads and dewatering of upper portion of Tower; Installation of stainless-steel reinforcement strips on the inside the dewatered portion of the Tower; Installation of new District-furnished Hydraulic Power Units (HPUs) adjacent to each Tower valve (total 7); Routing of power and instrumentation cables from each HPU on the outside of the Tower to the base of the Tower and then along the bottom of the reservoir to the shore where they are terminated in a new control cabinet; Removal of temporary bulkheads, re-watering of the Tower and installation of debris catcher inside the flooded Tower. Estimated cost of this work is between $7,000,000 and $8,000,000. This project will require multiple trades and types of work; for example saw-cutting, concrete drilling, grading, excavation, fill, concrete, rebar, waterproofing, painting, structural steel, bolting, mechanical, electrical, plumbing, handrails, guardrails, ladders, gratings and railings, fencing, trucking, hydroseeding, paving, and other required work and trades. For additional description and information, see Document 00 41 01 – Bid Form, Document 00 41 05 – Description of Bid Items, Section 01 11 00 – Summary of Work, and the remaining contract documents. The District will conduct a pre-bid jobsite inspection tour to familiarize prospective bidders with the project site and conditions. The inspection will be conducted on November 17, 2021 at 10:30 a.m. Bidders/bid walk attendees (Attendees) shall comply with federal, state, and local public health orders in effect at the time of inspection. Attendees shall assemble at the Parking/Trailer Area identified on the Drawings after accessing the site from Bear Creek Road at the Oursan Trail Gate and traversing the dam. This is the only time that the site will be open for inspection. The interior of the existing Tower will not be open for inspection. The inspection will last approximately 1 hour. No photography by the Attendees will be allowed. The District will take photographs, as requested by the Attendees, restricted to the work zone. The District will release photographs to Attendees after the bid walk, pending review by the District. All Attendees are required to have a photo ID and sign a confidentiality agreement not to share, sell, or publish photos. The Prime Contractor and its subcontractors are strongly encouraged to attend the jobsite inspection where a “sign-in” sheet will be provided. Of the approximately 70,000 farms in California, more than 90% are white-owned or whitemanaged and fewer than 1% are Black-owned or Black-managed, according to the 2017 federal agriculture census. The 2012 census reported that California had 722 Black farmers. By 2017, that number had decreased to 429. Nationally, there are 45,508 Black farmers or 1.3% of all farmers according to the 2017 agriculture census. Their properties account for 0.5% of the country’s farmlands. In contrast, about 14% of all U.S. farmers in 1920 were Black, according to that year’s agriculture census. At the time, there were 925,708 Black farmers. Nearly all of them farmed in Deep South states. Lucas blames the USDA for the depletion of Black farmlands over the last century. However, the USDA says it is in the process of reversing
harmful policies and taking restorative action for programs that affected the progress, financial stability, and productive livelihood of Black farmers. “We are serious about our efforts to end discrimination across all areas of the Department and to improve access to services for key stakeholders,” said USDA Deputy Secretary Jewel Bronaugh in a statement. In March, the U.S. Congress passed a $4 billion debt relief program for farmers of color to address past discrimination in USDA programs. The debt relief program was passed as part of the ARP. It includes funding to pay off USDA loans held by 16,000 Black, Native American, Alaskan Native, Asian American, Pacific Islander, and Hispanic and Latino farmers. Claiming discrimination, a group of white farmers have filed a dozen lawsuits against the program including one class action suit. Preliminary injunc-
tions by three courts have momentarily blocked the program from issuing funds from the program. According to Khubaka Michael Harris of the California Black Farmers and Agriculturalists Association (CBFAA), “The debt relief was written in a way to help Black folks, but it is not just for Black folks. That’s why it’s in the courts. It was written where anybody who is a farmer can say, ‘Hey, I’ve been affected by COVID, too.’ Then, you are going to say that this money is just earmarked for Black folks? Now, the legislators have to go back to write in a language that targets underserved communities.” Based in Sacramento, CBFAA advocates for socially disadvantaged California Black farmers, and agriculturalists of color nationwide. Billion-Dollar Company Forcing West Oakland’s Attitudinal Healing Connection to Move By Zack Haber
ScanlanKemperBard (SKB), a Portland-based real estate development company, has ended a license agreement that will soon force Attitudinal Healing Connection (AHC), a Blackled arts education non-profit, to leave West Oakland’s American Steel Studios. On November 2, AHC received a notification from SKB informing them that December 3 would be the last day they’ll be allowed to occupy the space where they currently do administrative work and host classes. The non-profit’s leadership is frustrated with the timing of the forced move and the manner in which they say SKB is handling the situation. Over three dozen local businesses, non-profits, schools and individuals including Youth Spirit Artworks, Hoover Elementary and District 3 City Councilmember Carroll Fife have signed on to support AHC in their objections. “These kinds of businesses are coming in without any thought of community benefit,” said AHC Executive Director Amana Harris. “I feel like them giving us a 30-day notice during the holidays is unacceptable.”

SKB Principal President Todd Gooding said that after purchasing American Steel Studios in late September, the company needs on-site office space to manage $30 million dollars’ worth of demolition and reconstruction. It’s the first move in a project that will eventually transform the entire site into spaces for software and science manufacturing companies, high-end artists, and a few restaurants. AHC happens to be in the space Gooding says his company urgently needs to oc-
cupy first. “We’re not singling them out,” Gooding said. “The building they’re in is not very well occupied and it happens to be the first building that we’re going to start work on.” According to Harris, AHC had already been planning to leave American Steel Studios before SKB showed up. She thinks ownership of a space will offer AHC more stability and opportunity to thrive, so the non-profit started looking for a place to buy, instead of rent, about six months ago.
They found a spot they feel will work well, and they’re about to launch a fundraising campaign to purchase and renovate it. To ensure a smooth transition, AHC had planned to take a little over year with the campaign and renovations. Originally, January 2023 was their projected date to leave American Steel Studios. SKB has proposed a different plan. They’ve offered to pay to move AHC into a space in The Peralta Building, another nearby building the company has purchased. The space is around the same size the non-profit currently occupies and rental costs would be the same. “We bent over backwards to accommodate them,” said Gooding. But Harris disagrees as the forced move by December 3 interrupts the classes they teach and their fundraising work. “I feel like we’re being jerked around without consideration for the kind of work we do,” said Harris. “It’s mid-year and we’re in the trenches of our programming. Oakland Council Seeks Racial and Gender Equity in Hiring for City-Funded Construction Projects City held town hall meetings to hear experiences of local residents working in construction

The Oakland City Council is developing policies and practices to overcome barriers that prevent the hiring of African Americans and women on building projects that are funded by taxpayer dollars. The Council is beginning implementation of a recent report from the city’s Department of Race and Equity. The report was produced in response to a request of building trade unions for a citywide Project Labor Agreement (PLA) that would guarantee most city construction jobs to members of their unions. The Council voted in October to create a task force to gather community expertise to adopt new policies to promote equity in city-funded construction employment. The task force has not started yet, according to City Representative Karen Boyd. So far, 10 of 28 building trades unions have submitted data on gender, race and ethnicity of their members. Of the unions that reported, 2% of current trade union members are female and 5% are Black. To get to the present stage has already taken several years of intensive efforts by city staff, nonprofits and community groups who wrote the city report, “Improving the Effectiveness of Project Labor Agreements.” Some of the work that led to the final report included holding town hall meetings to hear opinions and concerns of people involved in the building industry: construction workers, representatives of the building trades unions, small contractors, and community advocates. The town hall meetings were held between June and September 2019, sponsored by the city’s Contract and Compliance Division and the Department of Race and Equity at five different locations throughout the city. The Alameda County Board of Supervisors voted this week to appoint Dave Brown as District 3 supervisor to replace longtime Supervisor Wilma Chan, who was killed in an accident two weeks ago. Brown, who previously served as Chan’s chief of staff, will serve the remaining 14 months of her current term in office. “As we continue to mourn the tragic loss of Supervisor Chan, I am extremely grateful to have the opportunity to continue her inspirational work on behalf of District 3 and all County residents,” said Brown. “Dave Brown is an excellent chief of staff, one of the best I’ve seen during my time on the Board of Supervisors,” said Board President Keith Carson during the hearing. “(Dave) will have the ability to continue to carry out the programs Supervisor Chan supported.” A staffer for Chan for 15 years, Brown has held the title of chief of staff since 2016. Prior to that, he served as senior policy advisor under Chan from 2013 to 2015. He has the distinction of being Chan’s first ever staffer 30 years ago and previously held the title of policy advisor/community liaison
(1992-1998) during her first tenure on the Board of Supervisors. In addition to his work with Chan, Brown also was chief of staff for former Supervisor Alice Lai-Bitker in 2001. A graduate of Stanford, Brown served on the West Contra Costa Unified School Board from 2004-2008 and spent 10 years as a fundraising consultant from 2002-2012. Brown has stated that he will not seek election to the Board in 2022 and by law is prohibited from running, as candidates are statutorily required to have lived in the district for a full year before an election. Having served as chief of staff for two Asian-American women elected officials, Brown supports the need for more Asian American /Pacific Islander (AAPI) representation – especially AAPI women. With no woman and no AAPI currently on the Board, Brown has pledged to endorse an Asian American woman for the District 3 seat in the upcoming June 2022 election. The District 3 supervisorial seat had been vacant since Wednesday, November 3, when Chan was killed when she was hit by a car while she was walking. By law, the Alameda County Board of Supervisors had 60 days to make an appointment to fill the vacancy.

One of the major themes were concerns about the “behavior and commitment of the building trades unions.” Community members said the unions, “(h) ave not been forthcoming with data on the racial composition of their membership” and proposed that “the city should not engage in negotiating a PLA/ CWA (Project Labor Agreement/Community Workforce Agreement) unless the unions are willing to change their stance around data on membership and their practices, which participants saw as barriers to employment for Black workers and other Oakland residents,” according to the summary report. ‘I don’t see Black people working on projects in Oakland,’ was a common comment by participants “(And) we have to
have more discussion and focus on the lack of Black presence in the development projects,” said another. Several people mentioned that past job-producing efforts have too often stressed entry-level jobs and not toppaying, journeyman positions. “(There is) too much focus on pre-apprentice and apprentices. (There) needs to be more focus and discussion on how to increase work for journey people.” Journey people generally have additional skills and licensing and are better paid. Some of those attending the meetings were concerned that the building trades unions function as a closed club. “The union behavior sounds like you are saying ‘I can set up a fraternity and only the people I say yes to can join.’ This should be enough to say no to a PLA,” said one speaker. Past agreements have required certain percentages of Oakland residents to be hired on jobs, but contractors have often
