Taking Duffus On

Dan Duffus cries overreach as the Seattle City Council moves to stop the building phenomenon he helped spur.

C

ity Council member Richard Conlin has a message for neighbors who are furious with developers building big houses on tiny backyard lots. “The heat is on,” he wrote to Tangletown resident Peter Krause in an e-mail last week.

In fact, Conlin has officially anointed the big house/tiny lot phenomenon (see our cover story, “Not in Your Backyard,” July 25) an emergency. He introduced emergency legislation that he says will address neighbors’ concerns until a permanent fix can be worked out. On Monday, in a unanimous vote, the council approved the measure.

Getting Testy

New Seattle Schools Superintendent José Banda is starting off saying he wants to go slow. That should play well to the many parents and teachers who felt former superintendent Maria Goodloe-Johnson charged ahead with her own agenda without stopping to listen. But Banda does have one thing in common with his predecessor.

He believes in “data,” which, as school started last week, he said the district would use in ever more sophisticated ways. It’s perhaps understandable why education technocrats have jumped on the data bandwagon. The idea conveys science and progress, a notion that what you’re doing is based on indisputable “evidence” rather than the latest teaching fad.

Unfortunately, the love of data is a fad in itself, as is its corollary—testing, lots of it—since data doesn’t come from nowhere.

Under Goodloe-Johnson, the district instituted the thrice-yearly MAP test—run by a nonprofit on whose board she sat—on top of the annual test instituted by the state. The tests have sometimes been almost back-toback, causing many teachers to grumble about losing weeks of actual instruction time.

Losing class time and making kids sit through a dubiously useful test, all so teachers can protect themselves—it’s a sad state of affairs.

Banda now says he plans to help teachers use the test results more productively. Eric Anderson, who manages research, evaluation, and assessments for SPS, tells SW the district is planning to expand a web-based “Academic Data Warehouse” it has been developing. The database currently contains MAP scores, and will soon include state test results. He says teachers will be trained to use the system— for instance, to see MAP and state test results

them to erect houses on lots that fail to meet minimum-size regulations. Most of these “lots” were not considered lots at all for decades, but were part and parcel of somebody’s back or side yard. But in some historical document— a tax record, perhaps—they are recorded as separate, small lots. If developers can find the records, the city usually will grant them a building permit.

Krause and residents of other neighborhoods affected by Duffus’ projects have been complaining to Conlin and other city officials for months. To neighbors, the projects are sunlight-blocking, privacy-invading monstrosities that ruin their bucolic backyard experience. To top it off, they are offended by the modern style of many of these new houses, which in their view don’t fit in with the historic character of their neighborhoods. By Monday morning, Conlin says, the roughly 160 e-mails and phone calls he had received were running seven to one in favor of his bill.

Conlin’s proposed ordinance would require lots, historic or not, to be at least half as big as required by the minimum-size regulation (5,000 square feet in single-family neighborhoods). And even some of those lots, if they fell below 3,750 square feet, would have a new height restriction.

Duffus did not return a phone call last week seeking comment. But an e-mail he

sent around the real-estate community expressed outrage: “This is the largest taking by City Council since the 1988 Small Lot Ordinance. . . . Who this will affect? Consumers who buy these homes. Builders who build these homes and most importantly, the Senior Citizens who currently own a majority of the current legal lots in the City of Seattle.”

Whether that will actually give teachers useful information is arguable, however.

Administrators like to say that all that testing, in particular with MAP, gives teachers a way to monitor kids’ progress throughout the year. But most teachers I’ve met don’t seem very interested in MAP scores, in part because they don’t know what’s on the test or how it aligns with what they’re teaching.

So why did many schools opt to continue with three MAP tests a year when they were given the option last year of ditching the fall test?

One teacher explained to me that his colleagues voted to do so because they were concerned that if they didn’t have test results from the beginning of the year, they couldn’t show progress by the end of the year. This is a newly important issue, because student test-score results are being incorporated into teacher evaluations (another fad). Losing class time and making kids sit through a dubiously useful test, all so teachers can protect themselves—it’s a sad state of affairs.

Bedtime Sonics

Described by SportsGrid as an “ironic coping mechanism for the zombified masses still in shock over the Sonics’ departure,” the e-book, which started making small Internet waves late last week, isn’t actually intended for children—though its brevity (32 pages), childlike illustrations, and rhymes involving Shawn Kemp dunks and Michael Cage’s Jheri curl may find an audience among old and young alike.

“I too relocated from Seattle, in my case a year and a half ago, after the ad firm I was working for closed its doors and I decided to seek other opportunities,” says Gall of his Seattle roots. “The fact is, it’s pretty sad that kids growing up in Seattle today will literally be asking their parents the question of who the Supersonics were and why they left,” he says. “I thought that I could create something that would be a nice way for parents to be able to take a trip down memory lane, through the good and tragic times, at the same time teaching their kids an important civic history lesson about what was among many Seattleites’ fondest memories—the Sonics.”

Living in Chicago, Gall says many basketball fans he talks to don’t know the facts about how the Sonics came to leave Seattle, and that even many real-life Sonics fans—himself included— may have suppressed some of the worst parts of the sad transgression. It’s part of what inspired him to take on the “children’s” book.

“People have short memories about what actually happened. I read a couple comments from folks who don’t remember that Kevin Durant actually was drafted by, or even played for, the Sonics. Some people actually think it was lack of fan interest that resulted in the OKC move.

Still others here in Chicago actually said to me that they didn’t even know the team had relocated, and that the Sonics still existed and were alive and well.”

And thus Mommy, What’s a Seattle Supersonic? was born.

“I decided to do a quick book that parents could read to their kids, complete with embedded highlight videos from YouTube, to help them remember, or learn about for the first time, Seattle’s most beloved sports franchise,” says Gall.

“A kids’ book also made sense because while I’ve written professionally for several years, I am an absolutely terrible artist, and I realized that anything I tried to draw would look like something a kid would do—so I thought maybe kids would relate to that a little better than something that was drawn with a more skilled hand.

“And I thought making the story into a linear tale that rhymed would be a fun way to explain the history of the Sonics in a way kids would enjoy and relate to. And if I got lucky, maybe a kid would even start to ask if they could hear about Shawn Kemp’s ‘Lister Blister’ dunk every night before bedtime.”

Pacific’s octogenarian mayor has Put his tiny town on the maP—for all the wrong reasons, say critics who are seeking his recall.

Here Comes Cy Sun

ust nine months after he defeated the incumbent mayor as a little-known write-in candidate, crusty Korean War veteran Cy Sun stands at the pinnacle of another stunning accomplishment: The 82-yearold and his 103-year-old town of Pacific could both go down the tubes.

Elected on a promise to clean up corruption in the bedroom community of 6,800, Sun is now accused in a recall effort of breaking the law and stubbornly mismanaging Pacific to the brink of collapse. The mayor calls such charges the ravings of opponents who have falsely accused him of lying about his war medals and cheered as he was arrested by his own police force for trying to enter a city office.

Sun insists his small town can be saved, and even councilmember John Jones, who ran against Sun for mayor last year, doubts rumors of the municipality’s imminent demise. Then again, Jones says, “Anything’s possible when you have a mayor who enjoys being disliked.”

When he’s able to hear such dislike, that is. The elderly mayor’s hearing is so bad—a constant ringing from a grenade explosion more than 60 years ago—that he’s unable to preside over city council meetings. At one recent session, when he announced he was turning over the gavel to a councilmember because he couldn’t pick up the discussion, some audience members laughed at his predicament. “Why is he even here?” asked one woman.

“I’m sorry I have this physical defect,” said the mayor, born in Makawao, Hawaii, to a part-Hawaiian mother and a Korean

father he never knew, and who speaks in soft, measured declarations. “I’m not afraid to hear your comments. I know all of you have a lot of comments. I received the documents for recall today. I favor the recall. I want the recall. I want the voters to decide. Now you think about it. I served my country.

This is why I’m here.”

Sun—sinewy, balding, and attired as usual in jeans, running shoes, and a ball cap—then walked slowly out of the council chamber with a steely gaze at the crowd, peering over the top of his bifocals. He moved with some pain, bearing the chronic aches of the grenade shrapnel he carries around. A machinegun slug tore out one of his kidneys, and a North Korean bullet is lodged near his spine.

Bent by age, he palpably bears the weight of his past and current wounds. His Capra-esque start as mayor has taken a Wes Craven turn—the write-in dreamer who could end up written off as the town nightmare. Some who mock him have provoked both tears and anger; after departing that recent council meeting, Sun’s eyes watered as he referred to the audience as “savages.” But he insists he enjoys a good fight, even if he seems to continually pick the wrong ones.

Since his election as leader of the sleepy town straddling the King/Pierce county line near Auburn (Sun got 464 writein votes to beat incumbent Rich Hildreth, whose 401 votes included 16 from the Pierce side of Pacific), the new mayor has fired or forced out all his department heads, including three police chiefs. Pacific’s insurance carrier, worried about

eanne Fancher, who covers city hall for her local blog, Pacific City Signal (pacificcitysignal.tumblr.com), says she was willing to wait and see how Sun performed in office. Today she’s seen enough. Sun—a former Boeing engineer and Oregon farmer with no political experience—was an unqualified candidate whom voters winked at, she feels.

“I think if the media had done its job prior to the election, finding out who the real Cy Sun was,” says Fancher, “we wouldn’t be here now.” The candidate issued misleading campaign material, getting names and details wrong in his claims of local corruption, she claims. His low-key doorbelling and write-in campaign is “a study on how a small town without its own news system can be bamboozled by someone who believes everything he thinks,” she says.

Don Thomson, the 66-year-old chair of the Committee to Recall Cy Sun, says his mission “is to remove Cy Sun before he destroys the city”—once farmland, now a residential suburb whose main intersection, Third and Milwaukee, consists of the city hall, a small grocery, and a church. “If we don’t get

rising liability due to the management vacancies, announced it would drop coverage at the end of the year, putting the town’s future in doubt.

At the same time, Sun was feuding with the city clerk, locking her out of her office. Sun was then locked out of the same office by the city attorney, who worried the mayor would tamper with documents. When Sun tried to physically force his way in, he was arrested by Pacific police officers, whom he tried to fire while they were cuffing him. The city council and police both issued votes of no confidence against him, with the cops asserting he’d improperly ordered them to investigate a political opponent who’d falsely claimed that Sun once bragged he had been Henry Kissinger’s personal physician and a stand-in for Hawaiian nightclub star Don Ho. Subsequently, one councilmember, ex-Marine Gary Hulsey, publicly challenged Sun to prove he’d earned his war medals. When the mayor did so at an emotional public ceremony where he presented medal citations, the councilman privately apologized. Hulsey was then himself outed when news spread that the councilman had never informed voters he was a convicted murderer.

Sun was also suddenly being pursued in civil court by a woman who accused him of molesting her more than four decades ago when she was a teenager, even though her family had previously sued him and lost. The Aug. 1 lawsuit made a splash on TV and in the papers, and rocked Sun on his heels.

(What has made hardly a ripple in the news cycle, however, is the fact that the woman has now quietly dropped the suit.)

His detractors call him America’s most cantankerous smalltown mayor, a time bomb in the town a California real-estate huckster founded a century ago, naming it Pacific because it appeared so peaceful. “Cy has turned everything around for the worst,” claims ex-mayor Hildreth, who feels the balanced budget and rainy-day reserve he left behind is now in a precipitous dive under the new mayor. “Personally, I think it’s just stubbornness, not any kind of rational strategy” that drives Sun, Hildreth adds. “People who have a tendency to distrust government are going to fall for his claims of corruption. None of the stuff he claimed holds water.”

Hildreth feels his mayoral career was torpedoed in part by opponents who launched a campaign website called anybodybutrich.com, which is still in existence. The site didn’t endorse Sun, but echoed his complaints, citing instances of “the apparent unchecked petty corruption of Mayor Hildreth,” including his alleged misuse of a city credit card—charges of which Hildreth was cleared.

Sun has his dogged admirers, though they may be dwindling. Kevin Cline, for one, thinks Sun is just the disinfectant Pacific needed. “He is brutally honest and doesn’t try and sell a load of crap as a brick of gold,” says Cline, 30, a single father who runs a temporary labor business and lost his bid for a city council seat last year. “He raised no money and made his own signs. His strategy consisted of knocking on every door and handing out a poorly written but heartfelt plea to support him as a write-in. The rules say he shouldn’t have won.”

Just wait, Cline adds: “History will vindicate this man just as it has others who, like Cy, were willing to stand alone for what was true, right, and just.”

him out of here by December, we won’t be a city,” adds Thomson, a retired military veteran who, with his wife Shirley, volunteers to deliver meals to local seniors.

He’s usually good-humored, but Sun’s antics have gotten his dander up, he says. He took to attending council meetings, where he regularly stands up and asks the mayor to do the right thing and resign—or sometimes just tells him “You’re fired!”

Thomson thinks Sun invited the misery he endures. “The biggest enemy he has is himself,” says Thomson, citing the mayor’s tendency to slash projects and city staff without understanding the consequences. Adding up the cost of legal claims (already more than $2 million), project overruns, grant penalties, and city-hall understaffing, Thomson calculates, “It’s estimated that for every 25 cents the mayor claims to save, it’s going to cost us $3.”

Robert Smith, former Pacific councilmember, news reporter for the old Auburn-Globe News, and a next-door neighbor of Sun’s, says voters weren’t fickle in voting for an unknown to lead them, “they were outraged” over years of municipal ineptness. “But Cy blew it,” Smith says. “He turned out to be another symptom of the disease of Pacific. It’s inbred here. The only solution now is you let the town go out of business, unincorporate, and let someone come in who is not tainted.”

Removing Sun won’t solve all the problems, Smith adds. After he read that some recallers were vowing to “take back Pacific,” he went straight to his blog, speedtrapcity.blogspot. com, and responded. Restoring the halcyon days of life in a small town was commendable, he thought. But surely no one wants to take back “a government that racially profiled; used motor-vehicle ticketing as a revenue tool . . . [and] conducted a police raid on a local church in pursuit of a youth who was skateboarding in the city park,” he wrote.

“Mainly it’s because there’s corruption, the same if there were an enemy outfit in there. I want to attack it.”

Sun’s Pacific blitzkrieg has been memorable handto-hand combat, with such caught-on-tape action sequences as his fighting his way through a web of police tape to get into a city office.

If his eight-month saga were a war movie with a message, it would star Slim Pickens as the wa-hooing mayor, seemingly riding his own Dr. Strangelove bomb to oblivion.

“It is very clear that Mayor Sun is a profound believer in the ‘my way or the highway’ theory.”

He cited one past public official who was stopped for DUI, failed a polygraph examination on whether he’d threatened his wife’s ex-husband with a handgun, threw tantrums at city-council meetings, and told probationary city employees to view porn with him on city time. “You can’t possibly want back a city that tried to suppress a civil-rights march protesting police misconduct,” he said. “You folks can’t possibly want that restored.”

Smith and others agree that Sun took wise political advantage of a timely distrust of city hall and higher taxes with his mostly unproven claims of corruption, as laid out in flyers he distributed. His only real campaign appearances were made door-to-door as a kindly old man vowing to clean up Dodge. No

one seemed to know what specifically he had in mind—Sun included. The mayor admits that voters likely didn’t know whom they were electing, and his action plan basically consisted of just throwing the rascals out once he identified them, he says. “I’m not a politician. If I say I’m going to do something, I’m going to do it.”

As things turned out, “it” was a plan to paper Pacific with pink slips. As a political neophyte, Sun skipped the typical new-mayor honeymoon period of learning the ropes and tinkering with change. Instead, he charged into city hall much as he’d gone at the enemy on Heartbreak Ridge: firing away, sending three top managers packing in the first month.

He makes clear that his mayoral strategy is influenced by his compelling experience as a grunt with the Army’s 23rd Infantry Regiment, including the 1951 battle of Hill 851 on Heartbreak Ridge in Korea, a war in which Sun quickly rose to master sergeant and won the Silver Star and the French Croix de Guerre.

“I went through hell and back,” he says in a chat in his newly launched “Control Room,” a converted conference space where Sun writes his thoughts on a whiteboard. He rises several times and maps out how he came from a rear position for several attacks, in one of them cradling a machine gun in his arms with the cartridge belt draped over his shoulder, mowing down a field of enemy soldiers. “I did that and I’m going to sit around and watch this corruption go on? Now you tell me that I’m gonna let it go on after I went through that. And I’m going to live in the same kind of mess—dirt and filth? Hey, wake up. I’m not gonna do that. As long as I’m breathing the air, I’m not going to be a hypocrite.”

He volunteered for the Army at age 17 in Hawaii, just as he volunteered for duty at age 81 in Pacific. He wanted to be a leader, he says.

As mayor he’s paid $750 a month, a salary he returns to the city because it needs the money more than he, Sun says. Yet why endure this war—much of it self-made—for nothing?

“It’s hard for me to understand myself,”

lush with a 63-vote victory he considered a mandate (though, due to low turnout, he was elected by just 18 percent of the town’s registered voters), Sun in January canceled a contract to purchase five new police cars, opting instead for four. City Clerk Jane Montgomery says in a sworn statement that she and city Finance Director Maria Pierce were told by Sun not to tell the police chief. When Chief John Calkins heard the news at a council meeting, he blew up, shouting at Pierce. (Fancher reported in the Signal that “they were practically nose-to-nose. Ms. Montgomery stepped between the two, telling Calkins he needed to talk to the Mayor, not to Ms. Pierce. Someone told someone else to ‘shut up’ ”). Sun then put Calkins on paid leave, and four months later fired him for berating city staff. The ex-chief is appealing his dismissal, and a civil-service decision is due shortly.

Sun was supported by those who said Calkins had abused his power. But for Montgomery and other city employees, it was the first tip-off that the mayor would do things his way. As eight of the city’s nine police officers would later say in a statement of no confidence after the mayor interfered with one of their investigations, “It is very clear that Mayor Sun is a profound believer in the ‘my way or the highway’ theory.”

That was what city Building Inspector Roger Smith felt, too, after the mayor ordered him, without explanation, to stop issuing permits. Smith said he felt harassed and went on medical leave, and has yet to return. Shortly before Sun took office, Public Works/Community Development Director Jay Bennett resigned, saying Sun had promised to fire him anyway. He has yet to be replaced.

In February, Sun ordered the police department to halt an investigation into who had sent a letter to the city containing court copies of the murder conviction of councilmember Hulsey. At the time, Hulsey and Sun were at loggerheads over the validity of Sun’s war medals. Sun was worried that the name of the alleged letter-sender would leak out. She was one of his supporters, and on her anonymous letter had used a fake return address—the home of Rich Hildreth, the incumbent mayor Sun defeated—making it appear that Hildreth had exposed Hulsey’s record.

The court papers detailed how Hulsey, a Vietnam veteran, had stabbed his wife to death in Whatcom County in 1978. He pleaded not guilty by reason of insanity, was convicted of

second-degree murder, sentenced to 20 years, and paroled after eight. The conviction was unknown to voters, who have elected Hulsey twice since 2007 Sun, according to sworn police testimony, told his officers to tell the alleged sender she was not being investigated, and said they shouldn’t pursue an investigation because the woman was schizophrenic. The mayor gathered three of the officers in a training room and, using a whiteboard for illustration, lectured them about schizophrenia, they said, noting he had once taken a class on the topic at the University of Tokyo given by a Nobel Prize–winning instructor. He also told the officers, according to acting chief Lt. Ed Massey, that they were violating the woman’s constitutional rights. She could sue the city for $5 million for such violations, and he would be a witness against the police in such a lawsuit, Sun said. Massey refused to comply with the mayor’s orders, and notified the State Patrol and Postal Service inspectors.

They subsequently determined that no crime had been committed by the sender.

Sun’s scorched-earth takeover made headlines, and the townsfolk took notice. “Used to be, the biggest news in Pacific was some kid ran his horse down the main street and got a speeding ticket,” says Fancher. But today’s headlines aren’t unprecedented.

After its historic farmlands were overrun by real-estate developments in the 1970s thanks to the creation of a new valley-wide sewage system, a growing Pacific notched one of its first town scandals: the 1975 resignation of two-term mayor Jack Johnson in the wake of several police-brutality incidents. Police Chief Ron Earwood resigned later that year, saying he was taking a better job elsewhere. And in 2008, then-Chief John Tucker, wearing a souvenir Chicago Police Department T-shirt that recalled the 1968 Democratic convention head-busting with the emblazoned words, “We Kicked Your Father’s Ass, Now It’s Your Turn,” was stopped for drunk driving in Bonney Lake. He beat the rap in 2009, but has been a controversial figure since, earning the first pink slip handed out by Sun this year.

Soon after Sun took office, councilmember Gary Hulsey was outed as a wife-killer.

Word of the letter leaked, however, and the 64-year-old Hulsey—who plans to retire after this term—spoke for the first time of the murder at a council meeting, telling the public and reporters he was likely suffering from post-traumatic stress disorder when the slaying occurred. He later told CNN that in 1978 he was drinking a fifth of whiskey daily and, awakening one morning, found his wife dead with his knife in her chest. He called police and said, “I think I just killed my wife, I don’t know.”

Effectively, Sun’s letter-writing supporter had outed Hulsey, and Sun had forced Hulsey to apologize for questioning his war medals after the Auburn Reporter printed supporting evidence confirming he’d earned the medals. (Seattle Weekly has obtained additional documents corroborating Sun’s claims.) “I am not a liar,” an emotional Sun told an audience of 75 who gathered to hear his nearly hour-long medal speech at a local gym. “I’ve been to hell and back.”

Meanwhile, the war went on at city hall. In a sworn statement, City Engineer Jim Morgan says that, though on the campaign trail Sun had praised him as “an asset,” Sun told him at their first sit-down meeting, “You don’t know shit.” The mayor was so aggressive and profane, Morgan says, that he came to work with knots in his stomach, and eventually resigned (the job remains vacant). n March, Sun decided to create his “Control Room,” telling employees he was taking over city hall’s conference space for his clean-up-corruption mission and ordering a crew to throw things out.

Associate Planner Paula Wiech had used the space for Planning Commission and Park Board meetings.

In a sworn statement, she says she determined that posters and maps had been haphazardly tossed out, some landing in a Dumpster, and that irreplaceable historical documents possibly went missing.

At the same time, Sun told Wiech he was changing her job duties, and later ordered her not to get involved in public-works and environmental issues. It was the start of another feud similar to those Sun was already carrying on with the police department, the city clerk, and the city council.

The resignations continued in April.

Finance Director Pierce bailed, citing a hostile work environment. Resentment against the mayor was boiling over, resulting in the distribution around town of a 10-page pamphlet asking, in large bold type, “Who Is The Real Cy Sun?” Written anonymously, it was sent to newspapers and TV stations, which did not report the undocumented claims.

The pamphlet recounted the city firings and resignations; allegations about Sun’s messy divorce from his first wife 40 years ago; and a series of alleged lies Sun had supposedly told neighbors in the town of Echo, Ore., where he operated a horse ranch. Besides the Kissinger and Don Ho allegations, the pamphlet asserted that Sun had told people he was the only farrier allowed to shoe Triple Crown winner Secretariat. The material included alleged pictures of the ranch, showing a small, inactive farm rather than the large stables he allegedly claimed to operate.

Sun called the pamphlet a fabrication, and

It was dubbed the case of the “Echo Papers,” according to police documents. In his order to Acting Chief Massey, Sun said police should undertake a “discreet” probe of who had trespassed on his Oregon property. He said a polygraph test should be given to whomever was behind the “conspiracy,” and that the local sheriff’s department of Umatilla County, Ore., should also be investigated, “if they were involved.” Massey’s finished report “shall be comprehensive and complete, and could be submitted in a Court of Law,” Sun wrote in his two-page order.

Massey balked at undertaking what amounted to a secret investigation of the mayor’s political enemies. Later that day, the lieutenant received a second letter from Sun: “Effective 3 p.m. of the above date, my confidence in you as Acting Chief of Police was a misjudgment. Therefore, you are immediately removed from Acting Chief of Police and shall have no command authority.”

The next day, Massey and seven other officers signed a letter of no confidence against Sun, citing his interference in investigations and failure to name a permanent chief, as well as his demoralizing method of dealing with officers. The letter was given to the city council, which then issued its own no-confidence vote, citing the mayor’s “outright misinformation and lies,” his elimination of every Pacific department head, and his bungling of several city projects, including one that could cost the city $700,000 in forfeited payments. Turmoil in the police department was also contributing to a rise in crime, new statistics indicated.

One department member, Sgt. Jim Pickett, did not sign the cops’ no-confidence letter. By the end of the day, he was Sun’s new Acting Chief of Police.

In May, Sun issued his first, and to date only, monthly newsletter, claiming his job eliminations had saved the city more than $222,000. (He has fired or forced out about a dozen of the city’s 20 full-time staffers.) His reward, he wrote, was “a unanimous vote of NO CONFIDENCE! “Give me some slack!” he said in the letter to his constituents. The situation has caused “an agony, shame, and depression that penetrated both my wife (deeply) and I. I’m worried about my wife’s mental health.” How long, he wondered, “am I able to endure?

Because I’m 82 and the mental (stress caused by all the political intrigues) condition of my wife, I have my reservations.”

As for all those empty departmental positions, he says, “From what you’ve read [in the news media], you’re thinking ‘Who is the Public Works/Community Development Director and Engineer for all the on-going projects?’ The answer is: ‘I am!’ Your $750 a month mayor —for now!”

Sun then devised a plan to solve the backlog of building-permit applications and other city business by hiring consultants, including political backer and three-term ex-mayor Howard Erickson, as building and code-enforcement officer. That move was aborted when the Teamsters Union said such a hire would violate the city’s labor contract. It turned out that both Sun and Erickson were signing off on building permits, though neither was authorized to do so.

Hearing this, City Clerk Montgomery notified the city attorney and the city’s insurance carrier. The attorney, Ken Luce, informed Sun that his actions were unlawful and said the permits he signed were invalid.

Montgomery says she then discovered that Sun had taken Public Works files to his home. After being brushed off by Sun when she questioned the file removal, Montgomery filed a whistle-blower’s complaint against the mayor, accusing him of a litany of violations, including removing, destroying, and attempting to alter city records.

Sun called Acting Chief Pickett and said he was going to fire Montgomery—even though such an act could been seen as retaliation against a declared whistle-blower—and ordered the chief to deliver her a dismissal notice. Attorney Luce told the mayor and chief not to do so. Sun did what he thought was the next best thing: He had a lock placed on more Montgomery’s online city-hall door so she couldn’t enter. Luce then had police cut off the lock. Officers also stood watch during the week to assist her.

In a resignation letter, he told Sun, “I sense that I am being drawn toward a pit of unethical behavior.” He also recounted how he’d informed Sun that a councilmember had claimed a “possible federal investigation” was looming “into questions related to your identity.” According to a rumor among Sun’s detractors, there are questions about his true name and birth date, though SW has obtained his birth certificate from Hawaii (shades of Obama), which show he was born Cy Sun on Jan. 26, 1930 at 4 a.m. He also goes by Herbert Cy Sun, which he says is a first name he picked out just because he liked it.

Sun wanted to know more about the ID probe and was upset that Pickett wouldn’t provide details, including the identity of the federal agent. Sun told Pickett he no longer trusted him, and Pickett then stepped down.

The third chief to resign within six months, his departure has left the police department, to this day, with no leader.

n July, Pacific’s insurance carrier notified Sun and the council that because of administrative vacancies and questions about the city’s financial condition, the carrier would cancel Pacific’s insurance coverage on Dec. 31. That situation remains unresolved, and further erosion of Pacific’s fiduciary stability could lead to additional problems, including bankruptcy and the dissolution of the city, councilmembers and others warn.

He calls the suit politically motivated, and wonders how he can be sued over the same issue again. And Sun has a point: On Aug. 30, attorneys for Carbaugh voluntarily dismissed the suit “without fees or costs to any party.” The suit was dropped after attorneys learned it effectively sought the same relief as the family’s 1970 lawsuit, “and you can’t sue someone twice for the same reason,” said an attorney familiar with the case, who asked not to be named.

In a statement released to SW, Carbaugh said: “When I was a young girl, I was unable to tell the full truth of what happened to me because I was scared and did not want my parents to feel guilty for what happened to me. The law is still evolving to protect people like me, but I hope I have given a voice to other survivors of child sexual abuse who have not yet come forward.”

Meanwhile, a week earlier, the recall was moving forward. At an Aug. 23 press conference on the city-hall lawn, Thomson, chair of the Committee to Recall Cy Sun, unveiled the statement of charges in a 200-page book.

Thomson then drove to the King County Elections office to file charges, claiming Sun was guilty of malfeasance and violating his oath of office. The charges include claims from a city worker who reported that Sun had said he was “conducting surveillance” on the city clerk’s home, and that Sun had photos in his office showing the clerk and another city employee outside the clerk’s residence.

If a judge’s review determines there is sufficient cause for a recall vote, petitioners have six months to gather about 400 signatures to qualify the measure for the ballot, although Thomson hopes the issue will come before voters in the November general election. “We think it can be done by then,” he says. “People are excited to sign.” The drive will cost at least $15,000, most of it covered by local donations.

Cline, the council candidate and Sun supporter, thinks the recall will prove just how strong the mayor is. “He hasn’t quit yet, when lesser men would have,” says Cline.

fter the Aug. 27 council meeting, the second time that Sun had handed off his presiding duties due to his chronic tinnitus, councilmember Joshua Putnam posted his thoughts on Facebook.

He wished that, rather than being forced by a majority council vote to turn over the meeting to mayor pro tem Jones, Sun could have been allowed to stay and be assisted by a councilmember.

“We really could have used the Mayor’s presence, at least to hear if he would in fact sign various agreements he was being authorized to sign,” Putnam said. “I understand there’s plenty of opposition to the Mayor and what he’s done to the City so far this year, and there’s well-grounded fear the City may collapse at the end of the year when our insurance runs out. But the fact is, whether you like him or not, Mayor Sun is the Mayor at the moment . . . I don’t see the harm in letting him delegate administration of Council meetings to a Councilmember.”

After Sun left, city attorney Luce suggested the council seek a court order forcing the mayor to fill city management positions. Luce also said that police and civil-service staff vacancies could be advertised immediately.

With the sounds of tintinnabulation and audience laughter ringing in his ears, Sun was getting out of his car at his home a few minutes after leaving the meeting that night when SW caught up with him.

“They were very, very vindictive; they’re mean, they have no respect for human rights.

Savages,” Sun said, his voice wavering and his eyes tearing up. He unloaded papers from his Volkswagen bug, one of three he owns and tinkers with. “The audience, the council, they want to see me go down.”

A few blocks from city hall down Milwaukee Boulevard, Sun sat at his dining table in the modest, well-kept home and told his wife Barbara he got a “very bad” reception tonight. “The council voted that I will handle the meeting. And you know if I handle the meeting I can’t hear good, I’ll make a fool out of myself, and I handed it over to the mayor pro tem, and I left. You see, what the council wanted to do was to degrade me. Maybe I should take off my clothes and let them see all my scars and my operations and all my pockmarks from the shrapnel.”

“They’re trying to force you out,” Barbara said. “But it isn’t the whole community.”

Sun wasn’t sure. He’s heard some people still doubt his war medals, and remembers the stranger who walked up to him in February and shouted, “You’re a disgrace!” At the table, he pulled out a letter he’d recently sent to U.S. Senator Daniel Akaka of Hawaii, asking for help documenting his Distinguished Service Cross, for which he doesn’t have papers. In the letter, he laments to Akaka: “It

Thomson’s 200-page recall document was sitting near Sun on the table. “I don’t want to do anything about it,” the mayor said, waving his hand. “I’m not going to court and drag it out. I want the recall [vote] to occur.”

He paused and his wife sat quietly as he weighed his thoughts. “I got so much language in my mind that sometimes I got to sift things out before I make a statement,” Sun said, tapping on his head. The ringing compounds that: “Sometimes it’s so loud, I get dizzy,” he says.

The recall charges are only allegations, Sun concluded. “They’re not proof of anything.”

He leaned back and began talking about an upcoming Army reunion, where he planned to meet with two of the three other surviving members of his Korea regiment. “Here’s the way I think. You can see by the way I thought in combat. I never make a move until I know how to make it. I put all the forces together and I take the least resistant route, and do the best I can, the same as I do all my life.

“I never backed down,” he added. “You take a guy who runs up the hill and kills everybody in combat. You think he’s going to give up? I’m going to let them say all they want to say, and let them do all they want to do, and I’m going to let the people decide.”

trying to enter the clerk’s locked offices, then firing the police officers who took him into custody. The July 19 arrest—Sun, a locksmith at his side, charging into police tape and the arms of officers, then scolding them for hurting him as they applied handcuffs—was captured on video that was picked up in news reports around the nation. Police had been told by attorney Luce to prevent the mayor from entering the offices, as he was now under preliminary investigation—at the council’s request—by the King County Sheriff’s Office for possible destruction of public records.

Sun thinks it’s his police department that should be investigated, tending to view police troubles as corruption. “My arrest was a corruption,” he says. “How can I be prevented from entering offices in my own city hall?”

It’s a question that continues to hang in the air: There is no conclusive evidence he has destroyed any records, and the advice given to police to arrest Sun was arguably as much political as legal.

Having already tried to fire four cops (the city attorney told them to return to work), Sun then fired Montgomery, saying she failed to follow his orders. He also blamed her for “causing me to be arrested by Pacific Police [and] causing damaging nationwide news media coverage for the City of Pacific.” He told her in a letter that should she refuse to attend a Loudermill hearing—a kind of show-cause hearing at which government employees defend their actions, and which in this case would be presided over by Sun himself—“your DISCHARGE is final.” When Montgomery showed up for her hearing, however, she found the door locked and saw Sun running out another door, according to her sworn statement.

Montgomery later filed a $2.2 million damage claim with the city for wrongful discharge.

Loudermills were also required for the four fired officers; Sun, however, called an immediate end to the hearings the moment the four officers’ attorneys began to speak, claiming, incorrectly, that they were not allowed to talk.

The mayor said he considered the officers’ actions “mutiny and anarchy,” and wrote the governor and attorney general, asking them to send help. They did not respond.

Wiech, the associate planner, also filed a whistle-blower’s complaint against Sun in August, claiming he had destroyed records and improperly signed permit applications.

“He suggested taking grant money earmarked for other purposes, and lying about what we actually used them for,” she said in her complaint. She also said the mayor told her that his “phone was bugged, but the FBI was on his side.”

As if the city-hall battles weren’t troublesome enough, the mayor was suddenly hauled into civil court by a 57-year-old woman who claimed he’d molested her more than 40 years earlier. Kathy Carbaugh, now of California, lived with her family next door to Sun and his family in Fife Heights near Tacoma when he began sexually abusing her at age 14 for a year and a half, she claimed.

It wasn’t a new accusation: Sun, who was never criminally charged, had been sued by her family in 1970 for $10,000 in damages for the humiliation he’d allegedly caused, but they lost. Sun countersued for defamation— noting that the family had also claimed he’d raped Carbaugh’s mother—and won.

Sun insists the charges are as untrue today as they were proven to be decades ago. After he won his countersuit, Sun adds, Carbaugh’s

Vashon Island’s UMO Ensemble is anything but a straight theater company. Using grotesque costumes and broad gestures, its members practice a French-derived brand of “buffoon theater” in which fools mock their betters—and us in the audience, too. UMO’s new show, Maldoror, is based on writings by the 19th-century French poet Lautréamont, about a nihilist who despises and forsakes mankind. Mr. Maldoror opposes God, polite society, and conventional morality. He’s a dark Romantic figure in the tradition of Milton and Shelley, one who burns his angry candle at both ends. Indeed, Lautréamont died at 24, and the 1869 Les Chants de Maldoror was his only work, later taken to heart by the Surrealists and the Dada movement. There was no plot—it’s more a rant or manifesto of malign intent.

For a certain kind of baby boomer, identifying all the faces on a certain 1967 Beatles album was an important measure of musical knowledge.

With its totemic songs today loaded onto your iPhone, somehow the packaging of Sgt. Pepper’s Lonely Hearts Club Band doesn’t seem so important now. But it was, as Beatles scholar Scott Freiman will discuss tonight in his multimedia presentation Deconstructing the Beatles: Sgt. Pepper. Using clips and musical samples, he’ll explain how John, Paul, George, and Ringo— with producer George Martin—added so many layers to the songs, using only a four-track recorder. The sheer density of “Being for the Benefit of Mr. Kite!” or the B-side-concluding “A Day in the Life” was unprecedented in the ’60s. Sgt. Pepper became a dorm-room staple and a perennial on all those Rolling Stone greatest-album lists (back when boomers paid attention to such lists). Today, a teenager with a Mac could create something as complicated, if not so melodic, as Freiman will explain (he has Yale degrees in computer science and music).

Screening afterwards—at 9:30 p.m. with separate admission—is the 1978 folly Sgt. Pepper’s Lonely Hearts Club Band, starring Peter Frampton and the Bee Gees, undisputedly a terrible musical that Freiman will help introduce.

We haven’t read Martin Amis’ new novel Lionel Asbo: State of England (Knopf, $25.95), but we share his fascination with that parvenu class of lottery winners who become overnight celebrities. Amis was arguably born famous but earned his subsequent literary acclaim (perhaps too much of it—one reason the Brit now resides in Brooklyn). Not so his new hero, who changes his name to the anagram for Anti-Social Behavior Order. Lionel is a petty criminal and ex-con with a soft spot for family. Suddenly transported by his windfall to loftier social circles, he becomes a tabloid item with a poetess/PR-expert girlfriend.

Meanwhile there’s a nephew with whom he enjoys a rather Pip/Magwitch relationship.

The New York Times calls Lionel Asbo “a listless performance,” a kind of lesser reprise of Money or London Fields. The Guardian hates it, calling the novel “depressingly bad, a stinker,” but the English are always hardest on their own—particularly when they leave.

Dancing to the Stars

Most of the year, the Pacific Northwest Ballet Orchestra is heard but not seen.

Musicians play down in the orchestra pit while glamorous dancers use the stage above.

But for tonight’s Celebrate Seattle program, PNB’s contribution to the World’s Fair 50thanniversary bash, the musicians will emerge for a program focused on outer space. PNB music director Emil de Cou was previously the music director for NASA (!), and he’ll lead the PNBO through “sci-fi favorites and celestially themed classics”—meaning Alan Silvestri’s Back to the Future score, Holst’s “Saturn” and “Jupiter” movements from The Planets, and bits of Beethoven’s Ninth and Stravinsky’s Firebird. In addition, PNB dancers will perform parts of Apollo and Circus Polka. And there are even visiting astro-celebrities! These include astronaut Cady Coleman, Nichelle Nichols (Uhura on the original Star Trek), and NASA’s Bobak Ferdowsi (the guy with the Mohawk we saw during the recent Curiosity rover landing on Mars). On Their Way Up

In addition to contributing to every newspaper in town, including ours, music writer Gillian G. Gaar has written four books about Nirvana, so it’s fair to call her an expert on the subject. Her latest is Entertain Us: The Rise of Nirvana (Jawbone, $19.95), an account of the band’s early days, the years leading to the global explosion that was “Smells Like Teen Spirit.” That means few pages on subjects like MTV, heroin, and, refreshingly, Courtney Love. Like Gaar’s other books, Entertain Us instead concentrates on blow-by-blow accounts of studio sessions and analyses of set lists at early house shows and now-defunct venues in Seattle, Tacoma, and Olympia. Gaar researched thoroughly, but also relates some sweet and personal moments. We read how Kurt Cobain, barely able to pay the rent, kept smashing guitars onstage, so Krist Novoselic got into the habit of finding left-handed replacement guitars whenever he walked by a pawn shop. And later, Novoselic warned wearers of the band’s “Nirvana: Fudge Packin, Crack Smokin, Satan Worshippin Mother Fucker” T-shirts: “Don’t wear that to my mom’s house, ’cause if she saw that, she’d throw me out!” Elliott Bay Book Co., 1521 10th Ave., 624-6600, elliottbaybook.com. We celebrated Woody Guthrie’s 100th birthday in July, and now comes this revival of Greg Carter’s This Land/Woody Guthrie, a 1992 show that garnered much acclaim during its first Seattle staging in 2004. What’s good about the show remains good: It blends a variety of media, including live singers and a crackerjack band of pickers, pluckers, and pianists who perform Guthrie’s anthemic songs. There are films and animated projections that skitter across the firmament of contemporary American history, with references ranging from early union battles to the death of Matthew Shepard to the current presidential election.

Among the cast are an assortment of puppets inspired by the wind-carved and careworn faces of the Dust Bowl (created

by Carter, Jenny Anderson, and Paul Chamberlain). As the tableau unfolds, many of the show’s emotional highlights are assigned to these half-sized puppets, as their fully visible handlers speak for them. It’s an audacious device; and while the puppets’ faces never change, their operators nonetheless play them as effectively as the musicians do their instruments. They wring a surprising variety of emotions from these small figures—so like the flickering ghosts from a bygone America, telling their tales in pantomime, with others delivering the words they no longer can.

All of this would add up to a memorable night of theater if only Carter would develop a through-line in his historical ramble.

Wonderful songs, a talented cast, videos, and puppetry are great, but they’re also a multivehicle pileup. However admirable in sentiment, This Land/Woody Guthrie is a pageant, not a play; it’s a roughly stenciled valentine to Guthrie and his politics. If you’re on board with those politics, fine, but if you’re not, God help you, because there’s nothing else to latch onto.

Presented by Strawberry Theatre Workshop, running close to two hours and 45 minutes (including the 15-minute intermission), the show becomes a slog. It’s too many dirges stating the same case, with a script begging to be edited. Most important during this pivotal political season, there’s a nagging sensation that Carter has some overarching point that he can’t get off his tongue. Maybe when Chelsea Clinton runs for president, his next restaging will tell us. KEVIN PHINNEY

However, to enable Imoru to pop that way, director Rosa Joshi stultifies many of the other roles, particularly the Romans. That’s plausible given the formality of imperial Roman culture, but it’s hardly succulent to watch. (Goths Sarah Harlett and Peggy Gannon are rowdier.)

Thone’s Titus mostly shambles about, a hobbled ex-warrior funneling the world through the narrow channel of his imagination. Between managing his dwindling coop of offspring (the dead ones loom on shelves in Carol Wolfe Clay’s blood-marked Pier 1 canopic jars) and plotting revenge on Tamora, Titus stays busy. Thone pitches the pedantry perfectly, uttering staccato the line “I. Have.

No. More. Tears. To. Shed,” as though Titus’ body had been amputated from his hand, not the other way around. Fortunately, that’s when Aaron and Tamora’s plot goes into overdrive, hell breaks loose, and the production veers toward a ZinZanni-esque, culinary-themed conclusion that’s bizarrified by jaunty Schubert waltzes. Tonally, we’re all over the place (and so was Shakespeare at this stage in his career); Joshi magnifies the muddle in some fun ways that suggest Martin McDonagh more than Elizabethan theater.

Despite the spotty text, Upstart Crow manages to wring a surprising degree of pathos from Titus’ daughter Lavinia (the delightful Brenda Joyner) and her tongueless grasping for communication; from Aaron’s allegiance to his child; and even from Titus’ final creaky crackup. Each of the play’s big set pieces is memorable, and there’s plenty to look at in Wolfe Clay’s set (presented in the round), decked with bloody plastic shower curtains and a bowl of pulpy organs. Kim Newton’s time-defying costumes suggest 1930s fascism pitted against a helplessly subordinate counterculture. It’s a world that feels familiar.

While the distaff casting didn’t exactly illuminate the text for me, it’s rewarding to see strong female performers get a bigger slice of Shakespeare’s gory pie. MARGARET FRIEDMAN E stage@seattleweekly.com

In Memoriam

The Seattle Symphony’s first concert after September 11, 2001 was the seasonopening gala on Saturday the 15th.

Associate conductor Alastair Willis was on the podium because Gerard Schwarz, who’d planned to conduct, was trapped in Great Britain, unable to fly home. On the bill that night were Copland’s Lincoln Portrait and Bernstein’s Symphonic Dances from West Side Story—by startling coincidence (the program had been planned months earlier), works that evoked the two major cities that had been attacked, Washington, D.C. and New York City. Though I’d never thought of it as a memorial piece, the Dances turned out to be powerfully apropos: not only, in all likelihood, the greatest tone poem to the color and vigor of the wounded city that will ever be written, but devastating in its elegiac conclusion. No one in the audience that night who knew the show could have helped recalling the lyrics to “Somewhere” and its prayer of hope for a world no longer torn apart by sectarianism: “There’s a place for us/Somewhere a place for us./Peace and quiet and open air . . . “ As it happens, this Saturday’s SSO season-opener repeats those two works. Deliberately? It seems

As for many baby boomers, the Apollo moon landing made a huge impression on young Bill Finger, as he now notes in his artist statement for Ground Control. The Curiosity rover on Mars today is a small feat compared to that great miracle conveyed back in the day of threenetwork, black-and-white TV images beamed into our astonished suburban living rooms. Finger is a photographer who shoots small domestic dioramas, only his bear mysterious traces of moondust—an astronaut clambers into the attic, a muddy forest trail bears the imprint of a moon boot, and tiny rockets stand at the ready for blastoff. All these images would’ve been perfect for the World’s Fair–commemorating Skyward! exhibit just seen at Bumbershoot, since Finger is similarly recalling those retro-futuristic dreams: the space race, JFK, and flying cars parked in the driveway.

Space exploration is today the less-heroic domain of robots. Instead of Neil Armstrong, we have WALL-E, Curiosity, and R2-D2. Astronauts were once like gods to us. Now they’ve been shrunk to the size of G.I. Joe dolls. Space has somehow

film»This Week’s Attractions meal scene structure that’s less than revelatory, and the bouts are so blurrily filmed and so leavened with reaction shots that you can’t really see what’s going down. In the end, once we realize the title doesn’t refer to these bantams’ weight class but to their strength of heart, or something, the film feels blandly respectful and, oddly enough, apolitical. The idea that addiction (drugs, alcoholism) is a disease is still scoffed at in some quarters, but what traction the once-radical notion has is largely due to the work of William G. Wilson (aka Bill W.), the co-founder of Alcoholics Anonymous and its driving force.

Since its publication in 1939, the book Alcoholics Anonymous has sold more than 30 million copies and been translated into more than 40 languages, with its 12-step

principles now used as the model for more than 60 different recovery programs. Codirected by Kevin Hanlon and Dan Carracino, this doc is a loving, exhaustive, warts-and-all look at the man who spent years battling his own alcoholism before a spiritual experience in the hospital set him on the course to help others. Employing dramatic re-enactments with narration supplied by audio interviews of the real-life Bill, and supplementing those with lots of old newsreels of Bill and his wife, Lois, as well as interviews with historians and assorted AA members (some of whom have been sober for more than 50 years), the film is a bit disjointed. Its elements never quite gel. They do, however, make up an engrossing portrait of a remarkable man who remained humble even as he became something of a revolutionary. ERNEST HARDY

A paradigmatic “portrait” documentary—the popular sort that eschews cultural information and risk to focus on “how it feels” to be its subject—Yung Chang’s film visits a pair of Sichuan Province boxing trainers employed by the state to examine a sea of grade-schoolers for potential Olympic contenders. (They can be famous, the kids are told. “If you don’t train hard, then you’ll only be your mama’s kid.”)

Chang eventually settles on two fierce-browed contenders in their teens, and on one of the trainers, soulful 30-ish Qi Moxiang, who hasn’t yet given up his own hopes for a Tysonesque pro career. Like so much else in China, the system is mercenary and cruel to children, but Chang falls into a repetitive training/advice/

The method-y, elfin brooderhipster star of the moment, Paul Dano has four movies out this year, but here is his one-man show, a post-Cassavetes gift to the lowly god of grit and “authenticity.”

Shot with personal-space-violating intimacy by sensitive semi-mumble vet So Yong Kim, the movie never strays more than a few inches from the odiferous aura around Dano’s Joby, a dim goth alt-rocker in a nowhere band we first meet driving himself into an upstate snowbank. Joby struggles mostly alone with the disappointment he has provided his ex-wife and his deadbeat-dad legacy in regards to the titular grade-schooler (Shaylena Mandigo).

A lean character study of a classic, if hardly articulate, modern lost-boy archetype, Kim’s film sometimes runs the risk of taking Joby almost as seriously as he takes himself, staring this wastrel down as if his every pout and blink were a window on the human condition. But at the same time, the character’s pitiful narcissism is certainly sliced for sandwiches, and the film does find a patient balance between its obvious sincerity and the scenario’s lack of depth and surprise. Dano, with his remarkably guileless meta-teen puss, is thoroughly convincing, which is more than can be said for the film’s shameless climactic steal from Five Easy Pieces. MICHAEL ATKINSON

For George Gregory—one of nine participants in the Fort Worth, Texas, horse-training competition profiled in this doc—the process of taming one of the 100 wild mustangs the government rounds up from public lands every year is “as good as it gets.” The horse was unavailable for comment. That about sums up the good and the bad of this documentary from husband-and-wife directors Alex Dawson and Greg Gricus: Even its most interesting human subjects can’t compare to the beauty and enigma of the wild horses who, after a life of running free, find themselves forced to two-step and bow to bizarre commands. We duck among contestants—including the aging Gregory and his wife, a showboat blonde, and two Native American ranchers—as they prepare over three months for the “Extreme Mustang-Makeover Challenge.” The horses

There is no musical score for this Argentine road movie, only the incessant throbbing of a truck’s diesel engine. And it is a long, long drive from Paraguay to Buenos Aires— maybe two days in real time, 85 minutes for us. The driver, Rubén (Germán de Silva), is a taciturn guy past middle age who doesn’t speak for the movie’s first 20 minutes. His passenger, Jacinta (Hebe Duarte), is scared to break the silence, since she only got the ride because Rubén’s boss told him to.

are fresh off the plains, and the strangely tender, almost romantic dance of first contact is beautifully captured. We get some sense of the horses’ range of personalities; clearer is the nature of each trainer’s attachment. The actual competition proves anticlimactic, as the focus pivots away from these mysterious creatures, who suffer us and all our schemes and presumptions with what can only be called grace.

Slick and grown-up as Richard Gere himself, this intricate fiscal thriller takes a dead bead on extreme privilege, with Gere’s Madoff-like billionaire fund-runner scrambling to keep his personal empire from crumbling like crackers. He has everything, including a loving family, a hot French girlfriend (Laetitia Casta), and that warm umber lighting only the wealthy can afford, until he doesn’t; with the sale of his company for nine figures already jeopardized by cooked books, a car wreck and warm corpse get him scrambling one step ahead of the cops. Nicholas Jarecki, of those Jareckis, slices his cake and has it too: We bizarrely empathize with the amoral hero’s stressed-out tightrope walk, wanting him to get away with being an untouchable plutocratic scumbag, while the film simultaneously limns the rank injustices money can buy in bulk. Everything, as the title suggests, is negotiable. In fact, sometimes Jarecki’s ethical needle wavers and seems to side with Gere’s weasel, but that might be because the actor (looking by now like the squinty twin of Bill Maher) is so convincing and the safety net of supporting perfs around him (wife Susan Sarandon, lawyer Stuart Margolin, Harlem innocent Nate Parker) is so tight.

Tim Roth, as a mannered Columbo-ish detective, might seem out of place, but otherwise the movie has the vibrations of firsthand knowledge. MICHAEL ATKINSON

Truckers bear unsavory stereotypes (think back to Duel), but Rubén gradually softens.

And while Jacinta is cute and vivacious, she never imposes on the stranger seated beside her. Little is said between them, but both have impeccable manners. Acacias are the trees being brutally logged in the film’s first scenes; Rubén then drives the timber to market. In a way, both characters have been uprooted from place and kin. If you’re patient, very patient, Las Acacias suggests that new growth is possible. But there is no radio in the truck, and there are many kilometers to travel. BRIAN MILLER

Françoise Sagan became a teen literary sensation in France. Four years later, Otto Preminger made a talky CinemaScope melodrama out of the book, with 20-yearold star Jean Seberg and real locations along the Riviera.

Today, apart from that unspoiled coast, where conga lines erupt in colorful fishing villages, it’s hard to understand what all the fuss was about. The eagerly inexpressive Seberg is allowed to run wild by her widowed playboy father (David Niven), until he’s jolted out of his promiscuous ways by Deborah Kerr, who’d persuade any man to embrace virtue and marriage. Naturally Seberg hates her, and the movie relates—in flashback from a black-and-white Paris—how the little minx seeks to spoil her father’s happiness. What does she detest about Kerr?

CHINATOWN In Roman Polanski’s neo-noir Chinatown, Jack Nicholson’s private eye sexes up his mediocre snooping with blithe arrogance and sarcastic machismo.

It’s the actor’s default mode, sure, but in 1974 it hadn’t yet calcified into Shtickolson. On the trail of murder, water, and incest, his Jake Gittes is dumped in the wilds of Greek tragedy. There, depravity incarnate Noah Cross (John Huston) tells him, “You may think you know what you’re dealing with, but believe me, you don’t.”

JURASSIC PARK The late writer Michael Crichton, who famously tutored President Bush on the fallacy of global warming, was no scientist. But the doctorturned-novelist, from The Andromeda Strain forward, knew how to mix popular science into exceptionally good potboiler fiction. [REC] 3: GENESIS “This is my day!” a Spanish bride declares at her wedding reception, and she will not have it spoiled by zombies crashing the party. By the time she gets all Buffy on their undead asses, half her family has been turned into flesh-eating ghouls, but the horror isn’t treated too seriously in the third [REC] installment. This time only half the original filmmaking duo, Paco Plaza, is back; also returning is the video diary/shaky-cam format—for the first 20 minutes, at least, until the zombies appear. [REC] 3 then alternates between conventional filming and surveillance cameras, while the action is as old as D.W. Griffith: run from the zombies, hide from the zombies, retreat to the next room when the zombies knock down the door, repeat.

The chainsaw-wielding bride (Leticia Dolera) is made of tougher stuff than her new husband (Diego Martín), essentially Jell-O poured into a Colin Firth mold. None of the wedding party registers enough for us to care about the jugular chomps and bursting arteries, and the slow, spastic zombies are too familiar to be frightening. It’s an enjoyable if ordinary fright flick, and one wishes the Catholic jokes had been more worked out. The zombies are stymied by crucifixes, scripture, and holy water, but no one thinks to load up a Super Soaker from the baptismal font. THE STORY OF FILM: AN ODYSSEY Made for British television, this 15-hour survey of cinema history by Irish scholar Mark Cousins will run in repeating blocks of three episodes (three hours) each. In an Ulster brogue, Cousins narrates, alternating between stabs at lilting poetry and calculated down-to-earth matey-ness. The tapestry of imagery alternates between excerpted clips from hundreds of films and new, ugly interview footage with a curious scattering of personalities. TOUCH OF EVIL The reputation of Orson Welles’ 1958 Touch of Evil gradually grew over the four decades following its release, and several different edits and restoration now exist. The movie, which began as a pulp fiction novel about corruption in a border town, was originally to feature Welles as a mere heavy-for-hire.

The guy hadn’t worked in the U.S. for a decade; and this, his low-budget return to Hollywood, would be his last American movie. Janet Leigh stars as the innocent American wife of a Mexican lawman (Charlton Heston).

It was his idea, says Heston, to hire Welles as director.

Welles rewrote the script on the fly, restaged scenes in the public restrooms of Venice, California (a decrepit Moorish-style resort town then undergoing an oil boom), and collapsed days of shooting into single, long-take sequences like the famous opening shot, set to cantina music and a ticking time bomb. Want a taste of Hawaii? Head to Kent.

hen you really, really love a restaurant, how do you express your feelings? You might post an exclamation point–laden ode on Yelp, or ask the restaurant’s chef to cater your wedding. Or, if the object of your ardor is Saimin Says, a Hawaiian plate-lunch storefront named for the islands’ indigenous noodle soup, you could give the owners a Spam musubi pillow roughly the size of a cowboy-boot box.

The banded pink-and-white cushion, which a culinary historian might slip beneath his haunches while meditating on the breathtaking adaptations and accommodations that define Pacific Island cookery, now leans against the restaurant’s cash register. A note directing patrons to use cash or debit cards for purchases under $10 is package-taped to its midsection.

The goofy pillow is a lonely remnant of the Polynesian bric-a-brac that adorned Saimin Says’ previous location in Des Moines, much of it gifted to Colleen Shoda and Ted Keene by customers grateful for their precise renditions of dishes that aren’t anything special 2,700 miles southwest of Seattle. While very little of the collected decor has shown up in the newish Kent strip-mall unit that in 2010 became Saimin Says’ sole address (following

ther than the musubi pillow, a few Gauguin prints, and a wooden outrigger model perched atop the drinks cooler, there’s nothing distinctively Hawaiian about the current restaurant’s appearance. Yet Saimin Says’ on-point flavors are more effective than surfboards and a Don Ho soundtrack at inducing an island reverie.

Saimin Says uses fresh ingredients, except when the restaurant’s allegiance to what Shoda calls “true blue” Hawaiian cooking demands otherwise. Keene doesn’t meticulously recreate Spam, nor does he try to best the chantilly and coconut-pudding cakes produced by Seattle’s estimable Cakes of

a short spell in which the restaurant ran two locations), the devoted fans acquired over 18 years of frying rice and flipping omelets have made regular appearances—along with a crew of intrigued eaters from nearby office buildings.

“This location has brought us a whole new clientele,” Shoda says. “Whereas up there it was 90 percent Pacific Islander, down here it’s 50-50.”

It’s hard to conceive of a better primer on modern Hawaiian foodways than Saimin Says. Granted, any restaurant working in the Hawaiian idiom has a significant head start in the likability race, since the island’s collective recipe box is crammed with dishes devised to comfort communities far from home. Hawaii’s plantations attracted Chinese sugar-cane cutters, who preferred rice to poi; Korean millworkers, who concocted sweet garlic sauces; and Japanese pineapple pickers, who planted soybeans and simmered noodle soups. The laborers’ nostalgia added up to a cuisine that—much like Tex-Mex, its landlocked equivalent—is meaty, salty, and sloppy. Only a prude could resist it.

But Saimin Says doesn’t merely pander to cravings, it validates them. With tender, smoke-laced kalua pig; a mushroomy saimin

broth that lollygags on the tongue; and a terrific mayodrenched mac salad knitted with tuna, the restaurant assures skeptics that it’s perfectly OK to admire a culinary tradition that exalts teenage boys (the legendary inventors of loco moco) and canned meat.

“I remember going to Albertsons and ordering a dozen cans of Spam; I’d feel so awkward,” Shoda says of the restaurant’s early years. “Now I go to Costco and fill up a flat.”

Shoda was working at a Maui hotel when she realized there were no banks or relatives stopping her from leaving Hawaii and opening a cafe on the mainland. She initially planned to open a coffee shop—still a fairly novel concept back in 1994—but learned three others were slated to open within a block of the Las Vegas venue she’d chosen.

So she switched to a saimin concept and took it to Seattle, where she’d heard the winters were mild. She was accompanied by Keene, an Idaho native who’d mastered Hawaiian cooking during his island stay.

“You know you’ve got something when the fried rice is better than your mom’s,” Shoda says.

The pair married the following year.

They’ve since separated, but remain business partners (agreeable ones, according to Shoda). Although Saimin Says developed a loyal customer base in Des Moines’ Midway neighborhood, business faltered after the grocery store which had anchored its strip mall shut down, prompting the addition of the Kent location. The restaurant permanently moved out of Midway when a nightclub took over an adjacent space.

The Watering Hole: Sun Ya, 605 Seventh Ave. S., 623-1670, CHINATOWN The Atmosphere: As you enter Sun Ya, to the left is a massive, austere dining area best known for plopping stellar dim sum in front of its guests. But head straight and to the right a little, and you’ll shimmy into one of Seattle’s darkest bars, perfect for days when you’ve forgotten your sunglasses.

At 4 on a Tuesday afternoon, the bar is half-full but pregnant with promise. Every patron is on the wrong side of 40, with blacks and whites peppered (or salted) among a mostly Asian crowd.

Three television sets of varying sizes show Hurricane Isaac hitting Louisiana, Asian art adorns the walls, and red paper bulbs hang from the black tile ceiling, muting the lights. Against the back wall rest a wood stove and dartboard, both out of commission, and swivel chairs make for a potentially great bout of bumper drunks.

The Bartender: Tall, dark-haired Gloria Ohashi boasts a deep voice and quick wit. A skinny regular comes in and hands her a small green pumpkin that he says he found on the bus. “We don’t have regulars,” says Ohashi.

The crunchy pickle and veggie rolls make a nice midday snack, and the “rainbow roll,” an eight-piece extravaganza of raw fish atop a crab-and-avocado roll, is a meal all by itself. $ SOUND SOUPS 999 Third Ave., 284-1355. Soup can brighten the bleakest Seattle day, and Sound Soups knows how to serve it: piping hot and loaded with flavor, with varieties including clam chowder and old-fashioned chicken noodle. The beef stroganoff has good-sized pieces of meat smothered in a thick, creamy sauce, while the sirloin chili is blessed with gargantuan hunks of steak that clearly distinguish it from canned varieties. $

It’s a tradition to give apples to teachers on the first day of school, but they weren’t the only ones to have fruit pressed on them when King County school districts started their new terms last week. In accordance with school-lunch standards adopted by the Department of Agriculture, students across the country are now required to take a half-cup portion of fruit or vegetable with every meal. Students who fail to correctly assemble their trays will be sent back to the cafeteria line or offered a piece of fruit at the checkout station.

“The USDA is doing a great job of retraining us, starting with kids,” King County Nutrition Consultant Donna Oberg says.

The standards announced earlier this year were designed to combat the childhood obesity rate, which has tripled over the past three decades, Oberg says. In addition to mandating fruit and vegetable service, the standards call for meals to include more whole grains, less salt, and a greater diversity of vegetables. Meals will also be sized by age group, so a first-grader doesn’t get as much butternut-squash curry as a high-schooler.

Butternut-squash curry is one of a number of new recipes developed in conjunction with the Tom Douglas Group: Local students can also look forward to tabouli salad, baked pollock with tomato topping, and yogurt fruit parfait.

Oberg says cafeteria directors are scrambling to

develop dishes that satisfy the new rules, partly because suppliers haven’t yet started to manufacture items that meet the whole grain requirement. “I’ve had nutritional directors struggling with pizza and sub sandwiches, making sure the buns have more than two ounces of whole grain,” Oberg says. “But it’s moving very quickly in the right direction.”

Although students are required to take a fruit or vegetable, they are not required to eat it. There’s nothing to stop students from tossing their servings in the trash, although Oberg says a few districts have instituted “sharing tables” for unwanted food in hopes of reducing waste. Students are also free to subvert the low-sodium requirement by slathering their meals with condiments. Although school cafeterias don’t provide salt shakers, students have unfettered access to ketchups and mustards.

“There will be a lot of promotion, so students will understand why we’re doing this,” Oberg says, adding that parents can help support the overhaul by reviewing online menus with their children and encouraging them to try various fruits and vegetables.

Seattle Public Schools is easing its students into the new paradigm: Whole-grain chicken corn dogs, kidney beans, and bell peppers aren’t scheduled to appear until September 18.

“It’s going to take a little time, but I think it’s great news for kids and families,” Oberg says.

alfway through the second song of The Head and the Heart’s set at The Cedar in Minneapolis, Jonathan Russell smashed his Martin guitar to pieces and walked offstage into a crowd of blood-stained half-humans.

It was Zombie pub-crawl night, and Russell, the band’s co-frontman, spent the rest of the evening being cussed at by people in zombie suits because he wasn’t in uniform.

“I was convinced I was going to fly home,” Russell says, “[thinking] ‘I don’t give a shit.

This is no longer the idea that I thought this was going to be. I’m over it.’ ” It was October 2011, more than a year into the promotion of the band’s self-titled debut, and The Head and the Heart was working harder than Scott Perlewitz, Sub Pop Records’ head of commercial radio, had ever seen a band work.

“They would literally drive around in a van, do a radio stop, play a couple songs for the radio station, nail it every time, be charming, and then go do soundcheck, meet some more people, maybe do some publicity stuff, do a kick-ass show every night, and then get in a van and drive,” says Perlewitz, who worked

the early careers of Michael Bublé and Powerman 5000, among others, at Warner Brothers’ Reprise imprint before joining the independent Seattle label. “They work their asses off at a level, and with a kind of response, that the people who saw it came back with their friends. And that’s their story.”

Part of it, anyway. Before The Head and the Heart signed to Sub Pop in December 2010, their debut had already sold upward of 8,000 copies— which would be considered profitable for some Sub Pop releases.

Today, with the label behind them, that record has sold more than 203,000 units, according to Nielsen SoundScan. In the age of iTunes, Spotify, and comedian Louis C.K. selling a million dollars’ worth of downloads directly to his fans in a matter of days, conventional wisdom is that record labels and other media middlemen have become anachronistic. But the 195,000 records Sub Pop helped The Head and the Heart sell presents an interesting argument for why labels still work—and why the one that broke grunge is thriving on the eve of its 25th anniversary, which it celebrates next year.

T

he Head and the Heart formed in 2009, after Russell moved to Seattle from Virginia. His plan from the start was to form a band and get signed to Sub Pop. He’d attended high school with drummer Tyler Williams, but had never met Josiah Johnson (vocals, guitar, percussion), Charity Rose Thielen (vocals, violin), Chris Zasche (bass), or Kenny Hensley (piano) until The Head and the Heart started coming into shape.

The band didn’t hit Sub Pop’s radar until a year later, after their record had already started to sell. They were opening big shows for acts like Vampire Weekend, and major labels started throwing “shit-tons of money at us,” according to Russell. Stuart Meyer, THATH’s A&R rep at Sub Pop, admits that the label was late to the party. Ali Hedrick, the band’s booking agent, was pestering owner and co-founder Jonathan Poneman to listen to the record.

It’s been said that since the road is where bands make most of their money these days, it’s more important to have a booking agent than a label. Hedrick disagrees, which is why she pitched the band to several labels.

“It takes a village,” she says. “I want people spending money on marketing. I want somebody getting the record out to college radio and setting up interviews for them. Why wouldn’t you go with a record label who is going to invest in your business? If I was a band, I would never turn down a deal like Sub Pop. It’s great branding for the band. It’s a great association.”

Steve Manley, owner of B-Side Records in Madison, Wis., says that being on a label doesn’t have the same cachet with his customers that it once did, but that even now the Sub Pop imprint feels like a seal of approval. “If Sub Pop finds a worthy band to sign,” he says, “I think there’s usually something to that.”

ven when Sub Pop started calling, the independent success of The Head and the Heart made the band question not only whether they should sign to an indie or a major label, but whether they needed a deal at all.

Facebook has made it easy for bands to connect with fans; Bandcamp allows any artist with an mp3 to share—or sell—their songs directly with listeners; and remarkably highquality records can be made using Apple’s GarageBand recording software for a fraction of the price of renting a studio. All these conveniences have made it easier for bands to make records and reach an audience without the infrastructure and financial backing of a label.

Some artists, such as Seattle rapper Macklemore, have remained fiercely independent, continuing to tour and record on their own.

Others, such as Portland singer/songwriter Laura Veirs, have left their record labels and struck out on their own. For the release of 2010’s July Flame, Veirs cut ties with her longtime label, Nonesuch; created her own label; and hired people to fulfill the management, publicity, and marketing roles that are a label’s bread and butter. The result: July Flame sold more copies than her last Nonesuch release, Saltbreakers.

Independence makes sense for Veirs for the same reason it does for Louis C.K.: Their audiences were built on the support of a financial backer. Louis C.K. had cable TV (FX); Veirs had a record label. “They gave me international ads and ads in The New Yorker,” she says, “and press that I don’t think I would have gotten otherwise. Now that I have an existing audience, it’s much better for me to have my own label.”

“Why wouldn’t you go with a record label who is going to invest in your business? If I was a band, I would never turn down a deal like Sub Pop.” Megan Jasper, Sub Pop’s vice president, says the label goes though a series of conversations before offering a band a deal. In addition to aesthetic considerations, Sub Pop wants to make sure the parties’ business philosophies and personalities are the right fit. With The Head and the Heart, Jasper says, the primary question was whether the label could build on the momentum the band had built on its own.

“The thing that was clear, especially when you saw them play live, is that there was great potential there,” Jasper says. “And when you’re in that place, no matter what it is—whether it’s Fleet Foxes, whether it’s fucking grunge—you never know when you’re in the beginning or in the thick of it; you only know that there’s

something and it’s wanting to move forward. And that’s what we sensed with them, and I think they sensed it themselves.”

Ultimately, The Head and the Heart decided their talents lay in writing and performing, and wanted to give the tasks of marketing and planning to people who knew better. Sub Pop was the right fit because the label seemed big enough—and competent enough, as demonstrated through their recent work with Fleet Foxes, Iron & Wine, and Band of Horses—to see the potential in their debut album. The expectations in the deal were also modest enough that they wouldn’t have to compromise to sell the number of records that would have been necessary to keep a major-label suitor happy. Russell says they would have made a lot more money up front if they’d signed to a major label, but they would have been tied to the agreement for many years and records. The Sub Pop deal, for only two records, gave them less up front but came with some pluses, like ownership over the rights to the master recordings of The Head and the Heart—a wonky line item that could pay large dividends over the years and decades.

As the band readies to embark on its final tour in support of its debut, all parties are looking back at unqualified success. The band’s first single, “Lost in My Mind,” was a hit on adult-contemporary radio; they’ve played Conan twice; and The Head and the Heart is one of the 10 best-selling debuts in Sub Pop’s history. Not bad when you consider that Jasper sees the first album of a two-record deal mainly as a strong foundation for the second.

“It’s about building,” Jasper says, “It’s about developing. It’s about educating people and getting the music out and getting the word out and seeing what kind of groundwork you can create. And [with] the second record, you can truly build on all of that.”

ussell didn’t quit the band that night in Minneapolis. He got onstage the next night and played the show, even though, he says, “it was awkward as hell.” But he does miss that guitar. They all do.

“That was the guitar that we got to replace the $100 guitar that you had,” Johnson says, “because we knew that we were going to go on tour for a long time.”

Russell’s new guitar is OK. It’s not brokenin like his old one was, and it’s not as fancy as someone who’s sold 200,000 records can afford. But a cherry axe isn’t high on his list of priorities right now.

“There was a moment when I was sad that we were going to lose a band out of it,” says Giardino.

But, says Shannon, “I knew we weren’t going to stop playing music together.”

SHOP TALK Giardino is the band’s guitarist and Shannon plays synthesizer; they also have a drummer, Mike Gaul. They both sing, although Shannon sings in a low voice and layers it with male harmonies from a vocal processor. Hence it’s hard to even tell she’s singing.

“I’ve never really thought about it,” Shannon says of the barely-there feminine presence in the music. “But I guess if I did think about it, I would want it to be less feminine. I like tricking people. And it feels so much better to scream!” (She recently wrote a song called “Queen of Scream.”)

“She’s got a tough, pretty voice,” says Giardino.

No, most people seem to figure it out after a little while.

Here debuted at #5 on the Billboard charts in May. Was that at all surprising?

It was a little bit, yeah. That was a fun day.

It was just amazing to read the little Billboard thing. It was a milestone in a way.

Can you talk about the differences between making Here and making your debut, which included producing it yourselves?

This time it was a band making a record instead of some guys coming together to record an album.

We’d come off a lot of touring—probably a little too much in some ways. A couple people had left the band, but we all took a leap of faith and got a house [in Ojai, Calif.]. Most everyone stayed up at the house and we got a studio, and we have that studio still. That’s a really special thing, too, to be able to just roll in and start working and know that there’s not really a deadline unless you put one on yourself, which is the way I like to work.

This one was more collaborative, and we wrote

some songs together in the same room, which on the first album didn’t really happen. I think it was a good step in the evolution of us.

Did you always know the process would be different this time around?

That was part of the dream—to have it be more collaborative, and also the way that it’s going to be more fulfilling for everyone. I think it will just become more and more like that. Even on the first album, we split so much of the publishing and the writing and money and whatnot, so it was sort of like premature community sharing. And with this album, it’s not as much based on a philosophy as it is based on reality.

Here has a lot of ambience, with all the hoots and hollers. Did you pay extra attention to trying to capture that?

Don’t worry: She survived this threat.

BTW: Two years ago, Giardino and Shannon further cemented their bond by giving each other the same stick-and-poke tattoo: a hand with the middle and index fingers crossed.

They like the duplicity of the image. “[Fingers crossed is] wishing and hoping, but if it’s behind your back it’s lying,” says Shannon.

“It’s like blood brothers, or blood brother and sister,” says Giardino of the tattoos. “It’s a way to take something on more intensely.

I don’t know if it’s just sort of that we know that that ragamuffin approach delivers some cool sounds, or if it’s that we’re used to being able to do that, but I definitely encourage the band to shout and make noise. I think it’s still a little bit of an embarrassing thing for people to use their voice, especially if we’re recording, but I think it’s important and it adds to what I describe as the porousness, the pores of a song.

If a rock is completely tumbled and completely shiny, the water has no way to penetrate the rock. It’s become this impervious, gleaming, polished, produced piece. But if you allow it to be porous, you can enter into it and really experience the song. I’m into some stuff that is completely polished, but I think there are so many ways to completely polish something that can be really detrimental to a song, [and] there’s a lot of great songs out there that I don’t resonate with because of all that polishing.

Did the “Railroad Revival Tour” with Old Crow Medicine Show and Mumford & Sons, in which you traveled across the Southwest in vintage trains, inform the record at all?

That train tour changed our lives in many ways and inspired us musically in many ways, particularly in the grand sense of just playing music all the time, because that’s all that was going on on that train. SW: Do people call you Edward a lot?

Are you afraid you’ll end up like Darius Rucker, with people yelling “Hootie” at you for the rest of your life?

THE SITUATION It’s Friday night and I’m drinking beers at Vermillion on Capitol Hill with the self-styled “noir pop” band Baby Guns: Neil Giardino, 29, and Erin Shannon, 21. The latter is wearing a hot-pink floral jumpsuit so loud that a hobo walking down the street gawks at her and hoots hysterically.

HOW THEY GOT HERE Giardino and Shannon met at Seattle Central Community College three years ago. “Erin was always eyeballing me,” says Giardino.

“You were eyeballing me too!” Shannon nterjects.

“There was a burning car on Broadway one day,” Giardino continues. “We kind of embraced each other. We were waiting for it to explode or something. That was how it all started; that’s how we bonded.”

They’ve been been a couple twice. The first time he ended things with her. “We broke up at Bum Nap Park at Pike Place Market,” he recalls (referring to Victor Steinbrueck Park).

“Same place we had our first kiss, actually!”

Shannon says.

I felt a bit late to the game at the end of 1978 as I sheepishly bought my first copy of the Sex Pistols’ Never Mind the Bollocks. As awkward teenagers, most of us have this experience where we have to accept the fact that we are not as cool as some other kids.

I didn’t get turned on to Refused until about 1999. Again, I was late to the game. Their epic The Shape of Punk to Come had been made in 1997. This time I had the excuse of being a new father to two young children; there was just no way I could keep up with new music.

Alas, just as I was getting into the band, I discovered they had broken up. News on the street was that they would never again play as a group. Singer Dennis Lyxzén had formed International Noise Conspiracy, and the rest of the dudes were nowhere to be found. They were committed to their message of punk honesty and strife, and they seemed just as committed to their message that Refused were fucking dead.

But thankfully for a lot of us, Refused somehow found a way to get back together and play some shows this year, something most thought would never happen. I saw that they were playing at Coachella last spring, but life is busy, and those aforementioned “babies” are now teenagers themselves.

But I would get another chance—and not at some huge festival, but in my hometown of Seattle. A couple weeks ago, I finally saw Refused, and it was everything I had hoped it would be.

A Refused show ain’t a fucking social event. They are not a band that attracts a casual fan. No, shows like this actually live and breathe and have movement. An experience and a moment in time. To be remembered as an event. If you were there, you simply saw and heard what I did: The band live was better than the records.

The crowd air-bassed and yelled its lungs out. A girl to the right of me was losing her shit, like at a My War–era Black Flag show.

There was a couple to my left who kept looking at each other as if to say “Can you BELIEVE this? We never thought we’d see this fucking day!!” There were jock guys there, and punks and hipsters and old-schoolers like me. But that night, there was no distinction separating any of us. It was like a Stooges or Prince show—it was that fucking cool.

Later that night I got a text from my 15-yearold daughter, Grace. She wanted to know if it was OK if she went to a concert in downtown L.A. that weekend, and wondered if I could get her a ticket. I looked online at who would be playing. At the top of the bill? Refused.

There’s no transcendent pop on the level of the band’s earlier “My Girls” or “Fireworks”—although newly returned member Deakin comes close with his lead on the hypnotic, awestruck “Wide Eyed.” It’s Animal Collective attempting to return to their precrossover, feral-noise/psych-jam roots, only with so much pop and electronic baggage in tow. This will delight some fans, for sure; others will find it all too much to sift through to find something of sustenance. With

This local band is a delightful trio of goofballs who seem to write songs around whatever silly inside joke has most recently popped into their heads. Two things set them apart from many other fun-loving semi-novelty acts of the time: They can twist those simple ideas into hard-rocking, tightly picked jams, and rip it up live. When I stumbled upon a Schew Aquarium show last year at the Sunset, the band’s quirky banter and journeyman rock skills kept the entertainment level surprisingly high, effectively pulling me away from my Flying Squirrel pie and onto the dance floor—a tough thing to do. Austra FRIDAY, SEPTEMBER 14

Feel It Break, this Canadian electronic outfit’s debut LP, was a noteworthy introduction to the band’s sharp, icy beats and opera-trained frontwoman Katie Stelmanis’ strikingly piercing vocals. Austra followed it with a remix album, Sparkle (unrelated to the Whitney Houston farewell film), and have since been touring and releasing new music in small increments—they made a guest appearance alongside Jim Jarmusch on the 15-minute Fucked Up single “Year of the Tiger,” and performed a spooky cover of the Robyn/Röyksopp song “None of Dem” on an Australian radio station. More interesting, earlier this month they premiered a new track at a live in-studio; “Painful Like” is promisingly mysterious and woozy, with a killer, pulsing bass line.

Simply put, a McMurtry/Gourds bill epitomizes Austin, the Lone Star State’s capital whose social currents nevertheless run counter to Texan culture. In Austin, as in McMurtry’s lyrics, the river ain’t red; rather, it’s a cleareyed, hyperliterate depiction of the folks who populate modern-day Middle America. That doesn’t mean you’ll be clear-eyed by the end of this show, even if it’s at the ornate Neptune instead of Georgetown’s industrial fringe. With

Atmosphere SATURDAY, SEPTEMBER 15

Toward the end of the ’90s, a new sort of energy began to roll out from the clubs and indie record stores of Minneapolis to capture a sizable chunk of the underground hip-hop demographic. At its center was Atmosphere, a then-trio (now duo) who made swinging, loopbased, sometimes goofy rap. At Atmosphere’s core was the charismatic lead MC, Slug, who spit syllable-packed, highly relatable “modern man” lines about girls, booze, and being an MC in his distinctive loudmouth voice. After releasing just one record with Kill Rock Stars, 2010’s solid Past Time, the San Francisco post-punk trio Grass Widow returned this year with its third LP, Internal Logic, on its own label, HLR Records. (The name is an acronym of the trio’s first names—Hannah Lew, Lillian Maring, Raven Mahon.) Internal Logic starts with some squiggling synth noise that sounds like alien transmissions and leads into “Goldilocks Zone,” in which the girls muse, “Look at the sky/No one there to find.” The song sets the tone for the rest of the album—spacey, curious songs that buzz with a propulsive, glowing energy.
