Since transportation is a part of everything, the MBA is monitoring two bills that would end up dipping into the gas tax fund, Motor License Fund (MLF), to cover state police costs.
The MLF is where all fuel taxes, license and registration fees are deposited and is mainly used to pay for road and bridge repairs. However, the state's been dipping into that fund to cover state police bills at the expense of fixing the state's crumbling infrastructure At its peak, $800 million per year was used for the state police, until the General Assembly reduced the appropriation to $500 million per year in 2016.
Two proposals in play would ease the State Police out of the fund in five years, one being more aggressive than the other and yielding more funding for roads and bridges upfront.
Slower - Governor Shapiro’s proposal is part of the 2023-2024 budget It would stepdown $100 million per year for five years. A new fund may be created to collect resources to replace the funding shifted away from the State Police. In the current state budget that amount is $500 million. The proposal would reduce the amount by $100 million per year until the subsidy disappears entirely in fiscal year 20282029.
Note that currently the budget has an agreed upon top-line spend amount but there is no budget-enabling legislation yet – a fiscal code bill - to implement the funding. The Governor’s proposal is in limbo.
Majority Chair of the House Transportation Committee, Rep. Ed Neilson’s has House Bill 1162 - legislation that provides for the same phase-out of the MLF as proposed by the Governor. That bill sits in House Appropriations as of March 8, 2023.
Faster - Majority Chair of the Senate Transportation Committee, Senator Wayne Langerholc, is the sponsor of Senate Bill 121, which proposes a more aggressive phase-out of the subsidy. SB 121 provides for the appropriations to the Pennsylvania State Police from the MLF be (shall not exceed) $250 million for fiscal year 2023-24, $200 million for fiscal year 2024-25, $150 million for fiscal year 2025-26, $100 million for fiscal year 2026-27, $50 million for fiscal year 2027-28 and $0 for fiscal year 202829.
The advantage is the $250 million more dollars for road and bridges vs. Shapiro’s $100 million beginning fiscal year 2023/24. SB 121 passed out of the Senate by a vote of 28-21 and now is sitting in the House Transportation Committee as of March 8, 2023.
There are two possible pathways. The fiscal code may contain Governor Shapiro’s provisions (HB 1162) and the MLF will have a slower phase-out. If not, the second path is more challenging and will require passage of free-standing legislation, SB 121, a more aggressive phase-out of the funding for the Pennsylvania State Police
