PEMBERTON—A Pemberton Borough patrolman who responded to the Sunbury Village section of neighboring Pemberton Township on July 19, 2019, for reports of an altercation, and subsequently encountered a man armed with a long scythe, fatally shooting him as he reportedly advanced toward other individuals, will not have any charges filed against him, according to a Sept. 22 press release from the state Attorney General’s Office. While all the “available evidence,” including video footage and the recorded statements of civilian witnesses, revealed that Witney Rivera, 41, of Pemberton, was armed with a scythe and advancing toward other individuals when he was shot, state statute requires all fatal police encounters must still be presented to a grand jury, the state Attorney General’s Office noted.
