CHILD SUPPORT RE-EXAMINED Child support obligations aren’t always clear, especially if there are unusual circumstances. The BC Court of Appeal recently dealt with such a case.

Mark, 68 and retired, owned a mostly US real estate portfolio worth $11 million (in addition to a substantial inheritance)and earned some $168,000 a year.

The court considered the child support obligations for Peter (all names changed here), a pleasant 24-year-old man with a mental disability. Peter couldn’t make basic decisions for himself and likely would never be able to live independently. His life expectancy was normal, and he would need support for the rest of his life.

Their son Peter had some significant assets himself, partly from an inheritance from his grandmother and partly from a trust fund, though that fund could only be accessed if the Public Trustee agreed. Peter also got some monthly government assistance.

Peter’s parents, Mark and Linda, had divorced in 1995. They initially shared joint custody and guardianship of Peter, five years old at the time, but in late 1996, they agreed that Mark would have sole custody. Since Mark’s business took him to the United States a great deal, he also agreed to pay Linda (who earned only a modest income at the time) $300 a month in child support.

This was essentially to enable her to travel to the US for visits with Peter, which she did frequently over the years.

By the time of the court hearing over child support, however, both Linda and Mark were very well-off financially.

Linda had married a venture capitalist in 1998 and enjoyed an affluent lifestyle.

She didn’t work, and details of her current income were sketchy (she got some money from a company her husband was involved with). Before her first marriage to Mark, she had earned roughly $20,000 a year as a charter airline employee, and in the initial court documents in this case, she said she earned $20,000 annually, though later said it was less.

Due to the substantial change in Linda’s financial circumstances and her no longer having any financial difficulties in exercising access, the lower court decided Mark didn’t have to pay Linda any arrears dating from 2008 or make any further child support payments to her.

But Mark also wanted his ex-wife to help pay for the ongoing support of their son.

The Court of Appeal emphasized that, even though Mark could well afford to support Peter alone, Linda was also responsible for Peter’s support – it’s fundamental that both parents have an obligation to support a child like Peter, who was likely to outlive his parents.

It was Linda’s voluntary choice not to work, observed the appeal court. So it said Linda should be treated as earning $20,000 annually. Using this income figure and the child support guidelines, the appeal court ordered Linda to pay Mark $174 a month toward Peter’s child support.

The Ancient Art Of Marbling!

Oxygen Art Centre is pleased to present a workshop in the ancient art of marbling by Vancouver based artist Natalie Purschwitz. Dating back to 12th Century Japan, the ancient craft of marbling has amazed artists all around the world with its magical process of swirling inks, dyes and paints on a liquid surface to produce beautiful, organic patterns. For hundreds of years throughout Asia, the Mediterranean and across Europe, marbling has been used to create original artworks, endpages for books and colourful patterns for textiles. According to Purschwitz, there is a perfect balance between control and unpredictability in the process that is undeniably addictive. Every new piece is both a surprise and an accomplishment.

Another Great Year For Columbia Basin Trust

As it approaches its 20th anniversary, Columbia Basin Trust is pleased to announce 2014/15 was another year of strong support to the area it serves in the Columbia Basin.

Over the year the organization delivered nearly $22 million in programs and services to communities and residents, $17 million in new loans to Basin businesses and earned revenues of over $29 million.

The Trust works to strengthen the region’s social, economic and environmental well-being. In 2014/15, activities included establishing a new resource to support sports and physical activity, helping Junior Achievement expand into the Basin so youth can learn about entrepreneurship, renewing the Trust’s Social Strategic Plan and continuing to create a regional open-access broadband network.

The main way the Trust supports these activities is by investing in power projects. All power projects performed well over the year, and brought in revenues of over $22 million (out of total revenues of $29 million). In spring 2015 Waneta Expansion began operating, which will positively impact future revenues. The Trust also invests in market securities (stocks and bonds) and local real estate, and provides loans to Basin-based businesses.

“Because of the strong performance of our investments, our revenues were higher than anticipated, which means we were able to offer more programs and services to Basin residents,” said Neil Muth, Columbia Basin Trust President and Chief Executive Officer. “Moving into the future, we look forward to having even greater impact on wellbeing in the region.”

A major emphasis over the year involved engaging with residents to ask what’s important to them and how the Trust should focus its efforts. About 3,000 people provided input that will help the Trust make decisions, set priorities and manage how it provides programs and services to the region.

To thank the community and funders for the dedicated support of the Kohan Garden and to acknowledge a valuable contribution to our cultural heritage, the Slocan Lake Gallery and Slocan Lake Garden Societies are co-hosting a day of celebration on Sunday, July 26 of our beautiful Japanese garden in New Denver, from 10 am to 5 pm.

Life is always changing. The comings and goings of our staff, as they weave their way through life’s stages in this past year, have left us waving goodbye and hello; we’ve seen a sideways shuffle and eagerly awaited a new baby.

Last summer Heather went to Ontario for a year and Tara came to do the Kaslo sales. Tania announced she was pregnant and took maternity leave at the end of

June ((Baby arrived July 11! Details to follow). Heather returned to apply for Tania’s job, but Rita beat her to it and took over Tania’s classified ad position.

So Heather moved in to Rita’s accounts receivable chair. Then Tara decided that carrying two full time jobs was too much (lightweight :) and decided to leave us to focus her energies in the area she studied for.

Staring Emma Chart as Mary Poppins, Quinn Barron as Bert, Emily Raynor and Felix Barron as Jane and Michael Banks, and Gideon Berry and Sophie Bell as George and Winifred Banks, this Capitol production features a total cast of 33 local up-and-coming youth performers. Adriana Bogaard, an alumna of the Capitol’s Summer Theatre Program herself, is thrilled to design the set for this group of talented youngsters. Currently a design student at the National Theatre School of Canada, Adriana is really excited to be involved with Capitol’s Summer Theatre Program this year to create some of the magical moments of Mary Poppins.

Capitol Theatre director Stephanie Fischer says, “Mary Poppins the musical is a wonderful fusion of elements from the classic Disney film and the beloved stories of P.L. Travers. It’s an enchanting, heartwarming show with an important message about love and cherishing what really matters. This is a not-to-be-missed production for families and people of all ages!”

Scooter Scooter is a 5 year old neutered domestic long haired, grey male.

He was surrendered to the East Kootenay BCSPCA on May 13, 2015 because his owner could no longer care for him. He was then transferred to our shelter on June 28, 2015.

Scooter is great with other cats. He is vocal, laid-back and affectionate.

Scooter was recently shaved due to mats, so he looks like a little lion at the moment. He doesn’t care for getting brushed, so a shave once a year might be more beneficial for him.

Kaslo Unity Bridge Spans The River!

At 1 pm on July 2 history was made in Kaslo, with the installation of the 5th Street Unity Bridge spanning the Kaslo River. Steel girders 118´ long were swung into place

by Gwill Crane Services, while spectators watched from the safety of Railroad Ave. Rapid Span had manufactured the steel in two sections, after which it was trucked to Kaslo to be unloaded by Glen Settle and then bolted together to form a single span. Enthusiastic cheers, shouts and whistles greeted the hard working Kaslo Trailblazers Society team as the huge crane slowly settled the steel girders upon the concrete abutments designed by Pennco Engineering, all within ¼˝ of the target placement lines.

After over 800 hours of volunteer work since early April, finally SUCCESS! Now work continues to complete the wood superstructure, including a roof, in a similar design to the 2007 bridge constructed further upstream as part of the Kaslo River loop trail.

Community Welcomes New Medical Trainees

Members of the Health and Hospital Committee of the LCCDTS were just some of the community members on hand to welcome seven new medical trainees to the Lower Columbia recently. The medical students and residents are part of two growing programs that are expected to have a positive, long term impact on recruiting new doctors to the region.

Through the UBC Rural Family Practice Residency Program, four medical residents a year will spend two years in the Kootenay Boundary. While the residents will split their time among several communities, a large portion of their training will happen at Kootenay Boundary Regional Hospital. At the end of their two years in the program, the residents will be ready to practice medicine.

The medical students are in the area as part of the UBC Integrated Clinical Clerkship Program. Currently in its fifth year of successful operations, the students spend their third year of medical studies doing rotations at KBRH, at Kootenay Lake Hospital in Nelson and at family medicine clinics throughout the Lower Columbia.

At a welcome dinner for the newcomers, members of the Health and Hospital Committee presented the students and residents with welcome packages filled with coupons and freebies to help them get out and explore all of the communities of the Lower Columbia. “We are really grateful to the businesses and organizations that contributed to the welcome packages,” says Don Nutini, chair of the committee. “We wanted to let these young people know we are excited to have them in the region for the next one to two years, and we want them to have a great experience.”

Welcome packages included free passes to Birchbank Golf Course, a dinner special at The Colander, a free day of skiing at Red Mountain, Smoke Eaters hockey tickets, along with passes for bowling, swimming, free coffee and more. The welcome package initiative is part of a Medical Professional Welcome Program, recently launched by the Health and Hospital Committee. Program volunteers provide tours of the region to medical professionals who are considering moving to the area, or to those who have recently arrived and want to better understand all that the area has to offer.

Aspiring to ignite and unite community within this region and beyond, this spiritually-charged festival has it all! Whether rising early to meditate or dancing late to the beat of world music (or both!), participants will be inspired by top local and visiting teachers, speakers and musical acts.

Events are hosted in many eclectic studios, venues and parks of Nelson’s beautiful lakeside-mountain town, where you are encouraged to walk and cycle between events and enjoy the vibrant downtown and beautiful mountain scape. Nelson provides an ideal location to celebrate mindful-living, love of nature and engaged community.

Comprising of a television series, in-class lesson plans and mobile and web support systems, the program’s topics focus on youth mental health and well being issues, including: Peer Pressure, Bullying, Family Dynamics, Addictions, Body Image, Depression and Anxiety.

The 13-episode television series entitled Teens 101 is currently in production helmed by veteran Producer & Director Daniel D’Or. “I want to produce this show that conveys to teens, that no matter what stressful challenges they may be facing, they’re not alone,” says D’Or. We want to empower youth with knowledge, tools and direction that they and their families may require.

The series combines dramatic recreations with intimate, anecdotal interviews - firsthand accounts from youth and their families. Each story will depict how individuals struggled through their experiences and ultimately found a way to regain control and get back on track. “These remarkable young people will now be seen as role models and even heroes to teen audiences and hopefully inspiring a greater empathy and understanding of each other” D’Or says.

Classroom lesson plans will be designed by the parent corporation of Canamedia and Teens 101 Inc., Magic Lantern Media Inc. who currently provides curriculumcorrelated media to schools across Canada. With a unique and forward-thinking lesson plan, Teens 101 will help meet the significant curriculum needs for this subject matter in Canada classrooms today.

The innovative approach to website and app design is also key to the initiative. “The program designs for our social media and web interactive campaigns are courageous and raw with our direct ‘teen-to-teen’ approach,” says Digital Producer, Brad Schroeder. “By utilizing a multitude of dynamic technologies we endeavor to engage today’s youth by communicating through mediums youth will connect with and understand.”

Permaculture Design Course

The Kootenay Permaculture Institute in partnership with Selkirk College is offering the 14th annual Permaculture Design Course in Winlaw, August 16 – 29.

Permaculture is a holistic approach to land-use planning. The permaculture concept originated in Australia in the late 70s and now many people, organizations and companies around the world are using permaculture design principles to plan and create more ecological and resilient projects.

Permaculture is the conscious use of ecological principles in designing self-sustaining food, fibre and energy producing ecosystems. The idea is to set up regenerative systems that work with nature – using a diverse number of species and activities, interdependence, recycling and conservation – with perennial plants including trees to produce a stable and self-reliant dynamic system.

Permaculture design evolved from the observation of natural ecosystems that are usually abundant, resilient and often very diverse in species and in the relationship between species. You can create an abundance and diversity of food in your own backyard by using permaculture design principles and techniques while using only a small amount of energy, resources and time to implement and maintain the design. Permaculture systems can be developed in any climate and on any scale.

The Permaculture Design Course will cover the principles of permaculture design and the different techniques that can be used on your land or in your small urban backyard. It will include many hands-on activities at the farm

in the Slocan Valley. The farm where the course is being held was started in 1993 using permaculture principles.

It now produces a diversity of perennial vegetables, berries, fruits and nuts as well as many medicinal herbs and other useful plants. The participants will also work on a permaculture design exercise. Some of the topics covered during the course will include: Permaculture principles and techniques, site analysis, soil fertility, organic gardening, edible landscaping, fruit and nut trees, agroforestry, microclimate, water uses, forest ecosystems, land restoration, ecological building and urban permaculture.

The instructor Gregoire Lamoureux has been living in the West Kootenay for over 25 years and is one of the most experienced Permaculture teachers in Canada.

Guest speakers will include Barb Hazenveld who grew up in Alberta and traveled to Australia where she learned permaculture with Bill Mollison as well as Shanon Bennett who is an environmental educator and founder of Huckleberry Adventures, a program dedicated to instilling appreciation for the wonders found in the wilds of our backyards.
