Morning pursuit leads to arrest of two people BY ARWYN RICE PENINSULA DAILY NEWS

PORT ANGELES — Two Port Angeles residents were taken into custody Thursday morning after a two-hour chase and search of the woods and neighborhood near Peninsula College following the second reported theft of the same car. The car, a 1993 Honda Civic, had been reported stolen Jan. 10.

The owner had come back into possession of it, said Deputy Chief Brian Smith of the Port Angeles Police Department, adding that he did not know how or when that happened.

Reported stolen twice The owner reported the car stolen a second time Thursday morning, Smith said. Stephanie Lynn Case, also known as Stephanie Boucher, 26, was booked into the county jail Thursday for investigation of theft of a car and eluding police and on two warrants after being located by a police dog working with a tracking team and Penin-

sula College security team members, Smith said. Robert Lee Coberly, 35, was found in the area and was booked for investigation of possession of a stolen vehicle in a case related to the Jan. 10 stolen car report. Coberly was not booked for the Thursday morning incident, Smith said, adding that that investigation is continuing. An officer had seen Coberly in the car before it was reported Jan. 10, Smith said. After it was reported stolen, probable cause was developed for arresting him for investigation of possession of a stolen vehicle. TURN

Contractor, Nippon duel on lawsuits BY PAUL GOTTLIEB PENINSULA DAILY NEWS

PORT ANGELES — Nippon Paper Industries USA and a Louisiana company have filed competing, multimillion-dollar lawsuits over Nippon’s stalled biomass cogeneration plant. Factory Sales & Engineering Inc., now doing business as FSE Energy, filed its $6.2 million breach-of-contract lawsuit against Nippon on Nov. 10 in U.S. District Court. Nippon’s Dec. 8 answer was a three-pronged, $10.85 million claim against FSE alleging breach of contract, negligence and negligent misrepresentation. Since both companies are also seeking attorney fees, a final

award could exceed the stated amount each is seeking. The issue: Who is responsible for a leaky, cracked boiler at Nippon’s upgraded, costlier-thanexpected, $85 biomass cogeneration plant?

Burning wood waste The plant burns biomass — or wood waste — to create steam to generate electricity that the company can sell to others. The companies have until Jan. 28 to hold a telephone conference with Western U.S. District Court Judge Robert J. Bryan of Tacoma to discuss the basis of their claims and a possible settlement, according to court documents. TURN
