The City of Peachtree City has adopted a new ordinance regulating massage establishments and massage therapists. The new rules require businesses offering massage services to obtain a regulatory fee certificate and comply with certain other provisions of the law.
A regulatory fee certificate is required to open and/or operate a massage establishment in the City of Peachtree City. The ordinance, checklists, instructions, and applications are found by visiting city hall or online at www.peachtree-city.org/massage.
The applicant must be 18 years or older and the owner of the premises or holder of a lease where the business will be conducted. All application requirements must be submitted and met prior to the issuance of the regulatory fee certificate.
The applicant must submit to a background check and must be a citizen of the United States or an alien lawfully admitted for permanent residence for at least one year prior to application.
Each massage therapist employed at an establishment must be licensed to practice massage therapy in the state of Georgia via a license or provisional permit.
The city may, from time to time, make inspections of the business to determine compliance.
Price rates for all services and state-issued massage therapist licenses or provisional permits for each massage therapist working in a massage establishment must be prominently posted in the reception area in view of all customers.
Massage establishments and therapists shall only operate between the hours of 7:00 a.m. and 9:30 p.m
No alcoholic beverages shall be sold or provided to customers.
Ordinary beds and/or mattresses are not allowed within the business
Facility windows are not allowed to be tinted, blocked, or obstructed.
All employees, massage therapists and other persons on the premises, excluding customers, shall remain completely clothed at all times.
No one under 18 shall receive care at a massage facility without written permission from a parent, guardian, or licensed physician.
The following people are exempt from holding a regulatory fee certificate while personally practicing their respective profession(s):
Licensed physicians, surgeons, chiropractors, osteopaths, and physical therapists.
Nurses who are registered under Georgia law.
Licensed barbers, beauticians, nail technicians, and nail estheticians; provided that they only massage the neck, face, ears, scalp, feet, hands and hair of the customer, and that the customer remains fully clothed. Any other persons specifically exempted by OCGA 43-24A-19.
Violations of the massage establishment ordinance may result in the suspension or revocation of both the establishment's regulatory fee certificate and occupational tax license. In addition, violators may be fined up to $1,000, sentenced to up to 180 days in jail, or both.
