But these technologies remain unevenly adopted, and few bar associations have issued specific guidance on how they intersect with privilege and ethical conduct. Without a shared vocabulary or formal interpretation of what “reasonable protection” looks like in this era, the legal profession risks creating an ethics gap: one where best intentions outpace regulatory certainty, and where compliance is defined more by technical competence than professional consensus.

Ultimately, confidentiality must be reframed as contextual trust, earned not just through discretion, but through infrastructure design, access control, and contractual clarity.

The tools lawyers now rely on to protect information, cloud systems, encryption, decentralised ledgers, are also reshaping the legal landscape itself. Confidentiality remains a core value, but its expression is no longer confined to closed doors and locked filing cabinets. It lives in code, in cloud regions, and in zero-knowledge transactions. As law continues to evolve alongside technology, the profession must embrace a new kind of vigilance. Confidentiality isn’t disappearing, it’s transforming. And to uphold it, legal professionals must become fluent not only in doctrine, but in architecture.

unified standard creates confusion, especially for firms operating in multiple jurisdictions. In some cases, compliance in one state could constitute ethical ambiguity in another.

Are Ethics Boards Falling Behind?
