Some 46 veterans from Flagler County were guests of the Rotary Club of Flagler County last week for lunch at Pine Lakes and a program honoring those who served. The keynote speaker was U.S. Army CWO2 Dan Kabrich who advised veterans to speak out about their experiences in the military. He said they should not be ashamed of what they were asked to do.

‘We...are...family’:

Two local families celebrated National Adoption Day with six others who adopted a total of 17 children. JEFF DAWSEY STAFF WRITER

A

fter a judge officially ruled Tobin to be Allen and Serena Lapp’s son, Serena grabbed Tobin’s face and exclaimed, “You’re all mine! You’re all mine!” The Tobins were one of eight couples who became parents to a total of 17 children adopted through Community Partnership for Children on Friday, Nov. 18, at the Plaza Resort and Spa in Daytona Beach. On the cusp of the holiday season, over 100,000 foster kids nationwide are seeking adoption. But, thanks to families like the Bennetts and Gaffords — Flagler County residents — a lot of children have found forever families that they will begin to make memories with.

THE GAFFORDS

Although they’d finalized their adoption of 13-year-old Savannah earlier this year, Scott and Heidi Gafford attended the ceremony, and Savannah delivered an emotional speech that drew tears and applause from around the room. When asked about her transition from foster care to a “forever family,” Savannah said, “It has been exciting, but some parts have been difficult, just adjusting to change. But the attention my parents show me, that gets to me a lot.” “Yes, we give her a lot of attention,” her mom, Heidi added. In her speech, Savannah spoke about the food, clothing and love she barely received before. “At one of the houses we stayed for a while, the lady only had (food) when she expected a visit from the state,” Savannah said. “Before workers would come to the house, she would say, ‘Y’all hop in the car and let’s go get some food.’ At least we would have food for a couple of days.” She also talked about the process of getting adopted. “The problem is when you’re up for adoption, you worry that if you do the wrong thing, they’ll figure out they don’t want you,” she said. “But now I have people that are there, even when it’s hard.” The Gaffords married three years ago and wanted to extend

their family. Upon getting Savannah, Heidi said, “It was meant to be from the moment we met her.” THE CAULEYS

John and Amy Cauley became new parents for four children — T.J., 13, Aleigha, 11, and twins Tessa and Tanner, 9 — who are also their nieces and nephews, whom they’ve cared for for three years. The state removed the four siblings from their mother and allowed the Cauleys to take them. After their mother completed her case clearance, the state returned the children, only to remove them and send them back to their aunt and uncle. A few weeks later, their mother died in a car crash. “At first they were getting counseling, and we showed them continued support,” Amy Cauley said. John and Amy already have two children, a 24-year-old and a 17-year-old. Going from nearly emptying the nest to now having four more children, Amy said, the couple had to brace themselves for the transition. “We were like, ‘Oh, here we go!’” she said. “There’s a big age gap between our two older ones and these, and the four are close in age, so we experience a lot of your typical sibling arguments that we’re not use to. It took a lot of adjustment, but we’re on track.”

Flagler County swore in two new county commissioners and one returning, re-elected commissioner at a special investiture meeting Nov. 22. David Sullivan and Donald O’Brien took their seats at the dais for the first time, succeeding, respectively, former commissioner Barbara Revels, who served for eight years; and former commissioner George Hanns, who served for 24 years. Charlie Ericksen, a commissioner first elected in 2012, won re-election against challenger Jason DeLorenzo and was sworn in again. In their remarks at the end of the meeting, Sullivan and O’Brien both thanked the public and their predecessors on the board. Sullivan thanked Revels for “eight years of service on this board and the many good things she has accomplished.” He said that before the day’s swearingin ceremony, he’d spoken with County Clerk Gail Wadsworth, who’d showed him the minutes from the county’s very first County Commission meeting, in July of 1917. “The first board members were serious about their positions, and I intend to follow in their footsteps with what I hope will be the same attention to the job as we enter our 100th year,” Sullivan said. O’Brien said he remembered how former Palm Coast city coun-

cilman Bill McGuire had written down and regularly referred to his campaign goals. He said he planned to do the same, and then listed some of his goals: “Accountability, making sure we get to rewriting our strategic plan and moving forward and planning for the future, coordination and cooperation with our cities, engagement with the citizens and increased engagement though social media, and newsletters, town halls … and also, very importantly, supporting the job creators in our local economy,” he said. Speaking of his predecessor, Hanns, O’Brien said that it’s “not easy to succeed a legend.” He referred to a passage in the biography of John Adams by David McCullough, in which Thomas Jefferson arrives in France as ambassador and is asked by the French foreign minister if he was replacing Benjamin Franklin, his predecessor. Jefferson had replied, “I succeed. No one can replace him.” “That’s how I feel about Mr. Hanns: Nobody replaces him,” O’Brien said. “I’m humbled to be your servant, I look forward to getting started,” he continued, addressing the audience assembled for the meeting. With the recent election, voters voted out the board’s only two Democrats, Hanns and Revels, and the board is now composed entirely of Republicans. Sullivan, O’Brien and Ericksen — plus current commissioner Nate McLaughlin, whose seat was not up for election this year — comprise the entirety of the Board of County Commissioners at this time. The commission’s fifth seat, for District 2, has gone unfilled since Commissioner Frank Meeker died this past July. It will be filled by gubernatorial appointment. The commission voted unanimously at the special Nov. 22 meeting to approve McLaughlin as its chairman, and Ericksen as its vice chairman.

David Sullivan takes the oath of office to become a Flagler County Commissioner.

On deputies’ health and safety Sheriff: 2/3 of deputies are ‘very physically fit.’

BRIAN MCMILLAN EXECUTIVE EDITOR

Before a new deputy is hired at the Flagler County Sheriff’s Office, he or she is required to pass a physical fitness test, including a 1.5-mile run that must be completed in 15 minutes and 20 seconds or less. After that, there are no fitness requirements. This is troubling. Everyone I’ve spoken with

L ETTE RS

PalmCoastObserver.com

THURSDAY, NOVEMBER 24, 2016

about this has been surprised that there isn’t a yearly fitness evaluation of some kind. I asked Sheriff Jim Manfre about the issue this week. Considering the physical demands of the job, would the community be safer if deputies had a yearly fitness requirement? “Yes, of course,” he said. That was refreshing to hear. So why is there no test? One factor is the reality of hiring deputies. Sometimes, especially now that the economy is improving, there are not enough quality applicants. To resolve the problem, Manfre decided to suspend the physical fitness portion of the initial hiring test for a time.

As a result, all deputies hired from Sept. 26, 2014, to April 29, 2016, were never given a fitness test of any kind. Although the deputies’ union opposes yearly fitness tests (see the letter below from Jon Dopp), Manfre sees a compromise: Offer deputies more money if they will pass a voluntary fitness test. That’s a start, and I hope Sheriff-elect Rick Staly will pursue something like that. Manfre also just announced this week that a new gym has been completed at the Sheriff’s Operations Center, giving deputies a safe place to work out. Again, this is a step in the right direction. But the agency still seems to be in denial about the problem of deputies being out of shape. Neither Cmdr. Jim Troiano

nor Rick Staly were as direct as Manfre was in saying that it was a safety concern. Meanwhile, two deputies contacted me to say they were glad I had published the story because they feel less safe knowing the deputy they call for backup in a dangerous situation might be out of shape. That’s why it’s puzzling that the union itself isn’t pushing for fitness requirements on its own; I would think the majority of their members would want it, especially if Manfre is correct in his estimation that only two-thirds of the deputies are “very physically fit.” This is a tough topic in a time when cops are under attack. They risk their lives for us, and I’m grateful. Hopefully we can work together to make sure they’re healthy and safe.

Should deputies have fitness tests? ‘Fit for Duty’ story only raises questions about an issue that doesn’t exist Dear Editor: I recently read an article you wrote for the Nov. 17 edition of the Palm Coast Observer, in which you raised concerns regarding the physical fitness of Deputy Austin Chewning after observing him giving chase to a suspect at the Flagler County Courthouse. As the vice president of the Coastal Florida Police Benevolent Association, I felt compelled to address a few matters with you directly after reading this article. First, I’d like to address the pursuit itself. As you alluded to in your article, pursuits are dangerous endeavors, whether in a vehicle or on foot. It is almost always prudent for a deputy to refrain from a fullon foot pursuit after a suspect. Protocol and experience dictate that a deputy use the tools at his disposal to establish a perimeter and locate the suspect using search teams, K9 assistance and air support. All of these tools greatly diminish the risk to the deputy and the risk to the general public — as well as the risk to the suspect. All-out foot pursuits without further thought are, and should be, discouraged. It is also worth pointing out that Deputy Chewning knew the offender that was fleeing from him. This fact made it possible for Deputy Chewning to seek arrest warrants for the offender and then apprehend him at a later time, with more resources and in a scenario that was tactically favorable to law enforcement. When researching this subject matter, one would need to request the Sheriff’s Office’s policy regarding use of force (General Order 022), which outlines considerations a deputy should make regarding subject factors before engaging in any use of force. For clarification, a foot pursuit is a form of “force” for the purposes of this discussion.

A primary factor to consider when deciding whether or not to engage in a pursuit of any kind, is whether or not the offender is known to law enforcement. Other factors include, to name a few: threat posed to the general public, whether or not suspect has weapons, the nature of the charge the suspect is wanted for, the perceived physical abilities of the suspect, etc. To say that the union “doesn’t allow” physical assessments is misleading. To be fair, Sheriff Jim Manfre and his administration have never asked the union to “allow it.” Formal physical assessments, as explained by Mike Scudiero, can be misused by administrations and used to target employees. There is no clear-cut way to evaluate a deputy’s physical ability in an objective way. A deputy’s physical ability is assessed every single day that they are at work; wearing 30 pounds of gear and participating in numerous activities that are physically exhaustive. Supervisors are empowered to document any performance deficiencies and to recommend remedial training to fix deficiencies where necessary. Deputy Chewning, in spite of your personal observations about his physical stature, is a model deputy. He is kind, compassionate and incredibly dedicated. He is by far one of the most motivated and promising young deputies at the Flagler County Sheriff’s Office, and your biased, surface-level evaluation of his abilities is shameful. Your public humiliation of him without proper research was even more so. Your article referenced the fact that Deputy Chewning was built like “a lineman on a football team.” I remind you that a football team would not be successful without their linemen. Just like a football team, law enforcement requires a team of people with varying strengths and abilities to allow us to get this job done safely and efficiently. Deputy Chewning’s decisions in this

case demonstrated maturity, responsibility and restraint — qualities that are highly coveted in a law enforcement professional. We are fortunate in Flagler County to not have had any plight between law enforcement and the community we serve. This is because of the positive and understanding attitude of the community, as well as the professional, responsible behavior of law enforcement. An article like this serves only to raise questions in the minds of citizens about an issue that doesn’t even really exist. I hope that you will publish this letter with the same publicity with which you defamed Deputy Chewning. I would ask that you come shadow a deputy for a 12-hour shift so you can learn more and your next article can have better perspective than this one did. JON DOPP Senior vice president Coastal Florida PBA/PEA

If the military can do it, so can the Sheriff’s Office Dear Editor: I just got done reading your article, “Fit for Duty,” in the Nov. 17 Palm Coast, and I found it very interesting and disappointing at the same time. Before I go into my thoughts, I do want to say that I am a staunch supporter of law enforcement, and they have my utmost respect. They have a difficult job to do, and in these days and ages, it is even more difficult, which is why I think this issue is even more important today than any other time. Now, saying that, I understand the concerns of Sheriffelect Rick Staly and others about the dangers of a footrace, but I very much disagree on the stance and reasons that the Police Benevolent Association gives for not having physical fitness standards.

I was in the military, and, as everyone knows, they do have standards that are strictly adhered to. Every soldier goes through a physical fitness test at least once a year. The judgment on who passes or fails on a physical fitness test is in black and white as an Army regulation. It is not up to interpretation. These standards must be met for a soldier to stay in the Army. The older the soldier gets, the less they are required to do to meet those standards. The body fat index standard also slides as they get older. I strongly believe we should mandate a minimum requirement once a year for a fitness test for all of our officers, as well. I have seen the shape of some of our officers. It’s not good. I am not out to embarrass anyone or body-shame anyone with this next statement, but I would be curious to see pictures of all of our deputies to see what kind of shape they are in. An officer doesn’t have to win every footrace, but he should at least have a fighting chance to do so. If Rick Staly was really serious and wanted to not only help our community and the health of our officers, he would immediately work with the PBA to get a program instituted that would require officers to meet a minimum standard. In the long run, everyone benefits from this: We have a fit Sheriff’s Office that we can depend on, with an added benefit of lower health care costs for both the county and the individual officers. It is a no-brainer and winwin for everyone.

In pursuit of a representative government

HEATHER BEAVEN GUEST WRITER

A few years ago, I had my DNA analyzed. I am not who I thought I am. As family folklore goes, it’s true that I am predominately British. I am not, however, German. I am Norwegian and French. I am also Sub-Saharan African. Let’s be clear, no one who has laid eyes on me would think I am of African descent, nor do I claim that knowing of my lineage gives me a deeper understanding of bigotry. But it has changed me. I no longer look at the world as a white woman. I am more than that. I am both a little less color blind and a little more color aware. While I will never be an African-American, I now know that I am an American with African blood, and I can never unknow that piece of me. Knowing what courses through you, changes you. Locally, this election has shone a light on a failure of the political parties. Women aren’t equally represented. Minorities aren’t proportionally represented. Anyone born after 1966 isn’t equally represented, nor is any military veteran. Over half (52%) of Flagler County residents are female, yet only 40% of those elected to a constitutional office or a municipal governing body are women. More troubling, only 11 women were on the ballot Nov. 8. When women win office in

DEALS SO GOOD WE MADE THEM LAST ALL MONTH.

Flagler County, it’s serious business. Four of our five cities have female mayors. If those four women referred five women each to the She Should Run political campaign incubator, we’d go a long way to balancing our ballot. But the onus isn’t just on these four. We should all encourage people of caliber to run for office. The lack of racial and ethnic diversity in our electoral choices is even more apparent. On election day, as identified by their bio, there were two African-Americans and zero Latinos represented. In a county in which 25% of residents identity as “non-white” or “not only white,” there is only one elected office holder who doesn’t look like the majority. While some office holders representing the smaller municipalities don’t have bios readily available, it is clear that Flagler finds itself in a lack of diversity in other key demographics as well. Seventy-five percent of residents are under 65; however, just 13% of our elected officials are under 50. In Flagler, 11% are veterans, and yet, after just replacing the only elected office holder who served in the military, we don’t have one single elected office holder who served. As a woman, Navy veteran and wife of an Army soldier, as a 48-year-old mother and as a person who recently discovered the richness of her own blood, I pray that we take this off-cycle time to re-think how we can use our own personal influence and our local political parties to do more to encourage a rainbow of people to vote and participate in our government. Heather Beaven lives in Flagler Beach and ran for Congress in 2012.

Respected Flagler Schools administrator Baker Acted Shawn Schmidli is ‘well-respected around the state,’ a district spokesman said. JONATHAN SIMMONS NEWS EDITOR

Respected Flagler Schools administrator Shawn Schmidli was detained under a Baker Act Nov. 16 after deputies saw him running nude down the sidewalk outside the Government Services Building on State Road 100. A statement from Schmidli’s family, forwarded to the press from the school district’s official spokesman, said that Schmidli had “suffered a medical episode that could have happened to anyone. This was NOT a drug or alcohol related event. His condition was caused by a bacterial infection. Thanks to the prompt response by the medical staff with treatment, we are looking forward to a speedy recovery.” Schmidli, 35, is the district’s assessment coordinator and a former Matanzas High School teacher. He’s won accolades in both roles, earning a slew of 5-star reviews on ratemyteacher. com as a biology teacher, and often being called upon to present statistics-heavy reports at School Board meetings in his role as an administrator. But on Nov. 16, someone called the Flagler County Sheriff’s Office at about 3:12 p.m. about a district employee acting “irrational” at the Government Services Building, according to a Sheriff’s

Office case report. A deputy arrived and saw Schmidli running undressed down the sidewalk, with a Flagler County Fire Rescue rescue ambulance driving beside him, its light activated, in the eastbound lane. Schmidli was “weaving back and forth” as he ran, a deputy wrote in an incident report. The deputy pulled up next to Schmidli and told him to stop, but he ran faster. The deputy drove his patrol car to the entrance of city plaza, blocking Schmidli’s path, and then chased Schmidli on foot when he ran around the car. The deputy took Schmidli to the ground and detained him on the grass shoulder of the road. Schmidli was speaking incoherently and couldn’t form a complete sentence, according to the report. The ambulance took him to Florida Hospital Flagler, and Schmidli was Baker Acted; he will be held for psychiatric evaluation to determine whether he’s a danger to himself or others. Schmidli is still employed with the district, but is on personal leave, Flagler Schools spokesman Jason Wheeler said. “He’s a valued member of the Flagler Schools family,” Wheeler said. “He’s well-respected around the state.”

Signs of the times? The child who drew the symbol has been removed from the bus by the school, according to police. JONATHAN SIMMONS NEWS EDITOR

Two 5-year-old boys were riding the bus home from Imagine School at Town Center on Nov. 17 when an older boy drew swastikas on the younger boys’ hands and arms and told one of the two that he’d draw another on his forehead the next day. Both of the 5-year-olds are of mixed race, and the boy who drew the symbol was white, according to the 5-year-olds’ families. “(My grandson) came off the school bus yesterday with a swastika written on his hand in green marker, and he thought it was a number or something cute. He didn’t know what the insignia was,” said Letty Comin, 49. “He’s 5. It was a very sad day yesterday that we had to explain what this meant, and that it wasn’t good.” Priscilla Aponte, 34, and the mother of the second 5-year-old boy, said that her mother met Aponte’s 5-year-old son at the bus stop and noticed the swastikas on his hand and his upper arm about 20 minutes later, and told Aponte. The ink had been partially rubbed off, but the symbols were still clearly visible. “I got so upset, because my 5-year-old didn’t know what it means,” Aponte said. “He was very sad, because he’s the kind of kid who gets along with everyone.

... to hear what it meant broke his heart.” The incidents come as reported hate crimes and bias incidents have surged after the presidential election, with the Southern Poverty Law Center, a national civil rights group, reporting on Nov. 15 that it had received 437 reports of “incidents of hateful harassment and intimidation,” including 35 incidents involving swastika graffiti, since Donald Trump became the nation’s presidentelect Nov. 9. “There have been a lot of things shown in the media lately with a campaign that was run completely on hate,” Comin said. “And I don’t want to blame everything on that, but our country is more divided than it’s been in a long time. … And it’s very scary to have to explain to a 5-year-old what that means. … I really believe it has a lot to do with what the children are hearing on TV.” Aponte also said she attributed the incident at least in part to climate surrounding the Trump campaign. “Racism, it’s out in the open now, more than ever,” she said. “With the racism being out there and Donald Trump speaking foul language and speaking of all different races and what we should do — it’s not appropriate, and it affects our kids.” Comin and her daughter Mercedez Owens — the 5-year-old’s

mother — have complained to the school about the swastika incident, and scheduled a meeting with school administrators for the morning of Nov. 18. Comin and Owens walked the 5-year-old to school Nov. 18 so he wouldn’t be on the bus with the same older boy again. The fifth-grader child who drew the symbol has been removed from the bus by the school, according to the Flagler County Sheriff’s Office. Imagine School at Town Center is a charter school and uses its own buses, which are separate from those used by the Flagler County School District, School District spokesman Jason Wheeler said. Comin said she’d like to see the older boy expelled. “Expelled permanently, because I’m afraid for the safety of (my grandson),” she said. Aponte also wanted to

see the older boy permanently removed from the school. And, she said, “I would like to meet the parents of that child, and find out what kind of parents they are … for their child to do this to a 5-year-old.” Rhonda Cagle, a spokesperson for Imagine Schools, said the school is investigating. “We are working to resolve it quickly,” she said. “We will take appropriate disciplinary steps in accordance with our code of conduct.” Cagle said that could mean anything from a verbal warning to expulsion, depending on the intent and knowledge level of the child who allegedly drew the swastikas. Privacy laws prevented her from saying what measures have been taken to separate the children so far, she said. “We can confirm that we are doing everything appropriate so that the younger children involved can consider our school and our transportation places of safety,” she said. “Our principal is totally focused on this incident right now … making sure that the campus — all students, all faculty — are aware of what our standards are when it comes to respect, civility, tolerance. … This is not consistent with what we expect of out students in terms of character.” Cagle said she has not heard of any other bias incidents at any of the many Imagine Schools nationwide since the election.

Comin said she’d complained to the Flagler County Sheriff’s Office, and a deputy gave her a case number but explained that what the older boy had done was not criminal. “They have said that in the state of Florida, simply drawing an insignia is not a hate crime unless it’s followed by violence,” she said. “That’s ridiculous.” A Sheriff’s Office spokesman confirmed that the Sheriff’s Office had taken a complaint from Comin’s family. A Sheriff’s Office news release stated, “The Flagler County Sheriff’s Office is currently investigating the placing of a swastika on the hand of a student attending the Imagine School in Palm Coast yesterday. ... Deputies are following up today to determine a motive, as well as to see if there are any more incidents that may have occurred.” After a deputy followed up on the case Nov. 18, a Sheriff’s Office spokesman wrote in an email to the press that the deputy “was able to verify today that the fifth-grade student who drew the swastika was only ‘goofing around.’ … In fact, when the deputy asked the fifth-grade student today what he drew on the child’s hand, he stated he did not know.” Comin said the family has contacted a lawyer to explore options. For now, she said, “My foremost concern is getting him safely into class.”

County to reimburse Revels for Ethics Commission legal fees

County Commission celebrates George Hanns’ 24 years of service

County Commissioner Barbara Revels will be reimbursed for $1,037 worth of legal expenses. JONATHAN SIMMONS NEWS EDITOR

Flagler County Commissioner George Hanns

Officials and residents celebrated County Commissioner George Hanns’ six terms of service as a commissioner in a ceremony Nov. 21 punctuated by Hanns’ one-liners and others’ tales of the dedication and the levity he’s brought to the board for 24 years. Hanns is leaving the commission — Donald O’Brien takes the District 5 seat in a ceremony Nov. 22 — but he’s not done working to serve the public. “My dream now is to have a veterans museum,” Hanns said at the event. “Actually, I need somewhere to hang out. I certainly am not going to be coming to County Commission meetings. I’m going to miss you all, but this is something that I’m honored to be a part of, and if I’m needed, I’ll be here.” About 100 people, including former and current officials, showed up at the event, held at 4 p.m. in the County Commission chambers before a regular 5 p.m. County Commission meeting. Many spoke to recount some of the projects Hanns has been

involved with — the county’s artificial reef program, renovations at Princes Place, the Veterans Memorial in front of the Government Services Building, among others — and to give him some good-natured roasting. “There’s a couple things that come to mind about George: The first is, good things come in small packages,” said County Commissioner Charlie Ericksen, towering over the more diminutive Hanns. Hanns’ competitor and successor, O’Brien, was in attendance, and Hanns threw a bit of the fun his way.

“Donald O’Brien, he’s the fellow who I allowed to beat me in this race,” Hanns joked. “And you notice I didn’t pick any sixfooter of the job,” he continued, to chuckles from the audience. County Commissioner Nate McLaughlin presented Hanns with a plaque recognizing Hanns’ 24 years of service, and FireFlight helicopter medic Roy Longo gave Hanns a FireFlight baseball cap. A montage of pictures of Hanns from over the years played on the TV screens in the commission chambers. Hanns, who often brings a digital camera and tripod to county events, gathered the crowd together for a group picture in the final minutes before the ceremony ended and his last County Commission meeting began. “When you do hear things from time to time about people in elected positions doing things improper, I have never experienced that in 24 years in Flagler County,” Hanns said. “We really have a good thing going in Flagler County and I hope it continues.”

The motion through which the County Commission approved reimbursement of Revels’ legal fees stated that the allegation concerned a matter that arose out of Revels’ public duties and that successfully defending against the allegation served a public purpose.

The Flagler County Commission voted unanimously Nov. 21 to reimburse Commissioner Barbara Revels for a portion of the legal expenses she paid to defend herself against charges before the Ethics Commission. Revels herself was on vacation, and was not present at the commission meeting. Revels had faced three related charges before the Ethics Commission concerning her vote on the purchase the old Memorial Hospital property for use as a new Sheriff’s operations center. The Ethics Commission fined Revels $2,500 over two of the allegations, finding that she had twice, without disclosing a potential conflict of interest, voted on the hospital purchase even though she was a business associate of the property’s owners through her shares in Intracoastal Bank. But the Ethics Commission did not find probable cause on the third charge, which alleged that Revels had accepted something of value meant to influence her vote by accepting an increase in her line of credit at the bank. The reimbursement that will be provided by the county will

Three of the original 12 criminal counts against former Flagler County elections supervisor Kimberle Weeks have already been dismissed, and the defense is asking Judge Margaret Hudson to dismiss the rest. Weeks is charged with surreptitiously recording private individuals and local and state officials to “have leverage” over them, and with releasing some of those recordings, according to the State Attorney’s Office. Recording a person without their consent — and disseminating that recording — is generally a third-degree felony in the state of Florida when the recording was done intentionally. But the defense argues in a motion to dismiss filed Nov. 15 that the individuals Weeks recorded did not have a “reasonable expectation of privacy” when she recorded them, and the recordings were therefore not illegal. The motion cites case law, arguing that courts, in various instances, have found that Man arrested in a reasonable expectation of connection with privacy does not exist in a perfatal DUI crash son’s place of business, or on a business phone line, or in places Florida Highway Patrol troopwhere a notice warns people of ers arrested William Gerald potential audio surveillance, or Schwarz, 52, on Nov. 18 in conin some situations where there nection with the March 11 State are other people within earshot. Among the individuals Weeks is charged with recorded are: Florida Secretary of State Ken Detzner; Florida Elections Division attorney Gary Holland; Flagler County Commissioner Charlie Ericksen; Flagler County Attorney Al Hadeed; County Judge Melissa Moore-Stens; Palm Coast City Clerk Virginia Smith; Holly Hill Police Department Officer Michael Coomans; and Shannon Brown, a Flagler County woman whose former husband was involved with Weeks’ daughter. Hudson, in a June 24 decision, had already agreed to throw out three counts, numbers 7, 8 and 9. Those counts pertained to the dissemination of one of the recordings after Weeks had already played it in a Flagler County Canvassing Board meeting, which made it part of the public record and its further dissemination not punishable, Hudson ruled.

JACQUE ESTES COMMUNITY EDITOR

Daytona State College benefactors Mori and Forough Hosseini were recognized as Philanthropists of the Year at a ceremony Nov. 18 at Oceanside Country Club in Ormond Beach. “They have worked effortlessly in the community, and with the Legislature to assure funding for critical mission projects and initiatives,” said Yoon Van Hout, the event’s emcee and the director of the Association of Fundraising Professionals, which organized the ceremony. “They have also personally contributed funds to support student programs and expansion projects, including the Mori Hosseini Center.”

Most recently, Daytona State was allocated more than $32 million in the past four years for a new student services and workforce transition facility. “We never think of this as philanthropy,” Forough Hosseini said. “We think of this as giving back. It’s a responsibility, making sure everyone else’s life is better.” Fourteen agencies had nominated someone for the National Philanthropy Day celebration at Oceanside Country Club in Ormond Beach. The Outstanding Corporate Philanthropist was presented to Bright House. To view all of the agency champion nominees, view this story at palmcoastobserver.com

hat’s the most popular girls high sport in Flagler County? If you guessed weightlifting, you’d be correct. At the beginning of the season, 100 girls (67 at Matanzas, 33 at Flagler Palm Coast) attended weightlifting tryouts for both high schools in the county. Lady Pirates head coach Sara Novak had to trim her program down to approximately 40 lifters. “I think when people come out and see it, and we look really good, that makes it an attractive sport for females,” Novak said. “And it’s not hidden anymore. It’s really exciting, because, who doesn’t want to max out?” Bulldogs’ coach Duane Hagstrom — a powerlifting national champion and world record holder — believes CrossFit has helped make the sport so popular in the community. “CrossFit has brought weightSEE GIRL POWER PAGE 14

love kids. They’re real. They often tell us what we don’t want to hear, and they expose a lot of our prejudices. As I was finishing up a sausage, egg and cheese biscuit under a pavilion during Flagler Baseball’s closing day games on Saturday morning, Karen Bullock, a 4-year-old, sat directly across from me and sparked a conversation. After introducing herself, she introduced me to Valerie, her Barbie Doll. She had just come up with that name, because she forgot her first one. Valerie is actually her other doll’s name as well. Karen went on to tell me about her family. She has two sisters; one is allergic to chocolate, and the other lets her play with all of her toys. We also had a conversation about my life. She asked if I was married (though I wasn’t wearing a ring), and I showed her a picture of my beautiful wife, Jessica. Karen said Jessica looked pretty, and said she liked her name. Assuming I had other things to do, Karen’s dad, Harry, tossed her his phone and suggested she watch Disney on Netflix. But she had other plans. “Can I take your picture,” she asked me. Seldom do I, the “photographer,” get asked to have my picture taken — and never by a kid — so of course I said yes. I then asked her to take a picture with me, and she didn’t hesitate. Having already made my morning, Karen offered me some of her Little Debbie donuts and then a sunflower seed. I didn’t want the calorie-filled donut, and I didn’t want to refuse everything she offered, so I took the seed. I realized that she was eating the seeds whole, so I taught her how to crack the outer shell to get the inside. Karen told me it tasted a lot better. It’s good for gender equality.” Hagstrom said it’s more exciting to watch a girl lift a lot of weight than a guy. “You expect it from a big strong guy ,” he said, “but see a little small girl get under her body weight or more is way more exciting.” The two coaches have developed a friendship where they assist each other in various ways

Closing day for Cam and Bray: Flagler Baseball honors kids with cancer during closing day ceremony JEFF DAWSEY

“They’re worthy kids. They both have never-die attitudes.”

SPORTS EDITOR

Flagler Baseball wrapped up another season with a closing ceremony Saturday, Nov. 19, at the Flagler Fairgrounds. After the medals, trophies and plaques were handed out, those in attendance surrounded the 25 items that were donated to be raffled off. Raffled items included Pampered Chef kitchen tools, assorted baskets, fishing gear, fishing charters, gift certificates and more. All proceeds from the raffles and the concessions went to Cameron Fulling and Brayden Lane, two of the league’s players who are battling cancer. They’re worthy kids, “said league President Carl Sanderson. “They both have never-die attitudes, and you could see Cam’s family just about having to carry him out of here.” “Cam and Brayden still have ongoing expenses and treatments, so we just want to help the family,” Sandra Sanderson said. Flagler Baseball gave both families $1,600 from cash profits and is expected to donate a lot more. The league has donated $28,000 to local families. The league has had a recent growth spurt: From last fall season, the league grew from 14 teams to 22, and its enrollment increased from 140 kids to 230.

FPC's Nick Zipf chooses Daytona State

Isabella Rodriguez places 20th at allstar meet

Flagler Palm Coast pitcher Nick Zipf recently signed his letter of intent to continue his playing career and education at Daytona State College. Zipf has experienced success in every league he's played. He began Nick Zipf playing the game in New Jersey. There, he pitched the Cherry Hill little League team to a Cooperstown championship. Zipf hit a home run and struck out nine in six innings. Last year, Zipf recorded a walk-off hit that helped his team advance to the Perfect Game championship. He and his team went on to win the 16U championship. Two seasons ago, he assisted the Bulldogs in winning their district championship.

Matanzas Lady Pirate Isabella Rodriguez finished 20th at the FACA Cross Country Senior All-Star Classic Saturday, Nov. 19, at Apalachee Regional Park in Tallahassee. Rodriguez recently committed to continue her cross country career and education at Christian Brothers University in Memphis, Tennessee.

Victoria Woroniecki chosen for U.S. Synchronizing squad

Palm Coast's Victoria Woroniecki — a member of the Flagler County Synchro Belles — was selected to the 2017-2020 Senior USA Synchro National Training Squad. Woroniecki was also chosen to train for the FINA World Championships that will take place in July 2017 in Budapest, Hungary. She, along with Anita Alvarez, was selected to the duet squad.

Lady Bulldogs open season with early win streak The FPC Lady Bulldogs beat University 57-24 and Mainland 43-31 to open the season on a two-game win streak. The Bulldogs are playing with a young team this year, with only two upperclassmen, both juniors, on the roster.

Flagler Baseball players hit rare home runs

Michael London

Michael London and Sam Horton recorded home runs this past season with Flagler Baseball. Michael, who played in the Rookie Division, hit the only over-the-fence home run in his division, and Sam became the first player in at least three years to hit a home run over the 15-foot fence in the Major League Division. Both players were awarded trophies for their accomplishments.

or the DiRosa family of Palm Coast, the Macy’s Thanksgiving Day Parade is a tradition. Before moving to Palm Coast four years ago, the family celebrated Thanksgiving standing on the parade route. This year, they will once again find a spot along the route, but without their daughter Catherine. Catherine will be playing her clarinet in the Macy’s Great American Marching Band on Thanksgiving Day. She will be one of 250 students, representing all 50 states. “It’s so surreal to think I will be marching in the parade with Macy’s,” Catherine said. One of three drum majors at Flagler Palm Coast High School, Catherine isn’t the first drum major to march in the parade. Last year, her friend Lauren Perrotta also marched in the parade, and inspired Catherine to audition. With two drum majors being selected to participate two years running, what’s Band Director John Seth’s secret? “There’s no magical fairy dust. It’s hard work, and it pays off,” Seth said. “They have to be independent and take the initiative; this is all in their court. They have

Catherine DiRosa

to prepare an audition tape, prepare and meet deadlines. “ “Last June I sent in my audition on Youtube (https://youtu.be/ p1c3gIYNrws),” Catherine said. “My dad picked me up at work the end of July, and said, ‘Guess what came?’ There was a lot of screaming.” In her freshman year of high school, Catherine moved from Long Island, New York, to Palm Coast. She had been involved in a concert band since she was in the fourth grade, and had absolutely no interest in joining the FPC marching band. “I was going to quit (band),” she said. “I was not going to do the marching band. It isn’t my thing.” She credits Seth with not only with helping her change her mind about being in a marching band, but also helping her decide on her career. “I had no idea how much fun the marching band could be. Mr. Seth very much changed my life and my outlook,” Catherine said. “He has been a mentor for me.” Catherine plans on studying music composition in hopes of a career of writing musical scores for film. She has been accepted to Stetson University, but would like to go to a New York school. “I would like to try that,” she said. “I might also be a teacher.” FPC Band Director John Seth and drum major Catherine DiRosa at the the FBA Music Performance Assessment in October. PETS OF TH E WEEK

I

was hoping to start my column this week with the news that Phelps, the pup fished out of the Intracoastal, had been adopted, but alas, it hasn’t happened – yet. I will let you know when he has a home. Recently, I was interviewing a man who pulled out his wallet to show me a photo. His wife? Children? Grandchildren? No, it was a picture of his dog. We love taking pictures of our pets, and this is the time of year some folks may try to take their own holiday card, or newsletter photos. As someone who has taken pet photos for more than 20 years, here are some things I have learned. n Have fun and have patience. n Do not expect your pet to pose. n Set up the area where you want to take the photo, before bringing the pet into the room. n Have treats, but don’t advertise it. n Shoot, shoot, shoot. Do not snap one photo and then another. Use a digital camera so you can press on

the shutter and take multiple, rapid fire, photos. Last Christmas, I took a photo of Kodi at the computer, glasses on the tip of his nose, as if he were writing the column. My son saw it and asked what was wrong with my laptop’s keyboard (only an IT guy is going to be looking at the keyboard). I had put treats on the keyboard seconds before and fired away. I took 20 pictures to get two I really wanted. No problem – not like it’s film! Some of you may have pets that will wear a costume; others have dogs like my friend’s dog Trip-E, who shredded the red scarf during our photo ses-

sion last week. He was having a dandy time playing tug-ofwar with himself, and I had fun shooting away. After a few pictures, we did get the scarf off him and out of his mouth. Keep your camera phone handy over the holidays. The best photos are those candid moments, when the cat is batting the balls on the bottom of the tree, or in my case, when Rosie, the African Grey, landed in our decorated tree. Don’t overthink it – just shoot. Focus on the eyes and use natural light if possible. Send in your holiday pet photos for guest pets of the week!

BLACK FRIDAY DEALS Both humane societies will be closed to the public on Thursday, Nov. 24. But the sales begin on Friday. Flagler Humane Society will have free adoptions Nov. 25 through 27. Regular operation hours. Halifax Humane Society will have their annual Black Friday promotion. All black, or predominately black, animals are $10, all others will have half-off adoption fees. The shelter will be open from 8 a.m. to 7 p.m. on Friday, Nov. 25.

Stockings for soldiers Soldiers in Iraq will have very special Christmas stockings to open this year. COMMUNITY EDITOR

The Palm Coast Landing senior living community room looked a lot like Santa’s workshop on Wednesday, Nov. 16. Red and white stockings were being filled by residents, staff and three students from Rymfire Elementary. The team of more than 20 filled 100 stockings with items for U.S. soldiers stationed in Iraq. Items going into the stockings included toiletries, small puzzles, DVDs, playing cards and more, donated by local residents. “I go to Curves and I put a box there, and they kept filling

it,” organizer Liz Principe said. “Everyone was so generous.” The items will be shipped by the Invisible Warrior project, along with something special from the students at Rymfire Elementary and the Boys and Girls Club: 450 hand-written cards. The project was sponsored by Dale Woodward Funeral Homes and Veterans, Family Memorial Care and the Veterans Burial Society. “A lot of the soldiers don’t have family at home,” Principe said. “No one even sends them a card. I read some of the cards the children wrote, and they were so moving.”
