affairs by the country s intelligence apparatus On March 25, six IHC judges out of a total strength of eight wrote a startling letter to the Supreme Judicial Council (SJC) members regarding attempts to pressure judges through abduction and torture of their relatives as well as secret surveillance inside their homes The letter was signed by judges Mohsin Akhtar Kayani, Tariq Mehmood Jahangiri Babar Sattar Sardar Ejaz Ishaq Khan Arbab Muhammad Tahir and Saman Rafat Imtiaz A day later calls had emerged from various quarters for a probe into the investigation, amid which CJP Isa summoned a receivables from Exploration and Production (E&P) companies owed by state-owned gas utilities have soared to Rs 1,500 billion, with over $600 million payable to foreign companies This revelation was made in a letter written to the petroleum minister Musadik Masood Malik by Pakistan Petroleum Exploration and Production Companies Association (PPEPCA) According to PPEPCA our industry is confronting a complex array of challenges that require urgent action Foremost among these challenges is the alarming amount of outstanding receivables from Sui Southern Gas Company Limited (SSGCL) and Sui Northern Gas Pipelines Limited (SNGPL) which currently stands at a staggering Rs 1,500 billion of which over $600 million is payable to foreign companies These delayed payments are becoming a significant barrier to the upstream companies’ ability to invest in their assets Consequently we are witnessing a marked decline in indigenous oil and gas production with the shortfall being balanced by costly energy imports, especially LNG, or otherwise, resulting in growing energy shortages This critical issue of mounting receivables is not only affecting the financial health of companies within the industry but is also jeopardising the broader energy security and foreign investments into Pakistan The issue is also undermining the confidence of investors and creditors, hindering the necessary capital flow and technology for essential exploration and developmental activities This is evidenced by the fact that no new international upstream company has invested in any block or opportunity on offer over the past few years, while a number of international E&P companies have exited the country PPEPCA in its letter also highlighted that the severe cash flow crisis is pushing companies to drastically cut exploration and development activities Till February 2024, out of the planned 23 exploration wells for the year, only nine were spud Currently, only 19 out of the available 42 rigs are operational in the country and there is substantial reduction in seismic activities Even development wells are being put on hold as companies are reluctant to bring additional gas volumes to market This loss of activity has already curtailed / reduced around 300 MMscfd of gas production,” reads PPEPCA letter However in order to manage the crisis the PPEPCA also suggested the petroleum minister to take steps without further delay otherwise PPEPCA member companies may be forced to reduce/suspend production operation operations leading to a massive shortage of gas which the country may not be able to cover by importing expansive LNG As per PPEPCA s suggestion, the government should provide budgetary grant/Tariff Differential Subsidy (TDS) of at least Rs 75 billion to SSGC and SNGPL for partially adjusting the accumulated revenue shortfall instruct State Bank of Pakistan (SBP) for allocation of foreign exchange for making payments to foreign E&P companies in an equitable manner and work towards underground gas storage facilities to avoid any curtailment of indigenous gas It is relevant to note that E&P sector currently produces 3 200 MMscfd of natural gas along with 70 000 bbls of indigenous oil This output represents 35% of the country s primary energy supply However, it is alarming to see that a sector of such vital importance has been crippled due to a massive and ongoing default by the state-owned gas utility companies (SSGCL and SNGPL) Responding to questions sent by this scribe, the Petroleum Division said that financial strain faced by E&P companies is a inherited issue, and the government is fully committed to finding solutions for these outstanding payments We have been actively engaging with E&P companies to address these issues and are optimistic that a resolution will be reached in the coming weeks And, it is the duty of the Petroleum Minister to review all policies pertaining to the sector/ministry, said petroleum division,” said petroleum division officials in their response Furthermore the Petroleum Division has addressed inquiries regarding Musadik Malik s publicly expressed intentions to scrutinise policies sanctioned by the Council of Common Interests (CCI) and potentially reverse reforms implemented during the caretaker government’s tenure This includes the proposed review of the amendment to the Exploration and Production (E&P) Policy 2012 which currently permits E&P companies to sell up to 35 percent of gas to third parties While confirming that a handful of policies have indeed been under review the Petroleum Division clarified that the amendments to the E&P Policy 2012 have not yet undergone scrutiny by the minister The division refrained from offering detailed commentary on any policy prior to thorough review However, the division emphasised the petroleum minister’s unwavering commitment to bolstering the E&P sector ensuring the sustainability of the energy and petroleum value chain and alleviating the economic burden of energy particularly on country s vulnerable populations It is pertinent to mention here that as the country stands at the precipice of an imminent energy crisis the need for urgent critical issue of smuggled petroleum products which are posing threat to refineries upgradation project According to DG Oil s office memorandum, this illicit activity not only bleeds the economy but also jeopardises the opportunity for substantial investments in refinery upgradation The ramifications extend beyond the refinery sector impacting the profitability of oil marketing companies dealers and disrupting the White Oil Pipeline operations Moreover, currently refineries are carrying huge stock of High-Speed Diesel (HSD) due to availability of smuggled fuel in the market leading to upgradation projects are based on optimum capacity utilization of refineries The smuggling of petroleum products if continued would, therefore, seriously question the viability of these projects forcing the prospective investors to review their decisions The refinery policy which took four years in the making with its final approval in February 2024 has presented a golden opportunity not only to bring in huge investment but also substantially increase production of deficit products and meet environment friendly Euro-V specifications It would therefore be most unfortunate if the planned upgradation projects are delayed or abandoned due to continued illicit activity which is already bleeding the economy and has disrupted the entire supply chain of petroleum products; adversely affecting the refinery health White Oil Pipeline operations; and the profitability of Oil Marketing Companies (OMCs) and dealers We have raised this issue at various forums but unfortunately no Spirit) and HSD (High Speed Diesel) during the fiscal year 2022-23 starkly resembles the figures recorded during the tumultuous period of the COVID-19 pandemic in FY 2019-20 While the decline in GDP growth rate from 6 11% in FY 22 to 0 29% in FY23 may partly explain this downturn however unfortunately the Year To Date sales of MS and HSD have further plummeted by approximately 6 5% (July-February FY 2324 vs FY 22-23), casting doubts on the veracity of projected GDP growth rate of +1 7% for FY 24 Similarly the Monthly To Date (MTD) sales figures of MS and HSD in March 2024 exhibit an alarming variance of -12% and -21% respectively, against the forecasts established in the Product Review Meeting for the harvesting season Such high negative variances signify product glut lower refinery throughput choking of WOP and restrained sales volumes The OCAC maintained that the illicit trade has disrupted the entire supply chain of petroleum products adversely affecting the refinery health, White Oil Pipeline operations and the profitability of Oil Marketing Companies (OMCS) The significant price disparity between legitimate and smuggled fuel coupled with widespread availability and weak border controls, is causing irreparable damage to legitimate businesses Any hindrance to local POL production necessitates increased imports resulting in substantial financing costs for OMCs as they operate on razor-thin margins The oil industry continues to lose business to the illicit trade; simultaneously, the government continues to lose revenue from Petroleum Levy, Customs Duty, Corporate Tax Super Tax etc Reportedly the Petroleum Dealers of retail outlets have also raised grave concerns about the unabated surge in fuel smuggling to Pakistan, causing them sales and revenue losses The unchecked proliferation of substandard smuggled petroleum products not only drains the government revenue but also fuels a shadow economy making it increasingly challenging to monitor and regulate illicit activities The detrimental effects of substandard smuggled petroleum products on the environment vehicle engine and safety standards should not be left unattended anymore The influx of fuel through illicit channels will gravely impact the foreign direct investment required for the upgrade and modernization of refineries under the Brownfield Refinery Policy OCAC also submitted following recommendations for implementation without delay: (i) implement robust enforcement measures to control the expansion of the illicit sector (border control); (ii) conduct well-coordinated, regular nationwide crackdowns in collaboration with federal and provincial authorities; (iii) declare smuggling a grave crime categorized as a punishable offense Propose legislation to Parliament advocating declaration from the court that the actions detailed in the IHC judges’ letter of March 26 purportedly indicating interference by state institutions in judicial matters are unconstitutional and pose a IR A N I A N President Ibrahim Raisi ended his four-day three–city visit to Pakistan with the shadow of the USA not entirely removed from the relationship between the two neighbours Though Iran has said it has completed work on its gas pipeline to Pakistan Pakistan has not and Iran has threatened to impose the penalties provided in the agreement
Pakistan has pleaded that it does not want to have US sanctions imposed on it Pakistan continues to court the USA and avoid its ire while Iran has challenged it for years While the joint statement said there had been an agreement on the pipeline the absence of details indicated that there had not been any substantial agreement This split on the USA has had strong regional implications Iran has grown closer to Russia and China, and drawn away from India It is not that Pakistan is opposed to Russia or China, or friendly to India, but the big difference in the relationship is the USA Another point where Iran opposes the USA is Israel Again, Pakistan is not on the USA s side in this, though it is not actively antiIsrael Iran is engaged in a confrontation with Israel, which has led to the exchange of missiles, but the fears of a general expansion of the Gaza conflict have not yet taken place

To reduce the gender gap in education targeted interventions are needed, which include tailored programmes for recently dropped out girls and programmes of literacy for young girls who left education years ago– a literacy numeracy and life skill programme would be a more targeted approach for this group Besides in order to increase the number of schools promoting Public Private Partnerships (PPPs), as is done in Punjab in primary education, and expanding it to other levels of education, may yield positive results in terms of enrolment of girls in education Additionally better management of public schools particularly those in rural areas can also contribute to enhanced girls enrolment Currently 2 5 percent of GDP is allocated to the education sector, which is far from the 4 percent international average This should be increased to 4 5 per cent as per the recommendations of the World Bank to narrow the educational gaps and ensure quality education for all especially girls Girls education needs to be given top priority The education of girls is a primary catalyst for personal growth, social advancement and economic development Promoting girls’ education is not just a matter of giving the right of education to girls rather it is a transformative mission that can yield dividends to a nation on multiple fronts whether political economic or social and has an impact on many aspects of human development Without prioritising girls education, a nation will not be able to compete with other economies of the world and the dream of its progress will always remain a dream

Though the trade volume would depend on several factors such as infrastructure capacity, ease of trade regulations, and market demand However, with the potential opening of new trade routes and access to the warm waters of the Arabian Sea through Karachi and Gwadar Port trade volumes could be substantial
If CPEC were extended through Afghanistan to Central Asia, the benefits for Pakistan could be significant It could further enhance Pakistan’s strategic position as a trade hub increase connectivity with Central Asian markets and boost economic growth
In dollar terms the benefits could include increased revenue from transit fees expanded trade opportunities, and improved economic ties with regional countries This would strengthen Pakistan’s geopolitical position and the development of infrastructure along this route would stimulate economic growth

For Afghanistan, the direct access to China through the Wakhan border would enable Afghanistan to carry out its entire trade of over $1 3 billion with China through this route As a result Pakistan could potentially experience a reduction in its geopolitical advantage and security leverage over Afghanistan Alternatively Afghanistan would reduce its dependence on Pakistan and vulnerability to disruptions in transit trade, thus weakening Pakistan’s ability to use security concerns Afghanistan would potentially seek closer ties with other regional powers diminishing Pakistan s geopolitical leverage in the region
For China, the opening of the Wakhan border would give a much-needed boost to extending Chinese reach to diverse markets as part of the Belt and Road Initiative However security and cross-border terrorism will continue to be Beijing s primary focus
Therefore the opening of the road will largely depend on the ability of the Taliban to maintain control over Afghan territory, prevent the emergence of any real threat to China’s domestic security by groups and militants inside Afghanistan and Chinese willingness to set up a border control regime and construct necessary infrastructure such as roads highways and bridges to link Afghanistan with China through the Wakhan Corridor After the opening of this trade route, all traffic originating from Afghanistan for China either via sea or through the Karakoram Highway will be diverted toward the Wakhan border This route will assume high significance as China is increasingly tapping many areas of Afghanistan for mining precious and rare minerals China has signed impressive deals, including a $10 billion deal for access to lithium deposits in Afghanistan and a $3

In Sunday’s speech, Modi directly referred to Muslims as “those who produce more children” and “infiltrators” evoking a sinister conspiracy theory that the Muslims are outsiders and aim to outnumber the Hindu majority
The prime minister is clearly playing a dangerous game, turning the election into a war between Hindus and Muslims, and the BJP is openly calling itself the party of Hindus It is not wrong to conclude from his speech that he has accepted that his voters are only Hindus Other leaders of his party have made that clear as well
Last year Assam Chief Minister Himanta Biswa Sarma declared that he did not want the votes of Miya (Bengali-speaking Muslims)
Some analysts feel that the BJP has become desperate as it has not received the expected support in the first phase of the elections
This desperation has driven it to try its old formula of Hindu polarisation by generating the fear of a Muslim takeover of India
But if we look at Modi s speeches since the beginning of this election campaign, we can see that right from the start, he has been giving statements that portray the opposition parties as anti-Hindu For example he said the Congress manifesto bore the imprint of the Muslim League referring to the political party founded under British colonialism to secure Muslim rights He also claimed that the opposition leaders had the mindset of Mughals, India’s 16-18th century Muslim rulers and that they insulted Hindus by eating fish during sacred Hindu occasions and eating meat during the Hindu holy month of Sawan He said they do so to please their own voters Who can these voters be but Muslims? That the opposition leaders are indulging in anti-Hindu practices to appease Muslims is a completely absurd assertion given that the opposition also needs Hindu votes and cannot
afford to do anything to alienate them But lack
of logic has not stopped Modi and the BJP from repeating these claims in an attempt to provoke Hindus against Muslims This is a clear violation of the ECI’s Model Code of Conduct according to which no one is allowed to solicit votes or campaign on religious or communal grounds
It is also a violation of the People s Representative Act, which treats communal propaganda as a crime The law says, Appeals by a candidate, or any other person with the consent of a candidate to vote or refrain from voting on the ground of his religion race caste community or language is a corrupt electoral practice If found guilty under this provision an individual can face up to six years in jail

N D I A N Prime Minister Narendra Modi and his Bharatiya Janata Party (BJP) have decided that they will contest this seven-phase national election as champions of Hindu interests They have also made it clear that protecting Hindu interests means protecting them from Muslims According to them the Hindu majority face danger as the opposition Congress party is conspiring with the Muslim community to rob them of their wealth and entitlements and hand them over to Muslims On Sunday, the prime minister told a rally in Rajasthan that if the opposition comes to power it will take Hindus wealth and give it to those who have more children clearly referring to Muslims He then went on to call the Muslim community infiltrators Modi s comments caused outrage in some quarters Citizens and organisations from across the country have asked the Election Commission of India (ECI) to take action against him for his hate speech The rights group People s Union of Civil Liberties has even demanded that Modi be disqualified from contesting elections for that overt communal incitement These reactions did not result in any change of rhetoric; in fact, the prime minister doubled down two days later On Tuesday in his address at another election rally in Rajasthan Modi once again claimed that the Congress was conspiring to take the wealth of Hindus and distribute it among select people To ensure that there was

charges are criminal so one question for the High Court will be whether the Nixon precedent also applies to criminal prosecution It’s hard to believe it wouldn’t, since the threat of prison could influence a President far more than a civil lawsuit Yet the trial judge in the Jan 6 case and the D C Circuit Court of Appeals blew through this precedent as if it didn t exist The three-judge circuit panel also wrote its opinion as if Mr Trump is sui generis a unique threat to democracy and thus no other former President would ever be charged with a crime But as David Rivkin and Elizabeth Foley argue nearby this ignores the reality of our current politics Four Democratic prosecutors have decided to charge Mr Trump (three on criminal charges) In doing so they have unleashed partisan furies that future prosecutors will exploit If Democrats think President Biden won t at least be investigated for crimes by GOP prosecutors after he leaves office, they aren’t paying attention If the Court rules that Nixon v Fitzgerald applies the next question concerns whether the acts Mr Trump is charged with fall within that outer perimeter of his duties This is in part a factual question about Mr Trump s actions and motivations In the Jan 6 case, Mr Smith has cited numerous Trump actions to justify his four charges One of them is lobbying Vice President Mike Pence to block Congress s certification of Electoral College votes That was wrong about what Mr Pence could do under the Constitution, but Presidents talk to their Veeps all the time and Mr Pence was free to say no The same goes for Mr Trump’s calls asking state election officials to look for electoral fraud Mr Trump argues that he was merely trying to ensure the election was honestly conducted, which he says was part of his duty as President The Supreme Court could decide this question in the current proceeding though it doesn t have to As the three liberal Justices wrote recently in their unhappy concurrence in Trump v Anderson, the Court shouldn t address more questions than it must be to decide a case On that logic, the Justices could (and probably should) remand the “outer perimeter” question to the trial court for fact-finding and judgment Some of Mr Trump s actions might then qualify for immunity while others might not *** Such a remand would infuriate Democrats and the media who want Mr Smith s trial to begin soon and convict him before the election Sending the case back to the trial court could delay the trial past the election But this is one of the risks of using lawfare to defeat a political opponent The job of the Supreme Court isn’t to follow the election calendar Its duty is to consider the facts and law in the context of America s constitutional order It needs to think of the Presidency, and the separation of powers, as much as it does this former President The current Court has been acting as if it is up to this job no matter how unpopular a decision might be politically What matters is buttressing our institutions against today s gale force partisan winds On presidential immunit y (Trump included) WALL STREET JOURNAL E d i to r a l B oa r d The job of the Supreme Cour t isn’t to follow the elec tion calendar Its dut y is to consider the fac ts and law in the contex t of America’s constitutional order.
