ForthisCode,thefollowingdefinitionsapply:
1.“University”meansSoutheasternLouisianaUniversity.
2.“Student”isanypersonwhohasgainedadmissiontotheinstitution.
3.“RecognizedStudentOrganization”meansagroupofpersonswhohavecompliedwith theformalrequirementsforUniversityrecognition.Unlessotherwisestated,theseterms areinterchangeablewiththeterm“student”asitrelatestoallareasoftheStudentCode ofConduct.
4.“UniversityPremises”meansanybuilding,facility,orpropertyowned,leased,operated, controlled,orsupervisedbytheUniversity,includingclassrooms,residencehalls,dining facilities,recreationalareas,athleticfacilities,andoffices.
5.“UniversityActivities”meansanyactivityoreventsponsored,organized,orsanctioned bytheUniversity,whetheronoroffcampus,includingbutnotlimitedtoclasses, meetings,seminars,performances,athleticevents,andsocialevents.
6.“UniversityOfficial”meansanypersonemployedbytheUniversityinanadministrative, executive,supervisory,academic,research,orsupportcapacity,includingbutnotlimited tofaculty,staff,administrators,andcampuspoliceofficers.
7.“Shall”isusedintheimperative/mandatorysense.
8.“May”isusedinthepermissivesense.
9.“ProscribedConduct”meansanybehaviorthatisinviolationofthisCode.
10.“Sanction”meansanycorrectiveorrestorativeactiontoremediateaStudentCodeof Conductviolation.
11.“Adjudicator”meansaUniversityofficialauthorizedonacase-by-casebasistoimpose sanctionsuponthestudent(s)ororganization(s)foundtohaveviolatedtheStudent CodeofConduct.
12.“HearingBoard”meansagroupofUniversityadministrators,students,and/orfacultyor staffmembershearingcasesarisingfromstudentviolationsofUniversitypolicies.
13.“HearingBoardAdvisor”meansthepersonwhooverseesandleadsthehearingprocess, ensuringproceduralfairness,advisingonrulesandpolicies,facilitatingcommunication, andmaintainingconfidentiality.
14.“Appellate”or“AppellateAdjudicator”meansanindividualorcommitteethat determineswhetherthedecisionwasreasonablebasedontheGroundsforAppeals identifiedwithinthiscode.
15.“Complainant”meansthepersonwhoallegesaviolationoftheStudentCodeof Conductbyastudentorstudentorganization.Thirdpartiesreportinganincidentarenot complainants.
16.“Respondent”meansanystudentorstudentorganizationwhoallegedlyviolateda universityrule,regulation,orpolicy.
17.“Witness”meansapersonwhocangiveafirst-handaccountofanincidentandmaybe invitedtoprovidetestimonyorevidencerelevanttothecase,buttheirparticipationis notmandatory.
18.“Advisor”meansanypersonchosenbythestudenttoprovidesupportandguidance throughoutthedisciplinaryprocess.
19.“Investigator”meansanyUniversityofficialgatheringinformationfortheConduct AuthorityorHearingBoardtodeterminewhetheracodeofconductviolationoccurred.
20.“Complaint”meansawrittenstatementoftheessentialfactsconstitutingaUniversity regulationorruleviolation.Complaintsmaybefiledonlineorinperson.
SoutheasternLouisianaUniversityhaschargedtheOfficeofStudentAdvocacyand AccountabilitywiththeresponsibilityofadministeringtheStudentCodeofConduct.TheVice PresidentforStudentAffairs,ordesignee,isresponsibleforensuringthattheadministrationof theStudentCodeofConductiscarriedoutfairlyandimpartially.TheVicePresidentforStudent Affairs,ordesigneehastheauthorityto:
1.Initiatedisciplinaryproceedingsagainststudentsaccusedofviolatingthe Code;
2.ServeasaAdjudicatororappointanInvestigatororHearingBoardAdvisorto conductdisciplinaryhearings;
3.Imposedisciplinarysanctionsuponstudentsorstudentorganizationswhoare foundtohaveviolatedtheCode.
A.JurisdictionoftheUniversity
StudentsatSoutheasternLouisianaUniversityareprovidedacopyoftheStudentCodeof ConductannuallythroughtheOfficeofStudentAdvocacyandAccountability’swebsite. StudentsareresponsibleforreadingandabidingbytheStudentCodeofConduct’sprovisions.
1.ApplicationoftheCode: TheStudentCodeofConductandthestudentconductprocess applytotheconductofindividualstudents,bothundergraduateandgraduate,andall RecognizedStudentOrganizations.Forstudentconduct,theUniversityconsidersan individualtobeastudentwhenthepersonhasgainedadmissiontotheinstitution.
2.EnrollmentStatus: TheUniversityretainsconductjurisdictionoverstudentswhochoose totakealeaveofabsence,withdraw,orhavegraduatedforanymisconductpriortothe leave,withdrawal,orgraduation.Ifsanctioned,aholdmaybeplacedonthestudent’s abilitytore-enrolland/orobtainofficialtranscriptsand/orgraduate,andallsanctions mustbesatisfiedpriortore-enrollmenteligibility.Intheeventofseriousmisconduct committedwhilestillenrolledbutreportedaftertheaccusedstudenthasgraduated,the Universitymayinvoketheseprocedures.Shouldtheformerstudentbefound responsible,theUniversitymayrevokethatstudent’sdegree.
3.Purview: TheStudentCodeofConductappliestobehaviorsoncampus,atUniversity sponsoredeventsandmayalsoapplyoff-campuswhentheUniversitydeterminesthat off-campusconductaffectsasubstantialUniversityinterest.AsubstantialUniversity interestisdefinedtoincludethefollowing:
a.Anysituationwhereitappearsthatthestudent’sconductmaypresentadanger orthreattothehealthorsafetyofselforothers;
b.Anysituationthatsignificantlyimpingesupontherights,property,or achievementsofselforothersorsignificantlybreachesthepeaceand/orcauses socialdisorder;
c.AnysituationthatisdetrimentaltotheUniversity'seducationalmissionand/or interests;or
d.Anysituationwheretheconductadverselyaffectstheuniversitycommunity, pursuitofitsobjectives,orneighboringcommunities.
JurisdictionappliestoallUniversitylocations,includingwheretheUniversityisextendedto distanceeducation,suchasstudyabroad,servicetrips,experientiallearningopportunities, athletic,clubsports,andothergrouptravel.Jurisdictionmayalsobeappliedtobehavior conductedonline,viae-mail,orthroughelectronicmediumsincaseswherethebehaviorisnot protectedbyfreedomofspeechandexpression.TheUniversitydoesnotregularlysearchfor
onlineinformationbutmaytakeactionifsuchinformationisbroughttotheattentionof UniversityOfficials.
1.GuestsandVisitors: AStudentmaybeheldaccountableforthebehavioroftheirguests orvisitorsonUniversityPremises.IfaguestisfoundtobeinviolationoftheStudent CodeofConduct,applicablepoliceactionmaybebroughtagainsttheguest,anda studentconductcomplaintmaybebroughtagainstthestudenthostorthehoststudent organization.GuestsandvisitorsoftheUniversitymayalsoreportpotentialviolationsof theStudentCodeofConductcommittedbystudentstotheUniversityPolice DepartmentortheOfficeoftheDeanofStudents.
2.ViolationofLaw: Ifastudentischargedwithanoff-campusviolationoffederal,state,or locallaws,butnotwithanyotherviolationofthiscode,restorativeactionmaybetaken andsanctionsimposedforgravemisconductwhichhasadetrimentalimpactonthe University’seducationalfunction.
StudentsmaybeaccountabletoexternalauthoritiesandtheUniversityforactsthatconstitute violationsoffederal,state,orlocallaw.AtthediscretionoftheUniversity,disciplinary proceedingswillcontinuenormallyregardlessofpendingadministrative,civil,orcriminal proceedingsarisingfromthesameorotherevents.Theoutcomesofdisciplinaryproceedings willnotbesubjecttochallengeonthegroundthatcriminalchargesinvolvingthesameincident havebeendismissed,reduced,orarepending.
Whenastudentischargedbyfederal,state,orlocalauthoritieswithaviolationoflaw,the Universitywillnotrequestoragreetospecialconsiderationforthatindividualbecauseoftheir statusasastudent.Iftheallegedoffenseisalsothesubjectofaproceedingbeforeahearing bodyundertheStudentCodeofConduct,however,theUniversitymayadviseoff-campus authoritiesoftheexistenceoftheStudentCodeofConductandhowsuchmatterswillbe handledinternallywithintheUniversitycommunity.
TheUniversitywillcooperatefullywithlawenforcementandotheragenciesinenforcing criminallawoncampusandintheconditionsimposedbycriminalcourtstorehabilitatestudent violators.Individualstudentsandfaculty/staffmembers,actingintheircapacities,remainfree tointeractwithgovernmentalrepresentativesastheydeemappropriate.
B.Amnesty
Thepurposeofthisamnestypolicyistoensurethatstudentsactpromptlyinemergency situationswithouttheadditionalconcernoffacingdisciplinaryconsequences,thussafeguarding theirhealthandwell-being.TheOfficeofStudentAdvocacyandAccountability(OSAA)may grantamnestyincertaincases.Studentswhotakereasonableactiontoprevent,stop,orreport violationsoftheStudentCodeofConductmaybeprotectedbyamnesty.
● Limitations: OSAAmaygrantamnestyonacase-by-casebasistostudentswho proactivelyseekmedicalhelpforthemselvesorotherswherethehelp-seekingstudent mayhavebeeninvolvedinunderagedrinkingorotherimproperuseofalcoholordrugs (illegal,OTC,orprescribed)atthetimeoftheincident.Amnestydoesnotpreventany actionsthatanylawenforcementagency,includingSoutheasternUniversityPolice,may take.
● EducationalFollow-Up:Whileamnestyprotectsstudentsfromdisciplinaryaction, studentsmayberequiredtoparticipateineducationalprogramsorcounselingsessions relatedtosubstanceuse.Theuniversitymayrequirestudentstoattendworkshopsor meetwithacounselortoaddressthebehaviorandprovidesupport.
● OtherViolations:Amnestywillnotbegrantedforotherpolicyviolations(outsideof alcoholanddrugrelatedviolations)thatmayhaveoccurredduringtheincident.
StudentsatSoutheasternLouisianaUniversityareexpectedtoconductthemselvesas responsiblecitizensandtorespecttherightsanddignityofothers.Proscribedconductincludes, butisnotlimitedto,thefollowing:
1.ActsofDishonesty. Actsofdishonestyareanyformoffraudulentbehaviororviolation ofthe AcademicIntegrityPolicy.Actsofdishonestyinclude,butarenotlimitedto:
● Cheating,plagiarism,orotherformsofacademicdishonesty;
● FurnishingfalseinformationtoanyUniversityofficial,facultymember,oroffice;
● Forgery,alteration,ormisuseofanyUniversitydocument,record,orinstrument ofidentification.
● ImpersonatingaUniversityofficial,faculty/staffmember,office,student,oragent oftheUniversity.
2.DisorderlyConduct. Disorderlyconductdisturbsanorderlyfunctionorprocessofthe Universityand/orinfringesontherightsofothers,includingbutnotlimitedto:
● Lewdorindecentbehaviororconduct;
● Interferingwiththedutiesofastudent,faculty/staffmember,orUniversity official;
● Interferingwithanapprovedcampusdemonstration;
● Leadingorincitingotherstodisruptascheduledorordinaryactivitywithinthe Universitypremises.
3.AbusiveConduct. Abusiveconductisanyformofharassment,verbalabuse,retaliation, threatening,orintendingtocauseharm,stalking,orviolentbehavior,includingbutnot limitedto:
● Intentionallycausingharm,causingphysicalinjurytooneselforothers,ortaking anyactionagainstanypersonwithsuchrecklessdisregardthatharmmight result;
● Engaginginanyrepetitivebehaviorthatisthreateningorintimidatingtoanother personorthatisdisturbingtoanotherperson;
● Demonstratingunwantedorobsessiveattentiontoindividualsorgroupsin personorelectronically;
● Behaviorthatcouldcauseapersontosuffersubstantialactsthatalarm,cause fear,orseriouslyannoysuchotherperson(s),andthatservesnolegitimate purpose;
● Repeatedorhostilebehaviorsthatareasonablepersonwouldfindintimidating orthatwouldharmanotherperson,includingbutnotlimitedtobullyingand cyberbullying.
● Actsofbiasorviolationofthe DiscriminationandHarassmentPolicy.
4.Power-BasedViolenceorSexualMisconduct. Power-basedviolenceisanyformof interpersonalviolenceintendedtocontrolorintimidateanotherpersonbyasserting powerovertheperson.Sexualmisconductissexualharassment,abuse,assault,and/or sexdiscriminationprohibitedbyTitleIX.Sexualmisconductcasesmaybeadjudicated undergeneralconductorTitleIXproceduresbasedonjurisdiction(see Power-based ViolenceandSexualMisconductPolicy).
5.Endangerment. Endangermentisconductwhereanindividual'sactionsornegligence createasubstantialriskofputtingsomeoneorsomethingindanger.Thiscaninclude recklessbehaviororunsafepracticesthatjeopardizeothers'well-beingorsafety, including,butnotlimitedto,violationsofthe CoastingDevicesPolicy.
6.DrugViolation. Drugviolationsaretheuse,possession,manufacturing,distribution,or saleofcannabis,cocaine,narcotics,orothercontrolledsubstances(including over-the-counterdrugs,prescriptiondrugs,anddrugparaphernalia),exceptasexpressly permittedbylaw.
7.AlcoholViolation. Alcoholviolationistheunauthorizedorillegaluse,possession, manufacturing,distribution,orsaleofalcohol;publicintoxication;operatingavehicleor othermodeoftransportationundertheinfluenceofalcohol;oranyviolationofthe University’sAlcoholPolicy(SeetheStudentAlcoholPolicy).
8.AbuseofProperty.Theabuseofpropertyincludesallformsofpropertyabuse,including butnotlimitedto:
● Theintentional,malicious,ignorant,ornegligentdestruction,damage, disfigurement,orimproperuseofpublicorprivateproperty.
● ThetakingofpropertybelongingtotheUniversity,individuals,businesses,or organizations;Thisincludesactionssuchasshoplifting,embezzlement,andother formsoftheft,whetherpermanentortemporary;or
● Violationofthe CopyrightPolicy
9.Trespassing. Trespassingreferstounauthorizedpresenceon,in,orwithinany University-ownedoroperatedspace,includingvirtualspaces,buildings,andresidence
halls.Italsoincludesenteringorremaininginafacility,office,orresidencecontrolledby anotherpersonafterbeingaskedtoleave.
10.WeaponsViolation. Weaponsviolationistheunlawfulpossession,display,discharge, use,orsaleofweapons,threateningorattemptingtoinflictawound,causeinjury,or incapacitatewithaweapon,andincludesbutisnotlimitedtoallfirearms,switchblade knives,kniveswithbladesfiveormoreinchesinlength,ordangerouschemicals.A weaponisanyobjectthatisspecificallydesignedtoinflictharmordamage,orany objectusedwiththeintenttocauseharmordamage.
11.ExplosivesViolation. Anexplosivesviolationincludesthepossession,display,discharge, use,orsaleofexplosives,bombs,incendiarydevices,orfireworks(includingfirecrackers andammunition),aswellasattemptsorthreatstousesuchitems,exceptwhen requiredforauthorizedclassroominstruction.
12. AbuseofComputersandOtherTechnology. Abuseofcomputersandothertechnology isunauthorizeduseofelectronicorotherdevicestorecordaudioorvideoofindividuals inareaswheretheyhaveareasonableexpectationofprivacy(e.g.,lockerroomsor bathrooms)isprohibited,especiallyiftherecordingmaycauseinjuryordistress. Additionally,sendingorpostingobsceneorabusivemessages,videos,orimages electronicallyisalsoprohibited,includingviolationsofthe ResponsibleComputing Policy.
13.SafetyViolation. Asafetyviolationistheunauthorizedorimproperpossession,use,or tamperingwithemergency,fire,publicsafety,orsecurityequipment,devices,or systems,includingbutnotlimitedto:
● Creatinghealthorsafetyhazards,suchasdangerouspranks,climbingoutofor ontowindows,balconies,orroofs.
● Failingtopromptlyevacuatefacilitiesinemergenciesorinresponsetofire alarmsandcodes,orinappropriatelyusingthefirealarmsystem;
● Burningorattemptingtoburncandles,incense,oranyflammablesubstances thatposeafirehazardtopropertyorindividualsontheUniversitycampus.
14.ViolationofOtherPublishedUniversityPolicies,Rules,orRegulations. Violationof OtherPublishedUniversityPolicies,Rules,orRegulationsreferstoviolationofaformal guidelineorstandardestablishedbytheuniversitytogovernthebehaviorandactivities ofstudents,faculty,staff,and/orothermembersoftheuniversitycommunity.These policies,rules,andregulationsaredesignedtoensureorderlyconduct,upholdacademic standards,andpromoteapositiveandsafelearningenvironment.Theyaretypically documentedinofficialuniversityhandbooks,codesofconduct,orsimilarpublications andcaninclude:
● Policies:Broadprinciplesorrulesthatoutlinetheuniversity'sstanceonvarious issues,suchasacademicintegrity,discrimination,andcampussafety.
● Rules:Specificdirectivesormandatesthatmustbefollowed,detailingparticular requirementsorprohibitions.

15.ViolationofFederal,State,and/orLocalLaw. ViolationofFederal,State,and/orLocal Lawisviolatinganylocal,state,orfederallaw,includingbutnotlimitedto:
● Useoftobaccoproductsore-cigarettes,e-vaporizers,orelectronicnicotine deliverysystemsoncampus(see TobaccoFreeCampus);
● Gamblinginviolationofthelaw;
● Litteringorotheractionswhichendangertheenvironment(see Anti-Litter Policy).
16.FailuretoComply. FailuretoComplyisthefailuretoactinaccordancewithlegitimate directivesofauthorizeduniversityofficials,lawenforcement,oremergencypersonnel. Thisincludesbutisnotlimitedto:
● Failuretoidentifyoneselfortoshowanidentificationcardwhensorequested;
● Failuretocompletesanctionsbythedaterequiredoragreedupon;
● Violationofanydisciplinarysanctionand/orinterimmeasures;
● Failureofstudents,theirguests,orvisitorstocomplywiththoserulesand regulationsofpublisheduniversitypolicies,rules,orregulations.
17.AbuseoftheCampusDisciplineSystem. AbuseoftheCampusDisciplineSystemrefers toabreachoftheUniversityStudentCodeofConductwhereinastudentintentionally manipulatesorexploitsthedisciplinaryprocesses,includingbutnotlimitedto:
● WithholdinginformationrelevanttoanyinvestigationcarriedoutbyaUniversity officialorauthorizedagentoftheUniversity;
● Manipulatingorexploitingthedisciplinaryprocessesforpersonalgain,toevade responsibilityformisconduct,ortounfairlytargetothers;or
● Falselyreportinganincident.
18.Disruption. Disruptionisdisturbingthepeaceandgoodorderoftheuniversityor surroundingcommunities,includingbutnotlimitedto:
● Theintentionalobstruction,interruption,hindrance,ordisruptionofteaching, research,administration,ceremonies,disciplinaryproceedings,orother Universitytasksandactivities;
● Creatingexcessivenoisewhichcanbeheardinotherareasofthecampusand whichinterfereswiththenormaloperationsoftheUniversity;
● EngaginginmaladaptivebehaviorthatisdisruptivetotheUniversity's educationalprocess;
● Classroombehaviorthatseriouslyinterfereswiththefacultymember’sabilityto conducttheclassortheabilityofotherstudentstobenefitfromtheinstructional program(see StudentBehaviorintheClassroomPolicy).
19.Hazing.(RefertoHazingPolicy) Hazingisanyintentional,knowing,orrecklessactbya personactingaloneoractingwithothersthataredirectedagainstanotherwhenbothof thefollowingapply:
I.Thepersonkneworshouldhaveknownthatsuchanactendangersthe physicalhealthorsafetyoftheotherpersonorcausessevereemotionaldistress. II.Theactwasassociatedwithpledging,initiating,affiliatingwith,participating in,holdingoffice,ormaintainingmembershipinanyorganization.
A.StudentRightsandPrivileges:
1.Therighttolearnandpursueknowledgeinanenvironmentthatisrespectfuland conducivetolearning.
2.Therighttobefreefromharassmentordiscriminationbasedonrace,color,religion,sex, nationalorigin,age,disability,veteranstatus,oranyotherbasisprotectedbylaw.
3.Therighttoexercisefreedomofspeechandassemblyprovidedthatsuchexpression doesnotinfringeontherightsofothersordisrupttheeducationalprocess.
4.TobeinformedoftheStudentCodeofConduct,itscorrespondingprocedures,andallof therightsenumeratedherein;

27.Therighttoconfidentialitytotheextentpermittedbylaw.
28.Toprivacy,asappropriateandindicatedbyFamilyEducationalRightsandPrivacyAct (FERPA),throughouttheinvestigationanddisciplinaryprocess.
Asmembersofthecampuscommunity,studentshavearesponsibilitytoupholdthevaluesand standardsoftheinstitution.Thisincludesmaintainingacademicintegrity,respectingtherights anddignityofothers,andadheringtoallfederal,state,andlocallawandtherulesand regulationssetforthbytheinstitution.
Studentsareexpectedtocontributetoasafeandinclusiveenvironmentbyactingwithhonesty, beingaccountablefortheiractions,engaginginconstructivedialogue,stayinformedbyreading communicationsfromtheUniversity,andinformmembersoftheirpartyofUniversity communications.Theyarealsoresponsibleforactivelyparticipatingintheireducational experience,attendingclassesregularly,meetingdeadlines,andseekinghelpwhenneeded. Additionally,studentsshouldrespectcampusproperty,complywithinstitutionalpolicies,and contributetotheoverallwell-beingofthecommunity.
Anyuniversitycommunitymembermayfilecomplaintsofmisconductagainstastudentonline (see ReportIt).AlwayscallUniversityPoliceat985-549-2222or911incaseofanemergency. ComplaintsshallbepreparedinwritinganddirectedtotheOfficeofStudentAdvocacyand Accountabilityor,inviolationsoccurringintheUniversityresidentialfacilities,toUnivesity Housing.
Writtencomplaintsshouldincludethefollowing:
1.Fullname,localaddress,phonenumbers,and,ifpossible,“W”numbersofthe complainant,accused,andwitnesses.
2.Thespecificconductstandard,policy,and/orruleallegedlyviolated(theConduct Authoritymaydeterminethis);
3.Thedate,time,location,andpersonsinvolvedintheincidentunderinvestigation;
4.Anarrativeoftheincidentdescribingwhatoccurred;
5.Copiesofpertinentwitnessstatements,policeand/orhousingreports,and/or 6.Anyotherphysicalevidence(photographs,writtendocuments,items,etc.)
Complaintsshouldbesubmittedimmediatelyaftertheincident,preferablywithinten(10) businessdays.Barringunusualorextenuatingcircumstances,complaintsmaynotbeaccepted forincidentsthatoccurredmorethan30businessdayspriortofiling.
Uponreceiptofanallegedviolationreport,theUniversitywillconductapreliminaryreviewto determinewhetherthereporthassufficientinformationormerittowarrantaninvestigation.If thereissufficientinformation,theUniversitywillinvestigatewhetherviolatingtheStudent CodeofConducthasoccurred.IftheUniversitydeterminesthataviolationhasoccurredbased onClearandConvincingEvidence,thestudentwillbeprovidedwithwrittennoticeofthe allegedviolation,includingspecificsectionsoftherulesorpoliciesviolatedandanyevidence collected.
TheinvestigationofallegedviolationsoftheStudentCodeofConductwillbeconductedusing the"ClearandConvincing"standardofevidence.Thismeansthattheevidencepresentedmust behighlyandsubstantiallymorelikelytobetruethanuntrue,establishingafirmbeliefor convictionintheallegations.
IfitisconcludedthatthefactsdonotsupportafindingofaviolationbyClearandConvincing Evidence,thematterwillbeclosedandtheConductAuthoritywillrecordthefinaldispositionof thematteras“Closed.”TheConductAuthoritywillsendaletterofoutcometothecomplainant, withaninvitationtomeettodiscuss,atthecomplainant’sdiscretion.Neitherthefactofan investigationnorthelackoffindingwillbereflectedontheinvolvedparties’officialconduct record.
TheUniversitywillgrantequalrightstostudentswhoarecomplainantsindisciplinary proceedings.Thisincludesofferingthesameopportunitiesforboththerespondentandthe complainanttohaveotherspresentduringproceedings,allowinganunrestrictedchoiceof attorneyornon-attorneyadvocate,andprovidingsimultaneousnotificationoftheinstitution's appealproceduresforbothparties,ifapplicable.
Studentsaccusedofviolationshavetherighttoberepresentedbyanattorneyora non-attorneyadvocateattheirownexpense.Thisrightextendstoboththerespondentandthe complainant.Studentswillbeinformedoftheirrightsinwritingbeforeschedulingany disciplinaryproceedings.Officiallyrecognizedstudentorganizationsaccusedofviolationsare alsoentitledtorepresentationbyanattorneyoranon-attorneyadvocateattheirownexpense, arightthatsimilarlyappliestoboththeaccusedorganizationandthecomplainant.
Writtennotificationofthenameandrelationshipofanadvisortothecomplainantor respondentmustbesubmittedtotheHearingBoardAdvisoratleast48hourspriortothe hearing.Partiesmustkeeptheiradvisor,confidentialadvisor,andothermembersoftheirparty informedofcommunicationsfromtheuniversity.
Studentsmayrequestaccommodationsduringadisciplinaryprocesstoensurethattheyreceive afairandequitablehearing.Theseaccommodationsmightincludeadditionaltimetoprepare forhearings,thepresenceofasupportperson,ormodificationstotheformatofthe proceedingstoaddressspecificneeds.TheUniversityiscommittedtoprovidingnecessary adjustmentstosupportthestudent'sabilitytoparticipatefullyintheprocesswhilemaintaining theintegrityandfairnessofthedisciplinaryprocedures.Requestsforaccommodationsshould
bemadepromptly,allowingtheinstitutionadequatetimetoassessandimplementthe necessaryarrangements.
Theuniversityisnotrequiredtouseformalrulesofevidenceindisciplinaryproceedings.The university,however,shallmakegoodfaitheffortstoincluderelevantevidenceandexclude evidencewhichisneitherrelevantnorprobative.
Studentswillbeprovidedreasonablecontinuedaccessandtheabilitytoobtaincopiesof documentsandconductrecordsduringopencases.Studentsrequestingaccesstoview documentswillneedtosubmitaRecordsRequest.Toprotecttheprivacyofthoseinvolved, recordsmaynotbedistributed,posted,altered,ormadepublic,thiscontinuesafterthe resolutionprocessiscompleted.
Thepresumptionofinnocenceisafundamentalprincipleappliedtoaccusedstudentsor organizations,ensuringtheyareconsideredinnocentuntilprovenotherwise.Thispresumption remainsintactuntilresponsibilityiseitheracknowledgedbytheaccusedorformally determinedthroughahearingprocess.Duringthishearing,theuniversitybearstheburdenof provingeveryelementoftheallegedviolationtoestablishtheaccused'sresponsibility.
Disciplinaryrecordsshallnotbemadepartofthestudent’spermanentacademicrecordbut shallbecomepartofthestudent’sconfidentialconductrecord.Confidentialconductrecords remainonfilewiththeOfficeofStudentAdvocacyandAccountabilitysevenyearsafterthe incident.Inminorcasesthatdonotinvolveseparationfromtheinstitution,confidentialconduct recordsmaybeexpungedatthestudent’swrittenrequestoneyearaftergraduationfromthe University.
Opencasesawaitingadjudicationshallremainpartofthestudent’spermanentconductrecord. Confidentialconductrecordsinvolvingtheimpositionofsanctionsentailingseparationfromthe institutionarekeptindefinitely.
Torequestconductrecords,visitthe“RecordsRequest” portalontheOfficeofStudent AdvocacyandAccountability’swebsite.Thefollowingaddressesconfidentiality,access,and third-partyrecordsrequests:
SoutheasternLouisianaUniversityisresponsibleforprotectingstudentsandstudent organizations’information,includinginformationpertainingtoconductfilesasdefined
bytheFamilyEducationalRightsandPrivacyAct(FERPA).Thisinformationisstrictly confidentialandcanonlybereleaseduponthewrittenconsentofthestudentor studentorganization’scurrentleadership.
Studentsrequestingrecordsforthird-partyaccesswillneedtocompletetheform “AuthorizationtoReleaseInformationtoandfromtheOfficeofStudentAdvocacyand Accountability.”Processingthisrequestmaytakeuptothree(3)businessdays,asall documentsmustberedactedforidentifiableinformationpertainingtootherstudents.
Privilegeddocumentsorinternalmemorandumsthatarenotintendedtoserveasevidencemay notbeincludedinthedisciplinaryrecord.Thisensuresthatonlyrelevantandnecessary documentsaremaintained,streamliningthemanagementandaccessibilityofthedisciplinary records.
Toensurethatalldisciplinaryproceedingsarecarriedoutfreefromconflictsofinterest,the ConductAuthoritywillensurethatindividuals(administrativeoradjudicative)willnotservein multiplerolesduringthisprocess.Dualrolesshallbeconsideredifanyindividualcarriesout morethanoneofthefollowingroleswithrespecttoanydisciplinaryproceeding:
(a)CounselorandAdvocate
(b)Investigator
(c)InstitutionalComplainant
(d)Adjudicator/DecisionMaker
(e)AppellateAdjudicator/DecisionMaker
ForthepurposesofthisSection,"fullyparticipate"includestheabilitytomakeopeningand closingstatements,examineandcross-examinewitnesses,andprovidesupport,guidance,and advicetotheallegedrespondentorcomplainant.ThisSectiondoesnotmandatetheuseof formalrulesofevidenceindisciplinaryproceedings.However,theuniversitywillmakea good-faithefforttoincluderelevantevidenceandexcludeevidencethatisneitherrelevantnor probative.
ULSystemmemberinstitutionsshallhavetheabilitytotakereasonableinterimmeasures necessarytoensurethephysicalsafetyofmembersofitscampuscommunitiesduringatimely investigationandadjudicationofastudentdisciplinaryissue,includingbutnotlimitedtothe abilitytomakeadjustmentsinstudenthousingarrangements,imposeconditionsofmutualno contactbetweentheaccusedstudentandtheallegedvictim,temporarilysuspendastudent,or banastudentfromcampus.Suchreasonableinterimmeasuresshallrequirethefollowing:
(1)Withinseventy-twohoursoftheallegedviolationbeingdeemedanimmediate threat,writtennoticeoftheinterimmeasureexplainstheinstitution’sreasonsfor enactingthemeasures.
(2)Withinsevenbusinessdaysofthewrittennoticeasoutlinedintheaboveparagraph, unlessotherwisewaivedbytheaccusedstudent,aninterimmeasurehearingto determinewhetherthereissubstantialevidencethatthestudentposesarisktothe physicalsafetyofamemberofthecampuscommunityandthattheinterimmeasureis appropriatetomitigatethatrisk.
Atthehearing,boththeaccusedstudentandtheallegedvictimshallhavetherighttobe represented,atthestudent’sexpense,byanattorneyoranon-attorneyadvocatewhomayfully participateduringthehearing.Anaccusedstudent’swaiveroftherighttoaninterimmeasure hearingshallnotconstituteanadmissionofguiltorawaiverofanyadditionalrightsprovided forinthissection.(seeInterimMeasuresHearing)
Whentheinvestigationconcludes,theInvestigatorwillthenissueaninvestigationreportto bothpartiesstatingtheoutcomeoftheinvestigationwithinareasonabletimeframe.Acopyof theInvestigator’swrittensummaryoftheinvestigationwillbeaccessibletobothparties.Ifthe outcomeresultsinthevalidityoftheallegedviolations,thenthecasewillberecommendedby theInvestigatortobepresentedtoaHearingBoardorConductAuthorityforaDisciplinary Conference.
ADisciplinaryConference(DC)providestheRespondentwithanopportunitytoreviewthe investigativereportandacceptresponsibilityfortheallegedviolations.IftheRespondent assumesresponsibilityforallcharges,theymaysignaDisciplinaryAgreement.TheComplainant andRespondentwillbenotifiedoftheoutcome.TheComplainantmayappealtheissued sanctions(seeAppeals).
IftheRespondentfailstoappearforadisciplinaryconference,oraDisciplinaryAgreement cannotbereached,thecasewillbescheduledforahearingatalaterdate.
Conflictresolutionisaprocessdesignedtoaddressdisputesinaconstructiveandcollaborative manner,withthegoalofreachingaresolutionthatallpartiescanagreeupon.TheConduct Authoritymayrecommendconflictresolutionasanappropriateresponse,particularlyforissues thatdonotinvolveviolationsoftheStudentCodeofConduct.Participationinconflict resolutionisvoluntaryandrequirestheagreementofallinvolvedparties.
Mediationisavoluntaryprocessthatrequiresthecommitmentofallpartiesinvolved,typically usedforfirst-timeorlessseriousviolations.Theaimistoreachamutuallyagreed-uponwritten resolutionthataddressesthedisputeandpreventsfutureoccurrences.TheConductAuthority hasthediscretiontoreferacomplainttomediationwhenappropriate,butthisprocessrequires theconsentofallparties.TheOfficeofStudentAdvocacyandAccountabilitywillmaintaina recordofthemediationeffortsandanyresultingagreements.Importantly,mediationwillnever beusedasthesoleinstitutionalresponsetocomplaintsinvolvingviolence.Ifmediationefforts areunsuccessful,thecomplaintmaybeescalatedtoahearing.
Ifthecomplaintcannotbedisposedofbymutualconsent,thematterwillbereferredtoan InvestigatorpriortoahearinginvolvingaHearingBoardoraCaseManager.TheInvestigatorwill gatherinformationforaCaseManagerorHearingBoardtodeterminewhetheracodeof conductviolationoccurred.
AttheDisciplinaryConference,theRespondentmayassumeresponsibilityforallcharges,the studentmaysignadisciplinaryagreement.TheComplainantandRespondentwillreceive simultaneousnotificationofthedisciplinaryagreementandtheComplainantmayappeal.
IncasesthatcannotberesolvedinaDisciplinaryConference,andinthoseincidentsthatriseto thelevelofsuspensionuptoexpulsionfromtheUniversityorUniversityHousing,thematter willbereferredtoaHearingBoard.Hearingsinvolvingahearingboardaredesignedforthe complainantandrespondenttopresenttheiraccountsofanincident.
Thedisciplinaryhearingprocessforstudentsandstudentorganizationsisguidedbyspecific procedurestoensurefairnessandclarity.Hearingsmaybeconductedseparatelyforeach studentinvolvedifrequested.Boththecomplainantandrespondenthavetherighttobe representedbyanadvisoroftheirchoice,includinglegalcounsel,attheirownexpense,with notificationofrepresentationrequired48hoursbeforethehearing.
Duringthehearing,bothpartiescanpresentwitnesses,andrespondentshavetherightto remainsilentwithoutitbeinginterpretedasanadmissionofguilt.Thehearingprocessis confidential,andanyformofdishonestymayleadtofurtherdisciplinaryaction.Thehearing boardisresponsiblefordeterminingresponsibilityusinga"clearandconvincing"standard,and strictrulesofevidencedonotapply.
Hearingscanaccommodatesafetyconcernsthroughvariousmeans,suchasvideoconferencing. Thefindingsandsanctionsarecommunicatedtothepartieswithintenbusinessdaysafterthe finaldecision.
Noticeshallbesenttothelastlocalmailingaddressand/oremailaddressidentifiedonthe student’sofficialrecords.Noticesenttothelastlocal/mailingaddressshallbeconsidered deliveredtwobusinessdaysaftertheletterhasbeenposted.Noticesentviaemailisdelivered immediatelyuponsending.StudentsareresponsiblefornotifyingtheUniversityoftheircurrent contactinformation,includingphysical/mailing/electronicaddresses.Addresschangesmustbe madethroughthe OfficeoftheRegistrar.FailuretonotifytheUniversityofthecurrentlocal address,tocollectone’smailfromone’saddress,and/ortoreceiveorsignforamailingdoes notvoidthefactthatanoticewasdelivered.Hand-deliverednoticesaredeliveredonthedate theyaregiventothestudent.
Followingthehearing,theConductAuthorityshalladvisetheRespondentinwritingofthe determinationofthesanction(s)imposed,ifany.Thecomplainantshallalsobeinformed simultaneouslyofthedetermination.Therespondentandcomplainantmayappealtheresultof thedisciplinaryproceeding.
Generally,atimesetforahearingwillbeatleast10businessdaysafterthestudenthasbeen notifiedofthehearing.Duetothenatureoftheacademicyear,iftheincidentoccurscloseto theendofasemester,oriftheappropriatehearingbodycannotbescheduled,thestudent’s casewillbeheardassoonasahearingcanbescheduled.TheConductAuthoritydecideswhen tocancel,reschedule,postpone,ormovethehearinglocation.Maximumtimelimitsfor schedulinghearingsmaybeextendedatthediscretionoftheUniversity.TheUniversitymay makereasonableeffortswithpartiestoscheduleadateandtimeforthehearing;however, onceahearingisscheduled,theUniversityreservestherighttocontinuewiththescheduled hearingdate,time,andlocation.
Hearingsarenormallyconductedinprivate.OnlytheHearingBoard,HearingBoardAdvisor, Respondent,Complainant,theirdesignatedAdvisors,therecorder,andpersonsidentifiedwith theUniversitycommunityashavinganeducationalneedtoknow,maybepresentforthe hearing.Writtenrequestsforawaiverofrightstoaprivatehearingandproperlydocumented approvalfromallpartiesmustbesubmittedtotheHearingBoardAdvisoratleast48hours beforethehearing.Admissionofanypersontothehearingshallbeatthediscretionofthe HearingBoardAdvisor.

WhenastudentorstudentorganizationissubjectedtoaninterimactionthroughtheOfficeof StudentAdvocacyandAccountability,theywillreceiveawrittennoticestatingthereasonsfor theinterimactionandthetimeandplaceofthehearing.
Atthehearing,theuniversityshallshowreasonablecausewhytheinterimactioniswarranted, andtherespondentshallhavetheopportunitytoshowwhytheinterimactionisnotwarranted. Thestudentmaypresentanyinformationtotheboardthattheydeemrelevant,includingthe name(s)ofwitnessesprovidedbyboththerespondentandcomplainant.
TheuniversitypersonnelconductingtheinterimmeasurereviewmayconsistoftheDirector andatleasttwootherrepresentativesfromofficessuchas,butnotlimitedto,Counseling Services,StudentAccessibilityServices,membersoftheSoutheasternThreatAssessmentand ResponseTeam(START),andmembersoftheHearingBoard.
Aftermeetingwiththerespondentandcomplainant,reviewingallpertinentinformation,and interviewingwitnesses,therespondentandcomplainantwillbenotifiedoftheboard’sdecision totakeoneofthefollowingactions:
● Continuetheinterimactions;
● Modifytheinterimactions;
● Liftorremovetheinterimaction.
Noticeoftheoutcomeoftheinterimactionwillbesenttotherespondentandcomplainant withinten(10)businessdays.
Astudentorrecognizedstudentorganization(RSO)foundresponsibleforviolatingtheStudent CodeofConductmayappealthatdecision.Thepartyfilinganappealwillbeidentifiedasthe appellant.Failuretoappealorcomplywiththeappealproceduresmayresultintheoriginal decisionbeingfinalandconclusive.SubmittinganappealofaHearingBoard’sdecisionis completingandsubmittingaconductappealviathe“ConductAppeal”portal.Appealsmaybe deniediftheydonotmeetthecriteriaoutlinedinsection“GroundsforAppeal”,arenot
submittedwithinthespecifiedtimeframe,orifmultipleconflictingsubmissionsarereceivedby theappellatebody.
Inacademicmisconductcases,itisimportanttonotethatanappealofstudentconduct decision/findingpursuanttotheStudentCodeofConductappealprocessisdistinctfroman academic/gradegrievance.SeeAcademicIntegrityPolicy.
Exceptasrequiredtoexplainthebasisofnewinformation,anappealattheuniversitylevelmay belimitedtoareviewofthewrittenstatementbythepartyrequestingtheappealand/or writtendocumentspertainingtothecase.Thescopeofreviewshallbelimitedtoconsideration ofthefollowingquestions:
1.Whetherthedisciplineprocesswasconductedfairly,withoutbias,andinconformity withtheproperlyprescribedprocedures;
2.Whethernewevidence,contradictoryevidence,andevidencethatthestudentwasnot affordeddueprocess;
3.Whethertoconsidernewinformationsufficienttoalteradecisionorotherrelevant factsnotbroughtoutintheoriginalhearingbecausesuchinformationand/orfactswere notknowntothepersonappealingatthetimeoftheoriginalStudentConductBoard Hearing;or

TimeforFilinganAppeal
Aconductappealmustbesubmittedwithinten(10)businessdaysofbeingnotifiedofthe decision.Ifthestudentisnotifiedofthedecisionbyletter,thestudenthasten(10)business daysfromthedraftdateofthelettertomakeanappeal.Suchappealsshallbeinwritingand deliveredtotheVicePresidentforStudentAffairsortheirdesignee.TheVPSAislocatedin DysonHall,Room126.
StatusDuringAppeal
Itisimportantforstudentsandstudentorganizationswhofileanappealattheuniversitylevel tounderstandthattheimposedsanction(s)fromthehearingoutcomeareineffectuntilfurther notice.Therenderedsanctionisineffectasofthedateidentifiedonthesanctionletteroruntil anappealisgranted.TheVicePresidentforStudentAffairsortheirdesigneemaychooseto temporarilysuspendtheoutcomeofahearingwhiletheappealisbeingreviewed.
Generally,atimesetforanappealresponsewillbeatmostten(10)businessdaysafterthe studenthasdeliveredtheappeal.However,timelimitsforanappealresponsemaybeextended atthediscretionoftheVicePresidentforStudentAffairsordesignee.
Ifanappealisupheldincasesinvolvingappealsbystudentswhohavebeenfoundtohave breachedtheStudentCodeofConduct,thePresident,VicePresidentforStudentAffairs,or theirdesigneemayeither:
1.Orderanewhearing;or
2.Reduce,change,ordismissthesanctionsofthehearingbody.
AstudentmayappealthedecisionoftheVicePresidentforStudentAffairstothePresidentof theUniversityordesigneeifthesanctionisoneofsuspensionfromtheUniversityforone academicyearorifthesanctionisofgreaterseverity.Forappealsregardinglesssevere sanctions,thefinalappealshallbeattheVicePresidentforStudentAffairslevel.
AstudentmayappealthedecisionoftheUniversityPresidenttotheBoardofSupervisorsfor theUniversityofLouisianaSystemifthesanctionisoneofsuspensionfromtheUniversityfor oneacademicyearorifthesanctionisofgreaterseverity.Forappealsregardinglesssevere sanctions,thefinalappealshallbeattheUniversitylevel.Ifthestudentchoosestoappealto theBoardofSupervisorsafteralladministrativeprocedureshavebeenexhaustedatthe Universitylevel,theappealmustbesubmittedtothePresidentoftheUniversityofLouisiana System,whichreferstheappealtotheBoardofSupervisorsfortheUniversityofLouisiana System.Theappealmustbemadewithin30calendardaysoftheUniversity’sdecision.The Board’sreviewislimitedtodeterminingcompliancewithestablishedandappropriate proceduresattheUniversitylevel.ThestudentshallbenotifiedoftheBoard’sdecisionthrough electronicmeansorwrittencorrespondence.

Failuretocompletesanctionsmayresultinanofficial“hold”onastudent'sconductrecords and/orfurthercharges.Intheeventofnon-compliancewithanorderofsuspensionor dismissal,UniversityPolicewillensureenforcement.
Ineachcase,ahearingbodydeterminesthatastudenthasviolatedtheStudentCodeof Conduct,andthehearingbodyshallrecommendthesanction(s).Still,theHearingBoard Advisorwillimposethefinaldetermination.Sanctionsarenotlimitedtothoserecommended bythehearingbodybutmaybemodifiedbytheConductAuthority.
FactorsthatInfluencetheDegreeandNatureoftheSanctions Sanctionswillbeissuedtorespondentsfoundviolatingsomeoralloftheircharges.Whilesome violationshavetypicaloutcomes,theStudentCodeofConductseekstopreserveflexibilityin theassignmentofsanctionssothateachrespondentisaffordedappropriateandjust treatment.Allsanctioningwillconsidertheinstitution’sgoalofprovidinganeffectivelearning environmentforallmembersandseekstorepairtheharmthattheincidentmayhavecaused.

● Warning: Awrittenreprimandforviolationofspecifiedregulations.Awarningisfora designatedperiodandincludestheprobabilityofmoreseveresanctionsifthestudentis foundtobeviolatinganyinstitutionalregulation(s)duringthewarningperiod.Typical level:Mild.
● FinesandOtherFees: AfineassessedbytheUniversityforafindingofresponsibilityor afinepaidbythestudent/studentorganizationforparticipationinanonlinecourseor workshopaspartofasanction.UseofTobaccoProductsorE-cigarettesonCampus (afterbeingissuedawarning):$50.00ortimeofmonitoredcommunityserviceatthe University.(see TobaccoFreeCampus).Typicallevel:Mild.

Sanctionsareeducationalconsequencesgiventostudentswhentheyviolaterulesorpolicies, andtheyvaryinseveritydependingonthenatureofthemisconduct.
● “Mild”sanctionsareforlessseriousinfractionsandmayincludebutnotlimited toanadmonition,anotetoparents,datedwarnings,and/oreducational sanctions.
● “Moderate”sanctionsareformoresignificantviolationsandcouldinvolvebut notlimitedtoprobation,suspensionfromspecificactivities,and/ormandatory counselingsessions.
● “Severe”sanctionsarereservedforthemostseriousoffenses,repeated misconductoregregiousordangerousbehavior,andcanincludebutarenot limitedtosuspension,dismissal,expulsion,andinvolvementoflawenforcement. Eachsanctionlevelisalignedwiththeseriousnessoftheviolationandisintendedtoencourage correctivebehavior.Sanctionsmaybecombinedtoaddressthebehavior,furthereducatethe student,andpromoteadherencetoexpectedstandardsofUniversitypolicy.
Toreleaseastudentdisciplinaryholdontheiraccountandregisterforcourses,astudentshould contacttheofficeresponsibleforstudentconductordiscipline.Thisusuallyinvolves communicatingwitharepresentativetodiscussthereasonsforthehold,fulfillinganyrequired actionsorsanctionsanddemonstratingthattheyhaveaddressedtheissuesthatledtothe disciplinaryaction.Onceallrequirementsaresatisfied,theofficecanliftthehold,allowingthe studenttoproceedwithcourseregistration.
Inseverecasesofmisconduct,astudentmaybesuspendedorexpelled.Systemuniversities shallnotesuchonthestudent’sacademictranscriptasfollows:
● “Studentisineligibletoenroll.” Thiswillbenotedwhenastudentispermanently dismissed/expelledfromtheuniversityfordisciplinaryreasons.
● “Studentiseligibletoreturn(semester)(year).” Thiswillbenotedonatranscriptwhen astudentissuspendedfordisciplinaryreasonsforaspecifiedtimeandindicateswhich semesterthestudentwillbeeligibletoreturn.
● “Intra-institutionalcommunicationrequiredbyLouisianastatute.” Foranystudentwho isthesubjectofasexualmisconductincidentreport,theUniversitymayplaceaholdon thestudent'sofficialtranscriptand/orplacethisnotationonthestudent’sofficial transcript.
Notationofdisciplinaryactiononacademictranscriptsmayormaynotaffecteligibilitytoenroll atotherhighereducationinstitutions.
DisciplinaryStudentConductRecords
Sanctionsshallnotbemadepartofthestudent’spermanentacademicrecordbutshallbecome partofthestudent’sconfidentialconductrecord.Confidentialconductrecordsremainonfile withtheOfficeofStudentAdvocacyandAccountabilitysevenyearsaftertheincident. Confidentialconductrecordsmaybeexpungedatthestudent’swrittenrequestoneyearafter theirgraduationfromtheUniversityinminorcasesthatdonotinvolveseparationfromthe institution.Opencasesawaitinga
Confidentialconductrecordsinvolvingtheimpositionofsanctionsentailingseparationfromthe institutionarekeptindefinitely.Torequestconductrecords,visitthe“RecordsRequest”portal ontheOfficeofStudentAdvocacyandAccountability’swebsite.Thefollowingaddresses confidentiality,access,andthird-partyrecordsrequests:
SoutheasternLouisianaUniversityisresponsibleforprotectingstudentsandstudent organizations’information,includinginformationpertainingtoconductfilesasdefined bytheFamilyEducationalRightsandPrivacyAct(FERPA).Thisinformationisstrictly confidentialandcanonlybereleaseduponthewrittenconsentofthestudentor studentorganization’scurrentleadership.
2.AccesstoRecords
Studentswillbeprovidedreasonablecontinuedaccessandtheabilitytoobtaincopiesof documentsandconductrecordsduringopencases.Studentsrequestingaccesstoview documentswillneedtosubmitaRecordsRequest.Toprotecttheprivacyofthose involved,recordsmaynotbedistributed,posted,altered,ormadepublic,thiscontinues aftertheresolutionprocessiscompleted.
3.Third-PartyRecordsRequests
Studentsrequestingrecordsforthird-partyaccesswillneedtocompletetheform “AuthorizationtoReleaseInformationtoandfromtheOfficeofStudentAdvocacyand Accountability.”Thismaytakeuptothree(3)businessdaystoprocessthisrequestasall documentsmustberedactedforidentifiableinformationpertainingtootherstudents.
SoutheasternLouisianaUniversityrecognizesthatmentalhealthisanimportantstudenthealth andwellnessaspect.TheUniversityiscommittedtopromotingasupportiveandinclusive environmentthatencouragesstudentstoseekhelpwhenneeded.Thefollowingguidelineswill befollowedwhenastudentisexperiencingamentalhealthemergency:
1.Anystudentexperiencingamentalhealthemergencyoncampusshouldimmediately contacttheUniversityPoliceDepartmentat985-549-2222ordial911.
2.TheUniversityPoliceDepartmentwillcoordinatewiththeappropriateemergency respondersandmentalhealthprofessionalstoprovideassistancetothestudentinneed.
3.TheUniversitywilltakereasonablestepstoprotectthestudent'sprivacyandprovide appropriatesupportandresourcestohelpthestudentrecover.
4.TheUniversitywillworkwiththestudenttodevelopaplanforongoingsupportand follow-upcaretohelpthemmanagetheirmentalhealthandpreventfuturecrises.
5.TheUniversitywillprovideeducationandtrainingforfaculty,staff,andstudentson recognizingthesignsofmentalhealthemergenciesandrespondingappropriately.
6.TheUniversitywillcomplywithallapplicablelawsandregulationsregardingtheprivacy andconfidentialityofstudentmentalhealthrecords.
7.TheUniversitywillnotdiscriminateagainstanystudentonthebasisoftheirmental healthstatus.Itwillmakereasonableaccommodationstoensurethatstudentswith mentalhealthconditionshaveequalaccesstoeducationalopportunitiesandcampus resources.
8.Studentswithquestionsorconcernsaboutmentalhealthservicesorresourceson campusareencouragedtocontacttheCounselingCenterortheDeanofStudentsfor assistance.
9.TheUniversitywillmaintainalistofresourcesforstudentsinmentalhealth emergencies,includinglocalhospitals,crisishotlines,andcounselingservices.Itwill makethisinformationreadilyavailabletostudentsandthebroadercampuscommunity.
10.Ifastudentposesanimminentriskofharm,includingdangertoself,dangertoothers, orisgravelydisabled,theUniversitymustnotifythestudent’sparent,guardian,or identifiedemergencycontact.
BITwillassistinhelpingkeeptheuniversitycommunitysafeandconnectdistressedstudentsto availablesupportservices.BIT'sprimarygoalseekstoactpreventivelyversusreactionaryto studentsindistress.
TheBITisdividedintotwocategoriesofintervention,SoutheasternThreatandResponseTeam (START)andLionInterventionNetwork(LINK).

Thepurposeoftheteamistoassessandrespondquicklyandeffectively(withinput frompertinentprofessionalsontheteam)toreportsofstudentswhopresentbehaviors thatarepotentiallyoractuallyharmfultothemselvesortoothersorwhoaredisruptive totheteachingandlearningprocess,whetherornotthesebehaviorsare psychologically/medicallybased.Theteamfunctionsasacommunicationsand information-sharingnetworkthatassessesandrespondstostudentsincrisisinoroutof theclassroom.Additionally,theteammeetsregularlytodiscussandplanappropriate responsestopotentialstudents'psychological/mentalhealthandbehavioralissues.

Developedtoidentifystudentsfacingacademicchallengesand/orpersonalhardship (i.e.,financial,homelessness/displacement,lossoflovedone,caraccidents,non-life threateningbehaviors,etc.)thathindertheiracademics.LINKcanconnectstudentswith
anyextrahelptheyneedalongtheireducationalpathstosuccess.LINKfunctionsasa communicationsandinformation-sharingnetworkthatassessesandrespondsto studentsasapre-crisisinterventioninoroutoftheclassroom.Additionally,LINKis monitoreddailybyTheOfficeofStudentAdvocacyandAccountability(OSAA).OSAA meetsregularlytodiscussandplanappropriateresponsestopotentialstudentacademic challengesand/orpersonalhardships.CasesreportedtoLINKthatrisetothelevelof moderateorextremearereportedtoSTART.
SoutheasternLouisianaUniversityiscommittedtoofferinganeducationalopportunitytoall students.Incertainsituations,Universityofficialsmaybecomeawareofastudentwhohasa medicalorpsychologicaldisorderand,asaresultofthedisorder,presentsadirectthreattothe healthorsafetyofothersorposesanactualrisktotheirownsafety.Whenastudent’sbehavior constitutesathreattothehealth,safety,andwelfareofthestudent,others,ortoUniversity propertyorisdisruptivetotheeducationalprocessoftheUniversity,theUniversitymay determinethatisnecessaryforthestudenttobeinvoluntarilywithdrawnfromtheUniversity. Suchwithdrawalshouldfollowtheproceduresprescribedherein.
Involuntarywithdrawalwillbeundertakenwhenthestudentexhibitsbehaviorsthatincludebut arenotlimitedto:
● Behavior,eithervoluntaryand/orinvoluntary,thatviolatestheStudentCodeofConduct;
● BehaviorthatposesadirectthreattothehealthorsafetyofotherUniversitycommunity members;
● Behaviorresultingfrompsychologicaldisturbanceasdocumentedbyalicensed psychologist,psychiatrist,counselor,orsocialworker;
● BehaviorthatpreventstheUniversityfromguaranteeingasafeenvironmentforthe studentafterallreasonableinterventionsandaccommodationshavebeenmadeto providethestudentsupportandprotection;or
● BehaviorthatissodisruptivetoothermembersoftheUniversitycommunitythatit disruptsorderailstheeducationalprocessinterferingwiththerightsofotherstolearn andmeettheireducationalgoals.
ThestudentshallbesummonedinwritingtoattendaconferencewiththeDeanofStudentsor Designee.Thenoticeshallincludethefollowing:

Thestudentshallbeaffordedthefollowingrightswhenahearingisrequestedbeforethe CommitteeonInvoluntaryWithdrawal:
● Awrittenletterofthetimeandplaceofthehearingatleastten(10)businessdaysprior tothehearing.
● Thestudent’srighttoanadvisorasdefinedintheUniversityStudentCodeofConduct.
● Therighttopresentwitnessesandevidenceonbehalfofthestudentandtoquestion witnessesandchallengeevidencepresentedbytheUniversity.

AnyquestionsofinterpretationregardingtheStudentCodeofConductshallbereferredtothe VicePresidentforStudentAffairs,theOfficeofStudentAdvocacyandAccountability,ortheir designeeforfinaldetermination.TheUniversityreservestherighttochangetheStudentCode ofConductduringtheacademicyear.TheStudentCodeofConductshallbereviewed periodicallyunderthedirectionoftheVicePresidentforStudentAffairsordesignee.Themost currentcopyoftheStudentCodeofConductcanbefoundonthe OfficeofStudentAdvocacy andAccountability’swebsite.
PolicyStatement: SoutheasternLouisianaUniversityiscommittedtothehealth,safety,and well-beingofeachmemberoftheUniversitycommunity.Inordertofurtherstudentlearning andpromotetheUniversity’sacademicmission,Southeasternfostersanenvironmentof personalresponsibilityandrespectfulcitizenship.Thismeansthatallmembersoftheuniversity community–students,faculty,andstaff-inadditiontovisitors–haveasharedresponsibilityin safeguardingahealthylearningenvironmentinwhichinappropriatebehaviorsandthe associatednegativeconsequencesofalcoholmisuseareaddressedinamannerappropriateto thecircumstance.TheUniversity,asoutlinedinthefollowingpolicy,strivestocreateaculture thatsupportsstudentswhohavemadethedecisiontonotusealcohol,aswellasencourage, througheducation,studentswhochoosetodrinkalcoholtodosoinasafe,legal,and responsiblemanner.
Thepossession,use,sale,distribution,ormanufactureofalcoholmaybedoneonlyin accordancewiththeprovisionsoffederalandstatelaws,locallawsandordinances,and Universityregulations,includingthispolicy.Louisianastatelawprohibitsthepurchase,public possessionorconsumptionofanyalcoholicbeveragebypersonsundertheageof21.
Applicability: ThispolicyappliestoallSoutheasternstudents,faculty,staff,andvisitors.
Studentsandemployeesareremindedthatlocal,state,andfederallawsprovideforvarious legalsanctionsandpenaltiesforunlawfulpossessionordistributionofalcohol.Thesesanctions include,butarenotlimitedto,incarcerationandmonetaryfines.
Studentsfoundtobeinviolationofthispolicywillbeaffordeddueprocessasprescribedinthe UniversityCodeofStudentConduct.Sanctionsforpolicyviolationsincludeadisciplinary warning,uptoandincludingexpulsionfromtheUniversity.
*Studentsmayalsobereferredforcounselingand/orreferralforindividualassessment;referral maybeincludedasaconditionofanysanction.
● “Alcoholicbeverage”meansbeer,wine,ordistilledspirits(liquor)asdefinedbystate law.

● “Employee”meansanypersonhavinganemploymentrelationshipwiththeUniversity, includingbutnotlimitedtoclassifiedandunclassifiedstaff,faculty,graduateassistants andstudentemployees.
ThissectionofthepolicyappliestoallUniversitystudents,employees,andguests. Allstudents,employees,andguestsarestrictlyprohibitedfromtheunlawfulpossession, manufacture,use,ordistributionofalcoholonUniversitypropertyoraspartofanyUniversity activity,whetheronoroffcampus.ThispolicywillextendtoanyothersitestheUniversitymight operateorberepresented.Thispolicywillapplytothesale,possession,orconsumptionof alcoholinoratanyUniversitysponsoredorregisteredevent.Thepossession,consumption,sale orfurnishingofalcoholicbeveragesisprohibitedexceptinthoseareaswheresuchactivitiesare specificallyallowedorpreapproved.
ThefollowingconductisprohibitedexceptaspermittedbyUniversityregulationsandthelaw:
● Theuse,consumption,possession,manufacture,purchase,sale,furnishing,and/or distributionofalcoholicbeveragesonUniversityproperty,oratanyofitsactivities
● Theuse,consumption,possessionandorpurchaseofalcoholicbeveragesbypersons under21yearsofage.
● Possession,consumption,sale,manufacture,orfurnishingofalcoholicbeveragesinthe residencehallorresidencehallroom.
■ StudentsresidinginSoutheasternOaksmaypossessalcoholintheirroom dwellingifallresidentsareoflegalagetopossessandconsumealcohol.Alcohol maynotbepresentincommonareasoftheapartmentifALLresidentsinthe apartmentarenotoflegalage.
● Furnishing,serving,andorotherwiseprovidingalcoholicbeveragestopersonsunder21 yearsofage.
AcontractmustbesignedwiththeUniversityPoliceDepartmentforanofficer(s)tobepresent atallthird-partyrentaleventsandatUniversity(orUniversityaffiliated)sponsoredevents wherealcoholistobeservedifstudentswillbepresentanditisplausiblethatstudentsmight
beservedalcohol,e.g.,studentsareparticipatingintheeventotherthanintheircapacityinthe employmentoftheUniversity.

StudentOrganization’sEvent
Aneventmaybeconsideredastudentorganizationeventifoneandmoreofthefollowing occur:
● Theeventwaspre-plannedorpremeditated(flyers,emails,organizationssocialmedia)
● Theeventwasdiscussedorplannedduringtheorganizationsmeeting
● Themajorityoftheorganization’smembersknewofand/orattendedtheevent
● Organizationalresourceswereusedinanyway(i.e.entertainment,transportation,food, beverages,advertisement,etc.)
● Asignificantportionofattendeeswereinvitedbymembersoftheorganization
● Inaddition,aneventcouldbeconsideredastudentorganizationseventifanon-member perceivestheeventasbeingsponsoredbyanorganization.

Manufacture,Distribution,Possession,andUse
SoutheasternLouisianaUniversityprohibitstheunlawfulmanufacture,distribution,possession, oruseofillicitdrugsordrugparaphernaliaonUniversitypropertyoraspartofanyuniversity activity,whetheronoroffcampusassetforthbythispolicyanddefinedbyLouisianaLaw.Law asitappliestothissectionofthepolicyreferstoLouisianaR.S.40:961throughR.S.40:1034.
Studentsandemployeesareremindedthatlocal,state,andfederallawsprovideforvarious legalsanctionsandpenaltiesforunlawfulmanufacture,distribution,possession,oruseofillicit drugs.TherangeofpenaltiesandviolationsofLouisianaLawcitedaboveisfinesupto $1,000,000anduptolifeinimprisonmentwithoutparoledependingonthedruginvolvedand thenatureoftheviolation.

b.Inaddition,beginningthefallsemesterof2019,eachnewstudentshallbe providededucationinformationonthedangersofandprohibitiononHazing duringthenewstudentorientationprocesseitherinpersonorelectronically.
c.Ifthestudentreceivingthisinformationisaminor,thatinformationshallalsobe providedtothestudent’sparentsorlegalguardians.

Hazinginanyform,ortheuseofanymethodofinitiationintoorganizationsinanyeducation institutionsupportedwhollyorinpartbypublicfunds,whichislikelytocausebodilydangeror physicalpunishmenttoanystudentorotherpersonattendinganysuchinstitutionisprohibited. WhoeverviolatestheprovisionsofthisSectionshallbeexpelled,suspended,ordismissedfrom theeducationinstitutionandnotpermittedtoreturnforatleastonesemester,quarter,or comparableacademicperiod.Inaddition,thepersonviolatingsuchprovisionsmayalsobe subjecttotheprovisionsofR.S.14:40.8.
RS14:40.8CriminalHazing
Itshallbeunlawfulforanypersontocommitanactofhazing.Anypersonwhocommitsanact ofhazingshallbefineduptoonethousanddollars,imprisonedforuptosixmonths,orboth.
Ifthehazingresultsintheseriousbodilyinjuryordeathofthevictim,orthehazinginvolves forcedorcoercedalcoholconsumptionthatresultsinthevictimhavingabloodalcohol concentrationofatleast.30percentbyweightbasedongramsofalcoholperonehundred cubiccentimetersofblood,anypersonwhocommitsanactofhazingshallbefineduptoten thousanddollarsandimprisoned,withorwithouthardlabor,foruptofiveyears.
Ifanypersonservingasarepresentativeorofficerofanorganization,includingany representative,director,trustee,orofficerofanynationalorparentorganization,isa sanctionedorrecognizedmemberatthetimeofthehazing,knewandfailedtoreport,assoon aspracticableundercircumstancestolawenforcement,thatoneormoreoftheorganization’s memberswerehazinganotherperson,theorganizationmaybesubjecttothefollowing:
● Paymentofafineuptotenthousanddollars.
● Forfeitureofanypublicfundsreceivedbytheorganization.
● Forfeitureofallrightsandprivilegesofbeinganorganizationthatisorganizedand operatingattheeducationInstitutionforaspecificperiodoftimeasdeterminedbythe court.

● Hazingincludesbutisnotlimitedtoanyofthefollowingactsassociatedwithpledging, beinginitiatedinto,affiliatingwithparticipatingin,holdingofficein,ormaintaining membershipinanyorganization:
■ Physicalbrutality,suchaswhipping,beating,paddling,striking,branding,electric shocking,placingofaharmfulsubstanceonthebody,orsimilaractivity.
■ Physicalactivitysuchassleepdeprivation,exposuretotheelements, confinementinasmallspace,orcalisthenics,thatsubjectstheotherpersonto
anunreasonableriskofharmorthatadverselyaffectsthephysicalhealthor safetyoftheindividualorcausessevereemotionaldistress.
■ Activityinvolvingconsumptionoffood,liquid,oranyothersubstanceincluding, butnotlimitedto,analcoholicbeverageordrug,thatsubjectstheindividualto anunreasonableriskofharmthatadverselyaffectsthephysicalhealthorsafety oftheindividualorcausessevereemotionaldistress.
■ Activitythatinduces,causes,orrequiresanindividualtoperformadutyortask thatinvolvesthecommissionofacrimeoranactofhazing.
■ Activitiesoreventsthatfacilitaterapiddrinking,drinkinggames,intoxicationor impairment,andforcedconsumptionofbothpalatablefoodand,oranyother substance.
● Anyactiontakenorsituationcreatedthatmaycausepain,injury,excessivephysical stressorfatigueincluding,butnotlimitedtothefollowing:paddling,slapping,tackling, pushing,andexercisethatisnotpartofareasonableall-organizationathleticevent.
● Activitiesthatinvolvetheuseofrope,string,elastic,oranydeviceormaterialutilizedto restrainorconfineanindividual.
● Activitiesinvolvinglineups,interrogation,orverbalabuse.
● Theftofproperty.
● Transportationagainstanindividual’swillsuchaskidnappingand/orabandonmentata distantlocation.
● Illegalactivitiessuchastherequirementtostealitemsaspartofascavengerhunt.
● Activitiesorexpectationsthataresotimeconsumingastosignificantlyinterferewith classwork,studytime,andsleep.
● Requirementsthatfinanciallytakeadvantageofindividualswithinthegroup(Requiring anindividualtopurchaseitemsaspunishment).
● Theuseofobscenitiesandvulgaritiesindress,languageoraction.
● Sexualdegradingactivities,includingstripping,simulationofsexualactsorsexually explicitcheers,chants,andsongs.
● Conductinganyformofpersonalservitudeincluding,butnotlimitedtodriving individualstoclass,cleaninganotherindividual'sroom,servingmealstoanother individual,washinganotherindividual'scar,etc.
● Activitiesthatcausepsychologicalstressincluding,butnotlimitedto,anydeception designedtoconvinceastudentthathe/shewillnotbeinitiated,willberemoved,orwill beinjuredduringanyactivity.
● Dressingalikeinspecificcostumesorclothing(thisdoesnotapplytodressattire requiredforbusinessorritualmeetings).
● Activitiesthatcausepsychologicalstress,includingbutnotlimitedto,anydeception designedtoconvinceastudentthattheywillnotbemadeamemberoftheorganization orgroup,willberemoved,orwillbeinjuredduringtheactivity.
● ForcingorrequiringtheviolationofUniversityPolicy,Federal,Stateorlocallaw including,butnotlimitedto,burglary,defacement,trespassing,animalcruelty, academicdishonesty,andprovidingfalseormisleadinginformation.
1. University
● WhentheUniversityreceivesareportallegingthecommissionofanactoracts ofHazingbyoneormoremembersofanOrganization,theUniversityshall:
■ Report,assoonaspracticableundercircumstances,theallegedactor actstothelawenforcementagencyhavingjurisdictionintheplacewhere theallegedactoractsofHazingoccurredandtheUniversityPolice Department.Theinformationreportedtolawenforcementshallinclude alldetailsreceivedbytheUniversityrelativetotheallegedincident, withoutanyinformationbeingredacted,includingthenameofall individualsallegedtohavecommittedtheactoractsofhazing;and
● Documentinwritingallactionstakenwithregardtothereport,includingbutnot limitedtothedatethereportwasreceived,reportsmadetolawenforcementas providedinR.S.14:40.8,andanyinformationrelativetotheUniversity’s investigation,processing,andresolutionoftheincident.
● AstandardizedformthattheUniversityshallusetodocumentsuchreportsmade tolawenforcementasprovidedbyLa.R.S.14:40.8andthemannerinwhicheach hazingincidentishandledandresolvedattheUniversitylevelisattachedtothis policyasAppendixA.
● IftheUniversityfailstocomplywiththeprovisionsoftheHazingLawsitmaybe subjecttothepenaltiesoutlinedinLa.R.S.14:40.8,includingpaymentofafine uptotenthousanddollars.
Therightofuniversityorcollegepoliceofficerstocarryaconcealedweaponandto exercisethepowerofarrestwhendischargingtheirdutiesshallextendtoallegedactsof hazingcommittedbymembersofanorganizationthatisorganizedandoperatingatthe universityorcollegeforwhichthepoliceofficeriscommissionedregardlessofthe locationwheretheallegedactoccurs.Anypersonarrestedbyacollegeoruniversity policeofficer,intheexerciseofthepowergrantedthroughR.S.14:40.8,shallbe immediatelytransferredbysuchofficertothecustodyofthesherifforcitypolice whereinthearrestoccurs.

SexualHarassment:Unwelcomeconductofasexualnaturewhen(i)submission tosuchconductismadeeitherexplicitlyorimplicitlyatermorconditionofan individual/groupofindividuals’employmentoreducation;(ii)submissiontoor rejectionofsuchconductbyanindividual/groupofindividualsisusedasthe basisforadecisionaffectingthatindividual/groupofindividuals’employmentor education;or(iii)suchconducthasthepurposeoreffectofunreasonably interferingwithanindividual/groupofindividuals’employmentoreducation,or creatinganintimidating,hostile,oroffensiveemploymentoreducational environment,andhasnolegitimaterelationshiptoemployment,thesubject matterofacourse,educationalprograms(including,butnotlimitedto,athletics) oracademicresearch.Sexualharassmentalsoincludesnon-sexualharassment ordiscriminationofanindividual/groupofindividualsbecauseofthe individual/groupofindividuals’sexand/orgender,includingharassmentbased ontheperson’snonconformitywithgenderstereotypes.
E. ProtectedCharacteristics/Status:race,color,sex,religion,sexualorientation, nationalorigin,disability,geneticinformation,age,veteranstatusorretirement status.
F. Retaliation:Anyadverseactiontakenagainstanindividual/groupofindividuals whohas/havecomplainedaboutdiscrimination,harassmentorotherunlawful practice,orwhomayhaveparticipatedinacourtoradministrativeinvestigation, hearingorlitigationrelatingtoworkplaceconduct,discrimination,or
harassmentbyfilingachargeoractingasawitness.Retaliationisprohibited underTitleIXaswellasUniversitypolicy.Thisincludesovertorcovertactsof reprisal,interference,restraint,penalty,discrimination,intimidation,or harassmentagainstanindividual/groupofindividualsexercisingrightsunderthis policy.Toestablishaclaimofretaliation,theindividual/groupofindividualsneed notbeamemberofaprotectedgrouporclass.Individuals/groupsofindividuals whoassistothersinraisingacomplaintofprohibiteddiscriminationand/or harassmentbyofferingadviceandmoralsupport,orbygivingtestimonyor evidenceinsupportofacomplaint,aresimilarlyprotected.Thisprotectionexists evenifthecomplaintiseventuallydismissedorfoundtobelackinginmerit.The processforfilingacomplaintofretaliationissetforthintheUniversity’s RetaliationPolicy.

A. Evidence
1. DirectEvidence: Inordertoestablishdirectevidenceofdiscriminationand/orharassment, theremustbeproofthattheadverseactionorpreferentialtreatmentwasaresultofa
protectedcategory/status.Suchevidenceisanywrittenorverbalstatementbyanofficial thathe/shetookactionsagainst,orofferedpreferentialtreatmentto,anindividual/group ofindividualsbecauseoftheirprotectedcategory/status.
2. CircumstantialEvidence: Aviolationcanalsobeestablishedifthereiscircumstantial evidenceofdiscriminationand/orharassment.Typically,thislinkcanbedemonstrated basedonthefollowing:
▪ Suspicioustimingoftheadverseactionagainst,orpreferentialtreatmentof,
▪ theindividual/groupofindividuals;ambiguousstatementsbytheaccused;an accused'sconducttowardotheremployees/studentsinthesameprotectedgroupasthe individual/groupofindividuals;and"otherbitsandpieces"ofevidence"fromwhichan inferenceofdiscriminatoryintentand/orharassmentmightbedrawn";
▪ Evidencethatotherindividualssimilarlysituatedtotheindividual/groupof
▪ individualsbutarenotmembersofthesameprotectedgroup"receivedsystematically bettertreatment";and
▪ Evidencethattheindividualwasqualifiedforaposition,butwasreplacedbyorpassed overforthepositioninfavorofsomeonenotinthesameprotected
▪ groupastheindividualandthattheemployer'sstatedreasonfornotchoosingthe individualwaspretextual.
3. Non-discriminatory/Non-HarassingReason: Discriminationand/orharassmentcanbe establishediftheentityfailstoprovideevidenceofalegitimateandnon-retaliatory/nonharassingreasonforadverseemploymentactions/adverseeducationalactions/preferential treatment.Commonlegitimatereasonsforadverseemploymentactions/adverse educationalactions/preferentialtreatmentincludepoorjobperformance,inadequate qualificationsforthepositionsought;violationofworkrulesorinsubordination;poor academicperformance,andviolationofuniversityacademicpolicies,rulesorregulations.
4. PretexttoMotive: Evenifanentityproducesevidenceofalegitimatereasonforthe adverseaction/preferentialtreatment,aviolationcanstillbefoundifthereasonisapretext tohideactualmotive.Thiscanbeprovedthroughevidencethatanindividual/groupof individualswastreateddifferentlyfromsimilarlysituatedindividualsorsubjectedto heightenedscrutiny.
5. StandardofReview: Thepreponderanceoftheevidencestandardwillbeusedfor investigationallegationsofdiscriminationandharassment.
TheUniversitywillrespecttheconfidentialityofallpartiesandwitnessesasmuchaspossible, consistentwiththeUniversity’slegalobligations.Breachesofconfidentialityorprivacy committedbyanyonereceivingareportofharassmentordiscriminationorinvestigatingthe reportofthesamemaybeconsideredaseparateviolationofthePolicyandmayresultin disciplinarysanctions.
UponreceivingareportofharassmentordiscriminationSoutheasternwillimmediatelyoffer anysupportivemeasuresappropriatetothecircumstances–including,butnotlimitedto, temporarychangesinclasses,residencehallassignments,workassignments,etc.Bothparties willbeadvisedregardingtheUniversitypolicyonretaliation.

ComplaintProcedures –Complaints,whetherinformalorformal,shouldbereportedassoonas possibleafteranyallegedincidentofdiscriminationorharassmenthasoccurred.Thereisno deadlineorrequiredtimeframewithinwhichunlawfuldiscriminationorharassmentmustbe reported.However,alargeproximityoftimeinbetweentheallegeddiscrimination/harassment andthereportingmaynegativelyaffecttheinvestigation.
InformalComplaints –Acomplaintofunlawfuldiscrimination/harassmentdoesnothaveto beginattheInformalComplaintstage.However,useoftheInformalComplaintprocessmay allowamattertoberesolvedquicklyifthecomplainant/complainantsbelievethatthe circumstancesmaketheInformalComplaintprocessappropriateforaparticularsituation. Informalcomplaintsshouldbemadeinwritingwithin10businessdaysofthedatethatthe individual/groupofindividualskneworhadreasontoknowofthealleged discrimination/harassment.Althoughattemptswillbemadetoaddressallcomplaintsof discrimination/harassment,complaintsthataremademorethan30calendardaysafter complainant/complainantskneworshouldhaveknownabouttheallegedconductwillbemore difficultorimpossibletoinvestigatedependingonthefactsinvolved.

Writtencomplaintsofdiscrimination/harassmentshouldbesubmittedtotheUniversity’s ComplianceOfficerwithin10businessdaysoftheallegedincidentifthe complainant/complainantsdonotwishtousetheinformalcomplaintprocess.Thisisnota deadlinethatwillpreventaclaimofunlawfuldiscrimination/harassmentfrombeingheardby theComplianceOfficer.However,complaintsthataremademorethan30calendardaysafter thecomplainant/complainantskneworshouldhaveknownabouttheallegedconductwillbe moredifficultorimpossibletoinvestigatedependingonthefactsinvolved.
InitialMeetingwithComplainant. Assoonasispracticable(butnomorethan5businessdays afterthesubmissionofacomplaint),theindividualinvestigatingthecomplaintshallcontactthe complainantandscheduleaninitialmeeting,within5businessdaysofthecontact.Attheinitial
meeting,theComplianceOfficerwillprovideacopyofthispolicywhichexplainstheprocess andrightsofallparties,requestadditionalinformationregardingthereportedincident,and explaintheinvestigatoryprocess.
Process. TheComplianceOfficerwilleitherinvestigateorauthorizeaninvestigation,where allpartiesaregiventheopportunitytopresentwitnessesandevidence.
NoticeofAllegationstoRespondent. Attheoutsetofaninvestigation,theinvestigatorwill providetherespondentprompt(withinfiveworkingdaysofthemeetingwiththecomplainant) noticeoftheallegationsagainsthimorherinwritingtogetherwithacopyof/linktothisPolicy. Awrittennoticeofalldocumentswillbeprovidedtothecomplainantconcurrentlywiththe respondent.
InvestigationTimeFrame. Theinvestigationshouldbeginwithinfiveworkingdaysofthenotice totherespondentandmustbeconcludedwithinareasonabletimeframe,preferablynolonger thantenworkingdaysfromthedaythattheinvestigationbegan.
WrittenSummary. TheComplianceOfficewillthenissuetobothpartiesawrittensummaryof theoutcomeoftheinvestigationwithinareasonabletimeframe(withintenworkingdaysofthe completionoftheinvestigation).AcopyoftheComplianceOfficer’swrittensummaryofthe investigationwillbeaccessibletobothparties.
Preventativemeasures. Ifaninvestigationconfirmseitherthatdiscriminationorharassment hasoccurredorthatconductinviolationofthepolicyhasoccurred,immediateandappropriate actiontostopanysuchconductandreasonablestepstopreventanyfurtherharassment, discrimination,orretaliationshallbetaken.
Ifeitherpartytoacomplaintofunlawfuldiscriminationand/orharassmentwishestoappeal theLevel1decision,anappealofthewrittendecisionmustbemadeinwritingwithin10 businessdaysofthereceiptoftheLevel1Complaintdetermination.Theappealshouldbesent totheOfficeofthePresidentoftheUniversitywhowillforwardtheappealtotheUniversity EEOAdvisoryCommitteeforareviewanddetermination.
EachUniversityshallcreateanEEOAdvisoryStandingCommitteecomposedofmembersofthe facultyandstafffromvariousdepartments.TheEEOAdvisoryStandingCommitteeshould includeindividualsrepresentingtheinterestsofclassifiedandunclassifiedstaffandshould reflectthediverseworkforceofthecampus.TheEEOAdvisoryStandingCommitteeforeach
Universitywillcommunicateregularlyregardingissuesrelatedtopolicyimplementation includingUniversityclimateandsystemicconcerns.Inadditiontoitsotherresponsibilities,a sub-groupofbetweenthree(3)andfive(5)oftheEEOAdvisoryStandingCommitteeMembers shallserveastheLevel2appealreviewcommitteeforthis Discrimination/Harassmentprocess.
Eachuniversityshallmaintainapooloftrainedinvestigatorswhoareemployeesofthe universitieswhohavehadformaltrainingininvestigationtechniques,policies,andprocedures forpurposesofresolvingadministrativecomplaintsandactionswithinthecampus environment.Suchindividualsshouldhaveknowledgeininterviewing,evidencecollection,and reportwriting,andwillbetheprimaryindividualsresponsibleformakinginitialinquiresof complainantsandrespondentsinavarietyofadministrativeproceedings.
PriortotheEEOAdvisoryStandingCommittee’sreview,atrainedinvestigatorappointedbythe Presidentoftheuniversitywill:
ReviewandinvestigatetheLevel1complaintdecision; Collectandclarifyadditionalavailablefactsabouttheallegedincident; Meetwiththecomplainant/complainantsandtheaccusedindividual,separately,if appropriate.ThetrainedinvestigatorwillprovideareporttotheEEOAdvisoryStanding CommitteewithintenworkingdaysofreceivingthenoticeofappealfromthePresident.The EEOAdvisoryStandingCommitteewillreviewtheLevel1decisionandtheappealaswellas theinvestigator’sreport,andwillmakeadeterminationregardingtheLevel1decisionandwill providedetailedfindingsalongwithanyrecommendationsforappropriateactiontothe PresidentoftheUniversityforhis/herconsideration.Suchworkmustbecompletedwithinten (10)workingdaysofreceiptofthereportofthetrainedinvestigator.
Recommendationsmayinclude:upholdtheLevel1decisioninfullorinpartorrenderan alternativedecisioninfullorinpart.ThePresidentoftheUniversitywillreviewthereport submittedbytheEEOAdvisoryStandingCommitteeand,dependinguponthenatureand severityofthecharge(s),thePresidentmayapprovetherecommendedactionormay recommendanalternateresolution.TheactionofthePresidentmustbetakenwithinfive workingdaysofreceiptofthereportoftheCommittee.
Anyextensionofdeadlinesinthisprocessmustonlybeforreasonsofextenuating circumstancesandthosecircumstancesmustbesharedwiththecomplainant/sandthe accusedindividual.Thecomplainant/complainantsandtheaccusedindividualwillbenotified ofthedecisionsateachlevel.
Thecomplainant/complainantswillalsobenotifiedofallelementsofthedecisionthatdirectly relatetothecomplainant,involvegeneralcampuswidechanges,orareotherwiserequiredby stateorfederallaw.
Followinganinvestigation,ifafacultyorstaffmemberisfoundinviolationofthepolicy,that individualmaybesubjecttodisciplinaryaction,andthesanctionsmayincludereprimand, probation,suspension,demotion,reassignment,andtermination.Intheeventthatpersonnel actionisdeterminednecessaryandappropriatewithrespecttotheaccused,theUniversity shoulduseitsappropriatepersonnelpoliciesafteradeterminationregardingtheallegation.
TheComplianceOfficeroneachcampusshallidentifythehumanresourcespersonnelaswellas themanagerialandsupervisorypersonneloneachcampuseachyear.Theindividualsshallbe providedannualtrainingbytheComplianceOfficerordesigneeontheAnti-Discriminationand HarassmentPolicyandshallhaveaccesstotheComplianceOfficertoaddressanyquestionsor concernsthatarisewithrespecttothispolicy.TheComplianceOfficershallhaveaccesstoand shallusetheULSystemEEOCoordinator/Officerasaresourceasneededtoensurecompliance withthispolicy.TheEEOAdvisoryStandingCommitteeshallalsoreceivetrainingwithrespectto howtoproperlyreviewandanalyzecomplaintsofretaliationaspartoftheirannualEEO Training.
SoutheasternLouisianaUniversity,hereinafterreferredtoasRecipient,prohibitssexual misconductandiscommittedtoprovidingalearning,working,andlivingenvironmentthat promotesintegrity,civility,andmutualrespectinanenvironmentfreefromsexual misconductasprovidedinTitleIXandotherapplicablelaws.Recipientsshalltakeprompt andappropriateactiontoinvestigateandeffectivelydisciplinethoseaccusedofsuch conductinamannerconsistentwiththelawanddueprocess.Recipientsshallprovide supportandassistancetothoseallegingsexualmisconductandshallreportinstancesof sexualmisconductinaccordancewithlaw.Recipientwillstrivetocreateandmaintainsafe learning,working,andlivingenvironmentsforallindividualswhoparticipateinRecipient’s educationprogramsandactivities,includingonlineinstruction.Anynon-confidentialreport ofsexualmisconduct,asdefinedherein,mustbeinvestigated,addressed,andresolvedby Recipientundertheappropriatepolicyandprocedures.
Thispolicywasdesignedtoensureasafeandnon-discriminatoryeducationalandwork environmentandtomeetlegalrequirements.Recipientcomplieswithallapplicablefederal andstatelawsandregulations,andthispolicyshallbeamendedtoreflectanychangesto federalandstatelawsandregulationsincluding,butnotlimitedto,thefollowing:
•TitleIXofthe1972EducationAmendmentswhich(i)prohibitsdiscriminationonthe basisofsexineducationalinstitutionsand(ii)requirescollegesanduniversities receivingfederalfundingtocombatgender-basedviolenceandharassment,and respondtosurvivors’needsinordertoensurethatallstudentshaveequalaccessto education;
•TheJeanneCleryDisclosureofCampusSecurityPolicyandCampusCrimeStatistics Act(CleryAct),whichrequires(i)policiesandproceduresforsexualassaultand(ii) requirestimelywarningandexternalreportingofcrimes;
•Section304oftheViolenceAgainstWomenReauthorizationActof2013(VAWA), whichextendstheCleryActtoincludedatingviolence,domesticviolenceand stalking.
ThisPolicyappliestoRecipient’sstudentsandfaculty/staff.Thispolicyprohibitssexual misconductcommittedbyoragainststudentsandfaculty/staffbyotherstudents,faculty/staff, orthirdparties.
AstocasescoveredbyTitleIX,thispolicyapplieswhensexualharassment,asdefinedinthe Policy,occursinRecipient’seducationprogramoractivity,againstapersonintheUnitedStates.
ForallothertypesofsexualmisconductnotcoveredbyTitleIX,thisPolicyappliesgenerallyto sexualmisconductonRecipient’spremises;atRecipient-affiliatededucational,athletic,or extracurricularprogramsoractivitiesthathaveanadverseeffectontheeducationor employmentofamemberoftheRecipient’scommunity;orthatotherwisethreatensthe healthand/orsafetyofamemberoftheRecipient’scommunity.Recipientmayaddresssuch misconductinanymannerRecipientchooses,includingprovidingsupportivemeasuresor pursuingdisciplineasprescribedbytheCodeofStudentConduct(forstudents)orthe appropriateemploymentpolicy(foremployees).
AppealsOfficer.Thepersonorpanelwhoacceptsorrejectsasubmittedappealrequest, determineswhetheranyofthegroundsforappealaremet,anddirectsresponsive action(s)accordingly.
Coercion.Theuseofexpressorimpliedthreats,intimidation,orphysicalforcewhichplacesan individualinfearofimmediateharmorphysicalinjuryorcausesapersontoengagein unwelcomesexualactivity.Coercionalsoincludesadministeringadrug,intoxicant,orsimilar substancewiththeintenttoimpairthatperson’sabilitytoconsentpriortoengaginginsexual activity.
Complainant.Anindividualwhoisallegedtobethevictimofconductthatcouldconstitute sexualharassmentirrespectiveofwhetheraformalcomplainthasbeenfiled.
Consent.Consenttoengageinsexualactivitymustexistfrombeginningtoendofeachinstance ofsexualactivity.Consentisdemonstratedthroughmutuallyunderstandablewordsand/or actionsthatclearlyindicateawillingnesstoengageinaspecificsexualactivity.Silencealone, withoutactionsevidencingpermission,doesnotdemonstrateconsent.Consentmustbe knowingandvoluntary.Togiveconsent,apersonmustbeoflegalage.Assentdoesnot constituteconsentifobtainedthroughcoercionorfromanindividualwhomrespondentknows, orreasonablyshouldknow,isIncapacitated.Theresponsibilityofobtainingconsentrestswith thepersoninitiatingsexualactivity.Useofalcoholordrugsdoesnotdiminishone’s responsibilitytoobtainconsent.Consenttoengageinsexualactivitymaybewithdrawnbyany personatanytime.Oncewithdrawalofconsenthasbeenexpressed,thesexualactivitymust cease.Consentisautomaticallywithdrawnbyapersonwhoisnolongercapableofgiving
consent.Acurrentorpreviousconsensualdatingorsexualrelationshipbetweentheparties doesnotitselfimplyconsentorprecludeafindingofresponsibility.
DecisionMaker.Theindividualorthepanelthatmakesthedecisionsregardingtheoutcomeof ahearing.Makesdeterminationregardingrelevancyofquestionsincross-examination.Writes andissuesthewrittendecisionletter.
Incapacitation.Anindividualisconsideredtobeincapacitatedif,byreasonofmentalor physicalcondition,theindividualismanifestlyunabletomakeaknowinganddeliberatechoice toengageinsexualactivity.Beingdrunkorintoxicatedcanleadtoincapacitation;however, someonewhoisdrunkorintoxicatedisnotnecessarilyincapacitated,asincapacitationisastate beyonddrunkennessorintoxication.Individualswhoareasleep,unresponsiveorunconscious areincapacitated.OtherindicatorsthatanindividualmaybeIncapacitatedinclude,butarenot limitedto,inabilitytocommunicatecoherently,inabilitytodress/undresswithoutassistance, inabilitytowalkwithoutassistance,slurredspeech,lossofcoordination,vomiting,orinability toperformotherphysicalorcognitivetaskswithoutassistance.
Investigator.TheindividualwhocollectsstatementsandotherevidenceregardingaFormal Complaintofsexualharassment.Theinvestigatoralsowritesasummaryreport.

Recipient.Aneducationentityreceivingfederalfunds.
Remedies.RestoreorpreserveequalaccesstotheRecipient'seducationprogramoractivity. Suchremediesmayincludesupportivemeasures;remediesneednotbenon-disciplinaryornon punitiveandneednotavoidburdeningRespondents.
Respondent.Anindividualwhoseconducthasbeenreportedthatcouldconstitutesexual harassment.
Retaliation.Actsorattemptedactsforthepurposeofinterferingwithanyreport,investigation, orproceedingunderthisPolicy,orasretributionorrevengeagainstanyonewhohasreported SexualMisconductorwhohasparticipated(orisexpectedtoparticipate)inanymannerinan investigation,orproceedingunderthisPolicy.Prohibitedretaliatoryactsinclude,butarenot
limitedto,intimidation,threats,coercion,anddiscrimination.TitleIXprohibitsretaliation.For purposesofthisPolicy,anattemptrequiresasubstantialsteptowardscommittingaviolation.
Sexualmisconduct. Asexualactorcontactofasexualnaturethatoccurs,regardlessofpersonal relationship,withouttheconsentoftheotherperson(s),orthatoccurswhentheperson(s)is unabletogiveconsentorwhoseconsentiscoercedorobtainedinafraudulentmanner.Forthe purposeofthisPolicy,sexualmisconductincludes,butisnotlimitedto,sexualassault,sexual abuse,violenceofasexualnature,sexualharassment,quidproquoharassment, non-consensualsexualintercourse,sexualexploitation,videovoyeurism,contactofasexual naturewithanobject,ortheobtaining,postingordisclosureofintimatedescriptions,photos, orvideoswithouttheexpressconsentofthepersonsdepictedtherein,aswellasdating violence,domesticviolence,andstalking.
Recipientsshallusethefederalandstatedefinitionsofthefollowingtermswhenmakingall decisionsregardingsexualmisconductincludingpublicationofdefinitions,disciplinary decisions,Cleryreportingdecisions,campusclimatedecisions,andtrainingandprevention decisions.Ifthereareanychangestostateand/orfederallaw,definitionsmustbeamendedto reflectanychangestofederalandstatelawsandregulations.
DatingViolence,asdefinedbytheCleryAct.Violenceincluding,butnotlimitedto, sexualorphysicalabuseorthethreatofsuchabuse,committedbyapersonwhoisor hasbeeninasocialrelationshipofaromanticorintimatenaturewiththealleged victim.Theexistenceofsucharelationshipwillbedeterminedbasedonaconsideration ofthelengthandtypeofrelationshipandthefrequencyofinteraction.
DatingViolence,asdefinedbyLouisianalaw.Includes,butisnotlimitedto,physicalor sexualabuseandanyoffenseagainstthepersonasdefinedintheCriminalCodeof Louisiana,exceptnegligentinjuryanddefamation,committedbyonedatingpartner againsttheother.La.RS§46.2151(C).ForpurposesofthisSection,“datingpartner” meansanypersonwhois,orhasbeen,inasocialrelationshipofaromanticorintimate naturewiththevictimandwheretheexistenceofsucharelationshipshallbe determinedbasedonaconsiderationofthefollowingfactors:(1)Thelengthofthe relationship.(2)Thetypeofrelationship.(3)Thefrequencyofinteractionbetweenthe personsinvolvedintherelationship.
Domesticabuse, asdefinedbyLouisianalaw.Includes,butisnotlimitedto,physicalor sexualabuseandanyoffenseagainstthepersonasdefinedintheCriminalCodeof
Louisiana,exceptnegligentinjuryanddefamation,committedbyonefamilyor householdmemberagainstanother.La.RS46:2132(3)
DomesticViolence,asdefinedbytheCleryAct.Violence,includingbutnotlimitedto, sexualorphysicalabuseorthethreatofsuchabusecommittedbyacurrentorformer spouseorintimatepartneroranyotherpersonfromwhomtheallegedvictimis protectedunderfederalorLouisianalaw.Afelonyormisdemeanorcrimeofviolence committed:Byacurrentorformerspouseorintimatepartnerofthevictim;
•Byapersonwithwhomthevictimsharesachildincommon;
•Byapersonwhoiscohabitatingwith,orhascohabitatedwith,thevictimasa spouseorintimatepartner;
•Byapersonsimilarlysituatedtoaspouseofthevictimunderthedomesticor familyviolencelawsofthejurisdictioninwhichthecrimeofviolenceoccurred; or,
•Byanyotherpersonagainstanadultoryouthvictimwhoisprotectedfromthat person’sactsunderthedomesticorfamilyviolencelawsofthejurisdictionin whichthecrimeofviolenceoccurred.
Familyviolence,asdefinedbyLouisianalaw.Meansanyassault,battery,orother physicalabuse,whichoccursbetweenfamilyorhouseholdmemberswhoreside togetherorwhoformerlyresidedtogether.La.RS§46.2121.1(2)
Non-ConsensualSexualContact.Anyintentionalsexualtouchingorattemptedsexual touching,withoutconsent.
Non-ConsensualSexualIntercourse.Having,orattemptingtohave,sexualintercourse, cunnilingus,orfellatiowithoutconsent.Sexualintercourseisdefinedasanalorvaginal penetrationbyapenis,tongue,finger,orinanimateobject.
SexualAssaultasdefinedbytheCleryAct. Anoffensethatmeetsthedefinitionof rape,fondling,incest,orstatutoryrapeasusedintheFBI’sUniformCrimeReporting program.
SexualBatteryasdefinedbyLouisianaStateLaw. Includesanyactoroffenseunder theprovisionsofLSAR.S.14:41to14:43.1.
SexualExploitation.Anactattemptedorcommittedbyapersonforsexualgratification, financialgain,orotheradvancementthroughtheabuseorexploitationofanother person’ssexuality.Examplesofsexualexploitationinclude,butarenotlimitedto, non-consensualobservationofindividualswhoareundressedorengaginginsexualacts, non-consensualaudiotapingorvideotapingofsexualactivity,prostitutinganother
person,allowingotherstoobserveapersonalconsensualsexualactwithoutthe knowledgeorconsentofallinvolvedparties,andknowinglyexposinganindividualtoa sexuallytransmittedinfectionwithoutthatindividual’sknowledge.
SexualHarassment,asdefinedbytheDepartmentofEducationTitleIXregulations. Sexualharassmentmeansconductonthebasisofsexthatsatisfiesoneormoreofthe following:(1)AnemployeeofRecipientconditioningtheprovisionofanaid,benefit,or serviceoftheRecipientonanindividual’sparticipationinunwelcomesexualconduct; (2)Unwelcomeconductdeterminedbyareasonablepersontobesosevere,pervasive, andobjectivelyoffensivethatiteffectivelydeniesapersonequalaccesstothe recipient’seducationprogramoractivity;or(3)“Sexualassault”asdefinedin20U.S.C. 1092(f)(6)(A)(v),“datingviolence”asdefinedin34U.S.C.12291(a)(10),“domestic violence”asdefinedin34U.S.C.12291(a)(8),or“stalking”asdefinedin34U.S.C. 12291(a)(30).ForpurposesofthisPolicy,thevariousformsofprohibitedSexual Harassmentarereferredtoas“SexualMisconduct.”
SexuallyOrientedCriminalOffense. AnysexualassaultoffenseasdefinedinLa.R.S. 14:41to14:43.1
Stalking,asdefinedbytheCleryAct. Intentionalandrepeatedfollowingorharassing thatwouldcauseareasonablepersontofeelalarmedorthatwouldcauseareasonable persontosufferemotionaldistressorIntentionalandrepeateduninvitedpresenceat anotherperson’shome,workplace,school,oranyotherplacewhichwouldcausea reasonablepersontobealarmedorwouldcauseareasonablepersontosuffer emotionaldistressasaresultofverbalorbehaviorallyimpliedthreatsofdeath,bodily injury,sexualassault,kidnapping,oranyotherstatutorycriminalacttothevictimorany memberofthevictim’sfamilyoranypersonwithwhomthevictimisacquainted.34CFR 668.46(a)(ii)
Stalking, asdefinedbyLouisianaStatelaw.Stalkingistheintentionalandrepeated followingorharassingofanotherpersonthatwouldcauseareasonablepersontofeel alarmedortosufferemotionaldistress.Stalkingshallinclude,butnotbelimitedto,the intentionalandrepeateduninvitedpresenceoftheperpetratoratanotherperson’s home,workplace,school,oranyplacewhichwouldcauseareasonablepersontobe alarmed,ortosufferemotionaldistressasaresultofverbalorbehaviorallyimplied threatsofdeath,bodilyinjury,sexualassault,kidnaping,oranyotherstatutorycriminal acttohimselforanymemberofhisfamilyoranypersonwithwhomheisacquainted. La.RS§14:40.2(A)“Harassing”meanstherepeatedpatternofverbalcommunications ornonverbalbehaviorwithoutinvitationwhichincludes,butisnotlimitedto,making
telephonecalls,transmittingelectronicmail,sendingmessagesviaathirdparty,or sendinglettersorpictures.“Patternofconduct”meansaseriesofactsoveraperiodof time,howevershort,evidencinganintenttoinflictacontinuityofemotionaldistress upon theperson.Constitutionallyprotectedactivityisnotincludedwithinthemeaningof patternofconduct.La.RS§14:40.2(C)
Supportivemeasures.Non-disciplinary,non-punitiveindividualizedservicesofferedas appropriate,asreasonablyavailable,andwithoutfeeorchargetothecomplainantor respondentbeforeorafterthefilingofaformalcomplaintorwherenoformalcomplainthas beenfiled.
SupportivemeasuresaredesignedtorestoreorpreserveequalaccesstoRecipient’seducation programoractivitywithoutunreasonablyburdeningtheotherparty,includingmeasures designedtoprotectthesafetyofallpartiesorRecipient’seducationalenvironment,ordeter sexualharassment.Supportivemeasuresmayincludecounseling,extensionsofdeadlinesor othercourse-relatedadjustments,modificationsofworkorclassschedules,campusescort services,mutualrestrictionsoncontactbetweentheparties,changesinworkorhousing locations,leavesofabsence,increasedsecurityandmonitoringofcertainareasofthecampus andothersimilarmeasures.
Victim. Anindividualwho,afteralldueinvestigationand/oradjudication,hasbeenfoundtobe thetargetofsexualmisconduct.
RequirementsofStateLaw,FederalLawandDepartmentofEducation Regulations
AmnestyfromStudentDisciplinefortheReportingPartyandMaterialWitnesses
Assistingstudentswhoarereporting,orassistinginaninvestigationof,sexualmisconductis Recipient’sprimaryinterest.Inordertofacilitatereporting,Recipientsshallnotcharge studentswho,ingoodfaith,reportsexualmisconductorserveasmaterialwitnesseswith StudentCodeofConductviolations,forbehaviorthatotherwisewouldbeconsideredviolations (forexampleconsumingalcoholunderageorconsumingillegaldrugs).
CampusClimateSurvey.Toadequatelyassessperceptionsandbehaviorsofsexualmisconduct onRecipient’scampus,Recipientshalladministerananonymoussexualassaultcampusclimate surveytoitsstudentsonceeverythreeyears.Ifthesurveyisincludedasaseparatecomponent ofabroadersurveyregardingcampussafety,thesexualassaultcomponentwillbeclearly identifiedassuch.
ConfidentialAdvisors. Recipientshavedesignatedtrainedindividualswhoshallserveas ConfidentialAdvisors.Theyshall,totheextentauthorizedunderlaw,provideconfidential servicestostudents.
ConfidentialAdvisorsmay,asappropriate,serveasaliaisonbetweenanallegedvictimand Recipientorlocallawenforcementwhendirectedtodosoinwritingbyanallegedvictimwho hasbeenfullyandaccuratelyinformedaboutwhatproceduresshalloccurifinformationis shared,andassistanallegedvictimincontactingandreportingtoaresponsibleemployeeor locallawenforcement.
TheConfidentialAdvisorshallbeauthorizedtoliaisewithappropriatestaffandRecipientto arrangesupportivemeasures,asdefinedhereinabove.RequeststoaConfidentialAdvisorfor supportivemeasuresshallnottriggeraninvestigationbyRecipient.
TheConfidentialAdvisorshallbeauthorizedtoaccompanytheallegedvictim,whenrequested todosobytheallegedvictim,tointerviewsandotherproceedingsofacampusinvestigation andinstitutionaldisciplinaryproceeding.
TheConfidentialAdvisorisauthorizedtoadvisetheallegedvictimof,andprovidewritten informationregarding,boththeallegedvictim’srightsandtheRecipient’sresponsibilities regardingordersofprotection,no-contactorders,restrainingorders,orsimilarlawfulorders issuedbyacourtofcompetentjurisdictionorbyRecipient.TheConfidentialAdvisorisnot obligatedtoreportcrimestoRecipientorlawenforcementinawaythatidentifiesanalleged victimoranaccusedindividual,unlessotherwiserequiredtodosobylaw.

OngoingPreventionandAwarenessCampaigns. Ongoingpreventionandawareness campaignsconsistofprogramming,initiatives,andstrategiesthataresustainedover timeandfocusonincreasingunderstandingoftopicsrelevantto,andskillsfor addressing,datingviolence,domesticviolence,sexualassault,andstalking,usinga rangeofstrategieswithaudiencesthroughouttheinstitution.
PrimaryPreventionPrograms.Primarypreventionprogramsconsistofinitiativesand strategiesinformedbyresearchorassessedforvalue,effectiveness,oroutcomethatare intendedtostopdatingviolence,domesticviolence,sexualassault,andstalkingbefore theyoccurthroughthepromotionofpositiveandhealthybehaviorsthatfosterhealthy, mutuallyrespectfulrelationshipsandsexuality,encouragesafebystanderintervention, andseektochangebehaviorandsocialnormsinhealthyandsafedirections.
RiskReduction.Riskreductionconsistsofoptionsdesignedtodecreaseperpetration andbystanderinactionandtoincreaseempowermentforvictimstopromotesafetyand tohelpindividualsandcommunitiesaddressconditionsthatfacilitateviolence. Additionaloptionsmayincludedesignationandpublicationof“redzones”(i.e.,times andplacesofhighincidenceofcrimes,includingsexualviolence).
Generally,Recipientmustoffereducationandpreventionprogramstoallstudentsduringtheir firstsemesterofenrollmentandonanongoingbasisthroughouttheirenrollment.
Programsshallcover:
(1)statementsthatRecipientprohibitsallformsofSexualMisconduct,asdefinedbythis Policy,andthecrimesofdatingviolence,domesticviolence,sexualassault,andstalking, asdefinedbyfederallaw;
(2)thedefinitionsofdatingviolence,domesticviolence,sexualassault,andstalking understatelaw;
(3)thedefinitionof“Consent,”asprovidedinthisPolicy:
(4)safeandpositiveoptionsforbystanderinterventionthatmaybecarriedoutbyan individualtopreventharmortointervenewhenthereisarealorperceivedriskof datingviolence,domesticviolence,sexualassault,orstalkingagainstapersonother thantheindividual;
(5)informationonriskreductiontorecognizewarningsignsofabusivebehaviorand howtoavoidpotentialattacks;
(6)informationabouttheproceduresthatcomplainantsshouldfollow,andthat Recipientwillfollow,afteranincidentofdatingviolence,domesticviolence,sexual assault,orstalkinghasoccurred;and,
(7)anyothercontentorresourcesthatsupportpreventionandreductionofsexual misconduct.

Retaliationagainstanindividualformakingagoodfaithcomplaintofunlawful discrimination,harassmentorotherunlawfulpractice,orforusingorparticipatinginthe complaintprocess,isaviolationofRecipient’spolicyandisstrictlyprohibited.Employeesor studentsmakingasexualmisconductreportorcomplaint,orassistingintheinvestigationof suchacomplaint,willnotbeadverselyaffectedintermsandconditionsofemploymentand/or academicstandingnordiscriminatedagainst,terminated,orexpelledbecauseofthecomplaint.

Training.TitleIXCoordinators,investigators,decisionmakers,confidentialadvisors,andany personwhofacilitatesaninformalresolutionprocess,shallreceivetrainingonsexual harassmentasdefinedbythispolicy,thescopeofRecipient’seducationprogramoractivity, howtoconductaninvestigationandthegrievanceprocess.
Decisionmakersshallreceivetrainingonanytechnologytobeusedatalivehearingandon issuesofrelevanceofquestionsandevidence,includingwhenquestionsandevidenceabout theComplainant’ssexualpredispositionorpriorsexualbehaviorarenotrelevant.
Investigatorsshallreceivetrainingonissuesofrelevanceandhowtocreateaninvestigative reportthatfairlysummarizesrelevantevidence.
Annualtrainingshouldoccuratnewemployeeorientationsandatthebeginningofeach academicyear.
TrainingmaterialsshallbemadeavailableonRecipient’swebsite.
TransferPolicy.Thetranscriptofastudentwhohasbeenaccusedofasexuallyoriented criminaloffenseandwithdrawspendingdisciplinaryactionshallbewithhelduntilinvestigation andadjudicationofthematterbytheinstitutioniscompleted.
Ifacomplainantchoosestoinformallybringallegations,theymaybringthemattertoanyofthe individualsdesignatedhereinbelowunderthesection“ReportingOptions.”Ifthepersonto whomharassmentnormallywouldbereportedistheindividualaccusedofmisconduct,reports maybemadetoanothermanager,supervisor,ordesignatedemployeeordirectlytotheTitleIX CoordinatorortheDeputyTitleIXCoordinator.
AllRecipientemployeesaremandatoryreporters,withtheexceptionofconfidentialadvisors andthoseemployeesdeemedexemptbyRecipient(e.g.employeesofthePhysicalPlant). Shouldanymandatoryreporterobserve,encounter,orlearnofconductthatmaybeinviolation ofthispolicy,saidindividualmustreportthatconducttoeithertheTitleIXCoordinatororthe DeputyTitleIXCoordinator.Thisincludesconductbyemployees,students,orthirdparties.
Reportsofsexualmisconductshouldbebroughtforwardassoonaspossibleafterthealleged conductoccurs.Whilethereisnostatedperiodforreporting,promptreportingwillbetter enabletheUniversitytorespondtothereport,determinetheissues,andprovidean appropriateremedyand/oraction.Allincidentsshouldbereportedevenifasignificantamount oftimehaspassed.However,delayingareportmayimpedeRecipient’sabilitytoconductan investigationand/ortotakeappropriateremedialactions.
ReportingOptions.Ifanindividualchoosestoinformallybringallegations,complainantmust benotifiedoftherightto,atanytime,pursueaformalcomplaintand/ortakelegalaction.
A“FormalComplaint”isadocumentfiledbyacomplainantorsignedbytheTitleIXCoordinator allegingsexualharassmentagainstarespondentandrequestingthatRecipientinvestigatethe allegationofsexualharassment.AtthetimeoffilingaFormalComplaint,aComplainantmust beparticipatinginorattemptingtoparticipatein,theeducationprogramoractivityof Recipient.
AFormalComplaintcanbefiledbyathirdparty,suchasaparentorguardian,onbehalfofa Complainant.Whileparentsandguardiansdonotbecomecomplainants(orrespondents), TitleIXregulationsrecognizethelegalrightsofparentsandguardianstoactonbehalfof parties(includingbyfilingformalcomplaints)inTitleIXmatters.

FormalComplaintSignedbytheTitleIXCoordinator.IntheeventthataComplainantultimately requeststhatRecipientnotinvestigateapotentialTitleIXviolation,thatrequestshouldbe respectedunlesstheTitleIXCoordinatordeterminesthatsigningaFormalComplainttoinitiate aninvestigationisnotclearlyunreasonableinlightoftheknowncircumstances.

ConsolidationofFormalComplaints.RecipientmayconsolidateFormalComplaintsasto allegationsofsexualharassmentagainstmorethanoneRespondent,orbymorethanone ComplainantagainstoneormoreRespondents,orbyonepartyagainsttheotherparty,where theallegationsofsexualharassmentariseoutofthesamefactsorcircumstances.
InvestigationTimeFrame.Theinvestigationshouldbeginwithinfiveworkingdaysofthenotice totheRespondentandareport(asdescribedinsectionmbelow)mustbepreparedandshared withallpartieswithinareasonabletimeframe,preferablynolongerthantenworkingdays fromthedaytheinvestigationbegan.
EquitableTreatment.Investigatorwillremainneutralthroughouttheinvestigationandprovide bothComplainantandRespondentopportunitiestorespondinpersonandinwriting,tosubmit relevantdocuments,andtoproducerelevantwitnesses.Bothpartiesshallalsobeafforded simultaneousnoticesoftheopportunitytohavearepresentativeoradvisorpresentatall meetings,andtheabilitytoinspectanyinformationthatwillbeusedaftertheinvestigation duringinformalandformaldisciplinarymeetings.Atnotimewilleitherpartybeoffered mediationasanoptiontoresolveasexualmisconductcasethatinvolvesviolentorcriminal conduct. GatheringEvidence.Theburdenofproofandtheburdenofgatheringevidencesufficientto reachadeterminationregardingresponsibilityrestswithRecipient.
Recipientcannotaccess,consider,disclose,orotherwiseuseaparty’srecordsthataremadeor maintainedbyaphysician,psychiatrist,psychologist,orotherrecognizedprofessionalor paraprofessionalactingintheprofessional’sorparaprofessional’scapacity,orassistinginthat capacity,andwhicharemadeandmaintainedinconnectionwiththeprovisionoftreatmentto party,unlessRecipientobtainsthatparty’svoluntarywrittenconsent.
Recipientmustprovideanequalopportunityforthepartiestoproducewitnesses,includingfact andexpertwitnesses,andotherinculpatoryandexculpatoryevidence.
Recipientshallnotrestricttheabilityofeitherpartytodiscusstheallegationsunder investigationortogatherandpresentrelevantevidence.
RighttoInspect,Review,Access,andRespondtoEvidence.Allpartiesshallbeprovidedanequal opportunitytoinspectandreviewanyevidenceobtainedaspartoftheinvestigationthatis directlyrelatedtotheallegationsraisedinaFormalComplaint,includingevidenceuponwhich
Recipientdoesnotintendtorelyinreachingadeterminationregardingresponsibilityand inculpatoryorexculpatoryevidencewhetherobtainedfromapartyorothersource.
Aftersaidreview,partiesshallhavetenworkingdaystosubmitawrittenresponsetosaid evidence,whichtheInvestigatorwillconsiderpriortocompletionofthereport.
Recipientmustmakeallsuchevidenceavailableatanyhearingtogiveeachpartyequal opportunitytorefertosuchevidenceduringthehearing,includingforpurposesofcross examination.
ReportofInvestigation.Nolaterthantendaysfollowingthecompletionoftheinvestigation,the Investigatorwillcompleteawritteninvestigativereportthatincludessummariesofinterviews conducted;photographs,ifany;documentsandmaterialsreceived;descriptionsofrelevant evidence;summariesofrelevantelectronicrecords;andadetailedreportoftheeventsrelated totheincident.

LiveHearing.Recipient’sTitleIXgrievanceprocessshallprovideforalivehearing.Thehearing maybeconductedwithallpartiesphysicallypresentinthesamegeographiclocation,or,at Recipient’sdiscretion,anyorallparties,witnesses,andotherparticipantsmayappearatthe livehearingvirtually,withtechnologyenablingparticipantssimultaneouslytoseeandheareach other.
Allpartiesshallbenotifiedofthedetailsofthehearing,includingdate,time,location, participants,andpurpose.Saidnoticeshallbeprovidedtenworkingdayspriortothehearing, andwhetherthematterwillbedecidedbyanindividualorapanel.
Recipientshallcreateanaudio,audiovisualrecording,ortranscript,ofthehearingandmakeit availabletoallpartiesforinspectionandreview.

Sanctionsorinterventionsmayalsoservetopromotesafetyordeterstudentsandemployees fromsimilarfuturebehavior.SomebehaviorissoharmfultotheRecipient’scommunityorso detrimentaltotheeducationalprocessthatitmayrequiremoreserioussanctionsor interventions,suchasremovalfromRecipienthousing,removalfromspecificcoursesor activities,suspensionorexpulsionfromRecipient,oremploymentdiscipline/termination. Sanctionsorinterventionsmayinclude,butarenotlimitedto,oneormoreofthefollowing:
● FormalReprimand.AformalnoticethatRespondenthasviolatedRecipientpolicyand thatfutureviolationsmaybedealtwithmoreseverely.
● DisciplinaryProbation.AdesignatedperiodoftimeduringwhichRespondentisnotin goodstandingwithRecipient.Thetermsofprobationmayinvolverestrictionsofstudent privilegesand/orsetspecificbehavioralexpectations.
● Restitution.Reasonableandlimitedcompensationforloss,damage,orinjurytothe appropriatepartyintheformofmoneyormaterialreplacement.
● RestrictionfromEmploymentatRecipient.Prohibitionof,terminationfrom,orlimitation onRecipientemployment.
● Class/Workshop/Training/ProgramAttendance.Enrollmentinandcompletionofaclass, workshop,training,orprogramthatcouldhelpRespondentortheRecipientcommunity.
● UniversityHousingTransferorRemoval.Placementinanotherroomorhousingunitor removalfromRecipienthousing.Housingtransfersorremovalsmaybetemporaryor permanentdependingonthecircumstances.
● ProfessionalAssessment.Completionofaprofessionalassessmentthatcouldhelp RespondentorRecipientascertainRespondent’songoingsupervisionorsupportneeds tosuccessfullyparticipateinRecipient’scommunity.
● RemovalfromSpecificCoursesorActivities.Suspensionortransferfromcoursesor activitiesatRecipientforaspecifiedperiodoftime.
● NoContact.RestrictionfromenteringspecificRecipientareasand/orfromallformsof contactwithcertainpersons.
● Suspension.SeparationfromRecipientforaspecifiedperiodoftimeoruntilcertain conditionsaremet.
● Expulsion.PermanentseparationfromRecipient.
TransferNotification.Ifastudentisfoundresponsibleforasexually-orientedcriminaloffense uponthecompletionofsuchinvestigationand/oradjudicationandseekstotransfertoanother institution,Recipientisrequiredtocommunicatesuchaviolation,whentheinstitution becomesawareofthestudent’sattempttotransfer,withtheinstitution(s)towhichthestudent seekstotransferorhastransferred. Appeals.EitherpartymayappealtheoutcomeofthematterexceptwhereRespondenthas acceptedanagreementunderthesanctioningprocessoutlinedabove.Thedismissalofa FormalComplaintoranyallegationscontainedthereinmayalsobeappealed.Appealswillbe conductedinanimpartialmannerbyimpartialdecisionmaker.
Areviewofthematterwillbeefficientandnarrowlytailored.Apartymayseekreviewonlyon thefollowinggrounds:
•Aproceduralirregularitythataffectedtheoutcomeofthematter;
•Thereisnewlydiscoveredevidencethatcouldaffecttheoutcomeofthematter;
•AmemberoftheTitleIXpersonnelinvolvedinthecase(theTitleIXCoordinator,the DeputyTitleIXCoordinator,aninvestigator,aDecision-Maker,oranyindividual designatedbyRecipienttofacilitateaninformalresolutionprocess)hadaconflictof interestorbias;and/or
•Thesanctions/interventionsarenotdesignedtorestoreorpreserveComplainant’s accesstoRecipient’seducationprogramoractivity.
•Thesanctions/interventionsareinappropriateordisproportionatetothedetermined violation(s).
Allotherpartiesshallbenotifiedinwritingintheeventanypartyfilesanappeal.Partiesshall begivenareasonableopportunitytosubmitawrittenstatementinsupportof,orchallenging, theoutcome.
IncasesinvolvingstudentRespondentsadjudicatedbytheOfficeofAdvocacyand Accountabilityapartymayappealadecisionbasedontheappealsproceduresoutlinedinthe StudentCodeofConductwhichcanbefoundatwww.southeastern.edu/code.Insuchcases, theCodeofConductrequiresthattheappealingpartymustfileanappealwiththeVice PresidentforStudentAffairs,withintenworkingdaysofnotificationofthedecision.Withinten workingdays,theVice-President'sdecisionwillbemadeavailabletotheparticipatingparties,in writing,simultaneously.TheVice-President’sdecisionshallbefinalandunreviewableexceptin theeventofasanctionofexpulsionorsuspensionforaperiodofoneyearorlongerforthe Respondent,inwhicheventtheRespondentmayappealtothePresident.Suchappealmustbe madewithintenworkingdaysofnotificationoftheVice-President’sdecision.Withinten workingdays,thePresident’sfinalandunreviewabledecisionwillbemadeavailabletothe participatingparties,inwriting,simultaneously.
IncasesinvolvingemployeeRespondents,apartymaysubmitawrittenappealtoRecipient’s Presidentwithintenworkingdaysofthedateofthenotificationofthedecision.Withinten workingdays,thePresident’sfinalandunreviewabledecisionwillbemadeavailabletothe participatingparties,inwriting,simultaneously.
Delays/Extensions.Intheeventthatthereisalegitimategoodcauseneedforadelayora limitedextensionoftimeatanystageintheTitleIXproceedings(whetherattherequestofany officialorparty),Recipientshallnotifyinwritingallpartiesoftherationaleforthedelayor extensionaswellasthenewtimeframe.Goodcausemayincludeconsiderationssuchasthe absenceofaparty,aparty’sadvisor,orawitness;concurrentlawenforcementactivity;orthe needforlanguageassistanceoraccommodationofdisabilities.
ProhibitiononDualRoles.Noindividualcanserveinmorethanoneroleinanyinvestigation–theTitleIXteammembers,specificallytheInvestigator(s),Decision-Maker(s),appealsofficer(s), coordinator(s),andadvisor(s)mustallbedifferentofficials.
BiasorConflictsofInterest.WhenmakingdecisionsregardingtheselectionofallTitleIXteam membersineachcase,Recipientmustvetallofthepotentialmemberstoensurethatnoneof themhaveabiasorconflictofinterestregardinganypartytotheproceeding.Ifanofficial believesthattheycannotserveforoneofthesereasonstheymayrecusethemselvesfromthe proceeding.Intheeventthatapartybelievesthatanyofficialmayhaveabiasorconflictof interestthepartymaychallengethatofficial.SaidchallengewouldbemadetotheDeputyTitle IXCoordinatorunlessthatindividualisthesubjectofthechallenge,inwhicheventthe challengewouldbemadetotheChiefTitleIXCoordinator.Afterareviewofthechallenge,if foundmeritorious,theindividualwillbereplaced.

Unplannedpregnanciescanhaveasignificantimpactonyouracademicjourney.Forexample, lessthan1in10studentswithchildrencompleteabachelor'sdegreewithinsixyearsofstarting college.Additionally,61%ofwomenwhohavechildrenafterenrollingincommunitycollegedo notfinishtheirdegrees—65%higherthanthosewithoutchildren.Overaquarter(26%)ofall undergraduatestudents,or4.8millionstudents,arecurrentlyraisingdependentchildren.
LouisianahasoneofthehighestunintendedpregnancyratesintheU.S.,with95%ofthese pregnanciesoccurringwhencontraceptionisnotusedorisusedincorrectly.Whileabstinenceis theonly100%effectivemethodofpreventingpregnancy,thereareseveralhighlyeffective contraceptivemethodsavailablewhenusedcorrectly.
