notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - With brisk weather, November is often the best time of year to enjoy Town parks and open space, and take advantage of more than 20 miles of hiking trails. Hike Guilderland!, a useful Town website application, has interactive mapping and descriptions of hiking trails offered by the Town, Albany Pine Bush Preserve, Mohawk Hudson Conservancy, and Department of Environmental Conservation.

HIKE GUILDERLAND! When, but not if, measurable snow arrives, the same trails are suitable for snowshoeing. The Western Turnpike Golf Course will have groomed cross-country skiing and snowshoeing trails extending into Tawasentha Park. The golf cart paths will also be opened for daytime walkers. Parks & Rec’s "Get Out and Walk This Winter" program, which kept open Tawasentha, Keenholts, DiCaprio, and Nott Road Parks during daytime hours last winter, will return this winter. Sledding takes place at the Winter Recreation Area, a short distance south of the Tawasentha Park entrance. Please remember that dogs must kept on a leash at all times, including in Town parks, with the exception of the Nott Road dog park. While you may think that your dog is friendly, the Parks Department receives complaints from patrons who are confronted by unleashed dogs while walking their own dogs or patrons who are enjoying Town parks with their family and children. After last year’s resounding success, Parks & Rec is again offering “grab and go” kits for Thanksgiving crafts. You can sign-up for kits at GuilderlandRec.com. The kits will be available for pickup on Wednesday, November 24. November is also a very busy time for the Highway Department as it completes the rebuilding of Grant Hill Road, which has garnered praise from industry experts for the project’s design, quality of the workmanship in stabilizing slopes and widening the road, and making it safer for motorists and bicyclists. Highway employees are also wrapping up paving projects and, in anticipation of winter weather, cleaning out stormwater drains. The Highway Department is the midst of its annual leaf vacuuming effort. An interactive street-by-street calendar was 4

included in the Town’s Fall Newsletter and on the Department’s webpage. The calendar includes scheduled leaf vacuuming until Peter G. Barber - Town Supervisor December 3. If there is snow before a scheduled pick-up, there is no need to call the Highway Department which will resume the schedule as soon as possible. If there is no snow, crews will continue vacuuming leaves as long as necessary. Please remember that Highway trucks circulate year-round picking up tied lawn debris and lawn bags. You can also help Highway workers keep our streets safe for walkers, strollers, and bicyclists by not depositing leaf piles on the pavement. Please place the piles on the edge of your lawn, which makes it easier and safer for vacuuming. Large leaf piles on streets reduce visibility, particularly in the fall’s lengthening nighttime, and, with heavy rain falls, have clogged storm drains, causing flooded roads, generating odors from decaying leaves and organic material, and unnecessarily increasing maintenance costs. Please remember that from November 1 to April 1, no parking is allowed on Town roads between 2am and 7am. This restriction allows for more efficient clearing roads of ice and snow, and provides for safer passage of school buses, emergency vehicles, and highway trucks due to accumulated snow piles and dark conditions. On certain streets, there are posted signs that limit parking to specific days and times. In late July, the Town received the first of two annual payments under the American Rescue Plan Act. The first year’s installment of $1,746,353.72 was placed in a designated account. With the Town Board’s approval, the first disbursement of ARPA funds will be invested in a new ambulance and paramedic response vehicle for the EMS Department. At its November 4 meeting, the Town Board will consider authorizing a disbursement to purchase new radio consoles for the Town’s emergency dispatch unit. Dispatchers perform an indispensable role in responding to emergencies by an initial assessment of the reported emergency, understanding the abilities of each responding unit, coordinating a rapid response, and monitoring the response to conclusion. I am also very proud to report that the EMS Department has received two recent significant recognitions for its pandemic response. At its recent annual gala, Community Caregivers recognized the EMS with its Public Service Award. The State Department of Health’s Bureau of Emergency Medical Services recognized the Town EMS as the State EMS Agency of the Year that is awarded to an “agency which strives for consistency in EMS excellence and exhibits exemplary performance when providing or supporting prehospital emergency medical care.”


The award recognizes EMS’s leading role in responding to the pandemic, including the early use of UV-C light to decontaminate personal protective equipment, ozone generators to disinfect ambulances after COVID-19 transports, and electrostatic sprayers with EPA-rated disinfectant which could be used at hospitals and allowed for the immediate return of ambulances to service. These techniques disinfected the Town’s senior services buses, large meeting rooms at Town Hall, and spaces at the Guilderland Public Library. Town EMS was among the first agencies in the State to perform rapid antigen testing which greatly helped reduce infection among Town employees. EMS later was among the few local agencies to receive a State DOH license to administer vaccines at Station 1 and a Community Paramedicine designation which allowed for delivering vaccines off-site at the Guilderland High School and in hundreds of homes in our community. This homebound vaccination effort is continuing. The Guilderland YMCA has launched its annual Basket Brigade which will provide Thanksgiving dinners to 100 Guilderland families. You can help by dropping off any or all of the following: cans/jars of gravy, fruit, veggies, yams, and cranberry sauce, and boxes of stuffing, potatoes, and cake or brownie mix. The cost to sponsor a family’s basket is $65.00, and you can make donations online (https://cdymca.org/basketbrigade/) or by check or cash at Guilderland YMCA which can help in purchasing turkeys. The Guilderland YMCA’s lobby at 250 Winding Brook Drive is accepting donations through November 15.

A reminder that, while Town Hall and other facilities are fully open with no capacity restrictions, the Town is following CDC’s guidance which calls for wearing facemasks indoors in Town buildings, regardless of vaccination status, as long as the County’s infection rate is at 50 or more positive cases per 100,000 residents. With the County’s infection rate at threetimes the facemask threshold, and winter coming, it could take some time before facemasks are no longer required indoors. ROCK TAPE: NOT JUST FOR WORLDCLASS ATHLETES ANYMORE

Guilderland, NY - Kinesiolog y tape has been used for many years by holistic health care providers, and became increasingly popular during the 2008 Beijing Olympics when we started seeing elite athletes decorated with colorful strips of tape in intricate designs on their shoulders, backs and legs. Today, kinesiolog y tape is not exclusive to worldclass athletes. ‘Weekend Warriors’, high school athletes, and anyone who wishes to move pain free through their daily activities can reap the many benefits of kinesiotaping. Here at the Sports & Spinal Wellness Center, we use the premium brand of kinesiolog y tape called Rock Tape. So what does this magical tape actually do? Rock Tape is a cotton and nylon stretch tape that adheres to the skin and can generally be worn up to 3-5 days. It is waterproof, so you can sweat, shower, and even swim while wearing it and it will stay in place. When applied to a painful or inflamed area, the tape lifts the skin and decompresses the tissues to decrease pain, improve circulation, and give support without restricting range of motion. Let’s explore some of the major effects the tape has on the body and common applications for use.

2. The Mechanical Effect: When tissues are lifted and decompressed by Rock Tape, this improves the natural slide and glide between the skin and the underlying fascia, connective tissues and muscle. This significantly decreases joint and muscle pain and cramping , and allows for full range of movement. Continuing Support and Who Gets Fido?

This article contains two parts, each discussing recently enacted laws. by Margaret C. Tabak

SUPPORT FOR CHILDREN WITH SPECIAL NEEDS For more than 60 years, it has been undisputed that parents have a responsibility to support their children until the child is 21 years old, unless there is an earlier emancipation, such as the child’s marriage; entering the Armed Services; working full time; becoming self-supporting; or permanently leaving the home (although this one can become a little dicey). In 1989, the child support laws were revolutionized by the implementation of the Child Support Standards Act (CSSA). Rather than the judge having complete discretion as to how much support should be awarded, support became formula based. While there have been a number of amendments to the law, and a boatload of caselaw interpreting it, for the most part things have stayed the same for the past 30 years. This changed dramatically on October 8, 2021 when Governor Hochul signed into law legislation that requires parents to support a child until age 261 , if that person is developmentally disabled, defined as2: “Developmental disability” means a disability of a person which: (a) (1) is attributable to intellectual disability, cerebral palsy, epilepsy, neurological impairment, familial dysautonomia, Prader-Willi syndrome or autism; (2) is attributable to any other condition of a person found to be closely related to intellectual disability because such condition results in similar impairment of general intellectual functioning or adaptive behavior to that of intellectually disabled persons or requires treatment and services similar to those required for such person; or (3) is attributable to dyslexia resulting from a disability described in subparagraph one or two of this paragraph; (b) originates before such person attains age twenty-two; (c) has continued or can be expected to continue indefinitely; and (d) constitutes a substantial handicap to such person’s ability to function normally in society. It is necessary for the disability to be diagnosed by a professional. The support will be calculated using the CSSA. In addition: …the court may consider whether the financial responsibility of caring for the individual has been unreasonably placed on one parent when determining the support obligation. The duration of time the court may use when considering this factor shall be limited to the time period from when the child turned twenty-one until the individual turns twenty-six. Does this mean that parents will be fighting over who the child will live with from 21 to 26 to avoid or receive support? As a court cannot award custody for a person over 18 years of age, will we now be placing the adult child in the position of making the decision? In the alternative, will courts needs to assign guardians to disabled adults who may now be placed in this difficult situation? Often, persons with disabilities may be receiving governmental benefits such as social security or Medicaid. It will be extremely important to craft awards in a manner that does not cause the adult child to lose benefits.

In addition, the court can direct those benefits be paid to the parent or to an “… “exception trust”…. If such direction would assist in maximizing the assistance to the child.” In other words, the payor parent may be ordered to fund a trust, and the “home” parent would not receive any direct assistance. Depending on your perspective, this law can be of tremendous assistance to some parents and an unforeseen burden to others. Whether or not this opens a floodgate of litigation is yet to be determined, taking into account how many adult children will continue to live at home, and the impact of other benefits and services provided to the child. Hopefully the needs and welfare of the adult child will be paramount to all.

WHO GETS FIDO? We all love our pets and sometimes this becomes a contentious issue in a divorce. As a pet has traditionally been considered “chattel” or “property”, courts were loathe to get involved. In other words, deciding who gets Fluffy is the same as distributing the knick-knacks. On October 25, 2021, Governor Hochul signed into law3 legislation that requires a court to consider the “best interest” of a “companion animal” when determining possession. 5. “Companion animal” or “pet” means any dog or cat, and shall also mean any other domesticated animal normally maintained in or near the household of the owner or person who cares for such other domesticated animal. “Pet” or “companion animal” shall not include a “farm animal” as defined in this section4. According to the bill jacket, the justification for the legislation is: According to the American Veterinary Medical Association (AVMA), 36.5% of American households owned a dog and 30.4% owned a cat in 2012. … Custody decisions involving pets in divorce proceedings are not uncommon. Courts typically deal with pets in divorce proceedings as they do with personal property such as cars and furniture. For many families, pets are the equivalent of children and must be granted more consideration by courts to ensure that they will be properly cared for after a divorce. I am not sure what courts these legislators are practicing in, but in 33 years I have never had a pet custody trial. Over the years, my clients have agreed that one spouse or the other takes the pet, or sometimes they share back and forth. While difficult and emotional, I have never needed a judge to intervene. I will be interested to see what qualifies as “best interests”. Is it food? Exercise? Intellectual stimulation? Proving who loves the pet more? It is hard enough to determine what is best for children, much less pets! As someone who is walking her dog every morning in the vast variety of Guilderland weather, I appreciate doggie love. As with children, I encourage everyone to look at what is best for Wilbur, not necessarily what you want.

YEAR-END TAX STRATEGIES by Douglas Bauer • Certain high-deductible health insurance plans allow for the ability to make tax-deductible contributions to a Health Savings Account (HSA) as an above-the-line deduction, which means one need not itemize deductions in order to benefit. Additionally, contributions made via payroll deduction are not subject to FICA tax. For 2021, eligible persons may contribute as much as $3,600 for individual coverage or $7,200 for family coverage (plus an additional $1,000 for people age 55 or older). Be sure to coordinate this strategy with any contributions your employer may have made on your behalf. Please note that HSA contributions are not permitted if you are enrolled in Medicare Part A or Part B.

Earlier this year, we discussed the importance of making income tax planning a year-round activity. This month, we offer reminders of some strategies that have year-end deadlines as it relates to the 2021 personal income tax year. • If you are not on pace to achieve your target level of contributions to your employer-sponsored retirement plan (up to a maximum $19,500 for 401k or similar accounts, plus an additional $6,500 ‘catch up’ for those who are age 50 or older), you may wish to contact your employer’s payroll department to increase your contributions for your remaining paychecks. You may even find it makes sense to contribute your entire paycheck (after other mandatory withholdings) so as to maximize your contribution for the year. • For tax year 2021, the standard deduction amounts are $25,100 for married-filing-jointly, $18,800 for head of household, and $12,550 for individual taxpayers and marriedfiling-separately. If you find that your itemized deductions (which may include, but are not limited to, medical expenses, property taxes, sales taxes, mortgage interest, state income tax payments, and charitable donations) are close to the standard deduction, you may wish to consider pre-paying some 2022 expenses, such as charitable donations. By “bunching deductions”, those who typically are eligible only for the standard deductions may be able to itemize deductions every other year, thereby realizing some income tax savings.

• Depending on your personal tax situation, you may wish to realize capital gains (by selling appreciated securities) or capital losses (by selling securities which are worth less than what you paid for them). Many investors may be able to realize capital gains and pay a tax rate of 0% on their federal return if they are in a 12% or lower marginal income tax bracket. Other investors may benefit from utilizing realized losses to either offset realized gains (no limit) or to offset ordinary income (up to $3,000 per year, with any remainders carrying forward to future years). Please consult your tax preparer and/or financial advisor to determine if any of the above strategies are appropriate for your overall financial situation.

The ABCs of GPL By Library Director Tim Wiles Now that we’ve mostly completed our renovation, I thought it might be a good time to highlight some of what we offer here at Guilderland Public Library. A is for aquarium, a 540-gallon freshwater tropical tank that is visible from both the adult and youth reading areas. We hope this will spark a love of nature among kids, bring relaxation to adults, and serve as a “magnet” to draw kids and families back for repeat visits. A is also for air quality, which is vastly improved and meets or exceeds all CDC and NYS requirements. B is for books. Libraries will always be about books, but we are also about much more! C is for charging stations, which should be operating soon. C is for café, which may take a while longer. We’ll keep you posted! C is for curbside pickup, which continues, due to popular demand! C is for our new Children’s Library, which is the 6,555-square-foot addition on the east end of the library featuring lots of natural light. C is also for COVID—read our pandemic Operations Plan, available on our website. Key takeaway—the library is currently open for browsing and transactions, but not for seating—that comes when COVID rates lessen, based on CDC data.

E is also exhibits, which we hope to resume soon in our Helderberg Room. F is for our historic natural gas fireplace, made of wood harvested from the Fullers Tavern, built between 1795 and 1805 at the corner of Western Avenue and Fuller Station Road. Our thanks to Nicholas Ragone, owner of the site, for donating the wood for the mantles on the two-sided fireplace. The one which faces west is the original mantle from the Tavern. F is also for our Foundation, which raises money to augment the library. They are helping us now with Aquarium maintenance, and have more enhancements in the works for the future! G is for Guilderland! We are so proud to be part of this vibrant, diverse, caring community. It’s also for our garden, newly visible behind the library and a great place to have a safe conversation during daylight hours, as long as some warmth remains outside. And don’t forget Greufus, our bovine mascot, donated by the Greulich family! Kids love Greufus. H is for Hearing Assistance Technology, which we have installed in our two adult meeting rooms, as well as in the new children’s programming room. We are using three different technologies, WiFi IR (Infrared) for people with smartphones or tablets, and wearable devices for adults with T-coil hearing aids. I is for information. We are answering reference questions every hour we are open in person, over the phone at (518) 456-2400 x3, and via email (ask.librarian@guilderlandlibrary.org). J is for Job Information Resources, which you can find on our website. These include Learning Express, where you can prepare a resume, learn new computer skills, even find a job. We also have a link to Coursera, which offers access to over 4,000 programs to learn new skills, earn certifications, and advance your career.

D is for donations. Right now we have two donation bins in our staff parking lot across Mercy Care Lane. We hope to get a third. The books are hauled away by Bulk Book Warehouse of Rotterdam, which sells them online or recycles them. We hope to get back to used book sales sometime next year. Yes, they also take DVD’s! E is for electronic resources. Our E-library is open 24/7/365. During the pandemic, our already high rate of use for such materials more than doubled. People have found how easy it is to read or listen to books, page through magazines, watch films, listen to music, and use key resources like Consumer Reports and the daily New York Times from our website, all at no cost! We are always 16

My job is to stay neutral because they will both be my clients, and It is imperative that they both trust me. My 16 years experience in real estate and graduate studies as a counselor helps me to keep an emotional, and many times contentious situation professional. My job is to help my clients keep their emotions in check in order to accomplish their real estate goals, with as minimal stress as possible. The lines of communication are different than with a traditional sale because many times both parties are spoken to separately, but at other times need to be spoken to together. This requires experience and knowledge of handling the complexities of a divorce home sale. My job will be to maximize their equity in as timely a manner as possible. Of course this is always my job, but when divorce is the motivation to sell, it is a unique stressor to the sellers.
