Eva reviewed the previously approved motion regarding the funds to be transferred to the Contingency Fund. COMMITTEE: Executive Committee ACTION ITEMS: At the Executive Committee meeting on March 13, the following motion was approved regarded bylaws & policy manual changes. All motions to be presented to the Board of Directors for final approval. At the Executive Committee meeting on March 14, the following motions were approved regarding Issues Mobilization Requests: Motion Made, Seconded, and Carried: provide the Oregon Association of REALTORSÂŽ with $20,000 to draft a ballot measure regarding a 3/5 majority. Purpose is to protect home ownership incentives in the event of any tax increases. Motion Made, Seconded and Carried: provide the Oregon Association of REALTORS ÂŽ with $100,000 for campaign to defeat the housing bills that would tax homeowners.

1.1

OAR Chapters

At the request of two of more Designated REALTOR® members from the same market and trade area which is outside the jurisdiction of any Member Boards/Associations (unassigned territory), the Oregon Association of REALTORS® Board of Directors may form a Chapter. The purpose of the Chapter will be to create a structure for REALTORS® and REALTOR® Affiliates to meet and promote the goals of the Oregon Association of REALTORS® to meet and promote the goals of the Oregon Association of REALTORS® and the National Association of REALTORS®. Should the new Chapter be an area of a former local Member Board/Association, any excess funds remaining following the dissolution of the Member Board/Association, if allowed by the Member Board/Association Bylaws and following the process prescribed in said Bylaws, may revert to the Oregon Association of REALTORS® and be held in an OAR Restricted Fund for use by the Chapter for Chapter Activities. Participation in the Chapter shall be voluntary at the request of the Designated REALTOR®, however should a Designated REALTOR® join the Chapter, the NAR Dues formula will apply. The Chapter shall have a Chair and Vice Chair selected by the Chapter members. The Chair and Vice Chare are responsible to coordinate meetings of the Chapter and record the minutes of those meetings. OAR shall provide the following services/structures:  Maintain Chapter Records (membership & reports)  Provide a Chapter page on the OAR website and update monthly with Chapter member roster, calendar of events, contacts, etc.  Coordinate and schedule education events, process payments and education credit.  Shall create and process new member applications.  Shall keep membership records up to date and serve as the Point of Entry for the NRDS database.  Shall be responsible for all dues billing and processing.  Shall prepare quarterly financial and membership reports to send to the Chapter Chair and Leadership electronically.  Chapter will function much like a Committee of the State Association. Chapters shall be responsible for the following:       

All events including education events would be self-supporting through registration fees, sponsorships, chapter dues, or chapter reserves. The Chapter shall be responsible for securing the site and providing a facilitator for education events. All additional income from events will be sent to OAR and be designated for the Chapter for audit purposes. Shall secure sites for membership meetings, all other events scheduled by the Chapter. Shall have the ability to set the Chapter dues, in excess of the per member fee, to fund additional programs, products and or/services. Promote legislative efforts of the part of the Oregon Association of REALTORS® and the National Association of REALTORS®. Each Chapter is encouraged to be involved in their trade area and promote the value of using a REALTOR® to consumers in that area.

Each Chapter will be assigned an annual fundraising goal on behalf of the REALTORS® Political Action Committee and be requested to assist the Oregon Association of REALTORS® in meeting that goal.

THE FOLLOWING IS REPORTED FOR YOUR INFORMATION ONLY AND DOES NOT AFFECT ASSOCIATION POLICY OR BUDGET: Seller’s Property Disclosure Statement (SPDS) Review Workgroup The SPDS Review Workgroup has convened several times since the fall meetings. The workgroup evaluated content, style and phrasing of the questions in order to make the form as user friendly as possible, while enabling a seller to provide accurate disclosures. The most significant recommended change is to create a separate stand alone "Exclusion Form," to make it clear when a seller qualifies under one of the exclusions, they are therefore excluded from the requirement to complete the form in its entirety. Drafts of the SPDS revisions and Exclusion Form have been sent to Legislative Counsel for review and comments. The initial draft with recommended stylistic and language updates has been received back from Legislative Counsel. Due to the importance of the SPDS for our members and their clients, the Workgroup would like the Business Issues and Government Affairs Committee members, as well as several other stakeholders to further vet the draft. As a result, time constraints will not allow for the revised SPDS and Exclusion to move through the current legislative session. We are looking towards the 2018 legislative session, which will provide ample opportunity for thorough industry vetting and submission of a document that the industry can stand behind. Raising the Bar Workgroup The initial meeting for this workgroup was last fall. The workgroup is comprised of Realtor representatives from all brokerage sizes and geographic distribution throughout the state. This workgroup has been tasked with evaluating current licensing requirements for obtaining a license both at the Broker and Principal Broker level, maintaining a license and depth of educational content required at all levels. Subsequent to the initial meeting, several participants met directly with the REA Commissioner to discuss ideas and what realistically can be achieved this legislative session. This Sub Group determined increasing education and training for new and current PB's deserved immediate attention. A new Advanced Real Estate Practices (AREP) for PB's will be developed following passage of legislation giving the REA authority to implement this recommendation. The AREP for PB course will be mandatory for all PB's, including renewing PB. This course must be taken one time by all PB's. The course will include 27 hours of education, with the topics to be determined by the REA and other industry stakeholders. In addition, the 3-hour LARRC will still be required prior to renewal. For all renewals, subsequent to completion of the PB AREP course, PB's will be required to complete a specified number of CE hours from a designated list of approved topics appropriate for PB's. Other issues of importance for "Raising the Bar" have been temporarily placed on hold. (I.e. Mandatory E & O Insurance, licensing and education requirements for Brokers and Property Manager licensing)

Industry Forum 45


The Industry Forum was held on February 28, 2017 in the Portland area. The attendance included appraisers, title and escrow professionals, real estate attorneys, property manager specialists and REALTORSÂŽ. The group discussed trending topics in the industry, and highlighted the areas we can work cooperatively to take on the challenges that lay ahead. This Forum has resulted in very strong partnerships with industry affiliates. The topics discussed have far reaching benefits for all Oregon Association of REALTORSÂŽ Committees, specifically Business Issues, Professional Standards, and Government Affairs. Issues discussed at the Forum included the recently adopted Portland Rental Ordinance and tenant relocation fees, changes coming to the appraiser industry in 2018, and the increased concern with wire fraud. The Broker Forum will be held on April 13, in Salem, during the Spring Governance meetings. Global Business Council A concerted effort is being made to revive and grow the Global Business Council (GBC). The group had much success with the Business Across Borders lunch presentations several years back. Past topics included doing business in a foreign country, international relocation services, ownership of US real estate by foreign nationals, and basic immigration laws. In February 2016, OAR sponsored a CIPS Institute. Sixteen Realtors attended the full week program. NAR global staff will present at the OAR fall convention in Portland discussing international opportunities in the Pacific NW.

COMMITTEE: Government Affairs ACTION ITEMS: NONE THE FOLLOWING IS REPORTED FOR YOUR INFORMATION ONLY AND DOES NOT AFFECT ASSOCIATION POLICY OR BUDGET: As predicted, the 2017 session has been framed as a “housing session.” In other words, housing, primarily landlord / tenant issues have taken center stage. Unfortunately, when it comes to housing policy, the few things the state legislative assembly can do to impact housing is very controversial. We are fighting proposals to lift the state preemption on rent control, and working to protect landlord’s ability to protect their tenants and properties with no-cause evictions. We are also actively working against proposals that will tax homeownership through reducing the deductibility of property taxes, reducing the number of homeowners who can take the Mortgage Interest Deduction, and eliminating the capital gains exclusion when you sell your home. Taxing homeowners have been framed as ways to increase the state’s investment in low-income housing. However, with a $1.6 billion deficit to fill, these proposals are designed to help fill the budget shortfall – Primarily PERS labilities and unanticipated costs through the Affordable Care Act. On the positive side, our First-time Home Buyers Savings Account (FTHBSA) legislation is in the early roll out phase. Our polling is done, our economic research has been delivered, our website is up, our legislation has been introduced and we’re preparing for our first hearing. The FTHBSA campaign is in partnership with NAR. Our issues mobilization investment is being matched at three to one (usually a 50/50 split) for a total investment of $750,000. The campaign will focus on marketing to committee members to whom the bill has been referred. It will also illustrate the REALTOR® brand is advocates for homeownership. COMMITTEE: Political Affairs ACTION ITEMS: NONE THE FOLLOWING IS REPORTED FOR YOUR INFORMATION ONLY AND DOES NOT AFFECT ASSOCIATION POLICY OR BUDGET: The PAKC has met on March 10th, 2017 and will be meeting once again on April 5th, 2017 before REALTOR® Day. The focus of the PAKC work has been on: 1. Developing and recruiting REALTORS® to be part of the Key Constituent Program to stay engaged with state legislators. 2. Organization and Planning for 2017 REALTOR® Day at the Capitol. I have been working closely with Chairwoman Heather Benjamin on a day-to-day basis. We have been developing and executing marketing strategies and working to achieve our goal of 1000 REALTORS® to turnout. I have given chairwoman Benjamin a registration report on a weekly basis. To date the PAKC has: 1. Assigned key constituents to members and selected them to lead meetings with their legislators on REALTOR® Day. 2. Communicating with local association weekly regarding attendance and registration for REALTOR® Day. 3. Reaching out to title companies to set up booths for REALTOR® Day. More than 210 REALTOR® members have registered as of March 10th. When compared to registration at this time in 2015, the numbers are slightly above what they were back then. We anticipate another high turnout for REALTOR® Day.

THE FOLLOWING IS REPORTED FOR YOUR INFORMATION ONLY AND DOES NOT AFFECT ASSOCIATION POLICY OR BUDGET: Highlights since Sept. 2016 BOD Meeting, taken in part from the 2016 Q4 Education Report.

GRI Core Courses: At the end of 2016, we had offered 57 GRI courses, totaling 279 CE hours, to 1,064 students. We had 6 GRI graduates in our first year. So far in 2017, we have scheduled 56 GRI courses in all 6 districts. As of March 7th, we’ve already had 10 GRI graduates. The program, instructors, and courses continue to receive overwhelmingly positive responses and feedback. Designations/Certificates: In February, we partnered with the Eugene Association to bring the Accredited Buyer’s Representative (ABR) designation course to 32 members. We’ll be holding the Pricing Strategy Advisors (PSA) certification course in Portland in conjunction with October’s Fall Convention. We’re looking at holding additional designation/certification courses across Oregon throughout 2017. Webinars: Webinars continue to be a successful program with the most reach we get to our members. In 2016, we offered 17 webinars to more than 4,400 members. Looking forward to 2017, we have scheduled 17 webinars and will continue to fill our calendar as the year progresses. As of March 7th, we’ve held 5 webinars, reaching over 1,500 members. LMS: Our online learning management system (LMS) will be launching on April 1st with 20 courses we’ve created from our past recorded webinars. We’ll continue to roll out additional courses as we vet and edit past and upcoming webinars. Once we have our portal launched, we’ll begin reaching out to local associations/board and partners for the opportunity to develop their own portal underneath our license as a member benefit to provide distance and convenience learning and non-dues revenue. Profit Sharing: In 2016, we received $1,688 in commission from The CE Shop, almost double what we earned in 2015. We continue to provide CE credit for Real Estate Negotiation Institute courses offered to Oregon REALTORS®, in exchange for a $10/student payment. Real Estate Game Works officially launched on Monday, January 9th with 7 modules. A Q1 report will be included with the supplemental packet at the BOD meeting on April 14th. Miscellaneous: In 2017, we’ll be continuing our partnership with the Oregon Real Estate Agency to offer CE credit for their Board meetings and afternoon “Do’s & Don’ts” course in Lincoln City on June 5th, Klamath Falls on August 7th, Eugene/Springfield on October 2nd, and Gresham on December 4th. All upcoming education is posted, live, and open for registration on the OAR calendar. We encourage you to sign-up for education today. The two applicants were Greg Whistler and Cheryle Clunes On March 1, via conference call, the following candidates were unanimously deemed qualified to run for the 2018-2019 term as DVP. Our polling is done, our economic research has been delivered, our website is up, our legislation has been introduced and we’re preparing for our first hearing. The FTHBSA campaign is in partnership with NAR. Our issues mobilization investment is being matched at three to one (usually a 50/50 split) for a total investment of $750,000. The campaign will focus on marketing to committee members to whom the bill has been referred. It will also illustrate the REALTOR brand is advocates for homeownership. Go to www.oregonfirsthome.com to learn more and engage. Also, to supplement our lobbying activities we have applied for two additional issue campaigns: 1. Protect Oregon’s MID – Request $100,000 from OAR Issues Mob., Seeking match from NAR (additional $100,000). Oregon has a $1.6 billion deficit to fill to maintain current service levels. The House Revenue Committee has outlined the three tax proposals listed above as likely sources of additional revenue. To make matters worse, there might be a way to raise taxes on a simple majority vote.

Ballot Measure 25 (1996) implemented the 3/5 majority rule for measures to increase taxes on Oregonians. This rule was eroded by City of Seattle v. Department of Revenue (Sept. 2015). Now, under the interpretation of the Oregon Legislative Assembly's Legislative Counsel, bills that would limit or eliminate the mortgage interest deduction (HB 2006 (2017); and limit deductibility of property taxes (HB 2779 (2017) have been drafted and arguably only require a simple majority vote to raise taxes. The most likely scenario for rising taxes to help Oregon close the $1.6 billion in unfunded liability for the PERS deficit and unanticipated roll-up costs of the Affordable Care Act is a tax increase that will target corporations and homeowners. We need to survey the public sentiment and provide funding for drafting ballot measures to close the loophole that the court case potentially poses to the 3/5 majority rule. This application provides funding for this as part of a coalition. This amount should cover our portion for phase 1 (polling) and phase 2 (drafting). It would not include drafting advocacy and ballot measure title defense with the Oregon Attorney General. Nor, would it include signature gathering and ballot campaign expenses. 53

The committee meet on December 19, 2016 for a recap of elections successes. During the election cycle, 98% of the candidates we supported won. During legislative years, the RPAC trustees don’t hold regular meetings. However, we are actively planning our first major investor event to be held on REALTOR® Day at the Capitol, April 12 at 5:30PM at the Hallie Form Museum of Art on Willamette University’s campus. We are also planning on a committee retreat for the fall of 2017.

During this meeting the following items were discussed. In the email to the AEs/EOs requesting nomination forms, the following would be included:  A letter from President Grabenhorst expressing the importance of the local AEs/EOs assistance in collecting nomination forms  A reminder that local recipients of this award were not automatically added to the nomination pool, if a board/association wished to nominate that person a completed form would need to be submitted.  A reminder that if a person had been nominated previously, a new form would need to be completed in order for he/she to be considered. The committee asked the several of the previous nominees be brought forward for consideration and asked the newly suggested nominee be pursued. JC was directed to contact the associations for these members and ask that a form be completed. Nominations were submitted by March 6, 2017 the state ROTY will be chosen at the March 20, 2017 meeting.
