1 Seated wooden figure of Buddha Shakyamuni, lacquered and gilded, late Amarapura, Burma, mid-19th century

The image of Buddha Shakyamuni seated in full lotus position on the high, decorated throne in bumisparsha mudra.

The statue is made of light wood, lacquered black and gilded finally.

The Buddha is wearing royal attire, typical for Amarapura Buddha statues. The head is characterized by elongated earlobes, touching the shoulders, and the enlarged finial, which emerges from the ushnisha The eyes are highlighted by large waved eye bows. The lips, with a suggested smile, carved very well condition: rubbing to the gilding, small chip to the tip of the flame, losses of lacquer and gilding around the cavity on the back, otherwise very good age-related condition

2 Seated double Buddha statue of Gautama Buddha and future Maitreya Buddha, lacquered wood, Mon state (Burma), 17th to 18th century

Very rare image of the present and the future Buddha, seated on a double lotus throne, very likely from Mon State. Images from the Mon State often depicted with plain head, similar to Buddha statues from Bagan. Black lacquered wood with remnants of gilding.

A very similar image with almost the same double lotus base is illustrated in “Burmese Crafts” by S. Fraser-Lu (see reference below).

According to the statue at Dhammayan-Gyi Pagoda, Bagan, the image on the left shows Maitreya Buddha, on the right, Gautama, the historical Buddha.

A seated wooden statue of the Buddha on a multi-tiered throne in padmasana, depicting the earth touching gesture (bhumisparsha mudra). His face with serene expression, downcast eyes and a beautiful smile. The lips painted red.

There is a cavity hollowed out at the back of the throne, used for hiding sacred material. Lid missing.

The wooden statue is covered with black lacquer. Remnants of gilding.

A gilded wooden figure of the seated Buddha Shakyamuni, Shan, Burma, early 19th century

A rare tall and slender image of the Buddha, lacquered and gilded heavy wood.

The Buddha is seated in padmasana on a high multi-tiered and very detailed carved throne, his very long right hand in bhumisparsha mudra. The long earlobes doesn’t touch the shoulders, what could indicate a greater age. The form of the image is perfectly complemented by the very tall finial above the ushnisha.

Despite the partly extensive wear, this tall wooden image of the seated Buddha is a rare excellent example of Laotian Buddhist art. In particular the remaining throne decoration is finely detailed.

A tall and slender figure of the Buddha. This typical folk art Buddha sculpture from Laos is carved from a single piece of Teak wood.

Since these statues were placed in caves or outside under a sacred tree, they show extensive weathering, giving them a special charm.

This votive figurine depicting the seated Buddha sheltered by the naga king Muchalinda. The Buddha is shown in bhumisparsha mudra. Originally the tree at the figures back extends above the naga head but the top section is now lost.

Good detailed work with rich dark patina.

The figures show rich remnants of the original gilding.

13 Worshipping of the Buddha, Shan States (Burma), 18th to 19th century

These small works of metalsmiths from the Shan States are rarely offered, in particular as votive groups. They depict the main stations of the life of the Buddha. These lacquered, gilt metal objects were used as votive offerings to be sealed in the walls of newly build pagodas. After leaving his parent’s palace, Prince Siddhartha Gautama removed his princely dress and cuts a lock of his hair with his sword

These votive figurines and groups, donated by worshippers, were placed in relic chambers within a pagoda or embedded in their walls.

Here we offer a rare 18th century votive group on triangular base (partly damaged), made of bronze, with rich traces of gilding.

Lord Shiva and his consort Uma “seating” together in an intimate embrace, connoting love and desire. Nandi as Shiva’s vehicle rests obediently at their feet. Remnants of red pigment used in worship. An old sticker with a collection number on the underside.

20 Votive figurine of a Hindu deity with five faces, India, 19th century or earlier

In various presentations we find Hindu deities with five faces, such as Brahma, Hanuman or Gayatri. The five faces iconography is called Panchamukha.

Gayatri, here depicted with a sword in the right and a shield in the left hand as well as a heavy necklace, is the personified form of the Gayatri Mantra, a popular hymn from Vedic texts. Gayatri, also called the “Mother of Mantras”, is often associated with Savitr, the consort of Brahma and a solar deity in the Vedas

A cowherd, most likely Krishna as Gopala, seated with his cow and calf on a square base with four feet, one broken and lost. The figure has a long braid and wing-like elements on the upper arms, one broken. A compact and yet detailed presentation in small space of around 5 x 5 cm. 28 Outstanding Maru-gata iron Tsuba with Zodiac, Japan, Edo Period (1603 - 1868)

On the top stands a large hare with a big belly and extraordinary long ears which are forming the tsuba’s border (dote-mimi) and completely encloses the tsuba down to the resting boar

Within the circle we find eleven animals and the dragon. All eyes were highlighted with gilding (Shakudō - red copper with low gold content), now partly rubbed The tsuba’s reverse showsnot without a touch of humour - the detailed backsides of all twelve figurines

An impressive example that evidences the mastery of technique characteristic of the Japanese craftsmen.

29 A gold and silver decorated steel pen case (Qalamdan), Persia, 19th century

This steel box has a rectangular case with a coffered lid The interior of the box is divided into three compartments to hold reed pens, the inkwell, and a sand pot A lock with key on the front.

Extraordinary detailed and dense silver decoration and fine gold painting for some motifs and for the Persian Nastaliq inscription contained in a cartouche on the lid.

This inscription from a Persian poem can be read as:

“In Qalamdan pasande Shahan ast

Ke ba naqsho negare Bostan ast.”

Translation: This pencil case (Qalamdan) is to the taste of kings. Because it is (decorated) with motifs of the gardens (Bostan)*.

*Bostan: A garden filled with scented flowers and fruits (transcription and translation by Soudabeh H.Pashang, Essen)

32 A brass betel nut mortar with steel pestle, Shan States (Burma), around 1900

A nice example of a complete original mortar set (betel nut grinder). The top of the pestle bears a flower decoration. Mortar and pestle are in good condition with traces of wear consistent with age and use. With natural grown patina.

33 An old padlock depicting a rat, representing the Chinese zodiac year, bronze, China or India, 1st half 20th century

This old mechanical padlock is made of bronze, is working and comes with the matching key. All three parts of the lock are marked with “32”.

The lock was originally covered with black coating (lacquer ?). Where worn it shows beautiful golden bronze patina and a smooth surface.

When locked, the tip of the shackle appears as the tongue in the rat’s open mouth.

The surface is superbly finished with chased and embossed decoration showing scenes from the Burmese court or Jataka tales. A high quality silver bowl. No maker’s sign or script to the underside.

Standing upright on a square base, this Chinthe 2B is a beautiful example of its standard form with detailed decoration. The wide open mouth shows every single tooth. The base has been adorned with friezes of notches and dots at lower and upper rim as well as to the neck.

A rare copper-red Hintha 3B weight with special decoration. The head crest is extended by additional knobs to the handle. Tail and handle are connected by a little spacer without another function but just to show the master’s joy to cast this 50 tical weight.

The wings start with a first layer narrow to the chest and are extended towards the tail with a finely detailed large wing after the little main wing. A beautiful market weight, made of a special copper alloy. A good old weight.

Here we offer an unusual Hintha 3B weight with exceptional fine decoration. It starts with the protruding eyes designed in “Art déco style” with a gap between head and eye bows (please see full page above). The top of the crest shows a barely visible arrow sign. The protruding main wings are curved outwards and extended with additional larger wing feathers towards the tail. The base is decorated with two layers of vertical notches and horizontal lines. Some wear as expected, rich natural patina.

A typical Hintha 3B weight in good worn condition and with rich remnants of black coating. The slender bird figure stands upright on a massive, almost circular base, decorated with a band of vertical notches and three horizontal lines.

Revocation consequences

In the event of a valid revocation, the performance delivered by either party is to be returned and the proceeds of any utilization (e.g. interest) submitted.

If you cannot submit / return the received performance and benefits (e.g. utilization benefits) to us, or submit / return them only partially or in a deteriorated condition, you need to compensate us to the required extent. You must pay compensation for degraded items only insofar as the deterioration is due to handling of the items beyond testing of properties and functionality. Testing of properties and functionality is to be understood as testing and evaluation of the respective goods as is possible and common in retail shops, for instance.

Items which can be dispatched in packages are to be returned at our expense and risk.

Items which cannot be dispatched in packages will be fetched from your premises. Payment obligations must be fulfilled within 30 days.

The time limit becomes effective on dispatch of your revocation notice or the item for you, and on its receipt for us.

Allgemeine Geschäftsbedingungen (AGB)

§ 1 Geltungsbereich & Abwehrklausel

(1) Für die über die Galerie Michael Herrfurth Asiatische Kunst (Online-Galerie unter www.opiumgewichte.com) begründeten Rechtsbeziehungen zwischen dem Betreiber (nachfolgend „Anbieter“) und seinen Kunden gelten ausschließlich die folgenden Allgemeinen Geschäftsbedingungen in der jeweiligen Fassung zum Zeitpunkt der Bestellung.

(2) Abweichende Allgemeine Geschäftsbedingungen des Kunden werden zurückgewiesen.

§ 2 Zustandekommen des Vertrages

(1) Die Präsentation der Waren in der OnlineGalerie stellt kein bindendes Angebot des Anbieters auf Abschluss eines Kaufvertrages dar. Der Kunde wird hierdurch lediglich aufgefordert, durch eine Bestellung ein Angebot abzugeben.

(2) Durch das Absenden der Bestellung per Email gibt der Kunde ein verbindliches Angebot gerichtet auf den Abschluss eines Kaufvertrages über die durch ihn in der Email genannten Waren ab. Mit dem Absenden der Bestellung erkennt der Kunde auch diese Geschäftsbedingungen als für das Rechtsverhältnis mit dem Anbieter allein maßgeblich an.

(3) Der Anbieter bestätigt den Eingang der Bestellung des Kunden durch Versendung einer Bestätigungs-E-Mail. Diese Bestellbestätigung stellt noch nicht die Annahme des Vertragsangebotes durch den Anbieter dar. Sie dient lediglich der Information des Kunden, dass die Bestellung beim Anbieter eingegangen ist. Die Erklärung der Annahme des Vertragsangebotes erfolgt durch die Auslieferung der Ware oder eine ausdrückliche Annahmeerklärung.

§ 3 Leistungsbeschreibung

(1) Die Beschaffenheiten der angebotenen Gegenstände werden im Einzelnen durch die Beschreibung auf der Website bzw. in einem per Download oder Email zur Verfügung gestellten Katalog im pdf-Format links oder rechts neben, unter oder über der Abbildung verbindlich und abschließend dargestellt. Sonstige öffentliche Äußerungen des Anbieters, dessen Gehilfen oder Dritter enthalten keine ergänzende oder ändernde Leistungsbeschreibung.

(2) Den Parteien ist bewusst, dass es bei der Übertragung und Anzeige der Bilddateien möglicherweise zu Abweichungen zwischen dem Original und der Darstellung auf dem Monitor z.B. hinsichtlich der Farbtöne kommen kann. Eine farbgetreue Wiedergabe der zugrunde liegenden Originale ist nicht geschuldet. Geringfügige Abweichungen zwischen der Darstellung des Bildes auf den Monitor und dem Original sind vertragsgemäß. Vertraglich geschuldet wird jedoch die in der Produktbeschreibung enthaltenen Eigenschaften (z.B. Material, Alter, Herkunft) auf der Website bzw. im Katalog zum Zeitpunkt der Bestellung.

§ 4 Preise

(1) Alle Preise verstehen sich in Euro.

(2) Maßgeblich sind ausschließlich die auf Anfrage dem Kunden per Email mitgeteilten Preise. Die in der Internetpräsentation bzw. im pdf-Katalog im Übrigen enthaltenen Angaben, insbesondere Preise, enthalten kein verbindliches Angebot und sind freibleibend. Irrtümer auf voran geschalteten Website oder abweichende Preisangaben auf Websites Dritter haben keine Verbindlichkeit im Verhältnis der Vertragsparteien.

(3) Alle angegebenen Preise verstehen sich in Euro zzgl. der jeweils geltenden gesetzlichen Mehrwertsteuer. Diese wird in der Rechnung separat ausgewiesen.

(4) Die Kosten für Lieferung und Verpackung trägt der Kunde. Die Art der Lieferung wählt der Kunde. Äußert sich der Kunde nicht zur Art der Lieferung, wählt der Anbieter die für ihn günstigste Versandvariante.

(5) Bei Lieferungen in Länder außerhalb der Europäischen Union können zusätzliche Kosten für anfallende weitere Steuern und Zölle entstehen, auf die der Anbieter keinen Einfluss hat. Diese Kosten werden in vollem Umfang vom Kunden getragen.

§ 5 Zahlung

(1) Der Kunde wählt bei Abgabe seiner Bestellung unter mehreren durch den Anbieter vorgegebenen Zahlungsweisen die gewünschte aus. Zahlungen gelten ungeachtet der gewählten Zahlungsweise erst dann als geleistet, wenn der Anbieter uneingeschränkt über den Betrag verfügen kann.

(2) Der Kaufpreis ist sofort ohne Abzug fällig.

(3) Der Kunde ist vorleistungspflichtig.

(4) Der Kunde kommt ohne weitere Erklärung seitens des Anbieters 14 Tage nach Lieferung der Ware in Verzug, soweit er nicht bezahlt hat. Die Verzugsfolgen richten sich nach den gesetzlichen Bestimmungen.

§ 6 Vorbehalt bei Nichtverfügbarkeit

Der Anbieter sichert nicht zu, dass die Website bzw. der pdf-Katalog stets aktuell und die dargestellte Ware noch verfügbar ist.

§ 7 Eigentumsvorbehalt

Die gelieferte Ware verbleibt bis zur vollständigen Bezahlung im Eigentum des Anbieters.

§ 8 Fälligkeit

Die Zahlung des Kaufpreises ist mit Vertragsschluss fällig.

§ 9

Gewährleistung

(1) Die Gewährleistungsrechte des Kunden richten sich nach den allgemeinen gesetzlichen Vorschriften, soweit nachfolgend nichts anderes bestimmt ist. Für Schadensersatzansprüche des Kunden gegenüber dem Anbieter gilt die Regelung in § 6 dieser AGB. (2) Die Verjährungsfrist für Gewährleistungsansprüche des Kunden beträgt bei Verbrauchern bei neu hergestellten Sachen 2 Jahre, bei gebrauchten Sachen 1 Jahr. Gegenüber Unternehmern beträgt die Verjährungsfrist bei neu hergestellten Sachen und bei gebrauchten Sachen 1 Jahr. Die vorstehende Verkürzung der Verjährungsfristen gilt nicht für Schadensersatzansprüche des Kunden aufgrund einer Verletzung des Lebens, des Körpers, der Gesundheit sowie für Schadensersatzansprüche aufgrund einer Verletzung wesentlicher Vertragspflichten. Wesent-

liche Vertragspflichten sind solche, deren Erfüllung zur Erreichung des Ziels des Vertrags notwendig ist, z.B. hat der Anbieter dem Kunden die Sache frei von Sach- und Rechtsmängeln zu übergeben und das Eigentum an ihr zu verschaffen. Die vorstehende Verkürzung der Verjährungsfristen gilt ebenfalls nicht für Schadensersatzansprüche, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Anbieters, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen. Gegenüber Unternehmern ebenfalls ausgenommen von der Verkürzung der Verjährungsfristen ist der Rückgriffsanspruch nach § 478 BGB.

(3) Eine Garantie wird von dem Anbieter nicht erklärt.

§ 10 Haftungsausschluss

(1) Schadensersatzansprüche des Kunden sind ausgeschlossen, soweit nachfolgend nichts anderes bestimmt ist. Der vorstehende Haftungsausschluss gilt auch zugunsten der gesetzlichen Vertreter und Erfüllungsgehilfen des Anbieters, sofern der Kunde Ansprüche gegen diese geltend macht.

(2) Von dem unter Ziffer 1 bestimmten Haftungsausschluss ausgenommen sind Schadensersatzansprüche aufgrund einer Verletzung des Lebens, des Körpers, der Gesundheit und Schadensersatzansprüche aus der Verletzung wesentlicher Vertragspflichten. Wesentliche Vertragspflichten sind solche, deren Erfüllung zur Erreichung des Ziels des Vertrags notwendig ist, z.B. hat der Anbieter dem Kunden die Sache frei von Sach- und Rechtsmängeln zu übergeben und das Eigentum an ihr zu verschaffen. Von dem Haftungsausschluss ebenfalls ausgenommen ist die Haftung für Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Anbieters, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen.

(3) Vorschriften des Produkthaftungsgesetzes (ProdHaftG) bleiben unberührt.

§ 11 Abtretungs- und Verpfändungsverbot

Die Abtretung oder Verpfändung von dem Kunden gegenüber dem Anbieter zustehenden Ansprüchen oder Rechten ist ohne Zustimmung des Anbieters ausgeschlossen, sofern der Kunde nicht ein berechtigtes Interesse an der Abtretung oder Verpfändung nachweist.

§ 12 Aufrechnung

Ein Aufrechnungsrecht des Kunden besteht nur, wenn seine zur Aufrechnung gestellte Forderung rechtskräftig festgestellt wurde oder unbestritten ist.

§ 13 Rechtswahl & Gerichtsstand

(1) Auf die vertraglichen Beziehungen zwischen dem Anbieter und dem Kunden findet das Recht der Bundesrepublik Deutschland Anwendung. Von dieser Rechtswahl ausgenommen sind die zwingenden Verbraucherschutzvorschriften des Landes, in dem der Kunde seinen gewöhnlichen Aufenthalt hat. Die Anwendung des UN-Kaufrechts ist ausgeschlossen.

(2) Gerichtsstand für alle Streitigkeiten aus dem Vertragsverhältnis zwischen dem Kunden und dem Anbieter ist der Sitz des Anbieters,

sofern es sich bei dem Kunden um einen Kaufmann, eine juristische Person des öffentlichen Rechts oder ein öffentlich-rechtliches Sondervermögen handelt.

Salvatorische Klausel

Sollte eine Bestimmung dieser Allgemeinen Geschäftsbedingungen unwirksam sein, wird davon die Wirksamkeit der übrigen Bestimmungen nicht berührt.
