Right now France is confronted with a very worrying authoritarian shift. The State of Emergency that was called on the 13th of November 2015 as a reaction to the terrorist attacks of Paris, has been extended already three times.

This grants the executive and the police with extended powers. Basic and civic rights are massively curtailed through mass arrests, house arrests, house searches and prohibition of the right to assembly.

In December 2015, the State of Emergency was misused to ban gatherings and protests during the COP21 Climate Conference and today it is a misused measure to enforce

the repression of protests against the Labor Law. Since the beginning of March 2016, demonstrations, protests and blockades by broad parts of the population including unionists and students are emerging across the whole country, against the Labor Law that was introduced by minister of labor, Myriam El Khomri. Diverse social movements have joined the protests. One of the central concerns is the neoliberal restrictions of the rights of wageearning employees. These rights will be no longer guaranteed by law but negotiated within the companies.

The French government is ignoring the protests and 70% dissent against the law. Prime Minister Manuel Valls used constitution article 49.3 to push the law through Parliament without any debate. This exceptional procedure implies a vote of confidence and restricts future amendments to the law. Usually this article is used when the government itself does not have a majority in Parliament.

The popular demonstrations against the Labor Law and its authoritarian enforcement are confronted with vast repression across the country. There is little coverage of either protests or repression in the national as well as the international mainstream media. Countless videos and reports of eye-witnesses that circulate in social media and the internet demonstrate the brutality of police violence and numerous attacks (eg. see a summary of the online magazin Mediapart here) These recordings, often made at great risk, show excessive thus illegal police violence. This includes the highhanded use of globs, pepper spray, rubber bullets, stun grenades and sting grenades. Police repression with the same intensity is being used for some time now against working class suburbs and now reached the heart of social movements. This is how a young man ended up in a coma for more than a week and hundreds of others were injured and traumatized. On the 19th of May, Prime Minister Manuel Valls stated: "They (the police) have no orders to go soft on the demonstrators" - a statement that obviously

refers to all demonstrators. Since March many have been sentenced in summary trials and convicted with insufficient evidence. On the other hand Police officers are by now, despite all efforts, not held accountable for their misconducts.

Such response to protests is a sign of authoritarian regimes, hardly worthy of a democracy. The French government attempts to intimidate and thus to disable the protests against the Labor Law reform with repression and criminalization. Freedom of assembly is limited by the State of Emergency, in order to enforce a law by authoritarian means. The actual duty of the executive should be to enforce basic rights, including the right to demonstrate, not restrict them. The massive and illegal police violence and the criminalization of the protesters has to stop immediately!

To the French government, the President Franรงois Hollande, the Prime Minister Manuel Valls and the Minister of the Interior Bernard Cazeneuve, we request: The immediate end of the State of Emergency as well as the respect of all basic rights by state institutions and the executive (freedom of movement, freedom of opinion, right to non-discrimination, and so on). The unambiguous and global condemnation of police violence by the French government, limitation of police authorization, and deescalation as well as the ban on the use of rubber bullets, stun grenades, and sting grenades in every circumstance.

From the French Justice and from international organizations, we demand: The defense of basic rights, particularly the right to a fair and evidence-based process. Amnesty processes for all condemned demonstrators.The condemning of the disproportionate and illegal police violence. Independent and systematical investigation of the documented assaults and the punishment of the responsible persons.

Berlin, le 13 juin 2016

Appel international pour le droit à manifester et contre les violences policières en France Nous sommes nombreux et nombreuses à constater actuellement un tournant autoritaire inquiétant en France. L'état d'urgence proclamé le 13 novembre 2015 suite aux attentats perpétrés par l'EI à Paris a été depuis trois fois prolongé. Il confère à l'exécutif et à la police des pouvoirs élargis. Les droits fondamentaux de la population sont massivement entravés par les arrestations arbitraires, les assignations à domicile et les perquisitions, ou encore l’interdiction de se rassembler. L’état d’urgence a été détourné en décembre 2015 contre les militant.e.s de la COP 21 et il facilite aujourd’hui la répression des militant.e.s contre la Loi Travail de la Ministre Myriam El Khomri.

Depuis la fin mars 2016, un très large mouvement social mené par des syndicats, étudiant.e.s, lycéen.ne.s proteste dans tout le pays avec des manifestations et des blocages contre la réforme de la législation du travail proposée par la Ministre El Khomri. Cette contestation, rejointe par des mouvements sociaux très variés, bénéficie d’une large assise populaire. Cette loi est contestée car elle réduit drastiquement les droits des salarié.e.s, qui ne sont plus garantis par la loi mais qui seraient soi-disant « négociés » avec les employeurs dans chaque entreprise.

Le gouvernement français ignore ces contestations. Le Premier Ministre Manuel Valls a contraint l'Assemblée Nationale à adopter la loi le 12 mai 2016 à l'aide du paragraphe 49.3 de la Constitution.

Ce paragraphe, associé à un vote de confiance des députés envers le gouvernement, empêche la tenue des débats et la soumission d’amendements. Il est utilisé par le gouvernement lorsqu’il ne dispose pas de majorité parlementaire.

Les manifestations contre la loi travail et contre son adoption autoritaire perdurent depuis le 12 mai, mais elles sont soumises à une répression très forte dans tout le pays, sans que les grands médias français et internationaux y accordent l’attention nécessaire. De nombreuses vidéos et témoignages publiés sur Internet, dans les médias sociaux et dans des médias alternatifs montrent pourtant de nombreux actes de violence, souvent grave, de la part de la police (voir la compilation par le journal en ligne Mediapart : www.mediapart.fr/journal/france/310516/ces-images-qui-attisent-la-colere).

Les images tournées par des manifestants et des journalistes à leur propres risques et périls montrent indubitablement un usage de la force disproportionné donc illégal, à l'aide de matraques, gaz lacrymogènes, flash-balls, grenades de désencerclement... Des méthodes de répression déjà utilisées depuis longtemps dans les quartiers populaires contre la population sont devenues courantes contre les mouvements sociaux. Un jeune homme est longtemps resté dans le coma, des centaines d'autres personnes blessées et traumatisées. Le 19 mai 2016, le Premier Ministre Manuel Valls a déclaré « il n'y a pas de consigne de retenue » - ce qui s’applique à l’évidence pour tout.e.s les participant.e.s des manifestations. Depuis fin mars, plusieurs manifestant.e.s ont été condamnés en comparution immédiate malgré l'absence de preuves suffisantes. Malgré de nombreux dépôts de plainte, aucun fonctionnaire de police n’a encore été condamné par la justice.

Ces réponses à la contestation sociale relèvent plutôt d'un régime autoritaire que d'une démocratie digne de ce nom.

Le gouvernement français tente d'intimider la contestation contre la Loi Travail El Khomri par une répression violente et une criminalisation du mouvement. La liberté de réunion restreinte par l’état d’urgence permet d’imposer la loi controversée de manière autoritaire. Le pouvoir exécutif devrait théoriquement défendre les droits fondamentaux et imposer leur respect, et parmi eux celui du droit à manifester, au lieu de les restreindre.

Les violences policières excessives et illégales et la criminalisation des manifestant.e.s et de tous les contestataires doivent immédiatement cesser!

Nous demandons au gouvernement français, au Président François Hollande, au Premier Ministre Manuel Valls et au Ministre de l'Intérieur Bernard Cazeneuve : La levée immédiate de l'état d'urgence en France, et le respect sans exception des droits fondamentaux de la population par toutes les institutions étatiques (liberté de se déplacer, liberté d'opinion, droit à la non-discrimination, etc.).

La condamnation sans ambiguïté des violences policières par le gouvernement français dans tous les contextes, l'injonction à la déescalade et à la retenue des policiers envers en manifestation et partout, ainsi que l’interdiction de l’usage du flash-ball et des grenades de désencerclement en toutes circonstances.

Nous demandons à la justice française et aux organisations internationales : La défense des droits fondamentaux selon des procédures justes et basées sur des preuves. Nous demandons l’amnistie pour les manifestants qui ont été déjà condamnés.

Le jugement et la punition des violences policières disproportionnées et illégales. Des enquêtes indépendantes et systématiques des violences policières qui ont fait l’objet de vidéos et de témoignages, afin de condamner les responsables.

Nous faisons appel à la communauté internationale pour : Les organisations internationales, les gouvernements, le parlement européen et le conseil de l’Europe doivent condamner les violences policières et la répression des contestations en France, et faire tout ce qui est en leur pouvoir pour dissuader le gouvernement français de sa stratégie de tension.

Nous demandons aux médias français et internationaux de nous informer de manière indépendante et complète sur les évènements en France.

In Frankreich ereignet sich derzeit eine besorgniserregende, autoritäre Wende. Der Ausnahmezustand, der am 13. November 2015 als Reaktion auf die Terroranschläge von Paris verhängt wurde, ist seither dreimal verlängert worden. Er verleiht Exekutive und Polizei umfassende Vollmachten. Die Grund- und Bürgerrechte werden massiv beschnitten, etwa durch massenhafte Festnahmen, Hausarreste, Hausdurchsuchungen und Versammlungsverbote. Im Dezember 2015 wurde der Ausnahmezustand zum Verbot der Demonstrationen anlässlich des Klimagipfels COP 21 missbraucht; heute begünstigt der Notstand die Repression der Proteste gegen die Reform des Arbeitsrechts.

Seit Ende März 2016 kommt es im ganzen Land gegen das von der Arbeitsministerin Myriam El Khomri verantwortete Gesetz zu Demonstrationen und Blockaden durch breite Bevölkerungsschichten, Gewerkschafter_innen, Studierende und Schüler_innen. Unterschiedlichste soziale Bewegungen haben sich den Protesten angeschlossen. Im Zentrum der Kritik steht die Einschränkung der Rechte von Lohnabhängigen. Diese sollen fortan nicht mehr gesetzlich verbürgt, sondern in jedem Unternehmen einzeln ausgehandelt werden.

Die französische Regierung ignoriert die Proteste und Premierminister Manuel Valls hat das Parlament in seiner Abstimmung am 12. Mai 16 mit Hilfe des Verfassungsparagraphen 49.3 geknebelt. Diese Regelung sieht eine Koppelung mit einem Vertrauensvotum sowie die Aussetzung der Möglichkeit von Sachdebatten und Änderungsanträgen vor. Sie wird traditionell eingesetzt, wenn die Regierung keine eigene parlamentarische Mehrheit hat.

Die regelmäßigen Demonstrationen gegen das Gesetz und seine autoritäre Durchsetzung werden landesweit mit starker Repression überzogen – ohne, dass die großen französischen und internationalen Medien dem bisher die nötige Aufmerksamkeit gezollt hätten. Dabei zeugen zahlreiche Videos und Augenzeugenberichte auf Internetseiten und in sozialen Medien von massiver Polizeigewalt und vielen Übergriffen (siehe auch die Zusammenstellung der onlineZeitschrift Mediapart: www.mediapart.fr/journal/france/310516/ces-images-qui-attisent-la-colere).

Die oftmals unter großen Risiken gemachten Aufnahmen dokumentieren nicht nur die Unverhältnismäßigkeit, sondern schlicht die Unrechtmäßigkeit der Polizeigewalt. Diese beinhaltet insbesondere den willkürlichen Einsatz von Schlagstöcken, Tränengas und Gummigeschossen sowie von Handgranaten, die Betäubungsschocks auslösen und Gummipfropfen mit hoher Geschwindigkeit absondern (grenades de désencerclement). Diese Art der Repression wird bereits seit langem gegen die Bevölkerung proletarischer Vororte praktiziert und ist nun auf soziale Bewegungen ausgeweitet worden. So lag ein junger Mann über eine Woche im Koma und sind hunderte Menschen verletzt und traumatisiert worden. Am 19. Mai erklärte der Premierminister Manuel Valls: „Es gibt keine Vorgaben zur Zurückhaltung“ – eine Aussage, die offenkundig für alle Demonstrationsteilnehmer_innen gilt. Seit Ende März sind zahlreiche von ihnen in Schnellverfahren bei unzureichender Beweislage verurteilt worden. Polizeibeamt_innen sind dagegen bisher trotz vieler angestrengter Verfahren jeglicher Bestrafung entgangen.

Diese Zustände erinnern an den Umgang mit Protesten in autoritären Regimen. Sie sind demokratischer Gesellschaften unwürdig.

Die französische Regierung versucht, die Proteste gegen ihre Arbeitsrechtsreform durch Repression und Kriminalisierung einzuschüchtern und letztlich zu unterbinden. Die Versammlungsfreiheit wird

durch den Ausnahmezustand eingeschränkt, um ein Gesetz autoritär durchzusetzen. Die eigentliche Aufgabe der Exekutive wäre es, die Grundrechte, darunter das Demonstrationsrecht, durchzusetzen, anstatt sie weiter einzuschränken.

Daher muss die exzessive und illegale Polizeigewalt sowie die Kriminalisierung der Demonstrant_innen und Protestierenden sofort ein Ende haben!

An die französischen Regierung, den Präsidenten François Hollande, den Premierminister Manuel Valls und den Innenminister Bernard Cazeneuve richten wir daher folgende Forderungen: Sofortige Aufhebung des Ausnahmezustandes und Achtung aller Grundrechte durch die staatlichen Institutionen (Bewegungsfreiheit, Meinungsfreiheit, Recht auf Nicht-diskriminierung usw.).

Unzweideutige und umfassende Verurteilung der Polizeigewalt durch die französische Regierung, Initiativen zu polizeilicher Zurückhaltung gegenüber Demonstrationen und darüber hinaus bzw.

Deeskalation und allgemeines Verbot des Einsatzes von Gummigeschossen und grenades de désencerclement.

Von der französischen Justiz bzw. von internationalen Organisationen fordern wir: Verteidigung der Grundrechte auf faire und beweisgestützte Verfahren. Amnestie bzw. neue Verfahren für alle bereits verurteilten Demonstrant_innen.

Verurteilung und Ahndung der unverhältnismäßigen und rechtswidrigen Polizeigewalt.

Unabhängige und systematische Untersuchung der dokumentierten Übergriffe und Bestrafung der Verantwortlichen.

An die internationale Gemeinschaft appellieren wir: Internationale Organisationen, Regierungen, das Europäische Parlament und der Europäischen Rat sollen die Polizeigewalt und die Repression in Frankreich verurteilen und mit allen Mitteln auf die französische Regierung einwirken, ihre Strategie der Spannung zu beenden.
