W
ho Pays What?
Did you know in 2014 the Oklahoma trucking industry paid 45 percent of all taxes owed by Oklahoma motorists, despite trucks representing only 14% percent of vehicle miles traveled in the state, according to the American Transportation Research Institute? Here is a not so unreal scenario. Let’s say passenger cars wouldn’t have to pay at toll booths but only commercial vehicles would. The money collected would pay for roads and bridges for all vehicles to use. That doesn’t seem fair does it? The trucker will suffer financially, or the cost of trucking must go up. Also the material the truck brought will cost more when we buy it.
Last February the State Legislature of Rhode Island passed their Governor’s proposal to single out large commercial vehicles for a brand new highway toll in 14 locations across their state. Voters were told that not only would big trucks pay for their infrastructure but that it would require a vote of the people to ever include passenger vehicles in the new tolling. Like many states, Rhode Island realized they were behind on maintaining their infrastructure. They weren’t alone and lots of states have come to that conclusion. Question: What citizen could be opposed to requiring a single industry to foot the bill? Answer: Everyone should be. What’s fair is fair and what’s not is not. Otherwise, it is bad policy. Consider this. Whether the state’s appetite for new funds are labeled as a tax, toll, or fee doesn’t matter. Regardless of how justified the need may be, the government wants money. The question is who will pay and by what means. The same could be said for costly government regulations but I digress. To charge only trucks is unfair. In Rhode Island, the Governor and her legislative majority decided a truck tax was the way to pay for infrastructure. They also said that 65% of the trucks paying the tolls would be from out of state. Those policymakers figured trucks will be paying for Rhode Island’s new roads and bridges. Meanwhile, all other motorist will get a free pass. We can’t be certain but should wonder if Rhode Island spent road use dollars for years in places other than just highway infrastructure. Now that repairs are needed, there is no money. Trucks are an easy target and cannot vote legislators out of office. Both types of vehicle should pay something if tolling is required. Citizens should expect policymakers to be fair, otherwise you could be the next target. At the time of the passage of this bill, the Rhode Island Trucking Association along with the ATA threatened a legal challenge to this new law in court. It’s too bad they have to. Bad policy is bad policy regardless of where it is found

NATIONAL NEWS HEADLINER ALTERNATIVE FUELS IS CHEAPER EVEN AN ISSUE? It seems as though the vision of 20%, of heavy duty trucks using alternative fuels by 2020, is not as attainable as forecasted. In the past two years the slide in the price of diesel fuel has complicated decisions for fleets. The upcoming federal greenhouse gas/fuel economies have left many to consider looking further out. Final Phase 2 rules, released in September will cover 20212027 model year trucks and tractors and 2018-2027 MY Trailers. New stepped engine standards will require a 4% carbon dioxide reduction from 2017-2027. Phase 2 also seeks to address natural gas vehicles and engines including natural methane emissions. In addition to rules, many fleets have gone to “alternative” due to corporate sustainability goals and in some instances to comply with shipper requirements of more sustainable transportation. Compressed natural gas remains the king of alternative fuels when it comes to medium and heavy-duty trucks. An investment for the long term helps retain natural gas pricing, since it does not fluctuate as diesel prices do. Fleets can therefore forecast their fuel costs with improved accuracy.
NTSB DRIVER DRUG TESTING The National Transportation Safety Board recommends that the U.S. Department of Transportation needs to tighten pre-employment driver screening for carriers.

FREGHT TSI DECLINES
The Truck Parking Leadership Initiative, comprised of the NATSO Foundation, NATSO, Inc., the American Trucking Associations and the American Transportation Research Institute (ATRI), developed an app based on feedback from professional drivers and trucking companies who often describe truck parking availability as a critical need. Park My Truck allows any parking provider--whether public or private--to report their parking availability for free through this app; it doesn’t require any special technology except internet access. It is free for all truck parking providers and app users.
The Freight Transportation Services Index, based on the amount of freight carried by the for-hire transportation industry, fell 1.8% in August from July, following 4 months of increases, according to the Bureau of Transportation Statistics. The August decrease was due to declines in pipelines, rail carloads and particularly trucking, while all other modes grew or were stable. The August decrease was driven by declines in the mining (including oil and gas well drilling and servicing) and manufacturing sectors of the economy. The 1.8% Freight TSI decline in August from July was the largest monthly decrease since January 2014. The decrease, following an increase of 1.6% in July, virtually brought the index back to the June level. In the 2-month period, the index was down 0.2%. Since the beginning of 2015, the index has been extremely stable as it fluctuated above and below 122. It has deviated only twice by more than 1%: in March 2016 when it fell 2% below 122 to a two-year low and July 2016 when it rose 2% above 122 to reach an all-time high. Year-to-date, freight shipments measured by the index were up 0.8 percent in August compared to the end of 2015 but down 0.3 percent from August of last year. Shipments are up 10.4 percent in the five years from August 2011 and are 11.7 percent in the 10 years from August 2006.

FTR, FOURTH QUARTER SPIKE Chief Economist, Daniel Meckstroh, predicts “a spike in production that is going to occur in the fourth quarter.” This is largely due to economic trends in manufacturing where inventory cycles are typically short. When there is high manufacturing ratio then production slows. As manufacturing ratio declines as it has been seen in July 2016, then production rates are predicted to increase. For the trucking industry high inventories have been a drag on economic activity as well as freight movement. Consumers have largely played a role in this process as 70% of all U.S. economic activity goes back to the general public. “Consumers are keeping us out of a recession… we are in a jobs boom, with the percentage of new jobs being added much faster than overall economic expansion” according to Meckstroh. For trucking this means a predicted spike in the fourth quarter of this year.
USED TRUCK PRICES DECLINE Used truck prices are largely determined by prior year new truck registrations and those registrations have expanded within the last five years. With Class 8 new truck sales between 171,000-195,000 units, used Class 8 wholesale and auction prices have nosedived. The decline is expected to deepen as 2014 and 2015, show 31% increase. “Price resistance started in 2005 when tonnage dropped and the spot rate softened,” said Steve Clough, Arrow Truck Sales. Another reason for the drop in used truck pricing is the rising cost to maintain them due to mandated Exhaust particulate filters (DPFs) and selective catalytic reduction (SCR) systems.

3 TRENDS SPOT FREIGHT MARKET As a general understanding the volatility of spot pricing is often said to correlate with contract pricing. Since 2008, contract prices average a 1% quarter over quarter growth annually, while spot prices averaged a 2% growth. “Spot prices vary five times more than contact rate growth” said Noel Perry, FTR Economist, making them more volatile. Finally, spot and contract pricing lag changes in capacity, market events and price
response are short and resulting in delays for truckers and shippers that realize a change is required.
FUTURE REGULATIONS According to the FMCSA, over 20 rules are expected to be proposed for adoption. Some of these will relate to speed limiters, onboard devices including windshield technologies, forward collision, and lane departure, while others may be in the form of alcohol & drug regulations including driver permissions. Agencies also weighing in on these regulations include National Highway Traffic Safety Administration, the Environmental Protection Agency, Occupational Safety and Health Administration, the Pipeline and Hazardous Materials Safety Administration.
OSHA WORKPLACE INJURIES AND ILLNESSES Provisions call for employers to electronically submit injury and illness data that they already record. The new rule takes effect January 1, 2017 and requires certain employers to electronically submit data on OSHA Injury and Illness forms. The goal is to bring more attention to safety and improve “lives and limbs” of workers, in addition to improving accuracy of data to support workers that fear retaliation for reporting such injuries/illnesses. Phased over two years, the compliance schedule is as follows: • Establishments with >250 Employees: Industries covered by recordkeeping regulation must submit their 2016 Form 200A by July 1, 2017. These same employers are required to submit information from all 2017 forms (300A, 300 and 301) by July 1, 2018. Beginning in 2019 and every year thereafter, the information must be submitted by March 2. • Establishments with 20-249 employees in certain high risk industries must submit information from their 2016 Form 300A by July 1, 2107 and their 2017 Form 300A by July 1, 2018. Beginning in 2019 and every year thereafter, the information must be submitted by March 2. Certain High Risk Industries : General Freight Trucking and Specialized Freight Trucking, Construction, Chart Bus Industry, Couriers and Express Delivery Services, Warehousing and Storage and many more. A complete list of all industries affected by this can be found on the Oklahoma Trucking Association webpage.
OKLAHOMA DEPARTMENT OF PUBLIC SAFETY In collaboration with the Oklahoma Department of Public Safety, OTA is keeping our members informed of the launch of the CDL Third Party Examiner Pilot Program. During this pilot program, only ten (10) businesses will be selected. Each business engaged in Interstate or Intrastate commerce licensed in this state with an employee applying to be an instructor or third-party tester shall be required to pay an initial fee of five thousand dollars ($5,000.00) and an annual renewal fee of five thousand dollars ($5,000.00). The initial fee for each instructor or third-party tester shall be two thousand five hundred dollars ($2,500.00) and an annual renewal fee of two thousand five hundred dollars ($2,500.00). DPS will be accepting applications from businesses interested in participating in the program. The application deadline has been extended to November 3, 2016 and can be completed online at the DPS webpage, ok.gov/dps. Once all applications are received they will be reviewed and the ten (10) businesses will be selected based on certain criteria to include the number of employees that
would be tested in a year and also the businesses’ FMCSA Safety Rating. A nationwide criminal history background check will also be required on all instructors and third-party testers. Felony convictions or any conviction of fraud will disqualify the applicant. The business will also be required to submit a certificate of bond sufficient to pay for re-testing drivers in the event of fraudulent activities by a third-party tester. REAL ID OKLAHOMA REQUEST DENIED The Oklahoma Department of Public Safety says the government rejected the State’s request for an extension of time to comply with the federal REAL ID Act. Full enforcement of the REAL ID Act is said to be after January 29 by the U.S. Department of Homeland Security. Access to federal building, military bases or courthouses will not be admitted by non compliant states. Oklahoma is included in the list of non-compliant states. The Governor of Oklahoma plans to continue to work with state and federal officials to minimize effects.

OKLAHOMA DEPARTMENT OF PUBLIC SAFETY Oklahoma along with twenty other states filed a complaint in the federal courts challenging the U.S. Department of Labor’s new overtime rule. The complaint urges the court to prevent the implementation of the new rule before it takes effect on December 1, 2016. In March 2014, President Obama ordered the Department of Labor to revise the Fair Labor Standard’s Act. Revision of the FLSA relates to overtime exemption for executive, administrative, and professional employees to account for the federal minimum wage. “The policy discussion surrounding the minimum wage is ongoing at both the Congressional and state levels,” Attorney General Pruitt said. On May 2016, the DOL issued the final overtime rule, which doubles the salary-level threshold for employees to be exempt from over time if they earn less than $913 per week. Additionally, the rule contains a mechanism of automatically increasing the salarylevel every three years without going through the standard rule-making process required by Federal Law. OKLAHOMA TRANSPORATION COMMISSION The Oklahoma Transportation Commission commissioners approved ODOT’s FY17-24 eightyear highway and bridge construction plan. Major construction projects over the next eight years include:

ELECTIONS STATE OFFICIALS Tuesday, November 8, 2016 is Election Day nationwide. There are over seven (7) general election ballot state questions, in addition to the presidential, state legislative and county races. Summarized below are those final questions for general knowledge. It is also imperative that as elections near, we are mindful of everything we will be asked our vote in favor or against. SQ776: This measure adds a new section to the Oklahoma Constitution, Section 9A of Article 2. The
new section deals with the death penalty. The section establishes State Constitutional mandates relating to the death penalty and methods of execution. SQ777: This measure adds Section 38 to Article II of the Oklahoma Constitution. It creates the following guaranteed rights to engage in farming and ranching: The right to make use of agricultural technology. The right to make use of livestock procedures. The right to make use of ranching practices. SQ779: This measure adds a new Article to the Oklahoma Constitution. The article creates a limited purpose fund to increase funding for public education. It increases state sales and use taxes by one cent per dollar to provide revenue for the fund. The revenue to be used for public education shall be allocated: 69.5% for common school districts, 19.25% for the institutions under the authority of the Oklahoma State Regents for Higher Education, 3.25% for the Oklahoma Department of Career and Technology Education, and 8% for the State Department of Education.
Section 5 of the Oklahoma Constitution, which prohibits the government from using public money or property for the direct or indirect benefit of any religion or religious institution. SQ792: This measure repeals Article 28 of the Oklahoma Constitution and restructures the laws governing alcoholic beverages through a new Article 28A and other laws the legislature will create if the measure passes. Retail locations like grocery stores may sell wine and beer. Liquor stores may sell products other than alcoholic beverages and may create other licenses. Certain licenses must meet residency requirements. Felons cannot be licensees. The legislature must designate days and hours when alcoholic beverages may be sold and may impose taxes on sales. Municipality may levy an occupation tax. If authorized, a state lodge may sell individual alcoholic beverages for on-premises consumption but no other state involvement in the alcoholic beverage business is allowed. With one exception, the measure will take effect October 1, 2018.
SQ780: This measure amends statutes to reform criminal sentences for certain property and drug offenses. It makes certain property offenses misdemeanors. It makes simple drug possession a misdemeanor. SQ781: This measure creates the County Community Safety Investment Fund. The fund consists of costs save by reclassifying as misdemeanors certain property crimes and drug possession. The funds must be distributed to counties for the purpose of funding rehabilitative programs, such as mental health and substance abuse treatment programs. ABOUT NTDAW 2016 In celebration of National Truck Driver Appreciation Week, the Oklahoma Trucking Association launched its first annual public imaging campaign. Without trucking Oklahoma stops, America Stops. To celebrate professional
drivers across the state, the hashtag, #TruckerByTrade was developed.

Used by these drivers throughout NTDAW, many shared who they are outside of the trucking industry; parents, siblings, friends, neighbors, and beyond. Our Association was on the ground, present in various regions throughout Oklahoma to raise awareness.

August 31 was the official grand opening for the west Oklahoma City location for American Truck Training. Now located on site of Freymiller, Inc. American Truck Training school is a truck driving training program that specializes in CDL Class A and Class B training for individuals and trucking related businesses. Their newest west Oklahoma City location was christened by Congressman Steve Russell. The Congressman’s foray into the world of truck training started with a visit to David Freymiller and ended with a lesson from Norman Becker in how to back up an 18 wheeler. Darin Miller (the school director for the west location) hosted the meet and greet with the students of the west OKC American Truck Training and it was a gratifying experience for one and all. Congressman Steve Russell stated the fact that there is an immense shortage of truck drivers and noted that places like American Truck Training were providing the necessary skills and opportunities to Oklahomans to be able to fulfill trucking needs.

The 12th annual SuperTech Competition sponsored by the American Trucking Association’s Technology Maintenance Council (TMC) was held in Raleigh, NC September 18-21. 127 heavy truck technicians, 13 trailer technicians, and 41 diesel technology students competed for thousands of dollars in prizes and recognition as “best of the best” in the trucking industry. Contestants were challenged with an ASE written test and a number of hands-on work stations testing their proficiency on all aspects of heavy truck and trailer maintenance. They also participated in a half-day training fair to learn new skills and the latest truck technology. 34 states and a number of companies held preliminary competitions through the year to identify champions and teams to represent them in the national competition. Oklahoma was represented by 2016 state champion, Toby DeVoy, Travel Centers of America Sayre, OK, Clarence Preston, Cummins Inc., and Austin Henley, United Engines OKC.
Student Future tech competitors were 2016 OK Student Champion, Matthew Adams and Nathan Gonzales of Francis Tuttle Technology Center, sponsored by WalMart Transportation, Sydney Behm, Francis Tuttle, sponsored by Freymiller, Sean LaChance, Francis Tuttle, sponsored by Travel Centers of America, and Grey Berry, High Plains Technology Center, sponsored by UPS. Matthew Adams was announced as National FutureTech Champion at the TMC Industry Awards luncheon Sept. 21. Adams also won the Wheel End and Fasteners work stations. SuperTech was designed by TMC’s Professional Technician Development Committee (PTDC) to recognize the high level of expertise and professionalism among today’s heavy truck technicians. It also provides an avenue for technicians to test themselves, identify areas of strength and areas needing improvement, and learn new skills to improve job performance.

OTA: CO-HOSTS ODOT AND OKCPS’ CONSTRUCTION CAREER DAY. Community outreach during National Truck Driver Appreciation Week. On Friday, September 16, 2016 at the OSU-OKC Campus, over 200 area Oklahoma Public Schools’ students attended the construction career day job and hands on fair. This annual opportunity educates high school age students about trade opportunities after graduation. Numerous agencies and organizations came together to provide hands on equipment for students to gain a real life view including our member companies McCorkle Truck Lines and Pioneer Transports. The Oklahoma Trucking Association is invested in promoting the positive impact of trucking, and this was a strong avenue to do so. Shaping the minds of young adults creates a better understanding for them moving forward. “The premise was to share with them facts about our industry and the wealth of jobs that are available,” said OTA C E O, Jim Newport.
