ELIMIN A T E HATE As Black Lives Matter Oklahoma City enters its fifth year as an official chapter, there is still much work to be done. While the groundwork was laid in 2015, the Oklahoma City chapter became recognized officially the following year. Executive director Rev. T. Sheri Dickerson said she was approached by one of the founders, Patrisse KhanCullors, about forming the chapter due to her past activism and advocacy. “Oklahoma is very high on the list, sometimes number one, on the list of officer-involved fatalities,” Dickerson said, “so surely there needs to be a chapter that is giving voice and amplifying the voices of Black lives and challenging the system of police brutality, white supremacy, racism, all the other –isms.” Most recently, the group has rallied around the cases of Isaiah Lewis, who was shot and killed by Edmond police in April 2019; Derrick Scott Sr., who died in Oklahoma City police custody in May 2019; and Anthony Meely, who died in Ada police custody in October 2019. Demand for body-worn camera footage of Scott’s death resulted in its release last month. But for BLM OKC, Black lives aren’t the only ones that matter in their campaign for justice. A section of the mission statement on BLM OKC’s website further details its scope of activism: “We are expansive. We are a collective of liberators who believe in an inclusive and spacious movement. We also believe that in order to win and bring as many people with us along the way, we must ensure we are building a movement that brings all of us to the front. We affirm the lives of Black queer and trans folks, disabled folks, undocumented folks, folks with records, women, men, and all Black lives along the gender spectrum. Our network centers those who have been marginalized within Black liberation movement. We are intersectional. People do not live one-dimensional lives, and our struggle crosses multiple dimensions. We ally with other oppressed people and find common cause with their struggles.” “We had Magdiel Sanchez, which was one of our Latinx brothers, who was deaf. They didn’t understand why he wasn’t responding. He didn’t understand what they were saying, and their response was to kill him,” Dickerson said. Sanchez was shot and killed by

Support and inclusion

Another incident that preceded its formation was the arrest of Oklahoma City police officer Daniel Holtzclaw, who was convicted of raping numerous Black women in northeast Oklahoma City. The U.S. Supreme Court recently declined to hear his appeal, so he will serve the entirety of his 263-year sentence.

Every elected official and every person within a position of power that can use their privilege as leverage should be supporting and uplifting the movement for Black lives. T. Sheri Dickerson “I was there as a support to the OKC Artists for Justice group. Several of us that ended up forming the BLM OKC chapter were also part of that,” Dickerson said. “One of the reasons why we didn’t, because we were getting ready to when all of that happened, is we don’t co-opt the work. We don’t appropriate the work. Those are Black women, and we’re Black women that have founded this, and so that’s not what we do to our sisters. And there’s so much work that needs to be done. It’s not about title or affiliation. It was about protecting and fighting for justice, and so that’s still the goal.” Aside from initially advocating for victims of police violence and demanding racial equality in policing policies, BLM OKC has widened its scope of action. “That’s a small fraction of what BLM OKC has evolved into. … We started our youth league; young people’s voices deserve to be amplified. They’re part of the demographic to where they said, Rev. T. ‘We’re getting killed too,’” Dickerson said. “We also have an interfaith league, or arm of BLM OKC. Myself being clergy, Reverend Jesse Jackson being part of the organization being clergy, very clued up with clergy, and so we understand how voices of faith should be. It’s obligatory for us to speak out against injustice. But we’re all black, and our lives matter as well. And then we have the arm of the LGBTQIA because often, Black trans persons basically are trained to, are further marginalized or even erased, and their lives are being, just they’re being slaughtered at unfortunately alarming rates. And we need to stand for them because we say all Black lives matter.” That the so-called “Stonewall riots” erupted in New York City in 1969 after a Black trans woman, Marsha P. Johnson, was attacked by police is of

historical note here. “I’m a queer person, and so especially in this month, history is important, but this is what we still see today,” Dickerson said. “There still seems to sometimes be very intentional and deliberate attempts to mute or dilute the effectiveness of Black women who have been the foundation and core of so many movements, and still there’s that patriarchal pull that really starts to pull at the hearts of Black women who are literally all about doing the work, protecting the community, uplifting the community, educating. Many of us now, we just want to survive and for our children to survive.” The women-led core of the leadership is unique to the BLM OKC chapter, she said. “We have now expanded so that we have some diversity and introspection.


But for the most part, from the beginning, women were the majority of the leadership team, and we have black men who were very supportive of that particular structure, and that is still the case,” Dickerson said.

Encouraging change

The death of George Floyd immortalized in cell phone camera footage that showed Minneapolis police officer Derek Chauvin fatally kneeling with a knee on his neck for 8 minutes and 46 seconds set up a new wave of protests and property damage that the country is still feeling the effects of more than a month later. Despite being in the midst of the COVID-19 epidemic, thousands of Oklahomans took to the streets, including the Black Lives Matter protest that began at NE 36th Street and Kelley Avenue and traveled both to the capitol and police headquarters and the Oklahoma County jail. Last week, Springlake Drive in northeast Oklahoma City became the latest street in the nation to be emblazoned with large, yellow letters reading “BLACK LIVES MATTER!” “I wanted to make sure that families in Oklahoma who have lost their loved ones to police brutality didn’t feel disrespected or forgotten or abandoned. And so I wanted to make sure that our messaging was about, ‘We see you. We hear you. We support you. And we’re going to continue fighting for justice,’” Dickerson said. “We haven’t been quiet, and we’re going to continue to amplify and push for policy change, legislative change. You’d like to be able to say community or humanitarian change, but I don’t understand why we have to literally push within society simply to be acknowledged that our lives matter.”

Addressing blatant racism

BLM OKC does not endorse individual political candidates, though it does strongly encourage voting. “Now we can certainly amplify and encourage everyone to participate in voting and being part of the process of choosing and electing representation that is going to be reflective of our own community,” Dickerson said. “And we know that this won’t happen, but every elected official and every person within a position of power that can use their privilege as leverage should be supporting and uplifting the movement for Black lives because Black lives matter, and they should be aware of why this movement even has to exist and want to and desire to bring change.” She took great offense to President Donald Trump’s attempt to hold a rally on Juneteenth in Tulsa, blocks away from the historic site of the Tulsa race massacre that occurred 99 years ago.

“He is a feckless jackal in my eyesight, and all of his actions are repulsive and he is repugnant and very deliberate, intentional and unapologetic in glorifying and broadening his base and upholding the systems of white supremacy,” Dickerson said. “It really gives me pause when we can get to a point to where you can come to a place that is sacred because of the atrocities that have happened. The second atrocity because it happened on stolen land, so the amount of disrespect. And then to come out with that very milquetoast response, ‘My few black friends.’ When you know how many Black friends you have, that indicates that you are racist as fuck.” While she has been pleased to see the push to pull down Confederate statues and the banning of Confederate flags, her voice rises when discussing Republican state Sen. Casey Murdock’s plan to bring those statues to Oklahoma. “Oh my goodness. I’ve got some words for him because surely your daddy has taught you better than that. You have invited all the Confederate statues when Oklahoma wasn’t even part of the Confederacy. And to want to invite something that is going to inflict such pain and trauma to an already-bleeding and overtly undeserved, traumatized demographic?” Dickerson said. “Shame on them for not being aware. It’s so offensive and absurd, and it is very indicative of the regime that currently resides at 1600 N. Black Lives Matter Avenue in Washington, D.C. I do take a small amount of pleasure in being able to designate his new address.” After the Young Peoples March for Justice and the street mural, BLM OKC is taking a step back from public events in light of the record number of COVID-19 cases now being recorded in the state. Instead, it will focus on socially distant goals. “The in-person activities or protests we were planning, we’ve made the collective decision to change those, to either reschedule or just not have them because we want to protect our family because we see everyone as family,” Dickerson said. “And so we are going to be having some virtual protests. We want to have some createa-thons to keep the momentum about BLM and BLM OKC in the hearts and minds of the people who are pushing for justice for the many, many families that have been affected.”

It’s hard to believe the massive shift in daily life that Oklahoma City residents have experienced since March. For most of us, the turning point was March 11, when Utah Jazz player Rudy Gobert tested positive for COVID-19 just before a home Thunder game. I had just sent my Rose State students off on spring break, 6

not knowing it would be the last time I saw them face-to-face that semester. Following an effort to flatten the curve through self-quarantining and the temporary shuttering of many businesses, Oklahoma began its Open Up and Recover Safely (OURS) Plan in late April. which started June 1. This phase removed limitations to gathering sizes and allowed businesses to reopen with social distancing measures in place. Many restaurants that previously only offered takeout and curbside provide for seating both indoors and out. Gyms and exercise studios have reopened with limited

capacity. Patrons often see tables, seats, exercise equipment and the floor taped off. Unfortunately, June has also seen a series of record-breaking days for coronavirus numbers. For instance, on June 21, Oklahoma State Department of Health reported 478 new cases statewide. The case numbers within the Oklahoma City metro have risen too, but on a smaller scale. Oklahoma City Mayor David Holt is focused on the metro numbers. In a statement posted to social media on June 16, Holt wrote that although there is an obvious uptick, hospitalizations have remained comparatively low. This is because roughly half of cases in June have been diagnosed in patients 35 and younger, so their symptoms are generally less severe. “We reacted as we did early on because people were going into hospitals, people were dying,” Holt said via Zoom. “We didn’t react that way because people were just getting the equivalent of the flu. But that is usually how a person in that age demographic experiences COVID-19. They typically have milder symptoms.” He said the city is not currently considering returning to government restrictions because “it’s a different pandemic” now than it was back in March and the spike is not yet resulting in increased hospitalizations. “We look at it every day,” Holt said. “The reason I posted about it on social media is I understand that the more young people that have it, even if they’re not experiencing the worst effects of COVID-19, that’s just more carriers in our community that could eventually cause outbreaks amongst demographics that are not as fortunate.” Dr. David Chansolme is Medical Director of Infection Prevention at Integris Health. He said the recent jump in cases was not a surprise. “What’s making a difference now is that activities are opening back up and people are having more confidence in getting out, doing things, and I think that’s wonderful,” Chansolme said via Zoom. “But we have to understand that there is a price to pay on the other side of that with more coronavirus cases.” Chansolme repeated what medical professionals have said for months. Those age 60 and older or those with underlying health conditions like heart disease, lung disease and autoimmune conditions are at greater risk. Chansolme has seen several patients die. continued on pg 8

“But the bottom line is most people do get through this just fine,” he said. Chansolme emphasized the need for everyone to continue handwashing, social distancing and wearing masks. Masks should cover both the mouth and nose.

Personal responsibility

Gary E. Raskob, Ph.D., serves as dean of Hudson College of Public Health at The University of Oklahoma Health Sciences Center. He is a Regents Professor of Epidemiology and Medicine. While Raskob praised how businesses have responded to the pandemic, he said the general public is not always taking necessary precautions. Along with observing social distancing, he urged wearing a mask in public places. “That is the single most significant thing we can do to prevent transmission of this virus,” he said via phone. Raskob said urgent conversations about personal responsibility and how individual behavior influences public health are needed. He said this new era requires innovative socialization and temporary personal sacrifices in order to keep others safe. “This principle is not new in public health,” Raskob said. “It’s the same thing we discuss when we talk about secondhand smoke. It’s the same thing we talk about when we talk about getting vaccinated.” And what about the autumn? Many university campuses plan to return to in-class instruction, and Oklahoma City Memorial Marathon is scheduled for Oct. 4. Raskob said it’s too early to predict what will happen. “The safety of those things happening will, to a large extent, depend on how we behave now,” he said. At Integris, Chansolme said he advises patients with non-COVID-19 health issues to still see their healthcare providers when necessary, to avoid exacerbating problems. “We’re all beginning to learn what social distancing is in a restaurant,” Chansolme said, “what social distancing is in a protest, what social distancing is in a political rally. These are all things that we’re continuing to learn.

to public spaces. “A lot of my older patients are still very, very scared to go out,” he said. Holt couldn’t say if that was the exact reason, but he acknowledged the strain

But that doesn’t matter to the virus.” Both Holt and Raskob pointed out that it’s a generalization to assume all individuals age 18 to 35 will have milder symptoms. There is still a risk of serious health issues or transmission to vulnerable individuals. Holt said we should not grow lax in taking precautions. “We have got to accept that this new normal is going to be with us for many months, if not a couple years,” Holt said. “In that sense, it is a temporary normal, but it is not a short-term normal. It is something we’re going to have to accept for a while if we want to preserve our lives and our way of life.”

DECADES IN THE MAKING,

CITY SET TO REALIZE CORE TO SHORE VISION by Peter J. Brzycki

Almost a year after Oklahoma City formally opened sprawling Scissortail Park south of the central business district, three other big park projects that would fulfill the long-held vision of connecting downtown to the Oklahoma River and to the southside are in progress. When plans were drawn to relocate an obsolete and crumbling section of Interstate 40 several blocks to the south on the heels of creating new recreation along the Oklahoma River corridor through the first MAPS initiative, city leaders saw a unique opportunity: Create a park system to tie together the city’s core with a huge area of outdoor recreation and green space. Today, visitors can enjoy the substantial upgrades to Myriad Botanical Gardens then easily stroll south to the 38-acre upper section of Scissortail Park. By early next year, work will begin on the lower section of Scissortail just south of I-40 and reaching all the way to the Oklahoma River. The final plans for the lower park area are almost complete, and the project will be out for construction bids in the coming months. Once work starts on that 28-acre parcel, it should be complete by mid-2022. Currently, substantial improvements are also being made at Manuel Perez Park, just south of the Oklahoma River and east of Robinson. In addition, longrange plans are being forged for Wiley Post Park, also on the south shore of the river and to the west, which could include a pedestrian bridge spanning the water. When Scissortail, Perez and Wiley Post parks are combined, the result will be almost 130 acres of new and completely renovated park land, plus another 14 in Myriad Botanical Gardens. Additionally, the nearby Boathouse District continues to add attractions, with a new surf machine and zip lines set to join the existing boathouses, fitness court, bike pump track and whitewater facility on the north side of the river.

Empty circus

Tulsa Mayor and wannabe Warby Parker model G.T. Bynum could barely contain his enthusiasm when Donald Trump announced his first rally in months for Tulsa. Trump voters, however, turned out to be less enthusiastic, filling only about a third of BOK Center, an arena successfully sold out previously by the likes of Nickelback and The Wiggles. During a news conference days before the rally, Bynum rah-rah-rahed for re-

porters: “I don’t care if you’re Republican, Democrat or independent; that’s a tremendous honor.” Trump bragged that he received more than a million ticket requests for the rally, but most of those came from K-Pop fans and leftists who made reservations in the hopes that Trump would do exactly what he did, which was perform to a mostly empty arena. (The outdoor overflow area and stage were abandoned altogether.) Those who did brave the heat and COVID-19 (at least two of his campaign staff who were in the arena have since tested positive for the virus) were treated to some of Trump’s greatest hits as well as some new numbers, like his 10-minute rendition of walking down a ramp and drinking a glass of water. Bynum might want to consider swapping out an initial and two letters in his last name because he managed to turn his city into a circus for a lot of empty seats, possibly costing himself an election in the process.

Police “posse”

At a time when citizens are demanding more training and accountability from their law enforcement, Canadian County Sheriff Chris West announced open applications for his all-volunteer “sheriff’s posse.” Nothing could be more tone-deaf than calling for a return to Wild West tropes during a time when Black people are demanding that they stop being murdered by vigilante yahoos like those who hunted and shot Ahmaud Arbery in February in Georgia. Better yet, West has announced that absolutely no military or policing experience is required; just the desire “to answer the call to aid in safeguarding lives and property and the Constitutional Rights of innocent, law-abiding citizens,” whatever that means. West hung up his Oklahoma Highway Patrol brownshirt in order to campaign for sheriff. He regularly appears in a paisley vest and

a Western bowtie and sporting white facial hair reminiscent of a certain Kentucky chicken chain founder. But with ideas like these, maybe he would be better suited dressing like another fastfood mascot, one who wears big, red shoes with yellow laces.

Empire Slice House, Revolución, Burger Punk, Gorō Ramen, Gun Izakaya, Little Market Taking one of the most cautious approaches among operators in Oklahoma City, 84 Hospitality has yet to reopen on-site dining to patrons at any of its locations; it closed all in mid-March. Founder and CEO Rachel Cope recently revealed that despite the extreme caution, two employees at Revolución recently tested positive for COVID-19 while they were operating the kitchen there for carryout and delivery. Revolución was promptly closed, and all employees were tested and then reassigned to other restaurants owned by 84. 12

Cope recently posted on social media, “I fought whether I was going to be honest about what happened (because I felt some kind of ‘shame’ that I had ‘let’ this happen) but I think it’s important for you to know the truth. It has always been important for us to be transparent, especially when it comes to health and safety.” Despite taking extreme measures, the group continues to do a great deal of takeout from Empire Slice House in 16th Street Plaza District. And in fact, it will soon be opening Empire Slice Shop in the former Slapfish space in Nichols Hills Plaza. That concept will feature counter service, beer and wine and late-night hours. Popular Gorō Ramen, also in the Plaza, remains carryout only. And although Burger Punk is completely closed, 84 is readying a new patio in hopes of providing on-site dining soon. Gun Izakaya in The Paseo Arts District is closed until further notice, but 84’s nearby Little Market is open and operating. Cope recently posted on social media, “At 84 Hospitality Group we continue to try and find ways to do right by our employees, customers, and the community. Above all, be kind, be compassionate, & be safe.”

Picasso Cafe, OSO Paseo, Frida Southwest, The Other Room, The Daley After monitoring the news around COVID-19 for two weeks, on Monday, March 16th, Humankind Hospitality founder Shaun Fiaconne made the tough decision to close all its on-site dining. Like so many bar and restaurant owners in Oklahoma, Fiaconne then had to let go of all of his hourly workers and

focus on carryout while relying on salaried managers and chefs to do it all, including packaging up to-go orders, running items out to cars and cleaning up. “Our staff has a hand in everything, and we are pretty vertically integrated, so it wasn’t a difficult transition,” Fiaconne said. Although its business was down over 75 percent from months with typical operation, it was enough to pay employees and keep everything going until the virus situation improved. When the state and city moved into Stage 2 of reopening, the group opted to open its dining rooms in a staggered fashion using social distancing and special precautions — not only requiring temperature checks, masks and gloves for all employees but also using a low-


intensity fogger to sanitize the dining areas every morning at 7 a.m. Humankind also rehired all its hourly employees. When a large spike in cases began to be reported by Oklahoma State Department of Health (OSDH), Fiaconne made the tough call to once again restrict service staring June 22nd, a decision made much more difficult by the fact that business had been robust upon reopening. “We want to be part of the solution in the community, not part of the problem,” said Fiaconne. Currently, Picasso Cafe and OSO are only offering full-service patio dining and curbside takeout. Frida Southwest still offers indoor dining, but only via reservation and at only 50 percent capacity in an open dining room with very high ceilings. The Daley and The Other Room, both bars, are now completely closed. Fiaconne said the group will continue to closely watch virus levels from OSDH and adapt and adjust as the situation unfolds.

Broadway 10 Bar & Chophouse, Hatch Early Mood Food, Sidecar Barley & Wine Bar, Birra Birra, Bibi’s Ice Cream, Chicken Foot Five years ago, Hal Smith Restaurants alums Jeff Dixon and Aaron Soward came out of the gate swinging with very ambitious Broadway 10, closely followed by tiny but stylish Sidecar Barley & Wine Bar, both in Automobile Alley. The group now has seven locations operating and five more in progress, and it doesn’t show any signs of slowing down, regardless of the COVID-19 outbreak. In a recent interview, Dixon recognized the responsibility to the community but also to the group’s employ-

ees and patrons, choosing “fight” rather than “flight” as a strategy. Provision never laid off any of its 300 employees and kept its salaried managers and chefs on full pay, even making good on bonuses when revenue slipped after being forced into a pure carryout model by the city and state. All Provision restaurants offered 50 percent off their menu prices during the closures and did all they could to remain relevant to their patrons and, as a result, experienced steady business. At every turn in the phased reopening, Dixon said they have done as much as the laws allowed while taking serious precautions, even hiring a tailor to create hundreds of masks when none were available. “We knew we weren’t going to be able to please everyone, but from day one, we decided to buckle down, cut our menu prices, take care of our employees and their families and work every day to keep our customers,” said Dixon. In fact, the group sees a very bright future and has recently doubled the rooftop bar of Sidecar Chisholm Creek and will be opening Chicken Foot, a new fried chicken and cinnamon roll concept, in the Chisholm space recently vacated by Hopdoddy Burger Bar. In addition to Broadway 10, there are now two Sidecar and two Hatch locations in Oklahoma City as well as Birra Birra and Bibi’s Ice Cream. Provision hopes to open Chicken Foot in September as well as a Hatch and Sidecar on Cherry Street in Tulsa this fall, followed by another Hatch and Sidecar in 2021. And Dixon said there are more locations in the works.

Oklahoma Gazette: How did you get into making art? Greg Pogue Jr.: I started drawing at an early age. I use to draw Marvel comic characters and cartoons. I took a break so I could focus on playing sports during high school and college, and I didn’t start back drawing until I had a terrible knee injury in 2009. OKG: What inspires your work? Pogue: My family and friends inspire me the most, them knowing I’m striving to be a great artist and critiquing my work when I ask for their opinion. Knowing that my art might touch someone’s heart, and when I do commission pieces, the joy I get when I capture all the detail in the portrait I’m doing. OKG: How do you choose your subjects?

Pogue: Depends on the model, celebrity, athlete or public figure, how the person is posing and how the light is hitting them. Sometimes I look for a challenge if I feel like it’s going to be difficult portrait. OKG: What’s your process? What is your workspace like? Do you listen to music while you work? Pogue: My process can be me just scrolling on Instagram and seeing a beautiful picture, or me just thinking of a celebrity to do a portrait of. In my art room, I have my art table with my iPad attached to it, and I keep my computer open on Photoshop, so I can zoom in to see all the detail in the photo. As far as music, just depends on what mood I’m in. Sometimes I like working in complete silence or I can have my stereo on, playing anything from rap, hip-hop, R&B to jazz (courtesy of my father). OKG: Which of your drawings or paintings means the most to you and why? Pogue: The one of my parents, my father helped me with the colors, seeing that the photo was in black-and-white. He talked about his leather coat he was wearing for days and even pulled it out. With his recent passing, I would say that one means the most to me. My Nipsey Hussle drawing (“Nipsey Blue”) I did. I’ve been a fan before he hit mainstream. To see how his career was developing and taking off, it’s sad that his life was cut short for no reason. Last but not least, my Kobe and GiGi drawing. I’ve been a Kobe fan since he came into the NBA. It’s sad that his and especially GiGi’s life was cut short; I seen a lot of talent and potential in her. OKG: Who is your favorite artist? Pogue: Van Gogh and Monet from when their exhibit that was at the arts museum downtown, Shana Levenson and Lena Danya, just to name a few. OKG: What have you been doing at home during the COVID-19 pandemic? Pogue: I have been doing a lot

of drawing, watching a lot of movies and just working on different hobbies I have and helping my sister take care of my father till his untimely death in May.

DURABLE INDUSTRY Oklahoma’s cannabis industry stays strong while facing COVID-19 in addition to its everyday challenges in a volatile business market.

For the Oklahoma cannabis industry, the months since the coronavirus pandemic hit the state have been both the best and worst of times. “Frankly, the last three months have been great from a business perspective. It’s reflected in the retail numbers, which have been recordsetting. I don’t know that it’s all attributable to the pandemic, but it certainly didn’t hurt that so many patients were stuck at home,” Climb Collective and Overman Legal Group founder J. Blake Johnson said. Deemed an “essential business” in the state, Oklahoma growers, processors and dispensaries were able to keep their operations going and doors open while many other companies and industries were shuttered through April and May. In March, cannabis tax revenue brought in $57.9 million. In April, the number jumped to $64.5 million and to more than $72 million in May. That number continues to climb, with $80.45 million collected for the month as of June 24. For some dispensary owners, COVID-19 has been a booming time for business, allowing them to reap the benefits of a citizenry who were largely without the ability to spend time outside their normal haunts, instead making do at home. Bolstered federal unemployment benefits left some on their sofas with more income than they had while they were employed. But the quarantine has been a mixed bag for others, like Raney Aboud, co-owner and manager of Planet Hollyweed, 3121 N. Pennsylvania Ave. “The first thing that we did was we addressed the problem. We got people that we need to protect: our owners, our staff members,” he said. “Some of them are immunocompromised, and we had to make the decision to protect us and our patients.” The arrival of the pandemic to the state immediately changed the way they did business. “The best thing that we could do is still offer products for our patients, but the way that we had to do it was through the tiny window of our door and doing pickup-only, which was very detrimental to a lot of peoples’ experience buying weed in the sense that no one likes to not see their weed. That’s the most important part of buying it, and people have been doing that since before this legal market,” Aboud said. “As things went on, we retained some customers, for sure, but it was not easy. And it was definitely a struggle getting through things just for doing what we thought was right in that moment. It was kind of like all bets are off. This is not guerrilla warfare, but it kind of felt like that,

you know, with competition.” Planet Hollyweed is planning a new slate of flower strains from its growing operation and a “grand re-opening” event on Aug. 1, if they decide it is safe to do so.

Cannabis studies

The Oklahoma Legislature was also thrown a curveball, with every single bit of cannabis legislation being dropped this season. Before it at the beginning of the session were more than a dozen bills that would have possibly changed many ways the industry operates, including legalized delivery. Many of the former pieces of legislation were rolled into House Bill 3228, which passed both

the House and Senate but was vetoed by Gov. Kevin Stitt. The Legislature did not override the governor’s veto despite a push from many advocates and business owners.

working with lawmakers to help move the needle for the state’s medical cannabis program. “The strategy for pushing [HB]3228 did not work. The strategy was the problem, in my opinion,” Moe said. Instead, he was approached by legislators about conducting an interim study into adult use of cannabis in the state. “We will have that this summer. All of the reasons not to do it we will deal with this summer during an interim study so that next year, we can do it continued on pg 28

through legislation. … That is what I’ve been pushing for. That’s what the CLA has been pushing for,” Moe said. “We were not the key runners on [HB]3228. We had our bills. They were combined into 3228. We got what we need in there. The people running that bill did not succeed. We are succeeding in what we set out to do, which is to bring full access to the state of Oklahoma. And you know the reasons. It’s about fixing the medical program, but the only way to do it is through free, full access first.” Another study Moe has been involved with is the planned two-year study and pilot program on DUI laws pertaining to cannabis. “All the details haven’t been worked out, but what we’re looking at is something like this: If they think you’re impaired, they’ll say, ‘Hey, how about you take this breathalyzer and we call you a ride home?’” he said. “You fail the test, you don’t go to jail, but we get the numbers for our study and you get a ride home. So it’ll be like a get-out-of-jail-free card to the breathalyzer. That’s the way it’s been explained to me.” Moe said they are also planning to do closed-course driving tests with drivers that have been consuming cannabis as they have previously done in Muskogee. In the meantime, in order to put a stop to enforcement on several problematic pieces of legislation for the industry that were not resolved this session, a lawsuit was filed in Oklahoma County District Court June 22 on behalf of three industry participants. The injunction challenges the state’s residency requirements for cannabis business owners as well as the rule barring

them from operating within 1,000 feet of a school. Genesis Canna-Farms, KC’s Cannabis and Teresa Bilyeu are listed as the plaintiffs on the lawsuit. A court date had not been set as of June 24.

The court ruled that SQ807 is not preempted by the Controlled Substances Act and unlikely to result in a state violation of the Racketeer Influenced and Corrupt Organizations Act. “In considering federal law questions, the Supremacy Clause requires this Court adhere to decisions of the United States Supreme Court,” the opinion states. “We have previously declared unconstitutional various initiative petitions and state laws that infringed upon rights the United States Supreme Court has expressly determined are guaranteed by the United States Constitution. We have also followed United States Supreme Court precedent on federal questions in diverse areas such as Indian law and application of the Commerce Clause. However, the United States Supreme Court has never addressed preemption of state marijuana laws under federal statutes such as the CSA. Petitioner argues that this uncertainty concerning federal preemption of state marijuana regulations compels this Court to declare SQ 807 unconstitutional. The opposite is true. The burden is on a protestant to demonstrate that a proposed initiative is clearly and manifestly unconstitutional on its face. … This Court acknowledges the lack of controlling federal precedent has created uncertainty concerning the interplay between state regulatory schemes permitting marijuana use and existing federal law. The people of Oklahoma have spoken once on this interplay between state regulations and existing

federal law in the approval and implementation of SQ 788, Oklahoma’s legalization of medical marijuana. We have confronted that uncertainty, and considered the question in depth by examining the parameters of SQ 807, the language of federal statutes such as the CSA, and principles of preemption under the Supremacy Clause. Based on the above analysis, Petitioner has failed to meet his burden of demonstrating that SQ 807 is clearly or manifestly unconstitutional. We hold therefore that State Question No. 807, Initiative Petition No. 423, is legally sufficient for submission to the people of Oklahoma.” SQ807 petitioner and campaign manager Michelle Tilley said on Wednesday that they had discussed the June 23 ruling earlier in the day. The campaign had been waiting on the decision, which they expected on March 13 before the COVID-19 pandemic resulted in court closures. “Obviously, we’re pleased with the court’s decision, so we’re still alive,” Tilley said. “Right now, we’re in a 20-day waiting period, and someone could file for a rehearing of it. And then after that, if we don’t get anyone to file anything, then it would go to the Secretary of State, but they still have a hold on all petition activity right now, so we’re in a waiting game at this point.” Even if they are given the go-ahead after the waiting period, that would leave them less than a month to gather signatures to meet the deadline for this fall’s ballot. “At this point, it would be next to impossible for us to make the November 2020 ballot, even if everything just broke perfectly our way. It’s just the timeline at this point is just going to be super tight,” she said. But the fight to bring SQ807 to a vote is not dead in the water, though possibly delayed. In addition to bringing adult use of cannabis to a vote, it would overhaul the state’s criminal justice measures pertaining to cannabis, which have historically been some of the harshest in the nation and have yet to be addressed since the passage of State Question 788. “Two years in, we’ve seen massive growth in the industry. But its participants are still routinely targeted by local, state and federal law enforcement — who remain prejudiced by decades of criminalization — for harassment, seizure and prosecution,” Johnson said. “And our community has done nothing to redress the systemic injustice of people — disproportionately people of color — sitting in jails and prisons for the same conduct that gets us paid. So we still have a lot of work to do.”

LEO (July 23-Aug. 22)

Travel writer Paul Theroux has journeyed long distances by train: once from Britain to Japan and back again, and then from Massachusetts to Argentina. He also rode trains during part of his expedition from Cairo to Cape Town. Here’s one of his conclusions: “It is almost axiomatic that the worst trains take you through magical places.” I’d like to offer a milder version of that counsel as your metaphor for the coming weeks: The funky, bumpy, rickety influences will bring you the best magic.

Author Malidoma Somé lives in the U.S. now, but was born in the West African country of Burkina Faso. He writes, “In the culture of my people, the Dagara, we have no word for the supernatural. They might at times be a bit spooky or confounding, but will mostly be interesting and fun.
