Crack Down on Inmate Cell Phones

(AP) - Judges in California and South Carolina have ordered cellphone carriers to disable nearly 200 contraband cellphones used by inmates to orchestrate crimes behind and outside prison walls, the most sweeping order of its kind ever won by corrections officials. It's an important victory for prison officials who have been frustrated by their inability to stop the flow of smuggled phones that are used to coordinate drug deals, gang operations and killings. Even murderous cult leader Charles Manson, who died in November, obtained phones and used them to communicate with followers outside prison. The warrant essentially orders carriers to “turn these phones into bricks,” California Corrections Secretary Scott Kernan told The Associated Press on Monday. The phones will be shut down over the next week or two, he said. Kernan expects other states will follow the lead of South Carolina and California and ask judges to approve broad shutdowns. By CLAUDIA LAUER Associated Press Bill Cosby should be classified as a sexually violent predator, according to an evaluation by Pennsylvania's Sexual Offenders Assessment Board. The district attorney's office that prosecuted Cosby asked a judge in a filing Tuesday to schedule a hearing on whether to accept the recommendation. No date was immediately set. “We will see them in court,” responded Andrew Wyatt, Cosby's spokesman. The 81-year-old comedian was convicted April 26 of aggravated indecent assault. He was accused of drugging and assaulting former Temple University employee Andrea Constand at his home near Philadelphia in 2004. The weekslong retrial in suburban Philadelphia included testimony from five other women who were among dozens who have stepped forward to accuse Cosby of similar sexual misconduct. The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, as Constand has done. The former TV star once known as “America's Dad” for his portrayal of kindly Dr. Cliff Huxtable on his NBC hit “The Cosby Show” is now confined to his home awaiting sentencing , which is scheduled for Sept. 24. He faces up to 10 years in prison. His representatives have said he plans to appeal. Superior Court Judge Steven O'Neill, who presided at the trial, ordered him to be outfitted with a GPS monitoring bracelet and required him to seek permission to leave home, and only then to visit with lawyers or go to the doctor. The report by the Sexual Offenders Assessment Board, which examined 14 different criteria, is not public. Copies are given to the prosecutor, defense attorney and court before the hearing and the board's assessor will likely testify about how she made the recommendation. State law already requires Cosby to register as a sex offender because of the nature of the charge of which he was convicted. The sexually violent predator classification would require increased treatment in prison and increased notification of neighbors upon release. A person deemed a predator is subject to lifetime, at least monthly, mandatory sex offender counseling with a treatment provider approved by the state board.

A huge wave hit, scattering passengers on the vessel known as a duck boat into Table Rock Lake near Branson, Coleman said. When the Indianapolis woman came up for air, she was alone. She prayed. “I said, Lord, please, let me get to my babies,” she told reporters from her wheelchair Saturday in the lobby of a hospital where she’s recovering after swallowing lake water. “... If they don’t make it, Lord, take me too. I don’t need to be here.” Coleman recalled spotting the rescue boat and managed to reach it, “somehow.” Earlier, from her hospital bed, she recounted to television station KOLR her sister-in-law’s last words. Coleman’s husband and three children, ages 9, 7 and 1; her 45-year-old sister-in-law and 2-year-old nephew; her mother-inlaw and father-in-law and her husband’s uncle all died Thursday night in the deadliest accident of its kind in nearly two decades. Others killed included a Missouri couple who had just celebrated a birthday; another Missouri couple on what was planned as their last extended vacation; an Illinois woman who died while saving her granddaughter’s life; an Arkansas father and son; and a retired pastor who was the boat’s operator. LOS ANGELES (AP) - Two flight attendants for a Chinese airline were fined and ordered to leave the United States within 72 hours for attempting to smuggle nearly twodozen spotted and box turtles in a carry-on bag from Los Angeles to China. City News Service reports Monday that U.S. District Judge S. James Otero ordered Chinese nationals Huaqian Qu and Renfeng Gao to pay $5,500 each to the U.S. Fish and Wildlife Service before returning to China within three days. The U.S. Attorney’s Office says the two China Eastern attendants pleaded guilty last month to a federal conspiracy charge, which carries a possible penalty of up to five years behind bars. While prosecutors argued for 10-month prison sentences, Otero says the smuggling offense “was not violent,” and the probationary sentences with fines were “sufficient.”

City Wants Barack Obama Boulevard VALDOSTA, Ga. (AP) - Residents of a Georgia city are pushing to change the name of a residential street to Barack Obama Boulevard. The Valdosta Daily Times reports a citizens group plans to start circulating a petition Monday to rename Forrest Street for the nation’s first black president. The Rev. Floyd Rose says the petition needs signatures from 51 percent of the street’s residents. Rose says the name should be changed because Valdosta city leaders named Forrest Street in April 1883 for Confederate Gen. Nathan Bedford Forrest, who was also an early leader of the Ku Klux Klan. But Donald Davis of the Lowndes County Historical Museum says notes from the period indicate the street may have been named for Elbert Forrest, a black businessman in Valdosta.

LOUISVILLE, Ky. (AP) - Papa John’s is attempting to ward off its disgraced founder by adopting a poison-pill plan. The company is struggling to distance itself from John Schnatter, who resigned as chairman this month after his use of a racial slur during a media training session was revealed. He stepped down late last year as CEO after becoming enmeshed in the national anthem issue involving NFL players, saying it was hurting pizza sales. Schnatter, who later said his resignation was a mistake, is still the pizza chain’s biggest shareholder. He founded the company in 1984. Papa John’s, based in Louisville, Kentucky, said late Sunday it will put its shareholder rights plan in place for a year. The plan would be activated if anyone acquires 15 percent or more of the company’s outstanding shares without board approval. That would effectively prevent Schnatter, who holds 30 percent of all outstanding stock, from gaining a controlling stake in the company. The company said the plan won’t keep its board from considering any offer that is fair and in the best interest of shareholders. Papa John’s International Inc. has started scrubbing Schnatter’s image from its marketing materials and has said it’s evaluating all of its ties with him. Schnatter still serves as a board member. It’s holding off Schnatter as it struggles to reinvigorate the brand. Shares of Papa Joh’s International Inc. are down more than 30 percent over the past year.
