and good-guy image in ruins, an 81-year-old Bill Cosby was sentenced Tuesday to three to 10 years behind bars for drugging and sexually assaulting a woman, becoming the first celebrity of the #MeToo era to be sent to prison.

The punishment all but completed the dizzying, latein-life fall for the comedian, former TV star and breaker of racial barriers.

“It is time for justice. Mr. Cosby, this has all circled back to you. The time has come,” Montgomery County Judge Steven O’Neill said. He quoted from victim Andrea Constand’s own statement to the court, in which she said Cosby took her “beautiful, young spirit and crushed it.”

Cosby declined the opportunity to address the court before the sentence came down.

The punishment came at the end of a two-day hearing at which the judge declared Cosby a “sexually violent predator” — a modern-day scarlet letter that subjects him to monthly counseling for the rest of his life and requires that neighbors and schools be notified of his whereabouts.

The comic once known as America’s Dad for his role on the top-rated “Cosby Show” in the 1980s was convicted in April of violating Constand, Temple University women’s basketball administrator, at his suburban Philadelphia estate in 2004. It was the first celebrity trial of the #MeToo era.

Cosby faced a sentence of anywhere from probation to 10 years in prison. His lawyers asked for house arrest, saying Cosby — who is legally blind — is too old and vulnerable to do time in prison. Prosecutors asked for five to 10 years behind bars, saying he could still pose a threat Continued on page A5

When We All Vote, a non-partisan organization inspiring voter turnout in the run up to Election Day in November, is working on a National Week of Action. Former First Lady Michelle Obama is serving as a co-chair.

“When We All Vote, we get new ideas and new energy.

We get leaders that share our values” says Mrs. Obama in a new commercial running on prominent digital platforms and on radio across the U.S. The commercial will air over the 14 days before voter registration deadlines. On September 20, When We All Vote launched a text message campaign allowing people to text WeAllVote to 97779 for voter registration information.

The 2018 cycle has been propelled by two elements: Dislike of President Donald Trump and a record number of women running for office. According to NBC News, there were 53 female Senate candidates, previous record was 40 in 2016, and 476 female House candidates, with the previous record being 298 in 2012. Among the 476 women who ran for a seat in the U.S. House, about 75 percent were Democrats.

Over 52 percent of Democratic House female candidates won their primary races. There percentage was higher than for Democratic men or Republican women. The 2018 election cycle is expected to be a record one for female candidates. Backlash to Trump’s presidency is widely seen as one of the main reasons as his disapprovals climb higher.

When We All Vote is planning a Week of Action in which volunteers will host nearly 2000 events across the U.S. The purpose of the events will be to register voters and recruit volunteers. Former Florida Police Chief Guilty of Framing 3 Black Men

By Lauren Victoria Burke NNPA Newswire Contributor In 2013, then Biscayne Park Police Chief Raimundo Atesiano informed community leaders of the Biscayne Park Police Department’s perfect clearance record for solving crimes: It was 100 percent. According to Atesiano, his police department near Miami was perfect at solving burglaries.

On September 21st, it was revealed in a plea agreement that the former chief directed his officers to frame unsolved cases on three Black men. A federal court hearing confirmed that former Chief Atesiano directed three police officers on his department to accuse a series of crimes on three innocent men, all of them Black.

In August, Biscayne Park Police Officers Charlie Dayoub, 38, and Raul Fernandez, 62, pleaded guilty to falsifying the arrest affidavits for a 16-year-old black suspect in four break-ins from June 2013. A second false arrest was made on a man named Clarence Desrouleaux. Desrouleaux, 35, was deported to Haiti as the result of being framed and sentenced to five years. A third man, Erasmus Banmah, 31, was falsely accused for burglary.

Former Chief Atesiano, 52, pled guilty to conspiracy for the framings. The conspiracy convictions carry up to 10 years in prison. Atesiano resigned from the Biscayne Park Police Department in 2014. The details of the Atesiano framings of three Black men were detailed in a statement released on September 14 by the Department of Justice.

“According to documents filed in connection with the plea entered today, Atesiano was acting under color of law as chief of police when on three separate occasions he

ordered officers under his command to falsely arrest and charge individuals with unsolved burglaries. In court filings related to the plea, Atesiano admitted that on one occasion he instructed an officer to falsely arrest and charge an individual for several vehicle burglaries based upon what Atesiano knew were false confessions. According to the documents, Atesiano intentionally encouraged officers to arrest individuals without a legal basis in order to have arrests effectuated for all reported burglaries, which created a fictitious 100% clearance rate for that category of crime,” said U.S. Attorney Benjamin Greenberg said in a written statement on the Atesiano prosecution.

“The right to be free from false arrests is fundamental to our Constitution and system of justice,” said Acting Assistant Attorney General John Gore.

“Law enforcement officers who abuse their authority and deny any individual this right will be held accountable.

As the Chief of Police, Defendant Atesiano was trusted by his community to lead their police officers by example; he has failed his community and the officers of Biscayne Park,” Gore added.

“It is a deliberate injustice to intentionally charge and arrest an innocent man. Police Chief Raimundo Atesiano’s actions were intended to give his community a false sense of security and were a betrayal of his oath to protect the residents of Biscayne Park and all the people of Miami-Dade County,” commented State Attorney Katherine Fernandez Rundle. “I applaud the combined efforts of our law enforcement partnership to end this calculated abuse of power.”

Dad Put Girl in Game Machine to Steal Prizes

SALEM, N.H. (AP) – A Massachusetts teacher has been charged with putting his toddler into a game machine at a New Hampshire shopping mall and using her to steal prizes.

Police in Salem say 34-year-old Anthony Helinski, of Lawrence, Massachusetts, turned himself in Wednesday, five days after witnesses at the Mall at Rockingham Park recorded video of a man encouraging the girl to hand out prizes from within the KeyMaster game. The video then shows the toddler climbing out of the machine.

Andover Public Schools tells WCVB-TV that Helinski has been placed on leave from his job as a middle school teacher.

Helinski is charged with theft, trespassing and child endangerment. He does not have a listed phone number and it was unclear whether he has an attorney.

MCCOMB, Miss. (AP) – A man wore a live snake around his neck inside a Waffle House in southwestern Mississippi.

Cellphone video shows that when a guard confronted him, the man removed the snake, stepped toward the officer and yelled, “Let’s do it!”

Onlookers scattered, and they did not smother their screams.

The Enterprise-Journal reports the confrontation happened early Saturday at in McComb. A local resident posted video to Facebook.

The officers escorted the man and the snake out of the restaurant. The newspaper reports it was not immediately clear whether any charges were filed.

Police Shooting Protesters Allege Excessive Force

MEMPHIS, Tenn. (AP) _ Activists are questioning the level of force used by Tennessee police officers to arrest people protesting the Memphis Police Department’s shooting of a black man who was in critical condition.

The Commercial Appeal reports a video of one woman arrested during the Wednesday protest that blocked a city street shows her fleeing officers and being tackled. Police say Barbara Buress struggled against the two officers that tackled her, kicking one in the face.

Another protester, Theryn Bond, says officers’ ``manhandling’’ left her bruised. Buress and Bond are two of six people arrested during a protest of 25-year-old Martavious Banks’ shooting last week.

The shooting has sparked multiple angry protests from activists and relatives of Banks. Police have said Banks was shot during a confrontation with officers, who didn’t have their body or in-car cameras activated.

Sickle Cell Disease is a lifelong debilitating blood disorder that causes reduced blood and oxygen flow in the body, often resulting in organ damage and severe pain.

“The CFC was formed because there is urgent need to change the acute care paradigm for sickle cell disease patients. Pfizer [Rare Disease] is committed to working with the CFC to ensure that these issues are addressed as quickly as possible,” said Dr. Kevin Williams, chief medical officer of Pfizer Rare Disease.

As part of its mission of education and advocacy, the CFC published a report, “Improving Vaso-occlusive Crisis (VOC) Management,” which focuses on elevating the care paradigm in hospital emergency departments. Since Sickle Cell Disease treatment options are limited, the current practice is to focus on pain management, often with opioid medications, according to the report.

The impact of Sickle Cell Disease Sickle Cell Disease affects about 100,000 people in the United States, with the majority being those of African descent, Pfizer officials said. Although Sickle Cell Disease was identified more than 100 years ago, there has been little advancement when it comes to its treatment, management and the overall understanding of the pathophysiology of the disease.

VOCs are the hallmark symptom and one of Sickle Cell Disease’s most significant challenges. These pain crises, which some patients experience several times per year, are so severe that patients may end up in an emergency room, desperate for help, according to a published report.

Given the need for repeated treatments, people with Sickle Cell Disease may build up a tolerance to certain medications and, as a result, require higher doses over time.

Some emergency room staff may confuse dosage tolerance with dependence, and mistakenly view a patient with Sickle Cell Disease as a “drug seeker,” misunderstanding the legitimacy of the pain—a major barrier to care for these patients.

“The Council would like to socialize these principles to medical institutions across the country and welcome institutions that might be interested in piloting these best practices,” Williams said.

According to Williams, “The program is focused particularly on VOCs through patients and advocate voices and empowers patients to ‘self-advocate’ for better care.”

The CFC is particularly interested in developing educational tools for others within the Sickle Cell Day community (patients, medical providers, researchers and families).

Council members have brainstormed several concepts such as slides, brochures, apps, and videos that could be used as vehicles for understanding and communicating the novel science of Sickle Cell Day and to increase understanding and awareness.

Expanding the evolving science supporting Sickle Cell Disease is just one of several ways the council is attacking key issues from the report to ensure both healthcare professionals and patients are aware of the latest understanding of the disease and will facilitate more effective conversations about VOC management. “An example of this is a real-time interface through which patients would be able to track and better manage their symptoms, as well as receive reinforcement from their support network,” Williams said, noting that the CFC would like to hear from others who are interested in helping advance those ideas.

“The CFC is seeking to learn more about programs at institutions that have been successful in educating their emergency department staff and reducing stigmas. The Council wants to hear from institutions interested in developing and fielding an emergency department educational pilot program,” he said.

As outlined in the newly released CFC report, “there is work ahead to implement the overall CFC vision and specific workstream call-to-actions to create positive change for those affected by Sickle Cell Disease,” Williams added.

“The CFC hopes this report encourages ongoing efforts and helps to create new opportunities for collaboration and involvement in order to bring these initiatives to fruition. Thus, the CFC hopes to create positive change for those affected by Sickle Cell Disease and looks forward to keeping the community apprised,” Williams said.

America is on the Ballot

The United States of America, in 2018, is at a major crossroads and there is too much at stake to simply ignore the importance of this critical election.

If ever there was a time to vote, that time is now. And while there will be many candidates whose names will appear on ballots across this country, it is actually the future of the United States of America that is the most important thing on the ballot this November.

These important midterm elections are shaping up to be some of the most important elections in modern times.

The results of these midterm elections will not only determine the makeup of Congress, but they will also shape the overall future of this country.

The current president has single-handedly emboldened the worst elements of society to openly express their racist views and bigotry in ways that have not been blatantly seen in America since the days of the Civil Rights struggle.

The Civil Rights Act of 1964, the Voting Rights Act of 1965 and other legislation that was introduced, helped to deal with issues of racism, police brutality, economic disenfranchisement, discriminatory judicial practices and attacks on voting rights that have existed in this country since inception. However, the unrepentant hearts of racists in this country came to the forefront once again after the election, and subsequent re-election, of the nation’s first Black president in 2008 and 2012 respectively - President Barack Obama.

The current administration has shined a light on the darkness of racism and bigotry that has long been ignored and swept under the rug in this country. The divisive rhetoric and activity that this current administration has boldly encouraged, has now trickled down to many cities and states across this country, which is why voting in local and state elections is so important.

“All politics is local” is a popular political saying that is most often associated with former Democratic House Speaker Thomas P. “Tip” O’Neill, Jr. When you think about the phrase in itself, it makes sense that the things that impact you the most take place on the local level.

Taxation without representation is a horrible position to be in. The President of the United States, whoever that elected person may be, plays an important role in what affects Black people, but the president can only do so much.

All of the key decisions and pieces of legislation that impact Black people on a daily basis are made by individuals who are elected by regular citizens at the local, county and state levels of government. Those who are elected to office by regular citizens, then have the ability to appoint people to other key positions, as well as enact laws that will undoubtedly affect the quality of life of everyone, including those who didn’t vote.

The detrimental outcome of Black people choosing to completely disengage from the political process and choosing not to vote is a costly one. A non-vote is still relevant and just as powerful as if a vote were actually cast. President Donald J. Trump understood that, and expressed his sincere gratitude for a great majority of Black people choosing not to come out and vote in 2016.

After winning his election against Democratic nominee Hillary Clinton, Trump told a crowd of supporters at a 2016 rally in Grand Rapids: “The African American community was great to us.

They came through, big league. Big league. If they had any doubt, they didn’t vote, and that was almost as good, because a lot of people didn’t show up, because they felt good about me.”

At another rally the following week, Trump once again expressed his appreciation for Blacks choosing to stay home and not vote, saying: “We did great with the African American community…They didn’t come out to vote for Hillary. They didn’t come out. And that was big — so thank you to the African American community.”

According to the Pew Research Center, the Black voter turnout rate in 2016 declined for the first time in 20 years in a presidential election, falling to 59.6 percent in 2016, after reaching a record-high 66.6 percent in 2012 when President Obama was re-elected. The number of Black

voters who went to the polls in 2016 also declined, falling by approximately 765,000 voters. In contrast, Whites were motivated to come out and vote, primarily because of the polarization of Trump, and had an increase in their voter turnout rate - 65.3 percent in 2016 versus 64.1 percent in 2012.

Over the past few decades, the number of Blacks choosing to stay home and not vote, coupled with the Black vote being constantly targeted by voter suppression tactics, has contributed to the election of many individuals who have not had the best interest of African Americans in mind.

Trump now has the potential of having a second Supreme Court Justice named to the highest court in the land, which could prove disastrous for many African Americans if he is confirmed by the Republican-controlled Senate. The likelihood of this lifetime appointment, along with the other harmful pieces of legislation that have been introduced by this administration, only became a reality when Trump was elected to the office of the presidency by those who chose to vote and by those who chose to stay home and not vote.

This November, Black people must take voting and politics seriously if they are going to see collective changes in their communities, in their social status and in their daily lives.

At the recent Congressional Black Caucus Annual Legislative Summit, Reverend Dr. William Barber challenged the attendees at the annual Phoenix Awards Dinner to step up and vote.

“We are called to be the conscious of this nation,” said Rev. Barber. “Our vision has to be bigger than Trump. We have to come together to change the course of our nation.

You better know who you are when you are under assault.

We cannot fail to be who we are. We must vote.”

There is no Black community in America that can grow and progress if there is no solid representation in place to make important decisions that impact the quality of life of its residents. Whether it is educating Black children, ensuring their tax dollars are fairly distributed, having access to quality healthcare, having community-based services available to them or receiving equitable treatment in the court of law, Black people must vote to ensure they have quality representation. If Black people don’t vote to ensure they have quality representation, then the potential of having ineffective representatives thrust upon them becomes a potential reality.

Again, Black people need not downplay the significance of these upcoming midterm elections in November.

While the races for Congress and the various governorships across the country are extremely important, there are many down ballot races that are even more important and should not be ignored, as they will impact the daily lives of Black people for years to come.

In Harris County, Texas, which is the third most populous county in the U.S., there are 19 Black women running for various judicial seats on the ballot in the upcoming midterm elections.

Whether it is the judge who has the power to sentence your loved one to a lengthy prison sentence or the judge who is responsible for dealing with a lawsuit or the judge who has the power to determine what your child support payments and visitation rights look like through the family court - one or more of these Black women could very well be elected in a position that will impact your life in some shape, form or fashion in the very near future.

The same applies to all of the other important local and state races across the country.

All elections, especially local elections, are too important to overlook and ignore.

It is time for Black people to dig in, get in the fight and embrace their precious right to vote, which was paid for with a hefty price. More importantly, the fight to protect those precious voting rights is still being fought on a daily basis by those who understand the struggle to make a difference through politics and public policy. It is not the time to embrace non-voting. It is not the time to make a conscious decision to stay at home and avoid casting a ballot in 2018.

It is time to VOTE, because America is on the Ballot in 2018!

What is Our Legacy

When we begin to understand our own mortality, we become more “self-aware” of exactly what we will leave behind as a representation that we were here.

By Sean C. Bowers \Is it the successes and triumphs versus the losses, measured in a wins-and-losses format? Is it the total distance traveled past the life obstacles one has overcome? Or is it the amount of people one has connected with and inspired to help them maximize themselves and their potential?

To me, it is a combination of all three. A legacy is a type of personal achievement record, like being “on the record.” It is what we each do with the time given us — how we use or abuse that time and the “God given” gifts and talents we are each bestowed. Birth then becomes our starting line. From then on, each of us is granted the same amount of time in a day: 24 hours.

Prioritizing our lives is done on many levels, both conscientious and some sub-consciously. Early in life, I was consumed with the sole mission of earning a full college basketball scholarship and becoming our family’s first college graduate.

At the time, I was doing it for me and my Mom. Yet even then, I knew that as the oldest grandchild, I was creating a “blueprint” for all my younger relatives to follow to their own personal successes.

This prioritization at a young age was more egocentric.

It served me well at the time, but it wasn’t until a low point later in life that I came to understand and embrace my true legacy’s calling. One is often tested in life to see just how committed and focused we are.

When we begin to understand our own mortality, we become more “self-aware” of exactly what we will leave behind as a representation that we were here. My awakening came when I returned home to Virginia in 1997, after a championship-level High School and College basketball career. It came after a record-setting career in the broadcast radio and television equipment manufacturers industry.

The simple questions I asked were: “What brings you the most joy and fulfillment in your life? What do you want your mark on the world to be? What things have you been blessed with and how do you pass these blessings on to future generations that they too may find their “most-positive-purposeful way?”

The answers to these questions were separated into two categories. First, what I had to do to earn a living and support myself and, secondly, what can and should I do that will fill me and my soul with the most joy? We all face this quandary.

During our championship season of coaching in 1989 at Chief Sealth High School in Seattle, Washington, I was able to be a part of helping many young men become champions both on and off the court. The same as someone else had done for me years before by my seven role model coaches.

That success opened up an inner door within me that had been sealed in a self-preservation-driven attempt to move past a painful childhood littered with disappoint-mental debris. Those revelations became my writings and spoken word poetry, a kind of “therapy’ that gave me comfort and purpose.

It became my choice in this life to use my voice. To rejoice. Writing for the New Journal & Guide allowed me to reach a mature, thirty-year-old (and above) audience.

My V1ZUAL1ZE youth development coaching work reached the six to twenty year-old-crowd and the spoken word poetry circles reached the twenty to thirty-year old population with overlapped at both ends of the age ranges.

My calling: Delivering three different platforms and formats, enabling simultaneous personal observation, reflection, spiritual detection and empowerment information dissemination.

Each of the three platforms had rough beginnings as I strove to change the focus of my aperture from “about Me,” to “about We.” When I was young, I played with games and toys but as I matured, I gave up those childhood games and I toyed no more. I began addressing and redressing matters of importance that affect all of us: racism, sexism, classism and religious persecution. The more I worked towards those ideals, the more complete I became.

In life, crossroads can become self-imposed crosshairs if we are not careful and thoughtful. Self-awareness is not only being aware of one’s self, it is also becoming aware of manifested selflessness, including the true power to help transform the previously unfathomable and unconceivable into their tangible realities. In these manifestations of our highest calling lies our glory. That is the legacy and history of our life’s story.

My story is not unique. It is an old cautionary tale of not being consumed by consumerism or capitalism strictly for personal profitability and gain.

The song, “Satisfied Mind” asks, “How many times have you heard someone say, if I had his money I’d do things my way. How little they know, it’s so hard to find, one rich man in a hundred, with a satisfied mind.” I’m richer by far with a satisfied mind. My joy comes from those to whom I am kind. My personal conclusion is that my most joyful legacy comes from those to whom I’ve been of service to.

That is our rarest find and, in the end, promotes the most satisfied mind. Look at Prince’s song lyric: “Did you take more than you gave?” Our legacy then is not really about us; it is about how many others we’ve helped to become the owners and drivers of their own (life) bus.

Ballet Legend and Pioneer Dies at 84

Mitchell, who danced with the New York City Ballet from 1956-1968 and founded the groundbreaking and world renown Dance Theater of Harlem died Wednesday of heart failure. Jennifer Dunning of The New York Times writes: “Mr. Mitchell, the first black ballet dancer to achieve international stardom, was one of the most popular dancers with New York City Ballet, where he danced from 1956 to 1968 and displayed a dazzling presence, superlative artistry and powerful sense of self.

That charisma served him well as the director of Dance Theater of Harlem, the nation’s first major black classical company, as it navigated its way through severe financial problems in recent decades and complex aesthetic questions about the relationship of black contemporary dancers to an 18th-century European art form.”

Social media tributes have been pouring in for the game changer.

Mitchell attended the School of American Ballet in New York City, eventually joining the City Ballet where he would study with world famous dancer George Balanchine.

Mitchell performed with acclaimed dancer Diana Adams in what would be a groundbreaking performance of Agon Pas de Deux, breaking racial barriers in ballet. Mitchell performed with City Ballet in “A Midsummer Night’s Dream,” for which he is greatly remembered. Mitchell also performed in Balanchine’s “Requiem Canticles,” which was a tribute to Dr. Martin Luther King Jr. Following his assassination in 1968. It was this critically-acclaimed performance that inspired him to co-found the Dance Theater of Harlem with mentor Karel Shook in 1969, proving to the world that ballet is for everyone.

“When the sexual assault happened, I was a young woman brimming with confidence and looking forward to a future bright with possibilities,” she wrote in her five-page statement. “Now, almost 15 years later, I’m a middle-aged woman who’s been stuck in a holding pattern for most of her adult life, unable to heal fully or to move forward.”

She also wrote of Cosby: “We may never know the full extent of his double life as a sexual predator, but his decades-long reign of terror as a serial rapist is over.”

The AP does not typically identify people who say they are victims of sexual assault unless they come forward publicly, which Constand and other accusers have done.

Constand went to police a year after waking up in a

fog at Cosby’s gated estate, her clothes askew, only to have the district attorney pass on the case.

Another district attorney reopened the file a decade later and charged the TV star after stand-up comic Hannibal Buress’ riff about Cosby being a rapist prompted more accusers to come forward and after a federal judge, acting on a request from The Associated Press, unsealed some of Cosby’s startling, decade-old testimony in Constand’s related civil suit.

In his testimony, Cosby described sexual encounters with a string of actresses, models and other young women and talked about obtaining quaaludes to give to those he wanted to sleep with.

Cosby’s first trial in 2017 ended with a hung jury. He was convicted at a retrial that opened months after the #MeToo movement had taken down such figures as Hollywood studio boss Harvey Weinstein, NBC’s Matt Lauer, actor Kevin Spacey and Sen. Al Franken.

Constand said Cosby gave her what she thought were herbal pills to ease stress, then penetrated her with his fingers as she lay immobilized on a couch. Cosby claimed the encounter was consensual, and his lawyers branded her a “con artist” who framed the comedian to get a big payday — a $3.4 million settlement she received over a decade ago.

Five other accusers took the stand at the trial as part of an effort by prosecutors to portray him as a predator.

Cosby, whose estimated fortune once topped $400 million, broke barriers in the 1960s as the first black actor to star in a network show, “I Spy.” He went on to superstardom as wise and understanding Dr. Cliff Huxtable on “The Cosby Show,” a sitcom that showed America a new kind of black TV family: a warm and loving household led by two professionals, one a lawyer, the other a doctor.

He also found success with his Saturday morning cartoon “Fat Albert,” appeared in commercials for Jello-O pudding and became a public moralist, lecturing the black community about young people stealing things and wearing baggy pants. He won a Presidential Medal of Freedom and countless Emmys, Golden Globes and Grammy awards.

As the allegations mounted, his career all but collapsed, “Cosby Show” reruns were taken off the air, and one college after another stripped him of his honorary degrees.

Features Pulitzer Prize-Winning Journalist Coming to Bakersfield to Discuss Immigration and Journalism

South Kern Sol Pulitzer Prize-winning journalist Sonia Nazario is coming to Bakersfield next month to discuss her experi-

ences reporting on immigration and journalism.

Nazario, who is currently an opinion writer with the New York Times, won the 2003 Pulitzer Prize in Feature Writing for her six-part series “Enrique’s Journey,” which follows a Honduran boy immigrating to the United States, searching for his mother eleven years after she was forced to leave her family to find work in the U.S., according to the event page.

“Braving unimaginable peril, often clinging to the sides and tops of freight trains, Enrique travels through hostile worlds full of thugs, bandits, and corrupt cops,” says the event page. “However, he pushes forward, relying on his wit, courage, hope, and the kindness of strangers.”

Throughout her career, Nazario has written stories that have covered other topics including hunger and drug addiction.

Joining Nazario is Joaquin Alvarado, founder of Studiotobe, an independent storytelling platform. Alvarado is also the former CEO of the Center for Investigative Reporting.

The free public forum, hosted by California Humanities, is presented in partnership with the Bakersfield College’s Distinguished Speaker Series.

The event begins at 7 p.m. Tuesday, Oct. 9 at the Levan Center at Bakersfield College, 1801 Panorama Drive. Those interested in attending the event should register at bakersfieldcollege.edu.

Burglars Cause $10K in Damage at Yasiel Puig’s Home LOS ANGELES (AP) – Burglars caused $10,000 worth of damage to Los Angeles Dodgers star Yasiel Puig's home while attempting to steal a safe.

According to the Los Angeles Police Department, the suspects broke into Puig's San Fernando Valley home Tuesday night. They ransacked the residence, found a safe in the second-floor master bedroom, and dragged it downstairs to the front door.

Police said Thursday that the suspects then fled, leaving the safe in the entry way. An inventory is being conducted to determine what else was taken. Puig was at Dodger Stadium for a game on Tuesday.

“I (did) not sleep too much yesterday,” Puig said Wednesday, without offering details about the latest incident.

Police are seeking the public's help in identifying three suspects, including the driver of a black four-door Toyota vehicle with paper license plates.

Police say the same suspects are believed to have been involved in another burglary attempt at Puig's home on Aug. 30.

Previous break-ins at Puig's residences occurred in March 2017 and during Game 7 of last year's World Series.

Trial Moved from Courthouse with Confederate Monument

By KEVIN McGILL Associated Press NEW ORLEANS (AP) – A legal argument has been revived in Louisiana over whether a black defendant can get a fair trial in a courthouse where a Confederate monument is displayed.

Niles Haymer, a lawyer for defendant Ronnie Anderson, says the answer is no. He released copies Tuesday of his new motion to have Anderson's case moved out of state court in the city of Clinton, where a Confederate monument stands outside the East Feliciana Parish Courthouse.

A judge rejected a similar motion in August, saying Haymer filed too late.

But that same judge also threw out a serious firearms charge against Anderson. District Attorney Sam D'Aquilla has now filed a new felony charge against Anderson, involving illegal possession of a stolen firearm.

That gives Haymer an opportunity to renew his argument that the 30-foot-high (9-meter-high) monument _ a soldier on a pedestal erected in 1909 during the Jim Crow era _ signals that a black defendant cannot get a fair trial in East Feliciana Parish, which is about 30 miles (48 kilometers) north of Baton Rouge.

“Defendant contends that this Confederate Monument is not just memorializing the Confederacy but revering the Confederacy and what it stood for, right in front of the very place that African Americans go to seek fairness

and impartiality in the court system,” his motion reads.

D’Aquilla confirmed in an email that he has filed the new felony charge. Asked to comment on Haymer's new motion, he said he has commented in the past and his position hasn't changed. Last month, he said it is “ridiculous” to think a statue would affect the fairness of Anderson's trial. He said he doesn't have an opinion on the statue, but regardless of whether it's there the people inside strive for colorblind justice.

A database compiled by the Southern Poverty Law Center lists 11 other Confederate monuments at Louisiana courthouses. In northwest Louisiana's Caddo Parish, the governing body has voted to remove a Confederate monument from courthouse grounds. A lawsuit seeking to prevent removal is pending at a federal appeals court in New Orleans.

Confederate flags and monuments have come under renewed scrutiny following the 2015 shooting by Dylann Roof of nine black churchgoers in South Carolina and the 2017 deadly white nationalist rally in Charlottesville, Virginia.

Supporters say the statues are a part of history honoring their ancestors; detractors say they, in effect, honor slavery and in many cases were erected during the Jim Crow era to intimidate black people and bolster white supremacy.

And retirement isn’t short, either – you could spend two or three decades as a retiree. Taken together, these factors highlight the need to identify as many sources of retirement income as possible – and one of these sources might be an annuity.

A fixed annuity is an insurance product that allows you to make a lump-sum investment and can provide insured payments to you for a designated number of years, or for life. A fixed annuity guarantees a rate of interest for a stated period that will be unaffected by market fluctuations. Your principal investment and the specified interest rate are guaranteed based on the claims-paying ability of the issuing company.

A fixed annuity offers some key benefits, including the following: • No contribution limit – No IRS contribution limits apply to non-qualified annuities – that is, annuities held outside a tax-advantaged retirement plan, such as a defined benefit pension plan, Section 403(b) plan (TSA) or an IRA. This can be especially valuable if you are already close to retirement age and think you might be short on savings.

• Tax deferred accumulation – The interest you earn is tax deferred and will compound annually, meaning your money may accumulate faster than it would if it were placed in a taxable investment. Earnings will be taxed at your ordinary income rate once you start taking withdrawals, and withdrawals prior to age 59-1/2 may be subject to a 10% federal tax penalty. (You will want to consult with your tax advisor before withdrawing from your annuity.)

• Income for life – You can take your annuity payout as a lump sum or choose to receive payments for a set number of years, or for the rest of your life. Your income amount will be determined by the value in your contract and your life expectancy.

• Death benefit – If your annuity is still in the “accumulation” phase at the time of your death (meaning you haven’t yet begun collecting payments), it might provide a death benefit to the beneficiary you’ve named. Typically, this lump sum will be the greater of your account balance or the total of all premiums paid, although some annuities provide additional options. Be aware, though, that the death benefit may be taxable.

As is the case with all investments, a fixed annuity does have some caveats. Most important, an annuity is a longterm investment – if you pull money out within the first several years after your purchase, you likely will face some prohibitive surrender charges. These charges decline each year, typically reaching zero after seven years. Such withdrawals also may be subject to a market value adjustment.

One more thing to keep in mind: Different annuities come with different fees, and the higher the fee, the lower your “real” return will be. Consequently, you will want to compare fees before investing.

By SUDHIN THANAWALA Associated Press FRESNO, Calif. (AP) – Doctors, environmental groups and California officials will weigh in on the Trump administration's proposal to roll back car-mileage standards at what could be a raucous hearing in a region with some of the nation's worst air pollution.

The daylong session in Fresno on Monday is the first of three events by the U.S. Environmental Protection Agency and National Highway Traffic Safety Administration to gather public comment on the mileage plan.

The proposal announced in August would freeze U.S. mileage standards at levels mandated by the Obama administration for 2020 instead of continuing to rise to 36 miles (58 kilometers) per gallon (3.8 liters) by 2025, 10 miles (16 kilometers) per gallon (3.8 liters) higher than the current requirement.

Administration officials say waiving the tougher fuel efficiency requirements would make vehicles more affordable, which would get safer vehicles into consumers' hands more quickly.

Opponents say it would undercut efforts to reduce unhealthy tailpipe emissions that are a significant contributor to climate change. Environmentalists protested outside the hall where the hearing will take place, hoisting signs that read “Clean cars (equals) Clean air” and “Clean cars now.”

Paul Gipe, 67, and his wife Nancy Nies, 69, drove from the city of Bakersfield to join the demonstration against the rollback.

“It's a step backward and it's a statement that air pollution is acceptable. Damn the people, full speed ahead,” said Gipe, who writes about renewable energy on his web site.

An avid bicyclist, Gipe said there are days he can't ride because the air quality is so bad in his hometown.

“This is existential for California,” Becerra said. “Failure is not an option for us.” The hearing is taking place in the San Joaquin Valley, the country’s most productive agricultural region but an area that is plagued by sooty air in part because of its bowl-shaped geography. The Sierra Nevada and two other mountain ranges wall in the 250-milelong (400-kilometer-long) valley.

The air pollution there is blamed for hundreds of deaths each year.

The Obama administration had planned to keep toughening fuel requirements through 2026, saying the stricter standards would save lives.

Trump administration officials argued they would raise the price of vehicles by an average of more than $2,000, preventing many people from buying newer, safer and cleaner vehicles. Transportation experts have challenged those arguments.

Smothered Wet Burrito in Red Sauce I like a burrito that is loaded with flavor and dripping with the warmth of a red or green sauce, but what I like most of all is that you can choose whatever type of meat or cheese you like this is your burrito. Go ahead and make it just the way you like. Now let’s get started.

What I use: -Your choice of meat, cheese, red, or green sauce. (I used Carne Asada) -Onions, garlic, cilantro, guacamole, sour cream or mexican creama.

-Seasonings: salt, garlic and onion powder, black pepper, chili powder, and cumin.

-Beans: (I used pinto beans and cooked according to directions, however, you can use caned beans refried or whole. (pinto or black preferably) -Rice: (I used one cup but for three people) for added flavor and color I use the chicken & tomato bouillon mixed with one teaspoon of cumin.

-Tortillas: (size depends on how large or small you want your burrito). Of course I used the biggest ones.

-Preheat the oven to 400 degrees F (200 C).

Brown or grill your choice of meat along with the onion in a skillet over medium high heat. (best when using a spatula) Cook and stir until evenly browned and onion is translucent.

(best with a spatula) Drain grease and season with the garlic, cumin, salt, and pepper. (hint: for added flavor try adding a small drop of lime juice).

In a small saucepan, combine one can of enchilada sauce and cilantro. Whisk together until mixed well, and cook over medium heat until heated through.

Place a burrito shell on a clean surface and place a desired amount of beans, rice, and meat mixture into the center of your shell. If you like you can also add guacamole, and cheese at this time.

Now fold in the left and right side of the tortilla over the filling, like an envelope, and place the seam down in greased oven safe dish. Repeat if needed: Once desired burritos has been rolled. Pour the entire pan of sauce and cilantro over the tops of the burritos. Cover with cheese.

Bake in the preheated oven for 20 to 25 minutes until the burritos are heated through and the cheese is melted.

Top with creama or sour cream, lettuce, tomatoes and guacamole.

Remember this is your burrito make it the way you like and anything can be added or omitted. Either way you choose to make it, it’s going to be delicious!

By JANELL GORE South Kern Sol While Kern High School District has made strides in driving down suspension and expulsion rates, more students say they are skipping days of school because they feel unsafe on campus, according to data released by the district during a community forum hosted at West High School Thursday.

Overall, 10 percent of the district’s students surveyed said this year they skipped school at least once in the last 60 days because they felt unsafe at school or on their way home from school. It represents a three percent increase from the 2016-2017 school year.

That data comes months after Bakersfield High School teachers complained to board members in public meetings that fights had become a common occurrence on campus, something they attributed to a restructuring of disciplinary policies following a settlement the district entered into with California Rural Legal Assistance.

“Before, we were probably expelling kids too quick and removing them too quick and maybe for too long,” KHSD Board Trustee Mike Williams told The Bakersfield Californian in April. “Now we’ve swung the pendulum back so far that we’ve got kids who shouldn’t be here.”

But CRLA attorney Rebecca Buckley-Stein said there’s no way to qualify why students answered the way they did in the climate survey.

Instead, she focused on the disparities among races.

Students across all ethnicities reported feeling unsafe at school within a 60-day period, however the highest increase over the 2016-2017 school year came from Hispanic and white students. Both had six percent increases over last year.

A higher percentage of African American students also reported that there’s a lot of tension between “cultures, races and ethnicities” at local campuses. Roughly 30 percent of all African American students surveyed say there’s tension, compared to 19 percent among Hispanic students and 22 percent among white students.

“There is something going on and it seems linked to race,” Buckley-Stein said.

Regardless, district officials said they need to improve

school climate to make kids feel safer, but touted progress decreasing suspensions and expulsions during the forum.

“We want to celebrate the staff for some of the work they’re doing with students, but we want to look at some issues that are trending in the wrong direction as well over the long haul,” said Brian Mendiburu, director of student behavior and supports for KHSD. The forum was legally mandated as part of the terms of a $670,000 settlement agreement the district entered into in 2017 after more than 20 plaintiffs accused KHSD of disproportionately suspending and expelling Latino and African American students.

The district has come a long way in driving down the rate of suspensions and expulsions since beginning to implement Positive Behavioral Interventions and Supports, a systems approach that stresses restorative justice over harsh disciplinary actions, district leaders said.

At the forum, KHSD leaders delved into data relating to expulsions, suspensions, involuntary and voluntary transfers and school climate.

The data shows the number of suspensions have dropped slightly from 9.6 percent in the 2016-17 school year to a projected 8.8 percent in 2017-18. African American students, however, continue to make up the majority of students suspensions at a projected 18.9 percent in 2017-18 — a significant drop from the 23.1 percent in 2015-16.

The number of students expelled increased from 26 in 2016-17 to a projected 29 in 2017-18. Hispanics continue to be expelled at a higher rate than others, with a total of 14 students expelled in 2017-18.

The total number of students suspended and expelled in the 2017-2018 school year will be published in the fall.

Involuntary transfer decreased from 102 in 2016-17 to 61 in 2017-18.

Faculty members said these results are expected this early in the process, and they anticipate seeing continual growth. John Eyler, the founder and CEO of Collaborative Learning Solutions said the approach takes about five to seven years to fully implement.
