Police Chiefs Take Issue with Senator’s Comment

We to Need Close the Achievement Gap Between White, Black and Brown Students

By Nate Davis CEO and Board of Directors Chairman, K12 Inc. Our nation’s graduation rate is at an all-time high. The national figure shows 84 percent of young people, overall, graduating from high school within four years after first entering the 9th grade, a trend that has been on a consistent upswing since the 2010-2011 school year.

Still, despite much progress with that indicator, major gaps still exist. And there is great concern that the graduation rate hype not only masks those gaps, but distracts us from what must be our ultimate goal: ensuring all students earn a high school diploma and are college and career ready.

Even as overall graduation rates improve, Black and Hispanic students continue to lag behind that curve. Graduation rates for African American students are 76.4 percentage points—8 percentage points behind the national average—and Latino students are at 79.3 percent. Native American students fare even worse at just 72 percent graduation. Meanwhile, White and Asian students are anywhere from four to six points higher than the national average.

None of us can reasonably expect the closure of inequality gaps, if we’re simply satisfied with overall graduation rates while resigned to stubborn achievement gaps. Yet, it seems as if we’re in a phase whereby these disparities are being treated as normal—“the way it is”—as opposed to addressing a larger parity problem.

We have to ask ourselves: are we having a responsible and responsive conversation about high school graduation?

The most recent “Building a Grad Nation” report from America’s Promise Alliance says that, “Twenty-three states have Black-White graduation rate gaps larger than the national average, including five states—Wisconsin, Nevada, Minnesota, New York, and Ohio—where the gap is more than 20 percentage points…Twenty-four states have Hispanic/White graduation rate gaps that exceed the national average, and in two states – Minnesota and New York—the gap is more than 20 percentage points.”

The persistent normalcy of lower achievement among certain disadvantaged student populations is deeply troubling. Closing those gaps should be as important—if not more—than simply raising overall graduation rates.

At the same time, graduation rates can be used to unfairly malign schools that are serving underprivileged youth and, in fact, helping at-risk students earn a high school diploma. Alternative schools are singled out for having four-year cohort graduation rates that are generally lower than the national average, but left out of the conversation is how these schools are intentionally designed to serve credit-deficient transfer students and former dropouts at risk of never earning a diploma at all.

Measuring how well schools are graduating students is important, but it should be done right, and must not create disincentives for schools to serve credit-deficient students or dropouts looking for a second chance. After all, what is more important for these students: graduating or graduating “on-time”? It’s why graduation rate calculations should be reformed altogether so

Hospital Fires Employee Over Racial Slur Video FLOWOOD, Miss. (AP) – A Mississippi hospital says an employee recorded on video using a slur offensive to African-Americans has been fired.

WJTV-TV reports the video was taken Saturday at a Flowood doughnut shop. Donut Palace employee Keaundrea Wardlaw filmed the encounter with Kyle Thomas using a cellphone.

Wardlaw says Thomas was upset about the service.

She says she didn’t want to get him fired but doesn’t feel he should’ve used the slur.

Mississippi Baptist Medical Center says in a statement the off-duty employee’s language and behavior don’t represent the organization’s values. The hospital says Thomas worked in radiology.

Wardlaw says Thomas returned to the shop and apologized to her boss for causing a disruption. She says she would accept an apology if he’d offered her one too.

WJTV-TV says it could not immediately reach Thomas for comment.

schools are held accountable for students’ annual progress toward graduation every year, not just in the fourth year of high school.

Sadly, the drive to meet on-time graduation has led to recent cases of manipulation and fraud, which, of course, is wrong, but it also misses the primary purposes of high school altogether: preparing students for higher education, careers, and the workforce. The linkage between these goals—graduation and college and career readiness—is crucial for broader national competitiveness. Graduating students is meaningless if they are not prepared.

The number of high school students heading into remedial courses in their first year of college are staggering, and the gaps between varying demographics are even more troubling. Nearly 60 percent of African American students are forced to enroll in non-credit remedial classes in college, according to the Center for American Progress, compared to 45 percent of Latino students and 35 percent of White students. This means that Black, firstyear college students, already burdened the most by rising college costs and loan debt, are taking on a greater share of the $1.3 bil-

lion wasted on non-credit remedial courses.

There is no one silver bullet that will solve our nation’s graduation problem, but we can start by realigning graduation standards to the expectations of colleges, career training programs, industries and jobs, and developing competency-based, personalized learning paths for students unconstrained by four-year cohorts. And we must finally address funding gaps that exist for too many alternative schools working to eliminate achievement gaps between advantaged and disadvantaged students.

Addressing this complex challenge requires a mix of other solutions, too; improved learning models and instruction, greater support for our teachers, innovative technology, and increased services to disenfranchised students groups are just a few that we should be working on. But none of this can happen without educators, policymakers and business leaders willing to engage in honest and constructive conversations, and then pledging to act.

A rising graduation rate is worth celebrating, but let’s not become complacent.

Officials Seeking to End Suit Over Creating Larger Black Majority

JACKSON, Miss. (AP) – Three top Mississippi officials are asking a federal judge to dismiss a lawsuit that seeks to create a larger black majority in one of the 52 state Senate districts. It says District 22 is 51 percent black but “lacks real electoral opportunity” for African-Americans. The lawsuit says District 22 could be redrawn to have about a 60 percent black voting age population, and “one or two adjacent districts” would have to be changed. Mississippi’s population is nearly 38 percent black. The lawsuit says the state’s voting age population is at least 35 percent black, while African-Americans hold 25 percent of seats in the state Senate. That is 13 of the 52 seats.

Bail Reform This Year? Audit Shows Ferguson Proposed Legislation Raises Fears of Improves a Little Bit Computer-Based Bail System

By Manny Otiko California Black Media Progressives and some black activists have long complained about America’s bail system, which treats people with means differently from low-income people. Under the current cash bail system, people charged with a crime can sit in jail for months, and sometimes years, without seeing a judge simply because they can’t afford bail.

A good example of this situation is seen in the story of Kalief Browder, a New York teen, who was arrested on charges of petty theft. Because his family couldn’t afford his $3,000 bail, he languished in Rikers Island for three years, before a judge dropped the charges. Two years after his release, Browder committed suicide. His family said his experience in jail, where he had to fight to survive and was placed in solitary confinement, killed him.

The other side of the American justice system is seen in the case of Cameron Terrell, a white teenager from Palos Verdes Estates, who was behind the wheel in a drive-by shooting. His parents put up $500,000 in cash to secure a $5 million bond. Terrell was acquitted in July. Two black males, who were passengers in the car, are still facing life sentences.

However, a proposed bill suggests taking the setting of bail amounts out of human hands and making the criminal justice system fairer. According to a section of Senate Bill 10 “The California Money Bail Reform Act of 2017,” the new legislation would require the use of a “pretrial risk assessment tool.”

Critics of the bill interpret this to mean using a computer algorithm, that takes into consideration the suspects’ age, location, and criminal record, to set bail. This conjures up images of the automated system used in the Tom Cruise movie “Minority Report.”

More than 100 civil rights and civil liberties organizations have complained about the potential use of an algorithm-based system to evaluate bail.

“Last week, the national ACLU signed onto a statement along with other civil rights, digital justice and community-based organizations, which included a call for important policy reforms

to accompany any use of pretrial risk assessment tools.

“It’s far overdue for government jurisdictions to end the money bail systems that have kept poor people and people of color locked up while awaiting their day in court. Many jurisdictions, however, are turning to pretrial risk assessments, placing a technological barrier between people and their freedom. Algorithms cannot undo the racial bias that exists in the criminal legal system. These and other high tech tools will always disadvantage communities of color and threaten to replace mass incarceration with digital prisons. We join the chorus of civil and human rights organizations in calling on jurisdictions to reconsider their use of pretrial risk assessments and adopt solutions that actually set people free.” Said Myaisha Hayes, criminal justice & tech organizer for Center for Media Justice.

One of the fears about SB 10 is its reliance on technology.

Technology is far from perfect, as shown in Russia’s use of hacked emails to tamper with the 2016 elections. And according to the ACLU of Northern California, Amazon’s face recognition technology, which is currently used by some police departments, has shown signs of bias. White faces were found to generate less false matches than black faces.

According to Jaivon Grant, writing in the Sacramento Observer, this may encourage opposition to SB 10.

“The local and national civil rights groups have long sought to end the money bail system, and SB 10 is the closest they have come to doing so to date. However, Sen. Hertzberg and Assemblymember Bonta may have a very difficult time persuading enough of their fellow Democrat colleagues to support an algorithm-based bail program in the face of such compelling opposition by a powerful coalition of civil rights organizations opposing it,” he said.

Leaders of the assembly and senate were both reported saying this was a priority before the Aug 31 end of this year’s legislative session.

By JIM SALTER Associated Press ST. LOUIS (AP) – A new audit found that Ferguson, Missouri, has made significant progress in addressing problems in its municipal court, which drew scrutiny for its treatment of poor and minority people after the fatal police shooting of Michael Brown in 2014.

Democratic Missouri Auditor Nicole Galloway's report released Monday was a follow-up to an April 2017 audit that found the St. Louis suburb's court system in disarray. The 2017 audit found disorganized files, boxes moldy from a water leak, and cited the assessment of $26,000 in illegal fees and $1,400 in missing funds.

The new audit said court personnel have implemented new procedures aimed at preventing and detecting loss or theft, though the $1,400 is still missing.

“My last audit discovered careless and disorganized records management that led to serious questions as to the ability of the court to effectively serve citizens,” Galloway said in a news release.

“While there is still work that needs to be done, efforts are underway to address the audit findings and implement better processes moving forward.”

The court has new procedures to ensure independent reviews of records, financial activity and modifications to transactions, the audit said. It also noted that the court now has a system to better document reviews of closed cases and dismissed tickets.

An email message seeking comment from Ferguson City Manager De’Carlon Seewood was not immediately returned.

Last year's audit cited $26,000 in illegal fees such as a $15 “letter fee” and a $50 “warrant recall fee.” The court also charged a $75 “non-prosecution fee” for those who made an initial report but eventually declined to seek charges.

Brown was 18, black and unarmed, when he was fatally shot by white officer Darren Wilson on Aug. 9, 2014, following a confrontation in a neighborhood street. Wilson was eventually cleared of wrongdoing and resigned in November 2014.

The shooting resulted in sometimes violent protests and heightened scrutiny in the St. Louis suburb. A review by the U.S. Department of Justice found biased treatment of blacks by Ferguson's police and accused the municipal court of making money on the backs of poor and minority residents. A settlement with the Justice Department requires reforms under supervision of a monitor team.

Charlottesville: A Year Later

(AP) – The mother of a woman killed when a car plowed into a crowd of counterprotesters at a white nationalist rally last summer said Sunday there’s much healing to do a year after the violence in Charlottesville, Virginia.

Heather Heyer’s mother, Susan Bro, laid flowers at a makeshift memorial at the site of the attack in downtown Charlottesville. With a crowd gathered around her, she thanked them for coming to remember her daughter but also acknowledged the dozens of others injured and the two state troopers killed when a helicopter crashed that day.

“There’s so much healing to do,” Bro said. “We have a huge racial problem in our city and in our country. We have got to fix this or we’ll be right back here in no time.”

The vigil was one in a series of largely peaceful community events held in Charlottesville over the weekend to mark the oneyear anniversary of the rally, one of the largest gatherings of white nationalists and other far-right extremists in a decade.

Some 115 miles (185 kilometers) away in Washington, Jason Kessler, the principal organizer of last year’s “Unite the Right” event, led what he called a white civil rights rally Sunday afternoon in Lafayette Square in front of the White House.

President Donald Trump wasn’t home - he has been at his golf club in New Jersey for more than a week on a working vacation.

Kessler said in his permit application that he expected 100

to 400 people to participate in his event, though the number appeared it might be far lower. Just before 4 p.m., a contingent of about 30 white nationalists began marching through the streets.

Counterprotesters assembled ahead of the rally’s scheduled start vastly outnumbered Kessler’s crowd. By midafternoon, more than 1,000 people had already gathered in Freedom Plaza, also near the White House, to oppose Kessler’s demonstration and they too planned to march to Lafayette Square.

Makia Green, who represents the Washington branch of Black Lives Matter, told Sunday’s crowd that: “We know from experience that ignoring white nationalism doesn’t work.”

Earlier this month, Facebook stunned and angered counterprotest organizers when it disabled their Washington event’s page, saying it and others had been created by “bad actors” misusing the social media platform. The company said at the time that the page may be linked to an account created by Russia’s Internet Research Agency - a so-called troll farm that has sown discord in the U.S. but counterprotesters said it was an authentic event they worked hard to organize.

Government and police officials in Washington have expressed confidence the city can manage the events without violence; the mayor and police chief have promised a massive security mobilization to keep protesters and counterprotesters apart.

Earlier in the day in Charlottesville, more than 200 people gathered in a park to protest racism and mark the anniversary. The

group sang songs and listened to speakers, among them Courtney Commander, a friend of Heyer’s who was with her when she was killed.

“She is with me today, too,” Commander said.

Last year on Aug. 12, hundreds of white nationalists _ including neo-Nazis, skinheads and Ku Klux Klan members _ descended on Charlottesville in part to protest the city’s decision decided to remove a monument to Confederate Gen. Robert E. Lee from a park.

Fighting broke out between attendees and counterprotesters. Authorities eventually forced the crowd to disperse, but a car later barreled into the crowd of peaceful counterprotesters.

A state police helicopter later crashed, killing Lt. Jay Cullen and Trooper-Pilot Berke Bates.

Law enforcement officials faced blistering criticism in the aftermath of last year’s rally for what was perceived as a passive response to the violence that unfolded. A review by a former U.S. attorney found a lack of coordination between state and city police and an operational plan that elevated officer safety over public safety.

The anniversary weekend was marked by a much heavier police presence, which also drew criticism from some activists.

At one point Sunday, demonstrators marched through Charlottesville, chanting, “Cops and Klan go hand in hand,” and “Will you protect us?”

Child Honored for Saving Toddler from Pool CARRBORO, N.C. (AP) – A 10-year-old boy has been honored by North Carolina authorities for saving a 15-monthold girl from an apartment pool.

The News & Observer reports Joseph Ray “saw the baby sinking to the bottom of the pool” after she tipped out of a float.

He says he jumped in and carried her out. The Carrboro Police Department awarded Ray with its Lifesaver Award on Wednesday. The girl was taken to a hospital for observation.

Carrboro Police Officer Steven Dixon responded to the 911 call about the incident. Dixon says that despite all the adults around, Ray was the only one who recognized the baby was in danger. Ray’s mom, Tina Ongoro, says Ray didn’t know

the baby was a neighbor at the time, but now the two families keep in touch.

Omarosa Secretly Taped Her Firing

By JILL COLVIN Associated Press BRIDGEWATER, N.J. (AP) – Former presidential adviser Omarosa Manigault Newman said Sunday she secretly recorded conversations she had in the White House, including her firing by chief of staff John Kelly in the high-security Situation Room.

It was a highly unusual admission, which immediately drew fire from allies of the president and national security experts.

Parts of her conversation with Kelly were played on the air when she appeared on NBC’s “Meet the Press” to promote her new book, “Unhinged,” which will be released next week. The Associated Press independently listened to the recording of the conversation between Manigault Newman and Kelly, in which Kelly is heard referring to potential “difficulty” in Manigault Newman’s future “relative to your reputation.” She said she interpreted his comments as a threat.

In her book, Manigault Newman paints a damning picture of President Donald Trump, including claiming without evidence that tapes exist of him using the N-word as he filmed his “The Apprentice” reality series, on which she co-starred.

Manigault Newman said in the book that she had not personally heard the recording. But she told Chuck Todd on Sunday that, after the book had closed, she was able to hear a recording of Trump during a trip to Los Angeles.

“I heard his voice as clear as you and I are sitting here,” she said on the show.

But the other recording she discussed Sunday could prove equally explosive.

“Who in their right mind thinks it’s appropriate to secretly record the White House chief of staff in the Situation Room?” tweeted Ronna McDaniel, chair of the Republican National Committee.

In the recording, which Manigault Newman quotes extensively in the book, Kelly can be heard saying she can look at her time at the White House as a year of “service to the nation” and referring to potential “difficulty in the future relative to your reputation.”

Manigault Newman said she viewed the comment as a “threat” and defended her decision to covertly record it and other White House conversations, describing it as a form of protection.

“If I didn’t have these recordings, no one in America would believe me,” she said.

The Situation Room is a Sensitive Compartmented Infor-

mation Facility, or SCIF, where the nation’s most consequential foreign policy decisions are made, and staff are not permitted to bring in cell phones or other recording devices.

“I’ve never heard of a more serious breach of protocol,” said Ned Price, who served as spokesman of the National Security Council in the Obama administration. “Not only is it not typical, something like this is unprecedented.”

Price said there is no one checking staffers for devices at the door, but there is a sign outside the room making clear that electronic devices are prohibited.

“The Situation Room is the inner-most sanctum of a secure campus,” he said, describing the breach as part of a culture of disregarding security protocols in the Trump White House. He also questioning why Kelly would ever choose to have such a meeting there.

The White House did not immediately respond to questions about the tape, but has tried to discredit the book. White House press secretary Sarah Huckabee Sanders called it “riddled with lies and false accusations” and Trump on Saturday labeled Manigault Newman a “lowlife.”

White House counselor Kellyanne Conway also questioned Manigault Newman’s credibility in an interview Sunday on ABC’s “This Week.”

“The first time I ever heard Omarosa suggest those awful things about this president are in this book,” she said, noting Manigault Newman “is somebody who gave a glowing appraisal of Donald Trump the businessman, the star of the ‘The Apprentice,’ the candidate and, indeed, the president of the United States.”

Conway said that, in her more than two years working with Trump, she has never heard him use a racial slur about anyone.

Manigault Newman had indeed been a staunch defender of the president for years, including pushing back, as the highest-profile African-American in the White House, on accusations that he was racist.

But Manigault Newman now says she was “used” by Trump for years, calling him a “con” who “has been masquerading as someone who is actually open to engaging with diverse communities” and is “truly a racist.”

“I was complicit with this White House deceiving this nation,” she said. “I had a blind spot where it came to Donald Trump.”

NOTICE IS HEREBY GIVEN that the City of Ridgecrest invites and will receive sealed bids at the office of the City Clerk of the City of Ridgecrest, Owner of the work, located at 100 West California Avenue, Ridgecrest, California 93555, until the hour of 4:00 p.m. on August 21, 2018.

A pre-bid meeting is scheduled for 10:00 AM on August 2, 2018 at 100 W. California Avenue, RIDGECREST, California. This meeting is to inform bidders of project requirements and subcontractors of subcontracting and material supply opportunities. Bidders’ attendance at this meeting is mandatory.

DESCRIPTION OF WORK: The work involves the tenant improvements for the proposed rehabilitation of an existing 5,720 SF Senior Center building. The protposed improvements include new flooring; replacement of restroom fixtures, partitions, and accessories with ADA compliant features; replacement of kitchen cabinets; rehabilitation of minor plumbing issues; replacement of an existing water heater; replacement of tee-bar tile panels; replacement of gypsum board ceiling in restrooms and kitchen; and miscellaneous repairs. All proposed improvements are funded through Community Development Block Grant (CDBG).

SITE OF WORK: The site of the work is located at 125 South Warner Street, Ridgecrest, CA 93555.

COMPLETION OF WORK: All work must be completed within twenty-five (25) working days after the commencement date stated in the Notice to Proceed.

LIQUIDATED DAMAGES: Liquidated damages of five hundred dollars ($500.00) per working day, as specified in the Special Conditions, shall be paid by the contractor to the City of Ridgecrest for each working day in excess of the time limit stated above that the project is not complete.

OPENING OF BIDS: The bids will be publicly opened and announced at 4:00 p.m. on August 21, 2018 the above mentioned office of the City Clerk.

OBTAINING CONTRACT DOCUMENTS: The contract documents are entitled “Ridgecrest Senior Center CDBG-Funded Tenant Improvement”. All contract documents, plans, and specifications must be obtained from the City’s Consultant, Willdan Engineering, 374 Poli Street, Suite 101, Ventura, CA 93001, (805) 653-6597. BID SECURITY: Each bid shall be accompanied by a certified or cashier’s check or bid bond in the amount of ten percent (10%) of the total bid price payable to the City of Ridgecrest as a guarantee that the bidder, if its bid is accepted, will promptly execute the contract.

BIDS TO REMAIN OPEN: The bidder shall guarantee the total bid price for a period of sixty (60) calendar days from the date of bid opening.

PREVAILING WAGE REQUIREMENTS: Pursuant to California Labor Code Sections 1770, 1773, 1773.1, 1773.6, and 1773.7, as amended, the applicable prevailing wages for this project have been determined. It shall be mandatory upon the contractor to whom the contract is awarded and upon any subcontractor under him to pay not less than the higher of the Federal and the State prevailing wage rates to all workers employed by them in the execution of the contract. The applicable Federal prevailing wage rates are those that are in effect ten (10) calendar days prior to bid opening; they are set forth on the U.S. Department of Labor website: http://www.wdol.gov/wdol/scafiles/davisbacon/ ca33.dvb but are not printed in the Specifications. Lower State wage rates for work classifications not specifically listed in the Federal wage decision are not acceptable. The applicable State prevailing wage rates are set forth on the California Department of Industrial Relations website: http://www.dir. ca.gov/DLSR/PWD but are not printed in the Specifications; these rates are subject to predetermined increases.

Department of Industrial Relations (DIR) Requirements SB 854: Contractors and all subcontractors must be registered with the DIR. Effective January 1, 2015, in order to be awarded and to perform work on public works projects, prime contractors and subcontractors must possess and maintain registration with the Department of Industrial Relations (DIR) at https://efiling.dir.ca.gov/PWCR. This is a separate requirement from the Contractors State License Board (CSLB) licensing requirement.

The U.S. Department of Transportation (DOT) provides a toll-free hotline service to report bid rigging, bidder collusion, or other fraudulent activities. The hotline is available Mondays through Fridays between 8:00 a.m. and 5:00 p.m. eastern time, at (800) 424-9071. The hotline is part of the DOT’s continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated confidentially, and caller anonymity will be respected.

Conflict of Interest: in the procurement of supplies, equipment, construction, and services by subrecipients, the conflict of interest provisions in 24 CFR 85.36, OMB Circular A-110, and 24 CFR 570.611 shall apply. No employee, officer, or agent of the sub-recipient shall participate in the selection, award, or administration of a contract supported by federal funds if a conflict of interest, real or apparent, would be involved.

Small Business Requirements: The City of Ridgecrest hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, small businesses will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. The bidder to whom the contract is awarded will be required to comply with the Small Business Affirmative Action Plan requirements as set forth in the special provisions.

Section 3 Requirements: The work to be done on this project is subject to the provisions of Section 3 of the Housing and Urban Development Act of 1968 (12 USC 1701u) which requires that employment and other economic opportunities generated by certain HUD financial assistance shall, to the greatest extent feasible, and consistent with existing Federal, State and local laws and regulations, be directed to low- and very low-income persons, particularly those who are recipients of government assistance for housing, and to business concerns which provide economic opportunities to low- and very lowincome persons. These requirements are explained in detail on 24 CFR 135. The pre-bid conference will include a workshop on Section 3 compliance.

RETAINAGE FROM PAYMENT: The contractor may elect to receive one hundred percent (100%) of payment due under the contract from time to time, without retention of any portion of the payment by the City of Ridgecrest, by depositing securities of equivalent value with the City in accordance with the provisions of Section 4590 of the Government Code. Such securities, if deposited by the contractor, shall be valued by the owner, whose decisions on valuation of the securities shall be final. Securities eligible for investment under this provision shall be limited to those listed in Section 16430 of the Government Code or Certificates of Deposit from Banks or Savings & Loan. In order to substitute securities the contractor shall enter into an agreement with the City of Ridgecrest entitled “Agreement Concerning Investment of Funds” as attached to the contract.

ADDRESS AND MARKING OF BID: The envelope enclosing the bid shall be sealed and addressed to the City Clerk, City of Ridgecrest, and delivered or mailed to Ridgecrest City Hall, 100 West California Avenue, Ridgecrest, California 93555. The envelope shall be plainly marked in the upper left-hand corner with the name and address of the bidder and shall bear the words “Bid for Ridgecrest Senior Center CDBG-Funded Tenant Improvement Project” bid opening at 4:00 p.m. on August 21, 2018. The certified or cashier’s check, money order, or bidder’s bond shall be enclosed in the same envelope with the bid.

CONTRACTOR LICENSE CLASSIFICATION: The project will require the prime contractor to be in possession of a valid, appropriate State of California Contractor’s License. Bids will only be accepted from contractors holding a General Engineering Class B. CRAZY RICH ASIANS Part of a Bigger Crusade

By LINDSEY BAHR AP Film Writer BEVERLY HILLS, Calif. (AP) _ Constance Wu had resigned herself to the fact that “Crazy Rich Asians” was not going to work out for her. She was under contract for her sitcom “Fresh Off the Boat”, both were filming in the fall, and that was that.

“Crazy Rich Asians” would be the first studio-made Asian-American movie in 25 years, and Wu, who has established herself as a crusader for Asian-American representation in Hollywood, would have to sit this historic moment out.

But then, feeling “kind of dramatic,” and thinking about the significance of the project to her and untold number of Asian-Americans who make it a point to tell her their stories because of her tweets and “Fresh Off the Boat,” Wu decided to give it one last shot and composed an email to director “Crazy Rich Asians” director Jon M. Chu. “I said, I know the dates don't work out and whoever you cast, I will be the first in line and I will be their No. 1 fan and supporter, but I did want to let you know that I would put 110 percent of my heart into this project and I know what to do with it and how to carry a movie and if you can just wait for me, I don't think you'll regret it,” Wu, 36, said. “I did NOT think this email would work. I did it more for me so that I felt that I had told my truth. But then he read it and said, “You guys, we've got to push the production.”

theater actress with a passion for musicals, Wu has been working toward a moment like this her whole life, and taking it very seriously. During the shoot, she wouldn't go out with her co-stars for karaoke nights or have a drink after a long day of work. She wanted to be clear of mind and she'd already promised her director that she was going to give it her all.

She knew how unlikely it was that she'd ever get an opportunity as an Asian-American woman to lead a studio movie.

“Even a terrific actress like Sandra Oh was always No. 2 or No. 3 in the movie, she was never No. 1 unless it was an independent movie,” said Wu, who is not shy about saying that she only wants to go out for roles where she is the No. 1 star. It's a drive that has made some uncomfortable.

“People are like, `Who do you think you are? And it's like, I guess I think I'm a talented actor and I guess I'm not a person who is going to let you make me feel small anymore,” she said.

But Wu isn't interested in making people feel comfortable at the expense of her truth, which is why at least part of her time is spent amplifying underrepresented voices on twitter, even knowing that it's affected her employment opportunities.

Wu once heard from a friend that her liberal boyfriend said he didn't like Wu’s politics.

“I'm like, ‘Does he not like my politics or does he not like that I have politics?’ And she asked him and he was like, “Oh I guess it's that,” Wu said.

Fame, she said, is silly in that regard. She thinks it's “dumb” that she has a bigger voice than other people, like journalists or academics who are more studied in discourse on race and intersectionality. But, she also realized that while she has this platform, she can at least do some good with it.

Henry Golding, who plays Nick, is in awe of Wu's fortitude.

“She's such a role model for so many people. She has a backbone, which a lot of people don't. She's not afraid of saying what's on her mind and really driving home what she thinks should be done, or what's not happening in the industry that should be happening,” said Golding. “She's going to go down as a real fighter and someone who can act the socks off anything. She is Rachel Chu.” As for what's next, Wu said she thinks she's going to have a lot of choices in the coming years.

“I'm very privileged and lucky and I'm at a point where I can sort of get to decide where I want to go with my career,” Wu said.

And first up on her wish-list? A musical.

Black Entrepreneur Finds Success with Minnesota Tech Firm ST. PAUL, Minn. (AP) _ The founder of a thriving Twin Cities startup company is providing guidance to other black tech entrepreneurs in overcoming a dysfunctional home life on the path to success.

Clarence Bethea founded Upsie, a technology company that sells warranties that undercut retailers’ prices.

Founded in 2016, Upsie now has more than 14,000 users, Minnesota Public Radio reported .

Bethea grew up in a dysfunctional home. His father abused his mother, and he had to overcome homelessness and drug dealing.

“It was a lot of work, but I met the right people at the right time who changed the trajectory of my life,’’ said Bethea, 37. “I received guidance and support from

them along the way.’’

He went to Bemidji State University in 2002 on a basketball scholarship but dropped out of college to pursue entrepreneurship.

Bethea said his acceptance into Techstars Retail, an international startup accelerator, played an important role in his success. The accelerator offerings funding and mentorship for a three-month period. Upsie was one of 10 startups selected in 2017.

With $192 million in ticket sales so far, the film is expected to take in $218 million over the four-day President’s Day weekend and an incredible $361 million worldwide. According to ComScore, global ticket sales were set to reach $387 million over the weekend.

According to Entertainment magazine, “Black Panther” is already the eighth-largest single-day gross for the film industry ever and the third-biggest opening for a superhero movie.

“Black Panther” scored a $75.8 million opening day.

“The Avengers” opened with $80 million and “Avengers: Age of Ultron” opened with $84 million. The film also became the highest-grossing title in history at 33 AMC Theaters across the country, according to a report in the Hollywood Reporter.

Cell Locks Failed During Brawl at Lerdo Pre-Trial Facility

BAKERSFIELD, Calif. (AP) _ Officials say cell locks failed during a brawl involving 120 prisoners at a central California jail that left four inmates injured last week.

Tyson Davis, the chief deputy who oversees the Lerdo Pre-Trial Facility, told KBAK-TV Wednesday that the locks are old and inmates have begun to tamper with them, with some success.

The Kern County Sheriff’s Office said several inmates became disruptive Feb. 6 and refused to comply with the night’s lockdown. The violence sent four inmates to hospitals and left housing units damaged.

The labor union representing the guards says low staffing also contributed to the problem.

The Lerdo lockup North of Bakersfield is being improved and expanded and a new facility is expected to begin housing inmates by May.\

SANTA BARBARA, Calif. (AP) _ Authorities say nobody was hurt when six freight train cars derailed near a Southern California mountain town.

The BNSF Railway Company says most of the train cars were empty and the others were carrying wine when they came off the tracks Saturday near Tehachapi east of Bakersfield.

The derailment briefly shut down some lanes on rural State Route 58 but the debris was cleared after several hours.

KBAK-TV says the cause is under investigation.

Woman Burned as Gas is Pumped into Garbage Can in Her Backseat

MOSES LAKE, Wash. (AP) _ Authorities say a Washington woman suffered severe burns after gasoline fumes ignited when gas was being pumped into a garbage can in a car’s backseat.

KOMO-TV reports the Grant County Sheriff’s Office says the woman, who was a passenger early Saturday morning at a Cascade Valley Grocery convenience store, was smoking a cigarette, which ignited the flames.

Deputies later found a large amount of marijuana in the car’s trunk.

A bystander took the woman to Samaritan Healthcare in Moses Lake.

The male driver who was pumping the gas ran away.

Black Entrepreneur Finds Success with Minnesota Tech Firm ST. PAUL, Minn. (AP) _ The founder of a thriving Twin Cities startup company is providing guidance to other black tech entrepreneurs in overcoming a dysfunctional home life on the path to success.

Clarence Bethea founded Upsie, a technology company that sells warranties that undercut retailers’ prices.

Founded in 2016, Upsie now has more than 14,000 users, Minnesota Public Radio reported .

Bethea grew up in a dysfunctional home. His father abused his mother, and he had to overcome homelessness and drug dealing.

“It was a lot of work, but I met the right people at the right time who changed the trajectory of my life,’’ said Bethea, 37. “I received guidance and support from

them along the way.’’

He went to Bemidji State University in 2002 on a basketball scholarship but dropped out of college to pursue entrepreneurship.

Bethea said his acceptance into Techstars Retail, an international startup accelerator, played an important role in his success. The accelerator offerings funding and mentorship for a three-month period. Upsie was one of 10 startups selected in 2017.

“It took away the black or white thing,’’ he said.

“It made people judge me on who I am, how I am as a founder, what our team is doing every day and the business.’’

Entrepreneurs of color have a more difficult time

securing funding, said Sharon Kennedy Vickers, founder of the Twin Cities chapter of Blacks in Technology.

“The numbers are small for black tech founders because they don’t have the access to resources and capital to take their ideas to market,’’ she said. “There still exists a lot of preconceived ideas of what a tech founder looks like.’’

Bethea recently raised $1.7 million in nine weeks for the business, which will be used to hire more employees this year.

“For that next African-American founder who is like, ‘Can I do this?’ and is at a crossroads... hopefully this says that they can because I’m not anything special,’’ Bethea said.

But the Wednesday morning announcement was also met with immediate backlash online, raising questions about what the new category would mean for a film like “Black Panther,” a global blockbuster which has also been talked about as a favorite contender for the best picture Oscar.

John Bailey, the newly re-elected president of the Academy of Motion Picture Arts and Sciences, and film Academy CEO Dawn Hudson said in an email to members Wednesday morning that the Board of Governors met Tuesday night to approve the changes, which also included bumping the 2020 ceremony up to Feb. 9. The date for the 2019 show, Feb. 24, remains unchanged.

The addition of the popular film category, a clear effort to attract a larger audience to the ABC broadcast by honoring bigger and more seen films, led many to wonder whether a film like “Black Panther” would be ineligible for best picture and relegated to the popular film award because of its size and success, or lead to inadvertent segmenting by film academy voters.

Bailey and Hudson said eligibility requirements will be determined at a later date, but it is worth nothing that other top film categories like best animated feature and best foreign language film don't prohibit a best picture nomination. “Toy Story 3” was nominated for both best picture and best animated feature. It also wasn't specified whether it would be added for the 91st Academy Awards this February.

The division is not without precedent either. The first Academy Awards ceremony in 1929 actually did give out two top awards, one for Outstanding Picture and one for Unique and Artistic Picture to recognize both art films and epics, but the Unique and Artistic category was dropped the next year.

Ratings for the 90th Academy Awards fell to an all-time low of 26.5 million viewers, down 19 percent from the previous year and the first time the glitzy awards ceremony had fewer than 30 million viewers since 2008. Hosted by Jimmy Kimmel, the ceremony also clocked it at nearly four hours, making it the longest show in over a decade.

Runtime is a frequent criticism of the glitzy awards show, vexing hosts and producers as they try year after year to keep the ceremony to a palatable length and often using the orchestra to play winners off the stage.

In an effort to keep future ceremonies to three hours, Bailey and Hudson said certain awards will still be presented live, but others will be given out during commercial breaks. Specific categories will be determined at a later date, but the film academy said the off-air winning moments will be edited and aired in a later broadcast.

Oscar viewership is often tied to the box-office muscle of the big nominees. The 2018 best picture winner, “The Shape of Water,” had grossed $57.4 million in the United States by the time the awards aired and $63.9 million total. The biggest Academy Awards audience on record came in 1998, when the blockbuster “Titanic” was named best picture.

Gregory Ellwood, the editor-at-large of The Playlist, noted that in the past decade there have been a significant number of $100 million-plus earners nominated for best picture, like “Gravity,” “Dunkirk,” “Get Out,” “Toy Story 3,” “The Help” and the “The Revenant,” and some of which went on to win, like “Argo,” “The King's Speech” and “Slumdog Millionaire.”

Harris wrote on Twitter that while the academy might dismiss public reaction to the changes, the organization has broadened and diversified its membership in recent years and might find less support than they expect internally.

By Genoa Barrow| California Black Media Homeowners, farmers, ranchers and contractors alike have projects planned which include digging, excavating, drilling, trenching, and grading that could expose or damage underground utilities. There are over 20 million miles of underground utilities in the United States and calling 811 before digging could save thousands of dollars in damages and fines and prevent many unnecessary injuries. Call811.com provides instructions and timelines that are important to follow before beginning a project.

After a call to 811, each utility company will come out and mark where their respective “facilities” are. Each is designated with colored markers that represent specific lines such as red for electric; orange for communications; blue for water; yellow for gas, oil and stream; and green for sewer or storm drain. Markings are typically located up to and not past the user’s service connection or meter.

Van Jackson, a damage investigator with PG&E’s Dig-In Reduction Team, says PG&E’s Locate and Mark Division utilizes maps and other equipment to make the location determination for those who call.

Incidents and accidents bring investigators like Jackson on the scene. He says of the 1,800 dig ins PG&E responded to in 2017, half were a result of people not calling 811 before digging into the ground. The other half is contributed to factors such as failing to maintain the clearance PG&E set for them, when they did come out.

Accidents that occur as a result of not calling 811 first, can garner steep fines. One incident Jackson was called to investigate ended in a $5,000 fine being levied against a homeowner. While he says that is on the high end of the monetary sanctions that people can be subjected to, it should serve as a warning that it is better to call.

“Fines,” he says, “are determined after an investigation of the situation, the damage that is caused and the work that goes into repairing that damage.”

“Safety and prevention are a vital part of what PG&E does,” Jackson said.

“That’s a major part in trying to minimize the actual damages and injuries to those who are out here doing these excavations,” Jackson said.

In addition to information on safety practices, there is also education for individuals on California Code 4216 that mandates prior notification of dig projects.

Jackson, who works in the Bay Area, says people have been receptive of the offered sessions.

“I’ve been here 18 months; when totaled, just here in San Francisco, with all the outreach we’ve done, so far in attendance, we’ve provided workshops for at least 480 individuals from various companies that are doing work here in San Francisco,” he added.

In addition to those 90-minute workshops, PG&E also offers short videos online at www.pge.com on how to dig safely.

There is no cost for calling 811 and having the utility companies come out.

“The key word is free,” Jackson said.

The service has been expanded over the years to become a resource that is available 24-hours, seven days a week. Assistance is also available in several languages, which could eliminate some barriers to calling. Homeowners and contractors can also ask for assistance, generating their own USA ticket, by going online and logging onto 811express.com.
