The lawyers of WNBA star Brittney Griner, Maria Blagovolina and Alexander Boykov, said in a written statement following the verdict announcement that the court ignored all the evidence they presented and that they will appeal the decision.

“We are very disappointed by the verdict. As legal professionals, we believe that the court should be fair to everyone regardless of nationality,” Attorneys Maria Blagovolina and Alexander Boykov said in a statement.

“The court completely ignored all the evidence of the defense, and most importantly, the guilty plea. This contradicts the existing legal practice.

“Taking into account the amount of the substance (not to mention the defects of the expertise) and the plea, the verdict is absolutely unreasonable. We will certainly file an appeal,” they added.

Russian officials contended that Griner committed the crime on purpose. They also levied a fine totaling about $16,400 American dollars on the basketball star.

Authorities arrested Griner on Feb. 17 at an airport in Moscow after finding less than a gram of cannabis oil in her luggage.

She has been detained since then.

Recently, American officials revealed that the BidenHarris administration had offered notorious arms dealer Viktor Bout in exchange for the release of Griner and Paul Whelan.

“Today, American citizen Brittney Griner received a prison sentence that is one more reminder of what the world already knew: Russia is wrongfully detaining Brittney,” President Biden said.

“It’s unacceptable, and I call on Russia to release her immediately so she can be with her wife, loved ones, friends, and teammates. My administration will continue to work tirelessly and pursue every possible avenue to bring Brittney and Paul Whelan home safely as soon as possible.”

On July 23, the World Health Organization declared monkeypox a “public health emergency.”

Last Thursday, the federal government also declared monkeypox a national public health emergency.

“We are prepared to take our response to the next level in addressing this virus and we urge every American to take monkeypox seriously,” said U.S. Health and Human Services Secretary and former California Attorney General Xavier Becerra.

CDPH Director and State Public Health Officer Dr. Tomás J. Aragón says he welcomes the federal health emergency because it opens up channels for California to get more access to resources to slow the spread the disease.

“We hope today’s action injects additional federal funding and resources into our collective response efforts.

The state remains focused on slowing the spread of the virus in impacted communities, administering the limited number of vaccine doses we have, and raising awareness about prevention measures and access to treatment,” Aragón said, before adding that California is “well-positioned” to tackle the outbreak.

Alabama Town Disbands Police Dept Over Racist Text

VINCENT, Ala. (AP) – A racist text message sent by a police officer has prompted officials in a small Alabama town to disband their police department and fire the police chief and assistant chief.

Vincent Mayor James Latimore on Thursday confirmed that Police Chief James Srygley and Assistant Chief John L. Goss had been dismissed, al.com reported.

The Shelby County Sheriff’s Office on Friday condemned the two officers’ actions and said it stands with the city “in providing emergency law enforcement related service to the citizens (of Vincent) at this time.’’

In the message, which recently surfaced on social media, someone identified as “752? texts: “What do y’all call a pregnant slave?’’ An unidentified recipient responds twice: “?’’ and “??’’

“752? answers: “BOGO Buy one, get one free’’ “This has torn this community apart. It doesn’t matter what color we are as long as we do right by people,” City Councilman Corey Abrams said during Thursday’s council meeting.

On Tuesday, Latimore said “appropriate action has been taken’’ against the officer alleged to have sent the text, though at the time he would not name the person or anyone involved.

The city’s website lists three people in its department: Srygley, Goss and Officer Lee Carden.

During the council meeting, Latimore announced he had suspended the chief and assistant chief, and the council voted to end the agency. Latimer said Carden turned in his resignation via text message just hours after the city council voted to dissolve the department.

Located in central Alabama, southeast of Birmingham, Vincent has a population of just under 2,000 people. It’s located in Shelby, St. Clair, and Talladega counties.

Man Arrested on Hate Crime Charges in Church Vandalism

ANNE ARUNDEL, Md. (AP) – Police in Maryland have arrested a 66-year-old man on multiple hate crimes charges after racist graffiti was discovered at a church in Anne Arundel County.

The Capital newspaper reports that the graffiti discovered at Kingdom Celebration Center Wednesday followed a similar incident last month, when a racist slur was found on the church’s doors before a food distribution one morning.

Donald Eugene Hood Jr., 66, who has no fixed address, faces three hate crime charges and a fourth charge of malicious destruction of property in the most recent incident. Police identified him after reviewing surveillance footage from the church, according to a news release from the department.

He was arrested Friday and was later released on his recognizance, the news release said.

Police have not determined whether he was involved in the vandalism incident last month.

“I am appalled by these acts of hate targeting Black churches in our communities,’’ County Executive Steuart Pittman said in a statement Wednesday.

Buffalo Man Charged for Twitter Threat to Black Shoppers

BUFFALO, N.Y. (AP) _ A Black resident of Buffalo, New York, told investigators he anonymously tweeted out a fake threat to commit mass killings against Black people in his community, days after a real mass shooting, because he wanted to see if racists would cheer him on, according to federal prosecutors.

The U.S. Attorney’s office said Thursday that the suspect, 24, said in a May 16 post that he and “associates’’ would target Black people at area grocery stores _ two days after a white gunman from Conklin, New York, opened fire at a Tops Friendly Market and killed 10 people.

He “stated that the purpose of the post was to see what everyone would say and if anyone would agree with him,’’ according to an FBI agent’s affidavit supporting the charge.

The suspect was charged with making an interstate threat. His assigned attorney declined to comment.

The affidavit said the suspect told law enforcement that he also created a second account “in an effort to rectify the earlier post.’’ He replaced “only looking to kill blacks’’ with “ants, spiders and things of that nature.”

A search of his cellphone revealed a screenshot of a post from the second account claiming not to have meant any harm, the affidavit said.

The suspect made an initial appearance in U.S. District Court and was released. He faces up to five years in prison if convicted.

Last month, authorities announced the arrest of a Washington state man after police said he made multiple calls to a Tops supermarket in Buffalo in which he referenced shooting and killing Black people. A different Buffalo resident was arrested in May for making similar threatening phone calls to two local business and also referencing the Tops supermarket shooting.

Hitler’s Watch Sells at Maryland Auction for $1.1 Million CHESAPEAKE CITY, Md. (AP) _ A Maryland auction house has sold a wristwatch that once belonged to Adolf Hitler for $1.1 million.

Alexander Historical Auctions in Chesapeake City had estimated the value between $2 and $4 million, describing the watch as a “World War II relic of historic proportions.’’

Newsoutlets report that Jewish leaders and others objected to the sale this week, saying it had little to no historical value.

The auction house’s president, Bill Panagopulos, defended the auction and said the buyer is a European Jew. The watch features the initials AH and a swastika. The auction house said a French soldier seized the watch as spoils of war on May 4, 1945, when his unit became the first Allied force to arrive at Hitler’s Berchtesgaden retreat. The Nazi leader died in Berlin on April 30, 1945.

DOJ Charges Officers in Death of Breonna Taylor

Breonna Taylor’s family may finally get justice after the Department of Justice charged four current and former police officers in Louisville, Kentucky, who were involved in the fatal March 2020 raid on her apartment.

The DOJ accused the officers of lying to obtain a warrant that was used to search her home when they knocked her door down and opened fire.

U.S. Attorney General Merrick Garland announced that members of an investigative unit within the Louisville Metro Police Department had included false information in an affidavit that was then used to obtain a warrant to search Taylor’s home.

He told reporters at a hastily called news conference that prosecutors believed the officers “violated federal civil rights laws, and that those violations resulted in Taylor’s death.”

Three of the officers also misled investigators who began looking into Taylor’s death, Garland said, including two that he said had met in a garage in the spring of 2020 and “agreed to tell investigators a false story.”

“On March 13, 2020, Breonna Taylor should have awakened in her home as usual, but tragically she did not,” said Assistant Attorney General Kristen Clarke.

According to a DOJ release, the first indictment charges former Louisville Metro Police Department (LMPD) Detective Joshua Jaynes, 40, and current LMPD Sergeant Kyle Meany, 35, with federal civil rights and obstruction offenses for their roles in preparing and approving a false search warrant affidavit that resulted in Taylor’s death.

The second indictment charges former LMPD Detective Brett Hankison, 46, with civil rights offenses for firing his service weapon into Taylor’s apartment through a covered window and covered glass door.

The third charging document — and information filed by the Department of Justice — charges LMPD Detective Kelly Goodlett with conspiring with Jaynes to falsify the search warrant for Taylor’s home and to cover up their actions afterward.

The first indictment — charging Jaynes and Meany in connection with the allegedly false warrant — contains four counts. Count One charges that Jaynes and Meany, while acting in their official capacities as officers, willfully deprived Taylor of her constitutional rights by drafting and approving a false affidavit to obtain a search warrant for Taylor’s home.

The indictment alleges that Jaynes and Meany knew that the affidavit contained false and misleading statements, omitted material facts, relied on stale information, and was not supported by probable cause.

The indictment also alleges that Jaynes and Meany knew that the execution of the search warrant would be carried out by armed LMPD officers and could create a dangerous situation both for those officers and for anyone who happened to be in Taylor’s home.

According to the charges, the officers tasked with executing the warrant were not involved in drafting the warrant affidavit and were not aware that it was false. This count alleges that the offense resulted in Taylor’s death.

Count Two charges Jaynes with conspiracy, for agreeing with another detective to cover up the false warrant affidavit after Taylor’s death by drafting a false investigative letter and making false statements to criminal investigators.

Count Three charges Jaynes with falsifying a report with the intent to impede a criminal investigation into Taylor’s death.

Count Four charges Meany with making a false statement to federal investigators.

The second indictment —against Hankison — includes two civil rights charges alleging that Hankison willfully used unconstitutionally excessive force, while acting in his official capacity as an officer, when he fired his service weapon into Taylor’s apartment through a covered window and covered glass door.

Count One charges him with depriving Taylor and a person staying with Taylor in her apartment of their constitutional rights by firing shots through a bedroom window that was covered with blinds and a blackout curtain.

Count Two charges Hankison with depriving three of Taylor’s neighbors of their constitutional rights by firing shots through a sliding glass door that was covered with blinds and a curtain; the indictment alleges that several of Hankison’s bullets traveled through the wall of Taylor’s home and into the apartment unit occupied by her neighbors.

Both counts allege that Hankison used a dangerous weapon, and that his conduct involved an attempt to kill.

The information charging Goodlett with conspiracy contains one count. It charges Goodlett with conspiring with Jaynes to falsify the warrant affidavit for Taylor’s home, and file a false report to cover up the false affidavit.

counts carry a statutory maximum sentence of five years, as does the false-statements charge. Actual sentences, in case of conviction, are determined by a judge.

The charges announced today are separate from the Justice Department’s Civil Rights Division’s pattern or practice investigation into Louisville Metro Government and the Louisville Metro Police Department, which Attorney General Garland announced on April 26, 2021, the DOJ news release stated.

The charges are criminal against individual officers, while the ongoing pattern or practice investigation is a civil investigation that is examining allegations of systemic violations of the Constitution and federal law by LMPD and Louisville Metro, the DOJ noted.

The civil pattern or practice investigation is being handled independently from the criminal case by a different team of career staff.

Further, the charges are also separate from the charges previously filed by the Commonwealth of Kentucky against Hankison related to the shooting at Taylor’s home.

The federal charges allege violations of the U.S. Constitution, rather than of state law.

“They also allege excessive use of force with respect to Taylor and a person staying in her apartment; violations not included in the Commonwealth’s case,” DOJ officials wrote in the news release.

Senate Democrats took a critical step toward reducing inflation and the cost of living by passing the Inflation Reduction Act. Proponents said the measure would make a big difference for many Americans by locking in savings on health insurance premiums and reducing the cost of prescription drugs by allowing Medicare to negotiate lower prices.

The bill, when signed by President Joe Biden, should also lead to creating family-sustaining jobs and cutting energy costs by making the most significant investment in history in combating climate change, Democrats have claimed.

The country will pay the bill’s $739 billion price tag by making corporations pay their fair share. Those making less than $400,000 annually won’t see tax increases.

Vice President Kamala Harris cast the tie-breaking vote in a deadlock Senate to ensure passage.

“I’m thrilled we were finally able to pass this historic, once-in-a-generation investment in our country’s future that will lower costs for Georgians, create clean energy jobs and reduce the deficit all at the same time,” said Georgia Democratic Senator Reverend Raphael Warnock.

“I’m especially proud the legislation includes two provisions I introduced to cap insulin costs for Medicare patients at $35 a month and to limit the cost of prescription drugs for seniors. This bill will strengthen health care access and lower health care costs for people across Georgia.”

Warnock said the legislation would make a real change in people’s lives.

“From saving seniors money by allowing Medicare to directly negotiate drug prices, to expanding vital health care subsidies, to greening the economy, this legislation will make a lasting impact on Georgians’ lives,” Warnock stated.

Experts and economists said the Inflation Reduction Act would save American households thousands of dollars.

“This bill will reduce the cost of prescription drugs, make health insurance more affordable, cap out-of-pocket costs, reduce your energy bill, reduce the federal deficit, and bring down inflation,” Florida Democratic Rep. Val Demings said.

“As the daughter of a maid and a janitor, every dollar mattered in our household, and I’ll always fight to protect working families.”

Demings said the deal builds on work she did in the House to allow Medicare to negotiate the cost of prescription drugs, bring down energy costs, and create significant new jobs by fighting climate change.

“Senate Republicans tried and failed to block this legislation because it takes on their biggest backers: prescription drug companies, fossil fuel companies, and billionaire tax cheats,” Demings remarked.

“I’m going to put Florida families first and support policies to bring down costs for working people even if it cuts into the profit margins of these special interests.”

Senate Republicans, all of whom opposed the package, lashed out.

“This is not about inflation reduction. This is all about Democrats spending on things they want to spend money on,” Utah GOP Sen. Mitt Romney asserted.

“It’s another taxing and spending bill,” he insisted.

Biden said he ran for president promising to make government work for working families again, and that is what this bill does.

“This bill caps seniors’ out-of-pocket spending for prescription drugs at $2000 per year – no matter what their drug bills would otherwise be, seniors will not have to spend more than $2,000,” Biden stated “Additionally, 13 million Americans, covered under

The all-star program presented what organizers called a tremendous opportunity to educate the public regarding the significance of the Voting Rights Act and the dangerous threats from the Supreme Court.

Held at the Thurgood Marshall Center Trust in Washington D.C.’s historic Shaw District, the event also highlighted the “anti-democracy forces” that continue to threaten voting rights around the country.

Roots of Music Aims to Change New Orleans Kids’ Lives

For a brief moment, it's silent as a roomful of gradeschoolers take a breath and wait for a signal.

With a wave of his hand, their director, Lawrence Rawlins, queues them in and they sound their instruments in unison, playing the notes to Starpoint's “Object of My Desire.''

The band, known as the Roots of Music Marching Crusaders, is rehearsing for its upcoming performance at this weekend's annual Satchmo Summerfest, a two day-festival dedicated to the legendary New Orleans jazz musician Louis “Satchmo'' Armstrong. The festival will be held Saturday and Sunday. The Roots of Music plays Saturday at 11:30 a.m. outside of the New Orleans Jazz Museum's gates on Esplanade Avenue.

Established in 2007, the Roots of Music is a nonprofit, after-school and summer music education program for kids ages 9-14 from low-income households.

Derrick Tabb, Roots co-founder and executive director, said he was inspired to create the program after his junior-high band director took a special interest in him.

“He saved my life,'' said Tabb, who then began to use music as a positive outlet.

He has expanded on the music-program concept by introducing transportation, food, and tutoring.

Roots of Music operates three buses that pick up the students from over 50 schools around the city, Tabb said.

After practice, the buses take the kids back home. As for food, each day students receive a hot meal, donated to the program from organizations like Second Harvest Food Bank.

The tutoring program is led by students from Tulane and other local universities. Tabb said he hopes that the tutors can serve as role models for his students and inspire them to pursue higher education.

“Those three things are the tools these kids really needed to succeed,'' Tabb said. “Implementing them made this a no-excuse program.''

The program operates year-round, with students coming four to five times a week for music history and theory lessons, instrumental instruction and performance

preparation, which includes honing the marching and drill skills that make them Carnival parade regulars. Since starting in 2007, the program has grown from a group of 42 student musicians to about 150.

Throughout the year, they perform at conventions and festivals in New Orleans, in addition to parades. The band also travels around the world for performance opportunities, having previously played in London, Canada, France, Amsterdam and most recently Switzerland.

“It's a good time for (the) kids,'' Tabb said. “It gets them to see another part of the world, experience a different culture and meet new people that they probably wouldn't have.''

With kids coming from all over the city, Tabb said the program is about much more than music.

“It's also like an anti-crime program,'' he said, explaining that the band helps the kids build friendships and learn about teamwork. “It brings them together around a common goal at a neutral place. Now they have a positive reason to be together instead of being out doing whatever.''

Tabb said the added bonus of bringing the kids together is that it also brings entire communities closer.

“When you bring the kids together, you bring moms, dads and everyone else. It builds friendships with the whole family,'' he said.

For ninth grader Imand Peterson, 15, who plays the French horn, the performance at Satchmo SummerFest will be his final with the Roots of Music, as it's time for him to graduate from the program.

“I'm sad because, I've been here since I was little,'' he said. “I know it's going to hit me hard.''

Before Roots, Peterson said he had never touched an instrument. He remembers hearing the band for the first time while looking up random bands on YouTube.

“I just knew I wanted to join them,'' he said.

After a quick application, he was learning the rudiments of music and playing the drums, before eventually moving on to horns.

Although he wishes he could stay longer, he said he is grateful for all that he has been able to accomplish with the group.

“Playing a horn isn't just for the moment,'' he said. “I can get scholarships to schools now and travel all over the world playing music.''

Like Tabb, Peterson said music has changed his life.

When he's older, he wants to play in a brass band before branching out to work as a band director.

“There's no feeling like coming here and seeing kids happy and wanting to succeed,'' Tabb said Roots of Music graduates, like Jazz Henry, have gone on to have professional careers in music. Others are on their way.

Every high school band in the city has students from the Roots of Music, most serving as section leaders, Tabb said. The program also has a partnership with Berklee City

Music Boston, an out-of-school, student-centered music and performing arts educational organization.

Tabb has big goals for the program, which is back to its normal operations following a period of remote learning due to the pandemic and a hiatus after Hurricane Ida. “I want to make this the best place for kids to come to,'' Tabb said. “I want them to want to come here every day.''

Driver Gets 1 Year in Jail in Death of Nicki Minaj’s Father

Nicki Minaj, the platinum-selling, Grammy-nominated rapper of “Anaconda,’’ “Super Bass’’ and other hits, was born Onika Tanya Maraj in Trinidad and was raised in Queens. In a post on her website, Minaj, 39, called her father’s death “the most devastating loss of my life.’’

MINEOLA, N.Y. (AP) – The driver in a hit-and-run crash that killed the father of rapper Nicki Minaj last year was sentenced Wednesday to a year in jail, in keeping with a promise the judge made when the man pleaded guilty in May. Charles Polevich, who pleaded guilty to leaving the scene and tampering with evidence in the crash on New York's Long Island that killed Robert Maraj, was also ordered to pay a $5,000 fine and had his driver's license suspended for six months.

Polevich's lawyer, Marc Gann, suggested his client may have had a medical issue at the time of the crash and that he wasn't fully aware of what had happened when he fled.

Polevich, 72, said in court that he's “been heartsick since realizing the extent of the tragedy'' and that there was “no excuse'' for his behavior.

Maraj's widow, Carol Maraj, said in court that Polevich had left her husband “like a dog on the street'' and that sparing him a longer jail sentence was a “slap in the face for the family,'' Newsday reported.

Polevich struck Maraj, 64, while Maraj was walking along Roslyn Road in Mineola in February 2021. Polevich stopped briefly to ask Maraj if he was OK, but didn't call for help, prosecutors said.

Instead, Polevich went home, parked the car – a white, 1992 Volvo station wagon – in his garage and covered it with a tarp, prosecutors said. Maraj was taken to a hospital and pronounced dead the next day.

Prosecutors sought a sentence of one to three years behind bars, but Nassau County Judge Howard Sturim said in May, when Polevich pleaded guilty, that he would get “no more than one year in jail.''

Brendan Brosh, a spokesperson for the Nassau County district attorney's office, said that “given the severity of the defendant's conduct,'' prosecutors felt a stiffer sentence was warranted.

“We continue to express our condolences to the family of Robert Maraj,'' Brosh said.

Gann asked for a 90-day jail sentence, arguing that other factors outside of Polevich's control were partially to blame for the crash, including road construction, street lights that weren't working and Maraj's physical condition.

Maraj's widow, Carol Maraj, is suing Polevich over the crash.

Polevich, who had been splitting time between Long Island and Guam, where he runs a drilling and water purification business, surrendered to police a few days after the crash.

Detectives said they used pieces of surveillance video to track the Volvo involved in the crash to Polevich's Mineola home.

Rapper Mystikal, Accused of Rape Denied Bond by Judge GONZALES, La. (AP) – A Louisiana judge has refused to set any bond for rapper Mystikal, who is accused of raping and choking a woman at his home outside Baton Rouge.

State District Judge Steven Tureau ruled on Tuesday that evidence against 51-year-old Michael Tyler, his past history and the victim's fears met the standard for holding him without bail, The Advocate reported.

Tyler served six years in prison after pleading guilty in 2003 to sexual battery. In December 2020, prosecutors in Caddo Parish, in northwest Louisiana, dropped rape and kidnapping charges that had kept him jailed for 18 months.

He was not convicted of other charges, including marijuana possession and misdemeanor domestic violence, that had been brought against him since the mid-1990s, the newspaper reported.

Defense attorney Roy Maughan Jr., who had asked for $250,000 bond, maintained that Tyler is innocent of the most recent charges, including rape and domestic abuse battery by strangulation. But he told the newspaper after the hearing that Tyler probably won't appeal the bond ruling.

Maughan tried unsuccessfully to get the court record to reflect that Tyler made all of his court dates in those cases and, as a celebrity, would have a hard time evading capture if he fled. He had been released on $3 million bond in February 2019, nearly two years before the Caddo Parish charges were dropped.

Mystikal, who grew up in New Orleans and now lives in Prairieville, is accused of attacking the woman, taking her keys and holding her against her will, according to an arrest warrant.

Sheriff's Detective Garrett Keith testified Tuesday that the woman went to Tyler's home about 8 p.m. Saturday to talk about alleged financial commitments he had made to her.

He said the woman reported that Tyler's behavior changed abruptly after he went into the bathroom and returned: He accused her of stealing cash, choked her and pulled out her hair, Keith testified.

Tyler later apologized, prayed with her and threw rubbing alcohol on her to cleanse her “bad spirits'' before raping her, Keith testified.

Maughan's cross-examination tried to show that the prayer and apology indicated that things were calmer and the woman wasn't afraid, the newspaper reported.

Keith later told prosecutors that the woman was “praying for her safety'' and didn't know what Tyler said.

The woman was cut and bruised, and deputies found some of her braids, an earring and a broken nail in the house, the detective said. Some wounds were consistent with rape, he said.

Maughan also cross-examined Keith about whether and how the woman had objected to sex. Keith quoted her as saying Tyler's threats had made her afraid to object at first, but she later clearly told him “no.''

In California, Abortion Could Become a Constitutional Right. So Could Birth Control

If they vote “yes” on Proposition 1, they will also lock in a right that has gotten less attention: the right to birth control.

Should the measure succeed, California would become one of the first states — if not the first — to create explicit constitutional rights to both abortion and contraception.

The lawmakers and activists behind the constitutional amendment said they hope to score a one-two punch: protect abortion in California after the U.S. Supreme Court ended the federal constitutional right to abortion under Roe v. Wade, and get ahead of what they see as the next front in the reproductive rights fight: birth control.

“The United States Supreme Court said that the privacy and liberty protections in the United States Constitution did not extend to abortion,” said UCLA law professor Cary Franklin, an expert in constitutional law and reproductive rights who has testified before the California legislature in support of the amendment. “If they said ‘no’ on abortion, they’re probably going to say ‘no’ on birth control because that has a similar history.”

In June, the U.S. Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization ended the federal right to abortion and left states to regulate the service.

In his concurring opinion, Justice Clarence Thomas said the court should revisit other cases that have created protections for Americans based on an implicit right to privacy in the U.S. Constitution, such as the 1965 case Griswold v. Connecticut, which established a federal right to contraception for married people — which was later extended to unmarried people.

Some congressional Democrats are now trying to codify the right to contraception in federal law. In July, the U.S. House of Representatives passed the Right to Contraception Act, which would give patients the right to access and use contraception and providers the right to furnish it. But the bill has little chance of success in the U.S. Senate, where Republicans have already blocked it once.

Protecting access to contraception is popular with voters. A national poll from Morning Consult and Politico conducted in late July found that 75% of registered voters support a federal law that protects a right to birth control access.

California isn’t the only state where voters are considering reproductive rights in their constitutions.

On Tuesday, Kansas voters decisively rejected a constitutional amendment that would have allowed state lawmakers to ban or dramatically restrict abortion. It failed by nearly 18 percentage points.

Kentucky voters will face a similar decision in November with a proposed constitutional amendment that would declare that the state’s constitutional right to privacy does not cover abortion.

Vermont is going in the opposite direction. Voters there will weigh a ballot measure in November that would add a right to “personal reproductive autonomy” to the state constitution, though it does not explicitly mention abortion or contraception. In Michigan, a proposed constitutional amendment that would guarantee a right to both abortion and contraception is expected to qualify for the November ballot.

In California, Proposition 1 would prevent the state from denying or interfering with “an individual’s reproductive freedom in their most intimate decisions, which includes their fundamental right to choose to have an abortion and their fundamental right to choose or refuse contraceptives.”

The proposed constitutional amendment doesn’t go into detail about what enshrining the right to contraception in the state constitution would mean.

California already has some of the strongest contraceptive-access laws in the country — and lawmakers are considering more proposals this year. For instance, state-regulated health plans must cover all FDA-approved contraception; pharmacists must dispense emergency contraception to anyone with a prescription, regardless of age; and pharmacists can prescribe birth control pills on the spot. State courts have also interpreted California’s constitution to include a right to privacy that covers reproductive health decisions.

The amendment, if adopted, could provide a new legal pathway for people to sue when they’re denied contraceptives, said Michele Goodwin, chancellor’s professor of law at the University of California-Irvine.

If a pharmacist refused to fill a birth control prescription or a cashier declined to ring up condoms, she said, customers could make a case that their rights had been violated.

Making the rights to abortion and contraception explicit in the state constitution — instead of relying on a right to privacy — would also protect against shifting political winds, said state Senate leader Toni Atkins (D-San Diego), who was the director of a women’s health clinic in the 1980s. Although California’s lawmakers and executive officers are solid supporters of abortion rights, she said, the composition of the legislature and courts’ interpretation of laws could change.

“I want to know for sure that that right is protected,” Atkins said at a legislative hearing in June. “We are protecting ourselves from future courts and future politicians.”

The amendment would solidify California’s role as a reproductive rights sanctuary as much of the country chips away at birth control availability, Goodwin added.

Experts said two forms of birth control that are vulnerable to restrictions in other states are intrauterine devices, or IUDs, and emergency contraception like Plan B. These methods are often incorrectly conflated with abortion pills, which end a pregnancy instead of preventing it.

Nine states have laws that restrict emergency

contraception — for example, by allowing pharmacies to refuse to dispense it or excluding it from state family planning programs — according to the Guttmacher Institute, a research organization that supports abortion rights. In Alabama and Louisiana this year, abortion opponents introduced legislation that would restrict or ban abortion, and would also apply to emergency contraception.

“We’re seeing an erosion of abortion access that is playing out in statehouses across the country that have and will continue to target contraceptive care as well,” said Audrey Sandusky, senior director of policy and communications for the National Family Planning and Reproductive Health Association.

Susan Arnall, vice president of California’s Right to Life League, said the proposed amendment is symbolic and merely echoes current laws. Arnall thinks the campaign is mostly about Democratic politicians trying to score political points.

“It just allows the pro-abort legislators to trumpet and give them talking points about how they’re doing something about the overturn of Roe v. Wade,” she said.

“It is political virtue signaling. I don’t think it does much of anything else.”

Goodwin argues that the measure’s symbolism is significant and overdue. She pointed to the Civil War era, when enslaved people in Southern states could look to free states for spiritual hope and material help. “Symbolically, what that meant is a kind of beacon of hope, that those places did exist, where one’s humanity could be regarded,” Goodwin said.

But California’s reputation as a haven for contraceptive availability may not be fully warranted, said Dima Qato, an associate professor at the University of Southern California School of Pharmacy. In her 2020 study of contraceptive access in Los Angeles County, which has some of the highest rates of teen and unintended pregnancy in the country, Qato found that only 10% of pharmacies surveyed offered pharmacist-prescribed birth control. Pharmacies in lowincome and minority communities were the least likely to offer the service, Qato said, worsening disparities instead of solving them.

Qato supports the constitutional amendment but said California should focus on improving and enforcing the laws it already has.

“We don’t need more laws when we don’t address the root cause of a lack of effectiveness of these laws in these communities,” Qato said. “Lack of enforcement and accountability disproportionately impacts communities of color.”

to public health authorities. Symptoms of the disease, lesions and blisters, can be extremely painful in some cases as well.

“Over 99% of people who get this form of the disease are likely to survive. However, people with weakened immune systems, children under 8 years of age, people with a history of eczema, and people who are pregnant or breastfeeding may be more likely to get seriously ill or die,” the CDC reports.

According to the governor’s office, CDPH has taken a number of steps to expand access to vaccinations and the state has launched a public information campaign, mostly relying on webinars and town hall meetings to get information about Monkeypox out to people across the state.

“CDPH is also expanding treatment options. Access to the antiviral prescription drug tecovirimat (Tpoxx) used to treat monkeypox is limited, but the treatment can now be administered at more than 30 facilities and providers across the state,” a press release issued by Newsom’s office states.

As of August 2, the state had distributed nearly 1,713 treatment courses and 168 IV doses of Tecovirimat to health centers in various locations across the state.

So far, the CDPH has received a little over 109,000 monkeypox vaccines – of which 51,000 doses have been

distributed to local health departments across the state.

Among Black Californians, there have been 129 cases reported so far, accounting for about 11% of all confirmed cases in the state. African Americans make up about 6.5% of the state’s total population.

As of Aug. 5, CDPH reports that there have been 1,310 confirmed cases of monkeypox in the state with the most confirmed cases being reported in Los Angeles (431) followed by San Francisco (398) and Alameda County (83). There have been 7,509 confirmed cases in the United States and 28,220 across the world.

Shortly after the Governor declared a State of Emergency, Shane Harris of the Peoples Association of Justice Activists, a San Diego-based advocacy group, called on San Diego County to release demographic data on monkeypox cases in that county.

“The governor has declared a State of Emergency as of last night and constituents deserve to know the truth about this virus in our region,” said Harris speaking at a press conference. “My office led this argument during COVID that we needed more demographic data, and the county’s response is that we did not have enough cases at that time.

I want them to know that response will not work this time.

There is never too few of cases.”

At the state level, the CDPH has begun to

disaggregate the Monkeypox data it is collecting by race, city, hospitalizations, gender, age and sexual orientation.

The age group with the highest number of reported monkeypox cases (482) are 25-to-34-year-olds, who make up about 36.8 % of all confirmed infections in California.

“We’ll continue to work with the federal government to secure more vaccines, raise awareness about reducing risk, and stand with the LGBTQ community fighting stigmatization,” Newsom added.

Aragón echoed the governor’s statement.

“Our team is also committed to reducing stigma among the LGBTQ community, which has been singled out and treated unfairly because of this outbreak. No single individual or community is to blame for the spread of any virus,” Aragón reinforced.

When it comes to race, Harris said it is important to approach the containment and treatment of monkeypox with the same “perspective and passion” that characterized the state government’s response during the COVID-19 pandemic.

“Race and ethnicity were very important during COVID because we studied the very impact of cultural competency pertaining to COVID – how different communities dealt with it. It is still significantly important today,” Harris emphasized.

‘The Mandela Act’ Aims to Set Clear Definition of Solitary Confinement in CA Prisons Edward Henderson | California Black Media Assemblymember Chris Holden (D-Pasadena), a member of the California Legislative Black Caucus and Chair of the Assembly Appropriations Committee, has proposed legislation that would restrict prisons from holding people in solitary confinement, or all-day isolation for more than 15 consecutive days and no more than 45 days total, in a 6-month period.

Assembly Bill (AB) 2632, a.k.a ‘The California Mandela Act’, would prohibit the practice entirely for persons belonging to a “special population,” including pregnant women, persons with a developmental disability or a serious mental disorder, and individuals under 25 and over 60. It would also establish the procedures and reporting requirements for segregated confinement.

Last week, the Senate Appropriations committee sent AB 2632 to the suspense file.

Bills meeting the committee’s suspense threshold, i.e., the cost of a bill is determined to be $50,000 or more to the state’s General Fund or $150,000 or more to a special fund, are often placed on the suspense file after committee testimony is taken and not passed directly to the Senate for a vote. Instead, a vote-only suspense hearing will be held prior to the deadlines for fiscal committees to hear and report bills to the Senate Floor. The bill will either move on to the Senate Floor for further consideration or be held in committee.

If the bill passes the Legislature, California would be the first state to ban the practice in private immigration facilities. Since 2017, 14 other states have limited or ceased the practice for certain groups.

“Rehabilitation is lost once you put someone in a solitary confinement setting,” said Holden in a press release. “Our constitution prohibits torture, and I believe that the use of prolonged solitary is wrong, both morally, and also with respect to the rehabilitation of individuals in jails and prisons.”

The bill is named after Nelson Mandela who was famously detained in solitary confinement for 18 of his 27 years of imprisonment in South Africa. In 2015, the United Nations also named its standards of imprisonment after Mandela and deemed any period of isolation beyond 15 days torture.

Opponents of AB 2632 argue that suspending solitary confinement would complicate housing decisions and lead to dangerous living conditions for detainees and staff.

The Department of Corrections and Rehabilitation (CDCR) reports the bill would necessitate a one-time cost of $775 million to double the programming space at each institution and a one-time cost of up to $512 million to expand exercise yards by approximately 50%. CDCR also reported the increase in custody staffing required to implement the bill across its 31 institutions would cost about $200 million annually.

The Office of the Inspector General (OIG) reports ongoing costs of about of $3.8 million would be incurred to establish 25 new permanent positions to assess CDCR facilities in accordance to AB 2632 and report the findings to the Legislature.

AB 2632 is estimated to add millions in operating costs to the Board of State and Community Corrections, the Department of Justice, and county jails.

However, a recent fiscal report titled “The Cost of Solitary Confinement: Why Ending Isolation in California Prisons Can Save Money and Save Lives” drafted by the Immigration Defense Advocates and Berkeley Underground Scholars highlights potential savings from implementing the Mandela Act. The report used figures from the 2016 state budget and cost estimates from the California Department of Corrections and Rehabilitation. It predicts

savings between $60 and $300 million, while impacting more than 150 facilities in the state.

“The Mandela Act builds on the decades of work done by detained individuals, activists and organizers to shed light on the darkness that is solitary confinement and allows for constructive alternatives. This bill promotes accountability, safety, and human decency and I hope others will see that too,” said Holden.

Elections ‘22: Prop 26 and Prop 27 Are Dueling to Make Sports Gambling Legal McKenzie Jackson California Black Media Joseph Thomas, an avid sports fan in the San Fernando Valley, is stretching his texting fingers, anticipating the legalization of online sports gambling in the Golden State.

The retail sales manager enjoys playing fantasy football and wouldn’t mind wagering up to $100 a month on his favorite NFL team or players via the online gambling company FanDuel.

“It is something to do that could make watching the games more exciting,” Thomas said.

On Nov. 8, California voters have a choice between two ballot initiatives to legalize and tax sports betting: Prop 26 would allow in-person-only sports betting at Native American tribe operated casinos and at four horse racing tracks in the state, while Prop 27 would allow major sportsbooks operators to partner with tribes in California to offer sports betting to gamblers age 21 or older whether the bettor is on tribal lands or not.

Kathy Fairbanks, speaking for the Coalition for Safe, Responsible Gaming, a coalition of California Indian tribes and tribal organizations and state and community partners that are proponents of Prop 26, said winning the support of every potential voter, including Black Californians like Thomas, is their goal before the November Election.

“We are reaching out to everybody — we want the support of all voters in California — but the Black community is very important,” she said. “The way we will communicate with them throughout the campaign is similar to the way we communicate with all voters, but a little bit different.”

The Yes on 26 campaign is advertising in all mediums and utilizing direct mail to reach voters. It is urging the coalition’s organizations like the Baptist Ministers Conference of Los Angeles and Southern California, the Kern County Black Chamber of Commerce, and the Los Angeles Urban League to ask their members to mark “yes” for Prop 26 and “no” for Prop 27 on their ballots.

California-Hawaii State Conference NAACP spokesperson Kristine Yabumoto said in an email to California Black Media (CBM) that the civil rights organization endorses Prop 26.

On Aug. 3, the NAACP branch filed a lawsuit against California Secretary of State Shirley Weber in Sacramento Superior Court seeking to remove its name from a No on Proposition 26 opposition statement that would be printed in the state ballot pamphlet. According to the organization the quote from a Los Angeles NAACP member gives the impression the NAACP opposes Prop 26. The lawsuit says the quoted NAACP member, Minnie Hadley-Hempstead, believes she had been misled into giving the quote.

disappointed that Prop 27 supporters and those opposing Prop 26 would try to use the NAACP’s name deceptively.

“We are suing to have these dishonest statements removed from the ballot arguments, so it does not mislead voters,” he said.

As of press time, the coalition supporting Prop 27, had not responded to CBM inquiries.

Prop 27 is backed by major gambling companies including Bally’s, BetMGM, DraftKings, Fanatics, FanDuel, PENN Entertainment, and WynnBet. Tribes such as the Big Valley Band of Pomo Indians, Santa Rosa Rancheria Tachi Yokut Tribe, and Middletown Rancheria of Pomo Indians also support the initiative.

The proposition imposes a 10% tax on adjusted gross gaming revenue. 85% of the taxes goes toward fighting California’s homeless and mental health challenges. Nongaming tribes get the remaining 15% of tax revenue.

Leo Sisco, Chairman of the Santa Rosa Rancheria Tachi Yokut Tribe, said Prop 27’s approval would give tribes the economic opportunity to fortify their future for generations and protect tribal sovereignty.

“It is the only measure that will deliver hundreds of millions of dollars each year to help solve homelessness and address mental health in California,” Sisco said.

United Way of Greater Los Angeles President and CEO Elise Buik said that California needs to think big if the homeless problem is going to be solved.

“It could provide hundreds of millions each year in funding for proven solutions that help people experiencing homelessness come off the streets and into housing with supportive services,” Buik said Fairbanks said Prop 27 would have a negative impact on tribes and all of the state. She said online gambling companies have no effective way to prevent youth from using their apps or websites to place bets and that the proposition does not guarantee funding to tribes.

Over 50 Indian tribes oppose Prop 27 and are supporting Prop 26, which allows roulette and dice games at tribal casinos.

Fairbanks said Prop 26 extends the promise California voters made to tribes in 1998 when they authorized tribes to have gaming in the state.

“Tribes have been able to lift themselves out of poverty,” she said. “They’ve built casinos. They contribute annually to jobs, wages, and taxes in California. Proposition 26 will continue that and expand that by introducing in-person sports betting in a responsible manner.”

Tribal casinos annually employ over 150,000 Californians, generate $12.4 billion in wages, and have a $26.7 billion economic impact. They pay $5.1 billion in taxes and revenue sharing to federal, state, and local governments. Prop 26 will grow those figures, its supporters argue.

“Tribes will continue what they have been doing, which is sharing the prosperity,” Fairbanks said. “Sharing it with their tribal members; sharing it with their local communities; and sharing it through contracts tribes negotiate with the state.”

Fairbanks said polling Yes on 26 conducted suggests that voters are skeptical of online gambling and worry about underage gambling.

“Voters believe tribes have done a good job of being the only people in California, who can do Nevadastyle gambling,” she said. “The casinos are well run and responsible. If you want to do sports gambling, look at Prop 26 as the more responsible vote. You can do it inperson to your heart’s content.”

Diversifying American Media Ownership Must Become a National Priority

By Jim Winston and Dr. Benjamin F. Chavis Jr. Thus far, 2022 has been a year of multiple socioeconomic and political challenges for all Americans across the nation. Yet for African Americans and other communities of color, this year represents both challenges and opportunities from a business ownership perspective.

In particular, for Black-owned media businesses there is a growing sense of resilience even in the face of continued profound racial disparities and societal inequities.

The communications and media industry in America especially should be one of the leading industries that adopts the “good business” sense to embrace the values and benefits of Diversity, Equity and Inclusion (DEI). This is not about charity or benevolence. Diversity is objectively good for business.

The National Newspaper Publishers Association (NNPA) and the National Association of Black Owned Broadcasters (NABOB) are working together to encourage the media and advertising industries to become more proactive and committed to diversity from the C-suites to the decision-making managers. But more needs to be done to increase and to enhance the ownership of media businesses by African Americans and other minorities.

Economic equity in media requires equal access to investment capital, technical advances in communications infrastructure, and inclusion in other industry innovations.

As increased changes in the racial demographics of the nation continue to accelerate in the United States, American media must be more representative of the growing diversity of the nation.

It is noteworthy, therefore, that one of the recently announced major media mergers has Standard General, a minority-owned firm, pending regulatory reviews and approvals by the Department of Justice and the Federal Communications Commission, acquiring TEGNA,

a company owning 64 television stations around the country. Soo Kim, a successful Asian American business leader, who serves as Standard General’s founding and managing partner, emphasized “We’re open to exploring

new partnership models to get diverse viewpoints and perspectives on the air and to make sure people have the resources to do it.”

We agree with this sentiment as multiracial ownership

of American media businesses will continue to be viewed as a strategic forecast for the future economic wellbeing of the nation. We intend to raise our voices in support of the positive economic and social-equity consequences of diversifying American media.

The Leadership Conference on Civil and Human Rights has pointed out, “Access to the media by the broadest sector of society is crucial to ensuring that diverse viewpoints are presented to the American people, but racial and gender disparities in media ownership dating back to the beginning of the civil rights era continue to persist.”

Again, overcoming these disparities should be a national media industry priority.

“At a time when more people, particularly Black people, are distrustful of the media, diversity in media ownership,” the Leadership Conference argues, “has become more important than ever for the functioning of our democracy. Diversity in ownership is part of that solution.” We agree with the Leadership Conference on Civil and Human Rights’ position on this issue.

Lastly, as our nation prepares for the upcoming Midterm Elections in November, there are many who are predicating low overall voter turnout. Millions of dollars will be spent on Get-Out-The-Vote (GOTV) campaigns.

Those who desire to increase GOTV among AfricanAmericans and other communities of color will have to engage Black owned media as the “Trusted Voice” of Black America in order to increase voter turnout.

Brown NNPA Newswire Senior National Correspondent The FBI on Monday executed a search warrant on former President Donald Trump’s Mar-a-Lago resort in Palm Beach, Florida. “My beautiful home, Mar-A-Lago in Palm Beach, Florida, is currently under siege, raided, and occupied by a large group of FBI agents,” Trump said in a statement first sent to CNN. It wasn’t immediately clear what the FBI was looking for and what spurred the raid. However, the Department of Justice recently acknowledged it had launched an investigation into Trump’s actions leading up to Jan. 6. Multiple outlets cited several individuals familiar with the investigation in their reports. He told supporters at the White House, including Barr, that a big vote dump had occurred in Detroit. “I said, ‘Did anyone point out to you – did all the people complaining about it point out to you, you actually did better in Detroit than you did last time?” Barr stated. of T& T Building Construction and has supported and contributed to the erection of many church buildings throughout Northern and Southern California. Jerusalem Mission Church was founded in 1964, “in a little house across the street” from the present church, said, Dr. Dorothy Thomas (Wife, First Lady).

Lady Thomas expressed her heart-felt appreciation for the outpouring of love and support they received from the

community. “We celebrated him while he is still alive”, she said.

COVID Vaccines Available for Children Under 4 Edward Henderson California Black Media As parents across California focus on purchasing new clothes, school supplies and technological aids for their children for the coming school year, public health officials and healthcare professionals are asking them to consider the COVID-19 vaccine a back-to-school essential.

In June, COVID-19 vaccines were authorized for children 6 months through 4 years. Consequently about 2.2 million children in California and nearly 20 million children in the United States less than 5 years of age are eligible for COVID-19 vaccinations.

Although data from the trials involving thousands of infants and toddlers over the age of 6 months show that the vaccines are safe, effective and the best way to prevent serious health issues for youth and their families, many parents are hesitant to have their young children vaccinated.

Pfizer vaccine trials enlisted roughly 4,500 infants and toddlers over the age of 6 months. They proved the vaccine effective against COVID-19 and showed a strong antibody response in children receiving the vaccine.

Moderna vaccine trials involved over 6,500 infants and toddlers over the age of 6 months. They also proved the vaccine effective against COVID-19 and showed a strong antibody response in children who received it.

Dr. Jennifer Miller, a pediatrician with East Bay Pediatrics, spoke about her experiences with parents in her practice regarding the vaccine during a virtual press conference hosted by The California Department of Public Health (CDPH).

“For those families that are hesitant and questioning, I try to understand what their fears and questions are. I try to remind them that we are in this together. I care about the health and wellbeing of their children, and I will always suggest the best possible course for them,” she said. “I let them know that ultimately it is their decision to make, and I am here as a resource.

It is normal to be afraid of the unknown and to want to protect your child. With that in mind, vaccination is the best protection around.”

COVID-19 vaccines were only authorized for use in the US after three phases of clinical trials that show the vaccines are effective at protecting against the virus. For the COVID-19 vaccine clinical trials with children under 5 years old, infants and toddlers of different ethnicities were enrolled to ensure that the vaccine is consistently effective. Once the trials were completed, the U.S. Food and Drug Administration (FDA) determined after rigorous analysis that the data meets their high standards of safety, effectiveness and manufacturing quality.

Since the vaccines were authorized for emergency use, the Centers for Disease Control and Prevention (CDC) has been using platforms like V-safe and VAERS (Vaccine Adverse Event Reporting System) to monitor safety and efficacy of the vaccine.

Children 3 and above are eligible to receive the vaccination at pharmacies, while children under 3 will need to see their pediatrician or small community clinics due to federal regulations.

The state has purchased enough vaccines for every child in California with the first shipment of 500,000 doses arrived last month.

The Moderna vaccine for children under four is a two-dose vaccine like the dosage for adults, however there will be one month in between doses. The Pfizer vaccine is three doses. The first dose is followed by the second 21 days later and the final dose comes 60 days after that. The Moderna dose is 1/4 of an adult dose, and the Pfizer vaccine is 1/10 of the adult dose. Tests show the side effects of minor fever and pain at the injection site can be stronger for children who receive the Moderna vaccine.

Protecting everyone in the household is a top priority as the new school year approaches. For the first time since the pandemic, vaccines are available for the entire family. Age is no longer a factor. Data has also shown that the vaccine is effective for pregnant women and safe for their unborn children. Additional protections can also be given to them while they are still in the womb.

Dr. Sarah Takekawa, an Obstetrician-Gynecologist, is currently raising 3 children under 5. She spoke during the California Department of Public Health’s virtual press conference on concerns pregnant woman may have with the vaccine and its effect on children. Dr. Takekawa was fully vaccinated before conceiving her third child and received her booster while pregnant.

“I have seen first-hand what the COVID-19 infection can do to otherwise extremely healthy young women during their pregnancies. Watching firsthand adults otherwise healthy succumb to the disease, it seems easy to us to make this decision about wanting to get vaccinated and encouraging other parents to have their children vaccinated. But we also understand that it is a discussion that needs to be had.”
