New Leadership at Work Michele Lagana, OD, NYSOA President

On May 15th a new slate of board members took the helm of the NYSOA. Their inauguration occurred at the January House of Delegates meeting in Lake Placid, NY. Serving as your new officers are: Dr. Michele Lagana, President (Honeoye Falls) Dr. Dawn Chivers, President-Elect (Glen Falls) Dr. Ken Sorkin, Vice President (Plainview) Dr. Jeff Calhoun, Secretary/Treasurer (Williamsville) Dr. Chris Colburn, Immediate Past President (Jamestown) Thank you to Dr. Colburn for his recent leadership to NYSOA. We look forward to his continued service as the new AOA/NYSOA PAC chair.

There were also changes in elected Trustees: the Metropolitan area is now served by Dr. Aleksandra Wianecka (Dix Hills), Dr. Ray Pirozzolo (Staten Island) and Dr. Fran Reinstein (New York) while Dr. Ralph Lamberto (Utica) and Dr. Brian Powell (Fishkill) represent the Mohawk-Hudson area. Dr. Chris Shiomos (East Syracuse) and Dr. Dave Ciccone (Syracuse) are responsible for the Finger Lakes-Niagara region. Should you have any questions or concerns, your Trustees are always happy to address them. Congratulations to all new and re-elected board members and thank you for serving your profession!

Over the next 12 months we have a number of key initiatives that we’ll be working on…

1. Legal/Legislative issues – we continue to focus on our orals bill, Unilateral Pricing Policy (UPP) legislation and our Title VIII coalition bill. As chair of our legal/ legislative committee, you will see an update from Dr. Chivers in this issue. We’ve also been closely monitoring and discussing our options with regard to emerging disruptive technologies and non-covered service discount issues with the Manatt legal team.

2. Membership – as discussed in the last edition of Prospectus, we have a serious issue with membership that needs to be addressed. Membership is not only a concern for NY State but across the country as new OD’s fail to join the AOA and often don’t remain members even if they initially join. This is a similar problem that many other volunteer organizations share.

Legislative Update Dawn Chivers, OD, NYSOA President-Elect Now that the 2015 New York State legislative session has ended, I’m sure you are all wondering if we’ve made any progress for the optometrists in NY? The answer is yes; we’ve made a ton of progress on several fronts. For the first time since our topical drops bill was passed in 1995, ophthalmology has finally agreed to come to the table to start negotiations on our orals bill. These negotiations have started, but there was too much ground to be covered to come to an agreement that the optometrists of New York would be satisfied with and find truly meaningful in their everyday practice. We refused to pass an insufficient bill just to say, “we have orals”, only to need to come back to the legislature in a couple of years to expand our scope yet again. Negotiations are continuing, with the goal of introducing a bill in January 2016 with support from both professions. In the end, our grassroots efforts giving us wide support in the legislature and support from the more progressive OMDs who believe that this is the right thing to do is what finally moved the ophthalmology association to concede to talking with us. Thank you to every optometrist in NY who emailed

their legislators, called them, came to lobby day, this year and every year for the last 20 years. While we are disappointed that the bill didn’t get done this year, we are encouraged that there is a path forward to actually getting it done in 2016, and are confident that we will. Please continue to discuss this issue with the ophthalmologists that you work with every day. Tell them that this is important to you, and that IT IS TIME! The leadership of the NYS Ophthalmology association needs to hear from its members that they feel it is time.

NYSOA also spearheaded the Title VIII Coalition, a team of health professionals looking to use their power as a group to lobby for mutually beneficial legislation. We have introduced the bill (S.5862 (LaValle)/A.8153 (PeoplesStokes) to allow specific Title VIII professions to co-own PLLCs and PLLPs with physicians. As you know, current law prohibits physicians from co-owning with non-physicians. The NYSOA has had a separate bill that would allow ODs to co-own with physicians, but we are separately pursuing this more comprehensive approach based in part on the belief that there is greater influence with the legislature from the many professions pushing the issue. We expect the introduction will prompt a spirited debate with organized

medicine regarding the antiquated prohibition and the legislature over the next several months. This is another bill that we will seek to pass in 2016.

As many of you know, there has been a national effort by 1-800 Contact Lenses to prohibit Uniform Pricing Policies, including in New York. The NYSOA has opposed the legislation, and our government affairs team was successful in not allowing the bill to move out of committee this legislative session.

New York Senate Bill 4467, provides for the licensure of vision rehabilitation therapists, a state board of vision rehabilitation services, and outlines the requirements for licensure. It passed both the Senate and the Assembly and was sent to the Governor on June 18, 2015 for his signature.

The NYSOA has supported this bill given there was an express provision that required a referral or prescription from ODs, OMDs or others for vision rehabilitation services. The bill sponsors have agreed to support amendments to address the NYSOA’s concerns, about low vision therapists undertaking vision testing in a manner that was duplicative (and therefore unnecessary) of what would be done by the OD or OMD and appeared to have no beneficial purpose since the therapist could not diagnose or treat the condition.

CLIA Certification Process: FAQs Douglas Prangley, Director of Health Systems-East of RPS Diagnostic Why you need CLIA certification to run a Point of Care test, such as InflammaDry, in an office setting.

What is CLIA? The Centers for Medicare and Medicaid Services (CMS) regulates all examination of human specimens (e.g., tissue, blood, urine, tear, etc.) for diagnosis, prevention, or treatment purposes through the Clinical Laboratory Improvement Amendments (CLIA). The objective of the CLIA program is to ensure quality laboratory testing, including at the point-of-care site. CLIA certification by the U.S. Department of Health and Human Services allows physicians or medical office personnel to collect a sample and perform a laboratory test within their office.

What is a CLIA-waived test?

CLIA regulations are based on the complexity of the test method. Tests are categorized into three different complexities: waived, moderate, and high. The complexity level determines what is required to administer a particular test. For instance, waived tests, like InflammaDry, have the lowest level of complexity and can be easily performed by most medical office personnel with minimal training.

Such tests have been determined by the FDA to be so simple that there is little risk for error.

What is a CLIA Certificate of Waiver?

The CLIA Certificate of Waiver is a registration with the U.S. Department of Health and Human Services, which allows a physician or medical office personnel to collect a sample and perform a laboratory test within their office. The objective of the CLIA program is to ensure quality laboratory testing, including at the point-of-care. CLIA-waived tests require medical facilities to have a CLIA Certificate of Waiver in order to administer and receive reimbursement for using the test. Additionally, any facility that intends to receive reimbursement for Medicare or Medicaid billings must be properly certified through CLIA. A one-year post-market study found 0.18% (18 out of 10,000) of wearers developed a severe corneal infection, with 0.04% (4 out of 10,000) of wearers experiencing a permanent reduction in vision by two or more rows of letters on an eye chart. Relevant Precautions: Not everyone can wear for 30 nights. Approximately 80% of wearers can wear the lenses for extended wear. About two-thirds of wearers achieve the full 30 nights continuous wear. Side Effects: In clinical trials, approximately 3-5% of wearers experience at least one episode of infiltrative keratitis, a localized inflammation of the cornea which may be accompanied by mild to severe pain and may require the use of antibiotic eye drops for up to one week. Other less serious side effects were conjunctivitis, lid irritation or lens discomfort including dryness, mild burning or stinging. Contraindications: Contact lenses should not be worn if you have: eye infection or inflammation (redness and/or swelling); eye disease, injury or dryness that interferes with contact lens wear; systemic disease that may be affected by or impact lens wear; certain allergic conditions or using certain medications (ex. some eye medications). Additional Information: Lenses should be replaced every month. If removed before then, lenses should be cleaned and disinfected before wearing again. Always follow the eye care professional’s recommended lens wear, care and replacement schedule. Now and for the Future!

WHY NOW? Registries have been gaining importance in the medical industry over the last decade. The AOA proactively established the Quality Improvement/Registry Committee in 2010. Thorough research and development have gone into our registry. Registries have changed dramatically in the last 2 years, especially this past year! Our registry development occurred with these changes in mind as well as allowing it to be agile enough to adapt to future changes.

It is ready now to meet our needs and grow with future requirements.

CHANGES TO PQRS? PQRS has evolved over the past 2-3 years with new reporting options being introduced to facilitate quality reporting.

Now reporting options include EHR based reporting and clinical data registry reporting, in addition to traditional claims based reporting. As new reporting methods have been introduced, quality measures themselves have also changed to adapt to these new reporting methods.

CMS has a rule that requires any registry to be functioning for one full year, starting on January 1, prior to applying for qualified status. Think of this CMS requirement as a registry "practice year." CMS wants to ensure that every registry is properly working for one year before they deem it an official “qualified� registry for PQRS. With these CMS rules in mind, AOA will acclimate our doctors to AOA MORE during 2015 and beyond. While you will be able to view your PQRS dashboard metrics in AOA MORE during this time, you will officially submit your PQRS data to CMS in early 2018 for your 2017 data collected. Continue to submit on your own for patients you see in 2015 and 2016.

In addition to the traditional clinical quality measures with simple numerators and denominators, over the past few years more complicated electronic clinical quality measures (eCQMs) were developed to pull data directly from electronic records without much additional work on the part of the physician. CMS has long indicated their intention to ultimately phase out claims based reporting in favor of EHR and registry based reporting. Optometrists will need to be ready when this change occurs.

AOA MORE is launching at the right moment to capture the changes and bring you the most up to date platforms in a manner that now lets us evolve and change as needed.

What is the timeline for AOA MORE PQRS submission?

Your 2017 PQRS data will be the first time AOA MORE is able to submit to CMS on your behalf (reported by the end of February 2018). This means that even though you will be using AOA MORE during 2015 and 2016, you will still need to submit your own PQRS data (either claims-based or EHR-based) during 2015 and 2016.

Continued from Page 1 What are we doing about it? A group of ten new ODs from across the state have agreed to assist NYSOA in exploring the reasons for this decline in new graduate membership and also help us to work on solutions.

3. Technology/Communications – Dr. Sorkin is taking the lead on this new committee to improve NYSOA’s ability, and speed, of communicating with the membership. We are looking at texting options (for those who are interested), improving our Facebook page, etc. This group will also keep up to date on emerging forms of technology, such as online refractions, kiosks, etc. so that we understand their impact on our profession and also determine the best strategy to deal with them. For more information, check out Dr. Sorkin’s article on page 16.

4. Meetings – We continue to represent the NYSOA at key national meetings. Several of the board members attended the recent AOA Optometry’s meeting in Seattle.

Highlights from the meeting included election of new AOA officers and Trustees. Congratulations to NY’s own Andrea Thau, who assumed the position of President Elect for AOA. AOA also unveiled their MORE registry during the meeting. This is a free benefit for AOA members but

will cost non-members $1800. Further information can be found in this issue or at aoa.org/MORE, additionally your Trustees will present information at one of your society meetings to discuss the registry’s benefits.

The Center for Disease Control and Prevention (CDC) presented to the AOA House of Delegates about their Contact Lens Health Week Initiative which is being held from August 24-28, 2015. CDC is helping to spread the word about healthy contact lens wear and care. Continued from Page 7 Keep in mind that AOA MORE is using eCQMs to tabulate PQRS. This is a different source than the more traditional standards of “claims-based” PQRS (doctor self-reported) and “EHR-based” PQRS (EHR reports). That means that the numbers you see in your AOA MORE dashboard may vary from reports you get from your own tracking or reports that you receive from your EHR. CMS is emphasizing eCQMs as the best standard for reporting. This is why AOA MORE is built upon eCQMs! But, ODs must wait until the 2017 reporting year (see reasons above) before we can allow AOA MORE to report for us. Continue to submit your 2015 and 2016 PQRS on your own.

What happens in 2016?

Starting in January 2016, AOA MORE will collect your PQRS data for one full year (the CMS "practice year").

This means in 2016 PQRS data will be sent to AOA MORE (automatically done through your EHR integration) and you will also send your PQRS data to CMS by traditional claims-based or EHR-based reporting.

Sending your 2016 PQRS data through AOA MORE allows us to become a qualified data registry with CMS. Also, sending your 2016 PQRS data through traditional claims-based or EHR-based reporting will get you qualified to avoid payment penalties.

Beginning in January 2017, we expect to be a CMS-qualified registry and submit your 2017 PQRS data (submission for 2017 data occurs in the first quarter of 2018).

After January 1, 2017, as long as you are using AOA MORE and submitting your data to AOA MORE, you will no longer need to do extra written codes (i.e., 2027F, 2019F, etc.)—MORE will do it for you and you will no longer have to report through your EHR system! You will be required to formally “agree to submit” this data to PQRS when it’s time to do so, as that too is a requirement of CMS. AOA will notify doctors when it’s time to report and remind all AOA MORE users of the deadlines.

WHAT CAN I EXPECT IN THE FUTURE? Will MORE continue to evolve? You bet! What you see in June will be expanded in 2 months, and 2 months after that. MORE will continue to advance with changes and additions based on regulations AND your feedback as to what you want and deserve in your registry.

Starting with the right platforms allows us to do that – launching now allows us to add so much more to the registry for you.

Counsel’s Corner Vision Plan Discounts on Non-Covered Services

James W. Lytle - NYSOA Legal and Legislative Counsel, Manatt, Phelps & Phillips, LLP For some time, we have been examining issues related to the practice of vision plans that require participating providers to offer discounts on services and products that the vision plans do not actually cover. Plans have, for example, sought to require participating providers to offer deep discounts on additional pair of glasses, cleaning cloths, sunglasses, eyeglass chains, colored contact lenses, contact lens solution and laser vision correction procedures - even though the plan does not otherwise provide any actual coverage or otherwise reimburse the optometrist for these discounted items and services.

Last year, following prior meetings with the insurance regulatory agency, the Department of Financial Services (DFS), we prepared the attached letter setting forth our concerns over these practices and our interpretation that the practice was not consistent with New York State law. After using EyeMed policies as an example of this practice, we explained why coercing providers to offer discounts on products that the plan doesn’t cover violated the New York State Insurance Law prohibitions on offering “inducements” to encourage purchase of insurance.

Although DFS’ response to our inquiry earlier this year was neither as definitive nor as timely as we might have wished, we continued to believe that these discount policies are not enforceable in New York State—a position with which the New York State Dental Association concurs. Accordingly, even in the absence of any definitive ruling by DFS, we would continue to advise NYSOA members that vision plans may not legally require participating optometrists to offer their patients discounts on products not otherwise covered by the plan.

In the event that any vision plan may seek to compel a member of the NYSOA to offer discounts on non-covered services, we would be prepared to defend the NYSOA member in any legal action that may arise relating to this practice.

Communication and Technology The Art and Science of Staying In Touch

Sorkin, O.D., FAAO - NYSOA Vice President Chair of the Communications and Technology Committee The strength and success of a professional organization can be measured in a multitude of ways, not the least of which is the cohesiveness of its membership and the ability of its leadership to represent them. The key to all of this is communication.

Although by most standards, NYSOA is not a very large organization – a little over a thousand members.

This, however, does not alleviate the challenges of keeping its membership well informed in all matters that affect the governance of our profession in New York State. In addition to the regular updates regarding legislative issues and legal challenges affecting our medical standing there’s always ongoing news regarding insurance parity, local Society happenings, continuing education meetings, membership drives, dues payments, national AOA issues etc. etc.

an organization such as ours. At last tally, 43% of our membership is 56 years of age or older which means that they were introduced to this new paradigm after the age of 40. While many have embraced it (some just as obsessed with Facebook as their “kids”), a significant portion have not, leaving them in a state of a communications blackout and potential disenfranchisement. Not a good place for an organization to be when membership numbers are on the downturn.

A similar phenomenon is taking place with technology in general. I used to feel pretty comfortable tinkering under the hood of my car. Not so much now.

In the not so distant past, there were three ways to communicate with members - faceto-face meetings, phone calls and the traditional written form like direct mailings and newsletters. With the immediacy of today’s world, that just doesn’t cut it. The options for staying digitally interconnected have developed rapidly and seem to be evolving just as quickly. While e-mail and cellular technology provide us with faster methods of communication, it also presents some potential pitfalls like information overload, security breeches, lost transmissions like spam folders and deleted texts. It also has raised the expectations for response times immeasurably. Just watch any teen or 20-something receive a text and TRY not to respond. If you’re involved with social media, you’ve experienced the angst or even the downright outrage when your “friends” do not “Like” or comment on your post quick enough or, heaven forbid, AT ALL!!

P ROS P ECTUS | V OL 41 | ISSUE 2 | 2015 Continued from Page 17 Many practitioners out there have never used an auto-refractor, rather choosing to have a draw full of spare bulbs and batteries for their retinoscopes. Keratometer mires are still being twisted into alignment instead of booting up a computerized topographer. And many of you are still hand writing your chart notes... you know who you are. So what’s the problem? The world and the state-of-the-art optometric practice will continue to press forward and, like it or not, it will advance the standard of care which everyone of us will be expected to stay abreast of.

It is for these reasons, and the countless others I haven’t conceived of, that the Communications and Technology Committee has been formed and which I’ll be chairing this year. Innovating new and efficient ways to keep NYSOA members informed and engaged, is the main charge of this committee. Another important aspect will be to develop and maintain an ongoing presence in public media - both electronic and traditional. We will also stay as current as possible with all the new technologies and their impact on today’s optometric practitioner. On an ongoing basis, this important information will be sorted through, summarized and disseminated to our members.

Here are some specifics as to the role of this Committee and its goals for the upcoming year: 1. Improved communication with members Better, more timely yet non-obtrusive methods to get vital information to our members is key. We will review all of our current forms of communication (including email, eblasts, Prospectus, NYSOA website, snail mail, face-to-face local society meetings, etc.) and figure out what works, doesn’t work, what we should work on to improve and what we should abandon.

We will explore how to implement newer, more immediate forms of communicating such as texting and social media - both conventional computing and mobile devices - creating and updating our Facebook, Twitter, Instagram, etc. pages. We will utilize AOA’s public relations resources and expertise in conventional media coverage like newspaper and television interviews.

The committee will need to be cognizant of the changing demographics of the Association as the ratios of active members shifts from older to younger and male to female. Even the mode of practice (solo vs group, owner vs employed, urban vs sub-urban vs rural, clinical vs research vs academic) will factor in to how we reach out and maintain contact with members.

Optometry students, from 1st to 4th yr and residency, will be a vital link in helping them stay in touch with us, get involved and transition from student member to full member doctor.

2. Monitoring new technology The goal of the Committee is to utilize technology to improve communication to our membership and to the public as summarized above. In addition, we will be monitoring the ophthalmic, medical, information and office technology landscape to stay on top of (and maybe get ahead of ) the challenges that can potentially affect our profession, both positively and negatively.

Our ultimate goal is to foster a better informed, more engaged membership. By improving communication, we not only demonstrate the value of organized optometry but also sow the seeds for its future leaders and gaining potential new members.
